म6 अंितम अिधसूचना के (cid:7)काशन क(cid:24) तारीख से दो वष(cid:17) क(cid:24) अविध के भीतर, %थानीय 5ि(cid:31)य के परामश (cid:17) से और इस
अिधसूचना म6 संलoन अनुबंध के सामंज%य स ेआंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना राnय सरकार म 6स(cid:23)म (cid:7)ािधकारी (cid:27)ारा अनमु ो)दत होगी ।
(3) राnय सरकार (cid:27)ारा पा(cid:25)रि%थ ितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसचू ना म 6 िविन<दpट
(cid:9)प तथा सुसंगत क6(cid:14)ीय और राnय िविधय के सामजं % य और क6(cid:14)ीय सरकार (cid:27)ारा जारी माग(cid:17)िनदशk , य)द कोई ह , (cid:27)ारा
तैयार होगी ।
(4) आंचिलक महायोजना, पया(cid:17)वरणीय और पा(cid:25)रि% थितक(cid:24)य िवचार को समाकिलत करने के िलए राn य सरकार के सभी
संब; िवभाग के परामश (cid:17)स ेतयै ार होगी, अथा(cid:17)त्:--
(i) पया(cid:17)वरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पय(cid:17)टन ;
(v) नगरपािलक ;
(vi) राज%व ;
(vii) कृिष ;
(viii) मCय (cid:7)दशे राnय (cid:7)दषू ण िनयं,ण बोड (cid:17);
(ix) qसचाई; और

(5)आंचिलक महायोजना अनमु ो)दत िवaमान भू-उपयोग, अवसंरचना और )lयाकलाप पर कोई िनबधr न अिधरोिपत नहs
करेगी जब तक )क इस अिधसचू ना म 6 िविन<दp ट न हो और आचंिलक महायोजना सभी अवसरं चना और )lयाकलाप म6 और
अिधक द(cid:23)ता और पा(cid:25)रि%थ ितक(cid:24)य अनुकूलता का सवं ध(cid:17)न करेगी ।
(6) आंचिलक महायोजना म 6अनाtछा)दत (cid:23)े, के जीणb;ार, िवaमान जल िनकाय के संर(cid:23)ण, आवाह (cid:23)े, के (cid:7)बंधन,
जल-सभं र के (cid:7)बंधन, भूतल जल के (cid:7)बंधन, मदृ ा और नमी सरं (cid:23)ण, %थानीय समुदाय क(cid:24) आवUयकताj तथा पा(cid:25)रि%थितक(cid:24)
और पया(cid:17)वरण से संबंिधत ऐस ेअ(cid:13)य पहलjू , िजन पर Cयान दने ा आवUयक ह,ै के िलए उपबंध ह गे ।
(7) आंचिलक महायोजना सभी िवaमान एव ं (cid:7)% तािवत पूजा % थल , Tाम और नगरीय बंदोब%त , वन के (cid:7)कार और
)क%म , कृिष (cid:23)े, , ऊपजाऊ भिू म, ह(cid:25)रत (cid:23)े, जसै े उaान और उसी (cid:7)कार के % थान, उaान कृिष (cid:23)े,, फलोधान, झील
और अ(cid:13)य जल िनकाय का अxयकंन करेगी ।
(8) आंचिलक महायोजना %थ ानीय समुदाय क(cid:24) जीवकोपाज(cid:17)न को सुिनिU चत करने के िलए, पा(cid:25)रि%थितक संवेदी जोन म 6
िवकास को पा(cid:25)रि%थितक अनकु ूल िवकास के िलए िविनयिमत करेगी ।

)कए गए पाकy और खुले %थान का वािणिnयक और औaोिगक संब; िवकास )lयाकलाप के िलए उपयोग या संप(cid:25)रवतन(cid:17)
नहs होगा :
परंत ु पा(cid:25)रि%थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:25)रवत(cid:17)न, मानीटरी सिमित क(cid:24) िसफा(cid:25)रश पर और राnय सरकार के
पूव(cid:17) अनमु ोदन से, %थानीय िनवािसय क(cid:24) आवासीय ज(cid:9)रत को पूरा करन े के िलए और पैरा 4 क(cid:24) सारणी के %तंभ (2) के
अधीन मद स0ं 13, 18, 24, 29 और सं. 32 के सामन ेसूचीब; )lयाकलाप को पूरा करन ेके िलए अनुzात ह गे, अथा(cid:17)त ्:-
(i) पा(cid:25)रि%थ ितक अनुकूल पय(cid:17)टन )lयाकलाप के िलए पय(cid:17)टक के अ% थायी आवासन के िलए पा(cid:25)रि% थितक
अनकु ूल आरामगाह जैस ेट6ट, लकड़ी के मकान आ)द ;
(ii) िवaमान सड़क को चौड़ा और सुदढ़ृ बनाना ।
(iii) (cid:7)दषू ण का(cid:25)रत न करने वाले लघु उaोग ;
(iv) वषा (cid:17)जल संचयन, और
(v) कुटीर उaोग, िजसके अंतग(cid:17)त Tामीण उaोग, सिु वधा भंडार और % थानीय सुख-सिु वधाए ंह 0:
परंत ु यह और )क जनजातीय भिू म का उपयोग राnय सरकार के पूव(cid:17) अनुमोदन और संिवधान के अनtु छेद 244 या तOसमय
(cid:7)वृ(cid:29) िविध के उपबंध के अनपु ालन के िबना, िजसके अंतग(cid:17)त अनुसिू चत जनजाित और अ(cid:13)य परंपरागत वन िनवासी (वन
अिधकार क(cid:24) मा(cid:13)यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिnयक या उaोग िवकास )lयाकलाप के िलए अनुzात
नहs होगा :
परंत ु यह और भी )क पा(cid:25)रि%थ ितक संवेदी जोन के भीतर भ-ू अिभलेख म 6 उपसंजात कोई ,ु(cid:25)ट, मानीटरी सिमित के िवचार
(cid:7)ा2 करन ेके प3ात् राnय सरकार (cid:27)ारा (cid:7)Oयके मामल ेम 6एक बार संशोिधत होगी और उ(cid:31) ,ु(cid:25)ट के संशोधन क(cid:24) सूचना भारत
सरकार के पया(cid:17)वरण, वन और जलवाय ुप(cid:25)रवत(cid:17)न मं,ालय को दने ी होगी ।
परंत ु यह और भी )क उपयु(cid:17)(cid:31) ,ु(cid:25)ट का संशोधन म 6 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय )कसी भी दशा म 6 भ-ू
उपयोग का प(cid:25)रवत(cid:17)न सिVमिलत नहs होगा ।
परंत ु यह और भी )क िजसस े ह(cid:25)रत (cid:23)े, म 6 जैस े वन (cid:23)े,, कृिष (cid:23)े, आ)द म6 कोई पा(cid:25)रणािमक कटौती नहs होगी और

पुन~(cid:127)भूतकरण के िलए योजना सिVम िलत होगी और राn य सरकार (cid:27)ारा ऐसे (cid:23)े, पर या उनके िनकट िवकास )lयाकलाप
(cid:7)ितिष; करन ेके िलए ऐसी रीित स ेमाग(cid:17)िनदशk तैयार )कए जाएंगे ।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन –––– (क) पा(cid:25)रि%थितक संवेदी जोन के भीतर पय(cid:17)टन संबंधी )lयाकलाप पय(cid:17)टन महायोजना के अनुसार ह गे जो )क
आंचिलक महायोजना के भाग (cid:9)प म 6होगी ।
(ख) पय(cid:17)टन महायोजना पय(cid:17)टन िवभाग, मCय (cid:7)दशे (cid:27)ारा राज%व और वन िवभाग के परामश (cid:17)से तयै ार होगी ।
(ग) पय(cid:17)टन संबंधी )lयाकलाप िनVन िलिखत के अधीन िविनयिमत ह ग,े अथा(cid:17)त् :-
(i) पा(cid:25)रि%थितक संवेदी जोन के भीतर सभी नए पय(cid:17)टन )lयाकलाप या िवaमान पय(cid:17)टन )lयाकलाप का िव%तार क6(cid:14)
सरकार के पया(cid:17)वरण, वन और जलवाय ु प(cid:25)रवत(cid:17)न मं,ालय के माग(cid:17)दश(cid:17)क िस;ांत के (cid:27)ारा तथा राp (cid:129)ीय (cid:130) या(cid:131) संर(cid:23)ण
(cid:7)ािधकरण, (cid:27)ारा जारी पा(cid:25)रि%थितक पय(cid:17)टन (समय-समय पर यथा संशोिधत) माग(cid:17)दशक(cid:17) िस;ांत के अनसु ार, पा(cid:25)रि%थितक
पय(cid:17)टन, पा(cid:25)रि%थितक िश(cid:23)ा और पा(cid:25)रि%थितक िवकास को महOव दते े #ए पा(cid:25)रि%थितक संवेदी जोन क(cid:24) वहन (cid:23)मता के
अCययन पर आधा(cid:25)रत होगा;
(ii) पा(cid:25)रि%थितक अनुकूल पयट(cid:17) न )lयाकलाप स े संबिं धत पय(cid:17)टक के अ%थायी अिधभोग के िलए वास सिु वधा के िसवाय
संरि(cid:23)त (cid:23)े, क(cid:24) सीमा स े एक )कलोमीटर तक या पा(cid:25)रि%थितक संवेदी जोन क(cid:24) सीमा तक इनम 6 जो भी िनकट ह,ै नये
वािणिnयक होटल और (cid:25)रसोट(cid:17) अनुzात नहs ह गे।
परंत,ु जहाँ पा(cid:25)रि%थितक संवेदी जोन का िव%तार एक )कलोमीटर से nयादा ह ैवहाँ, एक )कलोमीटर से परे और पा(cid:25)रि%थितक
संवेदी जोन क(cid:24) सीमा तक सभी नए पय(cid:17)टक )lयाकलाप या िवaमान )lयाकलाप का िव%तार पय(cid:17)टन महायोजना और राp (cid:129)ीय
(cid:130)य ा(cid:131) सरं (cid:23)ण (cid:7)ािधकरण के अनुसार होगा।
(iii) आंचिलक महायोजना का अनमु ोदन )कए जान ेतक, पय(cid:17)टन के िलए िवकास और िवaमान पय(cid:17)टन )lयाकलाप के िव%तार
को वा%तिवक %थल िविन<द8 संवी(cid:23)ा तथा मानीटरी सिमित क(cid:24) िसफा(cid:25)रश पर आधा(cid:25)रत संबंिधत िविनयामक (cid:7)ािधकरण
(cid:27)ारा अनुzात )कया होगा ।
(4) ननननससैैससैै $$$$गगगगकककक ििििववववररररााााससससतततत -------- पा(cid:25)रि%थितक संवेदी जोन म 6 महOवपूण(cid:17) नैस7गक िवरासत के सभी %थल जैसे सभी जीन कोश
आरि(cid:23)त (cid:23)े,, शैल िवरचनाए,ं जल (cid:7)पात , झरन , घाटी मागy, उपवन , गुफाj, %थल , (cid:133)मण, अ(cid:134)रोहण, (cid:7)पातो आ)द क(cid:24)
पहचान क(cid:24) जाएगी और उ(cid:13)ह 6 प(cid:25)ररि(cid:23)त )कया जाएगा तथा उनक(cid:24) सुर(cid:23)ा और संर(cid:23)ा के िलए अंितम अिधसूचना के (cid:7)काशन
क(cid:24) तारीख से छह मास के भीतर, उपयु(cid:31) योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।

सां%कृितक महOव के (cid:23)े, क(cid:24) पहचान करनी होगी और अंितम अिधसूचना के अंितम (cid:7)काशन क(cid:24) तारीख स ेछह माह के भीतर
उनके संर(cid:23)ण क(cid:24) योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना म 6सिVमिलत क(cid:24) जाएगी ।

((cid:7)दषू ण िनवारण और िनयं,ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंध के

NOTIFICATION
New Delhi, the 19th May, 2016
S.O. 1825(E).—The following draft of the notification, which the Central Government proposes to
issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby
published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the
information of the public likely to be affected thereby; and notice is hereby given that the said draft notification
shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies
of the Gazette containing this notification are made available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so
specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan,

Draft Notification
Wheras, the Karera Wildlife Sanctuary notified under the Wildlife Protection Act, 1972 and situated in the
Shivpuri District of Madhya Pradesh is spread over an area of 202.21 square kilometres.
And whereas, a variety of vegetation is seen in the sanctuary due to its diverse ecosystems.
And whereas, Black Buck, Nilgai are found in large numbers in the sanctuary and the important avifauna
include Bar headed geese, paradise flycatcher, Demoiselle Grane, Darter, Dabchick, Grey partridge, Rosy
pelican, white backed vulture, wiretaited swallow, Tailor bird, Pied Kingfisher, Black headed golden Oriole,
white wagtail, white pelican, pintail, combduke, Shoveller, Gadwall, Jacana, Blossom headed parakeet,
Mahratta, Woodpecker, Marsh Harrier, Pied Myna, Baya weaver, Grey Horbill, Red Turtle Dove, Painted
snipe, Purple moorhens and Red creasted pochard vulture etc.
And wheras, it is necessary to conserve and protect the area around the protected area of Karera Wildlife
Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or
class of industries and their operations and processes in the said Eco-sensitive Zone.
Now therefore in exercise of powers conferred in sub-section (1) read with clause (V) and clause (xiv) of sub-
section (2) section 3 of Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of Rule 5 of the
Environment (Protection) Rules, 1986 the Central Government hereby notifies the area to an extent of 500
meter on notified urban and ‘abadi’ areas and 2 kilometer on the rest of area from the boundary of the Karera
Wildlife Sanctuary, as the Karera Wildlife Sanctuary Eco-sensitive Zone (herein after called the Eco sensitive
Zone).
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area
93.00 square kilometres with an extant varying from 500 meter from notified urban and ‘abadi’ areas and 2
kilometer on the rest of area from the boundary of the Karera Wildlife Sanctuary.
(2) The maps of the Karera Wildlife Sanctuary and its Eco-sensitive Zone along with latitudes, longitudes and
GPS coordinates of boundaries are appended as Annexure-I.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(3) The lists of villages falling within 500 meters and 2 kilometers the Eco-sensitive Zone are appended as
Annexure-II & III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the
Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of
final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given
in this notification.
(2) The said Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such
a manner as is specified in this notification and also in consonance with the relevant Central and State laws
and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments,
namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Madhya Pradesh State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure
and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of
all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water
bodies, management of catchment areas, watershed management, groundwater management, soil and
moisture conservation, needs of local community and such other aspects of the ecology and environment that
needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban
settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as,
parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following
measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for
recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or
industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet
the residential needs of local residents, and for the activities listed against serial numbers 13,18,24,29 and 32
in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for
eco-friendly tourism activities,
(ii) Widening and strengthening of existing roads,
(iii) Small scale industries not causing pollution,16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of
article 244 of the constitution or the law for the time being in force, including the Scheduled Tribes and other
Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the
correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest
and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and
agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism
Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of
Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall
be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest
and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as
amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based
on carrying capacity study of the Eco-sensitive Zone;
(ii) No new commercial hotels and resorts shall be permitted, within one kilometer of the boundary of the
Protected Area or the boundary of Eco-sensitive Zone whichever is nearer, except for accommodation for
temporary occupation of tourists related to eco-friendly tourism activities.
However, where Eco-sensitive Zone extends beyond one kilometer, then beyond one kilometer and up to the
boundary of the Eco-sensitive Zone, all new tourism activities or expansions of existing activities would be
conformity with Tourism Master Plan and National Tiger Conservation Authority guidelines
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny
and recommendation of the Monitoring Committee.
(3) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall
be identified and preserved and plan shall be drawn up for their protection and conservation, within six months
from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(4) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical,
architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for
their conservation shall be prepared within six months from the date of publication of this notification and
incorporated in the Zonal Master Plan.
(5) Noise pollution.- The Environment Department of the State Government or Madhya Pradesh State
Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-
sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14
of 1981) and the rules made thereunder.
(6) Air pollution.- The Environment Department of the State Government or Madhya Pradesh State Pollution
Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone
in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and
the rules made thereunder.
(7) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in
accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and
the rules made thereunder.
(8) Solid wastes. - Disposal of solid wastes shall be as under:-¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to
time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-
biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified
outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-
sensitive Zone.
(9) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out
as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of
India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E),
dated the 28th March, 2016, as amended from time to time.
(10) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal
Master Plan is prepared and approved by the competent authority in the State Government, Monitoring
Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and
regulations made thereunder.
(11) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive
Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco
sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and
the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

2. Setting up of saw mills. No new or expansion of existing saw mills shall be
permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water No new or expansion of polluting industries in the
or air or soil or noise pollution. Eco-sensitive Zone shall be permitted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per

within 100 meters of sanctuary.
10. Firing range. Prohibition on establishment of firing range within 100
meters of sanctuary and the existing firing ranges
shall be shifted outside the area in a phased manner
as per the Zonal Master Plan.
11. Conservation of steep slopes. Prohibition on construction of houses on slopes more
than 15 degrees. Villagers can construct kachha
houses for their own use.
12. Conservation of natural and heritage Prohibition on construction near natural heritage

13. Establishment of hotels and resorts. No new commercial hotels and resorts shall be
permitted within one kilometer of the boundary of the
protected area except for accommodation for
temporary occupation of tourists related to eco-

However, beyond one kilometer and upto the
extent of the Eco-sensitive Zone all new tourism
activities or expansion of existing activities would in
conformity with the Tourism Master Plan.
14. Construction activities. a) No new construction of any kind shall be permitted
from the boundary of Karera wildlife sanctuary up to a
distance of 100 meters. Only kachha huts can be
erected for the safety of the crops.
(b) In the area falling between 100 meters from the
protected area upto the extent of the eco-sensitive
zone the construction activity has to be as per the
Zonal Master Plan.
15. Felling of trees. (a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the Competent Authority in the State
Government;
(b) the felling of trees shall be regulated in
accordance with the provisions of the concerned
Central or State Acts and the rules made thereunder.
(c) in case of Reserve Forests and Protected Forests

16. Commercial water resources (a) The extraction of surface water and ground water
including ground water harvesting. shall be permitted only for bona fide agricultural use
and domestic consumption of the occupier of the

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for
effective monitoring of the Eco-sensitive Zone falling in the State of Madhya Pradesh , which shall comprise of
the following namely:-
1. Divisional Commissioner, Gwalior - Chairman;
2. District Collector, Shivpuri district - Member;
3. Superintendent Engineer, Public Works Department , Shivpuri - Member;
4. Superintendent Engineer, Public Health Engineering, Shivpuri - Member;
5. CEO of District Panchayat Shivpuri - Member;
6. One representative of NGO working in the field - Member;
of environment to be nominated by the State
Government for a period of one year
7. An expert in the area of ecology and environment to be nominated by the Government
of Madhya Pradesh for a period of one year. - Member;
8. Representative of the Town and Country Planning Department -Member;
9. Representative of Madhya Pardesh Pollution Control Board - Member;
10. Director, Madhav National Park, Shivpuri - Member-Secretary.
6. Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the
provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and
are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under
paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific
conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate
Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in
the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006
and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under
paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific
conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned
park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the
Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st
March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma
appended at Annexure-IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving
effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by
the Hon’ble Supreme Court of India or the High Court or National Green Tribunal .
