को अ(cid:29)धसू(cid:29)चत करती है, िजसका Hववरण (cid:18)न(cid:19)नानसु ार है, अथा(त ् :- 1. पा(cid:15)रि%थ'तक संवेद* जोन का ,व%तार और उसक. सीमाएं--(1) आ%_ (cid:24)देश रा`य के िजला Hवशाखापटनम मS पाZरिBथ(cid:18)तक संवेद(cid:8) जोन 30.51 वग ( Iकलोमीटर ,ेK तक फैला हुआ है और िजसमS 2 मंडल या(cid:18)न आन%दापुरम और (cid:18)छनांग(cid:29)धल(cid:8) िजला Hवशाखापटनम के 14 tाम सि(cid:19)म(cid:20)लत हM । (2) पाZरिBथ(cid:18)तक संवेद(cid:8) जोन का HवBतार 4.33 Iकलोमीटर क1 सीमा तक कांबलक<डा व%यजीव अभयार^य तक फैला हुआ है । (3) पाZरिBथ(cid:18)तक संवेद(cid:8) जोन क1 सीमा का वण(न उपाबंध I के (cid:26)प मS उपाबY है और tाम< क1 सूची उपाबंध II मS व(cid:21)णत( है । (4) पाZरिBथ(cid:18)तक संवेद(cid:8) जोन सीमा के साथ अ,ांश-देशांतर का मान(cid:29)चK उपाबंध III के (cid:26)प मS उपाबY है । 2. पा(cid:15)रि%थ'तक संवेद* जोन के 3लए आंच3लक महायोजना – (1) रा`य सरकार, पाZरिB थ(cid:18)तक संवेद(cid:8) जोन के (cid:24)योजन के (cid:20)लए राजपK मS अ(cid:29)धसूचना के अं(cid:18)तम (cid:24)काशन क1 तार(cid:8)ख से दो वष ( क1 अव(cid:29)ध के भीतर, Bथानीय Rयि;तय< के परामश ( से, इस अ(cid:29)धसूचना मS संलv न अनुबंध< के सामंजB य से आंच(cid:20)लक महायोजना तैयार करेगी । (2) उ;त योजना रा`य सरकार मS स,म (cid:24)ा(cid:29)धकार(cid:8) 8वारा अनमु ो(cid:4)दत होगी । (3) पाZरिB थ(cid:18)तक संवेद(cid:8) जोन के (cid:20)लए आचं(cid:20)लक महायोजना इस अ(cid:29)धसूचना मS Hव(cid:18)न(cid:4)द(T ट (cid:26)प मS ऐसी र(cid:8)(cid:18)त मS रा` य सरकार तथा सुसंगत कS&(cid:8)य और रा` य Hव(cid:29)धय< के सामंजB य मS भी तथा कS&(cid:8)य सरकार 8वारा जार(cid:8) माग(cid:18)(नदwश, य(cid:4)द कोई ह<, 8वारा तैयार होगी । (4) आंच(cid:20)लक महायोजना सभी संबY रा` य सरकार के Hवभाग< के परामश ( से तैयार होगी, अथा(त:्-- (i) पया(वरण ; (ii) वन ; (iii) नगर Hवकास ; (iv) पयट( न ; (v) नगरपा(cid:20)लक ; (vi) राजB व ; (vii) कृHष ;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (viii) रा` य (cid:24)दषू ण (cid:18)नयKं ण बोड ( ; (ix) (cid:20)सचं ाई ; और (x) लोक (cid:18)नमा(ण Hवभाग, इसमS पया(वरणीय और पाZरिB थ(cid:18)तक1 Hवचार< को समाक(cid:20)लत करने के (cid:20)लए ह<ग।े (5) महायोजना अनमु ो(cid:4)दत Hव8यमान भू-उपयोग, अवसंरचना9 मक और Ipयाकलाप< पर कोई (cid:18)नबधm न अ(cid:29)धरोHपत नह(cid:8)ं करेगी जब तक Iक इस अ(cid:29)धसूचना मS Hव(cid:18)न(cid:4)द(Tट न ह< और आचं(cid:20)लक महायोजना मS सभी अवसंरचना Ipयाकलाप< मS द,ता और पाZरिBथ(cid:18)तक1य अनुकूलता का संवधन( करेगी । (6) आंच(cid:20)लक महायोजना मS अनाyछा(cid:4)दत ,ेK< के जीणzYार, Hव8यमान जल (cid:18)नकाय< के संर,ण, आवाह ,ेK< के (cid:24)बंधन, जल-संभर< के (cid:24)बंधन, भूतल जल के (cid:24)बंधन, मदृ ा और नमी संर,ण, Bथानीय समुदाय< क1 आवOयकताओ ं तथा पाZरिBथ(cid:18)तक1 और पया(वरण से संबं(cid:29)धत ऐसे अ%य पहलूओ,ं िजन पर {यान देना आवOयक है, के (cid:20)लए उपबंध ह<गे । (7) आंच(cid:20)लक महायोजना सभी Hव8यमान एवं (cid:24)BताHवत पूजा B थल<, tाम< और नगर(cid:8)य बंदोबBत<, वन< के (cid:24)कार और IकB म<, कृHष ,ेK<, ऊपजाऊ भू(cid:20)म, हZरत ,ेK जैसे उ8यान और उसी (cid:24)कार के B थान, उ8यान कृHष ,ेK, आIक(ड<, झील< और अ%य जल (cid:18)नकाय< का अ}यकंन करेगी । (8) आंच(cid:20)लक महायोजना पाZरिB थ(cid:18)तक संवेद(cid:8) जोन मS Hवकास को पाZरिB थ(cid:18)तक अनकु ूल Hवकास और Bथ ानीय समुदाय< क1 जीवकोपाजन( को सु(cid:18)निO चत करते हुए Hव(cid:18)नय(cid:20)मत होगी । 3. रा6य सरकार 7वारा 8कए जाने वाले उपाय-- रा`य सरकार इस अ(cid:29)धसूचना के उपबंध< को (cid:24)भावी करने के (cid:20)लए (cid:18)न(cid:19)न(cid:20)ल(cid:21)खत उपाय करेगी, अथा(त ् :-- (1) भ-ू उपयोग - पाZरिB थ(cid:18)तक संवेद(cid:8) जोन मS वन<, उ8यान-कृHष ,ेK<, कृHष ,ेK<, आमोद-(cid:24)मोद के (cid:24)योजन के (cid:20)लए (cid:29)चि%हत Iकए गए पाकo और खुल े Bथान< का वा(cid:21)णि`यक और औ8यो(cid:29)गक संबY Hवकास Ipयाकलाप< के (cid:20)लए उपयोग या संपZरवतन( नह(cid:8)ं होगा : परंत ु पाZरिBथ(cid:18)तक संवेद(cid:8) जोन के भीतर कृHष भू(cid:20)म का संपZरवतन( मानीटर(cid:8) स(cid:20)म(cid:18)त क1 (cid:20)सफाZरश पर और रा`य सरकार के पूव ( अनमु ोदन से, Bथानीय (cid:18)नवा(cid:20)सय< क1 आवासीय ज(cid:26)रत< को पूरा करने के (cid:20)लए और पैरा 4 क1 सारणी के Bतंभ (2) के अधीन pम स0ं 10, 16, 22, 28 और 31 के सामने सूचीबY Ipयाकलाप< को पूरा करने के (cid:20)लए अन~ु ात ह<गे, अथा(त ् :- (i) पाZरिBथ(cid:18)तक अनुकूल पयट( न Ipयाकलाप< से संबं(cid:29)धत पयट( क< के अBथायी अ(cid:29)धभोग के (cid:20)लए (cid:20)लए पाZरिBथ(cid:18)तक अनुकूल कुट(cid:8)र जैसे टMट, लकड़ी के मकान आ(cid:4)द । (ii) Hव8यमान सड़क< को चौड़ा करना और उ%हS सुnढ करना, (iii) (cid:24)दषू ण उ9प%न न करने वाले लघु उ8योग, (iv) वषा( जल संचय, और (v) कुट(cid:8)र उ8योग< मS tाम उ8योग, भडं ारण क1 सुHवधा और Bथानीय सुख-सुHवधाएं सि(cid:19)म(cid:20)लत हM : परंत ु यह और भी Iक रा`य सरकार के पूव ( अनमु ोदन तथा संHवधान के अनुyछेद 244 और त9समय (cid:24)व9ृ त Hव(cid:29)ध के उपबंध< के अनुपालन के aबना, िजसके अंतगत( अनुसू(cid:29)चत जनजा(cid:18)त और अ%य परंपरागत वन (cid:18)नवासी (वन अ(cid:29)धकार< क1 मा%यता) अ(cid:29)ध(cid:18)नयम, 2006 (2007 का 2) भी है, वा(cid:21)णि`यक या उ8योग Hवकास Ipयाकलाप< के (cid:20)लए जनजातीय भू(cid:20)म का उपयोग अन~ु ात नह(cid:8) ं होगा : परंत ु यह और भी Iक पाZरिB थ(cid:18)तक संवेद(cid:8) जोन के भीतर भ-ू अ(cid:20)भलेख< मS उपसंजात कोई Kु(cid:4)ट मानीटर(cid:8) स(cid:20)म(cid:18)त के Hवचार (cid:24)ाNत करने के पOचात ् रा`य सरकार 8वारा (cid:24)9येक मामले मS संशो(cid:29)धत होगी और उ;त Kु(cid:4)ट के संशोधन क1 के%&(cid:8)य सरकार के पया(वरण, वन और जलवायु पZरवतन( मंKालय को सूचना देनी पZरवतन( सि(cid:19)म(cid:20)लत नह(cid:8)ं होगा : परंत ु यह और भी Iक िजससे हZरत ,ेK मS जैसे वन ,ेK, कृHष ,ेK मS कोई पाZरणा(cid:20)मक कटौती नह(cid:8)ं होगी और अन(cid:24)य;ु त या अनु9 पादक कृHष ,ेK< मS पुन: वनीकरण करने के (cid:24)यास Iकए जाएंगे । (2) "ाकृ'तक जल =ोत -- आचं(cid:20)लक महायोजना मS सभी (cid:24)ाकृ(cid:18)तक जल ‚ोत< क1 पहचान क1 जाएगी और उनके संर,ण और पुननव( ीकरण के (cid:20)लए योजना को सि(cid:19) म(cid:20)लत Iकया जाएगा और रा` य सरकार 8वारा ऐसी र(cid:8)(cid:18)त से मागद( शक( (cid:20)सYांत बनाए जाएंगे िजससे Iक उन ,ेK< मS या इसके समीप Hवकास Ipयाकलाप को रोका जा सके जो ऐसे ,ेK के (cid:20)लए हा(cid:18)नकारक हM । (3) पयट(cid:4) न – (क) पाZरिBथ(cid:18)तक संवेद(cid:8) जोन के भीतर पयट( न संबंधी Ipयाकलाप, जो पयट( न महायोजना के अनसु ार ह<गे, आंच(cid:20)लक महायोजना का भाग (cid:26)प मS ह<गे । (ख) पयट( न महायोजना पयट( न Hवभाग, 8वारा आ%_ (cid:24)देश रा`य सरकार के वन और पया(वरण Hवभाग के परामश ( से तैयार होगी । (ग) पयट( न संबंधी Ipयाकलाप (cid:18)न(cid:19) न(cid:20)ल(cid:21)खत के अधीन Hव(cid:18)नय(cid:20)मत ह<ग,े अथा(त ् :- (i) पाZरिBथ(cid:18)तक संवेद(cid:8) जोन के भीतर सभी नए पयट( न Ipयाकलाप< या Hव8यमान पयट( न Ipयाकलाप< का HवBतार के%&(cid:8)य सरकार के पया(वरण, वन और जलवायु पZरवतन( मंKालय के मागद( शक( (cid:20)सYांत< के 8वारा तथा राT ƒ(cid:8)य R या„ संर,ण (cid:24)ा(cid:29)धकरण के पाZरिBथ(cid:18)तक पयट( न मागद( शक( 8वारा जार(cid:8) (समय-समय पर यथा संशो(cid:29)धत) (cid:20)सYांत< के अनुसार, पाZरिBथ(cid:18)तक पयट( न, पाZरिBथ(cid:18)तक (cid:20)श,ा और पाZरिBथ(cid:18)तक Hवकास को मह9व देते हुए पाZरिBथ(cid:18)तक संवेद(cid:8) जोन क1 वहन ,मता के अ{ययन पर आधाZरत होगा; (ii) पाZरिBथ(cid:18)तक1य अनकु ूल पयट( क Ipयाकलाप< के संबंध मS अB थायी अ(cid:29)धभोग के (cid:20)लए वास सुHवधा के (cid:20)सवाय कांबलक<डा व%यजीव अभयार^य क1 सीमा से एक Iकलोमीटर भीतर होटल और Zरसोटo का नया सं(cid:18)नमा(ण अन~ु ात नह(cid:8)ं होगा; परंत ु संरj,त ,ेK< क1 सीमा से एक Iकलोमीटर क1 दरू (cid:8) से परे पाZरिBथ(cid:18)तक1य संवेद(cid:8) जोन क1 सीमा तक नए होटल और Zरसोट( क1 Bथापना पयट( न महायोजना के अनुसार पाZरिBथ(cid:18)तक1य पयट( न सुHवधा के (cid:20)लए पूव ( पZरभाHषत और Hव(cid:18)न(cid:4)द(Tट Bथान मS ह(cid:8) अन~ु ात Iकया जाएगा । (iii) आंच(cid:20)लक महायोजना का अनमु ोदन Iकए जाने तक, पयट( न के (cid:20)लए Hवकास और Hव8यमान पयट( न Ipयाकलाप< के HवBतार को वाBतHवक Bथल Hव(cid:18)न(cid:4)द(Tट संवी,ा तथा मानीटर(cid:8) स(cid:20)म(cid:18)त क1 (cid:20)सफाZरश पर आधाZरत संबं(cid:29)धत Hव(cid:18)नयामक (cid:24)ा(cid:29)धकाZरय< 8वारा अन~ु ात Iकया जाएगा । (4) नैस(cid:21)गक(cid:4) ,वरासत -- पाZरिBथ(cid:18)तक संवेद(cid:8) जोन मS मह9वपूण ( नैस(cid:29)गक( Hवरासत के सभी Bथल< जैसे सभी जीन कोश आरj,त ,ेK, शैल Hवरचनाएं, जल (cid:24)पात<, झरन<, घाट(cid:8) मागo, उपवन<, गुफाएं, Bथल<, …मण, अOवरोहण, (cid:24)पातो आ(cid:4)द क1 पहचान क1 जाएगी और उ%हS संरj,त Iकया जाएगा तथा उनक1 सुर,ा और संर,ा के (cid:20)लए इस अ(cid:29)धसूचना के (cid:24)काशन क1 तार(cid:8)ख से छह मास के भीतर, उपयु;त योजना बनाएगी और ऐसी योजना आंच(cid:20)लक महायोजना का भाग होगा । (5) मानव 'न3मत(cid:4) ,वरासत % थल@ - पाZरिB थ(cid:18)तक संवेद(cid:8) जोन मS भवन<, संरचनाओं, (cid:20)श(cid:6)प-त†य, ऐ(cid:18)तहा(cid:20)सक, कला9मक और सांBकृ(cid:18)तक मह9व के ,ेK< क1 पहचान करनी होगी और इस अ(cid:29)धसूचना के (cid:24)काशन क1 तार(cid:8)ख से छह संवेद(cid:8) जोन मS { व(cid:18)न (cid:24)दषू ण के (cid:18)नयंKण के (cid:20)लए रा` य सरकार का पया(वरण Hवभाग या रा`य (cid:24)दषू ण (cid:18)नयंKण बोड,( वाय ु ((cid:24)दषू ण (cid:18)नवारण और (cid:18)नयंKण) अ(cid:29)ध(cid:18)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:18)नयम< के उपबंध< के अनुसरण मS मागद( शक( (cid:20)सYांत और Hव(cid:18)नयम तैयार करेगा । (7) वाय ु "दषू ण -- पाZरिBथ(cid:18)तक संवेद(cid:8) जोन मS वाय ु (cid:24)दषू ण के (cid:18)नयंKण के (cid:20)लए रा` य सरकार का पया(वरण Hवभाग या रा`य (cid:24)दषू ण (cid:18)नयंKण बोड,( वाय ु ((cid:24)दषू ण (cid:18)नवारण और अकाब(cid:18)( नक सामtी का (cid:18)नपटान पाZरिBथ(cid:18)तक संवेद(cid:8) जोन के बाहर पहचान Iकए गए B थल पर Iकसी पया(वरणीय Bवीकृत र(cid:8)(cid:18)त मS होगा और पाZरिBथ(cid:18)तक संवेद(cid:8) जोन मS ठोस Lयौर< को उपाबंध के (cid:26)प मS संलvन Iकया जा सकेगा ।¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13 7. पया(वरण (संर,ण) अ(cid:29)ध(cid:18)नयम, 1986 क1 धारा 19 के अधीन दज ( क1 गई (cid:20)शकायत< का सारांश। 8. मह9 ता का कोई अ% य Hवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th January, 2016 S.O. 62(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110 003, or send it to the e-mail address of the Ministry at esz-mef@nic.in Draft Notification WHEREAS, the Kambalakonda Wildlife Sanctuary is situated in the heart of Visakhapatnam Mega City in Andhra Pradesh and is spread over an area of 7139 hectares between 83.04’ to 83.20’ Longitudes and 17.34’ to 17.47’ Latitudes; AND WHEREAS, the Sanctuary maintains very rich bio-diversity comprising 73 tree species, 39 species of herbs and shrubs, and 18 species of climbers, 2 species of Bamboos and 7 species of grasses, 23 mammal species, 7 species of reptiles and more than 90 species of birds have been documented from the Sanctuary; AND WHEREAS, the Sanctuary harbours large variety of flora and is characterised by a scrub jungle the major tree species of the area are Ficus banghlensis, Acacia lucophloea, Acacia chundra, Sapindus emarginatas, and Wrightia tinctoria etc; AND WHEREAS, the area harbours a rich faunistic diversity which includes, Panther, Bear, Wild Boar, Sambhar, Barking Deer, Mouse Deer, Spotted Deer, Jackal, and Wild Dog; AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the boundary of the protected area of Kambalakonda Wildlife Sanctuary, Visakhapatnam as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries or/and their operations and processes in the said Eco-sensitive Zone ; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub – section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of up to 4.33 kilometers from the boundary of the Kambalakonda Wildlife Sanctuary in the State of Andhra Pradesh, as the Kambalakonda Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:— 1. Extent and Boundary of Eco-sensitive Zone.—(1) The Eco-sensitive Zone is spread over an area of 30.51 square kilometers in Visakhapatnam District of Andhra Pradesh and includes 14 villages of 2 Mandals viz. Anandapuram and Chinagadhili in Visakhapatnam District. (2) The extent of Eco-sensitive Zone varies up to 4.33 kilometer from the boundary of Kambalakonda Wildlife Sanctuary. (3) The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II. (4) The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended as Annexure III; 2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment, (ii) Forest, (iii) Urban Development, (iv) Tourism, (v) Municipal, (vi) Revenue, (vii) Agriculture (viii) State Pollution Control Board, (ix) Irrigation, and (x) Public Works Department, for integrating environmental and ecological considerations into it. (5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, need of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 16, 22, 28 and 31 in column (2) of the Table in paragraph 4, namely:- (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities, (ii) Widening and strengthening of existing roads. (iii) Small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas in such a manner as which are detrimental to such areas which are detrimental to such areas. (3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment, Government of Andhra Pradesh. (c) The activity of tourism shall be regulated as under, namely:— (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco- sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Kambalakonda Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities: Provided that beyond the distance of one kilometer from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per the Tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:— (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forest vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone (10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forest vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.—(a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the table below, namely:— TABLE S.No. Activity Remarks (1) (2) (3) Prohibited activities 1. Union of India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 3. Setting up of industries causing water or air No new or expansion of polluting industries in the Eco- or soil or noise pollution. sensitive Zone shall be permitted. 4. Commercial use of firewood. Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone: Provided the existing wood-based industry may continue as per applicable laws. Regulated activities 10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities. Provided that beyond one kilometre and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities would in conformity with Tourism master Plan and national Tiger Conservation authority. 11 Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometer from the boundary of the protected area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub - paragraph (1) of paragraph 3. (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any: Provided further that existing multistoried and non-multistoried buildings, as on date of notification, under construction may be allowed as per applicable rules and regulations . (c) Beyond one kilometer from the boundary of the protected area upto the extent of Eco sensitive Zone, construction for bona fide local needs shall be permitted and other commercial construction activities shall be regulated as per Zonal Master Plan. (d) construction activity in the Eco-sensitive Zone shall be as per Zonal Master Plan (e) The Visakhapatnam Urban Development Authority shall integrate the Zonal master Plan into the development plan of the area. 12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. (c) In case of Reserve Forests and protected forests, the working plan prescriptions shall be followed. 13. Commercial water resources including (a) The extraction of surface water and ground water shall ground water harvesting. be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land. Monitoring Committee:- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:— (a) District Collector, Visakhapatnam —Chairman¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 (b) One representative of Non Governmental Organization working in the field of environment to be nominated by the Government of Andhra Pradesh for a term of one year in each case —Member (c) one expert in the area of ecology and environment to be nominated by the Government of Andhra Pradesh for a term of one year in each case —Member (d) Regional Officer, State Pollution Control Board, Medak —Member. (e) Senior Town Planner of the area/Chief Urban Planner/City Planner —Member. (f) Deputy Conservator of Forests (In Charge of the Sanctuary), Visakhapatnam —Member-Secretary. 6. Terms of Reference:- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. A line runs along the SH-38 and passes behind hillocks adjacent to Gambhiram Reservoir and touches the station ‘B’ with co ordinates N 17.87368 E 83.36599. The total distance from B to C station is 1.854 Kms. The Range of radius of the Eco-Sensitive zone is 140-308 mtrs on along the length. The proposed Eco-sensitive zone distance is 100 mtrs surrounding the protected area. C to D: The line runs South westerly direction behind Boravaniapalem Village and runs around the Devimetta and reaches at station ‘D’ with co-ordinates N17.833200 E 83.327710 near Sri Chaitanya Engineering College behind Kommadi Village. The total distance from C to D station is 5.469 Kms. The Range of radius of the Eco-Sensitive zone is 100-690 mtrs on along the length. The proposed Eco-sensitive zone distance is 100 mtrs surrounding the protected area. D to E: The line runs South Easterly direction runs through patta lands and vacant lands of Kommadi, Revallapalem Villages which includes Police Training Centre and Baba Institute of Technology and Sciences and passes through Housing Board Colony and Private layouts with co-ordinates N 17.792580 E 83.355850. The total distance from D to E station is 5.121 Kms. The Range of radius of the Eco- Sensitive zone is 100-286 mtrs on along the length. The proposed distance is 100 mtrs surrounding the protected area. E to F: The line runs north along NH-5 Southerly and runs along the boundary of Seethakonda Reserve Forest which includes Indira Gandhi Zoological Park, Visakhapatnam and passes through outskirts of Endada Village at station ‘F’ with co-ordinates N 17.753520 E 83.352580. The total distance from E to F station is 6.335 Kms. The Range of radius of the Eco-Sensitive zone is 100-1360 mtrs on along the length. The proposed distance is 100 mtrs surrounding the protected area excluding the area of Reserve Forest. F to G: The line runs Westerly direction all along the Southern boundary of Seethakonda RF Ravindranagar, Aarilova Colonies and reaches at station ‘G’ at Mudasarlova Reservoir with co-ordinates N 17.766220 E 83.301010. The total distance from F to G station is 6.692 Kms. The Range of radius of the Eco- Sensitive zone is 127-1280 mtrs on along the length. The proposed distance is 300 mtrs surrounding the protected area. G to H: The line runs Westerly direction behind Pineapple colony and Darapalem and touches Pata Adavivaram Junction covering BRTS roads and touches station H with co-ordinates N 17.778810 E 83.255460. The total distance from G to H station is 3.375 Kms. The Range of radius of the Eco- Sensitive zone is 240-418 mtrs on along the length. The proposed distance is 300 mtrs surrounding the protected area. H to I: The line runs Northerly direction touching Yerrakonda RF boundary and runs along the Western boundary Kambalakonda Extn RF boundary which includes Dabbanda, Mannepalem, Gollalapalem, Malapalli, Appikondapalem Villages and touches Station I which is station no.1 of Kambalakonda Extn., RF with co-ordinates N 17.844620 E 83.271270. The total distance from H to I station is 8.513 Kms. The Range of radius of the Eco-Sensitive zone is 178-2386 mtrs on along the length. The mean distance is 200 mtrs surrounding the protected area excluding the area of Reserve Forest. I to J: The line runs Easterly direction along the Kambalakonda Extn RF boundary upto Station no.7 leaving Mamidilova Village behind and touches Station J at over head tank of Dibbameedipalem Village with co-ordinates N 17.850740 E 83.300300. The total distance from I to J station is 3.190 Kms. The Range of radius of the Eco-Sensitive zone is 604-2003 mtrs on along the length. The proposed distance is 300 mtrs surrounding the protected area excluding the area of Reserve Forest. J to A: The line runs Northerly direction almost all parallel to Kambalakonda Wildlife Sanctuary Boundary along the foothills reaches Station A with co-ordinates N 17.879530 E 83.316650. The total distance from J to A station is 3.80 Kms. The Range of radius of the Eco-Sensitive zone is 216-578 mtrs on along the length.
