िवभागो के परामश(cid:24) से तैयार होगी अथा(cid:24)त:- (i) पया(cid:24)वरण ; (ii) वन ; (iii) नगर िवकास ; (iv) पय(cid:24)टन ; (v) नगरपािलक ; (vi) राज+ व ; (vii) कृिष ; और (viii) अVणाचल (cid:15)देश राcय (cid:15)दषू ण िनयं1ण बोड (cid:24)। (6) आंचिलक महायोजना अनुमो(cid:1)दत िवUमान भू-उपयोग, अवसंरचना और (cid:1)Lयाकलाप& पर कोई िनबeधन अिधरोिपत नहb करेगी जब तक (cid:1)क इस अिधसूचना म; और आचंिलक महायोजना म; सभी अवसंरचना और अिधक (cid:15)भावी और पा रि+ थितक(cid:30)य अनुकूल (cid:1)Lयाकलाप कारक इस (cid:15)कार िविन@दOट न हो । (7) आंचिलक महायोजना म; अनाfछा(cid:1)दत (cid:29)े1& के जीणh?ार, िवUमान जल िनकाय& के संर(cid:29)ण, आवाह (cid:29)े1& के (cid:15)बंधन, जल- संभर& के (cid:15)बंधन, भूतल जल के (cid:15)बंधन, मृदा और नमी संर(cid:29)ण, +थानीय समुदाय& क(cid:30) आवTयकताZ तथा पा रि+थितक(cid:30) और पया(cid:24)वरण से संबंिधत ऐसे अ(cid:21)य पहलूZ, िजन पर iयान दने ा आवTयक ह,ै के िलए उपबंध ह&गे । (8) आंचिलक महायोजना सभी िवUमान पूजा + थल&, aाम& और नगरीय बंदोब+त&, वन& के (cid:15)कार और (cid:1)क+ म&, कृिष (cid:29)े1&, ऊपजाऊ भूिम, ह रत (cid:29)े1 जैसे उUान और उसी (cid:15)कार के + थान, उUान कृिष (cid:29)े1, आ@कड&, झील& और अ(cid:21)य जल िनकाय& का अkयकंन करेगी । (9) आंचिलक महायोजना पा रि+थितक(cid:30)य संवेदी जोन म; िवकास को पा रि+थितक(cid:30)य अनुकूल िवकास और + थानीय समुदाय& क(cid:30) आजीिवका को सुिनिTच त करते )ए िविनयिमत होगी । 3. रररराााा(cid:28)(cid:28)(cid:28)(cid:28)यययय ससससररररककककाााारररर (cid:29)(cid:29)(cid:29)(cid:29)ाााारररराााा (cid:30)(cid:30)(cid:30)(cid:30)ककककएएएए जजजजाााानननन ेे ेेववववााााललललेे ेे उउउउपपपपाााायययय-------- राcय सरकार इस अिधसूचना के उपबंध& को (cid:15)भावी करने के िलए िन(cid:12)िलिखत उपाय करेगी, अथा(cid:24)त् :-- (1) भभभभ---ूू-ूूउउउउपपपपययययोोोोगगगग ---- पा रि+थितक(cid:30)य संवेदी जोन म; वन&, उUान-कृिष (cid:29)े1&, कृिष (cid:29)े1&, आमोद-(cid:15)मोद के (cid:15)योजन के िलए िचि(cid:21)हत (cid:1)कए गए पाकl और खुले +थान& का वािणिcयक और औUोिगक संब? िवकास (cid:1)Lयाकलाप& के िलए उपयोग या संप रवत(cid:24)न नहb होगा : परंतु पा रि+थितक(cid:30)य संवेदी जोन के भीतर कृिष भूिम का संप रवत(cid:24)न, मानीटरी सिमित क(cid:30) िसफा रश पर और राcय सरकार के पूव(cid:24) अनुमोदन से, +थानीय िनवािसय& क(cid:30) आवासीय ज(cid:17)रत& को पूरा करने के िलए और पैरा 4 क(cid:30) सारणी के +तंभ (2) के अधीन L.सं. 27, 30, 37 और 42 के सामने सूचीब? (cid:1)Lयाकलाप& को पूरा करने के िलए अनुmात ह&गे, अथा(cid:24)त् :- (i) (cid:15)दषू ण का रत न करने वाले लघु उUोग, (ii) पा रि+थ ितक(cid:30)य अनुकूल पय(cid:24)टन (cid:1)Lयाकलाप& के िलए पय(cid:24)टक& के अ+ थायी आवासन के िलए पा रि+ थितक(cid:30)य अनुकूल आरामगाह जैसे टट; , लकड़ी के मकान आ(cid:1)द ; (iii) वषा(cid:24) जल संचयन; और (iv) कुटीर उUोग, िजसके अंतग(cid:24)त aामीण िश(cid:3)पी भी ह 5: परंतु यह और (cid:1)क राcय सरकार के पूव(cid:24) अनुमोदन और संिवधान के अनुf छेद 244 या तQसमय (cid:15)वृ# िविध के उपबंध& के अनुपालन के िबना, िजसके अंतग(cid:24)त अनुसूिचत जनजाित और अ(cid:21)य परंपरागत वन िनवासी (वन अिधकार& क(cid:30) मा(cid:21)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिcयक या उUोग िवकास (cid:1)Lयाकलाप& के िलए जनजातीय भूिम का उपयोग अनुmात नहb होगा :4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु यह और भी (cid:1)क पा रि+थितक(cid:30)य संवेदी जोन के भीतर भू-अिभलेख& म; पाई जाने वाली कोई 1ु ट मानीटरी सिमित के िवचार (cid:15)ा7 करने के प8ात ्राcय सरकार "ारा (cid:15)Qयेक मामले म; एक बार संशोिधत होगी और उ% 1ु ट के संशोधन क(cid:30) भारत सरकार के पया(cid:24)वरण, वन और जलवायु प रवत(cid:24)न मं1ालय को सूचना दने ी होगी : परंतु यह और भी (cid:1)क उपयु(cid:24)% 1ु ट के संशोधन म; इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म; भू-उपयोग का प रवत(cid:24)न सि(cid:7)मिलत नहb होगा : परंतु यह और भी (cid:1)क ह रत (cid:29)े1 जैसे वन (cid:29)े1, कृिष (cid:29)े1 आ(cid:1)द म; कोई पा रणािमक कटौती नहb होगी और अ(cid:15)युNत या अनुQप ादक कृिष (cid:29)े1& म; पुन: वनीकरण करने के (cid:15)यास (cid:1)कए जाएंगे । (2) (cid:15)(cid:15)(cid:15)(cid:15)ााााककककृृृृििििततततकककक जजजजलललल----""""ोोोोतततत -- आचंिलक महायोजना म; सभी (cid:15)ाकृितक oोत& क(cid:30) पहचान क(cid:30) जाएगी और उनके संर(cid:29)ण और पुनन(cid:24)वीकरण के िलए योजना सि(cid:7)म िलत होगी और राcय सरकार "ारा ऐसे (cid:29)े1& पर या उनके िनकट िवकास (cid:1)Lयाकलाप (cid:15)ितिष? करने के िलए ऐसी रीित से माग(cid:24)िनद[श तैयार (cid:1)कए जाएंगे । (3) पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा रि+थितक(cid:30)य संवेदी जोन के भीतर पय(cid:24)टन संबंधी (cid:1)Lयाकलाप, पय(cid:24)टन महायोजना के अनुसार ह&ग,े जो आंचिलक महायोजना का भाग (cid:17)प ह&गे । (ख) पय(cid:24)टन महायोजना पय(cid:24)टन िवभाग, अVणाचल (cid:15)दशे सरकार "ारा राज+ व और वन िवभाग, अVणाचल (cid:15)दशे सरकार के परामश(cid:24) स े तैयार होगी । (ग) पय(cid:24)टन संबंधी (cid:1)Lयाकलाप िन(cid:7) निलिखत के अधीन िविनयिमत ह&गे, अथा(cid:24)त् :- (i) पा रि+थितक(cid:30)य संवेदी जोन के भीतर सभी नए पय(cid:24)टन (cid:1)Lयाकलाप& या िवUमान पय(cid:24)टन (cid:1)Lयाकलाप& का िव+तार राO टृीय Cय ाघ संर(cid:29)ण (cid:15)ािधक र ण पया(cid:24)वरण, वन और जलवायु प रवत(cid:24)न मं1ालय के माग(cid:24)दश(cid:24)क िस?ांत& के "ारा तथा पा रि+थितक(cid:30)य पय(cid:24)टन राO pीय Cय ाD संर(cid:29)ण (cid:15)ािधकरण, "ारा जारी (समय-समय पर यथा संशोिधत) माग(cid:24)दश(cid:24)क के अनुसार, होगा िजसम; (cid:1)कए जा सकते ह 5। 7. पया(cid:24)वरण ( संर(cid:29)ण ) अिधिनयम, 1986 क(cid:30) धारा 19 के अधीन दज(cid:24) क(cid:30) गई िशकायत& का सारांश । 8. कोई अ(cid:21)य महQव पूण(cid:24) िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, 8th December, 2015 S.O. 3331(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jor Bagh Road, Aliganj, New Delhi-110 003, or send it to the e-mail address of the Ministry at:- esz-mef@nic.in Draft Notification WHEREAS, the Namdapha Tiger Reserve covering an area of 1807.82 kilometres has been notified under section 38V of the Wildlife (Protection) Act, 1972 (53 of 1972) vide number CWL/D/21(11)/06-07/3253-3512 dated the 24th December, 2007 for the protection and conservation of tiger, co-predator, prey base and their habitat as inviolate area; AND WHEREAS, the buffer zone of Namdapha Tiger Reserve covering an area of 245 square kilometres and notified under section 38V of the said Wildlife (Protection) Act, 1972 vide number CWL/D/21(67)/2010-11/797-874 dated the 15th June, 2012 along with core area is among the largest contagious block of tropical rain forest in the country and is extremely important in maintaining contiguity within the north-east Indian forest, playing a vital role in maintenance of water and regime of the region and the broad forest types of the area are Tropical Wet Semi Evergreen to Evergreen forest, Sub-Tropical Broad Leaved Forest and Sub-Temperate Broad- Leaved forest; AND WHEREAS, the major tree species are Terminalia myriocarpa, Altingia excelsa, Bambax ceiba, Castanopsis indicam, Mesua ferrea, Phoebe goalparensis. Bamboos as Dendrocalamus hamiltonii, Bambusa pallida, Pseudostrachyum polymorphum and canes as Calamus floribundus, C. flagellum are found to occur in the Tiger Reserve;¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 11 AND WHEREAS, the major mammal species include Elephus maximus, Panther tigris, Panthera pardus, Neofelis nebulosa, Ursus thibetanus, Macaca assamensis, Trachypithecus pileatus, Cervus unicolor, Muntiacus muntjak, Naemorhedus goral, Sus scrofa, Cuon alpines etc; AND WHEREAS, the bird fauna largely comprise of- Babblers, Flycatchers, Jungle fowl, Kingfishers, Laughing thrushs, Nighters, Nuthatchs etc, the herpeto fauna broadly comprise of frogs as- Bufo sp., Duttaphrynus sp., Hyla sp., Megophyrus sp., etc and reptiles as Lizards- Calotes sp., Japalura sp., Hemidactylus sp., Varanus sp. Skinks as- Eutrophis sp., Lygosoma sp., Snakes as –Python sp., Ahaetulla sp., Amphiesma sp., Bungarus sp., Naja sp., Ophiophagus sp., Tortoises as- Cuora sp., Pangshura sp. and the aquatic bodies harbors various fishes as Danio sp., Barilius sp., Semiplotus sp., Puntius sp., Tor spp., Chagunius sp., Garra sp., Noemacheilus sp., Glyptothorax sp. etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the of Namdapha Tiger Reserve as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 1400 metres from the boundary of the Namdapha Tiger Reserve in the State of Arunachal Pradesh as the Namdapha Tiger Reserve Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from zero metres to 1400 meters from the boundary of the Namdapha Tiger Reserve. 2. The extent of Eco-sensitive Zone is zero meters towards north, where Namdapha Tiger Reserve shares boundary with Kamlang Wildlife Sanctuary and zero meters towards east and south sharing Indo-Myanmar international boundary. 3. The area of Eco- sensitive Zone is 4314.30 hectares and the boundary description of such Zone is as follows:- North.- Starting from the point at Geo-Coordinates 96° 23’ 43.867” E and 27° 39’ 2.059” N, the boundary goes Eastwards for about 500 metres upto Champai Bum at the Northwest boundary of Namdapha Tiger Reserve. East.- The boundary of Eco-Sensitive Zone extends all along the Western boundary of Namdapha National Park upto the starting point of Western boundary of the National Park at Geo-Coordinates 96° 27 ‘ 6.703” E and 27° 18’ 5.47” N. South.- The boundary extends towards West for about 382.85 mt upto the point at Geo-Coordinates 96° 26’ 53.691” E and 27° 18’ 3.876” N. (4) The map of the Eco-sensitive Zone along with latitudes and longitudes is appended as Annexure I. (5) The villages falling within the Eco-sensitive Zone are, Buddhista, Anandpur-II, Lama camp and Pakan. 2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) As the buffer zone of the Namdapha Tiger Reserve is part of the Eco-sensitive Zone, the Tiger Conservation Plan relating to the buffer zone shall also be taken into consideration during the preparation of the Zonal Master Plan. (4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; and (viii) Arunachal Pradesh State Pollution Control Board, for integrating environmental and ecological considerations into it. (6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (8) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 27,30, 37 and 42 in column (2) of the Table in paragraph 4, namely:- (i) Small scale industries not causing pollution; (ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities; (iii) Rainwater harvesting; and (iv) Cottage industries including village artisans: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 13 Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas as per buffer zone management plan of the Namdapha Tiger Reserve. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Arunachal Pradesh in consultation with Department of Revenue and Forests, Government of Arunachal Pradesh. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the Namdapha Tiger Reserve except for accommodation for temporary occupation of tourism activities: Provided that beyond the distance of one kilometre from the boundary of the Protected Areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government of Arunachal Pradesh shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government of Arunachal Pradesh shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under.- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment, Forests and Climate Change vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture;14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) the inorganic material shall be disposed of in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment, Forests and Climate Change vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority of the State Government and the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based Industries set up as per the Law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl. (c) No sale of surface water or ground water shall be permitted. (d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 19. (a) No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities. (b) Beyond one kilometre and upto the extent of the Eco-sensitive Zone, all new tourism activities or expansions of existing activities shall be in conformity with the Tourism Master Plan and National Tiger Conservation Authority guidelines. 35. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area: Provided that local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3. (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (c) Beyond one kilometre from the boundary of the protected area upto the extent of Eco - sensitive Zone, construction for bona fide local needs shall be permitted and other construction activities shall be regulated as per Zonal Master Plan. (d) Construction activity in the Eco-sensitive Zone shall be as per the Zonal Master Plan. C. PermittedActivities: 36. Ongoing agriculture and horticulture practices Permitted under applicable laws. by local communities along with dairies, dairy farming and fisheries. 37. Rain water harvesting. Shall be actively promoted. 38. Organic farming. Shall be actively promoted. 39. Adoption of green technology for all activities. Shall be actively promoted. 40. Use of renewable energy sources. Permitted under applicable laws. 41. Vegetative fencing. Permitted under applicable laws. 42. Cottage industries including village artisans, etc. Shall be actively promoted. 43. Rearing of Mithun (Bos frontalis). Permitted under applicable laws. 5. Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- (a) Deputy Commissioner, Changlang District, Government of Arunachal Pradesh – Chairman; (b) One representative of Non-governmental Organizations’ working in the field of environment to be nominated by the Government of Arunachal Pradesh for a term of one year – Member; (c) Member Secretary, Arunachal Pradesh State Pollution Control Board, Itanagar -Member; (d) Executive Engineer, PHE Department, Changlang District - Member; (e) Executive Engineer, Rural Works Department, Changlang District - Member; (f) District Agriculture Officer, Changlang District - Member; (g) Deputy Director, Urban Development, Changlang District - Member;¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 17 (h) One expert in the area of ecology and environment to be nominated by the Government of Arunachal Pradesh - Member; (i) Land records and Settlement Officer, Changlang District - Member; and (j) Conservator of Forest and Field Director, Namdpha Tiger Reserve, Miao – Member Secretary. 6. Terms of Reference: (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at Annexure II. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
