रा^य िव भाग& के साथ परामश(cid:24) से पया(cid:24)वरणीय और पा रि+थितक(cid:30)य िवचारण& को उसम; एक(cid:30)कृत करने के िलए तैयार क(cid:30) जाएगी, अथा(cid:24)त्:-- (i) पया(cid:24)वरण ; (ii) वन ; (iii) नगर िवकास ; (iv) पय(cid:24)टन ; (v) नगरपािलक ; (vi) राज+ व ; (vii) कृिष ; (viii) िहमाचल (cid:15)दशे रा^य (cid:15)दषू ण िनयं1ण बोड,(cid:24) (ix) cसचाई; और (x) लोक िनमा(cid:24)ण िवभाग¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (5) आंचिलक महायोजना अनुमो(cid:1)दत िव[मान भू-उपयोग, अवसंरचनाd मक और (cid:1)eयाकलाप& पर कोई िनबfधन अिधरोिपत नहg करेगी जब तक (cid:1)क इस अिधसूचना म; इस (cid:15)कार िविन@द= न हो और आंचिलक महायोजना सभी अवसंरचना और काय(cid:24)कलाप& म; द(cid:29)ता और पा र ि+थ ि तक(cid:30)य अनुकूलता का संव?न(cid:24) करेगी । (6) आंचिलक महायोजना म; अनाhछा(cid:1)दत (cid:29)े1& के जीण\?ार, िव[मान जल िनकाय& के संर(cid:29)ण, आवाह (cid:29)े1& के (cid:15)बंधन, जल- संभर& के (cid:15)बंधन, भूतल जल के (cid:15)बंधन, मृदा और नमी संर(cid:29)ण, +थानीय समुदाय& क(cid:30) आव8यकताj तथा पा रि+थितक(cid:30) और पया(cid:24)वरण से संबंिधत ऐसे अ(cid:21)य पहलूj, िजन पर kयान दने ा आव8यक ह,ै के िलए उपबंध ह&गे । (7) आंचिलक महायोजना सभी िव[मान पूजा + थल&, ‘ाम& और नगरीय बंदोब+त&, वन& के (cid:15)कार और (cid:1)क+ म&, कृिष (cid:29)े1&, ऊपजाऊ भिू म, ह रत (cid:29)े1 जैसे उ[ान और उसी (cid:15)कार के + थान, उ[ान कृिष (cid:29)े1, आ@कड&, झील& और अ(cid:21)य जल िनकाय& का अlयकंन करेगी । (8) आंचिलक महायोजना पा रि+थितक संवेदी जोन म; िवकास को िविनयिमत करेगी िजससे (cid:1)क + थानीय समुदाय& के पा रि+थितक(cid:30)ज(cid:21)य िवकास और जीिवका को सुिनि8 चत (cid:1)कया जा सके । (9) िहमाचल (cid:15)दशे रा^य सरकार अपनी अिधका रता के भीतर अलग से आंचिलक महायोजना तैयार करेगी | 3. रररराााा(cid:24)(cid:24)(cid:24)(cid:24)यययय ससससररररककककाााारररर (cid:25)(cid:25)(cid:25)(cid:25)ाााारररराााा (cid:26)(cid:26)(cid:26)(cid:26)ककककएएएए जजजजाााानननन ेे ेेववववााााललललेे ेे उउउउपपपपाााायययय-------- रा^य सरकार इस अिधसूचना के उपबंध& को (cid:15)भावी करने के िलए िन(cid:12)िलिखत उपाय करेगी, अथा(cid:24)त् :- (1) भभभभ--ूू--ूूउउउउपपपपययययोोोोगगगग ---- पा रि+थ ितक संवेदी जोन म; वन&, उ[ान-कृिष (cid:29)1े &, कृिष (cid:29)े1& आमोद-(cid:15)मोद के (cid:15)योजन के िलए िचि(cid:21)हत (cid:1)कए गए पाकm और खुले +थान& का वािणि^यक और औ[ोिगक संब? िवकास (cid:1)eयाकलाप& के िलए उपयोग या संप रवत(cid:24)न नहg होगा : परंतु पा रि+थितक संवेदी जोन के भीतर कृिष भूिम का संप रवत(cid:24)न के अधीन मानीटरी सिमित क(cid:30) िसफा रश पर और रा^य सरकार के पूव(cid:24) अनुमोदन से, +थानीय िनवािसय& क(cid:30) आवासीय ज(cid:17)रत& को पूरा करने के िलए और पैरा 4 क(cid:30) सारणी के +तंभ (2) के अधीन मद सं. 12, 23, 37, 38 और 39 के सामने सूचीब? (cid:1)eयाकलाप& को पूरा करने के िलए अनुnात ह&गे, अथा(cid:24)त् :- (i) पा रि+थितक(cid:30)य अनुकूल पय(cid:24)टन (cid:1)eयाकलाप& के िलए पय(cid:24)टक& के अ+थायी आवासन के िलए पा रि+थितक(cid:30)य अनुकूल आरामगाह जैसे ट;ट, लकड़ी के मकान आ(cid:1)द ; (iiii) िव[मान सड़क& को चौड़ा करना और नई सड़क& का सिoमा(cid:24)ण; (iii) कुटीर उ[ोग, िजसके अंतग(cid:24)त ‘ामीण उ[ोग, सुिवधा भंडार और +थानीय सुिवधाएं ह;5 (iv) वषा(cid:24) जल संचय; और (v) (cid:15)दषू ण उdपo न करने वाले लघु उ[ोग | परंतु यह और (cid:1)क रा^य सरकार के पूव(cid:24) अनुमोदन और संिव धान के अनुh छेद 244 तथा तdसमय (cid:15)वृ# िविध के उपबंध& के अनुपालन के िबना, िजसके अंतग(cid:24)त अनुसूिचत जनजाित और अ(cid:21)य परंपरागत वन िनवासी (वन अिधकार& क(cid:30) मा(cid:21)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि^यक या उ[ोग िवकास (cid:1)eयाकलाप& के िलए जनजातीय भूिम का उपयोग अनुnात नहg होगा : परंतु यह और भी (cid:1)क पा रि+थ ितक संवेदी जोन के भीतर भू-अिभलेख& म; उपसंजात कोई 1ु ट मानीटरी सिमित के िवचार (cid:15)ा7 करने के पNात ् रा^य सरकार "ारा (cid:15)dयेक मामले म; एक बार संशोिधत होगी और उ% 1ु ट के संशोधन क(cid:30) भारत सरकार के पया(cid:24)वरण, वन और जलवायु प रवत(cid:24)न मं1ालय को सूचना दने ी होगी । परंतु यह और भी (cid:1)क उपयु(cid:24)% 1ु ट का संशोधन म; इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म; भू-उपयोग का प रवत(cid:24)न सि(cid:7)मिलत नहg होगा । परंतु यह और भी (cid:1)क िजससे ह रत (cid:29)े1 म; जैसे वन (cid:29)े1, कृिष (cid:29)े1 आ(cid:1)द म; कोई पा रणािमक कटौती नहg होगी और अन(cid:15)युQ त या अनुdपादक कृिष (cid:29)े1& म; पुन: वनीकरण करने के (cid:15)यास (cid:1)कए जाएंगे ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) (cid:15)(cid:15)(cid:15)(cid:15)ााााककककृृृृििििततततकककक (cid:30)(cid:30)(cid:30)(cid:30)ोोोोतततत –––– सभी (cid:15)ाकृितक pोत& के आवाह (cid:29)े1 क(cid:30) पहचान क(cid:30) जाएगी और उनके संर(cid:29)ण और पुनन(cid:24)वीकरण के िलए योजनाj को आंचिलक महायोजना म; सि(cid:7)मिलत (cid:1)कया जाएगा तथा रा^य सरकार "ारा ऐसे रीित म; माग(cid:24)दश(cid:24)क िस?ांत तैयार (cid:1)कए जाएंगे िजससे (cid:1)क इन (cid:29)े1& म; या इनके समीप िवकास (cid:1)eयाकलाप को रोका जा सके जो ऐसे (cid:29)े1& के िलए हािनकारक ह5 । (3) पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा रि+थितक संवेदी जोन के भीतर पय(cid:24)टन संबंधी (cid:1)eयाकलाप, जो आंचिलक महायोजना का भाग (cid:17)प म; िन(cid:12)िलिखत (cid:17)प म; ह&गे । (ख) पय(cid:24)टन महायोजना, पय(cid:24)टन िवभाग "ारा वन और पया(cid:24)वरण िवभाग, रा^य सरकार के परामश(cid:24) से तैयार होगी । (ग) पय(cid:24)टन संबंधी (cid:1)eयाकलाप िन(cid:7) निलिखत के अधीन िविनयिमत ह&गे, अथा(cid:24)त् :- (i) पा रि+थितक संवेदी जोन के भीतर सभी नए पय(cid:24)टन (cid:1)eयाकलाप& या िव[मान पय(cid:24)टन (cid:1)eयाकलाप& का िव+तार भारत सरकार के पया(cid:24)वरण, वन और जलवायु प रवत(cid:24)न मं1ालय के माग(cid:24)दश(cid:24)क िस?ांत& के "ारा तथा पा रि+थितक पय(cid:24)टन राP Mीय qय ाr संर(cid:29)ण (cid:15)ािधकरण, "ारा जारी (समय-समय पर यथा संशोिधत) माग(cid:24)दश(cid:24)क िस?ांत& के अनुसार, पा रि+थितक पय(cid:24)टन, पा रि+थितक िश(cid:29)ा और पा रि+थितक िवकास को महdव दते े )ए पा रि+थितक संवेदी जोन क(cid:30) वहन (cid:29)मता के अkययन पर आधा रत होगा; (ii) पा रि+थितक(cid:30)य अनुकूल पय(cid:24)टक (cid:1)eयाकलाप& के संबंध म; अ+ थायी अिधभोग के िलए वास सुिवधा के िसवाय मज़थाल व(cid:21)यजीव अlयारCय क(cid:30) सीमा से एक (cid:1)कलोमीटर भीतर होटल और रसोटm का नया संिनमा(cid:24)ण अनुnात नहg होगा; परंतु संरि(cid:29)त (cid:29)े1& क(cid:30) सीमा से एक (cid:1)कलोमीटर क(cid:30) दरू ी से परे पा रि+थितक(cid:30)य संवेदी जोन क(cid:30) सीमा तक नए होटल और रसाट(cid:24) के +थापन पय(cid:24)टन महायोजना के अनुसार पा रि+थितक(cid:30)य पय(cid:24)टन सुिवधा के िलए पूव(cid:24) प रभािषत और िविन@द= +थान म; ही अनुnात (cid:1)कया जाएगा । (iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जाने तक, पय(cid:24)टन के िलए िवकास और िव[मान पय(cid:24)टन (cid:1)eयाकलाप& के िव+तार को वा+तिवक +थल िविन@द= संवी(cid:29)ा तथा मानीटरी सिमित क(cid:30) िसफा रश पर आधा रत संबंिधत िविनयामक (cid:15)ािधका रय& "ारा अनुnात (cid:1)कया होगा । (4) ननननैसैसैसैस""""गगगगकककक ििििववववररररााााससससतततत -------- पा रि+थितक संवेदी जोन म; महdवपूण(cid:24) नैस<गक िवरासत के सभी +थल& जैसे सभी जीन कोश आरि(cid:29)त (cid:29)े1, शैल िवरचनाएं, जल (cid:15)पात&, झरन&, घाटी मागm, उपवन&, गफु ाएं, +थल&, sमण, अtरोहण, (cid:15)पात& आ(cid:1)द क(cid:30) पहचान क(cid:30) जाएगी और उ(cid:21)ह; संरि(cid:29)त (cid:1)कया जाएगा तथा उनक(cid:30) सुर(cid:29)ा और संर(cid:29)ा के िलए इस अिधसूचना के (cid:15)काशन क(cid:30) तारीख से छह मास के भीतर, उपयु% योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) ममममााााननननवववव ििििनननन""""ममममतततत ििििववववररररााााससससतततत (cid:18)(cid:18)(cid:18)(cid:18)थथ थ थ लललल ---- पा रि+ थितक संवेदी जोन म; Draft Notification WHEREAS, the Majathal Wildlife Sanctuary located in Solan District, Himachal Pradesh and lying between Latitude 31°15’ N to 31°18’ N and Longitude 76°57’ E to 77°02’ E is spread over an area of 37.71 Square kilometre. AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary. The key species are Cheer, Leopard, sambar, Ghoral, barking deer, Black Bear. The area has rich flora and fauna. Deodar is the dominant species of Harsang Baghal and DPF Majathal. Other species includes Ban-oak, Kail, Chir, Kainth, Acacia catechu, Kachnar, Daroo, Paja, Shisham, Sanan, Jamun, Tor, Fegra, Amaltas, Trimble, Mango and Bihul etc. The Majhathal Wildlife Sanctuary (WLS) is bordering south bank of river Sutlej partly falling in Solan and partly in Shimla District of Himachal Pradesh in Western Himalayan region within 575m to 1985m above msl. The area has subtropical Monsoon climate. Himalayan Chir pine (Pinus Roxburghii), Ban Oak, (Quercus leucotrichophora) forest and sub tropical Euphorbia scrub are the major vegetation types (Champion and Seth 1968). Major habitat in the sanctuary comprises steep south eastern slopes covered with large patches of tall grass sparsely forested with scattered Chil, Ban Oak and mixed broadleaved forests in ravines and low lying areas. AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the boundary of the protected area of Majathal Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries or and their operations and processes in the said Eco-sensitive Zone ; NOW THEREFORE, in exercise of the power conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent up to 1.5 kilo metre around the boundary of Majathal Wildlife Sanctuary in the State of Himachal Pradesh as the Majathal Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone .- (1) The Eco-Sensitive Zone shall be of 12.68 Square kilometre with an extent upto 1.5 km around the boundary of Majathal Wildlife Sanctuary. The list of villages falling in Eco-sensitive Zone are given at Annexure-I.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II. 2. Zonal Master Plan for the Eco-sensitive Zone .- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the Competent Authority in the State Government. (3) The said Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The said Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment, (ii) Forest, (iii) Urban Development, (iv) Tourism, (v) Municipal, (vi) Revenue, (vii) Agriculture (ix) Himachal Pradesh State Pollution Control Board, (x) Irrigation (xi) Public Works Department For integrating environment and ecological consideration into it. (6) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (7) The said plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (8) The said Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (9) The said Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government .- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use .- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 23, 37, 38 and 39 in column (2) of the Table in paragraph 4, namely:- (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities, (ii) Widening and strengthening of existing roads and construction of new roads. (iii) Small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 13 the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Majathal Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities: Provided that, beyond the distance of one kilometer from the boundary of the Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in designated areas for Eco- tourism facilities as per Tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Himachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (7) Air pollution.- The Environment Department of the State Government or Himachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) Discharge of effluents .- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under. (9) Solid wastes .- Disposal of solid wastes shall be as under:- (a) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908(E), dated the 25th September, 2000 as amended from time to time; (b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (c) the biodegradable material shall be recycled preferably through composting or vermiculture; (d) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste .- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic .- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under. (12) Industrial Units .- (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco- sensitive zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone .- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE Sl. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 3. Use or production of any hazardous Prohibited (except as otherwise provided) as per applicable substances. laws. 4. However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan 13. Construction activities a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any. Further, beyond one kilometer upto the extent of Eco- Sensitive Zone construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per Zonal Master Plan. 14. Trenching ground Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws. 15. Discharge of treated effluents and solid Regulated under applicable laws. waste in natural water bodies or land area. 16. Air and Vehicular Pollution Regulated under applicable laws. 17. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise the following member, namely:- i) Deputy Commissioner, Solan - Chairman ii) An expert in the area of ecology and environment - Member to be nominated by the Government of Himachal Pradesh for a term of one year in each case. iii) One representatives of Non-governmental Organization - Member (working in the field of environment including heritage conservation) to be nominated by the Government of India for a term of one year in each case.¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 17 iv) Executive Engineer, Himachal Pradesh Pollution Control Board - Member v) Senior Town Planner - Member vi) Deputy Conservator of Forest (Widlife), Shimla - Member vii) Divisional Forest Officer (Territorial), Kunihar - Member-Secretary (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the MC based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 butare falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the MC based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Central Government in the Ministry of Environment, Forests and Climate Change as per pro forma given in Annexure III. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this Notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal (NGT). [F.
