करेगी ।

अिधसूचना म6 िविन<द8 ह ै और सुसगं त के(cid:13)(cid:14)ीय और राBय िविधय" तथा के(cid:13)(cid:14)ीय सरकार (cid:29)ारा जारी माग(cid:17)दश(cid:17)क
िस;ांत", य)द कोई हो, के अनु(cid:9)प भी तैयार क(cid:24) जाएगी ।
(4) आंचिलक महायोजना सभी सबं ; राBय िवभ ाग" के साथ परामश(cid:17) स े पया(cid:17)वरणीय और पा(cid:27)रि%थितक(cid:24)य
िवचारण" को उसम6 एक(cid:24)कृत करने के िलए तैयार क(cid:24) जाएगी, अथात(cid:17) ्:--
(i) पया(cid:17)वरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पय(cid:17)टन ;
(v) नगरपािलक ;
(vi) राज% व ;
(vii) कृिष ; और
(viii) पंजाब राB य (cid:7)दषू ण िनयं,ण बोड(cid:17),
(5) आंचिलक महायोजना अनुमो)दत िवgमान भ-ू उपयोग, अवसरं चनाTम क और )hयाकलाप" पर कोई िनबpधन
अिधरोिपत नहq करेगी जब तक )क इस अिधसूचना म6 इस (cid:7)कार िविन<द8 न हो और आंचिलक महायोजना सभी
अवसंरचना और कायक(cid:17) लाप" म6 द(cid:23)ता और पा(cid:27)र ि%थ ि तक(cid:24)य अनुकूलता का सवं ;न(cid:17) करेगी ।
(6) आंचिलक महायोजना म 6 अनाrछा)दत (cid:23)े," के जीणs;ार, िवgमान जल िनकाय" के संर(cid:23)ण, आवाह
(cid:23)े," के (cid:7)बंधन, जल-संभर" के (cid:7)बंधन, भूतल जल के (cid:7)बंधन, मृदा और नमी सरं (cid:23)ण, %थानीय समुदाय" क(cid:24)
आव3यकता\ तथा पा(cid:27)रि%थितक(cid:24) और पया(cid:17)वरण स ेसबं ंिधत ऐसे अ(cid:13)य पहलू\, िजन पर tयान दने ा आव3यक ह,ै के
िलए उपबंध ह"ग े ।
(7) आंचिलक महायोजना सभी िवgमान पूजा %थ ल", uाम" और नगरीय बंदोब%त", वन" के (cid:7)कार और
)क%म ", कृिष (cid:23)े,", ऊपजाऊ भूिम, ह(cid:27)रत (cid:23)े, जैसे उgान और उसी (cid:7)कार के %थ ान, उgान कृिष (cid:23)े,, आ<कड",
झील" और अ(cid:13)य जल िनकाय" का अxयकंन करेगी ।
(8) आंचिलक महायोजना पा(cid:27)रि%थितक सवं ेदी जोन म 6 िवकास को िविनयिमत करेगी िजससे )क % थानीय
समुदाय" के पा(cid:27)रि%थितक ज(cid:13)य िवकास और जीिवका को सुिनि3च त )कया जा सके ।
3. रररराााा(cid:16)(cid:16)(cid:16)(cid:16)यययय ससससररररककककाााारररर (cid:18)(cid:18)(cid:18)(cid:18)ाााारररराााा (cid:19)(cid:19)(cid:19)(cid:19)ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेे ेेउउउउपपपपाााायययय-------- राBय सरकार इस अिधसूचना के उपबंध" को (cid:7)भावी करन े के

िलए उपयोग या संप(cid:27)रवत(cid:17)न नहq होगा :
परंतु पा(cid:27)रि%थितक सवं ेदी जोन के भीतर कृिष भूिम का संप(cid:27)रवत(cid:17)न के अधीन मानीटरी सिमित क(cid:24) िसफा(cid:27)रश
पर और राBय सरकार के पूव (cid:17) अनुमोदन स,े %थानीय िनवािसय" क(cid:24) आवासीय ज(cid:9)रत" को पूरा करने के िलए और
पैरा 4 क(cid:24) सारणी के %तंभ (2) के अधीन मद स0ं 24, 28, 30 और 35 के सामने सूचीब; )hयाकलाप" को पूरा
करन ेके िलए अनुzात ह"गे, अथा(cid:17)त ् :-
(i) (cid:7)दषू ण उTप{ न करन ेवाल े लघु उgोग;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) पा(cid:27)रि% थितक(cid:24)य अनुकूल पय(cid:17)टन )hयाकलाप" के िलए पय(cid:17)टक" के अ%थ ायी आवासन के िलए
पा(cid:27)रि% थितक(cid:24)य अनकु ूल आरामगाह जैसे ट6ट, लकड़ी के मकान आ)द ;
(iii) वषा (cid:17)जल संचय, और
(iv) कुटीर उgोग, िजसके अंतग(cid:17)त uामीण द%तकार ह 0।
परंतु यह और )क राBय सरकार के पूव (cid:17) अनुमोदन और संिवध ान के अनुrछ ेद 244 तथा तTसमय (cid:7)वृ(cid:31) िविध के
उपबंध" के अनुपालन के िबना, िजसके अंतग(cid:17)त अनुसूिचत जनजाित और अ(cid:13)य परंपरागत वन िनवासी (वन
अिधकार" क(cid:24) मा(cid:13)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिBयक या उgोग िवकास )hयाकलाप" के
िलए जनजातीय भूिम का उपयोग अनुzात नहq होगा :
परंतु यह और भी )क पा(cid:27)रि% थितक सवं ेदी जोन के भीतर भू-अिभलेख" म 6 उपसंजात कोई ,ु(cid:27)ट मानीटरी
सिमित के िवचार (cid:7)ा2 करन े के पjात ् राBय सरकार (cid:29)ारा (cid:7)Tयेक मामले म 6 एक बार संशोिधत होगी और उ! ,(cid:27)ु ट
के संशोधन क(cid:24) भारत सरकार के पयाव(cid:17) रण, वन और जलवाय ु प(cid:27)रवतन(cid:17) मं,ालय को सूचना दने ी होगी ।
परंतु यह और भी )क उपयु(cid:17)! ,ु(cid:27)ट का संशोधन म6 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय )कसी भी
दशा म6 भू-उपयोग का प(cid:27)रवत(cid:17)न सि}मिलत नहq होगा ।
परंतु यह और भी )क िजससे ह(cid:27)रत (cid:23)े, म6 जसै े वन (cid:23)े,, कृिष (cid:23)े, आ)द म6 कोई पा(cid:27)रणािमक कटौती नहq
होगी और अन(cid:7)युO त या अनTु पादक कृिष (cid:23)े," म6 पुन: वनीकरण करने के (cid:7)यास )कए जाएगं े ।
(2) (cid:1)(cid:1)(cid:1)(cid:1)ााााककककृृृृििििततततकककक (cid:23)(cid:23)(cid:23)(cid:23)ोोोोतततत(cid:25)(cid:25)(cid:25)(cid:25) -- आचंिलक महायोजना म 6 सभी (cid:7)ाकृितक ~ोत" क(cid:24) पहचान क(cid:24) जाएगी और उनके
संर(cid:23)ण और पुननव(cid:17) ीकरण के िलए योजना सि}म िलत होगी और राBय सरकार (cid:29)ारा ऐसे (cid:23)े," पर या उनके िनकट
िवकास )hयाकलाप (cid:7)ितिष; करने के िलए ऐसी रीित से माग(cid:17)िनदश(cid:127) तैयार )कए जाएंगे ।
(3) पपपपयययय(cid:26)ट(cid:26)ट(cid:26)ट(cid:26)टनननन –––– (क) पा(cid:27)रि%थितक सवं ेदी जोन के भीतर पय(cid:17)टन सबं ंधी )hयाकलाप, जो आंचिलक महायोजना
का भाग (cid:9)प म6 िन(cid:3)िलिखत (cid:9)प म 6 ह"ग े ।
(ख) पय(cid:17)टन महायोजना पय(cid:17)टन िवभाग, िबहार सरकार (cid:29)ारा राज%व और वन िवभाग, पंजाब सरकार के
परामश(cid:17) से तैयार होगी ।
(ग) पय(cid:17)टन संबंधी )hयाकलाप िन} निलिखत के अधीन िविनयिमत ह"गे, अथात(cid:17) ् :-
(i) पा(cid:27)रि%थितक सवं ेदी जोन के भीतर सभी नए पय(cid:17)टन )hयाकलाप" या िवgमान पय(cid:17)टन )hयाकलाप" का
िव%तार राf (cid:128)ीय (cid:129) या(cid:130) सरं (cid:23)ण (cid:7)ािधकरण, पया(cid:17)वरण, वन और जलवाय ु प(cid:27)रवतन(cid:17) मं,ालय (cid:29)ारा जारी
(समय-समय पर यथा संशोिधत) मागि(cid:17) नदशे " के अनुसार होगा िजसम6 पा(cid:27)रि%थितक पय(cid:17)टन, पा(cid:27)रि%थितक
िश(cid:23)ा और पा(cid:27)रि%थितक िवकास को महTव )दया जाएगा और पा(cid:27)रि%थितक सवं ेदी जोन क(cid:24) वहन (cid:23)मता के
अtययन पर आधा(cid:27)रत होगा ;
(ii) पा(cid:27)रि% थितक(cid:24)य संवेदी जोन के भीतर होटल और िव(cid:131)ाम %थल अनुzात नहq ह"गे ।
(iii) आंचिलक महायोजना का अनुमोदन )कए जाने तक, पय(cid:17)टन के िलए िवकास और िवgमान पय(cid:17)टन
)hयाकलाप" के िव%तार को वा%तिवक %थल िविन<द8 सवं ी(cid:23)ा तथा मानीटरी सिमित क(cid:24) िसफा(cid:27)रश पर
आधा(cid:27)रत सबं ंिधत िविनयामक (cid:7)ािधका(cid:27)रय" (cid:29)ारा अनुzात )कया होगा ।
(4) ननननससैैससैै (cid:30)(cid:30)(cid:30)(cid:30)गगगगकककक ििििववववररररााााससससतततत -------- पा(cid:27)रि%थितक सवं ेदी जोन म6 महTवपूण(cid:17) नैस7गक िवरासत के सभी %थल" जैसे सभी

िलए इस अिधसूचना के (cid:7)काशन क(cid:24) तारीख से छह मास के भीतर, उपयु! योजना बनाएगी और ऐसी योजना

NOTIFICATION
New Delhi, the 16th November, 2015
S.O. 3103(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and
sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required
under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be
affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the
expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made
available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft

Draft Notification
Whereas, Harike Wildlife Sanctuary is a largest wetland in northern India in Tarn Taran District of Punjab State
and this wetland-cum-wildlife sanctuary is located about 55 kilometres from Amritsar city, the area of which is 86 square
kilometres that falls in District Tarn Taran, Ferozepur and Kapurthala
And Whereas. This Sanctuary is also Accorded The Status Of Ramsar Site in 1990;
And Whereas, the above specified protected area is mostly a water based area with 14 aquatic Taxa and 24
terrestrial species and the main water based species are Najas, Hydrilla, Ipomoea, Azolla sp., Potamegeton, Vallisneria,
etc.;
AND WHEREAS, the area is known to support 16 Taxa (72 species) of fishes, 6 Taxa of frogs and toads, 7 species of
turtles (including International Union for Conservation of Nature Testudines turtles), 13 species of mammals (including
smooth Indian Otter and Indus River Dolphin), 391 species (59 percent migratory) of birds and 4 species of snakes;
And Whereas, it is necessary to conserve and protect the area, the extent and boundaries of which are specified
in paragraph 1 of this notification around the protected area of the Harike Wildlife Sanctuary as Eco-sensitive Zone from
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
Now Therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule
5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent upto 100
metres all around the boundary of the Harike Wildlife Sanctuary in the State of Punjab as the Eco-sensitive Zone
(hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone is an area to an extent of
100 meters all around the boundary of the Harike Wildlife Sanctuary comprising an area of 393.44 hectares
approximately.
(2) The Eco-sensitive Zone is bounded by 31º9’13.974"N latitude and 75º2’25.773"E longitude towards East
(Reference point No.10 of map); 31º11’25.659"N latitude and 74º58’59.485"E longitude towards west (Reference point
No.4 of map); 31º12’38.538"N latitude and 75º1’11.464"E longitude towards north (Reference point No.3 of map) and
31º6’46.514"N latitude and 75º0’34.031"E longitude towards south(Reference point No.7 of map).
(3) The map showing the boundaries of Eco-sensitive Zone together with its latitudes and longitudes is appended as
Annexure I.
(4) The villages whose area or parts thereof falling within the Eco-sensitive Zone are, Ruknewala, Bhootiwala,
Maujgarh, Makhu, Rasulpur, Mandsinghpura, Gudde , Jand, Harike and Kirrian.¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 13
2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as
is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued
by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture; and
(viii) Punjab State Pollution Control Board,
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,
orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development and livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 24, 28, 30 and 35 in column (2) of
the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution,
(ii) Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for Eco-friendly
tourism activities;
(iii) Rainwater harvesting, and
(iv) Cottage industries including village artisans, etc.,
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or any other law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of
said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State
Government in such a manner so as to prohibit development activities at or near these areas which are detrimental to such
areas.
(3) Tourism.-(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Punjab in consultation
with Department of Revenue and Forests, Government of Punjab.¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(c) The activity of tourism shall be regulated as under, namely.-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of
Environment, Forests and Climate Change (as amended from time to time) mutatis mutandis with emphasis on eco-
tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under.- (i) the solid waste disposal in Eco-sensitive Zone shall be
carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the
Government of India in the erstwhile Ministry of Environment, Forests and Climate Change vide notification number
S.O. 908 (E), dated the 25th September 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material shall be disposed of in an environmentally acceptable manner at site identified outside the
Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the Ministry of Environment, Forests and Climate Change, Monitoring Committee shall
monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-
sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules
made thereunder and shall be regulated in the manner specified in the Table below, namely:—

4. Use or production of any hazardous substances Prohibited (except as otherwise provided) as per
applicable laws.
5. Commercial establishment of hotels and resorts. No new or expansion of existing commercial
establishments such as hotels and resorts shall be
permitted within the Eco-sensitive Zone.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per
applicable laws.
7. Establishment of new major hydroelectric Prohibited (except as otherwise provided) as per
projects. applicable laws.
8. Undertaking activities related to tourism like Prohibited (except as otherwise provided) as per
over-flying the sanctuary area by hot-air balloons, applicable laws.

within the Eco-sensitive Zone, except for the domestic
needs of local residents including the activities listed in
sub-paragraph (1) of paragraph 3. In case of the
construction activity related to small scale industries
not causing pollution shall be regulated and kept at the
minimum.
Regulated Activities:
12. Felling of trees. (a) There shall be no felling of trees on the forest land
or Government or revenue or private lands without
prior permission of the competent authority in the State
Government.
(b) The felling of trees shall be regulated in accordance
with the provisions of the concerned Central or State
Act and the rules made there under.
13. Drastic change of agriculture system Regulated under applicable laws.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for
effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(a) The Chief Conservator of Forests (Wildlife), Government of Punjab - Chairman
(b) Representative Department of Rural Development and Panchayat, Government of Punjab- Member;
(c) Regional Office, Punjab State Pollution Control Board-Member;
(d) One representative of Non-governmental Organizations’ working in the field of environment to be nominated
by the Government of Punjab for a term of one year in each case– Member;
(e) One expert in the area of ecology and environment to be nominated by the Government of Punjab for a term of
one year in each case- Member
(f) Representative Department of Rural Development and Housing Department, Government of Punjab – Member;
(g) Representative of Agricultural, Government of Punjab – Member;
(h) Representative of District Collector of Firozepur- Member;
(i) Divisional Forest Officer (In-charge of PA) – Member Secretary.
6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental
clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Chief Conservator of Forests (Wildlife)
shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any
person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at
Annexure II.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
