और यह "ीप माच(cid:24) महीने के कुछ (cid:1)दन& को छोड़कर जल से िघरा )आ होता ह ैऔर अTछ ी रेल ;तथा सड़क& के नेटवक(cid:24)
से जुड़ा है िजसके (cid:15)ित ब)त स े पय(cid:24)टक, प(cid:29)ी दशक(cid:24) , + कूल िवUाथV आक<षत होते ह 5 । यह प(cid:29)ी (cid:15)ािणजात म; िविन@दW ट होन े

तक के िव+त ा रत (cid:29)े1 को घाटा(cid:15)भा प(cid:29)ी अभयारEय पा रि+ थितक संवेदी जोन (िजसे इसम; इसके पZ चात् पा रि+थ ितक
संवेदी जोन कहा गया ह)ै के (cid:17)प म ;अिधसूिचत करती ह,ै िजसके 2 यौरे िन(cid:12)ानसु ार ह,5 अथात(cid:24) ्:--

राजप1 म; अंितम अिधसूचना के (cid:15)काशन क(cid:30) तारीख स े दो वष(cid:24) क(cid:30) अविध के भीतर +थानीय लोग& के (cid:15)ितफल और + थानीय
लोग& के परामश (cid:24)से और इस अिधसूचना म ;अनुबंध& का पालन करत े)ए एक आंचिलक महायोजना तैयार करेगी ।
(2) उ[त योजना का रा\य सरकार म ;स(cid:29)म (cid:15)ािधकारी "ारा अनमु ोदन (cid:1)क या जाएगा।
(3) पा रि+थ ितक संवेदनशील जोन का आंचिलक महायोजना रा\ य सरकार "ारा ऐसी रीित स े जो इस अिधसूचना म ;
िविन@दWट (cid:1)क या जाए और ससु ंगत के(cid:21)(cid:22) ीय और रा\ य िविधय& के और के(cid:21) (cid:22)ीय सरकार "ारा जारी माग(cid:24)दशV िस?ांत& के

(4) आंचिलक महायोजना पया(cid:24)वरणीय और पा रि+थ ितक(cid:30)य बात& को इसम; समाकािलत करने के िलए सभी संबंिध त
रा\य िव भाग& के परामश(cid:24) स ेतयै ार (cid:1)कय ा जाएगा, अथात(cid:24) ् :--
(i) पया(cid:24)वरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पय(cid:24)टन ;
(v) नगरपािलका ;
(vi) राज+व ;
(vii) कृिष ;
(viii) कना(cid:24)टक रा\य (cid:15)दषू ण िनयं1ण बोड;(cid:24)
(ix) aसचाई; और
(x) लोक िनमा(cid:24)ण िवभाग ।
(5) महायोजना म ; जब तक इस अिध सूचना म ; ऐसा िव <न (cid:1)दW ट न हो तब तक अनुमो(cid:1)द त िव Uमान भ-ू उपयोग,
अवसंरचना और (cid:1)fयाकलाप& पर कोई िनबgधन अिधरोिपत नहh (cid:1)क या जाएगा और आंचिलक महायोजना सभी अवसंरचना
के सुधार और अिधक द(cid:29) तथा पा रि+थ ितक(cid:30) अनकु ूल होन ेवाले (cid:1)fयाकलाप इस (cid:15)कार िविन@दW ट न हो ।
(6) आंचिलक महायोजना म ; अनाTछा(cid:1)दत (cid:29)े1& के जीणN?ार, िवUमान जल िनकाय& के संर(cid:29)ण, आवाह (cid:29)े1& के
(cid:15)बंधन, जल-संभर& के (cid:15)बंधन, भूतल जल के (cid:15)बंधन, मदृ ा और नमी संर(cid:29)ण, +थानीय समुदाय& क(cid:30) आवZयकताb तथा
पा रि+थितक(cid:30) और पया(cid:24)वरण से संबंिधत ऐस ेअ(cid:21)य पहलbु , िजन पर iयान दने ा आवZयक ह,ै के िलए उपबंध ह&गे ।
(7) आंचिलक महायोजना सभी िवUमान एवं (cid:15)+ तावित पूजा + थल&, dाम& और नगरीय बंदोब+त&, वन& के (cid:15)कार और
(cid:1)क+म &, जनजातीय (cid:29)े1&, कृिष (cid:29)े1&, ऊपजाऊ भिू म, ह रत (cid:29)े1 जसै े उUान और उसी (cid:15)कार के + थान, उUान कृिष (cid:29)1े ,
फलोUान, झील& और अ(cid:21)य जल िनकाय& का अjयकंन करेगी ।
(8) आंचिलक महायोजना पा रि+थ ितक संवेदी जोन म ; िवकास को िविनयिमत करेगी िजसस े पा रि+थ ितक(cid:30) अनुकूल
िवकास +थ ानीय समुदाय& क(cid:30) जीवकोपाज(cid:24)न सुर(cid:29)ा के िलए सुिनिZ चत (cid:1)कया जा सके ।

(cid:1)कए गए पाक_ और खुले +थान& का वािणि\यक और औUोिगक संब? िवकास (cid:1)fयाकलाप& के िलए उपयोग या संप रवत(cid:24)न
नहh होगा :
परंत ु पा रि+थितक संवेदी जोन के भीतर कृिष भूिम का संप रवत(cid:24)न, मानीटरी सिमित क(cid:30) िसफा रश पर और रा\य
सरकार के पूव(cid:24) अनमु ोदन स,े +थानीय िनवािसय& क(cid:30) आवासीय ज(cid:17)रत& को पूरा करन ेके िलए और पैरा 4 क(cid:30) सारणी के +तंभ
(2) के अधीन मद स.ं 13, 19, 25, 30 और स.ं 33 के सामने सूचीब? (cid:1)fयाकलाप& को पूरा करने के िलए अनुkात ह&गे,
अथा(cid:24)त ्:-
(i) पा र ि+थ ि त क अनकु ूल पय(cid:24)टन (cid:1)f याकलाप& के िल ए, पय(cid:24)टक& के अ+ थायी l यवसाय भोग के िल ए पा र ि+ थ ित क
अनकु ूल कटीर जसै ेटे(cid:21)ट , काWठ गृह;
(ii) िवUमान सड़क& को चौड़ा करना तथा उनका सुदढृ ीकरण;

(v) कुटीर उUोग, िजसके अंतग(cid:24)त dामीण उUोग सुिवधा भंडार तथा + थानीय सखु सिु वधाए ंभी ह 5:
परंत ुयह और (cid:1)क रा\य सरकार के पूव(cid:24) अनमु ोदन और सिं वधान के अनुTछ ेद 244 या तOसमय (cid:15)वृ# िविध के उपबंध&
के अनुपालन के िबना, िजसके अंतग(cid:24)त अनुसिू चत जनजाित और अ(cid:21)य परंपरागत वन िनवासी (वन अिधकार& क(cid:30) मा(cid:21)यता)
अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि\यक या उUोग िवकास (cid:1)fयाकलाप& के िलए जनजातीय भिू म का उपयोग
अनुkात नहh होगा :
परंत ु यह भी (cid:1)क पा रि+थ ितक संवेदी जोन के भीतर भ-ू अिभलखे & म ; (cid:15)तीत होने वाली कोई 1ु ट, मानीटरी सिमित
के िवचार (cid:15)ा7 करन ेके प8ात् रा\य सरकार "ारा (cid:15)Oयके मामल े म ; एक बार ठीक क(cid:30) जाएगी और उ% 1ु ट के ठीक करन ेक(cid:30)
के(cid:21)(cid:22) ीय सरकार के पया(cid:24)वरण, वन और जलवाय ुप रवत(cid:24)न मं1ालय को सूचना दने ी होगी ।
परंत ु यह भी (cid:1)क उपयु(cid:24)% 1ु ट का संशोधन म ; इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म ; भ-ू
उपयोग का प रवत(cid:24)न सि(cid:7)मिलत नहh होगा ।
परंत ु यह भी (cid:1)क िजससे ह रत (cid:29)े1 जसै े वन (cid:29)े1 और कृिष (cid:29)े1 म; कोई पा रणािमक कटौती नहh होगी और
अनुपयु[त या अनOु प ादक कृिष (cid:29)े1& म ;पुन: वनीकरण करन ेके (cid:15)यास (cid:1)कए जाएंगे ।
(2) (cid:1)(cid:1)(cid:1)(cid:1)ााााककककृृृृििििततततकककक जजजजलललल (cid:21)(cid:21)(cid:21)(cid:21)ोोोोतततत(cid:23)(cid:23)(cid:23)(cid:23) -- आचंिलक महायोजना म ; सभी (cid:15)ाकृितक oोत& के आवाह (cid:29)े1& क(cid:30) पहचान क(cid:30) जाएगी और उनके
संर(cid:29)ण और नवीकरण के िलए योजना सि(cid:7) मिलत होगी और रा\ य सरकार "ारा इन (cid:29)1े & पर या उनके िनकट िवकास
(cid:1)fयाकलाप&, जो ऐसे (cid:29)े1& के िलए हािनकारक ह,5 को (cid:15)ितिष? करन ेके िलए ऐसी रीित से माग(cid:24)िनदशc तैयार (cid:1)कए जाएंगे ।
(3) पपपपययययटट(cid:24)(cid:24)टट(cid:24)(cid:24) नननन –––– (क) पा रि+थितक संवेदी जोन के भीतर पय(cid:24)टन संबंधी (cid:1)fयाकलाप, जो आचं िलक महायोजना का भाग (cid:17)प
ह&गे ।
(ख) पय(cid:24)टन महायोजना पय(cid:24)टन िवभाग "ारा, कना(cid:24)टक सरकार के वन और पया(cid:24)वरण िवभाग, के परामश (cid:24)स ेतयै ार होगी ।
(ग) पय(cid:24)टन संबंधी (cid:1)fयाकलाप िन(cid:7)न िलिखत के अधीन िविनयिमत ह&गे, अथा(cid:24)त ्:-
(i) पा रि+थितक संवेदी जोन के भीतर सभी नए पय(cid:24)टन (cid:1)fयाकलाप& या िवUमान पय(cid:24)टन (cid:1)fयाकलाप& का िव+तार
भारत सरकार के पया(cid:24)वरण, वन और जलवाय ु प रवत(cid:24)न मं1ालय के माग(cid:24)दशक(cid:24) िस?ांत& के "ारा तथा राW pीय l याq
संर(cid:29)ण (cid:15)ािधकरण, "ारा जारी पा रि+थितक पय(cid:24)टन (समय-समय पर यथा संशोिधत) माग(cid:24)दशक(cid:24) िस?ांत& के
अनसु ार, पा रि+थितक पय(cid:24)टन, पा रि+थितक िश(cid:29)ा और पा रि+थितक िवकास को महOव दते े )ए पा रि+थितक
संवेदी जोन क(cid:30) वहन (cid:29)मता के अiययन पर आधा रत होगा;
(ii) पा रि+थितक(cid:30)य अनुकूल पय(cid:24)टक (cid:1)fयाकलाप& के संबंध म ; अ+थायी अिधभोग के िलए वास सुिवधा के िसवाय
पा रि+थितक संवेदी जोन क(cid:30) सीमा म; होटल और रसोट_ का नया सिं नमाण(cid:24) अनुkात नहh होगा ।
(iii) आंचिलक महायोजना का अनमु ोदन (cid:1)कए जान े तक, पय(cid:24)टन के िलए िवकास और िवUमान पय(cid:24)टन (cid:1)fयाकलाप&
के िव+तार को वा+तिवक +थल िविन@द= संवी(cid:29)ा तथा मानीटरी सिमित क(cid:30) िसफा रश पर आधा रत संबंिधत
िविनयामक (cid:15)ािधकरण& "ारा अनुkात (cid:1)कया होगा ।

New Delhi, the 29th December, 2015
S.O. 3550(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified
to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Draft Notification
WHEREAS, Ghataprabha Bird Sanctuary notified vide Government of Karnataka Notification No. FEE 58
FWL 96 dated 8.7.1999 and situated in Gokak and Hukkeri Taluks of Belgaum District is spread over an area of
29.875 square kilometres;
AND WHEREAS, it is a small bird sanctuary comprising a section of Ghataprabha River and over 22 islands
in it. A weir and dam constructed during 1883 near Dhupadal have created a reservoir upstream with a large island in it’s
midst. The Gokak waterfalls located in the eastern part of the Sanctuary is the major tourist attraction;
AND WHEREAS, the island surrounded by water throughout the year except few days in March, connected
with good network of rail and road attracts many tourists, bird watchers, school children. It gives good opportunity to
create awareness among public regarding wildlife to be specific in avifauna. It is a good example of riverine ecosystem;
AND WHEREAS, most of the islands that comprise the sanctuary are barren and dry and one of them at
western side of Dhupadal Lake is swampy and another has a good growth of Acacia arabica, Pithecollobium dulce and
Bambusa arundianaecia, both being introduced species. Acacia arabica and Imperate cylindrica are considered of
special interest, as they are good for nesting. Apart from harboring endemic birds like little Cormorant, Egret, Ibis, King14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
fisher, Storks, Snake birds, Heron etc., the area is noted for having attracted migratory birds like Demoiselle Crane and
European White Stork which have been sighted normally from November to March;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified
in paragraph 1 of this notification around the protected area of Ghataprabha Bird Sanctuary as Eco- sensitive Zone from
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule
5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 300
meters all around the boundary of Ghataprabha Bird Sanctuary in the State of Karnataka as the Ghataprabha Bird
Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone lies between the North Latitudes N 16º
10’29.22 to 16º 10’26.62 and East longitudes between E 74º 48’49.32’ E to 74º 48’44.62 and North Latitudes N 16º
11’11.36 N to 16º 11’06.88 and East longitudes between E 74º 41’28.08 to 74º 41’33.15 and spread over an area of
22.66 square kilometers with an extent of 300 meters all around the boundary of Ghataprabha Bird Sanctuary and the
boundary description of such Zone is given in Annexure-I.
(2) The list of 16 villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is
appended as Annexure-II.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as
Annexure-III.
(4) Key locations (GPS points) on the eco-sensitive zone boundary as well as on the sanctuary are appended as
Annexure-IIIA.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Fores;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Karnataka State Pollution Control Board;
(ix) Irrigation;
(x) Public Works Department;
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
need of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural
areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential need of local residents, and for the activities listed against serial numbers 13, 19, 25, 30 and 33 in column (2)
of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly
tourism activities,
(ii) Widening and strengthening of existing roads,
(iii) Small scale industries not causing pollution,
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the
State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to
such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with the Department of
Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone except for
accommodation for temporary occupation of tourists related to Eco-friendly tourism activities;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board
shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with
the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board
shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forest vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to
time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is
prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall
be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely:-

permitted within Eco-sensitive Zone:
Provided that, local people shall be permitted to
undertake construction in their land for their residential use
including the activities listed in sub-paragraph (1) of
paragraph 3:
Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the competent authority as per applicable
rules and regulations, if any.
15. Felling of trees. (a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the competent authority in the State
Government;
(b) the felling of trees shall be regulated in accordance
with the provisions of the concerned Central or State Acts
and the rules made thereunder;
(c) in case of Reserve Forests and Protected Forests the

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone falling in the State of Karnataka , which shall comprise of the following namely:-
(i) Regional Commissioner, Belagaavi –Chairman;
(ii) Hon’ble Member of Legislative Assembly, Arabhavi Constituency, Belagaavi District – Member;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(iii) Hon’ble Member of Legislative Assembly, Gokak Constituency, Belagaavi District – Member;
(iv) Hon’ble Member of Legislative Assembly, Hukkeri Constituency, Belagaavi District – Member;
(v) Representative of the Department of Environment, Government of Karnataka -Member;
(vi) Representative of the Department of Urban Development, Government of Karnataka -Member;
(vii) Representative of Non-governmental Organizations working in the field of natural conservation (including
heritage conservation) to be nominated by the Government of Karnataka -Member;
(viii) The Regional Officer, Karnataka State Pollution Control Board, Mysore -Member;
(ix) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by
the Government of Karnataka -Member.
(x) Deputy Commissioner or his representative, Chamarajanagar, Mandya and Ramanagar –Member;
(xi) The Deputy Conservator of Forests, Cauvery Wildlife Sanctuary, Kollegal – Member-Secretary.
*(Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the
Speaker of Legislative Assembly, Karnataka, if required)
6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry Associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at
Annexure-IV.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.

The boundary line starts from the co-ordinate E 74° 40’13.0 N 16° 09’ 50.0 of Ghodgeri village of Hukkeri
Taluk, Belgaum District. Then the line runs 300 meters paralell to the Ghataprabha Bird Sanctuary boundary through
Ghodgeri, Konnur, Khanapur, Shingalapur, Godchinmalki, Gokak and Lolasur villages.
North and West:
Then from the above point, the line passes 300 meters parallel to the Ghataprabha Bird Sanctuary through
Lolasur, Gokak, Shingalapur, Dhupadal, Shingalapur, Konnur, Shirdan & Sarapur villages of Hukkeri Taluk, Kotabagi,
Shirgaon, Awargol, Naginhal Sulthanpur villages and then finally joins the starting point.
