(2) पा(cid:7407)रि(cid:7021)थितक संवेदी जोन के भीतर आने वाल े 51 (cid:7061)ाम(cid:7298) क(cid:7409) सूची उनके मु(cid:6990) य िनदश(cid:7287) ांक िब(cid:7008) द(cid:7312)ु सिहत
उपाबधं -II के (cid:7272)प म(cid:7286) उपाब(cid:7373) ह ै ।
(3) सीमा के (cid:7011) यौरे अ(cid:6979)ांश और दशे ांतर के (cid:7011) यौर(cid:7298) के साथ पा(cid:7407)रि(cid:7021)थितक संवेदी जोन का मानिच(cid:7074) उपाबधं -III
के (cid:7272)प म(cid:7286) उपाब(cid:7373) ह ै ।
(4) मु(cid:6990) य पा(cid:7407)रि(cid:7021)थितक संवेदी जोन के मु(cid:6990) य ि(cid:7021)थित (जीपीएस) िब(cid:7008) द ुउपाबधं -IV के (cid:7272)प म(cid:7286) उपाब(cid:7373) ह ै ।
2. पा(cid:7407)रि(cid:7021)थितक सवं ेदी जोन के िलए आचं िलक महायोजना –(1) रा(cid:6996)य सरकार, पा(cid:7407)रि(cid:7021) थितक संवेदी जोन
के (cid:7079)योजन(cid:7298) के िलए राजप(cid:7074) म(cid:7286) इस अिधसूचना के अंितम (cid:7079)काशन क(cid:7409) तारीख स े दो वष(cid:6981) क(cid:7409) अविध के भीतर, इस
अिधसूचना म(cid:7286) (cid:7408)दए गए उपदश(cid:7300) का अनुपालन करते (cid:7263)ए, (cid:7021)थानीय (cid:7390)ि(cid:7334)य(cid:7298) के परामश(cid:6981) से आंचिलक महायोजना
तैयार करेगी ।
(2) उ(cid:6989) त योजना को रा(cid:6996) य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ािधकारी (cid:7367)ारा अनुमो(cid:7408)दत (cid:7408)कया जाएगा ।
(3) पा(cid:7407)रि(cid:7021)थितक संवेदी जोन के िलए आचंिलक महायोजना रा(cid:6996) य सरकार (cid:7367)ारा इस अिधसूचना म (cid:7286)
यथािविन(cid:7416)द(cid:7020) ट रीित म(cid:7286) और सुसंगत क(cid:7286)(cid:7076)ीय और रा(cid:6996) य िव िध य(cid:7298) और क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा जारी माग(cid:6981)दश(cid:6981)क िस (cid:7373)ांत(cid:7298),
य(cid:7408)द कोई ह(cid:7298), के सामंज(cid:7021) य स े तैयार क(cid:7409) जाएगी ।
(4) आचंिलक महायोजना उसम(cid:7286) पया(cid:6981)वरणीय और पा(cid:7407)रि(cid:7021) थितक मु(cid:7374)(cid:7298) को सि(cid:7013) मिलत करने के िलए सभी
संबंिध त रा(cid:6996) य िव भाग(cid:7298) के साथ परामश(cid:6981) से तैयार क(cid:7409) जाएगी, िजसके अतं ग(cid:6981)त िन(cid:7013) निलिखत ह,(cid:7289) अथात(cid:6981) :--

(cid:7079)कार और (cid:7408)क(cid:7021) म(cid:7298), कृिष (cid:6979)े(cid:7074)(cid:7298), ऊपजाऊ भूिम, ह(cid:7407)रत (cid:6979)े(cid:7074) जैसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021) थान, उ(cid:7378)ान कृिष (cid:6979)े(cid:7074),
आ(cid:7416)कड(cid:7298), झील(cid:7298) और अ(cid:7008)य जल िनकाय(cid:7298) का अ(cid:7012)यकंन करेगी ।
(8) आंचिलक महायोजना (cid:7021)थ ानीय समुदाय(cid:7298) क(cid:7409) जीवकोपाज(cid:6981)न को सुिनि(cid:7019) चत करने का सुिन (cid:7019) चय करेगी ।
3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए जान े वाल े उपाय-- रा(cid:6996)य सरकार इस अिधसूचना के उपबंध(cid:7298) को (cid:7079)भावी करन े

होगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संशोधन क(cid:7409) भारत सरकार के पया(cid:6981)वरण, वन और जलवायु प(cid:7407)रवत(cid:6981)न मं(cid:7074)ालय को सूचना
दने ी होगी ।
परंतु यह और भी (cid:7408)क उपयु(cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संशोधन म(cid:7286) इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:7408)कसी भी
दशा म(cid:7286) भू-उपयोग का प(cid:7407)रवत(cid:6981)न सि(cid:7013)मिलत नह(cid:7277) होगा ।
परंतु यह और भी (cid:7408)क िजसस े ह(cid:7407)रत (cid:6979)े(cid:7074) म(cid:7286) जैस े वन (cid:6979)े(cid:7074), कृिष (cid:6979)े(cid:7074) आ(cid:7408)द म(cid:7286) कोई पा(cid:7407)रणािमक कटौती नह(cid:7277)
होगी और अन(cid:7079)यु(cid:6989) त या अन(cid:7004)ु पादक कृिष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पुन: वनीकरण करन े के (cid:7079)यास (cid:7408)कए जाएगं े ।
(2) (cid:7079)ाकृितक जल (cid:7090)ोत - आचंिलक महायोजना म(cid:7286) सभी (cid:7079)ाकृितक जल (cid:7090)ोत(cid:7298) क(cid:7409) पहचान क(cid:7409) जाएगी और

अनुसार ह(cid:7298)गे, जो आंचिलक महायोजना का एक भाग बनग(cid:7286) े ।
(ख) पय(cid:6981)टन महायोजना पय(cid:6981)टन िवभाग (cid:7367)ारा रा(cid:6996) य सरकार के वन और पया(cid:6981)वरण िवभाग के परामश(cid:6981) स े
तैयार क(cid:7409) जाएगी ।

(cid:7367)ारा तथा रा(cid:7020) (cid:7069)ीय (cid:7018) या(cid:7062) सरं (cid:6979)ण (cid:7079)ािधकरण, (cid:7367)ारा जारी पा(cid:7407)रि(cid:7021)थितक पय(cid:6981)टन (समय-समय पर यथा

(ii) पा(cid:7407)रि(cid:7021) थितक अनुकूल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) के संबंिधत पय(cid:6981)टक(cid:7298) के अ(cid:7021) थायी िनवास के िलए आवासन
के िसवाय पा(cid:7407)रि(cid:7021) थितक संवदे ी जोन के भीतर होटल और (cid:7407)रसोट(cid:6981) के नए संिनमा(cid:6981)ण कु(cid:7076)मे ुख रा(cid:7398)ीय उ(cid:7378)ाम
क(cid:7409) सीमा के 1 (cid:7408)कलोमीटर के भीतर अनु(cid:6980)ात नह(cid:7277) ह(cid:7298)गे ।

के िलए पूव(cid:6981) प(cid:7407)रभािषत और िविन(cid:7416)द(cid:7397) (cid:7021)थान म(cid:7286) ही अनु(cid:6980)ात (cid:7408)कया जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:7408)कए जाने तक, पय(cid:6981)टन के िलए िवकास और िव(cid:7378)मान पय(cid:6981)टन
(cid:7408)(cid:7059)याकलाप(cid:7298) के िव(cid:7021)तार को वा(cid:7021)तिवक (cid:7021)थल िविन(cid:7416)द(cid:7397) सवं ी(cid:6979)ा तथा मानीटरी सिमित क(cid:7409) िसफा(cid:7407)रश पर
आधा(cid:7407)रत संबंिधत िविनयामक (cid:7079)ािधका(cid:7407)रय(cid:7298) (cid:7367)ारा अनु(cid:6980)ात (cid:7408)कया होगा ।
(4) नसै (cid:7414)गक िवरासत - पा(cid:7407)रि(cid:7021)थितक संवेदी जोन म(cid:7286) मह(cid:7004)वपूण(cid:6981) नैस(cid:7414)गक िवरासत के सभी (cid:7021)थल(cid:7298) जैसे सभी
जीन कोश आरि(cid:6979)त (cid:6979)े(cid:7074), शैल िवरचनाए,ं जल (cid:7079)पात(cid:7298), झरन(cid:7298), घाटी माग(cid:7300), उपवन(cid:7298), गुफाए,ं (cid:7021)थल(cid:7298), (cid:7082)मण,
अ(cid:7393)रोहण, (cid:7079)पात(cid:7298) आ(cid:7408)द क(cid:7409) पहचान क(cid:7409) जाएगी और उ(cid:7008)ह (cid:7286) संरि(cid:6979)त (cid:7408)कया जाएगा तथा उनक(cid:7409) सुर(cid:6979)ा और संर(cid:6979)ा के
िलए इस अिधसूचना के अंितम (cid:7079)काशन क(cid:7409) तारीख से छह मास के भीतर, उपयु(cid:7334) योजना बनाएगी और ऐसी

सरकार का पया(cid:6981)वरण िवभाग वायु ((cid:7079)दषू ण िनवारण और िनयं(cid:7074)ण) अिधिनयम, 1981 (1981 का 14) और उसके
अधीन बनाए गए िनयम(cid:7298) के उपबंध(cid:7298) के अनुसरण म(cid:7286) माग(cid:6981)दश(cid:6981)क िस(cid:7373)ांत और िविनयम तैयार करेगा ।
(8) बिह(cid:7090)ाव का िन(cid:7021)सारण - पा(cid:7407)रि(cid:7021)थितक संवेदी जोन म(cid:7286) उपचा(cid:7407)रत बिह(cid:7090)ाव का िन(cid:7021)सारण जल ((cid:7079)दषू ण
िनवारण तथा िनयं(cid:7074)ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम(cid:7298) के उपबंध(cid:7298) के
अनुसार होगा ।
(9) ठोस अपिश(cid:7397) - ठोस अपिश(cid:7397)(cid:7298) का िनपटान िन(cid:7388)िलिखत (cid:7272)प म(cid:7286) होगा -

25 िसतंबर, 2000 नगरपािलक ठोस अपिश(cid:7397) ((cid:7079)बंध और हथालन) िनयम, 2000 के उपबंध(cid:7298)

NOTIFICATION
New Delhi, the 7th January, 2016
S.O. 63(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and
sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required
under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be
affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after
the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made
available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so

Draft Notification
Whereas, Kudremukh National Park located at the tri-junction of Chikmagalur, Dakshina Kannada and Udupi
districts of Karnataka State at the middle of Central Western Ghats (the stretch between Goa and Nilgiris), remains
part of one of the 34 bio-diversity hotspots of the world and became signpost of tropical biological richness lies
between the 130 01’ to 130 29’ North Latitude and 750 01’ to 750 25’ East Longitude and spread over an area of 600.57
square kilometres;
AND, WHEREAS, the National Park is also a part of Sahyadri hill ranges and remains most attractive
landscape of the low elevation wet evergreen forests and Shola-Grassland Biome in the entire stretch of Western Ghat;
AND, WHEREAS, Kudremukh landscape represents a wide range of altitudes from 135 meters mean sea level
to uplands 1900 meters mean sea level and accordingly has a wide range of vegetation and attendant fauna. The major
forest types of Kudremukh National Park is classified into (Champion and Seth 1968) Southern hill top tropical
evergreen forests (1A/C ) [Sholas], Tropical wet evergreen forests (1A/C ), West coast semi-evergreen forests (2A/C2),

South Indian Moist Deciduous Forests (3B/C ) and South Indian subtropical hill savanna (8A (C 1/DS). J.P. Pascal,

AND, WHERAS,(cid:32)(cid:97) part from the floral value of Kudremukh National Park, the faunal values of Kudremukh
National Park is of critical and reason behind our intention of protection and conservation of forest area of this
landscape. Kudremukh becomes largest remaining home/habitat for the single largest remaining population of the Lion
tailed macaques (a flagship species of Kudremukh National Park) in India and world. The National Park is also home
for King Cobra, the longest venomous snake in the world and Malabar Slender Loris ((cid:111)(cid:76)(cid:105)(cid:114)(cid:32)(cid:115) (cid:121)(cid:108)(cid:100)(cid:101)(cid:107)(cid:107)(cid:97)(cid:105)(cid:101)(cid:114)(cid:110)(cid:117)(cid:115)(cid:32)
(cid:109)(cid:97)(cid:97)(cid:108)(cid:98)(cid:97)(cid:99)(cid:105)(cid:117)(cid:114)(cid:115) ), a rare primate endemic to Kudremukh. The National Park is a representative of Tropical wet evergreen
forest holding the assemblage of three top carnivores like Tiger, Leopard and Wild dogs. Kudremukh National Park
holds high degree of endemism for faunal groups like reptiles, amphibians and fishes. Insects represent the most
diverse faunal species followed by birds inside the National Park area. Avifauna’s like Hornbills are found in the old
growth forests and Flying squirrels are seen on tall trees in the valleys or on the fruit trees. Other faunal species occur
in this National Park includes, Asiatic elephant, Indian Gaur, Sambar Deer, Barking Deer/Muntjac, Spotted deer,
Mouse deer, Sloth Bear, Striped Hyena, Chevrotain, Wild Pig, Hanuman Langur, Bonnet Macaque, Malabar Giant
Squirrel, Peacock, Python and Malabar Civet Cat etc. Kudremukh National Park area is considered as hottest spot
among the hot spots for orchids in central Western Ghats.
AND, WHERAS, Among its all values, the ecosystem services value of Kudremukh are of great importance
and vital to the protection and conservation of this area of forest land as National Park. Kudremukh National Park is the
fountain head and catchment for major rivers like Tunga, Bhadra and Nethravathi and also catchments for other minor
rivers like Swarna, Gurupura, Yennehole and Seethanadhi, thus became lifeline for local people and plays a vital role in
the regional economy. Kudremukh receives one of the highest rainfalls in South India (average of 7000 milimetre per
year). Further, the wet evergreen shola forest of Kudremukh act like a sponge, thus huge quantity of water is held as
underground reserve and the same is released slowly into rivers throughout the year. Geographically, the National Park
area holds a vast and enduring effect on the regional climate (by aiding the South West Monsoon). Further,
Kudremukh National Park holds one of the highest standing biomass estimated at an average of 250-300 tons per hector
and therefore acts as one of the great carbon sinks, an antidote to global warming and climate change phenomenon;
And, whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in
paragraph1 of this notification around the protected area of Kudremukh National Park as Eco-sensitive Zone from
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
Now, therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of
rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto
10 kilometres around the boundary of Kudremukh National Park in the State of Karnataka as the Kudremukh National
Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone- (1) The area of Eco-Sensitive Zone is 286.259 square kilometres
with an extent upto 10 kilometres around the boundary of Kudremukh National Park. Someshwara Wildlife Sanctuary
adjoin the northern side of the National Park consequently, no Eco-sensitive Zone has been proposed on this side.
The boundary details of such Zone are given in Annexure-I.
(2) The list of 51 villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is
appended as Annexure-II.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as
Annexure-III.
(4) Key locations (GPS points) on the eco-sensitive zone boundary as well as on the sanctuary are appended as
Annexure-IV.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Karnataka State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department.
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, ground water management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing and proposed worshipping places, village and urban
settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like
places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational
purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related
development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential need of local residents, and for the activities listed against serial numbers 12, 18, 24, 29 and 32 in column
(2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly
tourism activities,
(ii) Widening and strengthening of existing roads.
(iii) Small scale industries not causing pollution,
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities etc:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
the State Government in such a manner as to prohibit development activities at or near these areas which are
detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests
and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Kudremukh National Park except for accommodation for temporary occupation of tourists related to eco-friendly
tourism activities:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of
the Eco-sensitive zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and
designated areas for eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and
recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of final notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall
be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master
Plan.
(6) Noise pollution.- The Environment Department of the State Government or Karnataka State Pollution Control
Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules
made there under.
(7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board
shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with
the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with
the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid
Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests (cid:118)(cid:100)(cid:105)(cid:101) notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time
to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into bio-degradable and non-bio-
degradable components;
(iii) the bio-degradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the
Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India
in the erstwhile Ministry of Environment and Forests (cid:118)(cid:100)(cid:105)(cid:101) Notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone
shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the table below, namely:-

10 Erection of Wind Mills. Prohibited (except as otherwise provided) as per
applicable laws.

12 Establishment of hotels and resorts. No new commercial hotels and resorts shall be

Protected Area except for accommodation for

friendly tourism activities.
However, beyond one kilometer and upto the
extent of the Eco-sensitive Zone, all new tourism
activities or expansion of existing activities would in
conformity with the Tourism Master Plan.
13 Construction activities. (a) No new commercial construction of any kind shall
be permitted within one kilometre from the boundary
of the protected area:
Provided that, local people shall be permitted to
undertake construction in their land for their
residential use including the activities listed in sub-
paragraph (1) of paragraph 3:
Provided further that the construction activity
related to small scale industries not causing pollution
shall be regulated and kept at the minimum, with the
prior permission from the Competent Authority as per
applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of
Eco-Sensitive Zone construction for bone fide local
needs shall be allowed and other construction
activities shall be regulated as per Zonal Master Plan.
(c) construction activity in the Eco-sensitive Zone
shall be as per Zonal Master Plan.
14 Felling of trees. (a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the competent authority in the State
Government;
(b) the felling of trees shall be regulated in
accordance with the provisions of the concerned
Central or State Acts and the rules made thereunder.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective

6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park the
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at

(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal .

Boundary Description of Kudremukh Eco-Sensitive Zone
North: The boundary line of Kudremukh Eco-sensitive zone starts from Bacchappu of Mudradi village and Moves
towards North East along Kudremukh National Park boundary and join the Someshwara Reserve Forest boundary
through Kapoli stream. Further it moves along Someshwar Reserve Forest Boundary and Join Kudremukh National
Park boundary line at Durga. Further It moves along the Kudremukh National Park boundary towards North East and
North West and reaches the stream near Peak point 767. Further it join road near Hasanabalu along stream.
East: Further the line Travels towards North East along the peak point of 741 and 744 and reaches the stream near
Betegeri and then it joins the Malathi stream. Further it moves along the Malathi stream and reaches the road near
Kalavantikadage and then it reaches the stream of Magode along the ridges of rocky knob Further it moves along the
stream and connects the peak point 862 and then moves along the ridges of 862 and join the stream at Hulgar bail and
then it join the Nalini stream at Sindodi. Further it Travers towards North East along the Ridges and reaches the peak
point near Elakkigudda through 872 point. Further it moves towards North east along Sunkadamakki stream and
connect the peak point 704, 821, 797 and then to thr stream Near Bukkibail. Further it moves along the stream up to
Volale and connects the peak point 857 and 1044 and then connects to the Taluk boundary and to stream near
Hanchinakodige. Further it moves along stream and road and reaches the Ridges of 1116 and moves along the ridges
and reaches the road at Bandehaklu. Further it moves towards Nort east along the road up to the ridges of 921 and
moves along the Ridges and reaches road near stream Chowna stream and then to Chownahalla stream along road.
Further it moves towards west and south and reach peak point 1385 and 1064. Later, it Moves along the ridges of 1064,
1330, 1018, 1049 and reaches the peak point 1157 then it traverses along the ridges and connect the peak point 1186
and 1108. Further it moves towards North East along the ridges and reaches the peak point 1119 and then to 1128.
Further it moves along the ridges of 1178 and reaches the road at Hulikan CE and then moves along the ridges of
Harikan CE and connects the peak point of 1506 at Ballalarayana durga. Then it moves along the contour of 1506 and
reaches the Balur SF at Ballalarayana Durga Falls.
South: Then the line traverses along Balur SF Boundary towards east and then connects the Charmadi road and then
moves along the Charmadi Ghat road towards South East and connect Charmadi Katpadi Reserved Forest boundary.
Further it moves along Charmadi to Kadpadi Reserved Forest boundary and reaches the stream at Bandage. Further it
moves along the stream and reaches road near Hosabettu. Then it moves towards North along road and reaches the
Tri-junction at Keyur. And then it moves towards south west along road reaches trijunction at Mura. Further it moves
along road towards North West and reaches the stream near Idiyala gudda. Further it moves along the stream towards
South up to the ridges of Belamavigudda and moves along ridges and reaches the Kuddalka stream through foot path.
Further it moves along the stream towards South west and reaches the road near Nartikal. Further it moves along road
and reaches the power line near point no124. Further it moves along the power line up to Hokkala and then connects
the peak point 198 of Sulkerimogru along footpath. Further it directly connects to the tri-junction of road and Kudige
stream at Sukkeri. Further it moves along reaches Kuthlur stream. Further it moves along Kthlur stream and joins the
Hundi stream near Naravi through foot path. Further it moves towards north along Hundi stream and connect the Bare
stream near Bare. Further it moves along Bare stream through Bedekila, Mulikar and reaches the Hurabe Reserved
Forest boundary.
West: Further the line traverses along the Hurabe Reserved Forest and reaches the Tri-junction of Machitte stream and
Mala stream at Kodange and them traverse along the Mala stream and reaches the road near Mullur. Further it moves
along the road and reaches the Tri-junction of road and NH at Koodabettu. Then it moves along road towards North
West and reaches the cart road near Shettibettu and along the cart road it reaches the road near Banglegudde. Further it
moves along road towards North West and reaches the stream near Guddeyangadi. Further it moves along the stream

reaches the road at point BM460. Further the line traverse towards North along road and reaches the Mathebettu stream
along sub-streams. Further the line traverse along Mathebettu stream and joins the ridges of Varanga gudda and
traverse along the ridged and then reaches the stream near Adka. Further the stream joins the Bendugudde ridges and
then along ridges and footpath it reaches the main road near Mudradi and the line further Travels along the main road
and reaches the Bacchappu.
