(1986 का 29) क0 धारा 3 क0 उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ प(cid:4)ठत उपधारा (1)
7वारा (cid:23)द8त शि:तय; का (cid:23)योग करत े हुए, जार(cid:8) करने का (cid:23)Aताव करती है, पया'वरण (संर+ण) (cid:17)नयम, 1986 के
(cid:17)नयम 5 के उप(cid:17)नयम (3) क0 अपे+ानुसार, जनसाधारण क0 जानकार(cid:8) के (cid:19)लए (cid:23)का(cid:19)शत क0 जाती है; िजनके उससे
(cid:23)भाFवत होने क0 संभावना है, ; और यह सूचना द(cid:8) जाती है Gक उ:त (cid:23)ा(cid:25)प अ(cid:28)धसूचना पर, उस तार(cid:8)ख से, िजसको इस
अ(cid:28)धसूचना वाले भारत के राजपI क0 (cid:23)(cid:17)तयां जनसाधारण को उपलJध करा द(cid:8) जाती हK, साठ (cid:4)दन क0 अव(cid:28)ध क0
समािLत पर या उसके पMचात ् Fवचार Gकया जाएगा;

पया'वरण (संर+ण) अ(cid:28)ध(cid:17)नयम, 1986 (1986 का 29) क0 धारा 3 क0 उपधारा (1), उपधारा (2) के खंड (v) और खंड
(xiv) और उपधारा (3) 7वारा (cid:23)द8त शि:तय; का (cid:23)योग करत े हुए, केरल रा[य मQ साइलQट वैल(cid:8) नेशनल पाक' क0 सीमा
से 9 Gकलोमीटर के FवAताXरत +ेI को, त(cid:19)मलनाडु रा[य क0 सीमा के साथ जडु े हुए (cid:4)हAसे को छोडकर, केरल रा[य मQ
साइलQट वैल(cid:8) नेशनल पाक' पाXरिA थ(cid:17)तक0 संवेद(cid:8) जोन (िजसे इसमQ इसके पM चात ् पाXरिA थ(cid:17)तक संवेद(cid:8) जोन कहा गया है)
के (cid:25)प मQ अ(cid:28)धसू(cid:28)चत करती है, िजसका Fववरण (cid:17)न(cid:18)नानसु ार है, अथा'त ् :--
(1) पा(cid:15)रि%थ'तक संवेद* जोन का ,व%तार और उसक. सीमाए-ं -(1) पाXरिAथ(cid:17)तक संवेद(cid:8) जोन का FवAतार केरल
रा[य मQ साइलQट वैल(cid:8) नेशनल पाक' क0 सीमा से 9 Gकलोमीटर तक है िजसके अंतगत' राRd(cid:8)य पाक' क0 उ8तर(cid:8)-पूवr8तर
(cid:4)दशा मQ त(cid:19)मलनाडु रा[य क0 सीमा को Fवभािजत करने वाला (cid:4)हAसा नह(cid:8)ं है और सीमा का वणन' उपाबंध I के cप मQ
संलtन है ।
(2) (cid:23)मुख uब$ दओु ं के (cid:17)नदvशांक; के साथ-साथ पाXरिAथ(cid:17)तक संवेद(cid:8) जोन का मान(cid:28)चI उपाबंध II के (cid:25)प मQ
संलtन है ।
(3) पाXरिAथ(cid:17)तक संवेद(cid:8) जोन मQ 148 Gक.मी. के भौग(cid:19)ेलक +ेI आता है िजसमQ (cid:17)न(cid:4)हत वन और tयारह राजAव
xाम भी हK तथा पाXरिAथ(cid:17)तक संवेद(cid:8) जोन के भीतर आना वाले xाम; क0 सूची उपाबंध III के (cid:25)प मQ संलtन हK ।
2. पा(cid:15)रि%थ'तक संवेद* जोन के 3लए आंच3लक महायोजना –(1) रा[य सरकार, पाXरिA थ(cid:17)तक संवेद(cid:8) जोन के
(cid:23)योजन के (cid:19)लए राजपI मQ अं(cid:17)तम अ(cid:28)धसूचना के (cid:23)काशन क0 तार(cid:8)ख से दो वष ' क0 अव(cid:28)ध के भीतर Aथानीय लोग; से
परामश ' करके और इस अ(cid:28)धसूचना मQ (cid:4)दए गए अनुबंध; का पालन करते हुए एक आंच(cid:19)लक महायोजना तैयार करेगी ।
(2) उ: त योजना रा[ य सरकार मQ स+म (cid:23)ा(cid:28)धकार(cid:8) 7वारा अनमु ो(cid:4)दत होगी ।
(3) पाXरिA थ(cid:17)तक संवेद(cid:8) जोन के (cid:19)लए उ:त महायोजना रा[ य सरकार 7वारा ऐसी र(cid:8)(cid:17)त से जो इस अ(cid:28)धसूचना मQ
Fव(cid:17)न(cid:4)द'R ट Gकया जाए और सुसंगत कQ%(cid:8)य और रा[ य Fव(cid:28)धय; के और कQ%(cid:8)य सरकार 7वारा जार(cid:8) मागद' श^ (cid:19)सWांत; के

(4) आचं (cid:19)लक महायोजना, इसमQ पया'वरणीय और पाXरिA थ(cid:17)तक0 Fवचार; को समाक(cid:19)लत करने के (cid:19)लए रा[ य के सभी
संबW Fवभाग; के परामश ' से तैयार होगी, अथा'त:्--
(i) पया'वरण ;
(ii) वन ;
(iii) शहर(cid:8) Fवकास ;
(iv) पयट' न ;
(v) नगरपा(cid:19)लक ;
(vi) राजA व ;
(vii) कृFष ;
(viii) रा[ य (cid:23)दषू ण (cid:17)नयIं ण बोड ' ;
(ix) (cid:19)सचं ाई; और
(x) लोक (cid:17)नमा'ण Fवभाग ।
(5) आंच(cid:19)लक महायोजना अनमु ो(cid:4)दत Fव7यमान भू-उपयोग, अवसंरचना और G\याकलाप; पर कोई (cid:17)नबधz न
अ(cid:28)धरोFपत नह(cid:8)ं करेगी जब तक Gक इस अ(cid:28)धसूचना मQ Fव(cid:17)न(cid:4)द'R ट न ह; और आंच(cid:19)लक महायोजना मQ सभी अवसंरचना
और G\याकलाप; के सधु ार के कारक तथा पाXरिA थ(cid:17)तक0य अनकु ूलता का संवधन' करेगी ।
(6) आंच(cid:19)लक महायोजना मQ अना{छा(cid:4)दत +ेI; के जीणrWार, Fव7यमान जल (cid:17)नकाय; के संर+ण, आवाह +ेI; के
(cid:23)बंधन, जल-संभर; के (cid:23)बंधन, भूतल जल के (cid:23)बंधन, मदृ ा और नमी संर+ण, Aथानीय समुदाय; क0 आवMयकताओ ं तथा
पाXरिAथ(cid:17)तक0 और पया'वरण से संबं(cid:28)धत ऐसे अ$य पहलुओ,ं िजन पर `यान देना आवMयक है, के (cid:19)लए उपबंध ह;गे ।
(7) उ:त महायोजना सभी Fव7यमान एवं (cid:23)AताFवत पूजा A थल;, xाम; और नगर(cid:8)य बंदोबAत;, वन; के (cid:23)कार और
GकA म;, जनजातीय +ेI, कृFष +ेI;, ऊपजाऊ भू(cid:19)म, हXरत +ेI जैसे उ7यान और उसी (cid:23)कार के A थान, उ7यान कृFष +ेI,
आGक'ड;, झील; और अ$य जल (cid:17)नकाय; का अ|यकंन करेगी ।
(8) आंच(cid:19)लक महायोजना पाXरिA थ(cid:17)तक संवेद(cid:8) जोन मQ Fवकास को Fव(cid:17)नय(cid:19)मत करेगी िजससे A थानीय समुदाय; क0
आजीFवका को सुरo+त करने के (cid:19)लए पाXरिA थ(cid:17)तक0 अनुकूल Fवकास सु(cid:17)निM चत Gकया जा सके ।
(9) आंच(cid:19)लक महायोजना के उपबंध; के पया'Lत (cid:25)प से (cid:23)चाXरत Gकया जाएगा ।
3. रा6य सरकार 7वारा 8कए जाने वाले उपाय-- रा[य सरकार इस अ(cid:28)धसूचना के उपबंध; को (cid:23)भावी करने के (cid:19)लए
(cid:17)न(cid:18)न(cid:19)ल(cid:20)खत उपाय करेगी, अथा'त ् :--
(1) भ-ू उपयोग - पाXरिA थ(cid:17)तक संवेद(cid:8) जोन मQ वन;, उ7यान-कृFष +ेI;, कृFष +ेI;, आमोद-(cid:23)मोद के (cid:23)योजन के (cid:19)लए
(cid:28)चि$हत Gकए गए पाक} और खुले Aथान; का वा(cid:20)णि[यक और औ7यो(cid:28)गक संबW Fवकास G\याकलाप; के (cid:19)लए उपयोग
या संपXरवतन' नह(cid:8)ं होगा :
परंत ु पाXरिAथ(cid:17)तक संवेद(cid:8) जोन के भीतर कृFष भू(cid:19)म का संपXरवतन' , के अधीन मानीटर(cid:8) स(cid:19)म(cid:17)त क0 (cid:19)सफाXरश
पर और रा[य सरकार के पूव ' अनमु ोदन से, Aथानीय (cid:17)नवा(cid:19)सय; क0 आवासीय ज(cid:25)रत; को पूरा करने के (cid:19)लए और पैरा 4
क0 सारणी के Aतंभ (2) के अधीन \म सं. 16, 21, 27, 33 और 36 के सामने सूचीबW G\याकलाप; को पूरा करने के
(cid:19)लए अन~ु ात ह;गे, अथा'त ् :-
(क) पाXरिA थ(cid:17)तक0य अनकु ूल पयट' न G\याकलाप; के (cid:19)लए पयट' क; के अA थायी आवासन के (cid:19)लए पाXरिA थ(cid:17)तक0य
अनुकूल कुट(cid:8)र जैसे टे$ट, काRट गहृ ;

(ग) (cid:23)दषू ण काXरत न करने वाले लघ ु उ7योग ;
(घ) वषा' जल संचयन; और
(ड.) कुट(cid:8)र उ7योग, िजसके अंतगत' xामीण उ7योग, सुFवधा भंडार और A थानीय सुख-सुFवधाएं हK:
परंत ु यह और भी Gक रा[य सरकार के पूव ' अनमु ोदन और संFवधान के अनु{ छेद 244 या त8समय (cid:23)व8ृ त Fव(cid:28)ध
के उपबंध; के अनुपालन के uबना, िजसके अंतगत' अनुसू(cid:28)चत जनजा(cid:17)त और अ$य परंपरागत वन (cid:17)नवासी (वन अ(cid:28)धकार;
क0 मा$यता) अ(cid:28)ध(cid:17)नयम, 2006 (2007 का 2) भी है, वा(cid:20)णि[यक या उ7योग Fवकास G\याकलाप; के (cid:19)लए जनजातीय
भू(cid:19)म का उपयोग अन~ु ात नह(cid:8)ं होगा :
परंत ु यह और भी Gक पाXरिA थ(cid:17)तक संवेद(cid:8) जोन के भीतर भ-ू अ(cid:19)भलेख; मQ पाई जाने वाल(cid:8) कोई Iु(cid:4)ट मानीटर(cid:8)
स(cid:19)म(cid:17)त के Fवचार (cid:23)ाLत करने के पMचात ् रा[य सरकार 7वारा (cid:23)8येक मामले मQ केवल एक बार संशो(cid:28)धत होगी और उ:त
Iु(cid:4)ट के संशोधन क0 भारत सरकार के पया'वरण, वन और जलवायु पXरवतन' मंIालय को सूचना देनी होगी:
परंत ु यह और भी Gक उपय:ु' त Iु(cid:4)ट के संशोधन मQ इस उप पैरा के अधीन यथा उपबं(cid:28)धत के (cid:19)सवाय Gकसी भी
दशा मQ भ-ू उपयोग का पXरवतन' सि(cid:18)म(cid:19)लत नह(cid:8)ं होगा :
परंत ु यह और भी Gक हXरत +ेI जैसे वन +ेI, कृFष +ेI मQ कोई पाXरणा(cid:19)मक कटौती नह(cid:8)ं होगी और अ(cid:23)यु: त
या अनु8 पादक कृFष +ेI; मQ पुन: वनीकरण करने के (cid:23)यास Gकए जाएंगे ।
(2) "ाकृ'तक जल-=ोत -- आंच(cid:19)लक महायोजना मQ सभी (cid:23)ाकृ(cid:17)तक जल €ोत; क0 पहचान क0 जाएगी और उनके संर+ण
और पुननव' ीकरण के (cid:19)लए योजना सि(cid:18) म(cid:19)लत होगी और रा[ य सरकार 7वारा इन +ेI; पर या उनके (cid:17)नकट Fवकास
G\याकलाप;, जो ऐसे +ेI; के (cid:19)लए हा(cid:17)नकारक है, को (cid:23)(cid:17)तFषW करने के (cid:19)लए ऐसी र(cid:8)(cid:17)त से माग(cid:17)'नदvश तैयार Gकए
जाएंग।े
(3) पयट(cid:4) न – (क) पाXरिAथ(cid:17)तक संवेद(cid:8) जोन के भीतर पयट' न संबंधी G\याकलाप, पयट' न महायोजना के अनुसार ह;ग,े जो
आंच(cid:19)लक महायोजना का भाग (cid:25)प ह;गे ।
(ख) पयट' न महायोजना पयट' न Fवभाग, केरल सरकार 7वारा राजA व और वन Fवभाग, कना'टक सरकार के परामश ' से
तैयार होगी ।
(ग) पयट' न संबंधी G\याकलाप (cid:17)न(cid:18)नानुसार Fव(cid:17)नय(cid:19)मत Gकए जाएंगे, अथा'त ् :-
(i) पाXरिAथ(cid:17)तक संवेद(cid:8) जोन के भीतर सभी नए पयट' न G\याकलाप; या Fव7यमान पयट' न G\याकलाप; का
FवAतार भारत सरकार के पया'वरण, वन और जलवायु पXरवतन' मंIालय के मागद' शक' (cid:19)सWांत; के 7वारा तथा
पाXरिAथ(cid:17)तक पयट' न राR d(cid:8)य P या(cid:129) संर+ण (cid:23)ा(cid:28)धकरण, 7वारा जार(cid:8) (समय-समय पर यथा संशो(cid:28)धत) मागद' शक'
(cid:19)सWांत; के अनुसार, पाXरिAथ(cid:17)तक पयट' न, पाXरिAथ(cid:17)तक (cid:19)श+ा और पाXरिAथ(cid:17)तक Fवकास को मह8व देते
हुए पाXरिAथ(cid:17)तक संवेद(cid:8) जोन क0 वहन +मता के अ`ययन पर आधाXरत होगा;
(ii) पाXरिA थ(cid:17)तक0य अनुकूल पयट' न G\याकलाप; के संबं(cid:28)धत पयट' क; के अA थायी (cid:17)नवास के (cid:19)लए आवासन के
(cid:19)सवाय पाXरिA थ(cid:17)तक संवेद(cid:8) जोन के भीतर होटल और Xरसोट' के नए सं(cid:17)नमा'ण अनु~ात नह(cid:8)ं ह;गे ।
परंत ु संरo+त +ेI; क0 सीमा से एक Gकलोमीटर क0 दरू (cid:8) से परे पाXरिAथ(cid:17)तक0य संवेद(cid:8) जोन क0 सीमा तक नए
होटल और Xरसोट' के Aथापन पयट' न महायोजना के अनुसार पाXरिAथ(cid:17)तक0य पयट' न सुFवधा के (cid:19)लए पूव'
पXरभाFषत और Fव(cid:17)न(cid:4)द'Rट Aथान मQ ह(cid:8) अनु~ात Gकया जाएगा ।
(iii) आंच(cid:19)लक महायोजना का अनमु ोदन Gकए जाने तक, पयट' न के (cid:19)लए Fवकास और Fव7यमान पयट' न
G\याकलाप; के FवAतार को वाAतFवक Aथल Fव(cid:17)न(cid:4)द'Rट संवी+ा तथा मानीटर(cid:8) स(cid:19)म(cid:17)त क0 (cid:19)सफाXरश पर

(4) नैस(cid:21)गक(cid:4) ,वरासत – पाXरिAथ(cid:17)तक संवेद(cid:8) जोन मQ मह8वपूण ' नैस(cid:28)गक' Fवरासत के सभी Aथल; जैसे सभी जीन कोश
आरo+त +ेI, शैल Fवरचनाएं, जल (cid:23)पात;, झरन;, घाट(cid:8) माग}, उपवन;, गुफाओं, Aथल;, ‚मण, अMवरोहण, (cid:23)पात; आ(cid:4)द
क0 पहचान क0 जाएगी और उ$हQ पXररo+त Gकया जाएगा तथा उनक0 सुर+ा और संर+ा के (cid:19)लए इस अ(cid:28)धसूचना के
(cid:23)काशन क0 तार(cid:8)ख से छह मास के भीतर, उपयु:त योजना बनाई जाएगी और ऐसी योजना आंच(cid:19)लक महायोजना का
भाग होगी ।

(8) बBह=ाव का 'न%सारण – पाXरिAथ(cid:17)तक संवेद(cid:8) जोन मQ उपचाXरत ब(cid:4)ह€ाव का (cid:17)नAसारण जल ((cid:23)दषू ण (cid:17)नवारण तथा
(cid:17)नयंIण) अ(cid:28)ध(cid:17)नयम, 1974 (1974 का 6) और उसके अधीन बनाए गए (cid:17)नयम; के उपबंध; के अनुसार होगा ।
(9) ठोस अप3शEट – ठोस अप(cid:19)शRट; का (cid:17)नपटान (cid:17)न(cid:18)न(cid:19)ल(cid:20)खत (cid:25)प मQ होगा –

(cid:23)का(cid:19)शत नगरपा(cid:19)लक ठोस अप(cid:19)शRट ((cid:23)बंध और हथालन) (cid:17)नयम, 2000 के उपबंध; के अनुसार Gकया जाएगा ;
(ii) Aथानीय (cid:23)ा(cid:28)धकरण जैव (cid:17)न(cid:18)नीकरणीय और अजैव (cid:17)न(cid:18)नीकरणीय संघटक; मQ ठोस अप(cid:19)शRट; के संपथृ :कन
के (cid:19)लए योजनाएं तैयार करQग े ;

S.O. 118(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified
to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Draft Notification
WHEREAS, the Silent Valley National Park is situated between the North latitudes 11o2’ and 11o13’ and the
East longitudes 76o24’ and 76o32’ in Mannarkkad and Nilambur Taluks of Palakkad and Malapurram Districts,
respectively, in the State of Kerala and is spread over an area of 89.52 square kilometres;
AND WHEREAS, the absence of Cicada insects, which produce typical sound in the forest through their
tympanal vibrations and are usually abundant in tropical forests possibly contributed to the naming of the forests as
“Silent Valley”;
AND WHEREAS, the National Park has undulating terrain with steep escarpments and many hillocks with
elevation ranging from 900 m. to 2,300 metres above MSL and serve as catchment for River Kunthipuzha, which is the
tributary of Bharathapuzha, a major source of water for drinking and irrigation purposes in the Districts of Palakkad and
Malappuram;
AND WHEREAS, the core area of Silent Valley National Park is central and critical part of 5500 square
kilometre of core area of Niligiri Biosphere Reserve and also forms an integral part of Nilambur Elephant Reserve
constituted under the project elephant spread over an area of 1419 square kilometres;
AND WHEREAS, the National Park has rich floral and faunal diversity, with about 966 species of angiosperm
species in 430 genera and 33 families of dicots including 108 species of orchids and 139 genera and 21 families of
monocots, about 77 species of lichens and 77 species of pteridophytes have been reported from the Park;
AND WHEREAS, the recorded faunal diversity consists of 41 species of mammals, 211 species of birds
including 15 Western Ghat endemics, 42 species of reptiles, 46 species of amphibians, 12 species of freshwater fish, 92
species of butterflies and 250 species of moths;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are
specified in paragraph 1 of this notification around the protected area of Silent Valley National Park as Eco- sensitive
Zone from ecological and environmental point of view and to prohibit industries or class of industries and their
operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of
up to 9 kilometres from the boundary of Silent Valley National Park in the State of Kerala as the Silent Valley National
Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) excluding the portion sharing boundary with
the State of Tamil Nadu details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1)The extent of Eco-Sensitive Zone is up to 9 kilometres from the
boundary of Salient Valley National Park in the State of Kerala excluding the portion sharing boundary with the State of
Tamil Nadu on the north-north eastern side of the National Park and the description of the boundary are appended as
Annexure-I.
(2) The map of the Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure II
(3) The Eco-sensitive Zone covers a geographical area of 148 square kilometres which includes vested forests and

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as
is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued
by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) State Pollution Control Board;
(ix Irrigation;
(x) Public Works Department.
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,
orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development
for livelihood security of local communities.
(9) Adequate publicity shall be given to the provisions of the Zonal Master Plan.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 16, 21, 27, 33 and 36 in column (2)
of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly
tourism activities;
(ii) Widening and strengthening of existing roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities:¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 17
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State
Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such
areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Kerala in consultation
with Department of Revenue and Forest, Government of Kerala.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the eco-sensitive Zone except for
accommodation for temporary occupation of tourists related to Eco-friendly tourism activities.
Provided that beyond the distance of one kilometre from the boundary of the Protected Areas till the extent of
the eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated
areas for Eco-tourism facilities as per Tourism Master Plan.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall
be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone
shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely:-

(b) the construction activity related to small scale industries not
causing pollution shall be regulated and kept at the minimum,
with the prior permission from the competent authority as per
applicable rules and regulations, if any.
(c) Beyond one kilometre and upto extent of Eco-sensitive Zone
construction for bona fide local needs shall be permitted and other
commercial construction activities shall be regulated as per Zonal
Master Plan.

18. Felling of trees. (a) There shall be no felling of trees on the forest or Government

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(ii) Representative of District Collector, Malappuram – Member;
(ii) The Member of Legislative Assembly, Mannarkkad – Member;
(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from
the Speaker of Legislative Assembly, Kerala, if required)
(iii) The Member of Legislative Assembly, Wandoor – Member;
(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from
the Speaker of Legislative Assembly, Kerala, if required)
(iv) President, District Panchayat, Palakkad – Member;
(v) President, District Panchayat, Malappuram – Member;
(vi) One representative of Non Governmental Organisation working in the field of environment to be nominated by
the Government of Kerala for a term of one year in each case – Member;
(vii) one expert in the area of ecology and environment from a reputed institution of University in the State to be
nominated by the Government of Kerala for a term of one year in each case – Member;
(viii) Representative of Kerala Pollution Control Board, District Officer - Member;
(ix) Concerned Divisional Forest Officer (Territorial) – Member;

Terms of Reference:
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-
sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall
be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central
Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the
provisions of the said notification.
(4) The activities that are not covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in
the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4
thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-
charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any
person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on
issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Central Government in the Ministry of Environment, Forest and Climate
Change as per the proforma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to the
provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.

From Anginda(2383 M), it runs along interstate boundary upto Bhavani river, then South along
the left bank of Bhavani river till the point the river takes eastward turn at Mukkali , then
NORTH AND towards South till it reaches Mannarkkad- Chinnathadakam road at Forest Check Post, Mukkali,
EAST thence along the road upto Mandampottithodu excluding the private lands and habitation of
approximatley 50 Ha area at Mukkali (N 76 0 53´ 30.36˝ E 11009´26.96˝ and N 76054´35.53 E
11005´75.93˝)
From Mandampottithodu towards west along southern boundary of Attapady forest range up to
North Eastern Boundary of Thathengalam Vested Forests (VFC-1) of Mannarkkad Range. Then
from North- Eastern boundary of Thanthenglam Vested Forests (VFC-1) It follows the southern

boundary till it reaches the south Eastern boundary of Thathengalam Vested Forests (VFC-1)
thence along the southern boundaries of VFC-1,18,17 and 92) till it reaches Palakkad –
Malappuram District boundary).
From the above point in Palakkad – Malappuram district boundary towards North all along the
Western boundaries of the vested forests bits Cherumba Malavaram (VFC-15(1) and 15(2),
WEST Kannoth Malavaram (VFC-2) and Kozhipara (VFC-10) unit till reaches the Kotapuzha river-
excluding approximatly an area of 50 Ha private land at Kottapuzha lying the north west
corner(N 76039´25.84˝ E 11023´04.02˝ and N 76042´09.70˝ E 11022´29.44˝)
Thence towards east along the left bank of Kotapuzha river till it finally joins the interstate
NORTH boundary of Kerala and Tamil Nadu, then along the interstate boundary till it reaches Anginda
