जैसे Ð चीतल, नीलगाय, काला (cid:27)हरण, तRदआु , गंध ?बलाव, लकड़बdघ ा, िसयार, भे(cid:27)डया, साह , मगृ और भालू के संर3ण
के िलए उपयुfत /प स े संर,3त करने क6 आवYय कता है और Fत नधा(cid:15)रयA क6 30 से अिधक .जाितयॉ ,जनमR
अनुसूची- 1 क6 .जाितयॉ स,+म ि लत है जैसे-र छ, चौिसंगामगृ के साथ आवासी और .वासी प3ी .जाितयA क6

अतः, इसिलए, के12 य सरकार, पया(cid:4)वरण (संर3ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प(cid:27)ठत
पया(cid:4)वरण (संर3ण) अिधिनयम, 1986 (1986 का 29) क6 धारा 3 क6 उपधारा (1) और उपधारा (2) के खंड (v) और
खंड (xiv) और उपधारा (3) <ारा .द= श?@यA का .योग करते हुए, महारा[ रा\य के ितपेYव र व1य जीव अभयारZय क6
सीमा के चारो ओर 150 मीटर से 11 (cid:27)कलोमीटर तक के िभ1 न-िभ1 न ?वFत ार के 3े(cid:19)को ितपेYव र व1य जीव अभयारZय
पा(cid:15)र,Fथितक6 संवेद जोन (,जसे इसमR इसके पYच ात ् पा(cid:15)र,Fथितक6 संवेद जोन कहा गया है) के /प मR अिधसूिचत
करती है, ,जसका ?ववरण िन+नानुसार है, अथा(cid:4)त ् :--
1. पा(cid:15)र,Fथितक संवेद जोन का ?वFतार और उसक6 सीमाएं--(1) पा(cid:15)र,Fथितक संवेद जोन अ3ांश 780 18Õ

मR उपाबV है ।
(2) पा(cid:15)र,Fथितक संवेद जोन मR आने वाले 60 wामA क6 सूची जी पी एस िनदxशांक के साथ उपाबंध II के /प म R
उपाबV है ।
(3) पा(cid:15)र,Fथितक संवेद जोन का मानिच(cid:19) इसके सीमा ?ववरण और इसके अ3ांश और देशा1त र के साथ Ð साथ
उपाबंध III और IIIक के /प मR उपाबV है।
2. पा(cid:15)र,Fथितक संवेद जोन के िलए आंचिलक महायोजना Ð (1) रा\य सरकार, पा(cid:15)र,Fथ ितक संवेद जोन के .योजन
के िलए राजप(cid:19) मR अिधसूचना के अंितम .काशन क6 तार ख से दो वष (cid:4) क6 अविध के भीतर, Fथानीय Qय?@यA के
परामश(cid:4) से, इस अिधसूचना मR संलdन अनुबंधA के सामंजFय से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा\य सरकार मR स3म .ािधकार <ारा अनुमो(cid:27)दत होगी ।
(3) पा(cid:15)र,F थितक संवेद जोन के िलए आचंिलक महायोजना इस अिधसूचना मR ?विन(cid:27)द(cid:4)lट /प मR ऐसी र ित मR
रा\य सरकार तथा सुसंगत कR2 य और रा\य ?विधयA के सामंजFय मR भी तथा कR2 य सरकार <ारा जार मागि(cid:4) नदxश,
य(cid:27)द कोई हA, <ारा तैयार होगी ।
(4) आंचिलक महायोजना, इसमR पया(cid:4)वरणीय और पा(cid:15)र,Fथ ितक6 ?वचारA को समाकिलत करने के िलए िन+न िल,खत
सभी संबV रा\य सरकार के ?वभागA के परामश(cid:4) से तैयार होगी, अथा(cid:4)त:्--

(ii) वन ;
(iii शहर ?वकास ;
(iv) पयट(cid:4) न ;
(v) नगरपािलक ;
(vi) राजFव ;
(vii) कृ?ष ;
(viii)महारा[ रा\य .दषू ण िनयं(cid:19)ण बोड(cid:4) ;
(ix) िसंचाई ;
(x) लोक िनमा(cid:4)ण ?वभाग
(5) आंचिलक महायोजना अनुमो(cid:27)दत ?वqमान भ-ू उपयोग, अवसंरचना और (cid:27)sयाकलापA पर कोई िनबधz न अिधरो?पत
नह ं करेगी जब तक (cid:27)क इस अिधसूचना मR ?विन(cid:27)द(cid:4)lट न हो और आचंिलक महायोजना सभी अवसंरचना और
(cid:27)sयाकलापA मR और अिधक द3ता और पा(cid:15)र,F थितक6 अनुकूलता का संवधन(cid:4) करेगी ।
(6) आंचिलक महायोजना मR अना{छा(cid:27)दत 3े(cid:19)A के जीण|Vार, ?वqमान जल िनकायA के संर3ण, आवाह 3े(cid:19)A के
.बंधन, जल-संभरA के .बंधन, भूतल जल के .बंधन, मदृ ा और नमी संर3ण, Fथानीय समुदायA क6 आवYयकताओं तथा
पा(cid:15)र,Fथितक6 और पया(cid:4)वरण से संबंिधत ऐसे अ1य पहलूओं, ,जन पर }यान देना आवYयक है, के िलए उपबंध हAगे ।
(7) आंचिलक महायोजना सभी ?वqमान एवं .Fत ा?वत पूजा Fथ लA, wामA और नगर य बंदोबFतA, वनA के .कार
और (cid:27)कFम A, कृ?ष 3े(cid:19)A, ऊपजाऊ भूिम, ह(cid:15)रत 3े(cid:19) जैसे उqान और उसी .कार के Fथ ान, उqान कृ?ष 3े(cid:19), फलोधान,
झीलA और अ1य जल िनकायA का अ(cid:127)यकंन करेगी ।
(8) आंचिलक महायोजना F थानीय समुदायA क6 जीवकोपाजन(cid:4) को सुिन,Yच त करने के िलए, पा(cid:15)र,Fथितक संवेद
जोन मR ?वकास को पा(cid:15)र,F थितक अनुकूल ?वकास के िलए ?विनयिमत करेगी ।
3. रा\य सरकार <ारा (cid:27)कए जाने वाले उपाय-- रा\य सरकार इस अिधसूचना के उपबंधA को .भावी करने के िलए
िन+निल,खत उपाय करेगी, अथा(cid:4)त ् :--
(1) भू-उपयोग - पा(cid:15)र,F थितक संवेद जोन म R वनA, उqान-कृ?ष 3े(cid:19)A, कृ?ष 3े(cid:19)A, आमोद-.मोद के .योजन के िलए
िच,1हत (cid:27)कए गए पाकr और खुले FथानA का वा,ण,\यक और औqोिगक संबV ?वकास (cid:27)sयाकलापA के िलए उपयोग या
संप(cid:15)रवतन(cid:4) नह ं होगा :
परंतु पा(cid:15)र,Fथितक संवेद जोन के भीतर कृ?ष भूिम का संप(cid:15)रवतन(cid:4) , मानीटर सिमित क6 िसफा(cid:15)रश पर और
रा\य सरकार के पूव (cid:4) अनुमोदन से, Fथानीय िनवािसयA क6 आवासीय ज/रतA को पूरा करने के िलए और पैरा 4 क6
सारणी के Fतंभ (2) के अधीन मद सं0 11, 21, 30, 31 और 32 के सामने सूचीबV (cid:27)sयाकलापA को पूरा करने के िलए
अनु(cid:128)ात हAगे, अथा(cid:4)त ् :-
i
( ) पा(cid:15)र,Fथितक अनुकूल पयट(cid:4) न (cid:27)sयाकलापA के िलए पयट(cid:4) कA के अFथायी आवासन के िलए पा(cid:15)र,Fथितक अनुकूल
आरामगाह जैसे टLट, लकड़ के मकान आ(cid:27)द ;
ii
( ) ?वqमान सड़कA को चौड़ा करना;
iii
( ) .दषू ण उ‘प1न न करने वाले लघु उqोग;
iv
( ) वषा (cid:4) जल संचय; और
v

परंतु यह और (cid:27)क जनजातीय भूिम का उपयोग रा\य सरकार के पूव (cid:4) अनुमोदन और सं?वधान के अनु{ छेद 244
या त‘समय .व=ृ ?विध के उपबंधA के अनुपालन के ?बना, ,जसके अंतगत(cid:4) अनुसूिचत जनजाित और अ1य परंपरागत
वन िनवासी (वन अिधकारA क6 मा1यता) अिधिनयम, 2006 (2007 का 2) भी है, वा,ण,\यक या उqोग ?वकास
(cid:27)sयाकलापA के िलए अनु(cid:128)ात नह ं होगा :
परंतु यह और भी (cid:27)क पा(cid:15)र,Fथ ितक संवेद जोन के भीतर भू-अिभलेखA मR उपसंजात कोई (cid:19)ु(cid:27)ट, मानीटर सिमित
के ?वचार .ाM करने के पNात ् रा\य सरकार <ारा .‘येक मामल े मR एक बार संशोिधत होगी और उ@ (cid:19)ु(cid:27)ट के संशोधन
क6 सूचना कR2 य सरकार के पया(cid:4)वरण, वन और जलवायु प(cid:15)रवतन(cid:4) मं(cid:19)ालय को देनी होगी ।
परंतु यह और भी (cid:27)क उपयु@(cid:4) (cid:19)ु(cid:27)ट का संशोधन मR इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:27)कसी भी
दशा मR भ-ू उपयोग का प(cid:15)रवतन(cid:4) स,+मिलत नह ं होगा ।
परंतु यह और भी (cid:27)क ,जससे ह(cid:15)रत 3े(cid:19) म R जैसे वन 3(cid:19)े , कृ?ष 3े(cid:19) आ(cid:27)द म R कोई पा(cid:15)रणािमक कटौती नह ं
होगी और अन.युf त या अनु‘ पादक कृ?ष 3े(cid:19)A मR पुन: वनीकरण करने के .यास (cid:27)कए जाएंगे ।
(2) .ाकृितक जल (cid:129)ोतA -- आचंिलक महायोजना मR सभी .ाकृितक जल (cid:129)ोतA क6 पहचान क6 जाएगी और उनके
संर3ण और पुनj(cid:130)ूतकरण के िलए योजना स,+म िलत होगी और रा\य सरकार <ारा ऐसे 3े(cid:19)A पर या उनके िनकट
?वकास (cid:27)sयाकलाप .ित?षV करने के िलए ऐसी र ित से मागि(cid:4)नदxश तैयार (cid:27)कए जाएंगे ।
(3) पयट(cid:4) न Ð (क) पा(cid:15)र,Fथितक संवेद जोन के भीतर पय(cid:4)टन संबंधी (cid:27)sयाकलाप पयट(cid:4) न महायोजना के अनुसार हAगे जो
(cid:27)क आंचिलक महायोजना के भाग /प मR होगी ।
(ख) पयट(cid:4) न महायोजना पयट(cid:4) न ?वभाग, रा\य सरकार <ारा राजFव और वन ?वभाग के परामश(cid:4) से तैयार होगी ।
(ग) पयट(cid:4) न संबंधी (cid:27)sयाकलाप िन+न िल,खत के अधीन ?विनयिमत हAगे, अथा(cid:4)त ् :-
(i) पा(cid:15)र,Fथितक संवेद जोन के भीतर सभी नए पयट(cid:4) न (cid:27)sयाकलापA या ?वqमान पयट(cid:4) न (cid:27)sयाकलापA का
?वFतार कR2 य सरकार(cid:32)के पया(cid:4)वरण, वन और जलवायु प(cid:15)रवतन(cid:4) मं(cid:19)ालय के मागद(cid:4) श(cid:4)क िसVांतA के <ारा तथा
राl(cid:131) य Qय ा(cid:132) संर3ण .ािधकरण, <ारा जार पा(cid:15)र,Fथितक पयट(cid:4) न (समय-समय पर यथा संशोिधत) मागद(cid:4) श(cid:4)क
िसVांतA के अनुसार, पा(cid:15)र,Fथितक पयट(cid:4) न, पा(cid:15)र,Fथितक िश3ा और पा(cid:15)र,Fथितक ?वकास को मह‘व देते
हुए(cid:32)पा(cid:15)र,Fथितक संवेद जोन क6 वहन 3मता के अ}ययन पर आधा(cid:15)रत होगा;
(ii) पा(cid:15)र,Fथितक6 अनुकूल पयट(cid:4) क (cid:27)sयाकलापA से संबंिधत पयट(cid:4) कA के अFथ ायी अिधभोग के िलए आवास के
िसवाय ितपेYव र व1य जीव अभयारZय क6 सीमा के एक (cid:27)कलोमीटर के भीतर नए होटलA और ?व(cid:133)ाम Fथ लA के िनमा(cid:4)ण
क6 अनु(cid:128)ा नह द जाएगी
परंतु संर,3त 3े(cid:19)A क6 सीमा स े एक (cid:27)कलोमीटर क6 दरू स े परे पा(cid:15)र,Fथितक6 संवेद जोन क6 सीमा तक नए
होटल और (cid:15)रसोट(cid:4) क6 Fथापना पयट(cid:4) न महायोजना के अनुसार पा(cid:15)र,Fथितक6य पयट(cid:4) न सु?वधा के िलए पूव (cid:4) प(cid:15)रभा?षत
और ?विन(cid:27)द(cid:4)S Fथान मR ह अनु(cid:128)ात (cid:27)कया जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:27)कए जाने तक, पयट(cid:4) न के िलए ?वकास और ?वqमान पयट(cid:4) न
(cid:27)sयाकलापA के ?वFतार को वाFत?वक Fथल ?विन(cid:27)द(cid:4)S संवी3ा तथा मानीटर सिमित क6 िसफा(cid:15)रश पर आधा(cid:15)रत संबंिधत
?विनयामक .ािधका(cid:15)रयA <ारा अनु(cid:128)ात (cid:27)कया जाएगा ।
(4) नैसिगक(cid:4) ?वरासत -- पा(cid:15)र,Fथितक संवेद जोन मR मह‘वपूण(cid:4) नैसिगक(cid:4) ?वरासत के सभी FथलA जैसे सभी जीन कोश
आर,3त 3े(cid:19), शैल ?वरचनाएं, जल .पातA, झरनA, घाट मागr, उपवनA, गुफाएं, FथलA, (cid:134)मण, अ(cid:135)रोहण, .पातो आ(cid:27)द
क6 पहचान क6 जाएगी और उ1हR संर,3त (cid:27)कया जाएगा तथा उनक6 सुर3ा और संर3ा के िलए अंितम अिधसूचना के
.काशन क6 तार ख से छह मास के भीतर, उपयु@ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग

(5) मानव िनिमत(cid:4) ?वरासत Fथ ल - पा(cid:15)र,F थितक संवेद जोन मR भवनA, संरचनाओं, िश(cid:29)प-त(cid:136)य, ऐितहािसक, कला‘मक
और सांFकृितक मह‘व के 3(cid:19)े A क6 पहचान करनी होगी और अंितम अिधसूचना के .काशन क6 तार ख से छह माह के
भीतर उनके संर3ण क6 योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मR स,+मिलत क6 जाएगी ।
(6) }व िन .दषू ण -- पा(cid:15)र,Fथितक संवेद जोन मR }व िन .दषू ण के िनयं(cid:19)ण के िलए रा\य सरकार का पया(cid:4)वरण ?वभाग,
वायु (.दषू ण िनवारण और िनयं(cid:19)ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमA के उपबंधA
के अनुसरण मR मागद(cid:4) श(cid:4)क िसVांत और ?विनयम तैयार करेगा ।
(7) वायु .दषू ण -- पा(cid:15)र,Fथितक संवेद जोन म,R वायु .दषू ण के िनयं(cid:19)ण के िलए रा\य सरकार का पया(cid:4)वरण ?वभाग,
वायु (.दषू ण िनवारण और िनयं(cid:19)ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमA के उपबंधA
के अनुसरण मR मागद(cid:4) श(cid:4)क िसVांत और ?विनयम तैयार करेगा ।
(8) ब(cid:27)ह(cid:129)ाव का िनFसारण -- पा(cid:15)र,Fथितक संवेद जोन मR उपचा(cid:15)रत ब(cid:27)ह(cid:129)ाव का िनFसारण, जल (.दषू ण िनवारण
तथा िनयं(cid:19)ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमA के उपबंधA के अनुसार होगा ।
(9) ठोस अपिशS -- ठोस अपिशSA का िनपटान िन+निल,खत /प म R होगा -
(i)(cid:32) पा(cid:15)र,Fथितक संवेद जोन म R ठोस अपिशSA का िनपटान भारत सरकार के त‘कालीन पया(cid:4)वरण और वन
मं(cid:19)ालय क6 समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तार ख 25 िसतंबर,
2000 नगरपािलक ठोस अपिशS (.बंध और हथालन) िनयम, 2000 के उपबंधA के अनुसार (cid:27)कया
जाएगा ;
(ii)(cid:32) Fथानीय .ािधकरण जैव िन+नीकरणीय और अजैव िन+नीकरणीय संघटकA मR ठोस अपिशSA के
संपथृ fकन के िलए योजनाएं तैयार करRगे ;
(iii)(cid:32) जैव िन+नीकरणीय सामwी को अिधमानतः खाद बनाकर या कृिम खेती के मा}यम से पुनःच(cid:27)sत
(cid:27)कया जाएगा ;

NOTIFICATION
New Delhi, the 7th January, 2016
S.O. 72(E).—The following draft of the notification, which the Central Government
proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v)
and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule
5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be
affected thereby; and notice is hereby given that the said draft notification shall be taken into
consideration on or after the expiry of a period of sixty days from the date on which copies of
the Gazette containing this notification are made available to the public;

contained in the draft notification may forward the same in writing, for consideration of the

Draft Notification
WHEREAS Tipeshwar Wildlife Sanctuary situated in Yavatmal district in the State of
Maharashtra is spread over an area of 148.632 square kilometers;
AND WHEREAS Tipeshwar Wildlife Sanctuary is an important wildlife habitat and needs
to be conserved suitably for protection of tigers and other wild animals i.e. Cheetal, Nilgai,
Black Buck, Panther, Civet, Hyena, Jackal, Wolf, Porcupine, Deer and Bear and more than 30
species of mammal including schedule-I species like Sloth Bear, four horned antelope are found
with varieties of residential and migratory bird species;
AND WHEREAS, varieties of amphibian, reptilian and Piscean species are found in this
area and vrious kinds of invertebrates from zooplanktons varieties of butterflies, moths,
beetles, odonates, crabs, prawns, spiders, shells are found in this area;
AND WHEREAS, the forest type is ‘Southern Tropical Dry Deciduous forest and it is
grouped as 5 A/C1a.’ and it serves as a living repository of various economical, medicinal,
aromatic and ornamental plant species;
AND WHEREAS, primitive scheduled tribes like Kolam and Gond are sharing common
habitat with wildlife of this area and these tribal communities resides adjacent to the forest and
their day to day requirements are fulfilled from the forests and their deities and other religious
places of worship are inside the forests;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and
boundaries of which are specified in paragraph 1 of this notification around the protected area
of Tipeshwar Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point
of view and to prohibit industries or class of industries and their operations and processes in the
said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the power conferred by sub-section (1) and clauses (v)
and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection)
Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules,
1986, the Central Government hereby notifies an area to an extent varying from 150 meter
to 11 kilometres around the boundary of Tipeshwar Wildlife Sanctuary in the State of
Maharashtra as the Tipeshwar Wildlife Sanctuary Eco-sensitive Zone (herein after referred to
as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) Eco-sensitive Zone is situated
between - 78° 18' 33.90'' to 78° 36' 17.25'' East. Latitude- 19° 47' 56.20'' to 20° 3' 16.83''
North Longitude. The Eco-Sensitive Zone is spread over an area of 404.57 square kilometers
with an extent varying from 150 meter to 11 kilometres around the boundary of Tipeshwar
Wildlife Sanctuary and the boundary description of such Zone is given in Annexure-I.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) The list of 60 villages falling in Eco-Sensitive Zone along with GPS coordinates is
appended as Annexure-II.
(3) The map of Eco-sensitive Zone and boundary details in terms of GPS coordinates are
appended as Annexure-III and III-A respectively.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the
purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years
from the date of publication of final notification in the Official Gazette, in consultation with local
people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The said Master Plan for the Eco-sensitive Zone shall be prepared by the State
Government in such a manner as is specified in this notification and also in consonance with the
relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The said Master Plan shall be prepared in consultation with all concerned State
Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Maharashtra State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department ;
for integrating environmental and ecological considerations into it.
(5) The said Plan shall not impose any restriction on the approved existing land use,
infrastructure and activities, unless so specified in this notification and the said Master Plan
shall factor in improvement of all infrastructure and activities to be more efficient and eco-
friendly.
(6) The said Master Plan shall provide for restoration of denuded areas, conservation of
existing water bodies, management of catchment areas, watershed management, groundwater
management, soil and moisture conservation, needs of local community and such other aspects
of the ecology and environment that needs attention.
(7) The said Master Plan shall demarcate all the existing worshipping places, village and
urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands,
green area, such as, parks and like places, horticultural areas, orchards, lakes and other water
bodies.
(8) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure
eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the
following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces
earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted
into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be
permitted on the recommendation of the Monitoring Committee, and with the prior approval of
the State Government, to meet the residential needs of local residents, and for the activities¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27
listed against serial numbers 11, 21, 30, 31 and 32 in column (2) of the Table in paragraph 4,
namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden
houses, etc. for Eco-friendly tourism activities;
(ii) widening and strengthening of existing roads;
(iii) small scale industries not causing pollution,
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and
industrial development activities without the prior approval of the State Government and
without compliance of the provisions of article 244 of the constitution or the law for the time
being in force, including the Scheduled Tribes and other Traditional Forest Dwellers
(Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone
shall be corrected by the State Government, after obtaining the views of Monitoring Committee,
once in each case and the correction of said error shall be intimated to the Central Government
in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in
any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest
area and agricultural area and efforts shall be made to reforest the unused or unproductive
agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans
for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the
guidelines shall be drawn up by the State Government in such a manner as to prohibit
development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per
Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with
Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-
sensitive Zone shall be in accordance with the guidelines issued by the Central Government in
the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-
education and eco-development and based on carrying capacity study of the Eco-sensitive
Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from
the boundary of the except for accommodation for temporary occupation of tourists related to
eco-friendly tourism activities:
Provided that beyond the distance of the one kilometre from the boundary of the
protected area till the extent of the Eco-sensitive zone, the establishment of new hotels and
resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as
per Tourism master Plan.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of
existing tourism activities shall be permitted by the concerned regulatory authorities based on
the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as
the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points,
walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
protection and conservation, within six months from the date of publication of this notification
and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of
historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-
sensitive Zone and plans for their conservation shall be prepared within six months from the
date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra
State Pollution Control Board shall draw up guidelines and regulations for the control of noise
pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981(14 of 1981) and the rules made there under.
(7) Air pollution.- The Environment Department of the State Government or Maharashtra
State Pollution Control Board shall draw up guidelines and regulations for the control of air
pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall
be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act,
1974 (6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of
the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the
Government of India in the erstwhile Ministry of Environment and Forests vide notification
number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into
biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or
vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s)
identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be
permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be
carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules,
1998 published by the Government of India in the erstwhile Ministry of Environment and
Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time
to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat
friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master
Plan and till such time as the Zonal Master Plan is prepared and approved by the competent
authority in the State Government, Monitoring Committee shall monitor compliance of vehicular
movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the
proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set
up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the
proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All
activities in the Eco sensitive Zone shall be governed by the provisions of the Environment
(Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the

(c) Beyond one kilometre and upto the extent of the
Eco-sensitive Zone construction for bona fide local

18. Felling of trees (a) There shall be no felling of trees in the forest or

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring

3. Regional Officer, Maharashtra State Pollution Control Board, Member
Amravati.
4. Town Planning Officer, Yavatmal. Member
5. One representative of Non-Governmental Organisation Member
(working in the field of environment and heritage
conservation) to be nominated by the State Government for a
period of one year in each case.
6. One expert in the area of ecology and environment to be Member
nominated by the State Government for a period of one year
in each case.
7. Representative of Addl. Principal Chief Conservator Of Forests, Member
(East) Wildlife, Nagpur.
8. Deputy Conservator of Forests, Pandharkawda Forest Division. Member-Secretary
6. Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of
the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of
India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated
the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the
prohibited activities as specified in the Table under paragraph 4 thereof, shall be
scrutinized by the Monitoring Committee based on the actual site-specific conditions
and referred to the Central Government in the Ministry of Environment, Forest and
Climate Change for prior environmental clearances under the provisions of the said

(3) The activities that are not covered in the Schedule to the notification of the

(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or
the concerned park Deputy Conservator of Forests shall be competent to file complaints
under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any
person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned
Departments, representatives from industry associations or concerned stakeholders to
assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities
as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of
the State as per pro- forma appended at Annexure-IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change
may give such directions, as it deems fit, to the Monitoring Committee for effective
discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any,
for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be
passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
