योजना राBय सरकार म8 स(cid:23)म (cid:7)ािधकारी (cid:29)ारा अनुमो+दत होगी । (3) पा(cid:27)रि’थ ितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म8 िविन>द] ट (cid:9)प म8 ऐसी रीित म8 राB य सरकार तथा सुसंगत क8(cid:14)ीय और राBय िविधय" के सामंज’य म8 भी तथा क8(cid:14)ीय सरकार (cid:29)ारा जारी माग(cid:17)िनदश_ , य+द कोई ह", (cid:29)ारा तैयार होगी । (4) आंचिलक महायोजना सभी संब= राBय सरकार के िवभाग" के परामश(cid:17) से तैयार होगी, अथा(cid:17)त्:-- (i) पया(cid:17)वरण ; (ii) वन और व(cid:13)यजीव; (iii) कृिष; (iv) राज’व ; (v) नगरीय िवकास ; (vi) पय(cid:17)टन; (vii) Uामीण िवकास; (viii) ‘सचाई और बाढ़ िनयं.ण; (ix) नगरपािलका; (x) पंचायती राज; और¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (xi) लोक िनमा(cid:17)ण िवभाग इसम8 पया(cid:17)वरणीय और पा(cid:27)रि’थ ितक(cid:24) िवचार" को समाकिलत करने के िलए ह"गे। (5) महायोजना अनुमो+दत िवPमान भू-उपयोग, अवसंरचनाb मक और +Vयाकलाप" पर कोई िनबcधन अिधरोिपत नहd करेगी जब तक +क इस अिधसूचना म8 िविन>द: न ह" और आचंिलक महायोजना म8 सभी अवसंरचना +Vयाकलाप" म8 द(cid:23)ता और पा(cid:27)रि’थितक(cid:24)य अनुकूलता का संवध(cid:17)न करेगी । (6) आंचिलक महायोजना म8 अनाeछा+दत (cid:23)े." के जीणg=ार, िवPमान जल िनकाय" के संर(cid:23)ण, आवाह (cid:23)े." के (cid:7)बंधन, जल- संभर" के (cid:7)बंधन, भू-जल के (cid:7)बंधन, मृदा और नमी संर(cid:23)ण, ’थानीय समुदाय" क(cid:24) आवYयकताh तथा पा(cid:27)रि’थितक(cid:24) और पया(cid:17)वरण से संबंिधत ऐसे अ(cid:13)य पहलुh, िजन पर iयान दने ा आवYयक ह,ै के िलए उपबंध ह"गे । (7) आंचिलक महायोजना सभी िवPमान पूजा ’ थल", Uाम" और नगरीय बंदोब’त", वन" के (cid:7)कार और +क’ म", कृिष (cid:23)े.", ऊपजाऊ भिू म, ह(cid:27)रत (cid:23)े. जैसे उPान और उसी (cid:7)कार के ’ थान, उPान कृिष (cid:23)े., आ>कड", झील" और अ(cid:13)य जल िनकाय" का अjयकंन करेगी । (8) आंचिलक महायोजना पा(cid:27)रि’थ ितक संवेदी जोन म8 िवकास को पा(cid:27)रि’ थितक अनुकूल िवकास और ’ थानीय समुदाय" क(cid:24) जीवकोपाज(cid:17)न को सुिनिYच त करते %ए िविनयिमत होगी । 3. रररराााा(cid:16)(cid:16)(cid:16)(cid:16)यययय ससससररररककककाााारररर (cid:18)(cid:18)(cid:18)(cid:18)ाााारररराााा (cid:19)(cid:19)(cid:19)(cid:19)ककककएएएए जजजजाााानननन ेे ेेववववााााललललेे ेे उउउउपपपपाााायययय-------- राBय सरकार इस अिधसूचना के उपबंध" को (cid:7)भावी करने के िलए िन(cid:3)िलिखत उपाय करेगी, अथा(cid:17)त् :-- (1) भभभभ---ूू-ूूउउउउपपपपययययोोोोगगगग ---- पा(cid:27)रि’थ ितक संवेदी जोन म8 आमोद-(cid:7)मोद के (cid:7)योजन के िलए िचि(cid:13)हत +कए गए वन", उPान-कृिष (cid:23)े.", कृिष (cid:23)े.", पाकW और खुले ’थान" का वािणिBयक और औPोिगक संब= िवकास +Vयाकलाप" के िलए उपयोग या संप(cid:27)रवत(cid:17)न नहd होगा : परंतु पा(cid:27)रि’थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:27)रवत(cid:17)न मानीटरी सिमित क(cid:24) िसफा(cid:27)रश पर और राBय सरकार के पूव (cid:17) अनुमोदन से, ’थानीय िनवािसय" क(cid:24) आवासीय ज(cid:9)रत" को पूरा करने के िलए और पैरा 4 क(cid:24) सारणी के ’तंभ (2) के अधीन Vम सं. 14, 18, 24 और 27 के सामने सूचीब= +Vयाकलाप" को पूरा करने के िलए अनुkात ह"गे, अथा(cid:17)त् :- (क) िवPमान सड़क" को चौड़ा करना और सुदढ़ृ करना और नई सड़क" के संिनमा(cid:17)ण; (ख) (cid:7)दषू ण उbपT न करने वाले लघु उPोग; (ग) वषा(cid:17) जल संचय; और (घ) कुटीर उPोग" िजसके अंतग(cid:17)त Uामीण उPोग, सुिवधाजनक ’टोर और ’थानीय सुख-सुिवधाएं सिnमिलत ह 2: परंतु यह और भी +क राBय सरकार के पूव(cid:17) अनुमोदन तथा संिवधान के अनुeछेद 244 और तbसमय (cid:7)वृ(cid:31) िविध के उपबंध" के अनुपालन के िबना, िजसके अंतग(cid:17)त अनुसूिचत जनजाित और अ(cid:13)य परंपरागत वन िनवासी (वन अिधकार" क(cid:24) मा(cid:13)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिBयक या उPोग िवकास +Vयाकलाप" के िलए जनजातीय भूिम का उपयोग अनुkात नहd होगा : परंतु यह और भी +क पा(cid:27)रि’थ ितक संवेदी जोन के भीतर भू-अिभलेख" म8 उपसंजात कोई .ु(cid:27)ट मानीटरी सिमित के िवचार (cid:7)ा4 करने के प5ात ्राBय सरकार (cid:29)ारा (cid:7)bयेक मामले म8 संशोिधत होगी और उ! .ु(cid:27)ट के संशोधन क(cid:24) के(cid:13)(cid:14)ीय सरकार के पया(cid:17)वरण, वन और जलवायु प(cid:27)रवत(cid:17)न मं.ालय को सूचना दने ी होगी । परंतु यह और भी +क उपयु(cid:17)! .ु(cid:27)ट का संशोधन म8 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय +कसी भी दशा म8 भू-उपयोग का प(cid:27)रवत(cid:17)न सिnमिलत नहd होगा : परंतु यह और भी +क ह(cid:27)रत (cid:23)े. म8 जैसे वन (cid:23)े., कृिष (cid:23)े. आ+द म8 कोई पा(cid:27)रणािमक कटौती नहd होगी और अन(cid:7)युF त या अनुbप ादक कृिष (cid:23)े." म8 पुन: वनीकरण करने के (cid:7)यास +कए जाएंगे । (2) (cid:1)(cid:1)(cid:1)(cid:1)ााााककककृृृृििििततततकककक जजजजलललल (cid:25)(cid:25)(cid:25)(cid:25)ोोोोतततत -- आचंिलक महायोजना म8 सभी (cid:7)ाकृितक जल oोत" क(cid:24) पहचान क(cid:24) जाएगी और उनके संर(cid:23)ण और पुनन(cid:17)वीकरण के िलए योजना को सिnम िलत +कया जाएगा और राB य सरकार (cid:29)ारा ऐसी रीित से माग(cid:17)दश(cid:17)क िस=ांत बनाए जाएंगे िजससे +क उन (cid:23)े." म8 या इसके समीप िवकास +Vयाकलाप को (cid:7)ितिष= +कया जा सके। (3) पपपपयययय(cid:27)ट(cid:27)ट(cid:27)ट(cid:27)टनननन –––– (क) पा(cid:27)रि’थितक संवेदी जोन के भीतर पय(cid:17)टन संबंधी +Vयाकलाप, जो पय(cid:17)टन महायोजना के अनुसार ह"ग,े आंचिलक4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] महायोजना का भाग (cid:9)प म8 ह"गे । (ख) पय(cid:17)टन महायोजना राBय सरकार के पय(cid:17)टन िवभाग (cid:29)ारा गुजरात राBय सरकार के राज’व और वन िवभाग के परामश(cid:17) से तैयार होगी । (ग) पय(cid:17)टन संबंधी +Vयाकलाप िनn निलिखत के अधीन िविनयिमत ह"गे, अथा(cid:17)त् :- (i) पा(cid:27)रि’थितक संवेदी जोन के भीतर सभी नए पय(cid:17)टन +Vयाकलाप" या िवPमान पय(cid:17)टन +Vयाकलाप" का िव’तार भारत सरकार के पया(cid:17)वरण, वन और जलवायु प(cid:27)रवत(cid:17)न मं.ालय के माग(cid:17)दश(cid:17)क िस=ांत" के (cid:29)ारा तथा पा(cid:27)रि’थितक पय(cid:17)टन रा] pीय q याr संर(cid:23)ण (cid:7)ािधकरण, (cid:29)ारा जारी (समय-समय पर यथा संशोिधत) माग(cid:17)दश(cid:17)क िस=ांत" के अनुसार, पा(cid:27)रि’थितक पय(cid:17)टन, पा(cid:27)रि’थितक िश(cid:23)ा और पा(cid:27)रि’थितक िवकास को महbव दते े %ए पा(cid:27)रि’थितक संवेदी जोन क(cid:24) वहन (cid:23)मता के अiययन पर आधा(cid:27)रत होगा; (ii) पा(cid:27)रि’थितक संवेदी जोन के भीतर नए होटल" और (cid:27)रसोटW का नया संिनमा(cid:17)ण अनुkात नहd होगा ; (iii) आंचिलक महायोजना का अनुमोदन +कए जाने तक, पय(cid:17)टन के िलए िवकास और िवPमान पय(cid:17)टन +Vयाकलाप" के िव’तार को वा’तिवक ’थल िविन>द: संवी(cid:23)ा तथा मानीटरी सिमित क(cid:24) िसफा(cid:27)रश पर आधा(cid:27)रत संबंिधत िविनयामक (cid:7)ािधका(cid:27)रय" (cid:29)ारा अनुkात +कया जाएगा । (4) ननननैसैसैसैस(cid:31)(cid:31)(cid:31)(cid:31)गगगगकककक ििििववववररररााााससससतततत -------- पा(cid:27)रि’थितक संवेदी जोन म8 महbवपूण(cid:17) नैस9गक िवरासत के सभी ’थल" जैसे सभी जीन कोश आरि(cid:23)त (cid:23)े., शैल िवरचनाएं, जल (cid:7)पात", झरन", घाटी मागW, उपवन", गफु ाएं, ’थल", sमण, अtरोहण, (cid:7)पात" आ+द क(cid:24) पहचान क(cid:24) जाएगी और उ(cid:13)ह 8 संरि(cid:23)त +कया जाएगा तथा उनक(cid:24) सुर(cid:23)ा और संर(cid:23)ा के िलए इस अिधसूचना के (cid:7)काशन क(cid:24) तारीख से छह मास के भीतर, उपयु! Gaga–I and Gaga–II between these two parts there are vast stretches of waste lands; And whereas, the sanctuary is situated near the coast on the Indo-Asian migratory fly way and Gaga-I has a flat terrain having a gentle slope and through Gaga–II river “Khari” flows and a sweet water lake is present on the eastern fringe of the Sanctuary which supports large number of avifauna; And whereas, the sanctuary has a unique grassland ecosystem having 66 species of trees, shrubs and herbs which inter alia supports 88 species of avi-fauna, 13 species of mammals, 7 species of reptiles; And whereas, the sanctuary harbours rare and endangered species such as Great Indian Bustard, Houbara Bustard and Wolf and migratory crane species;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the Gaga Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; Now therefore, in exercise of the powers conferred by sub-section (1) and clause (v) and clause (xiv) of sub–section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 1 km from the boundary of Gaga–I and Gag –II which together constitute the Gaga Wildlife Sanctuary in the State of Gujarat, as Gaga Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone.— (1) The extent of Eco-sensitive Zone is 1 kilometer from the boundary of Gaga–I and Gaga–II, both of which constitute the Gaga Wildlife Sanctuary. (2) The extent of Eco-sensitive Zone is 1942.78 hectares. (3) The map of Eco-sensitive Zone boundary together with latitude and longitude is appended as Annexure I. (4) The Eco-sensitive Zone is spread across two villages of Kalyanpur Taluka in Devbhumi Dwarka District of Gujarat state. The list of villages falling within the Eco-sensitive Zone is annexed as Annexure II. (5) The list of villages given in Annexure-II shall be further revisited and confirmed by the State Government while preparing the Zonal Master Plan. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; and (xi) Public Works Department for integrating the ecological and environmental considerations into the said plan. (5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 13 (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.-Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents, and for the activities listed against serial numbers 14, 18, 24 and 27 specified under column (2) of the Table in paragraph 4, namely:- (a) Widening and strengthening of existing roads and construction of new roads; (b) Small scale industries not causing pollution; (c) Rainwater harvesting; and (d) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Gujarat in consultation with Department of Environment and Forests, Government of Gujarat. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone. (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; and (iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial Units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks (1) (2) (3) Prohibited Activities 1. Setting up of industries causing water or No new or expansion of existing polluting industries in the air or soil or noise pollution. Eco-sensitive Zone shall be permitted. 4. Commercial establishment of hotels and New and expansion of commercial establishment of hotels resorts. and resorts shall be prohibited within the Eco-sensitive Zone with immediate effect. 5. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 6. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 12. Commercial water resources including (a) The extraction of surface water and ground water shall ground water harvesting. be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land; (b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority; (c) no sale of surface water or ground water shall be permitted; (d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 13. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- (a) Collector, Devbhumi Dwarka District- Chairperson; (b) Representative of the Department of Environment and Forests, Government of Gujarat –Member; (c) Regional Officer, State Pollution Control Board - Member; (d) One representative of Non-governmental Organisations working in the field of nature conservation to be nominated by the Government of Gujarat (for a term of one year in each case)– Member;¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 17 (e) One expert in Ecology/wildlife/birds from reputed Institution or University of the State of Gujarat to be nominated by the Government of Gujarat (for a term of one year in each case) - Member; (f) Senior Town Planner of area – Member; (g) Deputy Conservator of Forests, Jamnagar/Devbhumi Dwarka – Member Secretary. (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Central Government in the Ministry of Environment, Forests and Climate Change as per-pro forma appended at Annexure III. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
