के मानजचत्र ऄनलु ग्नक –IIक, ऄनलु ग्नक-IIख, ऄनलु ग्नक-IIग और ऄनलु ग्नक-IIघ के रूप म ेंसंलग्न ह।ै (4) और आसके पाररजस्ट्थजतकी संवेदी जोन के भू-जनदेिांक ऄनलु ग्नक –III की सारणी क और ख में ददए गए ह।ै (5) पाररजस्ट्थजतकी संवेदी जोन के अ अने वाल ेग्रामों की सूची ऄनलु ग्नक-IV के रूप म ेंसलं ग्न ह।ै 2. पाररजस्ट्थजतकी संवदे ी जोन के जलए अचं जलक महायोजना.–(1) राज्य सरकार, द्वारा पाररजस्ट्थजतकी संवेदी जोन के प्रयोजन के जलए, राजपत्र म ें ऄजं तम ऄजधसूचना के प्रकािन की तारीख स े दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करते हुए, राज्य सरकार के सक्षम प्राजधकारी के ऄनुमोदनाथ ा एक अंचजलक महायोजना बनाइ जायेगी। (2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना आस ऄजधसूचना में जवजनर्ददष् ट रीजत स े तथा प्रासंजगक केंरीय और राज्य जवजधयों के ऄनुरूप तथा केंरीय सरकार द्वारा जारी ददिा जनदिे ों, यदद कोइ हों, के ऄनुसार बनायी जाएगी। (3) अंचजलक महायोजना म ें पाररजस्ट्थजतकी और पयाावरण सबं ंधी सरोकारों को िाजमल करने के जलए आसे राज्य सरकार के जनम्नजलजखत जवभागों के परामिा से बनाया जाएगा, ऄथाात:् - (i) पयाावरण, (ii) वन और वन्द्यजीव, (iii) िहरी जवकास (iv) ग्रामीण जवकास, (v) पयाटन, (vi) ,[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 (vii) , (viii) कृजि, (ix) ससचाइ और बाढ़ जनयंत्रण, (x) पंचायती राज, (xi) , (xii) लोक जन मााण जव भाग। (4) जब तक आस ऄजधसूचना में जवजनर्ददष्ट न हो, अंचजलक महायोजना में वतामान में ऄनमु ोददत भू-ईपयोग, ऄवसंरचना और दरयाकलापों पर कोइ प्रजतबंध नहीं लगाया जाएगा तथा अचंजलक महायोजना में सभी ऄवसंरचनाओं और दरयाकलापों म ें सुधार करके ईन्द्ह ेऄजधक दक्ष और पाररजस्ट्थजतकी-ऄनुकूल बनान ेकी व्यवस्ट्था की जाएगी। (5) अंचजलक महायोजना म ें वनरजहत और ऄवरजमत क्षेत्रों के सुधार, जवद्यमान जल जनकायों के संरक्षण, जलग्रहण क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय जनता की अवश्यकताओं तथा पाररजस्ट्थजतकी एव ं पयाावरण के ऐसे ऄन्द्य पहलओंु की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया जाना अवश्यक ह।ै (6) अंचजलक महायोजना में सभी जवद्यमान पूजा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तयों, वनों की श्रेजणयों एवं दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भूजम, ईद्यानों एवं ईद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और ऄन्द्य जल जनकायों की सीमा का सहायक मानजचत्र के साथ जनधाारण दकया जाएगा और औ प्रस्ट्ताजवत भ-ू ईपयोग की जविेिताओं का ब्यौरा भी जाएगा। (7) अंचजलक महायोजना म ें पाररजस्ट्थजतकी संवेदी जोन म ें होने वाले जवकास का जवजनयमन दकया जाएगा और सारणी में यथासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध एव ं जवजनयजमत दरयाकलापों का पालन दकया जाएगा। आसमें स्ट् थानीय जनता की अजीजवका की सरु क्षा के जलए पाररजस्ट्थजतकी-ऄनुकूल जवकास का भी सुजनश्चय एवं संवधान दकया जाएगा। (8) अंचजलक महायोजना, क्षेत्रीय जवकास योजना की सह-काजलक होगी । (9) ऄनुमोददत अंचजलक महायोजना, जनगरानी सजमजत के जलए एक संदभ ा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना के ईपबंधों के ऄनुसार जनगरानी के ऄपने कताव्यों का जनवाहन कर सके। 3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:- (1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के जलए जचजन्द्हत ईद्यानों और खुल े स्ट्थानों का वृहद वाजणजज्यक या अवासीय पररसरों या औद्योजगक दरयाकलापों के जलए प्रयोग या संपररवतान ऄनुमत नहीं दकया जाएगा: परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर ऊ भाग (क), म ें जवजनर्ददष्ट प्रयोजन से जभन्न प्रयोजन के जलए कृजि और ऄन्द्य भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा ऄनमु ोदन स े क्षेत्रीय नगर योजना ऄजधजनयम तथा यथा लाग ू केन्द्रीय सरकार एव ं राज्य सरकार के ऄन्द्य जनयमों एव ं जवजनयमों के ऄधीन तथा आस ऄजधसूचना के ईपबंधों के ऄनुसार स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय जरूरतों को पूरा करने के जलए ऄनुमत दकया जाएगा जैसे:- (i) जवद्यमान सड़कों को चौड़ा करना, ईन्द्ह ेंसुद ृ करना और नइ सड़कों का जनमााण करना; (ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) प्रदिू ण ईत्पन्न न करने वाल े लघ ुईद्योग; (iv) कुटीर ईद्योग एवं ग्राम ईद्योग; पाररजस्ट्थजतकी पयाटन में सहायक सुजवधा भण्डार औ स्ट्थानीय सुजवधाए ं तथा ह वास; और (v) पैरा -4 में ईजल्लजखत बढ़ावा ददए गए दरयाकलापः परंत ु यह भी दक क्षेत्रीय िहरी जनयोजन ऄजधजनयम के ऄधीन सक्षम प्राजधकारी के पूवा ऄनमु ोदन के जबना तथा राज्य सरकार के ऄन्द्य जनयमों एवं जवजनयमों एवं संजवधान के ऄनुच्छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त जवजध, जजसके ऄंतगता ऄनुसूजचत जनजाजत और ऄन्द्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्द्यता) ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास दरयाकलापों के जलए जनजातीय भूजम का प्रयोग ऄनुमत नहीं होगा: परंत ु यह भी दक पाररजस्ट् थजतकी संवेदी जोन के ऄतं गता अने वाली भूजम के ऄजभलेखों म ें हुइ दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करन े के पश्चात,् राज्य सरकार द्वारा प्रत्येक मामल े म ें एक बार सुधारा जाएगा और ईि त्रुरट को सुधारन े की सूचना केंरीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय को दी जाएगी: परंत ु यह भी दक ईपयुाि त्रुरट को सुधारन े म,ें आस ईप-पैरा में यथा ईपबंजधत के जसवाय, दकसी भी दिा म ें भू- ईपयोग का पररवतान िाजमल नहीं होगा (ख) ऄनप्रु य ु या ऄनुत् पादक कृजि क्षेत्रों म ें वनीकरण तथा पयावा ासों की बहाली के : प्रयास दकए जाएंगे। (2) प्राकृजतक जल .- सभी प्राकृजतक जलमागों के जलग्रहण क्षेत्रों की पहचान की जाएगी और अंचजलक महायोजना में ईनके संरक्षण और बहाली की योजना सज‍ मजलत की जाएगी और राज्य सरकार द्वारा - दक ईसमें क्षेत्रों म ें जवकास दरयाकलापों को प्रजतजिद्ध और जनबंजधत दकया गया हो । (3) पयटा न एव ं पाररजस्ट्थजतकी पयटा न.– (क) पाररजस्ट्थजतकी संवेदी जोन में सभी नए पाररजस्ट्थजतकी पयाटन दरयाकलाप या जवद्यमान पयाटन दरयाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेदी जोन पयाटन महायोजना के ऄनुसार ऄनुमत होगा। (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य सरकार के पयावा रण और वन जवभाग के परामिा से पयाटन जवभाग द्वारा बनायी जाएगी। (ग) पयाटन महायोजना अंचजलक महायोजना का घटक होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अ अधार पर तैयार की जायेगी (ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दरयाकलाप जन‍न ानुसार जवजनयजमत दकए जाएंग,े ऄथाात:्- (i) की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, आनम ें जो भी ऄजधक जनकट हो, दकसी होटल या ररजॉटा का नया सजन्नमााण ऄनुमत नहीं दकया जाएगाः परंत ु यह, पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए की सीमा स े दकलोमीटर की दरू ी स े परे पाररजस्ट्थजतकी संवेदी जोन की सीमा तक पूवा पररभाजित और ऄभीजहत क्षेत्रों में पयटा न महायोजना के ऄनुसार, नए होटलों और ररजॉटा की स्ट्थापना ऄनुमत होगी; (ii) पाररजस्ट्थजतकी संवेदी जोन के ऄन्द्दर सभी नए पयाटन दरयाकलापों या जवद्यमान पयटा न दरयाकलापों का जवस्ट्तार, केन्द्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय द्वारा जारी ददिाजनदेिों तथा पाररजस्ट्थजतकी पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देने वाल े राष्ट्रीय व्याघ्र संरक्षण प्राजधकरण द्वारा जारी पाररजस्ट्थजतकी पयाटन संबंधी ददिाजनदेिों (समय-समय पर यथा सिं ोजधत) के ऄनुसार[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 होगा; (iii) अंचजलक महायोजना का ऄनुमोदन होने तक, पयाटन के जवकास और जवद्यमान पयटा न दरयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के अधार पर संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुमत दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन म ें दकसी नए होटल/ ररजॉट ा या वाजणजज्यक प्रजतष्ठान का संजन्नमााण ऄनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी जोन के ऄंतगता अने वाल े बहुमूल्य प्राकृजतक जवरासत के सभी स्ट्थलों जैसे दक जीन पूल ररजवा क्षत्रे , िैल संरचना, जल प्रपात, झरन,े दरे, ईपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा ईत्प्रपात अदद की पहचान की जाएगी और ईनकी सुरक्षा एव ं संरक्षण के जलए अंचजलक महायोजना के भाग के रूप म ें एक जवरासत संरक्षण योजना बनायी जाएगी। (5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्य संबधी, सौंदयाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण के जलए अंचजलक महायोजना के भाग के रूप में एक जवरासत संरक्षण योजना बनायी जाएगी। (6) ध्व जन प्रदिू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिू ण (जवजनयमन और जनयत्रं ण) जनयम, 2000 म ें जनयत ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिू ण औ जनयंत्रण । (7) वाय ु प्रदिू ण.- पाररजस्ट्थजतकी संवेदी जोन म,ें वाय ु प्रदिू ण जनवारण और जनयंत्रण, वाय ु (प्रदिू ण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार दकया जाएगा । (8) बजहस्राव का .- पाररजस्ट्थजतकी संवेदी जोन म ें ईपचाररत बजहस्राव का जनस्ट्सरण, पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अने वाले पयाावरणीय प्रदिू ण के जनस्ट्सरण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक किोर हो, के ईपबधं ों के ऄनुसार होगा। (9) िोस ऄपजिष्ट.- िोस ऄपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म ें िोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं. का.अ. 1357(ऄ), ददनांक 8 ऄप्रैल, 2016 के तहत प्रकाजित िोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन स ेबाहर जचजन्द्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्द्य प्रौद्योजगदकयों का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनुकूल प्रबंधन (इएसएम) ऄनुमत दकया जायेगा। (10) जैव जचदकत्सा अ .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म ें जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय–समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माच,ा 2016 के तहत प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्द्य प्रौद्योजगदकयों का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनरूु प ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनुकूल प्रबंधन (इएसएम) ऄनुमत दकया जायेगा। (11) प्लाजस्ट्टक ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 के तहत प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबधं ो के ऄनुसार दकया जाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (12) जनमाणा और जवध्वसं ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में जनमााण और जवध्वंस ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 317(ऄ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा प्रकाजित तथा समय-समय पर यथा संिोजधत इ–ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (14) सड़क-यातायात.- सड़क-यातायात को पयाावास-ऄनुकूल तरीके से जवजनयजमत दकया जाएगा और आस संबंध म ें अंचजलक महायोजना में जवििे ईपबंध िाजमल दकए जाएंग।े अंचजलक महायोजना के तैयार होने और राज्य सरकार के सक्षम प्राजधकारी स े ऄनुमोददत होन े तक, जनगरानी सजमजत प्रासंजगक ऄजधजनयमों और ईनके तहत बनाए गए जनयमों एव ं जवजनयमों के ऄनुसार सड़क-यातायात के ऄनुपालन की जनगरानी करेगी। (15) वाहन जजनत प्रदिू ण.- वाहन जजनत प्रदिू ण की रोकथाम और जनयंत्रण लागू जवजधयों के ऄनुसार दकया जाएगा और स्ट्वच्छतर ईंधन के ईपयोग के जलए प्रयास दकए जाएगं े। (16) औद्योजगक इकाआया.ं- ( ) अ पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए ईद्योगों की स्ट्थापना की ऄनु नहीं दी जाएगी। ( ) , 2016 समय-समय पर सिं ोजधत अ , अ , - अ औ अ , (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकया जाएगा:- (क) अंचजलक महायोजना म ें पहाड़ी ढलानों के ईन क्षेत्रों को दिााया जाएगा जजनम ें दकसी भी संजनमााण की ऄनज्ञु ा नहीं होगी; (ख) जजन ढलानों या जवद्यमान खड़ी पहाड़ी ढलानों म ें ऄत्यजधक भ-ू क्षरण होता ह ै ईनम ें दकसी भी संजनमााण की ऄनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी संवदे ी जोन म ें प्रजतजिद्ध या जवजनयजमत दकए जान े वाल े दरयाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेदी जोन म ें सभी दरयाकलाप, पयाावरण ( ) ऄजधजनयम, 1986 (1986 29) औ ईसके ऄधीन बने जनयमों के ईपबंधों जजसम ें तटीय जवजनयमन जोन, 2011 एवं पयाावरणीय प्रभाव अकलन ऄजधसूचना, 2006 िाजमल ह ै सजहत वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्द्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) तथा ईनम ें दकए गए संिोधनों के ऄनुसार िाजसत होंगे और नीच े दी गइ सारणी म ें जवजनर्ददष्ट रीजत से (लघु और वृहत खजनज), पत्थर ईत्खनन और ऄपघिाण आकाआयां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 ररट याजचका (जसजवल) स.ं 202 टी.एन. गौडाबमान जथरुमलू पाद बनाम भारत संघ के मामल े म ें माननीय ईच्चतम न्द्यायालय 4 ऄगस्ट्त, 2006 और 2012 ररट याजचका (जसजवल) . 435 गोवा फाईंडेिन बनाम भारत संघ के मामल े म ें तारीख 21 ऄप्रैल, 2014 के अदेि के ऄनुसरण म ें होगा । 2. प्रदिू ण (जल, वायु, मृदा, ध्वजन, पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगाने और वतामान अदद) ईत्पन्न करने वाले ईद्योगों प्रदिू णकारी ईद्योगों का जवस्ट्तार करने की ऄन ु जत नहीं होगीः की स्ट्थापना । , 2016 समय-समय पर संिोजधत अ , अ , - अ औ अ - 3. जल जवद्युत पररयोजनाओं की प्रजतजिद्ध। स्ट्थापना । 4. दकसी पररसंकटमय पदाथ ा का प्रजतजिद्ध। प्रयोग या ईत्पादन या प्रस्ट्संकरण । 5. प्राकृजतक जल जनकायों या भूजम प्रजतजिद्ध। क्षेत्र में ऄनुपचाररत बजहस्रावों का जनस्ट्सरण । 6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ और जवद्यमान अरा जमलों का जवस्ट्तार ऄनुमत नहीं होगा । 7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। 8. पोजलथीन बगै ों का ईपयोग प्रजतजिद्ध। 9. जलावन लकड़ी का वाजणजज्यक प्रजतजिद्ध। ईपयोग। 10. पयाटन से संबंजधत ऄन्द्य प्रजतजिद्ध। दरयाकलाप जैसे दक पाररजस्ट्थजतकी संवेदी जोन क्षेत्र के उपर से गमा वायु के गब्ु बारे, हले ीकाप्टर, ड्रोन, माआरोलाआट्स ईड़ाना अदद। ख.जवजनयजमत दरयाकलाप 11. होटलों और ररसोटों की पाररजस्ट्थजतकी पयाटन दरयाकलापों हते ु लघु ऄस्ट्थायी संरचनाओं के10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] वाजणजज्यक स्ट्थापना । जनमााण के जसवाय, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवदे ी जोन की सीमा तक, आनम ें जो भी ऄजधक जनकट हो, नए वाजणजज्यक होटलों और की स्ट्थापना ऄनुमत नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर या पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, आनमें जो भी ऄजधक जनकट हो, पयाटन महायोजना और लागू ददिाजनदेिों के ऄनुसार सभी नए पयाटन दरयाकलाप करन े या जवद्यमान दरयाकलापों का जवस्ट्तार करन े की ऄनुज्ञा होगी । अ औ 12. जनमााण दरयाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, जो भी जनकट हो, दकसी भी प्रकार का वाजणजज्यक जनमााण ऄनुमत नहीं दकया जाएगा: परंतु स्ट्थ ानीय लोगों को पैरा 3 के ईप पैरा (1) में सूचीबद्ध दरयाकलापों सजहत ईनके ईपयोग के जलए ईनकी भूजम में स्ट्थानीय की अवासीय अवश्यकताओं को पूरा करन े जलए जनमााण करने की ऄनु भवन ईपजवजधयों के ऄनुसार दी जाएगी परन्द्तु ऐस े लघु ईद्योगों जो प्रदिू ण ईत् पन्द् न नहीं करते ह,ैं से संबंजधत जनमााण दरयाकलाप जवजनयजमत दकए जाएंग े और लाग ू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूव ा ऄनुम स ेही न्द् यूनतम पर रखे जाएंगे । (ख) एक दकलोमीटर से अगे अंचजलक महायोजना ऄनुसार जवजनयजमत होंगे । 13. गैर-प्रदिू णकारी लघ ुईद्योग। फरवरी, 2016 म ें केन्द्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा जारी, समय- समय पर संिोजधत ईद्योगों में वगरकरण के ऄनुसार गैर- प्रदिू णकारी ईद्योग और ऄपररसंकट , लघ ु और सेवा ईद्योग, कृजि, पुष्प कृजि, या पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्री से ईत्पादों को ईत्पन्न करन े वाल े कृजि अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनज्ञु ात होंगे। 14. वृक्षों की कटाइ । (क) राज्य सरकार के सक्षम प्राजधकारी की पूवा अ के जबना वन भूजम या सरकारी या राजस्ट्व या जनजी भूजम पर वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ केंरीय या संबंजधत राज्य के ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार जवजनयजमत होगी । 15. वन ईत्पादों और गैर काष्ठ वन लाग ूजवजधयों के ऄधीन जवजनयजमत होगा । ईत्पादों का संग्रहण ।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : डेयररयां, दग्ु ध ईत्पादन, जल कृजि और मत्स्ट्य पालन। 22. फमों, कारपोरेट औ कंपजनयों लाग ूजवजधयों के ऄधीन जवजनयजमत होगा । द्वारा बड़े पैमाने पर वाजणजज्यक पिुधन संपदा और कुक्कुट फामों की स्ट्थापना । 23. प्राकृजतक जल जनकायों या भू क्षत्रे जल जनकायों में ईपचाररत ऄपजिष्ट जल/बजहस्रााव के जनस्ट्सरण से बचा म ें ईपचाररत ऄपजिष्ट जाएगा औ ईपचाररत ऄपजिष्ट जल के पुनचारण और पुन:ईपयोग के जल/बजहस्रााव का जनस्ट्सरण । प्रयास दकए जाएंगे तथा ईपचाररत ऄपजिष्ट जल/बजहस्रााव का जनस्ट्सरण लागू जवजधयों के ऄनसु ार जवजनयजमत दकया जाएगा। 24. सतही और भूजल का वाजणजज्यक लाग ूजवजधयों के ऄधीन जवजनयजमत होगा । जनष्किाण । 25. कृजि और की जस्ट्थजत के ऄनसु ार ऄपनी वार्विक कारावाइ ररपोटा राज्य के मख्ु य वन्द्यजीव वाडान को, अ V म ेंददए गए प्रपत्र के ऄनुसार, ईस वि ाकी 30 जून तक प्रस्ट्तुत करेगी । (8) केन्द्रीय सरकार का पयाावरण, वन और जलवाय ु पररवतान मंत्रालय जनगरानी सजमजत को ईसके कृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा जो वह ईजचत समझे । 7. ऄजतररक्त ईपाय.- आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए केंरीय सरकार और The Critical Tiger Habitat of Sariska Tiger Reserve was notified by State Government vide notification no. F3(34) Forest/2007 dated 28th December 2007 over an area of 881.11 square kilometers. The buffer area of 332.23 square kilometers was notified by notification No. F3(34) forest/2007 dated 06th July 2012;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 27 AND WHEREAS, the Tiger Reserve with its unique biodiversity and undulating terrain provides habitat for the tropical dry deciduous species, dry thorn species and several other species of flora and fauna therein; AND WHEREAS, the Sariska Tiger Reserve is unique as it is a part of Aravalli hill ranges having one of the densest forests in the state; AND WHEREAS, the Sariska Tiger Reserve is also one of the richest protected areas from the point of biodiversity. Nearly 20 species of mammals, 11 species of reptiles, 2 species of amphibians, 374 species of birds and 420 species of plants have been identified from the area. Some of the endemic and threatened species of flora and fauna present in the Sariska Tiger Reserve are dhok (Anogeissus pendula), salar (Boswellia serrata), katha (Acacia catechu), dhak (Butea monosperma), ber (Zizphus jujuba, Z. mauritiana), churel (Holoptelia intergrifolia), awanla (Embellica officinalis), gugal (Commiphora mukul), tendu (Dispyros melanoxylon), karaya (Sterculia urens), tiger (Panthera tigiris), leopard (Panthera pardus), hyena (Hyaene hyaena), jungle cat (Felis chaus), porcupine (Hystrix indica), small Indian civet (Viverricula indica), sambhar (Cervus uncolor), chital (Axis axis), caracal (Felis caracal) and wild boar (Sus scrofa) etc; AND WHEREAS, the major vegetation present in the area includes gurjan (Linnea gradis Syn.L.coromandellica), amaltas (Cassia fistula), binnas (Hesparathusa cranulata), goya khair (Dichrostachya cineria), khair (Acacia catechu), saijna (Maringa Pterygosperma), rohan (Soymida febrifuga), mokha (Scherebra swetenoides), rohini (Mallatus philipinensis), jamun (Syzyguim cumini), gular (Ficus glomerata), kadam (Mitragyna parvifolia), bahira (Terminalia bellerica), dhaora (Anogeissus latifolia), kahjur (Phoenix sylvestris), hingot (Balanites aegyptica), sevan (Gmelia arborea), arjun (Terminalia arjuna), neem (Azadirachta indica), peepal (Ficus religiosa), bargad (Ficus benghalensis), shisham (Dalbergia sisso) , bijasal (Pterocarpus marsupium) , kakon (Flacourita indica), kharini (Wrightia tinctoria), dudhi (Wrightia tomentosa), jhinjha (Bauhinia recemosa), casaeria (Casaeria tomentosa), barna (Crataeva relegiosa), bel (Aegle marmelose), ronj (Acacia leucophloea), lisora (Cordia myxa), imli (Tamarindus indica), kaith(Limonia acidissima), siris (Albizzia lebbek), semal (Bombax ceiba), celastrus (Celastrus paniculates)etc; AND WHEREAS, the other faunal species in the protected area are common langur or Hanuman langur (Presbytis entellus), common yellow bat (Scotophilus heathis), five striped plam squirrel (Funambulus pennant), house mouse (Mus musculus), house rat (Rattus rattus), Indian gerbille (Tetera indica), Indian mole-rat (Bandicota bengalensis), Indian porcupine (Hystrix indica ), Indian wild boar (Sus scrofa), blue bull or nilgai (Boselaphus tragocamelus), Iong eared hedgehog (Hemiechinus auritus), rufous tailed hare (Lepes nigricollis rufieaudatus), small Indian mangoose (Nerpestes edwardsi), spotted deer or chital (Axis axis) etc; AND WHEREAS, the major avi-faunal species present in the park are little grebe (Dabchick) (Tachybaptus ruficollis), great crested grebe (Podiceps cristatus), great white pelican (Pelecanus onocrotalus), spot-billed pelican (Pelecanus philippensis), dalmatian pelican (Pelecanus crispus), black bittern (Dupetor flavicollis), greater adjutant stork (Leptoptilos dubius), woolly-necked stork (Ciconia episcopus), Eurasian spoonbill (Platalea leucorodia), greater flamingo (Phoenicopterus ruber), cotton pygmy-goose (Nettapus coromandelianus), gadwall (Anas strepera), pheasant-tailed jacana (Hydrophasianus chirurgus), greater painted-snipe (Rostratula benghalensis), Eurasian woodcock (Scolopax rusticola), pintail snipe (Gallinago stenura), Indian skimmer (Rynchops albicollis), drongo cuckoo (Surniculus lugubris), spotted owlet (Athene brama), large-tailed nightjar (Caprimulgus macrurus), black-capped kingfisher (Halcyon pileata), Eurasian skylark (Alauda arvensis), scarlet minivet (Pericrocotus flammeus), verditer flycatcher (Eumyias thalassina), red-headed bunting (Emberiza bruniceps), black-headed oriole (Oriolus xanthornus) etc; AND WHEREAS, it is necessary to conserve and protect the area, extent and boundary, as of which is specified in paragraph 1 of this notification, around the protected area of Sariska Tiger Reserve as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Government hereby notifies the area to an extent of 0 (zero) kilometres to 1 kilometres around the boundary of Sariska Tiger Reserve in Alwar district in the state of Rajasthan as the Sariska Tiger Reserve, Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) the extent of Eco-sensitive Zone varies from 0 (zero) kilometres to 1 kilometre around the Sariska Tiger Reserve. The area of Eco-sensitive Zone is 207.77 square kilometres. Extent of Eco-sensitive zone in different directions (kilometres) as given below:- DIRECTION EXTENT North uniformly 1 kilometer North-East uniformly 0 East 0 to 1 kilometers South-East 0 to 1 kilometers South 100 meter to 1 kilometers South-West 0 meter to 1 kilometers West 100 meter to 1 kilometers North-West uniformly 1 kilometer As per the information provided by the state government, in North–East direction, the buffer area of Tiger Reserve is more than 1 kilometer and Alwar city exists adjacent to forest boundary line. Therefore, ESZ extent is zero in North-East direction. The state forest department has also informed that ESZ extent is zero in South-West direction due to the demand of the local stakeholders. (2) The boundary description of Sariska Tiger Reserve and its Eco-sensitive Zone is given in Annexure-I. (3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II A, Annexure-II B, Annexure-II C and Annexure-II D. (4) The geo-coordinates of Sariska Tiger Reserve and its Eco-sensitive Zone are given in table A and B of Annexure-III. (5) The list of villages falling within the Eco-sensitive Zone is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:- (i) Environment, (ii) Forest and Wildlife, (iii) Rural Development, (iv) Urban Development, (v) Tourism,[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 29 (vi) Municipal, (vii) Revenue, (viii) Agriculture, (ix) Irrigation and Flood Control, (x) Panchayati Raj, (xi) Rajasthan State Pollution Control Board, (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) Promoted activities given under para 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the Union Territory Department of Tourism in consultation with the Union Territory Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco- sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco- tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and the rules made thereunder.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 31 (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and management of solid wastes shall be as under:- a. the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b. Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste. – Bio medical waste management shall be as under: a. The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016. b. Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. - The construction and demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste. - The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out with in accordance with applicable laws and efforts shall be made for use of cleaner fuel. (16) Industrial units. – (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Board in February 2016, as amended from time32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] to time, unless so specified in this notification, and in addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. - The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description (1) (2) (3) A. Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Fencing of existing premises of hotels and lodges is regulated as per the applicable laws. 12. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 13. Terms of Reference. – (1) The Monitoring Committee shall monitor compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site- specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment, Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site- specific conditions and referred to the concerned regulatory authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
