1986 (1986 का 29) क(cid:27) धारा 3 क(cid:27) उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ारा (cid:11)द! शि#य$
का (cid:11)योग करते ’ए, राज)थान राCय म9 केशरबाग व(cid:17)यजीव अभयारBय (cid:1)क सीमा से 4.87 (cid:1)कलोमीटर तक के िव)तार तक के (cid:26)े/ को
पा(cid:30)रि)थितक(cid:27) संवेदी जोन के Yप म9 (िजसे इसम9 इसके पX चात् पा(cid:30)रि)थितक संवेदी जोन कहा गया ह)ै अिधसूिचत करती ह,ै िजसका
िववरण िन(cid:8)ानुसार ह,ै अथा(cid:20)त् :-

(2) पा(cid:30)रि)थितक संवेदी जोन का मानिच/ अ(cid:26)ांश और दशे ांतर के साथ उउउउपपपपााााबबबबंधंधंधंध IIIIIIII के (cid:13)प म9 उपाब> है ।
(3) पा(cid:30)रि)थितक संवेदी जोन का (cid:26)े/फल राज)थान के िजला धौलपुर म9 पड़ने वाले 22 [ाम$ तक फैला ’आ ह ै।
(4) पा(cid:30)रि)थितक संवेदी जोन के अंतग(cid:20)त आने वाले [ाम$ क(cid:27) सूची मु\य िब(cid:17)द]ु के िनद^शांक$ के साथ उउउउपपपपााााबबबबधधंंधधंं IIIIIIIIIIII के Yप म9 उपाब> ह ै।

अिधसूचना के (cid:11)काशन क(cid:27) तारीख से दो वष(cid:20) क(cid:27) अविध के भीतर, )थानीय 8ि#य$ के परामश(cid:20) से और इस अिधसूचना म9 संलQ न अनुबंध$
के सामंज)य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना राCय सरकार म9 स(cid:26)म (cid:11)ािधकारी ारा अनुमो(cid:1)दत होगी ।
(3) राCय सरकार ारा पा(cid:30)रि)थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म9 िविन?दI ट (cid:13)प तथा
सुसंगत क9(cid:18)ीय और राCय िविधय$ के सामंज)य और क9(cid:18)ीय सरकार ारा जारी माग(cid:20)िनदश^ $, य(cid:1)द कोई ह$, ारा तैयार होगी ।
(4) आंचिलक महायोजना, पया(cid:20)वरणीय और पा(cid:30)रि)थितक िवचार$ को समाकिलत करने के िलए राC य सरकार के सभी संब>
िवभाग$ के परामश(cid:20) से तैयार होगी, अथा(cid:20)त्:--
(i) पया(cid:20)वरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पय(cid:20)टन ;
(v) नगरपािलका ;
(vi) राज) व ;
(vii) कृिष ;
(viii) राCय (cid:11)दषू ण िनयं/ण बोड (cid:20);
(ix) _सचाई ; और
(x) लोक िनमा(cid:20)ण िवभाग,
इसम9 पया(cid:20)वरणीय और पा(cid:30)रि)थितक िवचार$ को समाकिलत करने के िलए ह$गे।
(5) आंचिलक महायोजना अनुमो(cid:1)दत िवUमान भू-उपयोग, अवसंरचना और (cid:1)‘याकलाप$ पर कोई िनबaधन अिधरोिपत नहb करेगी
जब तक (cid:1)क इस अिधसूचना म9 िविन?दIट न हो और आचंिलक महायोजना सभी अवसंरचना और (cid:1)‘याकलाप$ म9 और अिधक द(cid:26)ता और
पा(cid:30)रि)थितक अनुकूलता का संवध(cid:20)न करेगी ।
(6) आंचिलक महायोजना म9 अनाcछा(cid:1)दत (cid:26)े/$ के जीणV>ार, िवUमान जल िनकाय$ के संर(cid:26)ण, आवाह (cid:26)/े $ के (cid:11)बंधन, जल-संभर$
के (cid:11)बंधन, भूतल जल के (cid:11)बंधन, मृदा और नमी संर(cid:26)ण, )थानीय समुदाय$ क(cid:27) आवXयकता] तथा पा(cid:30)रि)थितक और पया(cid:20)वरण से संबंिधत

(7) आंचिलक महायोजना सभी िवUमान एवं (cid:11))तािवत पूजा ) थल$, [ाम$ और नगरीय बंदोब)त$, वन$ के (cid:11)कार और (cid:1)क) म$, कृिष
(cid:26)े/$, ऊपजाऊ भूिम, ह(cid:30)रत (cid:26)े/ जैसे उUान और उसी (cid:11)कार के ) थान, उUान कृिष (cid:26)े/, फलोधान, झील$ और अ(cid:17)य जल िनकाय$ का
अgयकंन करेगी ।
(8) आंचिलक महायोजना )थ ानीय समुदाय$ क(cid:27) जीवकोपाज(cid:20)न को सुिनिX चत करने के िलए, पा(cid:30)रि)थितक संवेदी जोन म9 िवकास को
पा(cid:30)रि)थक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. रररराााा(cid:24)(cid:24)(cid:24)(cid:24)यययय ससससररररककककाााारररर (cid:25)(cid:25)(cid:25)(cid:25)ाााारररराााा (cid:26)(cid:26)(cid:26)(cid:26)ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेे ेे उउउउपपपपाााायययय-------- राCय सरकार इस अिधसूचना के उपबंध$ को (cid:11)भावी करने के िलए िन(cid:8)िलिखत उपाय
करेगी, अथा(cid:20)त् :--
(1) भभभभ--ूू--ूूउउउउपपपपययययोोोोगगगग ---- पा(cid:30)रि)थितक संवेदी जोन म9 वन$, उUान-कृिष (cid:26)े/$, कृिष (cid:26)े/$, आमोद-(cid:11)मोद के (cid:11)योजन के िलए िचि(cid:17)हत (cid:1)कए गए
पाकh और खुले )थान$ का वािणिCयक और औUोिगक संब> िवकास (cid:1)‘याकलाप$ के िलए उपयोग या संप(cid:30)रवत(cid:20)न नहb होगा :
परंतु पा(cid:30)रि)थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:30)रवत(cid:20)न मानीटरी सिमित क(cid:27) िसफा(cid:30)रश पर और राCय सरकार के पूव (cid:20)
अनुमोदन से, )थानीय िनवािसय$ क(cid:27) आवासीय ज(cid:13)रत$ को पूरा करने के िलए और पैरा 4 क(cid:27) सारणी के )तंभ (2) के अधीन ‘म सं0 10,
16, 22, 28 और 31 के सामने सूचीब> (cid:1)‘याकलाप$ को पूरा करने के िलए अनुiात ह$गे, अथा(cid:20)त् :-
(i) पा(cid:30)रि)थितक अनुकूल पय(cid:20)टन (cid:1)‘याकलाप$ से संबंिधत पय(cid:20)टक$ के अ)थायी अिधभोग के िलए पा(cid:30)रि)थितक अनुकूल कुटीर जैसे ट3ट,
लकड़ी के मकान आ(cid:1)द;
(ii) िवUमान सड़क$ को चौड़ा करना और उ(cid:17)हे सुदढ़ृ करना;
(iii (cid:11)दषू ण उJपk न करने वाले लघु उUोग;
(iv) वषा(cid:20) जल संचयन; और
(v) कुटीर उUोग$ म9 [ामीण कारीगर भंडारण क(cid:27) सुिवधा और )थानीय सुख-सुिवधाएं सिlमिलत ह:3
परंतु यह और (cid:1)क जनजातीय भूिम का उपयोग राCय सरकार के पूव(cid:20) अनुमोदन और संिवधान के अनुc छेद 244 या तJसमय (cid:11)वृ!
िविध के उपबंध$ के अनुपालन के िबना, िजसके अंतग(cid:20)त अनुसूिचत जनजाित और अ(cid:17)य परंपरागत वन िनवासी (वन अिधकार$ क(cid:27) मा(cid:17)यता)
अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिCयक या उUोग िवकास (cid:1)‘याकलाप$ के िलए अनुiात नहb होगा :
परंतु यह और भी (cid:1)क पा(cid:30)रि)थितक संवेदी जोन के भीतर भू-अिभलेख$ म9 उपसंजात कोई /ु(cid:30)ट, मानीटरी सिमित के िवचार (cid:11)ा5
करने के प6ात् राCय सरकार ारा (cid:11)Jयेक मामले म9 एक बार संशोिधत होगी और उ# /ु(cid:30)ट के संशोधन क(cid:27) सूचना भारत सरकार के
पया(cid:20)वरण, वन और जलवायु प(cid:30)रवत(cid:20)न मं/ालय को दने ी होगी ।
परंतु यह और भी (cid:1)क उपयु(cid:20)# /ु(cid:30)ट का संशोधन म9 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म9 भू-उपयोग
का प(cid:30)रवत(cid:20)न सिlमिलत नहb होगा ।
परंतु यह और भी (cid:1)क िजससे ह(cid:30)रत (cid:26)े/ म9 जैसे वन (cid:26)े/, कृिष (cid:26)े/ आ(cid:1)द म9 कोई पा(cid:30)रणािमक कटौती नहb होगी और अन(cid:11)युm त
या अनउJप ादक कृिष (cid:26)े/$ म9 पुन: वनीकरण करने के (cid:11)यास (cid:1)कए जाएंगे ।
(2) (cid:15)(cid:15)(cid:15)(cid:15)ााााककककृृृृििििततततकककक जजजजलललल (cid:31)(cid:31)(cid:31)(cid:31)ोोोोतततत!!!! -- आचंिलक महायोजना म9 सभी (cid:11)ाकृितक जल nोत$ क(cid:27) पहचान क(cid:27) जाएगी और उनके संर(cid:26)ण और
पुनYoभूतकरण के िलए योजना सिlम िलत होगी और राC य सरकार ारा ऐसे (cid:26)े/$ पर या उनके िनकट िवकास (cid:1)‘याकलाप (cid:11)ितिष> करने
के िलए ऐसी रीित से माग(cid:20)िनदश^ तैयार (cid:1)कए जाएंगे ।
(3) पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा(cid:30)रि)थितक संवेदी जोन के भीतर पय(cid:20)टन संबंधी (cid:1)‘याकलाप पय(cid:20)टन महायोजना के अनुसार ह$गे जो (cid:1)क आंचिलक
महायोजना के भाग (cid:13)प म9 होगी ।
(ख) पय(cid:20)टन महायोजना पय(cid:20)टन िवभाग, राज)थान सरकार ारा राज) व और वन िवभाग के परामश(cid:20) से तैयार होगी ।
(ग) पय(cid:20)टन संबंधी (cid:1)‘याकलाप िनl निलिखत के अधीन िविनयिमत ह$गे, अथा(cid:20)त् :-
(i) पा(cid:30)रि)थितक संवेदी जोन के भीतर सभी नए पय(cid:20)टन (cid:1)‘याकलाप$ या िवUमान पय(cid:20)टन (cid:1)‘याकलाप$ का िव)तार के(cid:17)(cid:18)ीय
सरकार के पया(cid:20)वरण, वन और जलवायु प(cid:30)रवत(cid:20)न मं/ालय के माग(cid:20)दश(cid:20)क िस>ांत$ के ारा तथा राI pीय q याr संर(cid:26)ण (cid:11)ािधकरण, ारा
जारी पा(cid:30)रि)थितक पय(cid:20)टन (समय-समय पर यथा संशोिधत) माग(cid:20)दश(cid:20)क िस>ांत$ के अनुसार, पा(cid:30)रि)थितक पय(cid:20)टन, पा(cid:30)रि)थितक िश(cid:26)ा और
पा(cid:30)रि)थितक िवकास को महJव दते े ’ए पा(cid:30)रि)थितक संवेदी जोन क(cid:27) वहन (cid:26)मता के अeययन पर आधा(cid:30)रत होगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) पा(cid:30)रि)थितक अनुकूल पय(cid:20)टक (cid:1)‘याकलाप$ के संबंध म9 अ) थायी अिधभोग के िलए वास सुिवधा के िसवाय केशरबाग व(cid:17)यजीव
अभयारBय क(cid:27) सीमा से एक (cid:1)कलोमीटर भीतर होटल और (cid:30)रसोटh का नया संिनमा(cid:20)ण अनुiात नहb होगा;
परंतु संरि(cid:26)त (cid:26)े/$ क(cid:27) सीमा से एक (cid:1)कलोमीटर क(cid:27) दरू ी से परे पा(cid:30)रि)थितक संवेदी जोन क(cid:27) सीमा तक नए होटल और (cid:30)रसाट(cid:20) के
)थापन पय(cid:20)टन महायोजना के अनुसार पा(cid:30)रि)थितक पय(cid:20)टन सुिवधा के िलए पूव(cid:20) प(cid:30)रभािषत और िविन?द; )थान म9 ही अनुiात (cid:1)कया
जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जाने तक, पय(cid:20)टन के िलए िवकास और िवUमान पय(cid:20)टन (cid:1)‘याकलाप$ के िव)तार
को वा)तिवक )थल िविन?द; संवी(cid:26)ा तथा मानीटरी सिमित क(cid:27) िसफा(cid:30)रश पर आधा(cid:30)रत संबंिधत िविनयामक (cid:11)ािधकरण$ ारा
अनुiात (cid:1)कया होगा ।
(4) ननननैसैसैसैस$$$$गगगगकककक ििििववववररररााााससससतततत -------- पा(cid:30)रि)थितक संवेदी जोन म9 महJवपूण(cid:20) नैस:गक िवरासत के सभी )थल$ जैसे सभी जीन कोश आरि(cid:26)त (cid:26)े/, शैल
िवरचनाएं, जल (cid:11)पात$, झरन$, घाटी मागh, उपवन$, गुफाए,ं )थल$, sमण, अtरोहण, (cid:11)पातो आ(cid:1)द क(cid:27) पहचान क(cid:27) जाएगी और उ(cid:17)ह 9
संरि(cid:26)त (cid:1)कया जाएगा तथा उनक(cid:27) सुर(cid:26)ा और संर(cid:26)ा के िलए अंितम अिधसूचना के (cid:11)काशन क(cid:27) तारीख से छह मास के भीतर, उपयु#
योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) ममममााााननननवववव ििििनननन$$$$ममममतततत ििििववववररररााााससससतततत (cid:18)(cid:18)(cid:18)(cid:18)थथ थथ लललल ---- पा(cid:30)रि)थ ितक संवेदी जोन म9 भवन$, संरचना], िश(cid:3)प-तuय, ऐितहािसक, कलाJमक और सां)कृितक
महJव के (cid:26)े/$ क(cid:27) पहचान करनी होगी और अंितम अिधसूचना के (cid:11)काशन क(cid:27) तारीख से छह माह के भीतर उनके संर(cid:26)ण क(cid:27) योजनाएं
तैयार करनी होगी तथा आंचिलक महायोजना म9 सिlमिलत क(cid:27) जाएगी ।
(6) &&&&वव व व ििििनननन (cid:15)(cid:15)(cid:15)(cid:15)ददददषषषषूूूू णणणण -- पा(cid:30)रि)थितक संवेदी जोन म9 e विन (cid:11)दषू ण के िनयं/ण के िलए राC य सरकार का पया(cid:20)वरण िवभाग, वायु ((cid:11)दषू ण
िनवारण और िनयं/ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम$ के उपबंध$ के अनुसरण म9 माग(cid:20)दश(cid:20)क
िस>ांत और िविनयम तैयार करेगा ।
(7) ववववाााायययय ुु ुु (cid:15)(cid:15)(cid:15)(cid:15)ददददषषषषूूूू णणणण -- पा(cid:30)रि)थितक संवेदी जोन म9, वायु (cid:11)दषू ण के िनयं/ण के िलए राCय सरकार का पया(cid:20)वरण िवभाग, वायु ((cid:11)दषू ण
िनवारण और िनयं/ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम$ के उपबंध$ के अनुसरण म9 माग(cid:20)दश(cid:20)क
िस>ांत और िविनयम तैयार करेगा ।

(12) वृ(cid:26)$ क(cid:27) कटाई । (क) राCय सरकार म9 स(cid:26)म (cid:11)ािधकारी क(cid:27) पूव(cid:20) अनुमित के िबना वन,
सरकारी या राज)व या िनजी भूिम पर या वन$ म9 (cid:1)क(cid:17)ही वृ(cid:26)$ क(cid:27) कटाई

NOTIFICATION
New Delhi, the 13th January, 2016
S.O.138(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified
to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Draft Notification
WHEREAS, Kesarbagh Wildlife Sanctuary is located in Dholpur District of Rajasthan and the sanctuary is spread across
an area of 14.76 square kilometer;
AND WHEREAS, the sanctuary has dry deciduous thorny forest and the important tree species include Anogeissus
pendula, Balanites aegyptica, Butea monosperma, Acacia catechu, A. leucophloea etc. and the important faunal species
found in the sanctuary include sloth bear, hyena, jackal. jungle cat, and wild boar;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in
paragraph 1 of this notification around the protected area of Kesarbagh Wildlife Sanctuary as Eco- sensitive Zone from¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 13
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2)
and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of
the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent of up to 4.87
kilometers from the boundary of Kesarbagh Wildlife Sanctuary in the State of Rajasthan as the Kesarbagh Wildlife
Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 22.39 square
kilometers and has an extent up to 4.87 kilometers from the boundary of Kesarbagh Wildlife Sanctuary and the
description of boundary of the such zone is appended as Annexure I.
(2) The map of the Eco-sensitive Zone along with latitude and longitude is appended as Annexure II.
(3) The Eco-sensitive Zone is spread across 22 villages falling in Dholpur District of Rajasthan.
(4) The list of villages falling within the Eco-sensitive Zone along with co-ordinates of prominent points is appended as
Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as
is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued
by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The said plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing and proposed worshipping places, village and urban
settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like
places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development
for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 10, 16, 22, 28 and 31 in column (2)
of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-
friendly tourism activities;
(ii) widening and strengthening of existing roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the
State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to
such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master
Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with Department of
Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time)
with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-
sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Kesarbagh Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly
tourism activities:
Provided that beyond the distance of one kilometer from the boundary of the protected areas till the extent of the
Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated
areas for eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of final notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic
and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared
within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations
for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide number S.O. 908 (E), dated the 25th September 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide number S.O. 630(E), dated the 20th July, 1998 as amended from
time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is
prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall
be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

However, beyond one kilometer and upto the extent of
the Eco-sensitive Zone all new tourism activities or
expansions of existing activities would be in conformity
with Tourism Master Plan and National Tiger Conservation
Authority guidelines.
11. Construction activities. (a) No new commercial construction of any kind shall be
permitted within one kilometer from the boundary of the
protected area:
Provided that local people shall be permitted to

including the activities listed in sub-paragraph (1) of
paragraph 3.
(b) The construction activity related to small scale
industries not causing pollution shall be permitted as per
applicable rules and regulations, if any, with the prior
permission from the competent authority.
(c) Beyond one kilometer upto the extent of the Eco-
sensitive Zone construction of bona fide local needs shall
be permitted and other commercial construction activities
shall be regulated as per Zonal Master Plan.
(d) construction activity in the Eco-sensitive Zone shall be
as per Zonal Master Plan.
12. Felling of trees. (a) There shall be no felling of trees on the forest or
Government or revenue or private lands without prior
permission of the competent authority in the State

5. Monitoring Committee:- (1) The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone falling in the State of Rajasthan, which shall comprise of the following namely:-
(a) District Collector, Dholpur - Chairman;
(b) Divisional Forest Officer, Dholpur – Member ;
(c) one representative of Non Governmental Organisation working in the
field of environment to be nominated by the Government of Rajasthan for
a term of one year in each case – Member ;
(d) one expert in the area of ecology and environment from a reputed institution
or university of the State to be nominated by the Government of Rajasthan for a
term of one year in each case – Member;
(e-l) District level officers of the departments of:-
(e) Public Works Department (f) Irrigation (g) Tourism (h) Mining (i) Police,
(j) Municipal council, (k) Industry, (l) UIT -Members;
(m) Regional Officer of the State Pollution Control Board -Members;
(n) Sub Divisional Officer, Dholpur - Member;
(o) Honorary Wildlife Warden, Dholpur – Member;
(p) Deputy Conservator of Forests (Bharatpur) -Member-Secretary.
6. Terms of reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this
notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per proforma appended at
Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
