पर 1992 म< एक Uसचाई जलाV य बनाया गया था िजसके प!रणाम,व (cid:18)प िविभ(cid:22)न (cid:4)क,म ’ के प(cid:30)ी और (cid:16)वासी
पि(cid:30)य’ दोन’ को आक=षत करना भी ह ै । पहले वष (cid:25) 20 पि(cid:30)य’ क(cid:31) (cid:16)जाितय’, उसके बाद अगले वष (cid:25) 35 (cid:16)जाितय’
को दखे ा गया था ।चूं(cid:4)क जलाशय आस पड़ोस म< िवपुल पोषणकारी भूभाग’ वाले शातं तथा अिव(cid:30)ु3ध प!र(cid:30)े2 म <
आ(cid:23) (cid:25) पतझड़ी वन के म^ य म< अवि,थ त ह,ै यह अपनी (cid:16)जनन (cid:4)_याकलाप’ के िलए यहां आ‘य पाने वाले पि(cid:30)य’ के
िलए ,व ग (cid:25) बन गया ह ै।
और इस मानव िन=मत (cid:16)ाकृितक वास म< 1200 से अिधक पि(cid:30)य’ के जोड़ े (cid:16)जनन करते *ए पाए जाते ह 6
िजनम< सफेद बुb जा, बगुला, छोटा जलकौआ, चमचा च’च, रंगीन चमरख<च, जसै ी कुछ (cid:16)जाितयां ह 6जो यहां (cid:16)जनन
करती ह 6 और !टटहरी जलमुगe पनलुआ, बाकं र, भारतीय झबरा आ(cid:4)द जैसे प(cid:30)ी साल’ साल यहां पाए जाते ह 6 ।
सीखपरऔर, गागfनी, ितदारी, बटान आ(cid:4)द नवंबर मास से फरवरी मास के बीच (cid:16)जनन के िलए यहां (cid:16)वास करत े
ह 6 । मुंडागोड, हिलयल और येलापुर ता(cid:6) लुक’ के सिं gकट (cid:30)े2’ म < ब*त से छोटे और बड़े जलाशय भी पि(cid:30)य’ के
घ’सला, उनको पोषण तथा (cid:16)जनन करने म < सहायता करते ह 6जो इस (cid:16)कार इस अभयारJय को एक आदश(cid:25) जलीय
(cid:16)ाकृितक आवास का िनमा(cid:25)ण करते ह 6 ।
और अIत ीवेरी प(cid:30)ी अभयारJय के चार’ और के संरि(cid:30) त (cid:30)े2 क(cid:31) िजस का िव, त ार और सीमाए ं इस
अिधस ूचना के पैरा 1 म< िव =न (cid:4)दh ट ह,ै पा!र ि,थ ि तक (cid:31) वन,प ित, जीवजंतु, भौगोिलक संगम’ या महI व और

पया(cid:25)वरण (संर(cid:30)ण) अिधिनयम, 1986 (1986 का 29) क(cid:31) धारा 3 क(cid:31) उपधारा (1), उपधारा (2) के खंड (v) और
खंड (xiv) और उपधारा (3) #ारा (cid:16)द$ शि&य’ का (cid:16)योग करत े *ए, कना(cid:25)टक राbय म < अIत ीवेरी प(cid:30)ी अभयारJय
के इद (cid:25) िगद (cid:25) 1.47 (cid:4)क.मी. तक के िव,त ा!रत (cid:30)े2 को अIत ीवरे ी प(cid:30)ी अभयारJय पा!रि,थ ितक(cid:31) सवं ेदी जोन (िजसे
इसम< इसके पVच ात ् पा!रि,थ ितक(cid:31) सवं ेदी जोन कहा गया ह)ै के (cid:18)प म< अिधसूिचत करती ह,ै िजसके 3 यौरे
िन(cid:13)ानुसार है, अथा(cid:25)त ् :--

ऐसे जोन क(cid:31) सीमा का वण(cid:25)न उउउउपपपपााााबबबबधधंंधधंं IIII के (cid:18)प म< संलpन ह ै।
(2) पा!रि, थितक(cid:31) संवेदी जोन के अंतगत(cid:25) आने वाले Wाम’ क(cid:31) सूची इसके साथ (cid:16)मुख UबदNु के िनदशf ांक’ सिहत
उउउउपपपपााााबबबबधधंंधधंं IIIIIIII के (cid:18)प म< संलpन ह ै।
(3) सीमा के 3 यौरे तथा अ(cid:30)ांश और देशांतर रेखा के साथ-साथ पा!रि,थ ितक(cid:31) सवं ेदी जोन क(cid:31) सीमा के 3 यौरे
मानिच2 उउउउपपपपााााबबबबधधंंधधंं IIIIIIIIIIII के (cid:18)प म< संलpन ह ै।
(4) पा!रि, थितक(cid:31) सवं ेदी जोन और साथ ही अभयारJय म< मुqय अव,थ ान’ (जीपीएस Uबद)ु उउउउपपपपााााबबबबधधंंधधंं IIIIIIIIIIIIअ के (cid:18)प
म< संलpन ह 6।
2222.... पपपपाााा(cid:14)(cid:14)(cid:14)(cid:14)ररररिििि(cid:22)(cid:22)(cid:22)(cid:22)थथथथ ििििततततकककक ससससववंंववंं ददेेददेे ीीीी जजजजोोोोनननन ककककेेेे ििििललललएएएए आआआआचचंंचचंं ििििललललकककक ममममहहहहााााययययोोोोजजजजननननाााा--------(1) राbय सरकार, पा!रि,थ ितक सवं ेदी जोन के
(cid:16)योजन के िलए राजप2 म< अंितम अिधसूचना के (cid:16)काशन क(cid:31) तारीख से दो वष (cid:25) क(cid:31) अविध के भीतर ,थानीय लोग’
के (cid:16)ितफल और ,थ ानीय लोग’ के परामश(cid:25) से और इस अिधसूचना म< अनबु ंध’ का पालन करते *ए एक आंचिलक
महायोजना तैयार करेगी ।
(2) उi त योजना का राb य सरकार म< स(cid:30)म (cid:16)ािधकारी #ारा अनुमो(cid:4)दत (cid:4)कय ा जाएगा ।¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(3) पा!रि, थितक सवं ेदनशील जोन का आचं िलक महायोजना राbय सरकार #ारा ऐसी रीित से जो इस
अिधसूचना म< िविनAदh ट (cid:4)क या जाए और सुसंगत के(cid:22)(cid:23) ीय और राbय िविधय’ के और के(cid:22)(cid:23) ीय सरकार #ारा जारी
माग(cid:25)दशe िस@ांत’ के अनु(cid:18)प तैयार (cid:4)क या जाएगा ।
(4) आंचिलक महायोजना इसम< पया(cid:25)वरण और पा!रि,थ ितक(cid:31) क(cid:31) बात’ को समाकिलत करने के िलए सभी
सबं ंिधत राb य िवभ ाग’ के परामश(cid:25) से तैयार (cid:4)क या जाएगा, अथात(cid:25) ् :--
(i) पया(cid:25)वरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पय(cid:25)टन ;
(v) नगरपािलका ;
(vi) राज, व ;
(vii) कृिष ; और
(viii) कना(cid:25)टक राb य (cid:16)दषू ण िनयं2ण बोड(cid:25);
(ix) Uसचाई;
(x) लोक िनमा(cid:25)ण िवभाग ।
(5) आंचिलक महायोजना म < जब तक इस अिध सूचना म< ऐसा िव =न (cid:4)दhट न हो तब तक अनुमो(cid:4)दत िवj मान
भू-उपयोग, अवसरं चना और (cid:4)_याकलाप’ पर कोई िनबtधन अिधरोिपत नहu (cid:4)कय ा जाएगा और आंचिलक
महायोजना सभी अवसरं चना के सुधार और अिधक द(cid:30) तथा पा!रि,थ ितक(cid:31) अनुकूल होने वाल े (cid:4)_याकलाप इस
(cid:16)कार िविनAदh ट न हो ।
(6) आंचिलक महायोजना म < अनाvछा(cid:4)दत (cid:30)े2’ के जीणw@ार, िवjमान जल िनकाय’ के संर(cid:30)ण, आवाह (cid:30)े2’
के (cid:16)बंधन, जल-संभर’ के (cid:16)बंधन, भूतल जल के (cid:16)बंधन, मृदा और नमी सरं (cid:30)ण, ,थानीय समुदाय’ क(cid:31)
आवVयकताN तथा पा!रि,थितक(cid:31) और पया(cid:25)वरण से सबं ंिधत ऐसे अ(cid:22)य पहलूN, िजन पर ^यान दने ा आवVयक ह,ै
के िलए उपबंध ह’ग े ।
(7) आंचिलक महायोजना सभी िवjमान पजू ा ,थ ल’, Wाम’ और नगरीय बंदोब,त’, वन’ के (cid:16)कार और
(cid:4)क,म ’, जनजातीय (cid:30)े2’ कृिष (cid:30)े2’, ऊपजाऊ भूिम, ह!रत (cid:30)े2 जैसे उjान और उसी (cid:16)कार के ,थ ान, उjान कृिष
(cid:30)े2, फलोjान, झील’ और अ(cid:22)य जल िनकाय’ का अyयकंन करेगी ।
(8) आंचिलक महायोजना पा!रि, थितक संवेदी जोन म < िवकास को िविनयिमत करेगी िजसस े पा!रि,थ ितक(cid:31)
अनुकूल िवकास , थानीय समुदाय’ क(cid:31) जीवकोपाज(cid:25)न सुर(cid:30)ा के िलए सुिनिVच त (cid:4)कया जा सके ।
3. रररराााा(cid:28)(cid:28)(cid:28)(cid:28)यययय ससससररररककककाााारररर (cid:29)(cid:29)(cid:29)(cid:29)ाााारररराााा (cid:30)(cid:30)(cid:30)(cid:30)ककककएएएए जजजजाााानननन ेे ेेववववाााालललल ेे ेेउउउउपपपपाााायययय-------- राbय सरकार इस अिधसूचना के उपबंध’ को (cid:16)भावी करन े के िलए
िन(cid:13)िलिखत उपाय करेगी, अथा(cid:25)त ् :--
(1) भभभभ--ूू--ूू उउउउपपपपययययोोोोगगगग ---- पा!रि, थितक सवं ेदी जोन म< वन’, उjान-कृिष (cid:30)े2’, कृिष (cid:30)े2’, आमोद-(cid:16)मोद के (cid:16)योजन के
िलए िचि(cid:22)हत (cid:4)कए गए पाकk और खुले ,थान’ का वािणिbयक और औjोिगक सबं @ िवकास (cid:4)_याकलाप’ के िलए
उपयोग या संप!रवतन(cid:25) नहu होगा :
परंतु पा!रि,थितक सवं ेदी जोन के भीतर कृिष भूिम का संप!रवत(cid:25)न, मानीटरी सिमित क(cid:31) िसफा!रश पर
और राbय सरकार के पूव (cid:25) अनुमोदन से, ,थानीय िनवािसय’ क(cid:31) आवासीय ज(cid:18)रत’ को पूरा करन े के िलए और पैरा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
4 क(cid:31) सारणी के ,तंभ (2) के अधीन मद स.ं 13, 19, 25, 30 और 33 के सामन े सूचीब@ (cid:4)_याकलाप’ को पूरा
करन ेके िलए अनुzात ह’गे, अथा(cid:25)त ् :-
(i) पा!र ि, थ ितक अनुकूल पय(cid:25)टन (cid:4)_ याकलाप’ के िल ए, पय(cid:25)टक’ के अ,थ ायी अिध भोग के िल ए
पा!र ि, थ ितक अनुकूल कुटीर जैसे टे(cid:22)ट , काhट गृह आ(cid:4)द;
(ii) िवjमान सड़क’ को चौड़ा करना तथा उनका सदढृ ीकरण और नई सड़क’ का संिनमा(cid:25)ण;
(iii) (cid:16)दषू ण उIपg न करन े वाल े लघु उjोग;
(iv) वषा (cid:25) जल संचय; और
(v) कुटीर उjोग, िजसके अंतग(cid:25)त Wामीण उjोग, सुिवधा भडं ार और ,थ ानीय सुिवधाए सि(cid:10)मिलत भी ह:6
परंतु यह और (cid:4)क राbय सरकार के पूव(cid:25) अनुमोदन और संिवधान के अनvु छ ेद 244 या तIसमय (cid:16)वृ$ िविध
के उपबंध’ के अनुपालन के िबना, िजसके अंतग(cid:25)त अनुसूिचत जनजाित और अ(cid:22)य परंपरागत वन िनवासी (वन
अिधकार’ क(cid:31) मा(cid:22)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिbयक या उjोग िवकास (cid:4)_याकलाप’ के
िलए जनजातीय भूिम का उपयोग अनुzात नहu होगा :
परंतु यह भी (cid:4)क पा!रि, थितक सवं ेदी जोन के भीतर भू-अिभलेख’ म< (cid:16)तीत होने वाली कोई 2ु!ट, मानीटरी
सिमित के िवचार (cid:16)ा8 करन े के प9ात ् राbय सरकार #ारा (cid:16)Iयेक मामले म< केवल एक बार ठीक क(cid:31) जाएगी और
उ& 2ु!ट के ठीक करन े क(cid:31) के(cid:22) (cid:23)ीय सरकार के पया(cid:25)वरण, वन और जलवाय ु प!रवत(cid:25)न मं2ालय को सूचना दने ी
होगी ।
परंतु यह भी (cid:4)क उपयु(cid:25)& 2ु!ट का संशोधन म < इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:4)कसी भी
दशा म< भू-उपयोग का प!रवत(cid:25)न सि(cid:10)मिलत नहu होगा ।
परंतु यह भी (cid:4)क िजससे ह!रत (cid:30)े2 जैसे वन (cid:30)े2 और कृिष (cid:30)2े म< कोई पा!रणािमक कटौती नहu होगी और
अनुपयुiत या अनुI पादक कृिष (cid:30)े2’ म< पुन: वनीकरण करने के (cid:16)यास (cid:4)कए जाएगं े ।
(2) (cid:19)(cid:19)(cid:19)(cid:19)ााााककककृृृृििििततततकककक !!!!ोोोोतततत#### -- आचंिलक महायोजना म < सभी (cid:16)ाकृितक }ोत’ के आवाह (cid:30)े2’ क(cid:31) पहचान क(cid:31) जाएगी और
उनके संर(cid:30)ण और नवीकरण के िलए योजना सि(cid:10)म िलत होगी और राbय सरकार #ारा इन (cid:30)े2’ पर या उनके
िनकट िवकास (cid:4)_याकलाप’, जो ऐसे (cid:30)े2’ के िलए हािनकारक ह,6 को (cid:16)ितिष@ करने के िलए ऐसी रीित स े
माग(cid:25)िनदशf तैयार (cid:4)कए जाएगं े ।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन –––– (क) पा!रि,थितक(cid:31) सवं ेदी जोन के भीतर पय(cid:25)टन सबं ंधी (cid:4)_याकलाप, जो आंचिलक महायोजना का
भाग (cid:18)प ह’ग े ।
(ख) पय(cid:25)टन महायोजना पय(cid:25)टन िवभाग, कना(cid:25)टक सरकार के वन और पया(cid:25)वरण िवभाग, के परामश(cid:25) से तैयार होगी ।
(ग) पय(cid:25)टन संबंधी (cid:4)_याकलाप िन(cid:10) निलिखत के अधीन िविनयिमत ह’गे, अथात(cid:25) ् :-
(i) पा!रि,थितक सवं ेदी जोन के भीतर सभी नए पय(cid:25)टन (cid:4)_याकलाप’ या िवjमान पय(cid:25)टन (cid:4)_याकलाप’ का
िव,तार राh ~ीय (cid:127) या(cid:128) सरं (cid:30)ण (cid:16)ािधकरण, पया(cid:25)वरण, वन और जलवाय ु प!रवतन(cid:25) मं2ालय #ारा जारी
(समय-समय पर यथा संशोिधत) मागि(cid:25) नदशे ’ के अनुसार होगा िजसम< पा!रि,थितक पय(cid:25)टन, पा!रि,थितक
िश(cid:30)ा और पा!रि,थितक िवकास को महIव (cid:4)दया जाएगा और पा!रि,थितक सवं ेदी जोन क(cid:31) वहन (cid:30)मता

(ii) पा!रि,थितक(cid:31)य अनुकूल पय(cid:25)टक (cid:4)_याकलाप’ के संबंध म < अ,थायी अिधभोग के िलए वास सुिवधा के
िसवाय अIत ीवेरी प(cid:30)ी अभयारJ य क(cid:31) सीमा से एक (cid:4)कलोमीटर भीतर होटल और !रसोटk का नया
संिनमा(cid:25)ण अनुzात नहu होगा;
परंतु संरि(cid:30)त (cid:30)े2’ क(cid:31) सीमा से एक (cid:4)कलोमीटर क(cid:31) दरू ी स े परे पा!रि,थितक(cid:31)य सवं दे ी जोन क(cid:31) सीमा तक
नए होटल और !रसाट(cid:25) के ,थापन पय(cid:25)टन महायोजना के अनुसार पा!रि,थितक(cid:31)य पय(cid:25)टन सिु वधा के िलए पूव (cid:25)
प!रभािषत और िविनAद> ,थान म < ही अनुzात (cid:4)कया जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:4)कए जान े तक, पय(cid:25)टन के िलए िवकास और िवjमान पय(cid:25)टन
(cid:4)_याकलाप’ के िव,तार को वा,तिवक ,थल िविनAद> सवं ी(cid:30)ा तथा मानीटरी सिमित क(cid:31) िसफा!रश पर
आधा!रत सबं ंिधत िविनयामक (cid:16)ािधकरण’ #ारा अनुzात (cid:4)कया होगा ।

NOTIFICATION
New Delhi, the 9th December, 2015
S.O. 3340(E).— The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification
Whereas, the Attiveri Bird Sanctuary notified as per Government of Karnataka Notification no. FEE 140 FWL
93 dated 3/10/2000 and located in the borders of Mundgod and Kalghatgi taluka of Uttar Kannada and Dharwad
Districts is spread over an area of 2.226 sq. km.
And whereas, in 1992, an irrigation tank was built across Thayavvanahalla at Attiveri village to cater the
irrigation needs of the local farmers, which also resulted in attracting varieties of birds, both local and migratory. The
first year witnessed about 20 species of birds, followed by 35 species in the next year. As the reservoir is located in the
midst of a moist deciduous forest in a calm and serene locality with abundant feeding grounds in the surroundings, it
became a heaven for the birds to seek refuge here for their breeding activities.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
And whereas, more than 1200 pairs of birds are found breeding in this man made habitats White Ibis, Herons,
little Cormorants, Spoonbills, Painted storks are some of the species, which breed here, birds like Lapwings, Water hen
Stilt, Darter, Indian shag, etc. are found throughout the year. Pintails, Gargany, Shoveller, Plovers, etc. Migrate here for
breeding between November to February. Many small and big tanks in the adjacent areas of Mundagod, Haliyal and
Yellapur taluks also help the birds to nest, feed and breed, thus making up this sanctuary an ideal aquatic habitat.
And whereas, it is necessary to conserve and protect the area the extent which is specified in paragraph 1 of this
notification around the protected area of Attiveri Bird Sanctuary as Eco-sensitive Zone from ecological, floral, faunal,
geographical associations or importance and environmental point of view and to prohibit industries or class of industries
and their operations and processes in the said Eco-sensitive Zone.
Now therefore, in exercise of the power conferred by sub-section (1) and clauses (v) and (xiv) of sub-section
(2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule
5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent upto 1.47
kms. around the boundary of Attiveri Bird Sanctuary in the State of Karnataka as the Attiveri Bird Sanctuary Eco-
sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1) The Eco-Sensitive Zone is spread over an area of 7.63 square
kilometres with an extent up to 1.47 kilometres around the boundary of Attiveri Bird Sanctuary and the boundary
description of such Zone is appended as Annexure-I.
(2) The list of villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended
as Annexure-II.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as
Annexure-III.
(4) Key locations (points) on the Eco-sensitive Zone boundary as well as on the sanctuary are appended as
Annexure- III A .
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Karnataka State Pollution Control Board;

(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
need of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural
areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.- The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 13, 19, 25, 30 and 33 in column
(2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities;
(ii) widening and strengthening of existing roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph;
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such
areas.
(3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests
and Environment of the State Government of Karnataka.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Attiveri
Bird Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism
activities:
Provided that beyond the distance of 1 kilometer from the boundary of protected areas till the extent of the Eco-
sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-define and designated areas for
Eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be
permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the
Monitoring Committee.
(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government or Karnataka State Pollution Control
Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance
with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made
thereunder.
(7) Air pollution.—The Environment Department of the State Government or Karnataka State Pollution Control Board
shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents. — The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes.— Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide notification number S.O. 908(E), dated the 25th September, 2000 as amended from time
to time;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the
Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is
prepared and approved by the Competent Authority in the State Government, Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units
(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted
except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil and noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco-sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely:-

construction in their land for residential use including the
activities listed in sub-paragraph (1) of paragraph 3:

applicable rules and regulations, if any:
Provided further that, beyond one kilometer upto the extent
of Eco-sensitive Zone construction for bone fide local
needs shall be permitted and other construction activities
shall be regulated as per Zonal Master Plan.
15. Felling of trees. (a) There shall be no felling of trees in the forest or

5. Monitoring Committee:-
The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone

a. Deputy Commissioner, Uttar Kannada. - Chairman;
b. Representative of the Department of Environment, Government of Karnataka. – Member;
c. Representative of the Department of Urban Development, Government of Karnataka - Member;
d. An expert in the area of ecology and environment to be nominated by the Government of Karnataka for a term of
one year in each case. - Member;
e. A representative of NGO working in the field of environment to be nominated by the Government of Karnataka for
a term of one year. -Member;
f. Representative of Karnataka State Pollution Control Board. - Member;
g. The Conservator of Forests and Director, Dandeli-Anshi Tiger Reserve, Dandeli
-Member Secretary.
6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental
clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro-forma appended at
Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal .

BOUNDARIES OF ATTIVERI BIRD SANCTUARY
NORTH: The line starts at a junction point on the common inter village boundary of Garud honihalli village Sy
No. 297 and Asthakatti village Sy No. 114 near a small tank, then the line runs in east direction along the reserve forest
boundary and borders of SY No 114, 113, 110, 111, 102, 101, 100, 97 & 96 of Villages Asthakatti. Then it runs North
along the same reserve forest boundary and reaches the corner of Sy No. 67 of same village.
EAST: From the above point the boundary runs eastwards in the reserve forest boundary till the co-ordinate N 150 5'
35.68” E 750 3' 11.36”, then the boundary passes along outer line of reserved forest boundary of Bendlagatti village &
forest Sy. No. 85 till the co-ordinate N 150 4' 52.78” E 7503' 51.07”. Then the line runs in south-west direction along
the stream till the co-ordinate N 150 4' 43.0” E 750 3' 4.53”, then the line continuous southwards to reach the point with
co-ordinate N 1504' 28.28” E 750 3' 45.48”, then line passes in south direction till the co-ordinate N 150 4' 16.05” E 750
3' 43.71” on the inter village boundary of Bendlagatti and Vadaghatta villages. Then line passes in south-west direction
till the co-ordinate N 150 3' 51.69” E 750 3' 26.78”.
SOUTH: From the above point line proceeds in south-west direction till the co-ordinate N 150 3' 38.83” E 7503' 8.08”,
then the line runs westwards till the co-ordinate N 150 3' 34.18” E 7502' 42.4” further the line continuous till it reaches
the co-ordinate N 150 3' 38.21” E 750 2' 23.69”. Then the boundary runs in north-west direction along the reserve forest
boundary of Hunugunda of Uttara kannada district till it reaches a stream.
WEST: From the above point the line runs in west direction along the Kalaghatagi taluk boundary as well as reserve
forest boundary. Then it runs North along the reserve forest boundary and turns North-East direction through the borders
of Garud honihalli Village Sy. Nos. 318, 319, 311, 302, 301 & 297 till it reaches the point where the line begins.
