(सरं (cid:29)ण) अिधिनयम, 1986 (1986 का 29) क(cid:30) धारा 3 क(cid:30) उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप-
धारा (3) "ारा (cid:15)द# शि%य& का (cid:15)योग करत े)ए, गुजरात रा]य म; पोरबंदर प(cid:29)ी अC यारDय क(cid:30) सीमा के 0 से 25 मीटर तक

राजप1 म ; इस अिधसूचना के (cid:15)काशन क(cid:30) तारीख से दो वष(cid:24) क(cid:30) अविध के भीतर, +थानीय :ि%य& के परामश (cid:24) से, इस
अिधसूचना म; संलdन अनुबंध& के सामंज+य स ेआंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा]य सरकार के स(cid:29)म (cid:15)ािधकारी "ारा अनमु ो(cid:1)दत होगी ।
(3) रा]य सरकार "ारा पा रि+थितक(cid:30) संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित जो इस अिधसूचना म ;
िविन@दf(cid:24) ट ह ै तथा सुसंगत क;(cid:22)ीय और रा]य िविधय& के अनaु प और क;(cid:22)ीय सरकार "ारा जारी माग(cid:24)िनदश‘ &, य(cid:1)द कोई ह&,
"ारा तैयार होगी ।
(4) आंचिलक महायोजना, पया(cid:24)वरणीय और पा रि+थितक संबधी बात& का समाकिलत करने के िलए रा] य सरकार के
सभी संब? िवभाग& के परामश (cid:24)स ेतैयार होगी, अथा(cid:24)त:्--
(i) पया(cid:24)वरण;
(ii) वन और व(cid:21)यजीव;
(iii) कृिष ;
(iv) राज+व ;
(v) शहरी िवकास;
(vi) पय(cid:24)टन;
(vii) iामीण िवकास;
(viii) Qसंचाई और बाढ़ िनयं1ण;
(ix) नगरपािलक;
(x) पंचायती राज;
(xi) लोक िन मा(cid:24)ण िवभ ाग।
(5) आंचिलक महायोजना अनमु ो(cid:1)दत िवYमान भ-ू उपयोग, अवसरं चना और (cid:1)Vयाकलाप& पर कोई िनबधj न अिधरोिपत
नहk करेगी जब तक (cid:1)क इस अिधसूचना म ; इस (cid:15)कार िविन@दf(cid:24) ट न हो और आचंिलक महायोजना सभी अवसरं चना और
(cid:1)Vयाकलाप& म; और अिधक द(cid:29)ता और पा रि+थितक(cid:30) अनकु ूलता का संवधन(cid:24) करेगी ।
(6) आंचिलक महायोजना म ;अनाlछा(cid:1)दत (cid:29)े1& के जीणO?ार, िवYमान जल िनकाय& के संर(cid:29)ण, आवाह (cid:29)े1& के (cid:15)बंधन,
जल-सभं र& के (cid:15)बंधन, भूतल जल के (cid:15)बंधन, मदृ ा और नमी सरं (cid:29)ण, +थानीय समुदाय& क(cid:30) आव[यकताc तथा पा रि+थितक(cid:30)
और पया(cid:24)वरण से संबंिधत ऐस ेअ(cid:21)य पहलcु , िजन पर nयान दने े क(cid:30) आव[यकता ह,ै के िलए उपबंध ह&गे ।
(7) आंचिलक महायोजना सभी िवYमान पूजा + थल&, iाम& और नगरीय बंदोब+त&, वन& के (cid:15)कार और (cid:1)क+म &, जन
जातीय (cid:29)े1 कृिष (cid:29)े1&, ऊपजाऊ भिू म, ह रत (cid:29)े1 जसै े उYान और उसी (cid:15)कार के +थ ान, उYान कृिष (cid:29)े1, फलोउYान, झील&¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
और अ(cid:21)य जल िनकाय& का अCयकंन करेगी और इस योजना के साथ मानिच1 लगे ह&गे िजनम ; िवYमान और (cid:15)+तािवत भिू म
के उपयोग क(cid:30) िवशेषताc के 2यौरे ह&ग े।
(8) आंचिलक महायोजना +थ ानीय समुदाय& क(cid:30) आजीिवका क(cid:30) सरु (cid:29)ा के िलए, पा रि+थितक(cid:30) सवं ेदी जोन म ;िवकास को
पा रि+थितक(cid:30) अनकु ूल िवकास के िलए िविनयिमत करेगी और अिधसूचना म; िविन@द(cid:24)= (cid:15)ितिष?, िविनयम और संव<ध(cid:24)त
(cid:1)Vयाकलाप& का अनसु रण करेगी।
(9) आंचिलक महायोजना इस अंितम अिधसूचना म; (cid:1)दए गए उपबंध& के अनुसरण म; अपने कायr के बाहर ले जाने के िलए
मानीटरी सिमित के िलए एक संदभ(cid:24) द+तावेज तैयार करेगी ।

(cid:1)कए गए पाकr और खुले +थान& का वािणि]यक और औYोिगक संब? िवकास (cid:1)Vयाकलाप& के िलए उपयोग या संप रवतन(cid:24)
नहk होगा:
परंत ु पा रि+थितक(cid:30) संवेदी जोन के भीतर कृिष भूिम का संप रवतन(cid:24) , मानीटरी सिमित क(cid:30) िसफा रश पर और रा]य
सरकार के पूव(cid:24) अनमु ोदन से, +थानीय िनवािसय& क(cid:30) आवासीय ज(cid:17)रत& को पूरा करन ेके िलए और पैरा 4 क(cid:30) सारणी के +तंभ
(2) के अधीन सूचीब? (cid:1)Vयाकलाप& को पूरा करन ेके िलए अनुsात ह&गे, अथात(cid:24) ्:-
(i) िवYमान सड़क& को चौड़ा करना और उ(cid:21)ह ;सुदढृ करना और नई सड़क& का संिनमाण(cid:24) ;
(ii) (cid:15)दषू ण उuपv न करन ेवाल ेलघ ुउYोग;
(iii) वषा (cid:24)जल संचयन;
(iv) कुटीर उYोग, िजसके अंतग(cid:24)त iामीण उYोग, सुिवधा भडं ार और +थानीय सुिवधाए ंसि(cid:9)मिलत ह 5:
परंत ु यह और (cid:1)क रा]य सरकार के पूव(cid:24) अनुमोदन तथा संिवधान के अनlु छेद 244 और तuसमय (cid:15)वृ# िविध के
उपबंध& के अनुपालन के िबना, िजसके अंतग(cid:24)त अनुसिू चत जनजाित और अ(cid:21)य परंपरागत वन िनवासी (वन अिधकार& क(cid:30)
मा(cid:21)यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि]यक और उYोिगक िवकास (cid:1)Vयाकलाप& के िलए जनजातीय भूिम
का उपयोग अनुsात नहk होगा:
परंत ु यह भी (cid:1)क पा रि+थितक(cid:30) संवेदी जोन के भीतर भ-ू अिभलेख& म ; (cid:15)कट होन े वाली कोई 1ु ट, मानीटरी सिमित के
िवचार (cid:15)ा7 करन ेके प8ात ्रा]य सरकार "ारा (cid:15)uयेक मामल ेम ;एक बार संशोिधत होगी और उ% 1ु ट के संशोधन क(cid:30) सूचना
क;(cid:22)ीय सरकार के पया(cid:24)वरण, वन और जलवाय ुप रवत(cid:24)न मं1ालय को दने ी होगी :
परंत ुयह भी (cid:1)क उपयु(cid:24)% 1ु ट के संशोधन म ; इस उप-पैरा के अधीन यथा-उपबंिधत के िसवाय (cid:1)कसी भी दशा म ; भ-ू उपयोग
का प रवत(cid:24)न सि(cid:9)मिलत नहk होगा :

उनके सरं (cid:29)ण और पुनazभूतकरण के िलए योजना सि(cid:9) मिलत होगी और रा] य सरकार "ारा जल आवाह (cid:29)े1& म; िवकास
(cid:1)Vयाकलाप (cid:15)ितिष? और िनबjिधत करने के िलए ऐसी रीित स ेजल आवाह (cid:15)बंधन योजना के माग(cid:24)िनदश‘ तैयार (cid:1)कए जाएंगे ।
((((3333)))) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन –––– (क) पा रि+थितक(cid:30) संवेदी जोन के भीतर पय(cid:24)टन संबंधी (cid:1)Vयाकलाप पा रि+थितक(cid:30) पय(cid:24)टन महायोजना के
अनसु ार ह&गे जो (cid:1)क आंचिलक महायोजना के भाग (cid:17)प म ;होगी ।
(ख) पयट(cid:24) न िवभाग, गुजरात रा]य सरकार "ारा राज+व और वन िवभाग, गुजरात रा] य सरकार के परामश(cid:24) स े तैयार क(cid:30)
जाएगी।
(ग) पय(cid:24)टन संबंधी (cid:1)Vयाकलाप िन(cid:9)न िलिखत के अधीन िविनयिमत ह&ग,े अथा(cid:24)त ्
(i) पा रि+थितक(cid:30) अनुकूल पयट(cid:24) न (cid:1)Vयाकलाप से संबंिधत पय(cid:24)टक& के अ+थायी अिधभोग के िलए वास सिु वधा के
िसवाय पोरबंदर प(cid:29)ी अCय ारDय क(cid:30) सीमा स े एक (cid:1)कलोमीटर के भीतर या पा रि+थितक(cid:30) संवेदी जोन के िव+तार
तक, इनम; जो भी िनकट ह,ै होटल और रसोट(cid:24) का नया संिनमा(cid:24)ण अनुsात नहk होगा ; परंत,ु व(cid:21)यजीव अCय ारDय क(cid:30)

(ii) पा रि+थितक(cid:30) संवेदी जोन के भीतर सभी नए पय(cid:24)टन (cid:1)Vयाकलाप& या िवYमान पय(cid:24)टन (cid:1)Vयाकलाप& का िव+तार
क;(cid:22)ीय सरकार के पया(cid:24)वरण, वन और जलवायु प रवतन(cid:24) मं1ालय के माग(cid:24)दशक(cid:24) िस?ांत& के "ारा तथा पा रि+थितक(cid:30)
पय(cid:24)टन के संवध(cid:24)न के साथ राf{ ीय | या} सरं (cid:29)ण (cid:15)ािधकरण, "ारा जारी पा रि+थितक(cid:30) पय(cid:24)टन माग(cid:24)दशक(cid:24) िस?ातं &
(समय-समय पर संशोिधत) के अनसु ार, होगा;
(iii) आंचिलक महायोजना का अनमु ोदन (cid:1)कए जान े तक, पय(cid:24)टन के िलए िवकास और िवYमान पय(cid:24)टन (cid:1)Vयाकलाप&

िविनयामक (cid:15)ािधकरण& "ारा अनुsात (cid:1)कया होगा ।

िनTकष"ण के िलए संबंिधत िविनयामक 1ािधकरण पूव" िलिखत अनुAा

S.O. 3083(E).—The following draft of the notification, which the Central Government proposes to
issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby
published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the
information of the public likely to be affected thereby; and notice is hereby given that the said draft
notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on
which copies of the Gazette containing this notification are made available to the Public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period

Draft Notification
WHEREAS, the Porbandar Bird Sanctuary in the State of Gujarat is situated in the middle of the
Porbandar city and is covered on all sides by the human population and has an extent of 9.33 hectare;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
AND WHEREAS, the said Bird Sanctuary supports more than 75 species of birds and 14 species of
flora;
AND WHEREAS, the aforesaid sanctuary supports many migratory, local migratory and resident
bird species such as flamingoes, spotted duck, cormorants, painted storks, adjutant storks, shoveller, common
crane, egrets and spoonbills;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which
are specified in paragraph 1 of this notification, around the protected area of Porbandar Wildlife Sanctuary as
Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of
industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clause (v) and
clause (xiv) of sub – section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986
(29 of 1986), read with and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central
Government hereby notifies an area to an extent varying from zero to 25 meter from the boundary of
Porbandar Bird Sanctuary in the State of Gujarat, as Porbandar Bird Sanctuary Eco-sensitive Zone (after
herein referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1)The extent of Eco-sensitive Zone varies from
zero to 25 meters from the boundary of the Porbander Bird Sanctuary and the area of the Eco- sensitive Zone
is 0.0124 square kilometer.
(2) The map of Porbander Bird Sanctuary demarcating the Eco-sensitive Zone along with the geo co-
ordinates is appended as Annexure I and Annexure I-A .
(3) The list of habitation falling within the Eco-sensitive Zone along with geo coordinates of the prominent
points is appended as Annexure II.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the
Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of
the final notification in the Official Gazette, in consultation with local people and adhering to the stipulations
given in that notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such
manner as specified in the final notification and also in consonance with the relevant Central and State laws
and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and flood control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department,

(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure
and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of
all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water
bodies, management of catchment areas, watershed management, groundwater management, soil and moisture
conservation, needs of local community and such other aspects of the ecology and environment that need
attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements,
types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like
places, horticultural areas, orchards, lakes, wetlands and other water bodies with supporting maps and the Plan
shall be supported by maps giving details of existing and proposed land use features.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited,
regulated and promoted activities specified in the final notification so as to ensure eco-friendly development
for livelihood security of local communities.
(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its
functions in accordance the provisions of the final notification.
3. Measures to be taken by State Government.-The State Government shall take the following
measures for giving effect to the provisions of the final notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational
purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial
related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet
the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4,
namely:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) small scale industries not causing pollution;
(iii) rainwater harvesting; and
(iv) cottage industries including village industries, convenience stores and local amenities;
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of
article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other
Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of the Monitoring Committee, once in each case and the
correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest
and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be
drawn up by the State Government in such a manner as to prohibit which are detrimental such areas
development activities within the catchment areas.
(3) Tourism.-(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master
Plan, which shall form part of the Zonal Master Plan.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Gujarat in
consultation with the Department of Revenue and Forests, Government of Gujarat.
(c) The activities relating to tourism shall be regulated as under, namely.-
(i) no new construction of hotels and resorts shall be permitted within one kilometer from the boundary of the
Porbander Bird Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: provided that
beyond the distance of one kilometer from the boundary of the Wildlife Sanctuary till the extent of the Eco-
Sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and
designated areas for eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be
in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest
and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as
amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny
and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall
be identified and preserved and plan shall be drawn up for their protection and conservation, within six
months from the date of publication of this notification and such plan shall form part of the Zonal Master
Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their
conservation shall be prepared within six months from the date of publication of this notification and
incorporated in the Zonal Master Plan.
(6) Noise pollution.- The control of noise pollution in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 under the
Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or Gujarat State Pollution Control
Board shall draw up guidelines and regulation for the control of air pollution in the Eco-sensitive Zone in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and
rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance
with the provisions Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made
thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to
time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside
the Eco-sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-
sensitive Zone.
(10) Bio-medical waste.- (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as
per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India
in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the
28th March, 2016, as amended from time to time.
(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(c) Individual hospitals or private health centres already existing within the Eco Sensitive Zone shall provide
adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried
out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India
in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the
18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste
management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and
Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016,
as amended from time to time.
(13) E-waste.- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions
of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal
Master Plan is prepared and approved by the Competent Authority in the State Government, the Monitoring
Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and
regulations made thereunder.
(15) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive
zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil or noise pollution within the
proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated or promoted within Eco-sensitive Zone.- All
activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act,
1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table
below, namely:-

permission from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be
permitted.
(d) Steps shall be taken to prevent contamination or

paragraph 3 as per building byelaws to meet the
residential needs of the local residents such.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for
effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Collector, Porbandar District - Chairman;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(ii) Representative of the Department of Environment and Forests, Government of Gujarat- Member;
(iii) Regional Officer, State Pollution Control Board - Member;
(iv) One representative of Non-governmental Organisations working in the field
of nature conservation to be nominated by the Government of Gujarat (for a
term of three years in each case) - Member;
(v) Member Secretary or Member, Gujarat State Biodiversity Board - Member
(vi) One expert in Ecology and environment from reputed Institution or University
of the State of Gujarat to be nominated by the Government of Gujarat (for a
term of three years in each case) - Member;
(vii) Senior Town Planner of area -Member;
(viii) Deputy Conservator of Forests, (in-charge of the Sanctuary), Porbandar – Member Secretary.
6. Terms of reference:-
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of publication
of the final notification in the office gazette.
(2) The Monitoring Committee shall monitor the compliance of the provisions of the final notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the
notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O.
1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the
prohibited activities as specified in the Table under paragraph 4 thereof shall be scrutinized by the
Monitoring Committee based on the actual site specific condition ad referred to the Central Government in
the Ministry of Environment, Forest and Climate Change for prior environmental clearance under the
provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under
paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific
conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent
to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any
person who contravenes the provisions of the final notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March
of every year by 30th June of that year to the Chief Wild Life Warden of the State as per proforma appended
at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee, for effective discharge of its functions.
7. Additional measures:- The Central Government and State Government may specify additional measures, if
any, for giving effect to provisions of the final notification.
8. Supreme Court, etc, orders: -The provisions of notification shall be subject to the orders, if any, passed, or
to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
