(3) के साथ परित उपधारा (1) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, िारी करन े का प्रस्ट्ताव करती ह ै को पर्ाावरण (संरक्षण) जनर्मावली 1986 के जनर्म 5 के उपजनर्म (3) की अपेक्षानुसार, िनसाधारण की िानकारी के जलए प्रकाजित दकर्ा िाता ह ै जिनके उसस े प्रभाजवत होन े की संभावना ह,ै और र्ह सूजचत दकर्ा िाता ह ै दक उि प्रारूप अजधसूचना पर, उस तारीख स,े जिसको इस अजधसूचना को अंतर्वाष् ट करन े वाल े भारत के रािपत्र की प्रजतर्ां िनसाधारण को उपलब्ध करा िी िाती ह,ैं साि दिन की अवजध की समाजि पर र्ा उसके पश्च ात् जवचार दकर्ा िाएगा; ऐसा कोई व्यजि, िो प्रारूप अजधसूचना में अंतर्वाष्ट प्रस्ट्तावों के संबंध में किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान िा नाम जम्मू प्ांत िे सुप्ससद्ध और पुरान े शहर “किश्तवाड़” िे नाम पर रखा गया था जो इसिा प्वेशद्वार ह।ै यह जम्मू और िश्मीर िे किश्तवाड़ सजले म ें ग्रेट सहमालयन पववतों िे उंचे-नीच े भू-भाग म ें 2191.50 वगव किलोमीटर िे क्षेत्रफल म ें फैला हुआ ह।ै राष्ट्रीय उद्यान किश्तवाड़ शहर िे उत्तर म ें लगभग 60 किलोमीटर और जम्मू स े 230 किलोमीटर िी दरू ी पर सथथत ह।ै और, किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान असिसूचना स.ं एफ एस टी-20 िा 1981, कदनांि 4 फरवरी, 1981 द्वारा राष्ट्रीय उद्यान घोसित किया गया था। इसिा क्षेत्रफल 425 वर्ग किलोमीटर ह।ै जम्मू और िश्मीर सरिार न े किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान िी असिसूचना स.ं एस आरओ-212 कदनांि 6 जुलाई, 2015 िो पुन: असिसूसचत किया गया था सजसमें 2191.50 वगव किलोमीटर िा क्षेत्रफल शासमल ह ै। और, किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान और इसिे सनिटवती वन क्षत्रे िो इसिे थथासनि वन्यजीवों िे िारण संरक्षण िे उद्देश्य स े प्ाथसमिता दी जाती ह।ै यह क्षत्रे लुप्तप्ाय वनथपसत और जीवजंतु प्जासतयों िी व्यवहायव संख्या िो आश्रय प्दान िरता ह।ै यह िई जंगली वनथपसत और जीवजंतु प्जासतयों िे प्विवन, संरक्षण और थथायीिरण िे सलए “जीन पूल” िा प्सतसनसित्व िरता ह।ै और, किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान अत्यंत लुप्तप्ाय प्जासत हगं ुल अथवा िश्मीरी थटैग (िेरवस एलाफस हगं ुल) और िथतूरी मृग (मोसचस ् क्रेसोगेटर) िे वास िे सलए जाना जाता ह।ै यहा ं राष्ट्रीय उद्यान िे क्षेत्र में थतनिाररयों िी लगभग 25 प्जासतयां और पसक्षयों िी 200 प्जासतया ं सूसचत िी गई ह।ैं और, संरसक्षत क्षेत्र लुप्तप्ाय, दलु वभ शािाहारी और मांसाहारी पशुओं जैसे एजिर्ाई िाला भालू (उसास जथबेटानस), जहमालर्न ब्राउन भाल ू (उरसूस आिवटोस इसाबेसललनस), गोरल (नमै ोरहडेस गोरल), जहमालर्न लंगूर (सेम्नोसपथेिस अजाक्स), तेंिआु (पेन्द्थेरा प्रड्यूस), स्नो तेंदआु (पेन्थेरा उंकिया), इबेक्स(िापरा इबेक्स), सहमालयन माउस खरगोश (ओचोटोना रोयलेइ), सहमालयन मामोट (मामोट बोबाि), लााँग टेलड मामोट (मामोट िौडटे), जसर्ार (कैजनस ऑररर्स), रेड लोमड़ी (वुलपेस वुलपेस) और पक्षी प्जासतयों जैसे पजिमी रगोपैन (रगोपन मेलानोसेफेलस), मोनल (लोफोफोरूस इम्पेजानस), गोलडन ईगल (एदिला क्रार्जसटोस), स्नो तीतर (लेरवा लेरवा) और चिोर तीतर (एलेक्टोररस चोिर), सहमालयन सग्रफ्फोन सगद्ध (सजप्स सहमालयेंससस), बेअरडडे सगद्ध (सजपाइतुस बारबाटुस), िश्मीर फ्लाईिैचर (कफिेडुला सुबरूब्र) आकद िी बृहत ् संख्या िो आश्रय प्दान िरता ह।ै और, किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान िी सवशेिता इसिी थथलािृसत, जलवायु और ऊंचाई में थपष्ट सभन्नता ह।ै सजसिे पररणामथवरूप इस इस क्षेत्र में वन वनथपसत िी सवसविता होती ह।ै किबर, नांथ और कियार तीनों सवसशष्ट नालों िे सनचल े जलग्रहण क्षेत्रों में सवसवि प्जासतयों िे अनुिूल समश्रण स े उपयुक्त पहलुओं पर वन सविास होता ह।ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान में आर्द् व दवे दार वन, पसिमी समसश्रत शंिुिारी वन, आर्द् व शीतोष्ण पणवपाती वन, िम ऊंचाई िे ब्लू पाइन वन, पसिम सहमालयन ऊपरी ओि-फीर वन, चीलगोजा पाइन वन, शुष्ि दवे दार वन, परोरटया (पोहू) झाड़ी वन, पसिम सहमालयन उच्च थतर शुष्ि ब्लू पाइन वन, पसिम सहमालयन उप- अलपाइन ब्रीच/फीर वन, उप-अलपाइन चरागाह, ब्रीच/ रहोडोडड्रैं ोन झाड़ी वन, अलपाइन चरागाह ह।ैं उच्च ऊंचाई और अच्छी नमी िे िारण, दवे दार-िैल वन में फीर वन प्मुख ह।ैं बृहत पत्ती वाली प्जासतयां नालों िे किनारे और अपेक्षािृत ठंड े और नमथथलों ति ही सीसमत ह।ैं परोरटया भी पैचों में होता ह।ै इस क्षेत्र में महत्त्वपूणव औििीय पौिों जैस े सोथसुरेया लाप्पा, डायथिोररया एसपीपी, पोडोफयललुम एसपीपी, बेललाडोना एसपीपी, बेरसगसनया एसपीपी, सथिम्मेया एसपीपी, सपक्कोरसहजा एसपीपी और एिोसनतुम एसपीपी आकद िी बड़ी सवसविता भी ह।ै और, राष्ट्रीय उद्यान िा जलग्रहण क्षेत्र जम्म ू प्ांत िी प्ससद्ध चेनाब नदी िे स्त्रोत िे अलावा, संरसक्षत क्षेत्र िे अंतगवत आन े वाल े दजवनों ग्रामों िे सलए पेयजल और ससंचाई िे जल िा स्त्रोत ह।ै और, किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाए ं इस अजधसूचना के पैराग्राफ 1 में जवजनर्िष्टा ह,ैं पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृ ष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और सरं जक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजष्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस असिसूचना में इसके पिात ् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1)तथा धारा 3 की उपधारा (2) िे खंड (v) और खंड (xiv) एवं उपधारा (3) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, जम्मू और िश्मीर िेंर्द् शाससत प्दशे िे किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान की सीमा के चारों ओर 547.09 वगव किलोमीटर िे, 507.55 मीटर से 10.106 किलोमीटर तक जवस्ट्ताररत, क्षेत्र को किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान िे पाररजस्ट्थजतकी संवेिी िोन (जिस े इसमें इसके पश्च ात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात् :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी िोन 547.09 वगव किलोमीटर का ह।ै यह किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान िी सीमा िे चारो ओर 507.55 मीटर से 10.106 किलोमीटर ति सवथतृत ह।ै (2) किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान और इसिे पाररजस्ट्थजतकी संवेिी िोन की सीमा का सववरण अनलु ग्नि-I के रूप में संलग्न ह।ै (3) सीमा जववरण और अक्षाशं ों और ििे ांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन िो सीमांकित करत े हुए राष्ट्रीय उद्यान िे मानजचत्र अनलु ग्नि –IIि, अनलु ग्नि –IIख और अनलु ग्नि –IIग के रूप में संलग्न ह।ै (4) किश्तवाड़ उच्च ऊंचाई राष्ट्रीय उद्यान और पाररजस्ट्थजतकी संवेिी िोन िी सीमा िे भू- सनदशे ांिों िी सूची अनलु ग्नि-III िी सारणी ि और सारणी ख में दी गई ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (5) पाररसथथसतिी संवेदी जोन िे अंतगवत िोई ग्राम नहीं ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.–(1) िेंर्द् शाससत प्दशे सरकार, द्वारा पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिन के जलए, रािपत्र में अंजतम अजधसूचना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा स े और इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए, िेंर्द् शाससत प्दशे सरकार के सक्षम प्राजधकारी के अनमु ोिनाथा एक आंचजलक महार्ोिना बनाई िार्ेगी। (2) िेंर्द् शाससत प्दशे सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना म ें जवजनर्िष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज् र् जवजधर्ों के अनुरूप तथा केंरीर् सरकार द्वारा िारी दििा जनििे ों, र्दि कोई हों, के अनसु ार बनार्ी िाएगी। (3) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को िाजमल करने के जलए इसे िेंर्द् शाससत प्दशे सरकार के जनम्नजलजखत जवभागों के परामिा से बनार्ा िाएगा, अथाता ्:- (i) िम्मू और कश्मीर सरकार का पर्ाावरण, वन और वन्द्र्िीव संरक्षण जवभाग। (ii) राज्र् प्रिषू ण जनर्ंत्रण बोड।ा (iii) आवास और िहरी जवकास जवभाग। (iv) पर्ाटन जवभाग। (v) ग्रामीण जवकास जवभाग। (vi) ससंचाई और बाढ़ जनर्ंत्रण जवभाग। (vii) लोक जनमााण और जबिली जवकास जवभाग। (viii) रािस्ट्व जवभाग। (ix) आपिा प्रबंधन। (x) कृजष जवभाग। (xi) नगर जनगम, िम्मू। (xii) शहर योजना जवभाग, िम्मू। (4) िब तक इस अजधसूचना में जवजनर्िष्टा न हो, आंचजलक महार्ोिना में वतामान में अनुमोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना में वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलुओं की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट्थ लों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस म् ों, कृजष क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और मौजूदा और प्रस्ट्ताजवत भू-उपर्ोग की जविेषताओं का ब्र्ौरा भी दिर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में होन े वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी में र्थासचू ीब्ध पैराग्राफ 4 में प्रजतजष्ध एवं जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसम ें स्ट्थ ानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभ ा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कतव्या ों का जनवाहन कर सके । 3. िेंर्द् शाससत प्दशे सरकार द्वारा दकए िान े वाल े उपार्.- िेंर्द् शाससत प्दशे सरकार इस अजधसूचना के उपबंधों को प्रभावी बनान े के जलए जनम्नजलजखत उपार् करेगी, अथाात:् - (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं दकर्ा िाएगा: परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर ऊपर भाग (क), में जवजनर्िष्टा प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजष और अन्द्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनुमोिन स े क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्रीर् सरकार एवं िेंर्द् शाससत प्दशे सरकार के अन्द्र् जनर्मों एवं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करन े के जलए अनुमत दकर्ा िाएगा िैस:े - (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ें सुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रिषू ण उत्पन्न न करन े वाले लघु उद्योग; (iv) कुटीर उद्योग एवं ग्राम उद्योग; पाररजस्ट्थजतकी पर्टा न में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाए ं तथा गृह वास; और (v) पैराग्राफ-4 में उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः परंतु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना तथा िेंर्द् शाससत प्दशे सरकार के अन्द्र् जनर्मों एवं जवजनर्मों एवं संजवधान के अनच्ु छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा: परंतु र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अंतगात आने वाली भूजम के अजभलेखों में हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करन े के पिात्, िेंर्द् शाससत प्दशे सरकार द्वारा प्रत्र्ेक मामल े में एक बार सुधारा िाएगा और उि त्रुरट को सुधारन े की सचू ना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े में, इस उप-पैरा में र्था उपबंजधत के जसवार्, दकसी भी ििा में भू-उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनुप्रर्क्तु र्ा अनुत् पािक कृजष क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के िायविलापों स े पुन: वनीिरण िे प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल रोत.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके सरं क्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और िेंर्द् शाससत प्दशे सरकार द्वारा कदशा-सनदशे इस रीसत से तैयार किए जाएगं े दक उसमें ऐसे क्षेत्रों म ें या उसिे पास जवकास दक्रर्ाकलापों को प्रजतजष्ध और जनबंजधत दकर्ा गर्ा हो । (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंिी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन सबं ंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएगं े, अथाात्:- (i) संरसक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुमत नहीं दकर्ा िाएगाः परंतु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरसक्षत क्षेत्र की सीमा से एि दकलोमीटर की िरू ी से परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजषत और अभीजहत क्षेत्रों में पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनििे ों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िने े वाले राष्ट्रीर् व्याघ्र सरं क्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनििे ों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन होन े तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी सवं ेिी िोन में दकसी नए होटल/ ररिॉटा र्ा वाजणजज्र्क प्रजतष्ठान का संजन्नमााण अनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षेत्र, िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी सवं ेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत सरं क्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रिषू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषू ण िी रोिथाम और जनर्ंत्रण किया जाएगा । (7) वार् ु प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन में, वार् ु प्रिषू ण िा जनवारण और जनर्त्रं ण, वार् ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहराव का सनथसरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहराव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाले पर्ाावरणीर् प्रिषू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा िेंर्द् शाससत प्दशे सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था सिं ोजधत अजधसूचना सं. का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण- अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत दकर्ा िार्ेगा। (10) िवै जचदकत्सा अपसशष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्–समर् पर र्था सिं ोजधत अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप जैव सचकित्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संविे ी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनसु ार दकर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध िाजमल दकए िाएगं े। आंचजलक महार्ोिना के तैर्ार होने और िेंर्द् शाससत प्दशे सरकार के सक्षम प्राजधकारी से अनुमोदित होने तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एवं जवजनर्मों के अनसु ार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण.- वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगं े। (16) औद्योजगक ईकाइर्ा.ं - (ि) सरकारी रािपत्र में इस अजधसूचना के प्रकािन की तारीख को र्ा उसके बाि पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए प्रिषू णकारी उद्योग की स्ट्थापना िी अनुमसत नहीं होगी। (ख) िेन्र्द्ीय प्दिू ण सनयंत्रण बोड व द्वारा फरवरी, 2016 में जारी मागवदशवि ससद्धान्तों में उद्योगों िे वगीिरण िे अनुसार, जब ति कि असिसूचना में इस प्िार सवसनर्दष्टव न हो, समर्-समर् पर संिोजधत दकर्ा िाएगा; पाररसथथसतिी संवेदी जोन िे भीतर िेवल गैर-प्दिू णिारी उद्योगों िो अनुज्ञात किया जाएगा और इसिे असतररक्त, गैर प्दिू णिारी उद्योगों िो बढ़ावा कदया जाएगा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का सरं क्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों में अत्र्जधक भ-ू क्षरण होता ह ै उनमें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन में प्रजतजष्ध र्ा उद्योगों वतामान प्रिषू णकारी उद्योगों का जवस्ट्तार करने की अनमु जत नहीं की स्ट्थापना । होगीः परन्तु यह कि िेन्र्द्ीय प्दिू ण सनयंत्रण बोड व द्वारा फरवरी, 2016 में जारी मागव दशवि ससद्धान्तों में उद्योगों िे वगीिरण िे अनुसार जब ति कि असिसूचना में ऐसा सवसनर्दष्टव न हों, समर्-समर् पर संिोजधत दकर्ा िाएगा; पाररसथथसतिी संवेदी जोन िे भीतर गैर-प्दिू णिारी उद्योगों िो अनुज्ञात किया जाएगा और इसिे असतररक्त गैर-प्दिू णिारी िुटीर उद्यागों िो बढ़ावा कदया जाएगा। 3. बड़ी िल जवद्युत पररर्ोिनाओं प्रजतजष्ध। की स्ट्थापना । 4. दकसी पररसंकटमर् पिाथा का प्रजतजष्ध। प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । 5. प्राकृजतक िल जनकार्ों र्ा भूजम प्रजतजष्ध। क्षेत्र में अनुपचाररत बजहरावों का जनस्ट्सरण । 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट्तार अनुमत नहीं ररसोटों की पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु अस्ट्थार्ी सरं चनाओं वाजणजज्र्क स्ट्थापना । के जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो की स्ट्थापना अनुमत नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू दििाजनििे ों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी । 10. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क संजनमााण अनुमत नहीं दकर्ा िाएगा: परंतु स्ट्थ ानीर् लोगों को पैराग्राफ 3 के उप पैराग्राफ (1) म ें सूचीब्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् सनवाससयों की आवासीर् आवश्र्कताओं को पूरा करन े जलए संजनमााण करने की अनमु सत भवन उपजवजधर्ों के अनुसार िी िाएगी। परन्द्तु ऐसे लघ ु उद्योगों िो प्रिषू ण उत् पन्द् न नहीं करते ह,ैं स े संबंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएगं े और लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमसत से ही न्द्र् ूनतम पर रखे िाएगं े । एक दकलोमीटर से आगे आंचजलक महार्ोिना की अनुसार जवजनर्जमत होंगे । 11. गैर प्रिषू णकारी लघ ु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योगों में वगीकरण के अनसु ार समर्-समर् पर संिोजधत दकर्ा िाएगा दक गैर-प्रिषू णकारी उद्योग और अपररसंकटमय में, लघ ु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से ििे ी सामग्री से उत्पािों को उत्पन्न करन े वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 12. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमसत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई केंरीर् र्ा संबंजधत राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 जवजनर्जमत होगी । 13. वन उत्पािों और गैर काष्ठ वन लागू जवजधर्ों के अधीन जवजनर्जमत होगा । उत्पािों का संग्रहण । 14. जवद्युत और संचार टॉवर लगान,े के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत संचलन । होगा । 20. स्ट्थानीर् िनता द्वारा अपनार्ी स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन अनुमत िा रही वतामान कृजष और होंगे। बागवानी प्धजतर्ों के साथ डर्े ररर्ां, िग्ु ध उत्पािन, िल कृजष और मत्स्ट्र् पालन। 21. प्राकृजतक िल जनकार्ों र्ा भू क्षेत्र िल जनकार्ों में उपचाररत अपजिष्ट िल/बजहरााव के जनस्ट्सरण स े म ें उपचाररत अपजिष्ट बचा िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और िल/बजहरााव का जनस्ट्सरण । पुन:उपर्ोग के प्रर्ास दकए िाएगं े अन्द्र्था उपचाररत अपजिष्ट िल/बजहरााव का जनस्ट्सरण लागू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। 22. सतही और भूिल का वाजणजज्र्क लागू जवजधर्ों के अधीन जवजनर्जमत होगा । प्रर्ोग एवं जनष्कषाण । 23. फमों, कारपोरेट और कंपजनर्ों स्ट्थानीर् आवश्र्कताओं को पूरा करने के अलावा लाग ू जवजधर्ों के द्वारा बड़ े पैमाने पर वाजणजज्र्क अधीन जवजनर्जमत (अन्द्र्था उपबंि िो छोड़िर) होंग े । पिुधन संपिा और कुक्कुट फामों की स्ट्थापना । 24. कृजष और अन्द्र् उपर्ोग के जलए सवनयसमत एवं सम्ब्ध प्राजधकारी द्वारा भीतर पॉजलथीन बैग के उपर्ोग की अनुमजत होगी। परन्द्तु र्ह जवजिष्ट आवश्र्कता के आधार पर लाग ू जवजधर्ों के अधीन जवजनर्जमत होगा । 29. वाजणजज्र्क सकं ेत बोड ा और लागू जवजधर्ों के अधीन जवजनर्जमत होगा । Draft Notification WHEREAS, the Kishtwar High Altitude National Park was named after well-known and old town of Jammu Province “Kishtwar” which forms its gateway. It is spread over the undulating terrain of the great Himalayan Mountains with an area of 2191.50 square kilometres in Kishtwar District, Jammu and Kashmir. The National Park is located about 60 kilometres north from Kishtwar town and is 230 kilometre away from Jammu. AND WHEREAS, the Kishtwar High Altitude National Park was declared as a National Park vide notification no. FST-20 of 1981, dated 4th February 1981, with an area of 425 square kilometers. The Jammu & Kashmir Government re-notified the Kishtwar High Altitude National Park vide notification no. SRO-212 dated 6th July 2015, comprising an area of 2191.50 square kilometres. AND WHEREAS, the Kishtwar High Altitude National Park and its adjacent forest area are given priority for protection purpose due to its endemic wildlife. The area supports viable population of the endangered floral and faunal species. It represents “gene pool” for propagation, protection and perpetuation of many wild flora and fauna species. AND WHEREAS, the Kishtwar High Altitude National Park, is known to harbour the highly endangered species hangul or Kashmiri stag (Cervus elaphus hangul) and musk deer (Moschus crysogater). There are about 25 species of mammals and over 200 species of birds reported in the territories of the National park. AND WHEREAS, the protected area provides shelter to a large number of endangered, rare herbivore and carnivore animals like Asiatic black bear (Ursus thibetanus), Himalayan brown bear (Ursus arctos isabellinus), goral (Naemorhedus goral), Himalayan langur (Semnopithecus ajax), leopard (Panthera pardus), snow leopard (Panthera uncia), Ibex (Capra ibex), Himalayan mouse hare (Ochotona roylei), Himalayan marmot (Marmot bobak), long tailed marmot (Marmot caudate), jackal (Canis aureus), red fox (Vulpes vulpes) and avi-faunal species like western tragopan (Tragopan melanocephalus), monal (Lophophorus impejanus), golden eagle (Aquila chrysaetos), snow partridge (Lerwa lerwa) and chakore pheasant (Alectoris chukar), Himalayan griffon vulture (Gyps himalayensis), bearded vulture (Gypaetus barbatus), Kashmir flycatcher (Ficedula subrubra) etc. AND WHEREAS, the area of Kishtwar High Altitude National Park is characterized by marked variation of topography, climate and altitude. As a result of which diversity of forest vegetation occur in the area. The lower catchment areas of all the three conspicuous nallahs namely Kibar, Nanth and Kiyar carry forest growth on suitable aspects with increased admixture of miscellaneous species. AND WHEREAS, the Kishtwar High Altitude National Park consists of moist deodar forest, western mixed coniferous forest, moist temperate deciduous forest, low level blue pine forest, west Himalayan upper oak-fir forest, chilgoza pine forest, dry deodar forest, parrotia (pohu) scrub forest, west Himalayan high level dry blue pine forest, west Himalayan sub-alpine birch/fir forest, sub-alpine pastures, birch/rhododendron scrub forest, alpine pastures.Due to the high elevation and good moisture regime, the fir forests are predominant over deodar-kail forest. The broad-leaved species are confined to the sides of nallahs and on cooler and damp sites. Parrotia also occurs in patches. The area also has a vast diversity of important medicinal plants like Saussurea lappa, Diascoria spp, Podophyllum spp, Belladona spp, Bergenia spp, Skimmea spp, Piccorhiza spp and Aconitum spp etc. AND WHEREAS, the catchments of the National Park is source of drinking and irrigation water to dozens of villages falling down stream to the protected area, besides feeding source to the famous River Chenab of Jammu Provence. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Kishtwar High Altitude National Park which are specified in paragraph 1 as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 507.55 meters to 10.106 kilometers around the boundary of Kishtwar High Altitude National Park, in the Union Territory of Jammu & Kashmir as Kishtwar High Altitude National Park Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 Extent and boundaries of Eco-Sensitive Zone. – (1) The Eco-Sensitive Zone shall be of 547.09 square kilometers with an extent 507.55 meters to 10.106 kilometers around the boundary of Kishtwar High Altitude National Park. (2) The boundary description of Kishtwar High Altitude National Park and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the National Park demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-II A, Annexure-II B and Annexure-II C (4) Lists of geo co-ordinates of the boundary of Kishtwar High Altitude National Park and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) There are no villages falling within the Eco-Sensitive Zone. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The Union Territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the Union Territory. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union Territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union Territory laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union Territory Government, for integrating the ecological and environmental considerations into the said plan:- i) Environment, Forests and Wildlife Protection Department of Jammu and Kashmir Government, ii) State Pollution Control Board, iii) Housing and Urban Development Department, iv) Tourism Department, v) Rural Development Department, vi) Irrigation and Flood Control Department, vii) Public Works and Power Development Department, viii) Revenue Department, ix) Disaster Management, x) Agriculture Department, xi) Municipal Corporation, Jammu, xii) Department of Town Planning, Jammu, (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. Measures to be taken by the Union Territory Government.-The Union Territory Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union Territory Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union Territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union Territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union Territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the Union Territory Department of Tourism in consultation with the Union Territory Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or up to the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union Territory Government, whichever is more stringent. (9) Solid wastes.-Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union Territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non- polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Setting of industries causing New industries and expansion of existing polluting industries in the pollution (Water, Air, Soil, Noise, Eco-sensitive Zone shall not be permitted: etc.). Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Construction activities. a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the Union Territory as per proforma appended at Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures.- The Central Government and Union Territory Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
