यलर् अधिसचू नय नई दिल्ली, 20 जुलयई, 2017 कय.आ. 2275(अ).—धनम्नधलधिर् प्रयरूप अधिसूचनय, धजसे केन्द्रीर् सरकयर द्वयरय पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) और उपियरय (3) के सयथ परिर् उपियरय (1) द्वयरय प्रित्त शधिर्ों कय प्रर्ोग करर्े हुए पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) की अपेक्षयनुसयर, जनसयियरण की जयनकयरी के धलए प्रकयधशर् दकर्य जयनय प्रस्र्यधवर् ह;ै धजनके उससे प्रभयधवर् होने की संभयवनय ह;ै और र्ह सूचनय िी जयर्ी ह ै दक उि प्रयरूप अधिसूचनय पर, उस र्यरीि से, धजसको इस अधिसूचनय वयले भयरर् के रयजपत्र की प्रधर्र्यं जनसयियरण को उपलब्ि करय िी जयर्ी ह,ैं सयि दिन की अवधि की समयधि पर र्य उसके पश्चयर् ्धवचयर दकर्य जयएगय ; ऐसय कोई व्यधि, जो प्रयरूप अधिसूचनय म ें अंर्र्वाष्ट प्रस्र्यवों के संबंि म ें कोई आक्षपे र्य सुझयव िेने कय इच्छुक ह,ै इस प्रकयर धवधनर्िष्टा अवधि के भीर्र, केन्द्रीर् सरकयर द्वयरय धवचयर दकए जयने के धलए, आक्षेप र्य सुझयव सधचव, पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर्, इंदिरय पर्यावरण भवन, जोर बयग रोड, अलीगंज, नई दिल्ली-110003 र्य ई-मेल पर्े: esz- mef@nic.in पर धलधिर् रूप म ेंभेज सकेगय । प्रयरूप अधिसचू नय और, सोहले वय वन्द्र्जीव अभर्यरण्र् बलरयमपरु धजल े में अवधस्थर् ह ै । सोहले वय वन्द्र्जीव अभर्यरण्र्, उत्तर प्रिेश रयज्र् के बलरयमपुर एवं श्रवस्र्ी धजले म ें452.47 वग ादकलोमीटर के क्षेत्र में फैलय हुआ ह।ै और, प्रयणी और वनस्पधर् इस अभर्यरण्र् की समृधि जैधवक महत्तय को उपिर्शार् करर्े ह ैं। और, सोहले वय वन्द्र्जीव अभर्यरण्र् म ें बयघ, र्ेंिआु , लकड़बग्घय, धसर्यर, लोमड़ी, भेधड़र्य, भयलू, धहरण, सयंभर, चीर्ल, पयढय और कयकड़ आदि कय पर्यावयस ह।ै और, अब इस क्षेत्र कय पररक्षण और संरक्षण करनय आवश्र्क ह ै र्थय धवधनर्िष्टा दकर्य गर्य ह ै और पर्यावरण की िधृ ष्ट स े उद्योगो र्य उद्योगो के वगा को र्थय उनकी संदिर्यओं और प्रदकर्यओं को उि पयररधस्थधर्क संवेिी जोन म ें प्रधर्धिि करनय आवश्र्क ह;ै अर्ः, अब, केन्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परिर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के िंड (v) और िंड (xiv) के सयथ परिर् और उपियरय (1) द्वयरय प्रित्त शधिर्ों कय प्रर्ोग करर्े हुए, सोहले वय वन्द्र्जीव अभर्यरण्र् की सीमय के सयथ उत्तर प्रिेश रयज्र् में सोहले वय वन्द्र्जीव अभर्यरण्र् की सीमय के चयरों ओर 1.00 दकलोमीटर र्क के धवस्र्यररर् क्षेत्र को सोहले वय वन्द्र्जीव अभर्यरण्र्, पयररधस्थधर्क संवेिी जोन (धजसे इसम ें इसके पश्चयर्् पयररधस्थधर्क संवेिी जोन कहय गर्य ह)ै के रूप म ें अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनुसयर ह,ैं अथयार््:- 1. पयररधस्थधर्क सवं िे ी जोन कय धवस्र्यर और उसकी सीमयए-ं -(1) पयररधस्थधर्क संवेिी जोन कय धवस्र्यर सोहले वय वन्द्र्जीव अभर्यरण्र् की सीमय से 1.00 दकलोमीटर र्क ह ै और ऐसे जोन के जीपीएस र्थय वन्द्र्जीव अभर्यरण्र् के समन्द्वर्क उपयबिं I के रूप म ें उपयबि ह ै । संरधक्षर् क्षेत्र की उत्तरी सीमय नेपयल की सीमय के सयथ सयझी ह ै । पयररधस्थधर्क संवेिी जोन कय क्षेत्र 523.62 वग ादकलोमीटर ह ै। (2) पयररधस्थधर्क संवेिी जोन के भीर्र आन े वयले ग्रयमों की सचू ी उपयबिं II के रूप म ेंउपयबि ह ै। (3) पयररधस्थधर्क संवेिी जोन कय मयनधचत्र उसकी सीमय के ब्र्ौरों की सयथ र्थय अक्षयंश और िेशयंर्र सधहर् उपयबिं III के रूप म ेंउपयबि ह ै। 2. पयररधस्थधर्क संविे ी जोन के धलए आचं धलक महयर्ोजनय – (1) रयज्र् सरकयर, पयररधस् थधर्क संवेिी जोन के प्रर्ोजनों के धलए रयजपत्र म ें इस अधिसूचनय के अंधर्म प्रकयशन की र्यरीि स े िो वि ा की अवधि के भीर्र, स्थयनीर् व्यधिर्ों के परयमशा स,े और इस अधिसूचनय में उपिशों के अनुसयर आंचधलक महयर्ोजनय र्ैर्यर करेगी । (2) आंचधलक महयर्ोजनय को रयज्र् सरकयर म ेंसक्षम प्रयधिकयरी द्वयरय अनुमोदिर् दकर्य जयएगय । (3) पयररधस् थधर्क संवेिी जोन के धलए आंचधलक महयर्ोजनय इस अधिसूचनय म ें धवधनर्िष्ा ट ुपप में ऐसी रीधर् में रयज्र् सरकयर र्थय सुसंगर् केंरीर् और रयज्र् धवधिर्ों के सयमंजस् र् में भी र्थय केंरीर् सरकयर द्वयरय जयरी मयगाधनिेश, र्दि कोई हों, द्वयरय र्ैर्यर होगी । (4) आंचधलक महयर्ोजनय सबं ंधिर् रयज्र् धवभयगों के सयथ परयमशा से पर्यावरणीर् और पयररधस्थधर्क धवचयरणों को उसमें एकीकृर् करने के धलए र्ैर्यर की जयएगी अथयार््:-- (i) पर्यावरण; (ii) वन; (iii) शहरी धवकयस; (iv) पर्ाटन; (v) नगरपयधलकय; (vi) रयजस् व; (vii) कृधि; (viii) उत्तर प्रिेश रयज्र् प्रििू ण धनर्ंत्रण बोड;ा (ix) ससंचयई; और (x) लोक धनमयाण धवभयग । (5) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भ-ू उपर्ोग, अवसंरचनयत् मक और दिर्यकलयपों, नहरों और धनकयसी संकमों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक भू-उपर्ोग, अवसंरचनयत्मक और दिर्यकलयपों र्य संकमों कयII (ii) 3 ऐसय उपर्ोग र्त्समर् प्रवर्ृ दकसी धवधि के अिीन र्य इस अधिसूचनय के अिीन प्रधर्धिि न हो । (6) आंचधलक महयर्ोजनय म ें अनयच्छयदिर् क्षेत्रों के जीणोियर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भू-जल के प्रबंिन, मृिय और नमी संरक्षण, स्थयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधस्थधर्क और पर्यावरण स े संबंधिर् ऐसे अन्द्र् पहलूओं, धजन पर ध्र्यन िेनय आवश्र्क ह,ै के धलए उपबंि होंग े । (7) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमों और नगरीर् बंिोबस्र्ों, वनों के प्रकयर और दकस् मों, कृधि क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षत्रे जैसे उद्ययन और उसी प्रकयर के स्थ यन, उद्ययन कृधि क्षेत्र, आर्काडों, झीलों और अन्द्र् जल धनकयर्ों कय अभ्र्कंन करेगी । (8) आंचधलक महयर्ोजनय पयररधस्थधर्क संवेिी जोन के धवकयस को धवधनर्धमर् करेगी धजससे स् थयनीर् समुियर्ों के जीवकोपयजान को सुधनधश् चर् दकर्य जय सके । 3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधिर् उपयर् करेगी, अथयार्् :-- (1) भू-उपर्ोग - पयररधस् थधर्क संवेिी जोन के क्षेत्रों म ें आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्द्हर् दकए गए वनों, उद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, पयकों और िुल े स्थयनों कय वयधणधज्र्क और औद्योधगक संबि धवकयस दिर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय : परंर् ु पयररधस्थधर्क संवेिी जोन के भीर्र कृधि भूधम कय संपररवर्ान, पैरय 5 के अिीन मयनीटरी सधमधर् की धसफयररश पर और रयज्र् सरकयर के पूवा अनुमोिन स,े स्थयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन े के धलए और पैरय 4 की सयरणी के स्र्ंभ (2) के अिीन िम सं0 10, 20, 29, 33, और 34, के सयमन े सूचीबि दिर्यकलयपों को पूरय करन े के धलए अनुज्ञयर् होंगे, अथयार् ् :- (i) पयररधस्थधर्क अनुकूल पर्ाटन दिर्यकलयपों के धलए पर्ाटकों के अस्थयर्ी आवयसन के धलए पयररधस्थधर्क अनुकूल कुटीर जसै े टैंट, लकड़ी के मकयन आदि; (ii) धवद्यमयन सड़कों को चौड़य करनय और सुिढृ करनय और नई सड़कों के संधनमयाण; (iii) प्रििू ण उत्पन्न न करने वयल े लघ ुउद्योग; (iv) विय ा जल संचर्; और (v) कुटीर उद्योग, धजसके अंर्गर्ा ग्रयमीण उद्योग, सुधवियजनक भण्डयर और स्थयनीर् सुि-सुधवियएं भी ह:ैं परंर् ु र्ह और भी दक रयज्र् सरकयर के पूवा अनुमोिन और भयरर् के संधवियन के अनच्ु छेि 244 और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्द्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्द्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय : परंर् ु र्ह और भी दक पयररधस् थधर्क संवेिी जोन के भीर्र भू-अधभलेिों में उपसंजयर् कोई त्रुरट मयनीटरी सधमधर् के धवचयर प्रयि करन े के पश्चयर्् रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में केवल एक बयर संशोधिर् होगी और उि त्रुरट के संशोिन की भयरर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को सूचनय िेनी होगी ; परंर् ु र्ह और भी दक उपर्ुाि त्रुरट कय संशोिन म ें इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी िशय म ें भू-उपर्ोग कय पररवर्ान सधममधलर् नहीं होगय : परंर्ु र्ह और भी दक हररर् क्षेत्र में जैसे वन क्षेत्र, कृधि क्षत्रे आदि में कोई पयररणयधमक कटौर्ी नहीं होगी और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अनप्रर्ुक् र् र्य अनुत् पयिक कृधि क्षेत्रों में पुन: वनीकरण करन े के प्रर्यस दकए जयएंगे । (2) प्रयकृधर्क जल स्रोर् -- आचंधलक महयर्ोजनय में सभी प्रयकृधर्क स्रोर्ों की पहचयन की जयएगी और उनके संरक्षण और पुनुपद्िर्ू करण के धलए र्ोजनय को सधम मधलर् होगी और रयज्र् सरकयर द्वयरय ऐसे क्षत्रे ों पर र्य इनके धनकट धवकयस दिर्यकलयप प्रधर्धिि करने के धलए ऐसी रीधर् से मयगाधनिेश र्र्ै यर दकए जयएंग े । (3) पर्ाटन – (क) पयररधस्थधर्क संवेिी जोन के भीर्र पर्ाटन संबंिी दिर्यकलयप पर्ाटन महयर्ोजनय के अनुसयर होंगे, आंचधलक महयर्ोजनय कय भयग रूप म ेंहोंगे । (ि) पर्ाटन महयर्ोजनय पर्ाटन धवभयग, उत्तर प्रिशे सरकयर द्वयरय रयज्र् सरकयर के पर्यावरण और वन मंत्रयलर् के परयमशा से र्ैर्यर की जयएगी । (ग) पर्ाटन दिर्यकलयप को नीचे दिए अनुसयर धवधनर्धमर् दकर्य जयएगय, अथयार् ्:- (i) पयररधस्थधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दिर्यकलयपों र्य धवद्यमयन पर्ाटन दिर्यकलयपों कय धवस्र्यर केन्द्रीर् सरकयर द्वयरय पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् द्वयरय जयरी दकए गए मयगािशाक धसियंर्ों र्थय रयष्ट्रीर् संरक्षण प्रयधिकरण द्वयरय जयरी पयररधस्थधर्क पर्ाटन मयगिा शाक धसियंर्ों (समर्-समर् पर र्थयसंशोधिर्) के अनुसयर पयररधस्थधर्क पर्ाटन, पयररधस्थधर्क धशक्षय और पयररधस्थधर्क धवकयस पर बल िेर् े हुए र्थय पयररधस्थधर्क संवेिी जोन की क्षमर्य अध्र्र्न के आियर पर दकर्य जयएगय; (ii) सोहले वय वन्द्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर के भीर्र होटलों और ररसोटों के नए संधनमयाण को धसवयर् पर्ाटन स े संबंधिर् पयररधस्थधर्क अनुकूल पर्ाटन दिर्यकलयपों से संबंधिर् पर्ाटकों के अस्थयर्ी अधिभोग के धलए आवयस के अनुज्ञयर् नही दकर्य जयएगय ; परंर् ु संरधक्षर् क्षेत्र की सीमय स े एक दकलोमीटर की िरू ी स े परे पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क नए होटलों और ररसयटों की स्थयपनय को केवल पूव ा पयररभयधिर् और पयररधस्थधर्क पर्ाटन प्रसुधवियओं के धलए पर्ाटन महयर्ोजनय के अनुसयर अनुज्ञयर् दकर्य जयएगय । (iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दिर्यकलयपों के धवस्र्यर को वयस्र्धवक स्थल धवधनर्िष्टा संवीक्षय र्थय मयनीटरी सधमधर् की धसफयररश पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकयररर्ों द्वयरय अनुज्ञयर् दकर्य जयएगय । (4) नैसर्गका धवरयसर् -- पयररधस्थधर्क संवेिी जोन म ें महत्वपूणा नैसर्गाक धवरयसर् के सभी स्थलों जैसे जीन कोश आरधक्षर् क्षत्रे , शैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयए,ं स्थलों, भ्रमण, अश्वरोहण, प्रपयर्ो आदि की पहचयन की जयएगी और उन्द्ह ें संरधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए इस अधिसूचनय के प्रकयशन की र्यरीि स े छह मयस के भीर्र, उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आचं धलक महयर्ोजनय कय भयग होगय । (5) मयनव धनर्मर्ा धवरयसर् स्थ लों - पयररधस्थ धर्क संवेिी जोन में भवनों, संरचनयओं, धशल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंस्कृधर्क महत्व के क्षेत्रों की पहचयन करनी होगी और इस अधिसूचनय के प्रकयशन की र्यरीि स े छह मयह के भीर्र उनके संरक्षण की र्ोजनयएं र्ैर्यर करनी होंगी र्थय आंचधलक महयर्ोजनय म ें सधममधलर् की जयएगी । (6) ध्व धन प्रििू ण – रयज्र् सरकयर कय पर्यावरण धवभयग र्य उत्तर प्रिशे रयज्र् प्रििू ण धनर्त्रं ण बोड ा पयररधस्थधर्क संवेिी जोन में ध्वधन प्रििू ण के धनर्ंत्रण के धलए वयर्ु(प्रििू ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और र्द्िीनII (ii) 5 बनयए गए धनर्मों के अनुसयर मयगािशाक धसियंर् और धवधनर्म बनयएगय । (7) वयर् ु प्रििू ण -- पयररधस्थधर्क संवेिी जोन में, वयर् ु प्रििू ण के धनर्ंत्रण के धलए रयज्र् सरकयर कय पर्यावरण धवभयग वयर्ु (प्रििू ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसरण म ेंमयगािशाक धसियंर् और धवधनर्म र्ैर्यर करेगय । (8) बधहस्रयव कय धनस्सयरण -- पयररधस्थधर्क संवेिी जोन म ें उपचयररर् बधहस्रयव कय धनस्सयरण जल (प्रििू ण धनवयरण र्थय धनर्ंत्रण) अधिधनर्म, 1974 (1974 कय 6) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय । (9) िोस अपधशष्ट -- िोस अपधशष्टों कय धनपटयन धनम्नधलधिर् रूप म ेंहोगय- (i) पयररधस्थधर्क संवेिी जोन म ें िोस अपधशष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संशोधिर् अधिसूचनय सं. कय.आ. 1357(अ), र्यरीि 8 अप्रलै , 2016 के अनुसयर दकर्य जयएगय ; (ii) स्थयनीर् प्रयधिकरण जैव धनम्नीकरणीर् और अजैव धनम्नीकरणीर् संघटकों म ें िोस अपधशष्टों के संपृथक्कन के धलए र्ोजनयए ं र्ैर्यर करेंग े ; (iii) जैव धनम्नीकरणीर् सयमग्री को अधिमयनर्ः ियि बनयकर र्य कृधम िेर्ी के मयध्र्म स े पुनःचदिर् दकर्य जयएगय ; (iv) अकयबाधनक सयमग्री कय धनपटयन पयररधस्थधर्क संवेिी जोन के बयहर पहचयन दकए गए स्थ ल पर दकसी पर्यावरणीर् स्वीकृर् रीधर् म ें होगय और पयररधस्थधर्क संवेिी जोन म ें िोस अपधशष्ट ों को जलयनय र्य भष्म ीकरण अनज्ञु यर् नहीं होगय । (10) जैव धचदकत्स ीर् अपधशष्ट - पयररधस्थधर्क संवेिी जोन म ें जैव धचदकत्सीर् अपधशष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंशोधिर् अधिसूचनय सं. सयं.कय.धन. 343(अ) र्यरीि 28 मयचा, 2016 द्वयरय प्रकयधशर् जैव धचदकत्सीर् अपधशष्ट प्रबंिन धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (11) र्यनीर् पररवहन - पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि म ें आंचधलक महयर्ोजनय म ें धवशेि उपबंि अधिकधथर् दकए जयएंग े और आंचधलक महयर्ोजनय के र्ैर्यर होने और पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के अनुमोदिर् होन े र्क, रयज्र् स्र्रीर् पयररधस्थधर्क संवेिी जोन मयनीटरी सधमधर् प्रवृत्त धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीटर करेगी । (12) औद्योधगक इकयईर्य ं– (क) प्रस्र्यधवर् पयररधस्थधर्क संवेिी जोन के भीर्र धसवयर् धवधि के अनुसयर स्थयधपर् धवद्यमयन कयष्ठ आियररर् उद्योगों के नए कयष्ठ आियररर् उद्योगों की स्थयपनय को अनुज्ञयर् नहीं दकर्य जयएगय । (ि) प्रस्र्यधवर् पयररधस्थधर्क करनय। 10. होटलों और ररसोटों की वयधणधज्र्क परंर्ु पयररधस्थधर्क संवेिी जोन की सीमय से 1 दकलोमीटर स्थयपनय । के परे र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर, इनमें स े जो भी नजिीक हो, र्क सभी नए पर्ाटन दिर्यकलयपों को धसवयर् पयररधस्थधर्क अनुकूल पर्ाटन दिर्यकलयपों स े संबंधिर् पर्ाटकों के अस्थयर्ी अधिभोग के, अनुज्ञयर् नहीं दकर्य जयएगय। 11. संधनमयाण दिर्यकलयप । (क) संरधक्षर् क्षेत्र की सीमय से 1 दकलोमीटर भीर्र र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, जो भी नजिीक हो, धसवयर् पयररधस्थधर्क पर्ाटन दिर्यकलयपोंII (ii) 7 के धलए अस्थयर्ी ढयचं ों नए वयधणधज्र्क संधनमयणा को अनुज्ञयर् नहीं दकर्य जयएगय । परंर्ु स्थयनीर् व्यधिर्ों को उनके आवयसीर् उपर्ोग के धलए धजसके अर्ं गर्ा पैरय 3 के उप-पैरय (1) में सचू ीबि दिर्यकलयप भी ह,ैं को उनकी भूधम में संधनमयाण को अनुज्ञयर् दकर्य जयएगय । (ि) परंर्ु र्ह और भी सरकयरी र्य रयजस्व र्य धनजी भूधम पर र्य वनों में दकन्द्ही वृक्षों की कटयई नहीं होगी । (ि) वृक्षों की कटयई संबंधिर् केन्द्रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होंग;े (ग) आरधक्षर् वन और सरं धक्षर् वन की िशय म ें कयर्र्ा ोजनय में धवधहर् कय अनुसरण दकर्य जयएगय । 18. प्रवयसी चयरवयह े। लयगू धवधिर्ों के अिीन और आंचधलक महयर्ोजनय के अनसु यर धवधनर्धमर् पर्यिा रूप से इंसलु ेट दकर्य जयएगय । 20. धवद्यमयन सड़कों को चौड़य करनय और उन्द्ह ें उधचर् पर्यवा रण समयघयर् धनियारण और न्द् र्ूधनकरण सुिढृ करनय । उपयर् र्थय लयगू अनसु यर होंगे । 21. होटलों और लॉज के धवद्यमयन पररसरों म ें लयगू धवधिर्ों के अिीन धवधनर्धमर् होगय । बयड लगयनय। वन्द् र्जीव के मुक्र् सचं लन को अनुज्ञयर् करने के धलए पयररधस्थ धर्क संविे ी जोन के भीर्र होटलों र्य अन्द् र् वयधणधज् र्क स्थ यपनय अपनी पररसंपधत्र् र्ों में कयटेियर र्यर नहीं लगयएंगे और कोई भी बयड़ एक मीटर से ऊंची नहीं होगी । कोई धवद्यमयन बयड़, जो इस उपिशा कय अनुपयलन नहीं करर्ी ह,ै को आंचधलक महयर्ोजनय में वर्णर्ा समर्- सीमय होंगे । 28. पहयड़ी ढयलों और निी र्टों कय संरक्षण । कोई संधनमयणा दिर्यकलयप, जब र्क दक अन्द्र्थय आंचधलक महयर्ोजनय के अिीन अनुज्ञयर् न हो, को 1-10 से अधिक ढयलों वयली पहयधडर्ों पर और दकसी निी और प्रयकृधर्क नयलों के दकनयरों से 100 मीटर की िरू ी र्क को नहीं दकर्य जयएगय। 29. प्रििू ण उत्पन्न न करन ेवयल ेलघ ुउद्योग । पयररधस्थधर्क संवेिी जोन से गैर प्रििू ण, गैर पररसंकटमर्, लघ ुऔर सेवय उद्योग, पुष्प , उद्ययन र्य कृधि आियररर् उद्योग, जो पयररधस्थधर्क संवेिी जोन से स्विशे ीर् मयलों कय उत्पयिन कर रह े ह ैं जो पर्यवा रण पर कोई धवपरीर् प्रभयव नहीं डयलर् े ह,ैं को अनुज्ञयर् दकर्य जयएगय । सवं र्िर्ा दिर्यकलयप 30. स्थयनीर् समिु यर्ों द्वयरय चल रही कृधि और लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । बयगवयनी प्रथयओं के सयथ डर्े ररर्यं, पशुपयलन, जल कृधि और मत्स्र् पयलन । 31. जैधवक िेर्ी । सदि र् रूप से बढयवय दिर्य जयए । 32. सभी गधर्धवधिर्ों के धलए हररर् सदि र् रूप से बढयवय दिर्य जयए । प्रौद्योधगकी को ग्रहण करनय । 33. विय ाजल संचर्न । सदि र् रूप से बढयवय दिर्य जयए । 34. कुटीर उद्योगों धजसके द्वयरय नयमधनर्िष्ा ट पयररधस् थधर्क और पर्यवा रण क्षेत्र प्रत्र्ेक सिस्र् ; मयमले में र्ीन विा की अवधि के धलए एक धवशेिज्ञ (ग) पर्यावरण के क्षेत्र म ें कयर् ा करने वयले गरै सरकयरी संगिनों (धजसके अर्ं गर्ा सिस्र् ; धवरयसर् संरक्षण भी ह)ै कय प्रत्र्ेक मयमल े म ें र्ीन विा की अवधि के धलए उत्तर प्रिेश रयज्र् सरकयर द्वयरय नयमधनर्िष्टा एक प्रधर्धनधि (घ) प्रयिेधशक अधिकयरी, उत्तर प्रिशे रयज्र् प्रििू ण Notification New Delhi, the 20th July, 2017 S.O.-2275(E).— The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at Draft Notification WHEREAS, the Sohelwa Wild Life Sanctuary is situated in the Disrtict of Balrampur. The Sohelwa Wild Life Sanctuary is spread over an area of 452.47 square kilometres in District Balrampur & Shrawasti in the State of Uttar Pradesh. AND WHEREAS, the flora and fauna represent rich biological significance of this sanctuary. AND WHEREAS, the Sohelwa Wild Life Sanctuary is habitat Tiger, Leopard, Hyena, Jackal, Fox, Wolf, Bear, Deer, Sambar, Chital, Hog Deer and Kakad etc. AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Sohelwa Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 1.00 kilometer around the boundary of Sohelwa Wildlife Sanctuary in the State of Uttar Pradesh as the Sohelwa Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be an extent upto 1.00 kilometer from the boundary of Sohelwa Wildlife Sanctuary and the Global Positioning System co-ordinates of such zone and co- ordinates of Wildlife Sanctuary is appended as Annexure-I. Northern boundary of protected area has common boundary with Nepal. The Eco-sensitive Zone area is 523.62 square kilometer. (2) The list of villages falling in proposed Eco-sensitive Zone is given in Annexure-II. (3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture;II (ii) 19 (viii) Uttar Pradesh State Pollution Control Board; (ix) Irrigation; and (x) Public Works Department. for integrating environmental and ecological considerations into it. (5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10,20,29,33 and 34 in column (2) of the table in paragraph 4, namely:- (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities; (ii) widening and strengthening of existing roads and construction of new roads; (iii) small scale industries not causing pollution; (iv) rainwater harvesting; and (v) cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Uttar Pradesh in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Sohelwa Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities: Provided that beyond the distance of one kilometre from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined designated areas for Eco-tourism facilities as per Tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Uttar Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or Uttar Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluents in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco- sensitive Zone shall be permitted.II (ii) 21 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the table below, namely:- TABLE S.No. Activity Remarks (1) (2) (3) Prohibited Activities 1. Union of India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 3. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area or of the Eco-sensitive Zone whichever is nearer.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided that local people shall be permitted to undertake construction in their land for residential use including the activities listed in sub-paragraph (1) of paragraph 3: (b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. 12. Trenching ground. Establishment of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws. 13. Discharge of treated effluents and solid Regulated under applicable laws. waste in natural water bodies or land area. 14. Air and vehicular pollution. Regulated under applicable laws. 15. Noise pollution. Regulated under applicable laws. 16. Extraction of ground water. Regulated under applicable laws. 17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government; (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) In case of reserve forests and protected forests, the working plan prescriptions shall be followed. 18. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan. 19. Erection of electric lines. Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan. 20. Widening and strengthening of existing Shall be done with proper Environment Impact Assessment roads. and mitigation measures, as applicable. 21. Regulated under applicable laws. 23. Drastic change of agricultural system. Regulated under applicable laws. 24. Commercial use of natural water resource Regulated under applicable laws. including ground water harvesting. 25. Movement of vehicular traffic at night. Regulated under applicable laws. 26. Introduction of exotic species. Regulated under applicable laws. 27. Sign board and hoardings. Regulated under applicable laws. 28. Protection of hill slopes and river banks. No construction activity unless otherwise permitted by or under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah. 29. Small scale industries not causing Non polluting, non-hazardous, small-scale and service pollution. industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.II (ii) 23 Promoted Activities 30. On going agriculture and horticulture Shall be actively promoted. practices by local communities along with dairies, dairy farming, aquaculture and fisheries. 31. Organic farming. Shall be actively promoted. 32. Adoption of green technology for all Shall be actively promoted. activities. 33. Rain water harvesting. Shall be actively promoted. 34. Cottage industries including village Shall be actively promoted. artisans. 35. Use of renewable energy sources. Shall be actively promoted. 5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- i) Commissioner, Devipatan Zone, Gonda -Chairman ii) An expert in the area of ecology and environment -Member to be nominated by the Government of Uttar Pradesh for a period of one year. iii) One representative of non-Governmental Organisation -Member (working in the field of environment including heritage conservation) to be nominated by the Government of Uttar Pradesh for a period of one year. iv) Regional Officer, Uttar Pradesh State Pollution -Member Control Board v) Executive Engineer of Public Work Department -Member , Shrawasti & Balrampur vi) Executive Engineer of Irrigation Department, -Member Shrawasti & Balrampur vii) Superintendent of Police/Senior Superintendent -Member of Police, Maharajganj viii) District Agriculture Officer, Shrawasti & Balrampur - Member ix) Wildlife Warden, Suhelwa Wildlife Divison, Balrampur -Member x) Divisional Forest officer Suhelwa Wildlife - Member-Secretary. Sanctuary Balrampur 6. Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collector or the Park in-Charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned departments, industry associations or stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State as per pro forma appended at Annexure IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
