9वारा (cid:24)द:त शि<तय= का (cid:24)योग करते हुए, जार(cid:8) करने का (cid:24)Cताव करती है, पया(वरण (संर-ण) (cid:21)नयम, 1986 के
(cid:21)नयम 5 के उप(cid:21)नयम (3) क3 अपे-ानुसार, जनसाधारण क3 जानकार(cid:8) के (cid:12)लए (cid:24)का(cid:12)शत क3 जाती है; िजनके उससे
(cid:24)भाGवत होने क3 संभावना है, और यह सूचना द(cid:8) जाती है Hक उ<त (cid:24)ा(cid:26)प अ(cid:29)धसूचना पर, उस तार(cid:8)ख से, िजसको इस
अ(cid:29)धसूचना वाले भारत के राजपJ क3 (cid:24)(cid:21)तयां जनसाधारण को उपलKध करा द(cid:8) जाती हL, साठ (cid:4)दन क3 अव(cid:29)ध क3
समािMत पर या उसके पNचात ् Gवचार Hकया जाएगा ;

(xiv) और उप-धारा (3) 9वारा (cid:24)द:त शि<तय= का (cid:24)योग करते हुए, राजCथान राmय मR नाहरगढ़ व%यजीव अभयार_य
क3 सीमा के चारो ओर 0 से 13 Hकलोमीटर तक के GवCताXरत -ेJ को नाहरगढ़ व%यजीव अभयार_य पाXरिCथ(cid:21)तक3य
संवेद(cid:8) जोन (िजसे इसमR इसके पNचात ् पाXरिCथ(cid:21)तक संवेद(cid:8) जोन कहा गया है) के (cid:26)प मR अ(cid:29)धसू(cid:29)चत करती है, िजसका

1. पा(cid:15)रि’थ)तक संवेद, जोन का .व’तार और उसक0 सीमाएं--(1) नाहरगढ़ व%यजीव अभयार_य के पाXरिCथ(cid:21)तक
संवेद(cid:8) जोन, क3 सीमा के चारो ओर 0 से 13 Hकलोमीटर के GवCतार के साथ 79.872 वग ( Hकलोमीटर के -ेJ मR फैला
हुआ है और ऐसे जोन क3 सीमाओं का Gववरण उपाबंध I मR (cid:4)दया गया है ।
(2) पाXरिCथ(cid:21)तक संवेद(cid:8) जोन, राजCथान के जयपुर िजले के अंतगत( आने वाले 13 hाम= मR फैला हुआ है ।
(3) पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के अंतगत( आने वाले hाम= क3 सूची (cid:24)मुख iब%दओु ं के (cid:21)नदuशांक= के साथ उपाबंध II
के (cid:26)प मR उपाबW है ।

2. पा(cid:15)रि’थ)तक संवेद, जोन के 4लए आंच4लक महायोजना – (1) राmय सरकार, पाXरिC थ(cid:21)तक संवेद(cid:8) जोन के (cid:24)योजन
के (cid:12)लए राजपJ मR अ(cid:29)धसूचना के अं(cid:21)तम (cid:24)काशन क3 तार(cid:8)ख से दो वष ( क3 अव(cid:29)ध के भीतर, Cथानीय Qयि<तय= के
परामश ( से, इस अ(cid:29)धसूचना मR संलk न अनुबंध= के सामंजCय से आंच(cid:12)लक महायोजना तैयार करेगी ।
(2) उ<त योजना राm य सरकार के स-म (cid:24)ा(cid:29)धकार(cid:8) 9वारा अनुमो(cid:4)दत होगी ।
(3) पाXरिC थ(cid:21)तक संवेद(cid:8) जोन के (cid:12)लए आचं(cid:12)लक महायोजना इस अ(cid:29)धसूचना मR Gव(cid:21)न(cid:4)द(Sट (cid:26)प मR ऐसी र(cid:8)(cid:21)त मR
राm य सरकार तथा सुसंगत कR&(cid:8)य और राm य Gव(cid:29)धय= के सामंजCय मR भी तथा कR&(cid:8)य सरकार 9वारा जार(cid:8) माग(cid:21)(नदuश,
य(cid:4)द कोई ह=, 9वारा तैयार होगी ।
(4) यह मह:वपूण ( संरn-त -ेJ= मR से ऐसा -ेJ है जो एस.ट(cid:8).आर. तथा आर. ट(cid:8).आर. तक iबखरे तRदआु जैसे पशुओं
के (cid:12)लए (cid:4)टकने का एक साधन (cid:12)सW हो सकता है और इसी(cid:12)लए आचं(cid:12)लक महायोजना तैयार करते समय उनके अ(cid:21)तXर<त
संर-ण तथा जीणpWार के (cid:12)लए -ेJ= Gवशेष yप से पहाड़ी इलाक= के -ेJ= क3 पहचान के (cid:24)यास Hकए जाने चा(cid:4)हए ।
(5) आचं(cid:12)लक महायोजना, इसमR पया(वरणीय और पाXरिC थ(cid:21)तक3 Gवचार= को समाक(cid:12)लत को करने के (cid:12)लए राmय के
सभी संबW Gवभाग= के परामश( से तैयार होगी, अथा(त ् :--
(i) पया(वरण ;
(ii) वन ;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(iii) नगर Gवकास ;
(iv) पयट( न ;
(v) नगरपा(cid:12)लक ;
(vi) राजCव ;
(vii) कृGष ;
(viii) राजCथान राm य (cid:24)दषू ण (cid:21)नयJं ण बोड ( ;
(ix) (cid:12)सचं ाई ; और
(x) लोक (cid:21)नमा(ण Gवभाग,

) आंच(cid:12)लक महायोजना अनुमो(cid:4)दत Gव9यमान भू-उपयोग, अवसंरचना: मक और Hxयाकलाप= पर कोई (cid:21)नबधz न
अ(cid:29)धरोGपत नह(cid:8)ं करेगी जब तक Hक इस अ(cid:29)धसूचना मR और आचं(cid:12)लक महायोजना मR सभी अवसंरचना और अ(cid:29)धक
(cid:24)भावी और पाXरिC थ(cid:21)तक3य अनुकूल Hxयाकलाप कारक इस (cid:24)कार Gव(cid:21)न(cid:4)द(Sट न हो ।
(7) आंच(cid:12)लक महायोजना मR अना{छा(cid:4)दत -ेJ= के जीणpWार, Gव9यमान जल (cid:21)नकाय= के संर-ण, आवाह -ेJ= के
(cid:24)बंधन, जल-संभर= के (cid:24)बंधन, भूतल जल के (cid:24)बंधन, मदृ ा और नमी संर-ण, Cथानीय समुदाय= क3 आवNयकताओं तथा
पाXरिCथ(cid:21)तक3 और पया(वरण से संबं(cid:29)धत ऐसे अ%य पहलूओ,ं िजन पर [यान देना आवNयक है, के (cid:12)लए उपबंध ह=गे ।

( ) आंच(cid:12)लक महायोजना सभी Gव9यमान पूजा C थल=, hाम= और नगर(cid:8)य बंदोबCत=, वन= के (cid:24)कार और HकC म=,
कृGष -ेJ=, ऊपजाऊ भू(cid:12)म, हXरत -ेJ जैसे उ9यान और उसी (cid:24)कार के C थान, उ9यान कृGष -ेJ, आHक(ड=, झील= और
अ%य जल (cid:21)नकाय= का अ~यकंन करेगी ।

) आंच(cid:12)लक महायोजना पाXरिC थ(cid:21)तक संवेद(cid:8) जोन मR Gवकास के पाXरिC थ(cid:21)तक अनुकूल Gवकास और Cथानीय
समुदय= क3 आजीGवका को सु(cid:21)निNचत करते हुए Gव(cid:21)नय(cid:12)मत होगी ।
3. रा7य सरकार 8वारा 9कए जाने वाले उपाय-- राmय सरकार इस अ(cid:29)धसूचना के उपबंध= को (cid:24)भावी करने के (cid:12)लए
(cid:21)न(cid:15)न(cid:12)ल(cid:22)खत उपाय करेगी, अथा(त ् :--
(1) भू-उपयोग - पाXरिC थ(cid:21)तक संवेद(cid:8) जोन मR आमोद-(cid:24)मोद के (cid:24)योजन के (cid:12)लए (cid:29)चि%हत Hकए गए वन=, उ9यान-कृGष
-ेJ=, कृGष -ेJ=, पाक(cid:127) और खुले Cथान= का वा(cid:22)णिmयक और औ9यो(cid:29)गक संबW Gवकास Hxयाकलाप= के (cid:12)लए उपयोग या
संपXरवतन( नह(cid:8)ं होगा :
परंत ु पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के भीतर कृGष भू(cid:12)म का संपXरवतन( , iSjk 5 ds v/khu मानीटर(cid:8) स(cid:12)म(cid:21)त क3
(cid:12)सफाXरश पर और राmय सरकार के पूव ( अनुमोदन से, Cथानीय (cid:21)नवा(cid:12)सय= क3 आवासीय ज(cid:26)रत= को पूरा करने के (cid:12)लए
और पैरा 4 क3 सारणी के Cतंभ (2) के अधीन xम सं0 12, 18, 24, 29 और 32 के सामने सूचीबW Hxयाकलाप= को
पूरा करने के (cid:12)लए अनुcात ह=गे, अथा(त ् :-
(i) पाXरिC थ(cid:21)तक3य अनुकूल पयट( न Hxयाकलाप= के (cid:12)लए पयट( क= के अC थायी आवासन के (cid:12)लए पाXरिC थ(cid:21)तक3य
अनुकूल आरामगाह जैसे टRट, लकड़ी के मकान आ(cid:4)द;
(ii) Gव9यमान सड़क= को चौड़ा और सुoढ बनाना तथा नई सड़क= का सं(cid:21)नमा(ण;
(iii) (cid:24)दषू ण काXरत न करने वाले लघु उ9योग;
(iv) वषा( जल संचयन; और
(v) कुट(cid:8)र उ9योग िजसके अंतगत( hामीण उ9योग, सुGवधा भंडार और Cथानीय सुख-सुGवधाएं हL :
परंत ु यह और भी Hक राmय सरकार के पूव ( अनुमोदन तथा संGवधान के अनु{छेद 244 या त:समय (cid:24)व:ृ त
Gव(cid:29)ध के उपबंध= के अनुपालन के iबना, िजसके अंतगत( अनुसू(cid:29)चत जनजा(cid:21)त और अ%य परंपरागत वन (cid:21)नवासी (वन
अ(cid:29)धकार= क3 मा%यता) अ(cid:29)ध(cid:21)नयम, 2006 (2007 का 2) भी है, वा(cid:22)णिmयक या उ9योग Gवकास Hxयाकलाप= के (cid:12)लए4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
जनजातीय भू(cid:12)म का उपयोग अनुcात नह(cid:8)ं होगा :
परंत ु यह और भी Hक पाXरिC थ(cid:21)तक संवेद(cid:8) जोन के भीतर भू-अ(cid:12)भलेख= मR पाई जाने वाल(cid:8) कोई Jु(cid:4)ट मानीटर(cid:8)
स(cid:12)म(cid:21)त के Gवचार (cid:24)ाMत करने के पNचात ् राmय सरकार 9वारा (cid:24):येक मामले मR एक बार संशो(cid:29)धत होगी और उ<त Jु(cid:4)ट
के संशोधन क3 भारत सरकार के पया(वरण, वन और जलवायु पXरवतन( मंJालय को सूचना देनी होगी :
परंतु यह और भी Hक उपय<ु( त Jु(cid:4)ट के संशोधन मR इस उप पैरा के अधीन यथा उपबं(cid:29)धत के (cid:12)सवाय Hकसी भी
दशा मR भू-उपयोग का पXरवतन( सि(cid:15)म(cid:12)लत नह(cid:8)ं होगा :
परंत ु यह और भी Hक िजससे हXरत -ेJ जैसे वन -ेJ, कृGष -ेJ आ(cid:4)द मR कोई पाXरणा(cid:12)मक कटौती नह(cid:8)ं होगी
और अन(cid:24)य<ु त या अनु:प ादक कृGष -ेJ= मR पुन: वनीकरण करने के (cid:24)यास Hकए जाएंगे ।
(2) $ाकृ)तक जल >ोत -- आचं(cid:12)लक महायोजना मR सभी (cid:24)ाकृ(cid:21)तक (cid:130)ोत= क3 पहचान क3 जाएगी और उनके संर-ण और
पुननव( ीकरण के (cid:12)लए योजना सि(cid:15) म(cid:12)लत होगी और राmय सरकार 9वारा ऐसे -ेJ= पर या उनके (cid:21)नकट Gवकास
Hxयाकलाप (cid:24)(cid:21)तGषW करने के (cid:12)लए ऐसी र(cid:8)(cid:21)त से माग(cid:21)(नदuश तैयार Hकए जाएंगे ।
(3) पयट(cid:4) न – (क) पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के भीतर पयट( न संबंधी Hxयाकलाप, पयट( न महायोजना के अनुसार ह=गे,
जो आंच(cid:12)लक महायोजना का भाग (cid:26)प ह=गे ।
(ख) पयट( न महायोजना राजCथान सरकार के पयट( न Gवभाग 9वारा राजCव और वन Gवभाग राजCथान सरकार के
परामश ( से तैयार होगी ।
(ग) पयट( न संबंधी Hxयाकलाप (cid:21)न(cid:15) न(cid:12)ल(cid:22)खत के अधीन Gव(cid:21)नय(cid:12)मत ह=गे, अथा(त ् :-
(i) पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के भीतर सभी नए पयट( न Hxयाकलाप= या Gव9यमान पयट( न Hxयाकलाप= का
GवCतार के%&(cid:8)य सरकार esa पया(वरण, वन और जलवायु पXरवतन( मंJालय 9वारा जार(cid:8) माग(cid:21)(नदuश= राS(cid:131) (cid:8)य Qय ा(cid:132) संर-ण
(cid:24)ा(cid:29)धकरण, तथा 9वारा जार(cid:8) पाXरिCथ(cid:21)तक पयट( न (cid:4)दशा (cid:21)नदuश (समय-समय पर यथा संशो(cid:29)धत) के अनुसार होगा
िजसमR पाXरिCथ(cid:21)तक पयट( न, पाXरिCथ(cid:21)तक (cid:12)श-ा और पाXरिCथ(cid:21)तक Gवकास को मह:व (cid:4)दया जाएगा और पाXरिCथ(cid:21)तक
संवेद(cid:8) जोन क3 वहन -मता के अ[ययन पर आधाXरत होगा ;
(ii) नाहरगढ़ व%यजीव अभयार_य क3 सीमा के 1 Hकलोमाटर के भीतर होटल= और Xरसाट(cid:127) के नए सं(cid:21)नमा(ण
अनुcात नह(cid:8)ं होग े (cid:12)सवाय पाXरिCथ(cid:21)तक अनुकूल पयट( न Hxयाकलाप= के संबंध मR पयट( क= के (cid:12)लए अCथायी (cid:21)नवास
Cथान= के ।
परंत ु यह Hक संरn-त -ेJ= क3 सीमा से 1 Hकलोमीटर के आग े से पाXरिCथ(cid:21)तक संवेद(cid:8) जोन के GवCतार तक नए
भवन= और Xरसट(cid:127) के Cथापन को केवल पूव( पXरभाGषत, पदाGव(cid:4)हत -ेJ= मR पयट( न महायोजना के अनसु ार
पाXरिCथ(cid:21)तक3य पयट( न सुGवधाओं के (cid:12)लए अनुcात Hकया जाएगा ।
(iii) आंच(cid:12)लक महायोजना का अनुमोदन Hकए जाने तक, पयट( न के (cid:12)लए Gवकास और Gव9यमान पयट( न
Hxयाकलाप= के GवCतार को वाCतGवक Cथल Gव(cid:21)न(cid:4)द(Sट संवी-ा तथा मानीटर(cid:8) स(cid:12)म(cid:21)त क3 (cid:12)सफाXरश पर आधाXरत
संबं(cid:29)धत Gव(cid:21)नयामक (cid:24)ा(cid:29)धकाXरय= 9वारा अनुcात Hकया जाएगा ।
(4) नैस(cid:21)गक(cid:4) .वरासत -- पाXरिCथ(cid:21)तक संवेद(cid:8) जोन मR मह:वपूण ( नैस(cid:29)गक( Gवरासत के सभी Cथल= जैसे सभी जीन कोश
आरn-त -ेJ, शैल Gवरचनाएं, जल (cid:24)पात=, झरन=, घाट(cid:8) माग(cid:127), उपवन=, गुफाएं, Cथल=, (cid:133)मण, अNवरोहण, (cid:24)पातो आ(cid:4)द
क3 पहचान क3 जाएगी और उ%हR पXररn-त Hकया जाएगा तथा उनक3 सुर-ा और संर-ा के (cid:12)लए इस अ(cid:29)धसूचना के
(cid:24)काशन क3 तार(cid:8)ख से छह मास के भीतर, उपयु<त योजना बनाएगी और ऐसी योजना आंच(cid:12)लक महायोजना का भाग
होगी ।
(5) मानव )न4मत(cid:4) .वरासत ’ थल - पाXरिC थ(cid:21)तक संवेद(cid:8) जोन मR भवन=, संरचनाओं, (cid:12)श(cid:6)प-त(cid:134)य, ऐ(cid:21)तहा(cid:12)सक, कला:मक

S.O. 2608(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification
WHEREAS, the Nahargarh Wildlife Sanctuary lying between latitudes 26056’15.08’’N and 26057’5.81’’N and
longitudes 75048’55.70’’E and 75046’54.65’’E and notified vide Government of Rajasthan notification No. F11(39)
Revenue/8/80, dated the 22nd September, 1980 is situated in the Aravalli ranges at Amber hills, district Jaipur, Rajasthan
and is spread across 52.40 square kilometers;
AND WHEREAS, the sanctuary has ’’Tropical Dry Deciduous Forest’’ and “Tropical Thorn Forest” as per Champion
and Seth classification and the forest is spread over the area on various geological and soil formations and hilly terrain of
Aravalis and hence varies in composition;
AND WHEREAS, the Wildlife sanctuary has a varied habitat having diversified fauna and flora and the major flora of
this sanctuary includes Boswellia serrata, Linnea gradis Syn.L.coromandellica, Emblica officinalis, Wrightia tinctoria,
Ficus glomerata, Sterculia urens, Cassia fistula, Acacia catechu, Butea monosperma, Syzyguim cumini where leopard,
Hyaena, Jackal, Wolf, Lemur, Porcupine, Bijju, Nevla, Chinkara, Indian Wild boar, Fox, Crocodile, Jungle Cat, Chital,
Sambhar, Bluebull and many species of birds comprise the main fauna of the sanctuary.
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in
paragraph 1 of this notification around the protected area of Nahargarh Wildlife Sanctuary as Eco- sensitive Zone from
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the power conferred by sub section(1), clauses (v) and (xiv) of sub-section (2) and
sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub-rule (3) of rule 5 of
the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 016 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
to 13 kilometers around the boundary of Nahargarh Wildlife Sanctuary in the State of Rajasthan as the Nahargarh
Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under,
namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area of 79.872 square
kilometers with an extent varying from 0 to 13 kilometers around the boundary of Nahargarh Wildlife Sanctuary and the
boundary description of such Zone is given in Annexure I.
(2) The Eco-sensitive Zone is spread across 13 villages falling in Jaipur district of Rajasthan.
(3) The list of villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as
Annexure II.
(4) The maps of the Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as
Annexure III A and III B respectively.
(5) The details of Global Positioning System coordinates of the points along the boundary of the Nahargarh
Wilidlife Sanctuary and its eco-sensitive zone are appended as Annexure-III C.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall for the purpose of the Eco-
sensitive Zone prepare a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4) This is one of the important protected areas which may provide stepping stone for animals dispersing from
Sariska Tiger Reserve (STR) and Ranthambore Tiger Reserve (RTR) like leopard, etc. and therefore, while preparing the
Zonal Master Plan attempt should be made to identify areas specially of hilly region for their additional protection and
restoration.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Rajasthan State Pollution Control Board;
(ix) Irrigation;
(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(6) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural
areas, orchards, lakes and other water bodies.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 12, 18, 24, 29 and 32 in column (2)
of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities;
(ii) Widening and strengthening of existing roads and construction of new roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the
State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to
such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master
Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Rajasthan in consultation
with Department of Forests and Environment, Government of Rajasthan.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Nahargarh Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly
tourism activities:
Provided that beyond the distance of one kilometer from the boundary of the Protected Areas till the extent of
the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated
areas for Eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Rajasthan State Pollution Control Board
shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with
the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) Air pollution.- The Environment Department of the State Government or Rajasthan State Pollution Control Board
shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time
to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the
Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall
be permitted except the existing wood based Industries set up as per the law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely:-

within one kilometer of the boundary of the Protected Area
except for accommodation for temporary occupation of
tourists related to Eco-friendly tourism activities.
However, beyond one kilometer and upto the extent of the
Eco-sensitive Zone all new tourism activities or expansion of
existing activities shall in conformity with the Tourism
Master Plan and guidelines of National Tiger Conservation
Authority.
13 Construction activities. (a) No new commercial construction of any kind shall be
permitted within one kilometre from the boundary of the
Protected Area:
Provided that, local people shall be permitted to undertake
construction in their land for their residential use including
the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small
scale industries not causing pollution shall be regulated and
kept at the minimum, with the prior permission from the
Competent Authority as per applicable rules and regulations,
if any.
(b) beyond one kilometre upto the extent of Eco-sensitive
Zone construction for bona fide local needs shall be permitted
and other construction activities shall be regulated as per
Zonal Master Plan.
14. Felling of trees. (a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the Competent Authority in the State
Government;
(b) the felling of trees shall be regulated in accordance with
the provisions of the concerned Central or State Acts and the
rules made thereunder.
(c) in case of Reserve Forests and Protected Forests the
Working Plan prescriptions shall be followed.
15. Commercial water resources including (a) The extraction of surface water and ground water shall be

5. Monitoring Committee- (1) The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone falling in the State of Rajasthan , which shall comprise of the following, namely:-
(a) District Collector, Jaipur - Chairman;
(b) Sub Divisional Officer, Amer - Member;
(c) A representative of Non-Government Organization working in the field of environment - Member;
to be nominated by the Government of Rajasthan for a period of one year in each case.
(d) One expert in the area of ecology and environment to be nominated by the - Member;
Government of Rajasthan for a period of one year in each case.
(e) Honorary wildlife warden, Jaipur - Member;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
(f) Regional Officer, Rajasthan State Pollution Control Board - Member;

Terms of Reference:
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at
Annexure IV.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal .

Annexure I
Description of Boundaries of proposed Eco-sensitive Zone
In order to delineate boundaries of Eco-sensitive Zone of Nahargarh Wildlife Sanctuary all field structures,
habitations, water bodies, Industrial areas, religious places and other public institutes as provided by the revenue
authorities have been marked on the map annexed with this notification. Global Position System have been marked on
the Sanctuary boundaries, which are numbered from 1 to 100 on the map. Then the boundaries of Eco-sensitive Zone
have also been marked on the same map and its Global Position System points have also marked on the boundary and
numbered as 101 to 340.This map is annexed as Annexure-III. The boundary of Eco- sensitive Zone is decided as
indicated by the Global Position System points shown on this map as under:-
Northern boundary: The extent of Eco-sensitive Zone from Global Position System point number 186 marked
on reserve forest block boundary Amer -54 and Eco-sensitive Zone boundary including villages Bagwara, Singwana,
Chhapradi, Jaitpura Khinchi, Achrol, Aandhi, Labana, Gunawata, Dhandh, Harbar to Kukas to Global Position System
point number 274 will be 13 kilometers. Eco-sensitive Zone boundary from Global Position System point number 186 to
174 is co-terminus with the boundary of reserve forest block Amer-54 and will include the whole reserve forest in the
Eco-sensitive Zone within these Global Position System points.(As shown in Annexure-III)
Eastern boundary: The extent of Eco-sensitive Zone from Global Position System point number 275 to 284
will be Reserve forest block boundary, from Global Position System point number284 to 285 will be along National
Highway No. 8(Now NH 11-C),from Global Position System point number 285 to 299 will be 100 metres to 400 meters22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
from sanctuary boundary.Similarly,the boundary along NH 8(Now 11 C) from Global Position System point 299 to 301
will be Eco sensitive zone. Reserve forest block boundary from GPS point number 301 to 324 will be Eco sensitive zone
limit. Sanctuary boundary from Global Position System point number 324 to 329 will be Eco-sensitive Zone limit
including Rajamal ka talab. The extent of Eco-sensitive Zone from Global Position System point number 301 to 329 will
be from 100 meters to 2.0 kilometers. All these reference points will have been as shown in Annexure –III.
Southern boundary: Eco-sensitive Zone boundary from Global Position System point number 329 to 340 and
up to 101 will be co-terminus with the boundary of Sanctuary. From Global Position System point number 101 to 104 it
will be co-terminus with the boundary of reserve forest Block Amer-54. From GPS point number 104 to 108 it will be
co-terminus with the boundary of Sanctuary. From Global Position System point number 108 to 147 it will run along the
natural boundaries (flow as well as bed area upto both banks)of Amanishah nullah. All these reference points will be as
shown in Annexure –III.
Western boundary: Eco-sensitive Zone boundary from Global Position System point number 147to 160 will
be co-terminus with the boundary of sanctuary. From Global Position System point number 160 to 186 it will be 50
meters to 2 kilometers including Bahav sagar, Akhepura, Badagao, Bhatiya, Bishangarh areas. All these reference points
will be as shown in Annexure–III.
