उपधारा (3) (cid:30)ारा (cid:11)द(cid:31) शि!य" का (cid:11)योग करत े%ए, केरल राBय म7 शेन(cid:18)णु ी व(cid:17)यजीव अभयारAय क(cid:27) सीमा के चार" ओर 20
मीटर से 750 मीटर तक के िव’तार वाल े(cid:26)े- को शेन(cid:18)णु ी व(cid:17)यजीव अभयारAय पा(cid:28)रि’थितक(cid:27) संवेदी जोन (िजस े इसम7 इसके
प]च ात् पा(cid:28)रि’थितक संवेदी जोन कहा गया ह)ै के (cid:13)प म 7अिधसूिचत करती ह,ै िजसका िववरण िन(cid:8)ानुसार ह,ै अथा(cid:20)त ्:--

(3) पा(cid:28)रि’थितक संवेदी जोन म 7िनिहत वन" सिहत तीन Oाम आत ेह1 ।
(4) पा(cid:28)रि’थितक संवेदी जोन के अंतग(cid:20)त आने वाल ेOाम" और िनिहत वन" क(cid:27) सूची उउउउपपपपााााबबबबधधंंधधंं IIIIIIIIIIII के (cid:13)प म 7सलं a ह1 ।

अंितम अिधसूचना के (cid:11)काशन क(cid:27) तारीख स ेदो वष(cid:20) क(cid:27) अविध के भीतर, ’थानीय 6ि!य" के परामश(cid:20) से और इस अिधसूचना
म7 सलं Pन अनुबधं " के सामंज’य स ेआंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना राBय सरकार म 7स(cid:26)म (cid:11)ािधकारी (cid:30)ारा अनमु ो(cid:1)दत होगी ।
(3) राBय सरकार (cid:30)ारा पा(cid:28)रि’थ ितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म7 िविन=दb ट
(cid:13)प तथा ससु ंगत क7(cid:18)ीय और राBय िविधय" के सामजं ’ य और क7(cid:18)ीय सरकार (cid:30)ारा जारी माग(cid:20)िनदश‘ ", य(cid:1)द कोई ह", (cid:30)ारा
तैयार होगी ।
(4) आंचिलक महायोजना, पया(cid:20)वरणीय और पा(cid:28)रि’थितक(cid:27)य िवचार" को समाकिलत करन े के िलए राBय सरकार के
सभी संब< िवभाग" के परामश (cid:20)स ेतैयार होगी, अथा(cid:20)त:्--
(i) पया(cid:20)वरण ;
(ii) वन ;
(iii) शहरी िवकास ;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(iv) पय(cid:20)टन ;
(v) नगरपािलक ;
(vi) राज’व ;
(vii) कृिष ;
(viii) राBय (cid:11)दषू ण िनयं-ण बोड (cid:20);
(ix) _सचाई; और
(x) लोक िनमा(cid:20)ण िवभाग ।
5) आंचिलक महायोजना अनमु ो(cid:1)दत िव[मान भ-ू उपयोग, अवसंरचना और (cid:1)cयाकलाप" पर कोई िनबdधन अिधरोिपत
नहe करेगी जब तक (cid:1)क इस अिधसूचना म 7िविन=दbट न हो और आचिं लक महायोजना सभी अवसंरचना और (cid:1)cयाकलाप" म 7
और अिधक द(cid:26)ता और पा(cid:28)रि’थितक अनकु ूलता का संवध(cid:20)न करेगी ।
(6) आंचिलक महायोजना म 7 अनाfछा(cid:1)दत (cid:26)े-" के जीण\<ार, िव[मान जल िनकाय" के संर(cid:26)ण, आवाह (cid:26)े-" के
(cid:11)बंधन, जल-सभं र" के (cid:11)बंधन, भूतल जल के (cid:11)बंधन, मदृ ा और नमी संर(cid:26)ण, ’थानीय समुदाय" क(cid:27) आव]यकताT तथा
पा(cid:28)रि’थितक और पया(cid:20)वरण स ेसंबंिधत ऐस ेअ(cid:17)य पहलूT, िजन पर hयान दने ा आव]यक ह,ै के िलए उपबंध ह"गे ।
(7) आंचिलक महायोजना सभी िव[मान पूजा ’ थल", Oाम" और नगरीय बंदोब’त", वन" के (cid:11)कार और (cid:1)क’म ", कृिष
(cid:26)े-", ऊपजाऊ भिू म, ह(cid:28)रत (cid:26)-े जसै े उ[ान और उसी (cid:11)कार के ’ थान, उ[ान कृिष (cid:26)े-, फलोधान, झील" और अ(cid:17)य जल
िनकाय" का अjयकंन करेगी ।
(8) आंचिलक महायोजना ’थ ानीय समुदाय" क(cid:27) जीवकोपाजन(cid:20) को सुिनि] चत करने के िलए, पा(cid:28)रि’थितक संवेदी जोन म 7
िवकास को पा(cid:28)रि’थितक अनकु ूल िवकास के िलए िविनयिमत करेगी ।
(9) आंचिलक महायोजना के उपबंध" के पया(cid:20)3 (cid:11)चार (cid:1)कया जाएगा ।
3. रररराााा(cid:24)(cid:24)(cid:24)(cid:24)यययय ससससररररककककाााारररर (cid:25)(cid:25)(cid:25)(cid:25)ाााारररराााा (cid:26)(cid:26)(cid:26)(cid:26)ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेे ेे उउउउपपपपाााायययय-------- राBय सरकार इस अिधसूचना के उपबंध" को (cid:11)भावी करन े के िलए
िन(cid:8)िलिखत उपाय करेगी, अथा(cid:20)त ्:--
(1) भभभभ---ूू-ूू उउउउपपपपययययोोोोगगगग ---- पा(cid:28)रि’थितक संवेदी जोन म 7 वन", उ[ान-कृिष (cid:26)े-", कृिष (cid:26)े-", आमोद-(cid:11)मोद के (cid:11)योजन के िलए िचि(cid:17)हत
(cid:1)कए गए पाकk और खुल े ’थान" का वािणिBयक और औ[ोिगक संब< िवकास (cid:1)cयाकलाप" के िलए उपयोग या संप(cid:28)रवतन(cid:20)
नहe होगा :
परंत ु पा(cid:28)रि’थितक संवेदी जोन के भीतर कृिष भिू म का संप(cid:28)रवत(cid:20)न, के अधीन मानीटरी सिमित क(cid:27) िसफा(cid:28)रश पर
और राBय सरकार के पूव(cid:20) अनमु ोदन स,े ’थानीय िनवािसय" क(cid:27) आवासीय ज(cid:13)रत" को पूरा करन े के िलए और पैरा 4 क(cid:27)
सारणी के ’तंभ (2) के अधीन cम स.ं 17, 22, 28, 34 और 37 के सामन े सूचीब< (cid:1)cयाकलाप" को पूरा करन े के िलए
अनुlात ह"गे, अथा(cid:20)त् :-
(i) पा(cid:28)रि’थितक अनकु ूल पय(cid:20)टन (cid:1)cयाकलाप" के िलए पय(cid:20)टक" के अ’थ ायी अिधभोग के िलए पा(cid:28)रि’ थितक अनकु ूल
कुटीर जैस ेटे(cid:17)ट, का9 गृह ;
(ii) िव[मान सड़क" को चौड़ा तथा उनका सुदढृ ीकरण करना ;
(iii) (cid:11)दषू ण उCपL न करन ेवाले लघ ुउ[ोग ;
(iv) वषा(cid:20) जल संचयन; और
(v) कुटीर उ[ोग, िजसके अंतगत(cid:20) Oामीण कारीगर इCया(cid:1)द भी ह 1:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
परंत ु यह और (cid:1)क जनजातीय भिू म का उपयोग राBय सरकार के पूव(cid:20) अनमु ोदन और संिवधान के अनुfछ ेद 244 या
तCसमय (cid:11)वृ(cid:31) िविध के उपबंध" के अनुपालन के िबना, िजसके अंतग(cid:20)त अनुसिू चत जनजाित और अ(cid:17)य परंपरागत वन िनवासी
(वन अिधकार" क(cid:27) मा(cid:17)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिBयक या उ[ोग िवकास (cid:1)cयाकलाप" के िलए
अनुlात नहe होगा :
परंत ु यह और भी (cid:1)क पा(cid:28)रि’थ ितक संवेदी जोन के भीतर भ-ू अिभलेख" म 7 उपसंजात कोई -ु(cid:28)ट, मानीटरी सिमित के
िवचार (cid:11)ा3 करन े के प4ात ् राBय सरकार (cid:30)ारा (cid:11)Cयके मामल े म 7 एक बार संशोिधत होगी और उ! -ु(cid:28)ट के संशोधन क(cid:27)
सूचना भारत सरकार के पया(cid:20)वरण, वन और जलवाय ुप(cid:28)रवतन(cid:20) मं-ालय को दने ी होगी ।
परंत ुयह और भी (cid:1)क उपयु(cid:20)! -ु(cid:28)ट का संशोधन म 7इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म 7
भ-ू उपयोग का प(cid:28)रवत(cid:20)न सिSमिलत नहe होगा ।
परंत ुयह और भी (cid:1)क िजसस े ह(cid:28)रत (cid:26)े- म 7जैस ेवन (cid:26)े-, कृिष (cid:26)े- आ(cid:1)द म7 कोई पा(cid:28)रणािमक कटौती नहe होगी और
अन(cid:11)युRत या अनउCप ादक कृिष (cid:26)े-" म 7पुन: वनीकरण करने के (cid:11)यास (cid:1)कए जाएंग े।
(2) (cid:15)(cid:15)(cid:15)(cid:15)ााााककककृृृृििििततततकककक (cid:30)(cid:30)(cid:30)(cid:30)ोोोोतततत -- आचिं लक महायोजना म 7 सभी (cid:11)ाकृितक nोत" क(cid:27) पहचान क(cid:27) जाएगी और उनके संर(cid:26)ण और
पुनopभूतकरण के िलए योजना सिSम िलत होगी और राB य सरकार (cid:30)ारा ऐसे (cid:26)े-" पर या उनके िनकट िवकास (cid:1)cयाकलाप
(cid:11)ितिष< करन ेके िलए ऐसी रीित स ेमाग(cid:20)िनदश‘ तैयार (cid:1)कए जाएंगे ।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन –––– (क) पा(cid:28)रि’थितक संवेदी जोन के भीतर पय(cid:20)टन संबंधी (cid:1)cयाकलाप पय(cid:20)टन महायोजना के अनसु ार ह"ग े जो (cid:1)क
आंचिलक महायोजना के भाग (cid:13)प म 7होगी ।
(ख) पय(cid:20)टन महायोजना पय(cid:20)टन िवभाग, केरला सरकार के राज’ व और वन िवभाग, केरला सरकार के परामश(cid:20) से तैयार
होगी ।
(ग) पय(cid:20)टन संबंधी (cid:1)cयाकलाप िनSन िलिखत के अधीन िविनयिमत ह"गे, अथा(cid:20)त ्:-
(i) पा(cid:28)रि’थितक संवेदी जोन के भीतर सभी नए पय(cid:20)टन (cid:1)cयाकलाप" या िव[मान पय(cid:20)टन (cid:1)cयाकलाप" का िव’तार
के(cid:17)(cid:18) सरकार के पया(cid:20)वरण, वन और जलवाय ु प(cid:28)रवत(cid:20)न मं-ालय के माग(cid:20)दशक(cid:20) िस<ांत" के (cid:30)ारा तथा राb Qीय r याs
संर(cid:26)ण (cid:11)ािधकरण, (cid:30)ारा जारी पा(cid:28)रि’थितक पय(cid:20)टन (समय-समय पर यथा सशं ोिधत) माग(cid:20)दशक(cid:20) िस<ातं " के अनसु ार,
पा(cid:28)रि’थितक पय(cid:20)टन, पा(cid:28)रि’थितक िश(cid:26)ा और पा(cid:28)रि’थितक िवकास को महCव देते %ए पा(cid:28)रि’थितक संवेदी जोन क(cid:27)
वहन (cid:26)मता के अhययन पर आधा(cid:28)रत होगा;
(ii) पा(cid:28)रि’थितक(cid:27)य अनकु ूल पय(cid:20)टक (cid:1)cयाकलाप" के संबंध म 7 अ’थायी अिधभोग के िलए वास सिु वधा के िसवाय
पा(cid:28)रि’थितक संवेदी जोन के भीतर होटल और (cid:28)रसोटk का नया सिं नमाण(cid:20) अनुlात नहe होगा ;
परंत ुिव[मान ’थापन" का िव’तार आंचिलक महायोजना के अनसु ार अनlु ात (cid:1)कया जा सकेगा।
(iii) आंचिलक महायोजना का अनमु ोदन (cid:1)कए जान े तक, पय(cid:20)टन के िलए िवकास और िव[मान पय(cid:20)टन (cid:1)cयाकलाप"
के िव’तार को वा’तिवक ’थल िविन=द9 संवी(cid:26)ा तथा मानीटरी सिमित क(cid:27) िसफा(cid:28)रश पर आधा(cid:28)रत संबिं धत
िविनयामक (cid:11)ािधकरण" (cid:30)ारा अनुlात (cid:1)कया होगा ।
(4) ननननैसैसैसैस####गगगगकककक ििििववववररररााााससससतततत -------- पा(cid:28)रि’थितक संवेदी जोन म 7 महCवपूण(cid:20) नैस8गक िवरासत के सभी ’थल" जैस े सभी जीन कोश
आरि(cid:26)त (cid:26)े-, शैल िवरचनाए,ं जल (cid:11)पात", झरन", घाटी मागk, उपवन", गुफाएं, ’थल", tमण, अuरोहण, (cid:11)पात" आ(cid:1)द क(cid:27)

S.O. 65(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified
to the Secretary, Ministry of Environment, Forests and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Draft Notification
WHEREAS, the Shendurney Wildlife Sanctuary is situated between 8°44/ & 9°14/N latitude and 76°59/ & 77°
16/E longitude in Kollam District in the State of Kerala and is spread over an area of 172.403 square kilometre;
AND WHEREAS, the sanctuary is part of core area of Agasthayamalai Biosphere Reserve and also part of Periyar
Elephant Reserve in Kerala State;
AND WHEREAS, the Sanctuary supports wide variety of flora and fauna and the important rare, endemic and threatened
species of plants include Gluta travencorica, Cynometra bourdilonii, Palaquium bourdilonii, Madhuca bourdillonii,
Bentinckia condapanna, Cullenia excels, Cinnamomum sulphauratum, Garcinia imberti, Trichophus zeylanicus etc. and
important animals include Tiger, Leopard, Nilgiri marten, Mongoose, Elephant, Gaur, Sambar Deer, Lion Tailed
Macaque, Nilgiri Langur, Slender Loris, Sloth Bear, Leopard Cat etc.;
AND WHEREAS, the Shendurney sanctuary got its name from a tree locally called Chenkurinji (Gluta travancorica)
which is an endemic tree confined to this tract and the sanctuary also has a very important rare and endemic medicinal
plant named as Arogyapacha ( Trichopus zeylanicus) which has anti-fatigue properties and is widely used by tribals and

And whereas the Shendurney sanctuary is the catchment area of Kallada river and the water from Shendurney reservoir
supports a large tract of agricultural lands in Kollam and Pathanamthitta Districts of Kerala;
And whereas, it is necessary to conserve and protect the area, extent and boundaries of which are specified in
paragraph 1 of this notification around the protected area of Shendurney Wildlife Sanctuary as Eco-sensitive Zone from
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone.
Now therefore, in exercise of the powers conferred by sub section (1) and clauses (v) and (xiv) of sub-section (2) and
sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 20
metres to 750 meters around the boundary of Shendurney Wildlife Sanctuary in the State of Kerala as the Shendurney
Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under,

1. Extent and boundaries of Eco-sensitive Zone.- (1)The extent of Eco-Sensitive Zone varies from 20 metres to 750
meters from the boundary of Shendurney Wildlife Sanctuary in the State of Kerala and is spread over an area of 35.8697
square kilometre. Details of boundary are appended as Annexure-I.
(2) The map of the Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure II.
(3) The Eco-sensitive Zone covers 3 villages including vested forests. The list of the villages and vested forests
falling within the Eco-sensitive Zone is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as
is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued
by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal ;
(vi) Revenue ;
(vii) Agriculture;
(viii) State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department;
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development
for livelihood security of local communities.
(9) Adequate publicity shall be given to the provisions of the Zonal Master Plan.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 17, 22, 28, 34 and 37 in column (2)
of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities,
(ii) widening and strengthening of existing roads,
(iii) small scale industries not causing pollution,
(iv) rainwater harvesting, and
(v) cottage industries including village artisans etc :
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the
State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to
such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Kerala in consultation with
Department of Revenue and Forests, Government of Kerala.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time)
with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-
sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone except for
accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that extension of existing establishments may be allowed in accordance with the Zonal Master Plan:
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to
time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the competent authority in the State government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall
be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone
shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely:-

(c) Construction activity in the Eco-sensitive Zone shall be
as per Zonal Master Plan.
19. Felling of trees. (a) There shall be no felling of trees on the forest or

5. Monitoring Committee.—(1) The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(ii) The Member of Legislative Assembly, Punaloor - Member
(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from
the Speaker of Legislative Assembly, Kerala, if required)
(iv) President, District Panchayat, Kollam – Member
(v) One representative of Non Governmental Organisation working in the field of environment to be nominated by
the Government of Kerala for a term of one year in each case – Member
(vi) One expert in the area of ecology and environment from a reputed institution of University in the State to be
nominated by the Government of Kerala for a term of one year in each case – Member
(vii) Kerala Pollution Control Board, District Officer - Member
(viii) The Wildlife Warden, Shendurney – Member
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph
4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior
environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are
falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under
paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific
conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-
charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986
against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Central Government in the Ministry of Environment, Forest and
Climate Change as per proforma given in Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.

BOUNDARY DESCRIPTION OF THE ECO-SENSITIVE ZONE
North Aryankavu and Thenmala Ranges of Thenmala Forest Division - At a distance of 500m from the Northern
boundary of Shendurney Wildlife Sanctuary, the boundary of proposed ESZ starts from Periyanurutimalai
(point 22A) and runs towards North- West and meets at Enippara (point16).
West Thenmala and Punalur Divisions – At a distance of 500m from the Western boundary of the Shendurney
Wildlife Sanctuary the boundary of ESZ starts from Enippara (point16 ) and runs towards south and meets at
a place near Churuduipeak (point 6). This boundary includes the Kattilapara enclosure.
South Thiruvananthapuram Territorial Division – At a distance of 500m from the Southern boundary of the
Shendurney Wildlife Sanctuary the boundary of ESZ starts from the Churudi peak (point 6) the boundary
goes towards South – East and meets near Karumalai kadackal (point1) where the Tamil Nadu Forest starts.
East The Eastern boundary of the proposed Eco-Sensitive Zone runs from point 1 along the South-Western
boundary of Sanctuary up to point 50 and then runs along Northern boundary of the sanctuary from point 50
to 22A.
The enclosure namely Rosemala, and estates namely Kallar & Thenginthopu are encircled in all sides by
Shendurney Wildlife Sanctuary. And part of Northern portion of Rockwood estate is surrounded on three
sides by Shendurney Wildlife Sanctuary except Southern portion which is merging with rest of Rockwood
