िाता ह ै जिनके उससे प्रभाजवत होने की संभावना ह,ै और र्ह सूजचत ककर्ा िाता ह ै कक उि प्रारूप अजधसूचना पर, उस तारीख स,े जिसको इस अजधसूचना को अंतर्वाष्ट करन े वाले भारत के रािपत्र की प्रजतर्ां िनसाधारण को उपलब्ध करा दी िाती ह,ैं साि कदन की अवजध की समाजि पर र्ा उसके पश् चात् जवचार ककर्ा िाएगा; ऐसा कोई व्यजि, िो प्रारूप अजधसूचना म ें अंतर्वाष्ट प्रस्ट्तावों के संबंध म ें कोई आपजत्त र्ा सुझाव देन े का (संरक्षण) अजर्जनयम, 1972 िी र्ारा 38 (v) िे प्रार्र्ानों िे अर्ीन रािपत्र अजर्सूचना स.ं डब्ल्यूएलपी.0114/सी.आर.26/एफ-1, कदनांि 16 अर्थत, 2014 द्वारा बोर बाघ ररज़र्व (बोर र्न्यिीर् अभयारण्य, नया बोर र्न्यिीर् अभयारण्य और जर्थतृत नया बोर र्न्यिीर् अभयारण्य) घोजित किया र्या, जिसमें महाराष्ट्र राज्य िे जनम्नजलजित अभयारण्य शाजमल ह,ैं अिावत:् (i) बोर र्न्यिीर् अभयारण्य (61.10 र्र्व किलोमीटर) र्र्ाव और नार्पुर जिला (ii) नया बोर र्न्यिीर् अभयारण्य (60.69 र्र् व किलोमीटर) र्र्ा व और नार्परु जिला (iii) जर्थतृत नया बोर र्न्यिीर् (16.32 र्र् व किलोमीटर) र्र्ा व और नार्पुर जिला ह;ै और, महाराष्ट्र राज्य सरिार ने र्न्यिीर् (संरक्षण), अजर्जनयम, 1972 िी र्ारा 38 (v) िे प्रार्र्ानों िे अर्ीन रािपत्र अजर्सूचना स.ं डब्ल्यएू लपी-0815/सी.आर.261/एफ-1 कदनांि 04 कदसंबर, 2015 द्वारा बोर बाघ ररज़र्व (बोर र्न्यिीर् अभयारण्य, नया बोर र्न्यिीर् अभयारण्य और जर्थतृत नया बोर र्न्यिीर् अभयारण्य) िे 678.15 र्र् व किलोमीटर क्षेत्र िो बफर क्षत्रे घोजित किया र्या; और, बोर बाघ ररज़र्व पजक्षयों िे समृद्ध र्ास िे जलए िाना िाता ह ै इसम ें पजक्षयों िी लर्भर् 160 प्रिाजतयां ह ैं जिनम ें प्रर्ासी और िलपक्षी शाजमल ह।ैं इस क्षत्रे म ें भारतीय मूल िे क्षेत्रीय पजक्षयों िी संख्या भी अजभजलजित िी र्ई ह।ै इस क्षत्रे म ें सारस क्रेनस (एटीर्ोन एटीर्ोने) िा प्रिनन होना अजभजलजित किया र्या ह।ै इस क्षत्रे म ें िुछ महत्त्र्पूण व पजक्षयों िी प्रिाजतयां र्ाइट-रूम्पेड जगद्ध (जिप्स बेंगालेंजसस), गोल्डन ओररर्ोल (ओररओलुस िुंडू), ररज़र्व पजक्षयों म ें थतनर्ाररयों िी 30 प्रिाजतयों, सरीसृपों िी 26 और उभयचरों िी िई प्रिाजतयों िो अजभजलजित किया र्या ह।ै यह महत्त्र्पूणव लुप्तप्राय और अजतसंर्ेदनशील र्न्यिीर् िैसे बाघ (पेन्द्थेरा रटर्ररस), तदें आु (पेन्द्थेरा प्रड्यूस), रीछ (मले सास अरजसनस), र्न्यिीर् िुत्ता (िुओन अज्पनेस), फोर होनेड-अंटेलोपे (टेटरािेरूस क्यादररिोरजनस), सांभर (रुसा र्नूीक्लोर), आकद िो भी आश्रय प्रदान िरता ह;ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, उपर्िुा अभर्ारण्र् िे मानव वास और चल रही जवकासात्मक कक्रर्ाकलापों के अत्यंत जनकट होने स े अभर्ारण्र् के जलए, उजचत सुरक्षा उपार्ों और ऐस े कक्रर्ाकलापों पर जनर्ंत्रण करन े की आवश्र्कता है; और, बोर बाघ ररिर्व को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के पैराग्राफ 1 में जवजनर्दष्टा ह,ैं पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की दजृ ष्ट स े पाररजस्ट्थजतकी संवेदी िोन के रूप म ें सुरजक्षत और सरं जक्षत करना तथा उि पाररजस्ट्थजतकी संवेदी िोन में उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजर्सूचना म ें इसके पश्चात् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) तथा उपधारा (2) िे खंड (v) और खंड (xiv) एवं उपधारा (3) के द्वारा प्रदत्त िजिर्ों का प्रर्ोग करते हुए, बोर बाघ ररिर्व की सीमा के चारों ओर 0.5 किलोमीटर स े 26.50 किलोमीटर तक जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेदी िोन (जिसे इसमें इसके पश् चात ् पाररजस्ट्थजतकी संवेदी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ् :- 1. पाररजस्ट्थजतकी संवदे ी िोन का जवस्ट्तार और सीमा.- (1) पाररजस्ट्थजतकी संवेदी िोन का जवस्ट्तार बोर बाघ ररज़र्व िी सीमा िे चारों ओर 0.5 किलोमीटर स े 26.50 किलोमीटर ति जर्थतृत ह ै और पाररजथिजतिी संर्ेदी िोन िा क्षेत्रफल 678.14 र्र् वकिलोमीटर ह।ै (2) पाररजस्ट्थजतकी संवेदी िोन िा जर्थतार और सीमा िा जर्र्रण अनलु ग्नि-I के रूप म ें संलग्न ह।ै (3) मुख्र् अवस्ट्थानों और भूजम उपयोर् पैटनव के भ-ू जनदेशांिों के साथ बोर बाघ ररिर्व िे पाररजथिजतिी संर्ेदी िोन िे मानजचत्र अनलु ग्नि-II के रूप म ें संलग्न ह।ै (4) बोर बाघ ररिर्व और इसके पाररजथिजतिी संर्ेदी िोन िी सीमा िे भू-जनदेशांिों िी सूची अनलु ग्नि –III िी सारणी ि और सारणी ि के रूप म ें संलग्न ह।ै (5) प्रथताजर्त पाररजथिजतिी संर्ेदी िोन िे अंतर्वत आन ेर्ाले ग्रामों िी सूची अनलु ग्नि -IV म ेंदी र्ई ह।ै 2. पाररजस्ट्थजतकी संवदे ी िोन के जलए आचं जलक महार्ोिना.–(1) राज्र् सरकार, द्वारा पाररजस्ट्थजतकी संवेदी िोन के प्रर्ोिन के जलए, रािपत्र में अंजतम अजधसूचना के प्रकािन की तारीख स े दो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा से और इस अजधसूचना में कदए गए अनुबंधों का पालन करते हुए, राज्र् सरकार के सक्षम प्राजधकारी के अनुमोदनाथ ा एक आंचजलक महार्ोिना बनाई िार्ेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेदी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्दष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप तथा केंरीर् सरकार द्वारा िारी कदिा जनदिदेश ों, र्कद कोई हों, के अनुसार बनार्ी िाएगी। (3) बोर बाघ ररज़र्व िा बफर िोन पाररजथिजतिी संर्ेदी िोन िा भार् बनेर्ा और आंचजलि महायोिना िी तैयारी िे दौरान बाघ संरक्षण योिना िो भी ध्यान म ें रिा िाएर्ा। (4) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण सबं ंधी सरोकारों को िाजमल करने के जलए इसे राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से बनार्ा िाएगा, अथाात:् - (i) वन और वन्द्र्िीव; (ii) पर्ाावरण;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) कृजि; (iv) रािथर्; (v) िहरी जवकास; (vi) पर्ाटन; (vii) नर्रपाजलिा; (viii) महाराष्ट्र राज्र् प्रदिू ण जनर्ंत्रण बोडा। (5) िब तक इस अजधसूचना में जवजनर्दष्टा न हो, आंचजलक महार्ोिना में वतामान में अनमु ोकदत भू-उपर्ोग, अवसंरचना और कक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और कक्रर्ाकलापों में सुधार करके उन्द्ह ेअजधक दक्ष और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी। (6) आंचजलक महार्ोिना में वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान कदर्ा िाना आवश्र्क ह।ै (7) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं ककस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण ककर्ा िाएगा और मौिूदा और प्रस्ट्ताजवत भू-उपर्ोग की जविेिताओं का ब्र्ौरा भी कदर्ा िाएंगा। (8) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेदी िोन म ें होने वाले जवकास का जवजनर्मन ककर्ा िाएगा और सारणी में र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध एव ं जवजनर्जमत कक्रर्ाकलापों का पालन ककर्ा िाएगा। इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनश्चर् एवं संवधान ककर्ा िाएगा। (9) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (10) अनुमोकदत आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संदभा दस्ट्तावेि होगी ताकक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा ककए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेदी िोन में वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुले स्ट्थानों का वृहद वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक कक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं ककर्ा िाएगा: परंत ु पाररजस्ट्थजतकी संवेदी िोन के भीतर ऊपर भाग (क), में जवजनर्दष्टा प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजि और अन्द्र् भूजम का सपं ररवतान, मानीटरी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लागू केन्द्रीर् सरकार एवं राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोदन स े तथा इस अजधसूचना के उपबंधों के अनसु ार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करने तिा जनम्न िाय व िलापों के जलए अनुमत ककर्ा िाएगा िैसे:- (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुदढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (iii) प्रदिू ण उत्पन्न न करने वाल े लघ ुउद्योग; (iv) कुटीर उद्योग एवं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाए ं तथा र्ृह वास; और (v) पैराग्राफ-4 में उजल्लजखत बढावा कदए गए कक्रर्ाकलापः परंत ु र्ह भी कक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोदन के जबना एवं संजवधान के अनुच्छेद 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन ककए जबना वाजणजज्र्क र्ा औद्योजगक जवकास कक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा: परंत ु र्ह भी कक पाररजस्ट् थजतकी संवेदी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई ककसी त्रुरट को, मानीटरी सजमजत के जवचार प्राि करन े के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारन े की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को दी िाएगी: परंत ु र्ह भी कक उपर्ुाि त्रुरट को सुधारन े म,ें इस उप-पैरा में र्था उपबंजधत के जसवार्, ककसी भी दिा म ें भू- उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनप्रु र्क्तु र्ा अनुत् पादक कृजि क्षेत्रों म ें वनीकरण तथा पर्ावा ासों की बहाली के िायविलापों स े पुन: र्नीिरण िे प्रर्ास ककए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सज‍ मजलत की िाएगी और राज्र् सरकार द्वारा कदशा-जनदेश इस रीजत से तैयार किए िाएंर्े कक उसमें ऐसे क्षेत्रों म ें या उसिे पास जवकास कक्रर्ाकलापों को प्रजतजिद्ध और जनबंजधत ककर्ा गर्ा हो । (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेदी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन कक्रर्ाकलाप र्ा जवद्यमान पर्ाटन कक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेदी िोन संबंर्ी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेदी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी कक्रर्ाकलाप जन‍न ानुसार जवजनर्जमत ककए िाएंग,े अथाात:्- (i) संरजक्षत क्षत्रे की सीमा स े एक ककलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेदी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, ककसी होटल र्ा ररिॉटा का नर्ा सजन्नमाणा अनुमत नहीं ककर्ा िाएगाः परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा स े एि ककलोमीटर की दरू ी स े परे पाररजस्ट्थजतकी संवेदी िोन की सीमा तक पूवा पररभाजित और अभीजहत क्षेत्रों में पर्टा न महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेदी िोन के अन्द्दर सभी नए पर्ाटन कक्रर्ाकलापों र्ा जवद्यमान पर्टा न कक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी कदिाजनददेशिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी कदिाजनददेशिों (समर्-समर् पर र्था सिं ोजधत) के अनुसार6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] होगा; (iii) आंचजलक महार्ोिना का अनुमोदन होने तक, पर्ाटन के जवकास और जवद्यमान पर्टा न कक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत ककर्ा िाएगा और पाररजस्ट्थजतकी संवेदी िोन म ें ककसी नए होटल/ ररिॉट ा र्ा वाजणजज्र्क प्रजतष्ठान का संजन्नमााण अनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी िोन के अंतगता आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे कक िीन पूल ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरन,े दरदेश, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आकद की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंदर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रदिू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रदिू ण (जवजनर्मन और जनर्त्रं ण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेदी िोन में ध्वजन प्रदिू ण िी रोििाम और जनर्ंत्रण किया िाएर्ा । (7) वार् ु प्रदिू ण.- पाररजस्ट्थजतकी संवेदी िोन म,ें वार् ु प्रदिू ण िा जनवारण और जनर्ंत्रण, वार् ु (प्रदिू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार ककर्ा िाएगा । (8) बजहस्राव का जनथसरण.- पाररजस्ट्थजतकी संवेदी िोन म ें उपचाररत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रदिू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबधं ों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार ककर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेदी िोन म ें िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. का.आ. 1357(अ), कदनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार ककर्ा िाएगा; अकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी िोन स ेबाहर जचजन्द्हत ककए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से ककर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेदी िोन म ें मान्द्र् प्रौद्योजगककर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत ककर्ा िार्ेगा। (10) िैव जचककत्सा अपजशष्ट.- िैव जचककत्सा अपजिष्ट का प्रबंधन जनम्नानुसार ककर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेदी िोन म ें िैव जचककत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकाजित िैव जचककत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार ककर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेदी िोन म ें मान्द्र् प्रौद्योजगककर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैर् जचकित्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत ककर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार ककर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार ककर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेदी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार ककर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत ककर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना में जवििे उपबंध िाजमल ककए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोकदत होने तक, मानीटरी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की मानीटरी करेगी। (15) वाहन िजनत प्रदिू ण.- वाहन िजनत प्रदिू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार ककर्ा िाएगा। स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास ककए िाएगं े । (16) औद्योजगक ईकाइर्ा.ं - (i) सरकारी रािपत्र म ें इस अजधसचू ना के प्रकािन की तारीख को र्ा उसके बाद पाररजस्ट्थजतकी संवेदी िोन म ें ककसी नए प्रदिू णकारी उद्योग की स्ट्थापना िी अनुमजत नहीं होगी। (ii) िेन्रीय प्रदिू ण जनयंत्रण बोडव द्वारा फरर्री, 2016 म ें िारी समर्-समर् पर यिा संिोजधत मार्वदशवि जसद्धान्तों म ें उद्योर्ों िे र्र्ीिरण िे अनुसार, िब ति कि अजर्सूचना म ें इस प्रिार जर्जनर्दष्टव न हो, पाररजथिजतिी संर्ेदी िोन िे भीतर िेर्ल र्ैर- प्रदिू णिारी उद्योर्ों िो अनुज्ञात किया िाएर्ा और इसिे अजतररक्त, र्ैर प्रदिू णिारी उद्योर्ों िो बढ़ार्ा कदया िाएर्ा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार ककर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को दिाार्ा िाएगा जिनम ें ककसी भी संजनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें ककसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं दे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत ककए िान े वाल े कक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेदी िोन म ें सभी कक्रर्ाकलाप, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) और उसके अधीन बने जनर्मों के उपबंधों जिसम ें तटीर् जवजनर्मन िोन, 2011 एवं पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 िाजमल ह ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), अन्द्र् लाग ू जनर्मों तथा उनम ें ककए गए संिोधनों के अनुसार िाजसत होंगे और नीच ेदी गई सारणी म ेंजवजनर्दष्टा रीजत स े जवजनर्जमत होंगे, अथाात:् - उच्चतम न्द्र्ार्ालर् िे आदेश 4 अगस्ट्त, 2006 और 2012 िी ररट र्ाजचका (जसजवल) सं. 435 म ें गोवा फाउंडेिन बनाम भारत संघ के मामले म ें तारीख 21 अप्रलै , 2014 के आदेि के अनुसरण म ें होगा । 2. प्रदिू ण (िल, वार्,ु मृदा, ध्वजन, पाररजस्ट्थजतकी संवेदी िोन म ें कोई नर्ा उद्योग लगाने और वतामान आकद) उत्पन्न करन े वाल े उद्योगों की प्रदिू णकारी उद्योगों का जवस्ट्तार करने की अनमु जत नहीं होगीः स्ट्थापना । परन्त ु यह कि िेन्रीय प्रदिू ण जनयंत्रण बोडव द्वारा फरर्री, 2016 म ें िारी समर्-समर् पर यिा संिोजधत मार्वदशवि जसद्धान्तों म ें उद्योर्ों िे र्र्ीिरण िे अनुसार, िब ति कि अजर्सूचना म ें ऐसा जर्जनर्दष्टव न हों, पाररजथिजतिी संर्ेदी िोन िे भीतर र्ैर-प्रदिू णिारी उद्योर्ों िो अनुज्ञात किया िाएर्ा और इसिे अजतररक्त र्ैर-प्रदिू णिारी िुटीर उद्यार्ों िो बढ़ार्ा कदया िाएर्ा। 3. बडी िल जवद्युत पररर्ोिनाओं की प्रजतजिद्ध। स्ट्थापना । 4. ककसी पररसंकटमर् पदाथ ा का प्रर्ोग प्रजतजिद्ध। र्ा उत्पादन र्ा प्रस्ट्संकरण । 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र प्रजतजिद्ध। में अनुपचाररत बजहस्रावों का जनस्ट्सरण । 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट्तार अनुमत नहीं होगा । 7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। 8. िलावन लकड़ी का वाजणजज्र्क प्रजतजिद्ध। उपर्ोग । 9. वाजणजज्र्क संकेत बोडा और होर्डंग लार् ू जर्जर्यों िे अर्ीन प्रजतजिद्ध किया िाएर्ा। प्रबुद्ध संिेतबोडव और का प्रर्ोग । होर्डवर् िो ग्रामथिानों और नर्रों िे अंतर्वत प्रजतजिद्ध किया िाना चाजहए। 10. नए काष्ठ आधाररत उद्योग। पाररजस्ट् थजतक संवेदी िोन की सीमाओं के भीतर नए काष्ि आधाररत उद्योग की स्ट्थ ापना को अनुज्ञात नहीं ककर्ा िाएगा : तथाजप जवद्यमान काष्ठ आधाररत उद्योग लागू जवजध के अनुसार जनरंतर बने रहगें े। ख.जवजनर्जमत कक्रर्ाकलाप 11. होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन कक्रर्ाकलापों हते ु लघु अस्ट्थार्ी संरचनाओं के[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षत्रे की सीमा स े एक ककलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेदी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो की स्ट्थापना िी अनुमजत नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक ककलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेदी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू कदिाजनददेशिों के अनुसार सभी नए पर्ाटन कक्रर्ाकलाप करने र्ा जवद्यमान कक्रर्ाकलापों का जवस्ट्तार करन े की अनुज्ञा होगी । 12. संजनमााण कक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक ककलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेदी िोन के जवस्ट्तार तक िो भी जनकट हो, ककसी भी प्रकार का वाजणजज्र्क संजनमााण अनुमत नहीं ककर्ा िाएगा: परंतु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप परै ाग्राफ (1) में सूचीबद्ध कक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम म ें स्ट्थानीर् जनर्ाजसयों की आवासीर् आवश्र्कताओं को पूरा करने जलए संजनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार दी िाएगी: परन्द्त ु ऐसे लघ ु उद्योगों िो प्रदिू ण उत् पन्द् न नहीं करते ह,ैं से संबंजधत संजनमााण कक्रर्ाकलाप जवजनर्जमत ककए िाएंगे और लागू जनर्मों और जवजनर्मों, र्कद कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से ही न्द् र्ूनतम पर रखे िाएंग े । (ख) एक ककलोमीटर से आगे आंचजलक महार्ोिना की अनुसार जवजनर्जमत होंगे । 13. गैर प्रदिू णकारी लघ ुउद्योग। फरवरी, 2016 म ें केन्द्रीर् प्रदिू ण जनर्ंत्रण बोड ा द्वारा िारी, समर्- समर् पर यिा संिोजधत उद्योगों में वगीकरण के अनसु ार गैर- प्रदिू णकारी उद्योग और अपररसंकटमय, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, बार्र्ानी र्ा पाररजस्ट्थजतकी संवेदी िोन स े देिी सामग्री स े उत्पादों को उत्पन्न करन े वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनज्ञु ात होंगे। 14. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई केंरीर् र्ा संबंजधत राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 15. वन उत्पादों और गैर काष्ठ वन लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । उत्पादों का संग्रहण । 16. जवद्युत और संचार टॉवर लगान,े लागू जवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबछाने को तार-जबछाने तथा अन्द्र् बुजनर्ादी बढावा कदर्ा िाएगा)। ढाचं े की व्यवस्ट्था । 17. 18. जवद्यमान सड़कों को चौड़ा करना, लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध कदिाजनददेशिों के उन्द्ह ें सुदढृ बनाना और नई सड़कों अनुसार न्द्र्ूनीकरण उपार् ककए िाएंगे। का जनमााण। 19. पर्ाटन से संबंजधत अन्द्र् कक्रर्ाकलाप लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । िैसे कक पाररजस्ट्थजतकी संवेदी िोन क्षेत्र के ऊपर से गमा वार्ु के गुब्बारे, हले ीकाप्टर, ड्रोन, माइक्रोलाइट्स उड़ाना आकद। 20. पहाड़ी ढलानों और नदी तटों का लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । संरक्षण । 21. राजत्र म ें वाहन र्ातार्ात का संचलन लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा । । 22. स्ट्थानीर् िनता द्वारा अपनार्ी िा स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन अनमु त होंगे। रही वतामान कृजि और बागवानी पद्धजतर्ों के साथ डेर्ररर्ां, दग्ु ध उत्पादन, िल कृजि और मत्स्ट्र् पालन। 23. प्राकृजतक िल जनकार्ों र्ा भू क्षत्रे म ें िल जनकार्ों में उपचाररत अपजिष्ट िल/बजहस्रााव के जनस्ट्सरण से बचा उपचाररत अपजिष्ट िल/बजहस्रााव िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और पनु :उपर्ोग के का जनस्ट्सरण । प्रर्ास ककए िाएंग े अन्द्र्था उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सरण लागू जवजधर्ों के अनसु ार जवजनर्जमत ककर्ा िाएगा। 24. सतही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा के अधीन जवजनर्जमत होगा । 28. जवदेिी प्रिाजतर्ों को लाना । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । 29. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । 30. पोजलथीन बगै ों का उपर्ोग । issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for Draft Notification WHEREAS,the Bor Tiger Reserve is spread over an area of 138.11 square kilometers in the Wardha district andis located 40 kilometers away from Wardha district headquarters and 65 kilometers away from Nagpur in the State of Maharashtra; AND WHEREAS,Government of Maharashtra vide its Gazette Notification No. WLP. 0114/C.R.26/F-1,dated 16th August,2014; has declared Bor Tiger Reserve (Bor Wildlife Sanctuary, New Bor Wildlife Sanctuary and Extended New Bor Wildlife Sanctuary) under the provisions of section 38 (V) of Wildlife (Protection) Act, 1972 comprising of the following Sanctuaries in the state of Maharashtra namely : (i) Bor Wildlife Sanctuary (61.10 square kilometer) District Wardha and Nagpur (ii) New Bor Wildlife Sanctuary (60.69 square kilometer) District Wardha and Nagpur (iii) Extended New Bor Wildlife Sanctuary (16.32 square kilometer) District Wardha and Nagpur; AND WHEREAS, the State Government of Maharashtra vide its Gazette Notification No. WLP- 0815/C.R.261/F-1 dated 04th December, 2015 declared 678.14 square kilometer as the buffer area of Bor Tiger Reserve (Bor Wildlife Sanctuary, New Bor Wildlife Sanctuary& Extended New Bor Wildlife Sanctuary) under the provisions of section 38(V) of Wildlife (Protection), Act, 1972; AND WHEREAS, the Bor Tiger Reserve is known to harbor rich avifauna with about 160 species of birds including migratory and water birds.A number of territorial birds of Indian origin are also recorded from the area. The breeding of saras cranes (Antigone antigone) have been recorded from this region. Someimportant birds species recorded from the area are white-rumped vulture(Gyps bengalensis), golden oriole (Oriolus kundoo), brain-fever cuckoo (Hierococcyx varius), paradise fly catcher (Terpsiphone paradise), Egyptian vulture (Neophron percnopterus), red-headed vulture (Sarcogyps calvus), steppe eagle Aquila (Aquila nipalensis), Indian spotted eagle(Clanga hastata), river tern sterna (Sterna aurantia), black-headed Ibis (Treskiomis melanocephalus), painted stork (Myesteria leucocephala), woolly necked stork (Ciconia episcopus) etc; AND WHEREAS, the area has very high floral diversity represented by Southern Tropical Dry Deciduous Forests. The floral species present in the area include Kachnar (Bauhinia racemosa), Aonla (Phyllanthus emblica), Ain (Terminalia tomentosa), Behada(Terminalia bellerica), Bel (Aegle marmelos), Bistendu (Diospyros montana), Chironji (Buchanania lanzan), Gular (Ficus glomerata), Hirda (Terminalia chebula), Kusum (Schleichera oleosa), Lendia (Lagerstroemia parviflora), Palas (Butea frondosa), Salai (Boswellia serrata), Shiwan (Gmelina arbórea), Surya (Xylia xylocarpa), Tendu (Diospyros malanoxylon), Tondri (Casearia tomentosa), Warang (Kydia calycina), White kuda (Holarrhena anthidysentrica) etc; AND WHEREAS, the Bor tiger reserve records 30 species of mammals, 26 species of reptiles and many species of amphibian. It also supports important endangered and vulnerable wildlife such as tiger (Panthera tigris), leopard (Panthera pardus), sloth bear (Melursus ursinus), wild dog (Cuon alpines), four horned-antelope (Tetracerus quadricornis), sambar deer (Rusa unicolor) etc; AND WHEREAS,the extremely close vicinity of the above-mentioned sanctuaries to human habitation and ongoing developmental activities, necessitate the requirement of proper safeguards and control over such activities; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Bor Tiger Reserve which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 point of view and to prohibit industries or class of industries and their operations and processes in the said Eco- sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act)read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an areato an extent of 0.5 kilometerto 26.50 kilometersaround the boundary of Bor Tiger Reserveas Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-SensitiveZone. – (1) The Eco-Sensitive Zone shall be to an extent of 0.5 kilometreto 26.50 kilometre around the boundary of Bor Tiger Reserve and the area of the Eco-sensitive zone 678.14 square kilometres. (2) Theextent and boundary description of the Eco-sensitive Zone is appended as Annexure-I. (3) Map of Eco-Sensitive Zone of Bor Tiger Reservealong with geo-coordinates of prominent locations and land use pattern are appended as Annexure-II. (4) List of geo-coordinates of the boundary of Bor Tiger Reserve and its Eco-sensitive zoneis appended as Table A and B of Annexure-III. (5) The list of villages falling in the proposed Eco-Sensitive Zone is given in Annexure-IV. 2. Zonal Master Plan for Eco-SensitiveZone. - (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The buffer zone of the Bor Tiger Reserve shall form part of the Eco-sensitive Zone and the Tiger Conservation Plan shall also be taken into consideration during the preparation at the Zonal Master Plan. (4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:- (i) Forest and Wildlife; (ii) Environment; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Municipal; (viii) Maharashtra State Pollution Control Board. (5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (9) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) Promoted activities given under para 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the Union Territory Department of Tourism in consultation with the Union Territory Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental Actand rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.-Disposal and management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste. – Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. - The construction and demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste. - The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out with in accordance with applicable laws and efforts shall be made for use of cleaner fuel.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (16) Industrial units. – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Board in February 2016, as amended from time to time, unless so specified in this notification, and in addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. - The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. Setting of industries causing New industries and expansion of existing polluting industries in the pollution (Water, Air, Soil, Noise, Eco-SensitiveZone shall not be permitted: etc.). Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of major Prohibited hydroelectric project. 4. Use or production or processing Prohibited of any hazardous substance. 5. Discharge of untreated effluents Prohibited in natural water bodies or land area. 6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. 7. Setting up of brick kilns. Prohibited 8. Commercial use of firewood. B. Regulated Activities 11. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-Sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 13. Small scale non-polluting Non-polluting industries as per classification of industries issued by industries. the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 15. Collection of Forest Produce or Regulated under applicable laws. Non-Timber Forest Produce. 16. Monitoring Committee. - For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:— S. A representative of State Biodiversity Board Member; 10. Deputy Conservator of Forest, Nagpur Member; 11. Deputy Conservator of Forest, Wardha Member Secretary 6. Terms of Reference. – (1)The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.Supreme Court, etc. orders. -The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
