मक और Hwयाकलाप= पर कोई (cid:21)नबध| न अ(cid:30)धरोGपत नह(cid:8)ं करेगी जब तक Hक इस अ(cid:30)धसूचना मR Gव(cid:21)न(cid:4)द)Sट न ह= और आचं(cid:23)लक महायोजना मR सभी अवसंरचना Hwयाकलाप= मR द.ता और पाXरिCथ(cid:21)तक3य अनुकूलता का संवधन) करेगी । (6) आंच(cid:23)लक महायोजना मR अना}छा(cid:4)दत .ेJ= के जीण~Wार, Gव:यमान जल (cid:21)नकाय= के संर.ण, आवाह .ेJ= के (cid:26)बंधन, जल-संभर= के (cid:26)बंधन, भ-ू जल के (cid:26)बंधन, मदृ ा और नमी संर.ण, Cथानीय समुदाय= क3 आवNयकताओ ं तथा पाXरिCथ(cid:21)तक3 और पया)वरण से संबं(cid:30)धत ऐसे अ&य पहलूओ,ं िजन पर ]यान देना आवNयक है, के (cid:23)लए उपबंध ह=गे । (7) आंच(cid:23)लक महायोजना सभी Gव:यमान पूजा C थल=, pाम= और नगर(cid:8)य बंदोबCत=, वन= के (cid:26)कार और HकC म=, जनजा(cid:21)त .ेJ=, कृGष .ेJ=, ऊपजाऊ भू(cid:23)म, हXरत .ेJ जैसे उ:यान और उसी (cid:26)कार के C थान, उ:यान कृGष .ेJ, आHक)ड=, झील= और अ&य जल (cid:21)नकाय= का अ€यकंन करेगी । (8) आंच(cid:23)लक महायोजना पाXरिC थ(cid:21)तक संवेद(cid:8) जोन मR Gवकास को पाXरिC थ(cid:21)तक अनुकूल Gवकास और C थानीय समुदाय= क3 जीवकोपाजन) को सु(cid:21)निN चत करते हुए Gव(cid:21)नय(cid:23)मत होगी । (9) राजCथान रा^य सरकार अपने .ेJा(cid:30)धकार के अंतगत) .ेJ के (cid:23)लए आचं (cid:23)लक महायोजना तैयार करेगी । 3. रा8य सरकार 9वारा :कए जाने वाले उपाय-- रा^य सरकार इस अ(cid:30)धसूचना के उपबंध= को (cid:26)भावी करने के (cid:23)लए (cid:21)न(cid:22)न(cid:23)ल(cid:24)खत उपाय करेगी, अथा)त ् :-- (1) भ-ू उपयोग - पाXरिC थ(cid:21)तक संवेद(cid:8) जोन मR आमोद-(cid:26)मोद के (cid:26)योजन के (cid:23)लए (cid:30)चि&हत Hकए गए वन=, उ:यान-कृGष .ेJ=, कृGष .ेJ=, पाक(cid:129) और खुले Cथान= का वा(cid:24)णि^यक और औ:यो(cid:30)गक संबW Gवकास Hwयाकलाप= के (cid:23)लए उपयोग या संपXरवतन) नह(cid:8) ं होगा : परंत ु पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के भीतर कृGष भू(cid:23)म का संपXरवतन) मानीटर(cid:8) स(cid:23)म(cid:21)त क3 (cid:23)सफाXरश पर और रा^य सरकार के पूव ) अनमु ोदन स,े Cथानीय (cid:21)नवा(cid:23)सय= क3 आवासीय ज(cid:28)रत= को पूरा करने के (cid:23)लए और पैरा 4 क3 सारणी के Cतंभ (2) के अधीन wम स0ं 11, 17, 23, 28 और सं. 31 के सामने सूचीबW Hwयाकलाप= को पूरा करन े के (cid:23)लए अनु‚ात ह=गे, अथा)त ् :- (i) पाXरिCथ(cid:21)तक अनुकूल पयट) न Hwयाकलाप से संबं(cid:30)धत पय)टक= को अCथायी अ(cid:30)धभोग के (cid:23)लए वास-सुGवधा; (ii) Gव:यमान सड़क= को चौड़ा करना और सुƒढ़ करना तथा नई सड़क= का सं(cid:21)नमा)ण ; (iii) (cid:26)दषू ण उ;प&न न करने वाले लघु उ:योग; (iv) वषा) जल संचय; और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (v) कुट(cid:8)र उ:योग= मR pाम उ:योग, भंडारण क3 सुGवधा और Cथानीय सुख-सुGवधाएं सि(cid:22)म(cid:23)लत हL : परंत ु यह और भी Hक रा^य सरकार के पूव ) अनमु ोदन तथा संGवधान के अनु}छेद 244 और त;समय (cid:26)व;ृ त Gव(cid:30)ध के उपबंध= के अनुपालन के xबना, िजसके अंतगत) अनुसू(cid:30)चत जनजा(cid:21)त और अ&य परंपरागत वन (cid:21)नवासी (वन अ(cid:30)धकार= क3 मा&यता) अ(cid:30)ध(cid:21)नयम, 2006 (2007 का 2) भी है, वा(cid:24)णि^यक या उ:योग Gवकास Hwयाकलाप= के (cid:23)लए जनजातीय भू(cid:23)म का उपयोग अन‚ु ात नह(cid:8)ं होगा : परंत ु यह और भी Hक पाXरिC थ(cid:21)तक संवेद(cid:8) जोन के भीतर भ-ू अ(cid:23)भलेख= मR उपसंजात कोई Jु(cid:4)ट मानीटर(cid:8) स(cid:23)म(cid:21)त के Gवचार (cid:26)ाMत करने के पNचात ् रा^य सरकार :वारा (cid:26);येक मामले मR संशो(cid:30)धत होगी और उ(cid:13)त Jु(cid:4)ट के संशोधन क3 के&'(cid:8)य सरकार के पया)वरण, वन और जलवायु पXरवतन) मंJालय को सूचना देनी होगी । परंत ु यह और भी Hक उपय(cid:13)ु) त Jु(cid:4)ट का संशोधन मR इस उप पैरा के अधीन यथा उपबं(cid:30)धत के (cid:23)सवाय Hकसी भी दशा मR भ-ू उपयोग का पXरवतन) सि(cid:22)म(cid:23)लत नह(cid:8)ं होगा : परंत ु यह और भी Hक हXरत .ेJ मR जैसे वन .ेJ, कृGष .ेJ आ(cid:4)द मR कोई पाXरणा(cid:23)मक कटौती नह(cid:8)ं होगी और अन(cid:26)य(cid:13)ु त या अनु; पादक कृGष .ेJ= मR पुन: वनीकरण करने के (cid:26)यास Hकए जाएंगे । (2) $ाकृ)तक जल ?ोत -- आचं(cid:23)लक महायोजना मR सभी (cid:26)ाकृ(cid:21)तक जल „ोत= क3 पहचान क3 जाएगी और उनके संर.ण और पुननव) ीकरण के (cid:23)लए योजना को सि(cid:22) म(cid:23)लत Hकया जाएगा और रा^ य सरकार :वारा ऐसी र(cid:8)(cid:21)त से मागद) शक) (cid:23)सWांत बनाए जाएंगे िजससे Hक उन .ेJ= मR या इसके समीप Gवकास Hwयाकलाप को रोका जा सके जो ऐसे .ेJ के (cid:23)लए हा(cid:21)नकारक हL । (3) पयट(cid:4) न – (क) पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के भीतर पयट) न संबंधी Hwयाकलाप, जो पयट) न महायोजना के अनसु ार ह=गे, आंच(cid:23)लक महायोजना का भाग (cid:28)प मR ह=गे । (ख) पयट) न महायोजना रा^य सरकार के पयट) न Gवभाग :वारा रा^य सरकार के राजCव और वन Gवभाग के परामश ) से तैयार होगी । (ग) पयट) न संबंधी Hwयाकलाप (cid:21)न(cid:22) न(cid:23)ल(cid:24)खत के अधीन Gव(cid:21)नय(cid:23)मत ह=ग,े अथा)त ् :- (i) पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के भीतर सभी नए पयट) न Hwयाकलाप= या Gव:यमान पयट) न Hwयाकलाप= का GवCतार राS o(cid:8)य Q या… संर.ण (cid:26)ा(cid:30)धकरण, के&'(cid:8)य सरकार पया)वरण, वन और जलवायु पXरवतन) मंJालय :वारा जार(cid:8) (समय-समय पर यथा संशो(cid:30)धत) माग(cid:21))नदेश= के अनुसार होगा िजसमR पाXरिCथ(cid:21)तक पयट) न, पाXरिCथ(cid:21)तक (cid:23)श.ा और पाXरिCथ(cid:21)तक Gवकास को मह;व (cid:4)दया जाएगा और पाXरिCथ(cid:21)तक संवेद(cid:8) जोन क3 वहन .मता के अ]ययन पर आधाXरत होगा ; (ii) पाXरिCथ(cid:21)तक3य अनुकूल पयट) क Hwयाकलाप= के संबंध मR अC थायी अ(cid:30)धभोग के (cid:23)लए वास सुGवधा के (cid:23)सवाय सीतामाता व&यजीव अभयार[य क3 सीमा से एक Hकलोमीटर भीतर होटल और Xरसोट(cid:129) का नया सं(cid:21)नमा)ण अन‚ु ात नह(cid:8) ं होगा ; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forests and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at: - esz-mef@nic.in Draft Notification Whereas the Sitamata Wildlife Sanctuary situated in the South-East region of the State of Rajasthan in Chittorgarh and Pratapgarh districts at the junction of the Aravalli Hill range, Vindhyan Hill range and the Malwa Plateau and lying between 740 23’ E– 74040’ E longitude and 240 04’ N to 24023’ N latitude and spread over an area of 422.94 sq.kms. was notified as a sanctuary in the year 1979 vide Government of Rajasthan notification No. F11(9) Revenue/ Group-8/78 Jaipur, dated 02 January, 1979. . And Wheras, Sitamata forms the north -west limit for the teak-bamboo mixed forest and the species associated with it is one of the richest Sanctuary of flora and fauna. Nearly 50 species of reptiles, 9 species of Amphibians, 30 species of fishes listed so far from the sanctuary. Sitamata is known for medicinal plants, 108 species of medicinal plants, 275 species of birds and 800 species of plants already identified. 13 species of the 32 endangered medicinal plants issued by The National Medicinal Plant Board, New-Delhi. And Whereas this protected area, with its comparatively less undulating terrain and three perennial (Jakham, Sitamata and Karmoi) rivers provide habitat for the tropical moist deciduous plant species, which form micro habitat for the Aravalli Red Spur Fowl, Grey Jungle Fowl, Flying Squirrel and several other species of flora and fauna and is unique as it forms the distribution limit for many of species that have moved from Himalayas, Indo-Malayan and African regions, in addition to the elements from Western Ghats. And Whereas, it is necessary to regulate certain activities detrimental to the conservation of flora and fauna in the Sitamata Wildlife Sanctuary from environmental point of view, by declaring the Eco sensitive zone around it. Now Therefore, in exercise of the powers conferred in sub-section (1) read with clause (V) and clause (xiv) of sub-section (2) Section 3 of Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extant of 0.5 to 3 kms. around the boundary of the Sitamata Wildlife Sanctuary as Sitamata Wildlife Sanctuary Eco- sensitive Zone (herein after called “the Eco sensitive Zone”) details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area 172.45 sq kms. around the boundary of Sitamata Wildlife Sanctuary and the boundary description of such Zone is given in Annexure-I. (2) The Eco-sensitive Zone is spread across 58 villages falling in Chittorgarh, Pratapgarh and Udaipur districts of Rajasthan. (3) The list of villages falling within Eco-sensitive Zone is appended as Annexure-II. (4) The maps of the Eco-sensitive Zone along with latitudes and longitudes and GPS coordinates of boundary are appended as Annexure III-A and III-B respectively. (5) The details of GPS coordinates of the points along the boundary of the Sitamata Wilidlife Sanctuary and its eco-sensitive zone are appended as Annexure-III C. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the Competent Authority in the State Government.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; (ix) Rajasthan State Pollution Control Board; (x) Irrigation; and (xi) Public Works Department, for integrating environmental and ecological considerations into it. (6) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (8) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities. (10) The State Government of Rajasthan shall prepare Zonal Master Plan for area under its jurisdiction. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 11, 17,23,28 and 31 in column (2) of the Table in paragraph 4, namely:- (i) Accommodation for temporary occupation of tourists related to Eco-friendly tourists activity; (ii) Widening and strengthening of existing roads and construction of new roads; (iii) Small scale industries not causing pollution; (iv) Rainwater harvesting; and (v) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs and water courses-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Sitamata Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities: (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Rajasthan State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or Rajasthan State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial Units:- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the Law; (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks (1) (2) (3) Prohibited Activities 1. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. No renewal of licenses of existing saw mills on their expiry period. 3. Setting up of industries causing water or air No new or expansion of polluting industries in the Eco-sensitive or soil or noise pollution. Zone shall be permitted. 4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 5. Use or production of any hazardous Prohibited (except as otherwise provided) as per applicable laws. substances. 6. Fishing. There shall be complete ban on fishing in all the water bodies including Orai and Sitamata dam. 9. Use of Plastic carry bags. Prohibited with immediate effect. 10. Purchase of Tendu Patta. Prohibition on purchase of tendu Patta by contractors within 100 meters from the boundary of the sanctuary. No purchasing places (Fads) shall be earmarked at the time of auction of Tendu Patta units by the Forest Department. Regulated Activities 11. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco- sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan and guidelines of National Tiger Conservation Authority. 12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] activities listed in sub-paragraph (1) of paragraph 3; (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any; (c) Beyond one kilometre upto the extent of Eco-Sensitive Zone construction for bone fide local needs shall be permitted and other construction activities shall be regulated as per Zonal Master Plan. 13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder; (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 14. Commercial water resources including (a) The extraction of surface water and ground water shall be ground water harvesting. permitted only for bona fide agricultural use and domestic consumption of the occupier of the land; (b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority; (c) no sale of surface water or ground water shall be permitted; (d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 15. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone falling in the State of Rajasthan , which shall comprise of the following, namely:- (i) District collector, Pratapgarh - Chairman; (ii) District level officer of Public Works Department - Members; (iii) District level officer of Town Planning Department - Members; (iv) District level officer of Industries Department - Members; (v) Regional officer, Rajasthan State Pollution Control Board - Member; (vi) An expert in the area of ecology and environment to be nominated by the Government of Rajasthan for a period of one year in case -Member; (vii) A representative of Non-Governmental Organisation working in the field of environment to be nominated by the Government of Rajasthan for a period of one year in case -Member; (viii) Honorary wildlife warden - Member; (ix) Assistant Conservator of Forests, Sitamata Wildlife Sanctuary - Member-Secretary 6. Terms of Reference: (1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification. (2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collectors or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
