का (cid:24)योग करते हुए, \बहार रा]य मQ भीम बांध व$य जीव अभयार[य क0 सीमा से 2 Gकलोमीटर तक के FवAत ार तक के ,ेI को भीम बांध व$य जीव अभयार[य पाXरिAथ(cid:18)तक संवेद(cid:8) जोन (िजसे इसमQ इसके पMच ात ् पाXरिAथ(cid:18)तक संवेद(cid:8) जोन कहा गया है) के (cid:25)प मQ अ(cid:28)धसू(cid:28)चत करती है, िजसका Fववरण (cid:18)न(cid:19)नानुसार है, अथा(cid:14)त ् :-- (1) पा(cid:15)रि&थ(तक संवेद+ जोन का -व&तार और उसक/ सीमाएं--(1) पाXरिAथ(cid:18)तक संवेद(cid:8) जोन के ,ेI का FवAत ार 443.11 वग (cid:14) Gकलोमीटर तक होगा। पाXरिAथ(cid:18)तक संवेद(cid:8) जोन क0 सीमा भीम बांध व$य जीव अभयार[य के चारो ओर दो Gकलोमीटर तक होगी (2) पाXरिAथ(cid:18)तक संवेद(cid:8) जोन के अंतगत(cid:14) आने वाले oाम; क0 सूची उपाबंध I के (cid:25)प मQ उपाबW है और भीम बाधं व$य जीव अभयार[ य क0 सीमा के जीपीएस (cid:18)नदpशांक उपाबंध II के (cid:25)प मQ उपाबW है । (3) पाXरिAथ(cid:18)तक संवेद(cid:8) जोन का मान(cid:28)चI अ,ां$त र और देशां$त र के साथ सीमा के Jय ौरा स(cid:4)हत उपाबंध III के (cid:25)प मQ उपाबW है । 2. पा(cid:15)रि&थ(तक संवेद+ जोन के 5लए आंच5लक महायोजना – (1) रा]य सरकार, पाXरिAथ (cid:18)तक संवेद(cid:8) जोन के (cid:20)लए राजपI मQ अं(cid:18)तम अ(cid:28)धसूचना के (cid:24)काशन क0 तार(cid:8)ख से दो वष (cid:14) क0 अव(cid:28)ध के भीतर, Aथानीय Pयि:तय; के परामश (cid:14) से और इस अ(cid:28)धसूचना मQ संल_ न अनुबंध; के सामंजAय से आंच(cid:20)लक महायोजना तैयार करेगी । (2) आचं(cid:20)लक महायोजना रा]य सरकार मQ स,म (cid:24)ा(cid:28)धकार(cid:8) 7वारा अनुमो(cid:4)दत होगी । (3) रा]य सरकार 7वारा पाXरिA थ(cid:18)तक संवेद(cid:8) जोन के (cid:20)लए आचं(cid:20)लक महायोजना इस तरह, इस अ(cid:28)धसूचना मQ Fव(cid:18)न(cid:4)द(cid:14)Rट (cid:25)प तथा सुसंगत कQ%(cid:8)य और रा]य Fव(cid:28)धय; के सामंजAय और कQ%(cid:8)य सरकार 7वारा जार(cid:8) माग(cid:18)(cid:14) नदpश;, य(cid:4)द कोई ह;, 7वारा तैयार होगी । (4) आंच(cid:20)लक महायोजना, पया(cid:14)वरणीय और पाXरिAथ(cid:18)तकय Fवचार; को समाक(cid:20)लत करने के (cid:20)लए रा]य सरकार के सभी संबW Fवभाग; के परामश (cid:14) से तैयार होगी, अथा(cid:14)त:्-- (i) पया(cid:14)वरण ; (ii) वन ; (iii) नगर Fवकास ; (iv) पयट(cid:14) न ; (v) नगरपा(cid:20)लक ; (vi) राजAव ; (vii) कृFष ; (viii) \बहार रा]य (cid:24)दषू ण (cid:18)नयंIण बोड (cid:14) ; (ix) (cid:20)सचं ाई; और (x) लोक (cid:18)नमा(cid:14)ण Fवभाग ।¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (5) आंच(cid:20)लक महायोजना अनुमो(cid:4)दत Fव7यमान भू-उपयोग, अवसंरचना और Gsयाकलाप; पर कोई (cid:18)नबधt न अ(cid:28)धरोFपत नह(cid:8)ं करेगी जब तक Gक इस अ(cid:28)धसूचना मQ Fव(cid:18)न(cid:4)द(cid:14)Rट न हो और आंच(cid:20)लक महायोजना सभी अवसंरचना और Gsयाकलाप; मQ और अ(cid:28)धक द,ता और पाXरिA थ(cid:18)तक अनुकूलता का संवधन(cid:14) करेगी । (6) आंच(cid:20)लक महायोजना मQ अनाuछा(cid:4)दत ,ेI; के जीणiWार, Fव7यमान जल (cid:18)नकाय; के संर,ण, आवाह ,ेI; के (cid:24)बंधन, जल-संभर; के (cid:24)बंधन, भूतल जल के (cid:24)बंधन, मदृ ा और नमी संर,ण, Aथानीय समुदाय; क0 आवMयकताओं तथा पाXरिAथ(cid:18)तक और पया(cid:14)वरण से संबं(cid:28)धत ऐसे अ$य पहलूओं, िजन पर vयान देना आवMयक है, के (cid:20)लए उपबंध ह;गे । (7) आंच(cid:20)लक महायोजना सभी Fव7यमान पूजा Aथ ल;, oाम; और नगर(cid:8)य बंदोबAत;, वन; के (cid:24)कार और GकAम ;, कृFष ,ेI;, ऊपजाऊ भू(cid:20)म, हXरत ,ेI जैसे उ7यान और उसी (cid:24)कार के Aथ ान, उ7यान कृFष ,ेI, फलोधान, झील; और अ$य जल (cid:18)नकाय; का अyयकंन करेगी । (8) आंच(cid:20)लक महायोजना A थानीय समुदाय; क0 जीवकोपाजन(cid:14) को सु(cid:18)निMच त करने के (cid:20)लए, पाXरिAथ(cid:18)तक संवेद(cid:8) जोन मQ Fवकास को पाXरिAथ(cid:18)तक अनुकूल Fवकास के (cid:20)लए Fव(cid:18)नय(cid:20)मत करेगी । 3. रा8य सरकार 9वारा :कए जाने वाले उपाय-- रा]य सरकार इस अ(cid:28)धसूचना के उपबंध; को (cid:24)भावी करने के (cid:20)लए (cid:18)न(cid:19)न(cid:20)ल(cid:21)खत उपाय करेगी, अथा(cid:14)त ् :-- (1) भू-उपयोग - पाXरिA थ(cid:18)तक संवेद(cid:8) जोन मQ वन;, उ7यान-कृFष ,ेI;, कृFष ,ेI;, आमोद-(cid:24)मोद के (cid:24)योजन के (cid:20)लए (cid:28)चि$हत Gकए गए पाकz और खुले Aथान; का वा(cid:21)णि]यक और औ7यो(cid:28)गक संबW Fवकास Gsयाकलाप; के (cid:20)लए उपयोग या संपXरवतन(cid:14) नह(cid:8)ं होगा : परंतु पाXरिAथ(cid:18)तक संवेद(cid:8) जोन के भीतर कृFष भू(cid:20)म का संपXरवतन(cid:14) , मानीटर(cid:8) स(cid:20)म(cid:18)त क0 (cid:20)सफाXरश पर और रा]य सरकार के पूव (cid:14) अनुमोदन से, Aथानीय (cid:18)नवा(cid:20)सय; क0 आवासीय ज(cid:25)रत; को पूरा करने के (cid:20)लए और पैरा 4 क0 सारणी के Aतंभ (2) के अधीन मद सं0 10, 21, 32, 38 और सं. 39 के सामन े सूचीबW Gsयाकलाप; को पूरा करने के (cid:20)लए अनु{ात ह;गे, अथा(cid:14)त ् :- (i) पाXरिA थ(cid:18)तक अनुकूल पयट(cid:14) न Gsयाकलाप; के (cid:20)लए पयट(cid:14) क; के अAथ ायी आवासन के (cid:20)लए पाXरिAथ (cid:18)तक अनुकूल आरामगाह जैसे टQट, लकड़ी के मकान आ(cid:4)द ; (ii) Fव7यमान सड़क; को चौड़ा और सुfढ़ बनाना ; (iii) (cid:24)दषू ण काXरत न करने वाले लघु उ7योग; (iv) कुट(cid:8)र उ7योग, िजसके अंतगत(cid:14) oामीण उ7योग, सुFवधा भंडार और Aथ ानीय सुख-सुFवधाएं हK; और (v) वषा(cid:14) जल संचयन । परंतु यह और Gक जनजातीय भू(cid:20)म का उपयोग रा]य सरकार के पूव (cid:14) अनुमोदन और संFवधान के अनुuछ ेद 244 या त8समय (cid:24)व8ृ त Fव(cid:28)ध के उपबंध; के अनुपालन के \बना, िजसके अंतगत(cid:14) अनुसू(cid:28)चत जनजा(cid:18)त और अ$य परंपरागत वन (cid:18)नवासी (वन अ(cid:28)धकार; क0 मा$यता) अ(cid:28)ध(cid:18)नयम, 2006 (2007 का 2) भी है, वा(cid:21)णि]यक या उ7योग Fवकास Gsयाकलाप; के (cid:20)लए अनु{ात नह(cid:8)ं होगा : परंतु यह और भी Gक पाXरिA थ(cid:18)तक संवेद(cid:8) जोन के भीतर भू-अ(cid:20)भलेख; मQ उपसंजात कोई Iु(cid:4)ट, मानीटर(cid:8) स(cid:20)म(cid:18)त के Fवचार (cid:24)ाLत करने के पMचात ् रा]य सरकार 7वारा (cid:24)8येक मामले मQ एक बार संशो(cid:28)धत होगी और उ:त Iु(cid:4)ट के संशोधन क0 सूचना कQ%(cid:8)य सरकार के पया(cid:14)वरण, वन और जलवायु पXरवतन(cid:14) मंIालय को देनी होगी। परंतु यह और भी Gक उपयु:(cid:14) त Iु(cid:4)ट का संशोधन मQ इस उप पैरा के अधीन यथा उपबं(cid:28)धत के (cid:20)सवाय Gकसी भी दशा मQ भ-ू उपयोग का पXरवतन(cid:14) सि(cid:19)म(cid:20)लत नह(cid:8)ं होगा । परंतु यह और भी Gक हXरत ,ेI जैसे वन ,ेI, कृFष ,ेI आ(cid:4)द मQ कोई पाXरणा(cid:20)मक कटौती नह(cid:8)ं होगी और अ(cid:24)यु:त या अनु8प ादक कृFष ,ेI; मQ पुन: वनीकरण करने के (cid:24)यास Gकए जाएंगे ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) #ाकृ(तक जल >ोत? - आचं(cid:20)लक महायोजना मQ सभी (cid:24)ाकृ(cid:18)तक जल }ोत; क0 पहचान क0 जाएगी और उनके संर,ण और पुन~(cid:127)ूतकरण के (cid:20)लए योजना सि(cid:19) म(cid:20)लत होगी और रा]य सरकार 7वारा ऐसे ,Iे ; पर या उनके (cid:18)नकट Fवकास Gsयाकलाप (cid:24)(cid:18)तFषW करने के (cid:20)लए ऐसी र(cid:8)(cid:18)त से माग(cid:18)(cid:14) नदpश तैयार Gकए जाएंगे । (3) पयट(cid:4) न – (क) पाXरिAथ(cid:18)तक संवेद(cid:8) जोन के भीतर पयट(cid:14) न संबंधी Gsयाकलाप पयट(cid:14) न महायोजना के अनुसार ह;गे जो Gक आंच(cid:20)लक महायोजना के भाग (cid:25)प मQ होगी । (ख) पयट(cid:14) न महायोजना पयट(cid:14) न Fवभाग 7वारा रा]य सरकार के वन और पया(cid:14)वरण Fवभाग के परामश(cid:14) से तैयार क0 जाएगी । (ग) पयट(cid:14) न संबंधी Gsयाकलाप (cid:18)न(cid:19) न(cid:20)ल(cid:21)खत के अधीन Fव(cid:18)नय(cid:20)मत ह;गे, अथा(cid:14)त ् :- (i) पाXरिAथ(cid:18)तक संवेद(cid:8) जोन के भीतर सभी नए पयट(cid:14) न Gsयाकलाप; या Fव7यमान पयट(cid:14) न Gsयाकलाप; का FवAतार कQ%(cid:8)य सरकार के पया(cid:14)वरण, वन और जलवायु पXरवतन(cid:14) मंIालय के मागद(cid:14) श(cid:14)क (cid:20)सWांत; के 7वारा तथा राR(cid:128) (cid:8)य Pय ा(cid:129) संर,ण (cid:24)ा(cid:28)धकरण, 7वारा जार(cid:8) पाXरिAथ(cid:18)तक पयट(cid:14) न (समय-समय पर यथा संशो(cid:28)धत) मागद(cid:14) श(cid:14)क (cid:20)सWांत; के अनुसार, पाXरिAथ(cid:18)तक पयट(cid:14) न, पाXरिAथ(cid:18)तक (cid:20)श,ा और पाXरिAथ(cid:18)तक Fवकास को मह8व देत े हुए पाXरिAथ(cid:18)तक संवेद(cid:8) जोन क0 वहन ,मता के अvययन पर आधाXरत होगा; (ii) पाXरिA थ(cid:18)तक अनुकूल पयट(cid:14) क Gsयाकलाप; के संबंध मQ अAथायी अ(cid:28)धभोग के (cid:20)लए वास सुFवधा के (cid:20)सवाय भीम बाधं व$य जीव अभयार[ य क0 सीमा से एक Gकलोमीटर भीतर होटल और Xरसोटz का नया सं(cid:18)नमा(cid:14)ण अनु{ात नह(cid:8)ं होगा ; परंतु संरd,त ,ेI क0 सीमा से एक Gकलोमीटर क0 दरू (cid:8) से परे पाXरिAथ(cid:18)तक संवेद(cid:8) जोन क0 सीमा तक नए होटल और Xरसोट(cid:14) क0 Aथापना पयट(cid:14) न महायोजना के अनुसार पाXरिAथ(cid:18)तक पयट(cid:14) न सुFवधा के (cid:20)लए पूव (cid:14) पXरभाFषत और Fव(cid:18)न(cid:4)द(cid:14)Rट Aथान मQ ह(cid:8) अनु{ात Gकया जाएगा । (iii) आंच(cid:20)लक महायोजना का अनुमोदन Gकए जाने तक, पयट(cid:14) न के (cid:20)लए Fवकास और Fव7यमान पयट(cid:14) न Gsयाकलाप; के FवAतार को वाAतFवक Aथल Fव(cid:18)न(cid:4)द(cid:14)Rट संवी,ा तथा मानीटर(cid:8) स(cid:20)म(cid:18)त क0 (cid:20)सफाXरश पर आधाXरत संबं(cid:28)धत Fव(cid:18)नयामक (cid:24)ा(cid:28)धकरण; 7वारा अनु{ात Gकया होगा । (4) नैस(cid:21)गक(cid:4) -वरासत -- पाXरिAथ(cid:18)तक संवेद(cid:8) जोन मQ मह8वपूण(cid:14) नैस(cid:28)गक(cid:14) Fवरासत के सभी Aथल; जैसे सभी जीन कोश आरd,त ,ेI, शैल Fवरचनाएं, जल (cid:24)पात;, झरन;, घाट(cid:8) मागz, उपवन;, गुफाओं, Aथल;, (cid:130)मण, अMवरोहण, (cid:24)पातो आ(cid:4)द क0 पहचान क0 जाएगी और उ$हQ पXररd,त Gकया जाएगा तथा उनक0 सुर,ा और संर,ा के (cid:20)लए इस अ(cid:28)धसूचना के (cid:24)काशन क0 तार(cid:8)ख से छह मास के भीतर, उपयु:त योजना बनाई जाएगी और ऐसी योजना आंच(cid:20)लक महायोजना का भाग होगी । (5) मानव (न5मत(cid:4) -वरासत &थ ल - पाXरिA थ(cid:18)तक संवेद(cid:8) जोन मQ भवन;, संरचनाओं, (cid:20)श(cid:6)प-त(cid:131)य, ऐ(cid:18)तहा(cid:20)सक, कला8मक और सांAकृ(cid:18)तक मह8व के ,ेI; क0 पहचान करनी होगी और इस अ(cid:28)धसूचना के अं(cid:18)तम (cid:24)काशन क0 तार(cid:8)ख से छह माह के भीतर उनके संर,ण क0 योजनाएं तैयार करनी होगी तथा आंच(cid:20)लक महायोजना मQ सि(cid:19)म(cid:20)लत क0 जाएगी । (6) B व(न #दषू ण -- पाXरिAथ(cid:18)तक संवेद(cid:8) जोन मQ vव (cid:18)न (cid:24)दषू ण के (cid:18)नयंIण के (cid:20)लए रा]य सरकार का पया(cid:14)वरण Fवभाग, वायु ((cid:24)दषू ण (cid:18)नवारण और (cid:18)नयंIण) अ(cid:28)ध(cid:18)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:18)नयम; के उपबंध; के अनुसरण मQ मागद(cid:14) श(cid:14)क (cid:20)सWांत और Fव(cid:18)नयम तैयार करेगा । (7) वायु #दषू ण -- पाXरिAथ(cid:18)तक संवेद(cid:8) जोन मQ, वायु (cid:24)दषू ण के (cid:18)नयंIण के (cid:20)लए रा]य सरकार का पया(cid:14)वरण Fवभाग, वायु ((cid:24)दषू ण (cid:18)नवारण और (cid:18)नयंIण) अ(cid:28)ध(cid:18)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:18)नयम; Draft Notification Whereas, the Bhimbandh Wildlife Sanctuary, Munger Forest Division lies between Latitudes 24°55’ and 25°15’ N and Longitude 86°15’ and 86°33’ E in the Munger, Lakhisarai and Jamui districts of Bihar and extends over an area of 681.90 square kilometres. And whereas, the flora and fauna represent rich biological significance of this Sanctuary. And whereas, this sanctuary shelters wild animals including Leopard, Sloth bear, besides some of the endangered species like Hyena, Wolf, Large Indian civet, Barking deer, and also reptiles, amphibians and birds that are endangered and are of high conservation significance. And whereas, the landscape and forests of this sanctuary are suitable habitats for the abovementioned wild animals, and are also of considerable significance from point of view of diversity of vegetation comprising of Tropical Dry deciduous and Tropical Moist deciduous forests. And whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Bhimbandh Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; Now therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent up to two kilometre around the boundary of Bhimbandh Wildlife Sanctuary in the State of Bihar as the Bhimbandh Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco- sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.- (1) The area of Eco-sensitive Zone shall be spread over an area 443.11 square kilometre. The extent of Eco-sensitive Zone shall be upto two kilometre around the Bhimbandh Wildlife Sanctuary Wildlife Sanctuary. 2. The list of villages falling in the in Eco-sensitive Zone area are given at Annexure-I. And the GPS Co- ordinates of points along the boundary of Bhimbandh Wildlife Sanctuary are given at Annexure-II. 3. The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 (i) Environment, (ii) Forest, (iii) Urban Development, (iv) Tourism, (v) Municipal, (vi) Revenue, (vii) Agriculture, (viii) Bihar State Pollution Control Board, (ix) Irrigation, and (x) Public Works Department, for integrating environmental and ecological considerations into it. (5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco- friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 21, 22, 38 and 39 in column (2) of the Table in paragraph 4, namely:- (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities, (ii) Widening and strengthening of existing roads and construction of new roads, (iii) Small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Bhimbandh Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities: Provided that, beyond the distance of one kilometre from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre- defined and designated area for eco-tourism facilities as per Tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.—The Environment Department of the State Government or Bihar State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco- sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.—The Environment Department of the State Government or Bihar State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco- sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder. (9) Solid wastes.—Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests (cid:118)(cid:100)(cid:105)(cid:101) notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into bio-degradable and non- bio-degradable components; (iii) the bio-degradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed of in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco- sensitive Zone.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 (10) Bio-medical waste.— The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests (cid:101)(cid:118)(cid:100)(cid:105) notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.— (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:- TABLE S. Union of India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 3. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco- sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan 11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3: Provided further that the construction activity related to small24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer upto the extent of Eco-sensitive Zone construction for bone fide local needs shall be permitted and other construction activities shall be regulated as per Zonal Master Plan. 12. Trenching ground. Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws. 13. Discharge of treated effluents and solid waste Regulated under applicable laws. in natural water bodies or land area. 14. Air and vehicular pollution. Regulated under applicable laws. 15. Noise pollution. Regulated under applicable laws. 16. Extraction of ground water. Regulated under applicable laws. 17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 18. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan. 19. Existing establishments. Regulated under applicable laws. 20. Insulation of electric lines. Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan. 21. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 22. Fencing of existing premises of hotels and Regulated under applicable laws. lodges. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted. 33. Construction of rope ways. Regulated under applicable laws. 34. Setting up of security coups. Regulated under applicable laws. Promoted activities 35. On going agriculture and horticulture practices Shall be actively promoted. by local communities along with dairies, dairy farming, aquaculture and fisheries. 36. Organic farming. Shall be actively promoted. 37. Adoption of green technology for all activities. Shall be actively promoted. 38. Cottage industries including village artisans. Shall be actively promoted. 39. Monitoring Committee.— (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- i) Divisional Commissioner, Munger Division Revenue - Chairman ii) An expert in the area of ecology and environment - Member to be nominated by the Government of Bihar for a period of one year. iii) Representation of Agriculture Deptt., Government of Bihar - Member iv) One representatives of Non-governmental Organisation - Member (working in the field of environment including heritage conservation) to be nominated by the Government of India for a period of one year. v) Representation of Department of Forests and Environment, - Member Government of Bihar vi) Regional Officer, Bihar State Pollution Control Board - Member vii Representation of Department of Water Resources, - Member Government of Bihar viii) Concerned DFO Territorial - Member Secretary. (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State as per pro forma given in Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
