तालाकावेरी व(cid:20)य जीव अभयारJय पिI चमी घाट का के(cid:20)(cid:21) Qबद ुह 6िजसक(cid:30) िवशेषता 35 (cid:8)ितशत से अित ढाल वाले अभयारJ य
(cid:29)े4 के 85 (cid:8)ितशत से अिधक का भू भाग ऊबड खाबड है, और िजसम> 6000 िम.िम. से 7000 साधारण मीटर के बीच उU च वषा(cid:25) होती ह,ै
समृD जैव िविवधता -थ ानीक वाद के उUच दर और चीता, मालावार िबलाव, बाघ, लघु पुU छ वानर, N वागं , नीलिगरी माट(cid:25)न, जंगली
कुNत ा, एिशयाई हाथी, पंजा रिहत ऊदिबलाव जैसी नाजुक (cid:10)प से संकटX- त और संकटX- त (cid:8)जाितय( के िलए आYय है ।

महNव पूण(cid:25) खग (cid:29)े4 के (cid:10)प म> पहचाना गया ह ै । और अभयारJ य म> दशे ज और संकटX- त पेिपिलयन िनड िततिलयां जैसे मालाबार
लहरदार मोर, पे!रस मोर, मालाबार काला कौआ और मालाबार लहरदार अबािबल पुU छी िततली तथा वय- क प(cid:29)ी िजसम> मालाबार
पाइड होन(cid:25) िबल, मालाबार भूरी होन(cid:25)िबल मालाबार सदा सुहािगन, मालाबार िचलिबल, \ यानंद िचलिबल, I वेत उदर वाला तjपाई,
आर>ज और 5ल ैक eलाईकैचर तथा नीलिगरी eलाईकैचर को भी आYय िमलता है ।
संरि(cid:29)त (cid:29)े4 कावेरी नदी के िलए आवाह (cid:29)े4 ह ै जो तालाकावेरी से िनकलती ह ै और अभयारJ य डोडाहोल, नाडूबेलहोल,
िबटेमेलहोल, कुमेकोली और मुंडराहोल जैसी बारहमासी स!रताk के िलए एक महN वपूण(cid:25) (cid:29)े4 के (cid:10)प म> भी काय(cid:25) करता ह ैजो तालाकावेरी
व(cid:20)य जीव अभयारJय #ारा दी गई पा!रि-थ ितक(cid:30) (cid:8)णाली सेवाk के महNव का वण(cid:25)न करती ह 6।
और, वीर ऐशवान व(cid:20)यसजीव अभयारJय के चार( ओर के (cid:29)े4 को, िजसका िव-तार और सीमाएं इस अिधसूचना के पैरा 1 म>

(cid:8)द% शि’य( का (cid:8)योग करते +ए, कना(cid:25)टक रा_ य म> तालाकावेरी व(cid:20) य जीव अभयारJ य के इद(cid:25)िगद (cid:25) 0.1 2कलोमीटर से 15.225
2कलोमीटर क(cid:30) सीमा तक के (cid:29)े4 को तालाकावेरी व(cid:20) य जीव अभयारJ य पा!रि-थितक(cid:30) संवेदी जोन (िजसे इसम> इसके पI चात्
पा!रि-थितक(cid:30) संवेदी जोन कहा गया ह)ै के (cid:10)प म> अिधसूिचत करती ह,ै िजसके 5 यौरे िन(cid:3)ानुसार ह,ै अथा(cid:25)त् :--

(2) पा!रि-थ ितक(cid:30) संवेदी जोन म> आने वाले छह गांव( िजसके (cid:8)मुख Qबदkु के िनदशn ांक उउउउपपपपााााबबबबधधंंधधंं II के (cid:10)प म> संलf न ह 6।
(3) अ(cid:29)ांश और देशांतर रेखा के साथ-साथ पा!रि- थितक(cid:30) संवेदी जोन क(cid:30) सीमा का मानिच4 उउउउपपपपााााबबबबंधंधंधंध III के (cid:10)प म> संलf न ह ै।

अंितम अिधसूचना के (cid:8)काशन क(cid:30) तारीख से दो वष(cid:25) क(cid:30) अविध के भीतर -थानीय लोग( से परामश(cid:25) करके और इस अिधसूचना म> 2दए गए
अनुबंध( का पालन करते +ए एक आंचिलक महायोजना तैयार करेगी ।
(2) उbत योजना का रा_य सरकार म> स(cid:29)म (cid:8)ािधकारी #ारा अनुमोदन क(cid:30) जाएगी ।
(3) पा!रि-थितक(cid:30) संवेदी जोन क(cid:30) उb त महायोजना रा_ य सरकार #ारा ऐसी रीित से जो इस अिधसूचना म> िविनEद] ट 2क या जाए
और सुसंगत के(cid:20)(cid:21) ीय और रा_य िविधय( के और के(cid:20)(cid:21) ीय सरकार #ारा जारी माग(cid:25)दशO िसDांत( के अनु(cid:10)प तैयार 2क या जाएगा ।
(4) आंचिलक महायोजना इसम> पया(cid:25)वरण और पा!रि- थितक(cid:30) क(cid:30) बात( को समाकिलत करने के िलए सभी संबंिधत रा_ य िवभ ाग( के
परामश(cid:25) से तैयार 2कय ा जाएगा, अथा(cid:25)त् :--
(i) पया(cid:25)वरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पय(cid:25)टन ;
(v) नगरपािलका ;
(vi) राज- व ;
(vii) कृिष ; और
(viii) कना(cid:25)टक रा_य (cid:8)दषू ण िनयं4ण बोड(cid:25);
(ix) Qसचाई; और
(x) लोक िनमा(cid:25)ण िवभाग ।
(5) उbत योजना म> जब तक इस अिध सूचना म> ऐसा िव ?न 2द] ट न हो तब तक अनुमो2द त िवl मान भू-उपयोग, अवसंरचना और
2pयाकलाप( पर कोई िनबqधन अिधरोिपत नहr 2क या जाएगा और आंचिलक महायोजना सभी अवसंरचना के सुधार और अिधक द(cid:29) तथा
पा!रि-थ ितक(cid:30) अनुकूल होने वाले 2pयाकलाप इस (cid:8)कार िविनEद] ट न हो ।
(6) उbत योजना म> अनाUछा2दत (cid:29)4े ( के जीणmDार, िवlमान जल िनकाय( के संर(cid:29)ण, आवाह (cid:29)े4( के (cid:8)बंधन, जल-संभर( के
(cid:8)बंधन, भूतल जल के (cid:8)बंधन, मृदा और नमी संर(cid:29)ण, -थानीय समुदाय( क(cid:30) आवIयकताk तथा पा!रि-थितक(cid:30) और पया(cid:25)वरण से संबंिधत
ऐसे अ(cid:20)य पहलूk, िजन पर sयान दने ा आवIयक ह,ै के िलए 5 यौरे उपल5 ध ह(गे ।
(7) उbत योजना सभी िवlमान पूजा -थ ल(, Xाम( और नगरीय बंदोब-त(, वन( के (cid:8)कार और 2क- म(, जनजातीय (cid:29)े4( कृिष (cid:29)े4(,
ऊपजाऊ भिूम, ह!रत (cid:29)े4 जैसे उlान और उसी (cid:8)कार के - थान, उlान कृिष (cid:29)े4, फलोlान, झील( और अ(cid:20)य जल िनकाय( का अ‘यकंन
करेगी ।
(8) उbत योजना पा!रि-थितक(cid:30) संवेदी जोन म> िवकास को िविनयिमत करेगी िजससे पा!रि- थितक(cid:30) अनुकूल िवकास - थानीय
समुदाय( क(cid:30) जीवकोपाज(cid:25)न सुर(cid:29)ा के िलए सुिनिIच त 2कया जा सके ।
3. रररराााा(cid:22)(cid:22)(cid:22)(cid:22)यययय ससससररररककककाााारररर (cid:24)(cid:24)(cid:24)(cid:24)ाााारररराााा (cid:25)(cid:25)(cid:25)(cid:25)ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेेेे उउउउपपपपाााायययय-------- रा_य सरकार इस अिधसूचना के उपबंध( को (cid:8)भावी करने के िलए िन(cid:3)िलिखत उपाय
करेगी, अथा(cid:25)त् :--
(1) भभभभ---ूू-ूूउउउउपपपपययययोोोोगगगग ---- पा!रि-थितक(cid:30) संवेदी जोन म> आमोद-(cid:8)मोद के (cid:8)योजन के िलए िचि(cid:20)हत 2कए गए ह 6वन(, उlान-कृिष (cid:29)े4(, कृिष (cid:29)े4(,
पाकt और खुले -थान( का वािणि_यक और औlोिगक संबD िवकास 2pयाकलाप( के िलए उपयोग या संप!रवत(cid:25)न नहr होगा :
परंतु पा!रि-थितक संवेदी जोन के भीतर कृिष भूिम का संप!रवत(cid:25)न, मानीटरी सिमित क(cid:30) िसफा!रश पर और रा_य सरकार के पूव(cid:25)
अनुमोदन से, -थानीय िनवािसय( क(cid:30) आवासीय ज(cid:10)रत( को पूरा करने के िलए और पैरा 4 क(cid:30) सारणी के -तंभ (2) के अधीन मद सं. 12,
18, 24, 29 और सं. 32 के सामने सूचीबD 2pयाकलाप( को पूरा करने के िलए अनुuात ह(गे, अथा(cid:25)त् :-
(i) पा!रि-थितक(cid:30) अनुकूल पय(cid:25)टन 2p याकलाप( के िल ए, पय(cid:25)टक( के अ- थायी अिध भोग के िलए पा!रि-थितक(cid:30) अनुकूल कुटीर
जैसे टे(cid:20) ट, का] ट गृह;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) िवlमान सड़क( को चौड़ा करना तथा उनका सदढृ ीकरण,
(iii) (cid:8)दषू ण उNपv न करने वाले लघु उlोग,
(iv) वषा(cid:25) जल संचय, और
(v) कुटीर उlोग, िजसके अंतग(cid:25)त Xामीण उlोग भी ह6 :
परंतु यह और 2क रा_य सरकार के पूव(cid:25) अनुमोदन और संिवधान के अनुU छेद 244 या तNसमय (cid:8)वृ% िविध के उपबंध( के
अनुपालन के िबना, िजसके अंतग(cid:25)त अनुसूिचत जनजाित और अ(cid:20)य परंपरागत वन िनवासी (वन अिधकार( क(cid:30) मा(cid:20)यता) अिधिनयम, 2006
(2007 का 2) भी है, वािणि_यक या उlोग िवकास 2pयाकलाप( के िलए जनजातीय भूिम का उपयोग अनुuात नहr होगा :
परंतु यह भी 2क पा!रि-थितक(cid:30) संवेदी जोन के भीतर भू-अिभलेख( म> (cid:8)तीत होने वाली कोई 4ु!ट, मानीटरी सिमित के िवचार
(cid:8)ा8 करने के प9ात् रा_य सरकार #ारा (cid:8)Nयेक मामले म> केवल एक बार ठीक क(cid:30) जाएगी और उ’ 4ु!ट के ठीक करने क(cid:30) के(cid:20) (cid:21)ीय सरकार
के पया(cid:25)वरण, वन और जलवायु प!रवत(cid:25)न मं4ालय को सूचना देनी होगी ।
परंतु यह भी 2क उपयु(cid:25)’ 4ु!ट का संशोधन म> इस उप पैरा के अधीन यथा उपबंिधत के िसवाय 2कसी भी दशा म> भू-उपयोग का
प!रवत(cid:25)न सिwमिलत नहr होगा ।
परंतु यह भी 2क िजससे ह!रत (cid:29)े4 जैसे वन (cid:29)े4 और कृिष (cid:29)े4 म> कोई पा!रणािमक कटौती नहr होगी और अनुपयुb त या
अनुNप ादक कृिष (cid:29)े4( म> पुन: वनीकरण करने के (cid:8)यास 2कए जाएंगे ।
(2) (cid:1)(cid:1)(cid:1)(cid:1)ााााककककृृृृििििततततकककक जजजजलललल (cid:31)(cid:31)(cid:31)(cid:31)ोोोोतततत- आचंिलक महायोजना म> सभी (cid:8)ाकृितक जल xोत( के आवाह (cid:29)े4( क(cid:30) पहचान क(cid:30) जाएगी और उनके संर(cid:29)ण और
नवीकरण के िलए योजना सिwम िलत होगी और रा_ य सरकार #ारा इन (cid:29)े4( पर या उनके िनकट िवकास 2pयाकलाप(, जो ऐसे (cid:29)े4( के
िलए हािनकारक ह,6 को (cid:8)ितिषD करने के िलए ऐसी रीित से माग(cid:25)िनदशn तैयार 2कए जाएंगे ।
(3) पपपपयययय!ट!ट!ट!टनननन –––– (क) पा!रि-थितक संवेदी जोन के भीतर पय(cid:25)टन संबंधी 2pयाकलाप, जो आंचिलक महायोजना का भाग (cid:10)प ह(गे ।
(ख) पय(cid:25)टन महायोजना पय(cid:25)टन िवभाग, कना(cid:25)टक सरकार के वन और पया(cid:25)वरण िवभाग, के परामश(cid:25) से तैयार होगी ।
(ग) पय(cid:25)टन संबंधी 2pयाकलाप िनw निलिखत के अधीन िविनयिमत ह(गे, अथा(cid:25)त् :-

व(cid:20)यजीव अभयारJय क(cid:30) सीमा से एक 2कलोमीटर भीतर होटल और !रसोटt का नया संिनमा(cid:25)ण अनुuात नहr होगा;
परंतु संरि(cid:29)त (cid:29)े4 क(cid:30) सीमा से एक 2कलोमीटर क(cid:30) दरू ी से परे पा!रि-थितक(cid:30)य संवेदी जोन क(cid:30) सीमा तक नए होटल
और !रसोट (cid:25) के -थापन पय(cid:25)टन महायोजना के अनुसार पा!रि-थितक(cid:30)य पय(cid:25)टन सुिवधा के िलए पूव(cid:25) प!रभािषत और िविनEद@
-थान म> ही अनुuात 2कया जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन 2कए जाने तक, पय(cid:25)टन के िलए िवकास और िवlमान पय(cid:25)टन 2pयाकलाप( के िव-तार
को वा-तिवक -थल िविनEद@ संवी(cid:29)ा तथा मानीटरी सिमित क(cid:30) िसफा!रश पर आधा!रत संबंिधत िविनयामक (cid:8)ािधकरण( #ारा
अनुuात 2कया जाएगा ।

New Delhi, the 13th January, 2016
S.O. 142(E).— The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified
to the Secretary, Ministry of Environment, Forests and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Draft Notification
WHEREAS, the Talacauvery Wildlife Sanctuary situated in western side of Coorg District, Karnataka lies
between North Latitudes 120 17’ 14” to 120 26’ 38” and the East Longitudes 750 25’ 23” to 750 33’ 15” notified vide
AHFF 173 FWL 87 (I) dated 31-08-1987 under the provisions of the sub-section (1) of section 18 of the Wildlife
(Protection) Act, 1972 is spread over an area of 105.59 square kilometres.
AND WHEREAS, the Talacauvery Wildlife Sanctuary forming the core of western ghats is
characterized by rugged terrain with more than 85% of the sanctuary area having very steep slope of
more than 35%, high rainfall ranging between 6000 mm to 7000 mm, rich biodiversity, high rate of
endemism and home for critically endangered and endangered species like Tiger, Malabar Civet, Lion
tailed macaque, Slender loris, Nilgiri Marten, Wild Dog, Asian Elephant, Clawless Otter respectively.
AND WHEREAS, the sanctuary being surrounded by many reserve forests like Patti Ghat and
Padinalknadu reserved forests, the sanctuary provides extended habitat for large mammalia like Asian
Elephant and Tiger and forms part of the Mysore Elephant Reserve declared under the Project¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 15
Elephant. It acts as an important corridor for large mammals to move between Nagarahole National
Park and Talacauvery Wildlife Sanctuary in Karnataka and Wayanad and Aralam Wildlife Sanctuaries
in Kerala state.
AND WHEREAS, the sanctuary area has a very high Floral and Faunal diversity, the
sanctuary largely consists of evergreen and semi-evergreen forests interspersed with shola grasslands
[1A/C , 2A/C , 1A/C , 8A (C1/DS1) of Champion and Seth classification] and the vegetation

comprises of very important species like Dipterocarpus indicus, Antiaris toxicaria, Kingiodendron
pinnatum, Diospyrous ebenum, Alstonia scholaris, Bischofia javanica, Calophyllum apetalum,
Cinnamomum zeylanicum, Dalbergia latifolia, Lagerstroemia lanceolata, Pterocarpus marsupium,
Vateria indica, Elaeocarpus sp., Knema attenuate, Myrstica sp., Palaquium ellipticum, Garcinia sp.,
Machilus macarantha, Mesua ferrea, Hopea parviflora, Dysoxylum malabaricum, Cannarium
strictum, Xanthoxylum tetraspermum, Calophyllum apetulum, Arenga whitii, Cossinium fenustratum,
Hydnocarpus pentandra, Moullava spicata, Mapia foetida, Gnetum ula, etc.
AND WHEREAS, the large mammals found in the sanctuary include Tiger, Leopard, Wild
Dog, Elephant, Gaur, Sambar, and Barking deer and smaller mammals include Lion tailed macaque,
Nilgiri langur, Nilgiri Marten, Clawless otter, Brown palm civet, Leopard cat, Slender loris, Travancore
flying squirrel and others and wildlife includes King cobra, Indian rock python.
AND WHEREAS, the sanctuary has been identified as one of the important bird areas in the
Western Ghats as 13 of the 16 endemic birds of the Western Ghats are found here and the sanctuary
also harbours endemic and endangered Papilionid butterflies viz, Malabar banded peacock, Paris
peacock, Malabar raven, and Malabar banded swallowtail and major birds includes Malabar pied
hornbill, Malabar grey hornbill, Malabar trogon, Malabar whistling thrush, Wyanaad laughing thrush,
white-bellied tree-pie, orange and black flycatcher and Nilgiri flycatcher.
AND WHEREAS, this protected area is catchment for river Cauvery which originates from Talacauvery and the
sanctuary also acts as an important catchment area for Perennial streams like Dodda Hole, Nadumale Hole, Betemale
Hole, Kume Kolli and Mundra Hole which depicts the importance of eco-system services offered by Talacauvery
wildlife sanctuary.
AND WHEREAS, it is necessary to conserve and protect the geographical area the extent and boundaries of
which is specified in paragraph 1 of this notification around the protected area of Talacauvery Wildlife Sanctuary as
Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and
their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the power conferred by sub-section (1) and clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent
varying from 0.1 km to 15.225 kms around the boundary of Talacauvery Wildlife Sanctuary in the State of Karnataka as
the Talacauvery Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of
which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The area of Eco-Sensitive Zone is 105.671 square kilometres
with an extent varying from 0.1 kilometres to 15.225 kilometres around the boundary of Talacauvery Wildlife Sanctuary
and the boundary details of such Zone are given in Annexure-I.
(2) The list of six villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is
appended as Annexure-II.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as
Annexure-III.
(4) Key locations on the eco-sensitive zone boundary as well as on the sanctuary are appended as Annexure-IV.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

(2) The said Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment,
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue,
(vii) Agriculture,
(viii) Karnataka State Pollution Control Board,
(ix) Irrigation,
(x) Public Works Department.
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural
areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 12, 18, 24, 29 and 32 in column (2)
of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly
tourism activities,
(ii) Widening and strengthening of existing roads and construction of new roads.
(iii) Small scale industries not causing pollution,
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided that no use of tribal land shall be permitted for commercial and industrial development activities
without the prior approval of the State Government and without compliance of the provisions of article 244 of the India
or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition
of Forest Rights) Act, 2006 (2 of 2007):
Provided further that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the
State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to
such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests
and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Talacauvery Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly
tourism activities:
Provided that beyond the distance of one kilometre from the boundary of the protected areas till the extent of the
eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated
areas for eco-tourism facilities as per Tourism Master Plan.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of final notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board
shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with
the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under.
(7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board
shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time
to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall
be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the table below, namely:-

13. Construction activities. (a) No new commercial construction of any kind shall be
permitted within one kilometre from the boundary of the
protected area:
Provided that, local people shall be permitted to
undertake construction in their land for their residential use
including the activities listed in sub-paragraph (1) of
paragraph 3:
(b) The construction activity related to small scale
industries not causing pollution shall be regulated and kept
at the minimum, with the prior permission from the
competent authority as per applicable rules and regulations,
if any.
(c) Beyond one kilometer upto the extent of Eco-sensitive
Zone construction for bone fide local needs shall be
allowed and other construction activities shall be regulated
as per Zonal Master Plan.
(d) Construction activity in the Eco-sensitive zone shall be
as per Zonal Master Plan.
14. Felling of trees. (a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the competent authority in the State
Government;
(b) The felling of trees shall be regulated in accordance
with the provisions of the concerned Central or State Acts
and the rules made thereunder.
(c) In case of Reserve Forests and Protected Forests the

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

2. Hon’ble Member of Legislative Assembly, Madikeri Constituency, Kodagu District – Member
3. Representative of the Department of Environment, Government of Karnataka – Member;
4. Representative of the Department of Urban Development, Government of Karnataka –Member;
5. Representative of Non-governmental Organizations working in the field of natural
conservation (including heritage conservation) to be nominated by the Government of
Karnataka for a period of one year – Member;
6. The Regional Officer, Karnataka State Pollution Control Board, Mysore – Member;
7. One expert in Ecology from reputed Institution or University of the State of Karnataka
to be nominated by the Government of Karnataka for a period of one year – Member;
8. Deputy Commissioner or his representative, Kodagu District, Madikeri – Member
9. The Deputy Conservator of Forests, Madikeri Wildlife Division, Madikeri – Member-Secretary.
6. Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this
notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at
Annexure-V.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal .

Boundary Description of Talacauvery Wildlife Sanctuary
North and East: The Eco-Sensitive zone boundary of Talacauvery Wildlife Sanctuary starts at a point on the D line of
the Patti Ghat reserve forest which is also the starting point of Pattighat reserve forest and runs in north eastern and
eastern direction all along the northern, eastern and southern boundary of Pattighat reserve forest till it reaches a point
bearing GPS co-ordinates N-12.422073, E-75.504575 at Bhagamandala village.
Then the Eco Sensitive Zone boundary runs at a width of 100 meters all along the eastern and south eastern
boundary of Talacauvery Wildlife Sanctuary through Bhagamandala, Thannimani and Forest, Cherangala,
Sannapulikotu, Aiyangeri and Forest and Perur villages till it reaches a point bearing GPS co-ordinates N-12.306759, E-
75.552426 at Perur Village. The line then runs in Southern direction and touches eastern boundary of Padinalknadu
Reserve forest. Then the boundary move in south-eastern direction all along the eastern boundary Padinalknad reserve

South and West:- Then the boundary runs in western direction all along Iyangeri village boundary till it reaches a point
on the western boundary of Padinalknadu reserve forest and Later the line runs in the northern direction all along the
