घोजित ककया र्या िा। क्षत्रे वन्यजीव संरक्षण जवभार्, जम्मू और कश्मीर सरकार के प्रशासजनक जनयंत्रण के अंतर्तग ह ै और राजौरी में वन्यजीव संभार् राजौरी-पछुं मुख्यालय के पयगवेक्षण के अंतर्तग ह।ै और, संरजक्षत क्षत्रे का जलग्रहण क्षत्रे जम्मू प्रांत की प्रजसद्ध पछुं नदी के स्त्रोत के अलावा, संरजक्षत क्षत्रे के अंतर्गत आन े वाल े दजगनों ग्रामों के जलए पेयजल और ससंचाई के जल का स्त्रोत ह।ै और, ररज़वग और पूवी भार् की ओर हीरापुर वन्यजीव अभयारण्य के साि जनकटथि सीमा के कारण पाररजथिजतकी संवेदी जोन का शून्य जवथतार ह।ै (2) टाटा कुट्टी वन्यजीव अभयारण्य और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण अनलु ग्नक-I के रूप म ें संलग्न ह।ै (3) सीमा जववरण और अक्षाशं ों और िेिांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांककत करत े हुए वन्यजीव अभयारण्य के मानजचत्र अनलु ग्नक–IIक, अनलु ग्नक –IIख, अनलु ग्नक –IIर् और अनलु ग्नक –IIघ के रूप में सलं ग्न ह।ै (4) पाररजस्ट्थजतकी संवेिी िोन और टाटा कुट्टी वन्यजीव अभयारण्य की सीमा के भू- जनदेशांकों की सूची अनलु ग्नक-III की सारणी क और सारणी ख म ें दी र्ई ह।ै (5) मुख्य सबंदओंु के भू-जनदेशांकों के साि पाररजथिजतकी संवेदी जोन के अंतर्गत आन े वाल े ग्रामों की सूची अनलु ग्नक IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी संविे ी िोन के जलए आचं जलक महार्ोिना.–(1) केंर्द् शाजसत प्रदेश सरकार, द्वारा पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिन के जलए, रािपत्र म ें अंजतम अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए अनबु ंधों का पालन करते हुए, केंर्द् शाजसत प्रदेश सरकार के सक्षम प्राजधकारी के अनुमोिनाथा एक आंचजलक महार्ोिना बनाई िार्ेगी। (2) केंर्द् शाजसत प्रदेश सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप तथा केंरीर् सरकार द्वारा िारी दििा जनिेिों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को िाजमल करन े के जलए इसे केंर्द् शाजसत प्रदेश सरकार के जनम्नजलजखत जवभागों के परामि ासे बनार्ा िाएगा, अथाात:्- (i) पर्ाावरण। (ii) वन और वन्द्र्िीव संरक्षण जवभाग, िम्मू और कश्मीर। (iii) िम्मू और कश्मीर प्रदिू ण जनर्ंत्रण बोडा। (iv) आवास और िहरी जवकास जवभाग। (v) पर्ाटन जवभाग। (vi) ग्रामीण जवकास जवभाग। (vii) ससंचाई और बाढ़ जनर्ंत्रण जवभाग। (viii) सावािजनक जनमााण और जबिली जवकास जवभाग। (ix) रािस्ट्व जवभाग। (x) आपिा प्रबधं न।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (xi) कृजि जवभाग। (xii) भे़ि और पिुपालन जवभाग। (xiii) बार्वानी जवभार्। (xiv) नर्र जनर्म, पछुं । (xv) शहर योजना जवभाग, पुंछ। (4) िब तक इस अजधसूचना में जवजनर्िष्टा न हो, आंचजलक महार्ोिना में वतामान में अनमु ोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और मौजूदा और प्रस्ट्ताजवत भू-उपर्ोग की जविेिताओं का ब्र्ौरा भी दिर्ा िाएंगा। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी में र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध एव ं जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनजश्चर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभ ा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके । 3. केंर्द् शाजसत प्रदेश सरकार द्वारा दकए िान े वाल े उपार्.- केंर्द् शाजसत प्रदेश सरकार इस अजधसूचना के उपबंधों को प्रभावी बनान े के जलए जनम्नजलजखत उपार् करेगी, अथाात:् - (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं दकर्ा िाएगा: परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर ऊपर भाग (क), में जवजनर्िष्टा प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजि और अन्द्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लागू केन्द्रीर् सरकार एवं केंर्द् शाजसत प्रदेश सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करन े के जलए अनुमत दकर्ा िाएगा िैस:े - (i) जवद्यमान स़िकों को चौ़िा करना, उन्द्ह ेंसुिढ़ृ करना और नई स़िकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करने वाल े लघ ुउद्योग; (iv) कुटीर उद्योग एवं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाए ं तथा र्हृ वास; और (v) पैराग्राफ-4 में उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना तथा केंर्द् शाजसत प्रदेश सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपु ालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा: परंत ु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात,् केंर्द् शाजसत प्रदेश सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारन ेकी सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े म,ें इस उप-पैरा में र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू- उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनप्रु र्क्तु र्ा अनुत् पािक कृजि क्षेत्रों म ें वनीकरण तथा पर्ावा ासों की बहाली के कायगकलापों स े पुन: वनीकरण के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और केंर्द् शाजसत प्रदेश सरकार द्वारा कदशा-जनदेश इस रीजत स े तैयार ककए जाएंर्े दक उसमें ऐसे क्षेत्रों म ेंया उसके पास जवकास दक्रर्ाकलापों को प्रजतजिद्ध और जनबंजधत दकर्ा गर्ा हो। (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंिी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना केंर्द् शाजसत प्रदेश सरकार के पर्ाावरण और वन जवभाग के परामि ा से पर्ाटन केंर्द् शाजसत प्रदेश जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:्- (i) संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुमत नहीं दकर्ा िाएगाः परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजित और अभीजहत क्षेत्रों में पर्टा न महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्टा न दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था सिं ोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्टा न दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होटल/ ररिॉट ा र्ा वाजणजज्र्क प्रजतष्ठान का जनमागण अनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्त्रं ण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण की रोकिाम और जनर्ंत्रण ककया जाएर्ा । (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रििू ण का जनवारण और जनर्ंत्रण, वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनथसरण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाल े पर्ाावरणीर् प्रििू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा केंर्द् शाजसत प्रदेश सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। अकाबाजनक पिाथथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स ेबाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत दकर्ा िार्ेगा। (10) िैव जचदकत्सा अपजशष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प जैव जचककत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) स़िक-र्ातार्ात.- स़िक-र्ातार्ात को पर्ाावास-अनकु ूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना में जवििे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होन े और केंर्द् शाजसत प्रदेश सरकार के सक्षम प्राजधकारी स े अनुमोदित होने तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एवं जवजनर्मों के अनुसार स़िक-र्ातार्ात के अनुपालन की जनगरानी करेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (15) वाहन िजनत प्रििू ण.- वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगं े। (16) औद्योजगक ईकाइर्ा.ं- (क) सरकारी रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख को र्ा उसके बाि पाररजस्ट्थजतकी संवेिी िोन म ेंदकसी नए प्रििू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं होगी। (ख) जब तक कक अजिसूचना में इस प्रकार जवजनर्दष्टग न हो, केन्र्द्ीय प्रदिू ण जनयंत्रण बोडग द्वारा फरवरी, 2016 म ें जारी समर्-समर् पर संिोजधत मार्दग शगक जसद्धान्तों म ें उद्योर्ों के वर्ीकरण के अनुसार, पाररजथिजतकी संवेदी जोन के भीतर केवल र्ैर-प्रदिू णकारी उद्योर्ों को अनुज्ञात ककया जाएर्ा और इसके अजतररक्त, र्ैर प्रदिू णकारी उद्योर्ों को बढ़ावा कदया जाएर्ा। (17) पहा़िी ढ़लानों का सरं क्षण.- पहा़िी ढ़लानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहा़िी ढ़लानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी संजनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढ़लानों र्ा जवद्यमान ख़िी संरचनाओं के स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो की नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करन े की अनुज्ञा होगी । 10. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन 436(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals Wildlife Sanctuary is spread over an area of 116.70 square kilometers and is located at about 82 kilometers from Poonch district headquarters in Surankote Tehsil, District Poonch, Jammu & Kashmir. The Sanctuary is adjacent to the Hirpora Wildlife Sanctuary bifurcated by water partition line of Peer Panjal Hills. AND WHEREAS, the Tata Kutti Wildlife Sanctuary is an amalgam of erstwhile three game reserves namely Tata Kutti Wildlife Reserve, Kalakund Tata Kutti Wildlife Reserve and Wildlife Reserve Kalamund Tata Kutti, a famous hunting place at the time of Maharaja with an area of 50.4365 square kilometers and additional forest area of 66.27 square kilometers of the demarcated forests of Bharam Galla, Marha, Gundi and Mandi Blocks of Poonch Forest Division. AND WHEREAS, the Tata Kutti Wildlife Sanctuary was declared as a Wildlife Sanctuary vide notification number SRO 47 dated 30thJanuary 2013 in lieu of denotification of Trikuta (Vaishno Devi) Wildlife Sanctuary with an area of 31.40 square kilometers under erstwhile Jammu and Kashmir Wildlife Act, 1978. The area is under the administrative control of the Wildlife Protection Department, Jammu and Kashmir Government and under the supervision of Wildlife Division Rajouri-Poonch headquarter at Rajouri. AND WHEREAS, the catchments of the protected area are source of drinking and irrigation water to dozens of villages falling down stream to the protected area, besides feeding source to the famous River Poonch of Jammu Province. AND WHEREAS, the protected area is a treasure house of rich faunal and floral assemblage and is specifically valued for presence of two species including genetically threatened red jungle fowl (Gallus gallus) and one species of goral (Nemorhaedus goral).The recorded species from the Tata Kutti Wildlife Sanctuary include 34 species of plants, 16 species of mammals and more than 112 species of birds. AND WHEREAS, the Tata Kutti Wildlife Sanctuary consists of Moist Kail Forest, Western Mixed Coniferous Forest, Moist Temperate Deciduous Forest, Low level Blue Pine Forest, West Himalayan upper Oak-Fir Forest, Chilgoza Pine Forest, Parrotia (Pohu) Scrub Forest, West Himalayan High level Dry Blue Pine Forest, West Himalayan sub-alpine Birch/Fir Forest, Sub-alpine Pastures, Birch/Rhododendron Scrub Forest and Alpine Pastures. The Sanctuary harbors the broad-leaved species like acer, walnut (Juglans regia), horse chestnut (Aesculus indica), oak, Vibernum spp., Rosa moschata, Parrotia spp, Betula utilis etc. The area supports a vast diversity of very important medicinal plants like Saussurea lappa, Diascoria spp, Podophyllum spp, Belladona spp, Bergenia spp, Skimmea spp, Piccorhiza spp, Aconitum spp etc. AND WHEREAS, the Tata Kutti wildlife sanctuary is probably the only protected wildlife area in Jammu region which represents the threatened and vulnerable species such as Markhor or screw horn goat (Capra falconeri), snow leopard (Panthera uncial), Himalayan black bear (Ursus thibetanus), Goral goat[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 (Naemorhedus goral), musk deer (Moschus moschiferus), Himalayan grey langur (Semnopithecus ajax) etc. all together. Other significant faunal species present in the area are leopard (Panthera pardus), common Langur (Presbytis entellus), stone marten (Martes foina), Himalayan yellow throated marten (Martes flavigula), jungle cat (Felis chaus), Himalayan mouse hare (Ochotona roylei), Himalayan marmot (Marmot bobak), Long tailed marmot (Marmota caudate), jackal (Canis aureus), red fox (Vulpes vulpes), Alpine ibex (Capra ibex)etc. AND WHEREAS, the threatened and vulnerable avi-faunal species present in the area are Western tragopan (Tragopan Melanocephalus), Himalayan griffon vulture (Gyps himalayensis), bearded vulture (Gypaetus barbatus), Kashmir flycatcher (Ficedula subrubra), Himalayan monal (Lophophorus impejanus), golden eagle (Aquila chrysaetos), snow partridge (Lerwa lerwa) and cheer pheasants (Catreus wallichi). Other important important avi-faunal species present in the area are snow pigeon (Columba leuconota), Kashmir nuthatch (Sitta cashmirensis), Himalayan swiftlet (Aerodramus brevirostris), Himalayan pied wood-pecker (Dendrocopos himalayensis), wryneck (Jynx torquilla), alpine accentor (Prunella collaris), plumbeous water-redstart (Rhyacornis fuliginosa), long-eared owl (Asio otus), duskey crag-martin (Ptyonoprogne concolor) etc. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Tata Kutti Wildlife Sanctuary which are specified in paragraph 1 as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero (0) to 3.98 kilometers around the boundary of Tata Kutti Wildlife Sanctuary, in Pooch District in the Union Territory of Jammu and Kashmir as the Tata Kutti Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: Extent and boundaries of Eco-Sensitive Zone. – (1)The Eco-Sensitive Zone shall be of 67.456 square kilometres with an extent of zero (0) to 3.98 kilometres around the boundary of Tata Kutti Wildlife Sanctuary. The zero extent of the Eco-sensitive zone is due to contiguous border with Hirpora Wildlife sanctuary towards the Eastern side and Kulian Conservation Reserve towards North-Western side of the Wildlife Sanctuary. (2) The boundary description of Tata Kutti Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB, Annexure-IIC and Annexure-IID (4) Lists of geo co-ordinates of the boundary of Tata Kutti Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The Union Territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the Union Territory. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union Territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union Territory laws and the guidelines issued by the Central Government, if any.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union Territory Government, for integrating the ecological and environmental considerations into the said plan:- i) Environment. ii) Forests and Wildlife Protection Department, Jammu and Kashmir iii) Jammu and Kashmir Pollution Control Board. iv) Housing and Urban Development Department. v) Tourism Department. vi) Rural Development Department. vii) Irrigation and Flood Control Department. viii) Public Works and Power Development Department. ix) Revenue Department. x) Disaster Management. xi) Agriculture Department. xii) Sheep and Animal Husbandry Department. xiii) Horticulture Department. xiv) Municipal Corporation, Poonch. xv) Department of Town Planning, Poonch (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the Union Territory Government. -The Union Territory Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 Territory Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union Territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union Territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union Territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco- sensitive Zone. (b) The Tourism Master Plan shall be prepared by the Union Territory Department of Tourism in consultation with the Union Territory Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco- sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco- tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union Territory Government, whichever is more stringent. (9) Solid wastes.-Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union Territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Setting of industries causing New industries and expansion of existing polluting industries pollution (Water, Air, Soil, in the Eco-Sensitive Zone shall not be permitted: Noise, etc.). Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the Union Territory Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the Union Territory as per performa appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures.- The Central Government and Union Territory Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
