एफडK(cid:6)यएू ल74 तार(cid:8)ख 27.06.1974 9वारा अ(cid:29)धसू(cid:29)चत Hकया गया था, यह 431.23 वग( Hकलोमीटर के -ेJ मR फैला हुआ है। नजद(cid:8)कतम रेलवे Cटेशन तालागुMपा है, जो अभयार\य से 15 Hकलोमीटर दरू है ; और, शेरावती घाट(cid:8) व% यजीव अभयार\य (cid:20)शमोगा िजले के सगारा तालुक के भाग= मR फैला हुआ है और यह -ेJ पणप( ा(cid:19)त अध ( हXरत शोला वन= और पिNचमी घाट क2 सया(cid:4)& सदैव हXरत वन= 9वारा आdछा(cid:4)दत है, जो वन fैक का शानदार सुंदर और मू(cid:6)यवान भाग है । गंभीर बायो(cid:4)टक दबाव के बावजूद अभयार\य के भाग अपनी (cid:24)ाचीन, सघन 5489 GI/2015 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY Hकया जाए Hकंतु संसाधन= मR और सधु ार लाने के (cid:20)लए समु(cid:29)चत कदम भी उठाए जाएं; और, अभयार\य वनCप(cid:19)त और (cid:24)ाणी दोन= मR अ:य(cid:29)धक समWृ है । इन वन= मR मू(cid:6)यवान व-ृ (cid:24)जा(cid:19)तयां हL, िजसमR सांगवान, चंदन, रोजवुड. हनी, न%द(cid:8) आ(cid:4)द हL और यह जंगल(cid:8) भLसा, (cid:29)च:तीदार (cid:4)हरण, सांभर, बाघ और ते%दएु ं को आjय देता है । यह -ेJ सर(cid:8)सपृ = करता है । इस अभयार\य मR अनेक जड़ी-बू(cid:4)टयां, झाmड़यां, फन ( और घास हL ; और अभयार\य के भीतर Gव9यमान सड़कR lामीण सड़कR हL और इनका उपयोग गCत के (cid:20)लए Hकया जाता है । अ(cid:29)धकांश Gव9यमान सड़कR एक बCती से दसू र(cid:8) बCती को जोड़ती हL । अभयार\य के भीतर Gव9यमान सड़क= का उपयोग साधारण जनता के साथ Gवभाग 9वारा भी Hकया जाता है । और, शेरावती घाट(cid:8) व% यजीव अभयार\य के चार= ओर के -ेJ को, िजसका (िजसे इसमR इसके पN चात ् पाXरिCथ (cid:19)तक2य संवेद(cid:8) जोन कहा गया है) के (cid:26)प मR अ(cid:29)धसू(cid:29)चत करती है, िजसका Gववरण (cid:19)न(cid:13)नानसु ार है, अथा(त ् :-- (1) पा(cid:15)रि&थ(तक संवेद+ जोन का -व&तार और उसक/ सीमाएं--(1) शेरावती घाट(cid:8) व% यजीव अभयार\य पाXरिCथ(cid:19)तक संवेद(cid:8) जोन उ:तर अ-ांश 13° 53’ 40” से पूव ( देशांतर 74° 46’21. 581” और पूवt अ-ांश 74 ° 34’ 50” से 75° 00’ 15” के बीच है और यह 189.60 वग ( Hकलोमीटर के -ेJ मR फैला हुआ है िजसका GवCतार शेरावती घाट(cid:8) व% यजीव अभयार\य क2 सीमा के चार= ओर 10 Hकलोमीटर तक है और ऐसे जोन क2 सीमा का वणन( उपाबंध I पर (cid:4)दया गया है । (2) अभयार\य के पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर आने वाले 80 lाम= क2 सूची उनके अ-ांश= और देशा%तर= के साथ उपाबंध II के (cid:26)प मR उपाबW क2 गई है । (3) अ-ांश और देशा%तर तथा मु^य uब% दओु ं स(cid:4)हत पाXरिCथ(cid:19)तक संवेद(cid:8) जोन का मान(cid:29)चJ उपाबंध III के (cid:26)प मR उपाबW हL । (4) पाXरC थ(cid:19)तक संवेद(cid:8) जोन सीमा पर अभयार\य पर मु^ य अवCथान= (जीपीएस uबदं ओु )ं को उपाबंध IIIक के (cid:26)प मR उपाबW है । 2. पा(cid:15)रि&थ(तक संवेद+ जोन के 4लए आंच4लक महायोजना —(1) रा]य सरकार, पाXरिCvतक संवेद(cid:8) जोन के (cid:24)योजन के (cid:20)लए राजपJ मR इस अ(cid:29)धसूचना के अं(cid:19)तम (cid:24)काशन क2 तार(cid:8)ख से दो वष ( क2 अव(cid:29)ध के भीतर, C थानीय Q यि<तय= के परामश ( से, इस अ(cid:29)धसूचना मR संलw न अनुबंध= के सामंजC य से आचं (cid:20)लक संवेद(cid:8) जोन के (cid:20)लए आंच(cid:20)लक महायोजना, रा] य सरकार 9वारा इस अ(cid:29)धसूचना मR यथाGव(cid:19)न(cid:4)द(S ट र(cid:8)(cid:19)त मR और सुसंगत कR&(cid:8)य और रा] य Gव(cid:29)धय= और कR&(cid:8)य सरकार 9वारा जार(cid:8) मागद( शक( (cid:20)सWांत=, य(cid:4)द कोई ह=, के सामंजC य से तैयार क2 जाएगी । (4) आचं (cid:20)लक महायोजना संबं(cid:29)धत रा]य Gवभाग= के साथ परामश ( से तैयार क2 जाएगी अथा(त ् :—वन ; (i) वन (ii) शहर(cid:8) Gवकास ; (iii) पयट( न ; (iv) नगरपा(cid:20)लक ; (v) राजC व ; (vi) कृGष ; (vii) कना(टक रा] य (cid:24)दषू ण (cid:19)नयंJण बोड ( ; (viii) (cid:20)सचं ाई ; और (ix) लोक (cid:19)नमा(ण Gवभाग । (5) आंच(cid:20)लक महायोजना अनमु ो(cid:4)दत Gव9यमान भू-उपयोग, अवसंरचना और Hxयाकलाप= पर कोई (cid:19)नबधy न अ(cid:29)धरोGपत नह(cid:8)ं करेगी जब तक Hक इस अ(cid:29)धसूचना मR इस (cid:24)कार Gव(cid:19)न(cid:4)द(S ट न Hकया जाए और उ<त आचं (cid:20)लक महायोजना सभी अवसंरचना और Hxयाकलाप= मR द-ता और पाXरिC थ(cid:19)तक2य अनुकूलता का सधु ार करेगी । (6) आंच(cid:20)लक महायोजना मR अनाdछा(cid:4)दत -ेJ= के जीणzWार, Gव9यमान जल (cid:19)नकाय= के संर-ण, आवाह -ेJ= के (cid:24)बंधन, जल-संभर= के (cid:24)बंधन, भूतल जल के (cid:24)बंधन, मदृ ा और नमी संर-ण, Cथानीय समुदाय= क2 आवNयकताओ ं तथा पाXरिCथ(cid:19)तक2 और पया(वरण से संबं(cid:29)धत ऐसे अ%य पहलुओ,ं िजन पर {यान देना आवNयक है, के (cid:20)लए उपबंध ह=गे । (7) आंच(cid:20)लक महायोजना सभी Gव9यमान एवं (cid:24)C ताGवत पूजा C थल=, lाम= और नगर(cid:8)य बंदोबCत=, वन= के (cid:24)कार और HकC म=, जनजातीय -ेJ, कृGष -ेJ=, ऊपजाऊ भू(cid:20)म, हXरत -ेJ जैसे उ9यान और उसी (cid:24)कार के C थान, उ9यान कृGष -ेJ, आHक(ड=, झील= और अ%य जल (cid:19)नकाय= का अ}यकंन करेगी । (8) आंच(cid:20)लक महायोजना C थानीय समुदाय= क2 जीवकोपाजन( को सु(cid:19)निN चत करने का सु(cid:19)नNचय करेगी । 3. रा7य सरकार 8वारा 9कए जाने वाले उपाय-- रा]य सरकार इस अ(cid:29)धसूचना के उपबंध= को (cid:24)भावी करने के (cid:20)लए (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत उपाय करेगी, अथा(त ् :-- : (1) भ-ू उपयोग पाXरिC थ(cid:19)तक संवेद(cid:8) जोन मR आमोद-(cid:24)मोद के (cid:24)योजन के (cid:20)लए (cid:29)चि%हत Hकए गए वन=, उ9यान-कृGष -ेJ=, कृGष -ेJ=, पाकp और खुले Cथान= का वा(cid:21)णि]यक और औ9यो(cid:29)गक संबW Gवकास Hxयाकलाप= के (cid:20)लए उपयोग या संपXरवतन( नह(cid:8) ं होगा : परंत ु पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर कृGष भू(cid:20)म का संपXरवतन( , मानीटर(cid:8) स(cid:20)म(cid:19)त क2 (cid:20)सफाXरश पर और रा]य सरकार के पूव ( अनमु ोदन स,े Cथानीय (cid:19)नवा(cid:20)सय= क2 आवासीय ज(cid:26)रत= को पूरा करने के (cid:20)लए और पैरा 4 क2 सारणी के Cतंभ (2) के अधीन xम सं. 12, 18, 24, 29 और 32 के सामने सूचीबW Hxयाकलाप= को पूरा करने के (cid:20)लए अन~ु ात ह=गे, अथा(त ् :- (i) करना और सुoढ़ करना; (iii) (cid:24)दषू ण उ:प%न न करने वाले लघ ु उ9योग ; (iv) वषा( जल संचयन; और (v) कुट(cid:8)र उ9योग, िजसके अंतगत( lामीण उ9योग, सुGवधाजनक Cटोर और C थानीय सुGवधाएं भी हL :4 THE GAZETTE अनुसू(cid:29)चत जनजा(cid:19)त और अ%य परंपरागत वन (cid:19)नवासी (वन अ(cid:29)धकार= क2 मा%यता) अ(cid:29)ध(cid:19)नयम, 2006 (2007 का 2) भी है, वा(cid:21)णि]यक या उ9योग Gवकास Hxयाकलाप= के (cid:20)लए जनजातीय भू(cid:20)म का उपयोग अन~ु ात नह(cid:8)ं होगा : परंत ु यह और भी Hक पाXरिC थ(cid:19)तक संवेद(cid:8) जोन के भीतर भ-ू अ(cid:20)भलेख= मR उपसंजात कोई Jु(cid:4)ट मानीटर(cid:8) स(cid:20)म(cid:19)त के Gवचार (cid:24)ाMत करने के पNचात ् रा]य सरकार 9वारा (cid:24):येक मामले मR एक बार संशो(cid:29)धत होगी और उ<त Jु(cid:4)ट के संशोधन क2 के% &(cid:8)य सरकार के पया(वरण, वन और जलवाय ु पXरवतन( मंJालय को सूचना देनी होगी : परंत ु यह और भी Hक उपय<ु( त Jु(cid:4)ट के संशोधन मR इस उप पैरा के अधीन यथा उपबं(cid:29)धत के (cid:20)सवाय Hकसी भी दशा मR भ-ू उपयोग का पXरवतन( सि(cid:13)म(cid:20)लत नह(cid:8)ं होगा : परंत ु यह और भी Hक हXरत -ेJ जैसे वन -ेJ, कृGष -ेJ मR कोई पाXरणा(cid:20)मक कटौती नह(cid:8)ं होगी और अ(cid:24)यु< त या अनु: पादक कृGष -ेJ= मR पुन: वनीकरण करने के (cid:24)यास Hकए जाएंगे । : (2) #ाकृ(तक जल-=ोत आंच(cid:20)लक महायोजना मR सभी (cid:24)ाकृ(cid:19)तक ‚ोत= क2 पहचान क2 जाएगी और उनके संर-ण और पुननव( ीकरण के (cid:20)लए योजना सि(cid:13) म(cid:20)लत होगी और रा] य सरकार 9वारा ऐसे -ेJ= पर या उनके (cid:19)नकट Gवकास Hxयाकलाप (cid:24)(cid:19)तGषW करने के (cid:20)लए ऐसी र(cid:8)(cid:19)त से माग(cid:19)(नदƒश तैयार Hकए जाएंगे । (3) पयट(cid:4) न : (क) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर पयट( न संबंधी Hxयाकलाप, पयट( न महायोजना के अनुसार ह=ग,े जो आंच(cid:20)लक महायोजना का एक भाग बनRग े । (ख) पयट( न महायोजना पयट( न Gवभाग, कना(टक सरकार 9वारा राजC व और वन Gवभाग, कना(टक सरकार के परामश ( से तैयार क2 जाएगी । (ग) पयट( न संबंधी Hxयाकलाप (cid:19)न(cid:13) न(cid:20)ल(cid:21)खत के अधीन Gव(cid:19)नय(cid:20)मत ह=ग,े अथा(त ् :- (i) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर सभी नए पयट( न Hxयाकलाप= या Gव9यमान पयट( न Hxयाकलाप= का GवCतार भारत सरकार के पया(वरण, वन और जलवायु पXरवतन( मंJालय के मागद( शक( (cid:20)सWांत= के 9वारा तथा पाXरिCथ(cid:19)तक पयट( न राS f(cid:8)य Q या„ संर-ण (cid:24)ा(cid:29)धकरण, 9वारा जार(cid:8) (समय-समय पर यथा संशो(cid:29)धत) मागद( शक( (cid:20)सWांत= के अनुसार, पाXरिCथ(cid:19)तक पयट( न, पाXरिCथ(cid:19)तक (cid:20)श-ा और पाXरिCथ(cid:19)तक Gवकास को मह:व देते हुए पाXरिCथ(cid:19)तक संवेद(cid:8) जोन क2 वहन -मता के अ{ययन पर आधाXरत होगा; (ii) पाXरिC थ(cid:19)तक अनकु ूल पयट( न Hxयाकलाप= के संबं(cid:29)धत पयट( क= के अC थायी (cid:19)नवास के (cid:20)लए आवासन के (cid:20)लए (cid:20)सवाय पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर होटल और Xरसाट( के नए सं(cid:19)नमा(ण शेरावती घाट(cid:8) व% यजीव अभयार\य क2 सीमा के 1 Hकलोमीटर के भीतर अन~ु ात नह(cid:8)ं ह=गे । परंत ु संरh-त -ेJ= क2 सीमा से एक Hकलोमीटर क2 दरू (cid:8) से परे पाXरिCथ(cid:19)तक2य संवेद(cid:8) जोन क2 सीमा तक नए होटल और Xरसाट( के Cथापन पयट( न महायोजना के अनुसार पाXरिCथ(cid:19)तक2य पयट( न सुGवधा के (cid:20)लए पूव( पXरभाGषत और Gव(cid:19)न(cid:4)द(Sट Cथान मR ह(cid:8) अनु~ात Hकया जाएगा । (iii) आंच(cid:20)लक महायोजना का अनमु ोदन Hकए जाने तक, पयट( न के (cid:20)लए Gवकास और Gव9यमान पयट( न Hxयाकलाप= के GवCतार को वाCतGवक Cथल Gव(cid:19)न(cid:4)द(Sट संवी-ा तथा मानीटर(cid:8) स(cid:20)म(cid:19)त क2 (cid:20)सफाXरश पर आधाXरत संबं(cid:29)धत Gव(cid:19)नयामक (cid:24)ा(cid:29)धकाXरय= 9वारा अन~ु ात Hकया होगा । : (4) नैस(cid:21)गक(cid:4) -वरासत पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR मह:वपूण ( नैस(cid:29)गक( Gवरासत के सभी Cथल= जैसे सभी जीन कोश आरh-त -ेJ, शैल Gवरचनाएं, जल (cid:24)पात=, झरन=, घाट(cid:8) मागp, उपवन=, गुफाओं, Cथल=, …मण, अNवरोहण, (cid:24)पात= आ(cid:4)द क2 पहचान क2 जाएगी और उ%हR पXररh-त Hकया जाएगा तथा उनक2 सुर-ा और संर-ा के (cid:20)लए इस अ(cid:29)धसूचना के (cid:24)काशन क2 तार(cid:8)ख से छह मास जोन मR भवन=, संरचनाओं, (cid:20)श(cid:6)प-तvय, ऐ(cid:19)तहा(cid:20)सक, कला:मक और सांCकृ(cid:19)तक मह:व के -ेJ= क2 पहचान क2 जाएगी और इस अ(cid:29)धसूचना के (cid:24)काशन क2 तार(cid:8)ख से छह माह क2 रा] य सरकार का पया(वरण Gवभाग या कना(टक रा] य (cid:24)दषू ण (cid:19)नयंJण बोड,( वाय ु ((cid:24)दषू ण (cid:19)नवारण और (cid:19)नयंJण) अ(cid:29)ध(cid:19)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:19)नयम= के उपबंध= के अनुसरण मR मागद( शक( (cid:20)सWांत और Gव(cid:19)नयम तैयार करेगा । : (8) बCह=ाव का (न&सारण पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR उपचाXरत ब(cid:4)ह‚ाव का (cid:19)नCसारण जल ((cid:24)दषू ण (cid:19)नवारण तथा (cid:19)नयंJण) अ(cid:29)ध(cid:19)नयम, 1974 (1974 का 6) और उसके अधीन बनाए गए (cid:19)नयम= के उपबंध= के अनुसार होगा । : (9) ठोस अप4शFट ठोस अप(cid:20)शSट= का क2 समय-समय पर यथा संशो(cid:29)धत अ(cid:29)धसूचना स.ं का.आ. 908(अ), तार(cid:8)ख 25 (cid:20)सतबं र, 2000 को (cid:24)का(cid:20)शत नगरपा(cid:20)लक ठोस अप(cid:20)शSट ((cid:24)बंध और हथालन) (cid:19)नयम, 2000 के उपबंध= के अनुसार Hकया जाएगा ; (ii) Cथानीय (cid:24)ा(cid:29)धकरण जैव (cid:19)न(cid:13)नीकरणीय और अजैव (cid:19)न(cid:13)नीकरणीय संघटक= मR ठोस अप(cid:20)शSट= के संपथृ <कन के (cid:20)लए योजनाएं तैयार करRग े ; (iii) जैव (cid:19)न(cid:13)नीकरणीय सामlी को अ(cid:29)धमानतः खाद बनाकर या कृ(cid:20)म खेती के मा{यम से पुनःचHxत Hकया जाएगा ; (iv) अकाब(cid:19)(नक सामlी का (cid:19)नपटान पाXरिCथ(cid:19)तक Hकलोमीटर से परे और पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के GवC तार तक सभी नए पयट( न Hxयाकलाप= या Gव9यमान Hxयाकलाप= के GवC तार पयट( न महायोजना और राS f(cid:8)य Q या„ संर-ण (cid:24)ा(cid:29)धकरण के (cid:4)दशा-(cid:19)नदƒश= के अन(cid:26)ु प ह=गे । (13) सं(cid:19)नमा(ण Hxयाकलाप । (क) राSf(cid:8)य पाक( क2 सीमा से 1 Hकलोमीटर के भीतर Hकसी नए वा(cid:21)णि] यक सं(cid:19)नमा(ण को अनु~ात नह(cid:8)ं Hकया जाएगा : परंत ु C थानीय Qयि<तय= को उनके आवासीय उपयोग के (cid:20)लए उनक2 भू(cid:20)म मR सं(cid:19)नमा(ण, िजसके अंतगत( पैरा 3 के उप-पैरा (1) मR सूचीबW Hxयाकलाप भी हL, को करने के (cid:20)लए अनु~ात Hकया (cid:20)लए सं(cid:19)नमा(ण और सं(cid:19)नमा(ण कायक( लाप= को महायोजना के अनुसार Gव(cid:19)नय(cid:20)मत Hकया जाएगा। (14) व-ृ = क2 कटाई । (क) रा]य सरकार मR स-म (cid:24)ा(cid:29)धकार(cid:8) क2 पूव ( अनमु December, 2015 S.O. 3551(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections Notification WHEREAS, the Sharavati Valley Wildlife Sanctuary situated in Shimoga district of Karnataka State Lies between latitudes 130 54’ to 14˚ 12’ North and longitudes 740 38’ to 75˚ 00’ East and notified vide Government order Nos. AFD70/FWL71/ Dated 20.04.1972 and AFD/12/FWL/74 Dated 27.06.1974 is spread over an area of 431.23 sq km. The nearest Railway Station is Thalaguppa which is 15 Kms from the Sanctuary. AND WHEREAS, Sharavati Valley Wildlife sanctuary is spread over parts of Sagara taluk of Shimoga District and the area is covered by moist deciduous, semi evergreen, Shola forests and evergreen forests of Sahyadri hills of ‘Western Ghats, which is a magnificent piece of beautiful and valuable forest track. In spite of severe biotic pressure, parts of the sanctuary have been able to retain its pristine, dense and diverse vegetation. It is, therefore, absolutely essential to ensure that the existing resources are not only effectively conserved but appropriate steps are also initiated to further improve the resources.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 AND WHEREAS, the sanctuary is immensely rich in flora and fauna both in variety and diversity. These forests consist of valuable tree species including Teak, Sandal, Rosewood, Honne, Nandi etc. and harbour Wildlife like Bison, Spotted deer, Sambar, Tiger and Panther. The area is very rich in reptiles and avifauna population. The hilly area forms the catchment basin for Sharavati River. The area serves as an abode for many vertebrates and invertebrates. The sanctuary has innumerable herbs, shrubs, ferns and grasses. AND WHEREAS, the roads existing inside the sanctuary are village roads and are being used for patrolling. Majority of the existing roads connect one settlement to the other. The existing roads inside the sanctuary are being used by the general public as well as by the department. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Sharavathi Valley Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 10 km all around the boundary of Sharavathi Valley Wildlife Sanctuary in the State of Karnataka as the Sharavathi Valley Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Sharavathi Wildlife Sanctuary ‘Eco sensitive zone’ lies between North Latitudes 130 53’ 40” to E 740 46’ 21.581’’and the East Longitude 740 34’ 50” to 750 00’ 15” and spread over an area of 189.60 Sq Kms with an extent upto 10 kms all around the boundary of Sharavathi Valley Wildlife Sanctuary and the boundary description of such Zone is given in Annexure-I. (2) List of 80 villages falling within the Eco-sensitive Zone of the sanctuary along with latitudes and longitudes is appended as Annexure-II. (3) The map of the Eco-sensitive Zone along with latitudes and longitudes and key points are appended as Annexure- III. (4) Key locations (GPS points) on the eco-sensitive zone boundary as well as on the sanctuary are appended as Annexure-III A. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment, (ii) Forest, (iii) Urban Development, (iv) Tourism, (v) Municipal, (vi) Revenue, (vii) Agriculture (viii) Karnataka State Pollution Control Board, (ix) Irrigation (x) Public Works Department for integrating environmental and ecological considerations into it.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 18, 24, 29 and 32 in column (2) of the Table in paragraph 4, namely:- (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities, (ii) Widening and strengthening of existing roads. (iii) Small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of Article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 (ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Sharavathi Valley Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco- friendly tourism activities: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within a period of six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under. (9) Solid wastes. - Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908(E), dated the 25th September, 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial Units (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco- sensitive zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S.No. Activity Remarks (1) (2) (3) Prohibited Activities 1. Provided that beyond one kilometer upto the extent of Eco- Sensitive Zone construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan. 14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 15. Monitoring Committee:- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone falling in the State of Karnataka , which shall comprise of the following namely:- (i) Regional Commissioner, Mysore -Chairman (ii) Hon’ble Member of Legislative Assembly, Hosanagar* Constituency, Shimoga District – Member (iii) Hon’ble Member of Legislative Assembly, Thirthahalli* Constituency, Shimoga District – Member (iv) Hon’ble Member of Legislative Assembly, Sagar Constituency* Shimoga District – Member (v) Representative of the Department of Environment, Government of Karnataka -Member; (vi) Representative of the Department of Urban Development, Government of Karnataka -Member; (vii) A representative of NGO working in the field of environment to be nominated by the Government of Karnataka for a period of one year -Member; (viii) The Regional Officer, Karnataka State Pollution Control Board, Shimoga -Member; (ix) An expert in the area of ecology and environment to be nominated by the Government of Karnataka for a period of one year -` Member; (x) Deputy Commissioner or his representative, Shimoga, -Member (xi) The Deputy Conservator of Forests, Wildlife Division, Shimoga- Member Secretary. *(Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required) 6. Terms of Reference: (1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification. (2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV. (7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to the provisions of this notification. 8. Then line runs along the Western and Northern boundary of Kandodi village and meets the Hadigere village limit. Again the line runs along the Northern boundary of Hadigere and Western boundary of N.Talakalale and meets the Sharavathi river. Then line runs along the Northern and Eastern boundary of N.Talalkale village and meets the Northern boundary of Attigodu State forest. Then the line runs in the Northern and Eastern direction of the Northern boundary of Attigodu State forest to meet the Southern side of Talalkalale Reservoir submersion boundary. Then the line runs along the submersion and meets the Bidarur road. Then the line runs along the Bidarur and Kargal road and meets the Lingamakki reservoir dam. Then the line runs in the along the Sharavathi river and Eastern boundary of Iduvani and Kantota village and meets the North West corner of Kantota village. Then the line runs along the Northern boundary of Kantota, Haravalli, Honneamardu and meets the Bellene village boundary. Then the line runs along the Western and Northern boundary of Bellenne village and meets North East corner of Bellenne village. East : The line runs Eastern boundary of Bellenne village and meets the Northern boundary of Bellegere. Then the line runs along the Northern boundary of Bellegere, Nitle Haletota, Madaravalli, Kesuvinamane, Hulkod, Benkatvalli village and meets the Eastern corner of Benkatavalli village. Again the line runs along the Eastern side of Benkatavalli, Nadavadahalli to meets the Sharavathi submersion boundary. The line runs in the Southern direction along the submersion and meets the Chikmathur village boundary. Then line runs along the Chikmathur village, Hunal Madike village Northern and Eastern boundary and Mattikoppa and Besur village Eastern boundary to meet South East corner of Besur village. South : Then the line runs through Southern boundary of Besur and Ambaragodlu village and meets Old Batkal road. Then the line runs in the Southern direction and meets the and meets the submersion boundary. Again the line runs in South West direction through Sharavathi submersion area and meets the Kerivase village submersion boundary. Then the line runs along the submersion and meets the Eastern boundary of Karur village. Then the line runs along the Eastern and Southern boundary of Karur and B.Keppige and meets South West corner of B.Keppige village. Then the line runs in the Western direction of B.Keppige and Arahalli village and meets the North West corner of Arahalli village. Then the line runs along the Tumri and Valagere road and meets the Southern boundary of Valagere village. Then the line runs along the Southern boundary of Valagere, Kallur and Channagonda village and meets the Kattinakaru village boundary.
