का.आ. 1700(अ).—िन(cid:7388)िलिखत (cid:7079)ारूप अिधसूचना, िजसे केन्(cid:7076)ीय सरकार, पयार्वरण (संरक्षण) अिधिनयम,
1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पिठत
उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए, जारी करने का (cid:7079)स्ताव करती ह,ै पयार्वरण (संरक्षण) िनयम,
1986 के िनयम 5 के उपिनयम (3) की अपेक्षानुसार, जनसाधारण की जानकारी के िलए (cid:7079)कािशत की जाती है;
िजनके उसस े (cid:7079)भािवत होने की संभावना ह ै ; और यह सूचना दी जाती ह ै िक उ(cid:7334) (cid:7079)ारूप अिधसूचना पर, उस
तारीख स,े िजसको इस अिधसूचना वाले भारत के राजप(cid:7074) की (cid:7079)ितयां जनसाधारण को उपलब्ध करा दी जाती ह,(cid:7289)
साठ िदन की अविध की समाि(cid:7385) पर या उसके प(cid:7391)ात् िवचार िकया जाएगा ;

हुआ ह;ै

वन्यजीव अभयारण्य के संरिक्षत क्षे(cid:7074) के चार(cid:7298) ओर के क्षे(cid:7074) को, िजसका िवस्तार अिधसूचना के पैरा 1 म(cid:7286) िविन(cid:7416)द(cid:7397)र्
ह,(cid:7289) िवस्तार और सीमा(cid:7312) के क्षे(cid:7074) को सुरिक्षत और संरिक्षत करना आवश्यक ह ै तथा उ(cid:7334) पािरिस्थितक संवेदी जोन म(cid:7286)
उ(cid:7378)ोग(cid:7298) या उ(cid:7378)ोग(cid:7298) के वग(cid:7300) के (cid:7079)चालन तथा (cid:7079)संस्करण करने को (cid:7079)ितिष(cid:7373) करना आवश्यक ह;ै
अतः, अब, केन्(cid:7076)ीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत
पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) और उपधारा (2) के खंड (v)
और खंड (xiv) और उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए, मध्य (cid:7079)दशे राज् य म(cid:7286) ओरछा वन् यजीव
अभयारण्य की सीमा के चार(cid:7298) ओर 2 िकलोमीटर पिरिध, ओरछा शहर के आवासीय क्षे(cid:7074) (100 मीटर पिरिध) पर
और उ(cid:7275)र (cid:7079)दशे के क्षे(cid:7074) को छोड़कर ओरछा वन्यजीव अभयारण्य पािरिस्थितक संवेदी जोन (िजसे इसम(cid:7286) इसके
पश् चात् पािरिस्थितक संवेदी जोन कहा गया ह)ै के रूप म(cid:7286) अिधसूिचत करती ह,ै िजसका िववरण िन(cid:7388)ानुसार ह,ै
अथार्त् :--
1. पािरिस्थितक सवं दे ी जोन का िवस्तार और उसकी सीमाएं.—(1) पािरिस्थितक संवेदी जोन ओरछा वन्यजीव
अभयारण्य की सीमा 2 िकलोमीटर तक िवस्तािरत ह,ै ओरछा शहर के आवासीय क्षे(cid:7074) (100 मीटर पिरिध) और¹Hkkx IIμ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3
उ(cid:7275)र (cid:7079)दशे के क्षे(cid:7074) को छोड़कर और पािरिस्थितक संवेदी जोन का क्षे(cid:7074)फल 24.84 वगर् िकलोमीटर ह।ै पािरिस्थितक
संवेदी जोन की सीमा का वणर्न उपाबंध-I म(cid:7286) िदया गया ह।ै
(2) वन्यजीव अभयारण्य और पािरिस्थितक संवेदी जोन के िनदश(cid:7287) ांक (cid:7059)मश: उपाबंध-II और उपाबंध-III म(cid:7286)
िदए गए ह।(cid:7289)
(3) पािरिस्थितक संवेदी जोन के अधीन आने वाले 17 (cid:7061)ाम(cid:7298) की सूची और उनके िनदश(cid:7287) ांक उपाबंध- IV के रुप
म(cid:7286) ह।ै
(4) सीमा के ब्यौरे और अक्षांश और दशे ान्तर के साथ पािरिस्थितक संवेदी जोन का मानिच (cid:7074) उपाबंध-V के
रुप म(cid:7286) संल(cid:7336) ह ै।
2. पािरिस्थितक सवं दे ी जोन के िलए आंचिलक महायोजना.—(1) राज्य सरकार, पािरिस्थितक संवेदी जोन
(cid:7079)योजन के िलए राजप(cid:7074) म(cid:7286) इस अिधसूचना के अंितम (cid:7079)काशन की तारीख स े दो वषर् की अविध के भीतर, स्थानीय
(cid:7390)ि(cid:7334)य(cid:7298) के परामशर् से और इस अिधसूचना म(cid:7286) संलग् न अनुबंध(cid:7298) के सामंजस् य से आंचिलक महायोजना तैयार करेगी ।
(2) आंचिलक महायोजना राज्य सरकार म(cid:7286) सक्षम (cid:7079)ािधकारी (cid:7367)ारा अनुमोिदत होगी ।
(3) राज्य सरकार (cid:7367)ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म(cid:7286)
िविन(cid:7416)दष्र् ट रीितयाँ तथा सुसगं त क(cid:7286)(cid:7076)ीय और राज् य िविधय(cid:7298) के सामंजस् य और क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा जारी मागर्िनदश(cid:7287) (cid:7298),
यिद कोई ह(cid:7298), (cid:7367)ारा तैयार होगी ।
(4) आंचिलक महायोजना, पयार्वरणीय और पािरिस्थितक िवचार(cid:7298) को समाकिलत करने के िलए राज् य सरकार
के सभी संब(cid:7373) िवभाग(cid:7298) के परामशर् से तैयार होगी, अथार्त्:--
(i) पयार्वरण;
(ii) वन और वन्यजीव;
(iii) कृिष ;
(iv) राजस् व;
(v) नगर िवकास;
(vi) पयर्टन;
(vii) (cid:7061)ामीण िवकास;
(viii) िसंचाई और बाढ़ िनयं(cid:7074)ण;
(ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िन मार्ण िव भाग।
(5) आंचिलक महायोजना अनुमोिदत िव(cid:7378)मान भू-उपयोग, अवसंरचना और ि(cid:7059)याकलाप(cid:7298) पर कोई िनब(cid:7304)धन
अिधरोिपत नह(cid:7277) करेगी जब तक िक इस अिधसूचना म(cid:7286) िविन(cid:7416)दष्र् ट न हो और उ(cid:7334) योजना सभी अवसंरचना और
ि(cid:7059)याकलाप(cid:7298) म(cid:7286) और अिधक दक्षता और पािरिस्थितक अनुकूलता का संवधर्न करेगी ।
(6) आंचिलक महायोजना म(cid:7286) अनाच्छािदत क्षे(cid:7074)(cid:7298) के जीण(cid:7299)(cid:7373)ार, िव(cid:7378)मान जल िनकाय(cid:7298) के संरक्षण, आवाह क्षे(cid:7074)(cid:7298)
के (cid:7079)बंधन, जल-संभर(cid:7298) के (cid:7079)बंधन, भूतल जल के (cid:7079)बंधन, मृदा और नमी संरक्षण, स्थानीय समुदाय(cid:7298) की
आवश्यकता(cid:7312) तथा पािरिस्थितक और पयार्वरण स े सबं ंिधत ऐस े अन्य पहलू(cid:7312), िजन पर ध्यान दने ा आवश्यक ह,ै के

(7) आंचिलक महायोजना सभी िव(cid:7378)मान पूजा स् थल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोबस्त(cid:7298), वन(cid:7298) के (cid:7079)कार और िकस् म(cid:7298),
कृिष क्षे(cid:7074)(cid:7298), ऊपजाऊ भूिम, हिरत क्षे(cid:7074) जैसे पाक(cid:7299) और उसी (cid:7079)कार के स् थान, उ(cid:7378)ान कृिष क्षे(cid:7074), फलो(cid:7378)ान(cid:7298), झील(cid:7298)
और अन्य जलाशय(cid:7298) का मानिच(cid:7074) की मदद से अभ्यकंन करेगी और योजना का मानिच(cid:7074) (cid:7367)ारा िव(cid:7378)मान और
(cid:7079)स्तािवत भूिम के उपयोग का ब्यौरा दते े हुए समथर्न िकया जाएगा ।
(8) आंचिलक महायोजना पािरिस्थितक संवेदी जोन म(cid:7286) िवकास को, स् थानीय समुदाय(cid:7298) की जीिवका सुरक्षा के िलए
पािरिस् थितक अनुकूल िवकास को सुिनिश् चत करते हुए िविनयिमत करेगी ।
(9) आंचिलक महायोजना इस अिधसूचना के अधीन अपने मानीटरी काय(cid:7300) को करने के िलए मानीटरी सिमित के
िलए एक संदभर् दस्तावेज तैयार करेगी ।
3. राज्य सरकार (cid:7367)ारा िकए जान े वाल े उपाय.—राज्य सरकार इस अिधसूचना के उपबंध(cid:7298) को (cid:7079)भावी करने के िलए
िन(cid:7388)िलिखत उपाय करेगी, अथार्त्:--
(1) भू-उपयोग –
पािरिस् थितक संवेदी जोन म(cid:7286) वन(cid:7298), उ(cid:7378)ान-कृिष क्षे(cid:7074)(cid:7298), कृिष क्षे(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योजन के िलए िचिन्हत िकए
गए पाक(cid:7300) और खुले स्थान(cid:7298) का वािणिज्यक और औ(cid:7378)ोिगक ि(cid:7059)याकलाप(cid:7298) के िलए उपयोग या संपिरवतर्न नह(cid:7277) होगा
और मानिच(cid:7074) के साथ आंचिलक महायोजना म(cid:7286) स्प(cid:7397) रूप से क्षे(cid:7074)(cid:7298) को िनधार्िरत िकया जाएगा:
परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम ऐसे और अन्य भूिम का संपिरवतर्न मानीटरी सिमित की
िसफािरश पर और राज्य सरकार के पूवर् अनुमोदन स,े जो स्थानीय िनवािसय(cid:7298) की आवासीय जरूरत(cid:7298) को पूरा करने
के िलए ह,ै अनुज्ञात िकया जाएगा जैसे:-
(i) िव(cid:7378)मान सड़क(cid:7298) को चौड़ा करना और उन्ह (cid:7286)सुदढृ करना तथा नई सड़क(cid:7298) का सिं नमार्ण;
(ii) बुिनयादी ढांच(cid:7298) और नागिरक सुख सुिवधा(cid:7312) का संिनमार्ण और नवीकरण;
(iii) (cid:7079)दषू ण उत्प(cid:7382) न करन े वाले लघ ु उ(cid:7378)ोग;
(iv) कुटीर उ(cid:7378)ोग(cid:7298) िजसके अंतगर्त (cid:7061)ामीण उ(cid:7378)ोग; सुिवधाजनक भण्डार और स्थानीय सुिवधा(cid:7312) का समथर्न करने
वाले वासगृह सिहत पािरिस्थितक पयर्टन भी है; और
(v) पैरा 4 म(cid:7286) यथा सूचीब(cid:7373) संविधर्त ि(cid:7059)याकलाप:
परंतु यह िक राज्य सरकार के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय (cid:7079)वृ(cid:7275) िविध के उपबंध(cid:7298) के
अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकार(cid:7298) की
मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक या उ(cid:7378)ोग िवकास ि(cid:7059)याकलाप(cid:7298) के िलए जनजातीय
भूिम का उपयोग अनुज्ञात नह(cid:7277) होगा:
परंतु यह और िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेख(cid:7298) म(cid:7286) उपसंजात कोई (cid:7074)ुिट, मानीटरी सिमित के
िवचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् राज्य सरकार (cid:7367)ारा (cid:7079)त्येक मामले म(cid:7286) एक बार संशोिधत होगी और उ(cid:7334) (cid:7074)ुिट के संशोधन
की सूचना क(cid:7286)(cid:7076)ीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं(cid:7074)ालय को दने ी होगी ।
परंतु यह और िक उपयुर्(cid:7334) (cid:7074)ुिट का संशोधन म(cid:7286) इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा म(cid:7286)
भू-उपयोग का पिरवतर्न सिम्मिलत नह(cid:7277) होगा ।¹Hkkx IIμ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 5
परंतु यह और िक िजससे हिरत क्षे(cid:7074) म(cid:7286) जैसे वन क्षे(cid:7074), कृिष क्षे(cid:7074) आिद म(cid:7286) कोई पािरणािमक कटौती नह(cid:7277) होगी और
अन(cid:7079)युक् त या अनुत् पादक कृिष क्षे(cid:7074)(cid:7298) म(cid:7286) वनरोपण और आवास पुनरु(cid:7373)ार ि(cid:7059)याकलाप(cid:7298) के साथ पुन: वनीकरण करने
के (cid:7079)यास िकए जाएंगे ।
(2) (cid:7079)ाकृितक जल (cid:7090)ोत.—आचंिलक महायोजना म(cid:7286) सभी (cid:7079)ाकृितक जल (cid:7090)ोत(cid:7298) की पहचान की जाएगी और उनके
संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी और राज् य सरकार (cid:7367)ारा ऐसे क्षे(cid:7074)(cid:7298) पर या उनके िनकट
िवकास ि(cid:7059)याकलाप (cid:7079)ितिष(cid:7373) करने के िलए ऐसी रीित से मागर्दशर्क िस(cid:7373)ान्त तैयार िकए जाएंगे ।
(3) पयटर् न.—(क) पािरिस्थितक संवेदी जोन के भीतर नये पयर्टन पािरिस्थितक संवेदी जोन के िलए ि(cid:7059)याकलाप या
िव(cid:7378)मान पयर्टन ि(cid:7059)याकलाप(cid:7298) का िवस्तार पयर्टन महायोजना के अनुसार ह(cid:7298)गे ।
(ख) पयर्टन महायोजना पयर्टन िवभाग, (cid:7367)ारा पयार्वरण और वन िवभाग, मध्य (cid:7079)दशे सरकार के परामशर् से तैयार
होगी ।
(ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप म(cid:7286) जाना जायेगा ।
(घ) पयर्टन सबं ंधी ि(cid:7059)याकलाप िनम् निलिखत के अधीन िविनयिमत ह(cid:7298)गे, अथार्त् :-
(i) वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक
इनम(cid:7286) जो भी िनकट ह,ै नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नह(cid:7277) ह(cid:7298)गे। परन्तु वन्यजीव अभयारण्य
की सीमा से एक िक.मी. की दरू ी से आगे नये होटल और िरसोटर् का स्थापना पयर्टन महायोजना के अनुसार
पािरिस्थितक पयर्टन सुिवधा(cid:7312) के िलए पूवर् पिरभािषत और पदािभिहत वग(cid:7300) के िलए अनुज्ञात िकया
जाएगा;
(ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन ि(cid:7059)याकलाप(cid:7298) या िव(cid:7378)मान पयर्टन ि(cid:7059)याकलाप(cid:7298) का

तथा राष् (cid:7069)ीय व् या(cid:7062) संरक्षण (cid:7079)ािधकरण, (cid:7367)ारा जारी पािरिस्थितक पयर्टन (समय-समय पर यथा संशोिधत)
मागर्दशर्क िस(cid:7373)ांत(cid:7298) के अनुसार, पािरिस्थितक पयर्टन, को महत्व दते े होगा;
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव(cid:7378)मान पयर्टन
ि(cid:7059)याकलाप(cid:7298) के िवस्तार को वास्तिवक स्थल िविन(cid:7416)द(cid:7397)र् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर
आधािरत संबंिधत िविनयामक (cid:7079)ािधकरण(cid:7298) (cid:7367)ारा अनुज्ञात िकया होगा ।
(4) नसै िगकर् िवरासत.—पािरिस्थितक संवेदी जोन म(cid:7286) महत्वपूणर् नैसिगर्क िवरासत के सभी स्थल(cid:7298) जैसे सभी जीन
कोश आरिक्षत क्षे(cid:7074), शैल िवरचनाएं, जल (cid:7079)पात(cid:7298), झरन(cid:7298), घाटी माग(cid:7300), उपवन(cid:7298), गुफाएं, स्थल(cid:7298), (cid:7082)मण, अ(cid:7393)रोहण,
(cid:7079)पात(cid:7298) आिद की पहचान की जाएगी और उन्ह (cid:7286) संरिक्षत िकया जाएगा तथा उनकी सुरक्षा और संरक्षा के िलए इस
अिधसूचना के अंितम (cid:7079)काशन की तारीख से छह मास के भीतर, उपयु(cid:7334) योजना बनाएगी और ऐसी योजना
आंचिलक महायोजना का भाग होगा ।
(5) मानव िनिमतर् िवरासत स् थल.—पािरिस् थितक संवेदी जोन म(cid:7286) भवन(cid:7298), संरचना(cid:7312), िशल्प-तथ्य, ऐितहािसक,
कलात्मक और सांस्कृितक महत्व के क्षे(cid:7074)(cid:7298) की पहचान करनी होगी और इस अिधसचू ना के अंितम (cid:7079)काशन की तारीख
स े छह माह के भीतर उनके संरक्षण की योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म(cid:7286) सिम्मिलत की
जाएगी ।
(6) ध् विन (cid:7079)दषू ण.—पािरिस्थितक संवेदी जोन म(cid:7286) ध् विन (cid:7079)दषू ण के िनयं(cid:7074)ण के िलए राज् य सरकार का पयार्वरण
िवभाग या राज् य (cid:7079)दषू ण िनयं(cid:7074)ण बोडर्, वायु ((cid:7079)दषू ण िनवारण और िनयं(cid:7074)ण) अिधिनयम, 1981 (1981 का 14) के
उपबंध(cid:7298) और उसके अधीन बनाए गए िनयम(cid:7298) के अनुसरण म(cid:7286) मागर्दशर्क िस(cid:7373)ांत और िविनयम तैयार करेगा ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

िवभाग या राज् य (cid:7079)दषू ण िनयं(cid:7074)ण बोडर् वायु ((cid:7079)दषू ण िनवारण और िनयं(cid:7074)ण) अिधिनयम, 1981 (1981 का 14)
और उसके अधीन बनाए गए िनयम(cid:7298) के उपबंध(cid:7298) के अनुसार म(cid:7286) मागर्दशर्क िस(cid:7373)ांत और िविनयम तैयार करेगा ।
(8) बिह(cid:7090)ाव का िनस्सारण.—पािरिस्थितक संवेदी जोन म(cid:7286) उपचािरत बिह(cid:7090)ाव का िनस्सारण जल ((cid:7079)दषू ण
िनवारण तथा िनयं(cid:7074)ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम(cid:7298) के उपबंध(cid:7298) के
अनुसार होगा ।
(9) ठोस अपिश(cid:7397).—ठोस अपिश(cid:7397)(cid:7298) का िनपटान िन(cid:7388)िलिखत रूप म(cid:7286) होगा--
(क) पािरिस्थितक संवेदी जोन म(cid:7286) ठोस अपिश(cid:7397) का िनपटान समय-समय पर संशोिधत ठोस अपिशष् ट
(cid:7079)बंधन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं(cid:7074)ालय की
अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अ(cid:7079)ैल, 2016 (cid:7367)ारा (cid:7079)कािशत िकए गए थे, के उपबंध(cid:7298) के
अनुसार िकया जाएगा ;
(ख) स्थानीय (cid:7079)ािधकरण जैव िन(cid:7388)ीकरणीय और अजैव िन(cid:7388)ीकरणीय संघटक(cid:7298) म(cid:7286) ठोस अपिश(cid:7397)(cid:7298) के
संपृथ(cid:7333)न के िलए योजनाएं तैयार कर(cid:7286)गे ;
(ग) जैव िन(cid:7388)ीकरणीय साम(cid:7061)ी को अिधमानतः खाद बनाकर या कृिम खेती के माध्यम स े पुनःचि(cid:7059)त िकया
जाएगा ;
(घ) अकाबर्िनक साम(cid:7061)ी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी
पयार्वरणीय स्वीकृत रीित म(cid:7286) होगा और पािरिस्थितक संवेदी जोन म(cid:7286) ठोस अपिशष् ट(cid:7298) को जलाना या
भष् मीकरण अनुज्ञात नह(cid:7277) होगा।
(10) जैव िचिकत्स ीय अपिशष्ट .—पािरिस्थितक संवेदी जोन म(cid:7286) जैव िचिकत्सीय अपिश(cid:7397)(cid:7298) का िनपटान भारत सरकार
के पयार्वरण, वन और जलवायु पिरवतर्न मं(cid:7074)ालय की समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343(अ)
तारीख 28 माचर्, 2016 (cid:7367)ारा (cid:7079)कािशत जैव िचिकत्सीय अपिश(cid:7397) (cid:7079)बंध िनयम, 2016 के उपबंध(cid:7298) के अनुसार िकया
जाएगा ।
(11) यानीय पिरवहन.—पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह(cid:7298)गी और इस सबं ंध म(cid:7286)
आंचिलक महायोजना म(cid:7286) िवशेष उपबंध अिधकिथत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज् य
सरकार के सक्षम (cid:7079)ािधकारी के (cid:7367)ारा अनुमोिदत होने तक, मानीटरी सिमित (cid:7079)वृ(cid:7275) िनयम(cid:7298) और िविनयम(cid:7298) के अनुसार

(12) औ(cid:7378)ोिगक इकाईया.ं—
(क) पािरिस्थितक संवेदी जोन के भीतर नए का(cid:7399) आधािरत उ(cid:7378)ोग(cid:7298) के स्थापना की अनुज्ञा िविध के अनुसार
स्थािपत िव(cid:7378)मान का(cid:7399) आधािरत उ(cid:7378)ोग(cid:7298) के िसवाए नह(cid:7277) दी जाएगी ।
(ख) (cid:7079)स्तािवत पािरिस्थितक संवेदी जोन के भीतर जल, वायु, मृदा, ध्विन (cid:7079)दषू ण कािरत करने वाले िकसी

8. होटल और िरसोटर् का वािणिज्यक पािरिस्थितक पयर्टन ि(cid:7059)याकलाप के अस्थायी सरं चना(cid:7312) के
स्थापन । िसवाय संरिक्षत क्षे(cid:7074) की सीमा से एक िकलोमीटर तक या
पािरिस्थितक संवेदी जोन के िवस्तार तक इनम(cid:7286) जो भी िनकट
ह,ै नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नह(cid:7277) ह(cid:7298)गे।
परंतु, संरिक्षत क्षे(cid:7074) की सीमा से एक िकलोमीटर से परे और
पािरिस्थितक संवेदी जोन के िवस्तार तक इनम(cid:7286) से जो भी
िनकट हो सभी नए पयर्टक ि(cid:7059)याकलाप या िव(cid:7378)मान
ि(cid:7059)याकलाप का िवस्तार पयर्टन महायोजना और यथा लाग ू
मागर्दशर्क िस(cid:7373)ांत(cid:7298) के अनुपालन होगा।
9. सिं नमार्ण ि(cid:7059)याकलाप । (क) सरं िक्षत क्षे(cid:7074) या पािरिस्थितक संवेदी जोन जो भी िनकट
हो की सीमा से एक िकलोमीटर के भीतर िकसी भी (cid:7079)कार का
नया वािणिज्यक संिनमार्ण अनुज्ञात नह(cid:7277) िकया जाएगा:
परंतु स्थानीय (cid:7390)ि(cid:7334)य(cid:7298) को उनके उपयोग के िलए उनकी भूिम

उ(cid:7378)ोग । उत्पादन करने वाले गैर (cid:7079)दषू ण, गैर पिरसंकटमय, लघु और
सेवा उ(cid:7378)ोग, कृिष, कृिष उ(cid:7378)ान या कृिष आधािरत उत्पाद(cid:7298) का
उत्पादन करने वाले उ(cid:7378)ोग सक्षम (cid:7079)ािधकारी (cid:7367)ारा अनुज्ञात
िकए जाएंगे ।
11. ईंट भ(cid:7349)(cid:7298) की स् थापना। लागू िविधय(cid:7298) के अनुसार िविनयिमत (अन् यथा उपबंिधत के
िसवाय) ।

5. मानीटरी सिमित.—(1) क(cid:7286)(cid:7076)ीय सरकार, पािरिस्थितक संवेदी जोन के (cid:7079)भावी मानीटरी के िलए एक
मानीटरी सिमित का गठन करती ह ै जो िन(cid:7388)िलिखत स े िमलकर बनेगी, अथार्त् :-
(i) (cid:7079)भागीय आयु(cid:7334), सागर- अध् यक्ष;
(ii) पयार्वरण के क्षे(cid:7074) म(cid:7286) कायर् करने वाले गैर सरकारी संगठन(cid:7298) (िजसके अंतगर्त िवरासत सदस्य;
संरक्षण भी ह)ै का तीन वषर् की अविध के िलए मध्य (cid:7079)दशे राज्य सरकार (cid:7367)ारा
नामिन(cid:7416)द(cid:7397)र् एक (cid:7079)ितिनिध

अिधसूचना के पैरा 4 के अधीन (cid:7079)ितिष(cid:7373) गितिविधय(cid:7298) के िसवाय आने वाले ऐस े ि(cid:7059)याकलाप(cid:7298) की दशा म(cid:7286) वास्तिवक

िवशेषज्ञ(cid:7298), औ(cid:7378)ोिगक संगम(cid:7298) या संब(cid:7373) पणधािरय(cid:7298) के (cid:7079)ितिनिधय(cid:7298) को अपने िवचार-िवमशर् म(cid:7286) सहायता के िलए
आमंि(cid:7074)त कर सकेगी ।
(7) मानीटरी सिमित (cid:7079)त्येक वषर् की 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य वन्यजीव
वाडर्न को उपाबंध VI म(cid:7286) उपबंिधत रूप िवधान के अनुसार उक् त वषर् के 30 जून तक (cid:7079)स्तुत करेगी ।

WHEREAS, the Orchha Wildlife Sanctuary spreads over an area of 45.36 Square Kilometers is
located in Tikamgarh district in the State of Madhya Pradesh and is connected with Orchha territorial range
and babina range in Uttar Pradesh;
AND WHEREAS, the Orchha Wildlife Sanctuary is extremely rich in flora and fauna.Orchha
Wildlife Sanctuary are rich in biodiversity.

AND WHEREAS, it is necessary to conserve and protect the area,the extent and boundaries of which
are specified in paragraph 1 of this notification, around the protected area of Orchha Wildlife Sanctuary as
Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or
class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv)
of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read
with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby
notifies an area to an extent two kilometers periphery of Orchha Wildlife Sanctuary, except at residential area
of Orchha town (100 meters periphery) and excluding area of Uttar Pradesh as Orchha Wildlife Sanctuary
Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), in the state of Madhya Pradesh details
of which are as under, namely:—
1. Extent and boundaries of Eco-sensitive Zone.—(1)The extent of Eco-sensitive Zone is two
kilometres periphery of Orchha Wildlife Sanctuary, except at residential area of Orchha town (100 meters
periphery) and excluding area of Uttar Pradesh and the Eco-sensitive Zone is speed over an area of 24.84
square kilometres and boundary description of the said Zone is given at Annexure-I.
(2). The co-ordinates of the Wildlife Sanctuary and Eco-sensitive Zone are given in Annexure-II and III
respectively.
(3) The list of 17villagesand their co-ordinates falling under the said Eco-sensitive Zone is annexed as
Annexure-IV.
(4) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is
appended as Annexure-V.
2. Zonal Master Plan for Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the
Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of
final notification in the Official Gazette, in consultation with local people and adhering to the stipulations
given in this notification.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) The zonal master plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such
manner as is specified in this notification and also in consonance with the relevant Central and State laws and
the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments,
namely:—
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use,
infrastructure and activities, unless so specified in this notification and the said Plan shall factor in
improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water
bodies, management of catchment areas, watershed management, groundwater management, soil and moisture
conservation, needs of local community and such other aspects of the ecology and environment that need
attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban
settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like
places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be
supported by Maps giving details of existing and proposed land use features.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly
development for livelihood security of local communities.
(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out
its functions of monitoring under the provisions of this notification.
3. Measures to be taken by State Government.—The State Government shall take the following
measures for giving effect to the provisions of this notification, namely:—
(1) Land use.—
Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial
activities and such areas shall be clearly defined in the Zonal Master Plan along with maps:¹Hkkx IIμ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 17
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be
permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State
Government, to meet the residential needs of the local residents such as—
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting
eco-tourism including home stay; and
(v) promoted activities as listed in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of
article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and
other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected
by the State Government, after obtaining the views of Monitoring Committee, once in each case and the
correction of said error shall be intimated to the Central Government in the Ministry of Environment,
Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and
agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with
afforestation and habitat restoration activities.
(2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be
drawn up by the State Government in such a manner as to prohibit development activities at or near these
areas as which are detrimental to such areas
(3) Tourism.—(a) All new tourism activities or expansion of existing tourism activities within the Eco-
sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by Department of Tourism in consultation with the
Departments of Environment and Forests, Government of Madhya Pradesh.
(c) The Tourism Master Plan shall form a part of the Zonal Master Plan.
(d) The tourism activities shall be regulated as under, namely:—
(i) no new construction of hotels and resorts shall be allowed within One kilo-metre from the boundary of
the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of One kilometre from the boundary of the Wildlife Sanctuary till the
extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in
pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone
shall be in accordance with the guidelines issued by the Central Government in the Ministry of
Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger
Conservation Authority (as amended from time to time) with emphasis on eco-tourism;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific
scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene
pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc.,
shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six
months from the date of publication of the final notification and such plan shall form part of the Zonal Master
Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical,
architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for
their conservation shall be prepared within six months from the date of publication of the final notification and
incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government or the Madhya Pradesh
State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the
Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act,
1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.—The Environment Department of the State Government or the Madhya Pradesh State
Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-
sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981
(14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in
accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and
the rules made thereunder.
(9) Solid wastes.—Disposal of solid wastes shall be as under:—
(a) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the
Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment,
Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 as amended from
time to time;
(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-
biodegradable components;
(c) the biodegradable material shall be recycled preferably through composting or vermiculture; and
(d) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified
outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-
sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the
Government of India in the Ministry of Environment, Forest and Climate Change vide notification number
G.S.R. 343(E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner
and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the
Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring
Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and

(12) Industrial units.—(a) No establishment of new wood based industries within the Eco-sensitive Zone
shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed
Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.—All activities in the
Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of
1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:—

Provided that, local people shall be permitted to undertake
construction in their land for their use including the activities
listed in sub paragraph (1) of paragraph 3 as per building
byelaws.
(b) The construction activity related to small scale industries
not causing pollution shall be regulated and kept at the
minimum, with the prior permission from the competent
authority as per applicable rules and regulations, if any.
(c) Beyond one Kilometer it shall be regulated as per the Zonal
Master Plan.

5. Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee for
effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:—
(i) Divisional Commissioner, Sagar -Chairman;
(ii) One representative of Non-Governmental Organisations working - Member;
in the field of environment (including heritage conservation) to be
nominated by the Government of Madhya Pradesh for a period of
three years
(iii) An expert in the area of ecology and environment to be -Member;

period of three years

(vi) District Collector, Tikamgarh -Member;

(viii) Superintending Engineer, Public Health Department Tikamgarh -Member;
(ix) Chief Executive Officer of Zilla Panchayat, Tikamgarh -Member;
(x) District Officer of Town and Country Planning Department - Member;
(xi) Member of State Biodiversity Board -Member; and
(xii) Wildlife Warden of Orchha Wildlife Sanctuary -Member-Secretary.
6. Terms of Reference.—
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Committee shall be three years.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006,
and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of
the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the
actual site-specific conditions and referred to the Central Government in the Ministry of Environment,
Forest and Climate Change for prior environmental clearances under the provisions of the said
notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006
but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of
the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the
actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned
work in-charge shall be competent to file complaints under section 19 of the Environment (Protection)
Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry associations or concerned stakeholders to assist in its deliberations
depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on
31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State of Madhya
Pradesh as per the performa appended at Annexure VI.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
(9) The Central Government and State Government may specify additional measures, if any, for giving
effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the
Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.

Boundary description Of Eco-sensitive Zone
Eco-sensitive Zone is proposed in the 2 Kilometre periphery of Orchha Wildlife Sanctuary, except at
residential area of Orchha town (100 meter periphery) and excluding area of Uttar Pradesh. Total area of Eco-
sensitive Zone is 24.84 square Kilometers. There are 17 villages that fall in the periphery of Eco-sensitive
Zone. The northern boundary of Eco-sensitive Zone touches boundary of Uttar Pradesh., Eastern boundary of
Eco-sensitive Zone covers 8 villages including Lidhora, Baghpura, Sevari, Madori, Gulenda, Sarsora,
KotiandNata. Southern boundary of Eco-sensitive Zone touches boundary of Uttar Pradesh. The western
boundary of Eco-sensitive Zone includes 9 villages namely Majra, Mador, Ladpura, Futera, Gundrai, Ganj,
Orchha, Nakta and Aazadpura.
