:वारा (cid:24)द;त शि=तय> का (cid:24)योग करत े हुए, जार(cid:8) करने का (cid:24)Dताव करती है, पया(वरण (संर-ण) (cid:19)नयम, 1986 के
(cid:19)नयम 5 के उप(cid:19)नयम (3) क3 अपे-ानुसार, जनसाधारण क3 जानकार(cid:8) के (cid:20)लए (cid:24)का(cid:20)शत क3 जाती है; िजनके उससे
(cid:24)भाHवत होने क3 संभावना है ; और यह सूचना द(cid:8) जाती है Iक उ=त (cid:24)ा(cid:26)प अ(cid:29)धसूचना पर, उस तार(cid:8)ख से, िजसको इस
अ(cid:29)धसूचना वाले भारत के राजपK क3 (cid:24)(cid:19)तया ं जनसाधारण को उपलLध करा द(cid:8) जाती हM, साठ (cid:4)दन क3 अव(cid:29)ध क3
समािNत पर या उसके पOचात ् Hवचार Iकया जाएगा ;

उपधारा (1) :वारा (cid:24)द;त शि=तय> का (cid:24)योग करत े हुए, काना(टक रा^य मS चु(cid:6)लानरू अw यार] य क3 सीमा से 10
Iक लोमीटर तक के HवD ताZरत -ेK को चु(cid:6)लानूर अw यार] य पाZरिD थ(cid:19)तक3य संवेद(cid:8) जोन (िजसे इसमS इसके पO चात ्
पाZरिD थ(cid:19)तक3य संवेद(cid:8) जोन कहा गया है) के (cid:26)प मS अ(cid:29)धसू(cid:29)चत करती है, िजसका Hववरण (cid:19)न(cid:12)नानसु ार है, अथा(त ् :--
1. पा(cid:15)रि%थ'तक( संवेद+ जोन का -व%तार और उसक( सीमाएं--(1) पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन चु(cid:6)लानरू मयूर
अभयार] य क3 सीमा का HवDत ार 100 मीटर से 900 मीटर तक है और इसक3 सीमा का वणन( उपाबंध-1 पर (cid:4)दया गया
है ।
(2) मुx य aब% दओु ं के (cid:19)नदyशांक के (cid:26)प मS उपाबंध के साथ पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन का मान(cid:29)चK उपाबंध 2 के
(cid:26)प मS उपाबu है ।
(3) पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन 2.667 वग ( Iकलोमीटर के भौगो(cid:20)लक -ेK मS फैला हुआ है, िजसके अंतगत( aKसूर
और नीनमारा वन (cid:24)भाग> और तीन राजD व kाम> के (cid:19)न(cid:4)हत वन हM तथा पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के भीतर आने वाले
kाम> क3 सूची उपाबंध-2 के (cid:26)प मS उपाबu क3 गई है ।
2. पा(cid:15)रि%थ'तक( संवेद+ जोन के 4लए आंच4लक महायोजना –(1) रा^य सरकार, पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के
(cid:24)योजन> के (cid:20)लए राजपK मS इस अ(cid:29)धसूचना के अं(cid:19)तम (cid:24)काशन क3 तार(cid:8)ख से दो वष ( क3 अव(cid:29)ध के भीतर, इस
अ(cid:29)धसूचना मS (cid:4)दए गए उपदशz का अनुपालन करते हुए, Dथानीय Rयि=तय> के परामश ( से आचं (cid:20)लक महायोजना तैयार
करेगी ।
(2) उ= त योजना को रा^ य सरकार मS स-म (cid:24)ा(cid:29)धकार(cid:8) :वारा अनमु ो(cid:4)दत Iकया जाएगा ।
(3) पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के (cid:20)लए आचं(cid:20)लक महायोजना रा^ य सरकार :वारा इस अ(cid:29)धसूचना मS
यथाHव(cid:19)न(cid:4)द(T ट र(cid:8)(cid:19)त मS और सुसंगत कS&(cid:8)य और रा^ य Hव (cid:29)ध य> और कS&(cid:8)य सरकार :वारा जार(cid:8) मागद( शक( (cid:20)स uांत>, य(cid:4)द
कोई ह>, के सामंजD य से तैयार क3 जाएगी ।
(4) आचं(cid:20)लक महायोजना उसमS पया(वरणीय और पाZरिDथ(cid:19)तक3 मु{> को सि(cid:12) म(cid:20)लत करने के (cid:20)लए संबं(cid:29)ध त रा^ य
Hव भाग> के साथ परामश ( से तैयार क3 जाएगी, िजसके अंतग(त (cid:19)न(cid:12) न(cid:20)ल(cid:21)खत हM--
(i) पया(वरण ;
(ii) वन ;¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(iii) शहर(cid:8) Hवकास ;
(iv) पयट( न ;
(v) नगरपा(cid:20)लक ;
(vi) राजD व ;

(viii) रा^ य (cid:24)दषू ण (cid:19)नयKं ण बोड,(
(ix) (cid:20)सचं ाई,
(x) लो क (cid:19)न मा(ण Hव भाग
(5) आंच(cid:20)लक महायोजना अनमु ो(cid:4)दत Hव:यमान भू-उपयोग, अवसंरचना और I_याकलाप> पर कोई (cid:19)नबध| न
अ(cid:29)धरोHपत नह(cid:8)ं करेगी जब तक Iक इस अ(cid:29)धसूचना मS इस (cid:24)कार Hव(cid:19)न(cid:4)द(T ट न Iकया जाए और उ= त आचं (cid:20)लक
महायोजना सभी अवसंरचना और कायक( लाप> मS द-ता और पाZर िD थ क3य अनुकूलता का सधु ार करेगी ।
(6) आचं (cid:20)लक महायोजना मS अनाXछा(cid:4)दत -ेK> के जीण}uार, Hव:यमान जल (cid:19)नकाय> के संर-ण, आवाह -ेK> के
(cid:24)बंधन, जल-संभर> के (cid:24)बंधन, भूतल जल के (cid:24)बंधन, मदृ ा और नमी संर-ण, Dथानीय समुदाय> क3 आवOयकताओ ं तथा
पाZरिDथ(cid:19)तक3 और पया(वरण से संबं(cid:29)धत ऐसे अ%य पहलूओ,ं िजन पर ~यान देना आवOयक है, के (cid:20)लए उपबंध ह>गे ।
(7) आंच(cid:20)लक महायोजना सभी Hव:यमान पूजा D थल>, kाम> और नगर(cid:8)य बंदोबDत>, वन> के (cid:24)कार और IकD म>,
कृHष -ेK>, ऊपजाऊ भू(cid:20)म, हZरत -ेK जैसे उ:यान और उसी (cid:24)कार के D थान, उ:यान कृHष -ेK, आIक(ड>, झील> और
अ%य जल (cid:19)नकाय> का अwयकंन करेगी ।
(8) आचं (cid:20)लक महायोजना D थानीय समुदाय> क3 जीवकोपाजन( को सु(cid:19)निO चत करने का सु(cid:19)न O चय करेगी ।
(9) आंच(cid:20)लक महायोजना के उपबंध> को पया(N त (cid:24)चार (cid:24)दान Iकया जाएगा ।
3. रा7य सरकार 8वारा 9कए जाने वाले उपाय-- रा^य सरकार इस अ(cid:29)धसूचना के उपबंध> को (cid:24)भावी करने के
(cid:20)लए (cid:19)न(cid:12)न(cid:20)ल(cid:21)खत उपाय करेगी, अथा(त ् :--
(1) भ-ू उपयोग – पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन मS वन>, उ:यान-कृHष -ेK>, कृHष -ेK>, आमोद-(cid:24)मोद के (cid:24)योजन के
(cid:20)लए (cid:29)चि%हत Iकए गए पाक} और खुले Dथान> का वा(cid:21)णि^यक और औ:यो(cid:29)गक संबu Hवकास I_याकलाप> के (cid:20)लए
उपयोग या संपZरवतन( नह(cid:8) ं होगा :
परंत ु पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के भीतर कृHष भू(cid:20)म का संपZरवतन( , मानीटर(cid:8) स(cid:20)म(cid:19)त क3 (cid:20)सफाZरश पर और रा^य
सरकार के पूव ( अनमु ोदन स,े Dथानीय (cid:19)नवा(cid:20)सय> क3 आवासीय ज(cid:26)रत> को पूरा करन े के (cid:20)लए और पैरा 4 क3 सारणी के
Dतंभ (2) मS _म सं. 12,17, 23,,29 और 32 के अधीन I_याकलाप> को पूरा करन े के (cid:20)लए अन€ु ात होगा, अथा(त ् :-
(i) पाZरिD थ(cid:19)तक3य अनुकूल पयट( न I_याकलाप> के (cid:20)लए पयट( क> के अD थायी आवासन के (cid:20)लए
पाZरिD थ(cid:19)तक3य अनुकूल आरामगाह जैसे टSट, लकड़ी के मकान आ(cid:4)द ;
(ii) Hव :यमान सड़क> को चौड़ा करना और सुtढ़ करना;
(iii) (cid:24)दषू ण उ;प%न न करने वाले लघ ु उ:योग,
(iv) वषा( जल संचय, और
(v) कुट(cid:8)र उ:योग, िजसके अंतगत( kामीण उ:योग, सुHव धाजनक भंडार और Dथ ानीय सुHव धाएं भी हM, :
परंत ु यह और Iक रा^य सरकार के पूव ( अनमु ोदन और संHव धान के अनुX छेद 244 तथा त;समय (cid:24)व;ृ त Hव(cid:29)ध के
उपबंध> के अनुपालन के aबना, िजसके अंतगत( अनुसू(cid:29)चत जनजा(cid:19)त और अ%य परंपरागत वन (cid:19)नवासी (वन अ(cid:29)धकार>4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
क3 मा%यता) अ(cid:29)ध(cid:19)नयम, 2006 (2007 का 2) भी है, वा(cid:21)णि^यक या उ:योग Hवकास I_याकलाप> के (cid:20)लए जनजातीय
भू(cid:20)म का उपयोग अन€ु ात नह(cid:8)ं होगा :
परंत ु यह और भी Iक पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के भीतर भ-ू अ(cid:20)भलेख> मS उपसंजात कोई Kु(cid:4)ट, इसमS पैरा 3 मS
(cid:19)न(cid:4)द(T ट मानीटर(cid:8) स(cid:20)म(cid:19)त के Hवचार (cid:24)ाNत करने के पOचात ् रा^य सरकार :वारा (cid:24);येक मामले मS केवल एक बार
संशो(cid:29)धत होगी और उ=त Kु(cid:4)ट के संशोधन क3 भारत सरकार के पया(वरण, वन और जलवाय ु पZरवतन( मंKालय को
सूचना देनी होगी ।
परंत ु यह और भी Iक उपय=ु( त Kु(cid:4)ट का संशोधन मS इस उप पैरा के अधीन यथा उपबं(cid:29)धत के (cid:20)सवाय Iकसी भी
दशा मS भ-ू उपयोग का पZरवतन( सि(cid:12)म(cid:20)लत नह(cid:8)ं होगा ।
परंत ु यह और भी Iक िजससे हZरत -ेK मS जैसे वन -ेK, कृHष -ेK आ(cid:4)द मS कोई पाZरणा(cid:20)मक कटौती नह(cid:8)ं होगी
और अन(cid:24)य=ु त या अनु; पादक कृHष -ेK> मS पुन: वनीकरण करने के (cid:24)यास Iकए जाएंगे ।
(2) "ाकृ'तक =ोत - आचं(cid:20)लक महायोजना मS सभी (cid:24)ाकृ(cid:19)तक ƒोत> क3 पहचान क3 जाएगी और उनके संर-ण और
नवीकरण के (cid:20)लए योजना सि(cid:12) म(cid:20)लत होगी और रा^ य सरकार :वारा ऐसे -ेK> पर या उनके (cid:19)नकट Hवकास I_याकलाप
(cid:24)(cid:19)तHषu करने के (cid:20)लए ऐसी र(cid:8)(cid:19)त से माग(cid:19)(नदyश तैयार Iकए जाएंगे ।
(3) पयट(cid:4) न - (क) पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के भीतर पयट( न संबंधी I_याकलाप, पयट( क महायोजना के अनुसार
ह>गे, जो आंच(cid:20)लक महायोजना का एक भाग बनSगे ।
(ख) पयट( न महायोजना पयट( न Hवभाग :वारा केरल सरकार के राजD व और पया(वरण Hवभाग के परामश ( से
तैयार क3 जाएगी ।
(ग) पयट( न संबंधी I_याकलाप (cid:19)न(cid:12) न(cid:20)ल(cid:21)खत के अधीन Hव(cid:19)नय(cid:20)मत ह>ग,े अथा(त ् :-
(i) पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के भीतर सभी नए पयट( न I_याकलाप> या Hव:यमान पयट( न I_याकलाप> का
HवDतार राT „(cid:8)य R या… संर-ण (cid:24)ा(cid:29)धकरण, पया(वरण, वन और जलवायु पZरवतन( मंKालय :वारा जार(cid:8) (समय-
समय पर यथा संशो(cid:29)धत) माग(cid:19)(नदेश> के अनुसार होगा िजसमS पाZरिDथ(cid:19)तक3 पयट( न, पाZरिDथ(cid:19)तक3 (cid:20)श-ा और
पाZरिDथ(cid:19)तक3 Hवकास को मह;व (cid:4)दया जाएगा और पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन क3 वहन -मता के अ~ययन पर
आधाZरत होगा ;
(ii) पाZरिD थ(cid:19)तक3य अनुकूल पयट( न I_याकलाप> के संबं(cid:29)धत पयट( क> के अD थायी (cid:19)नवास के (cid:20)लए आवासन के
(cid:20)सवाय पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन के भीतर होटल और Zरसाट( के नए सं(cid:19)नमा(ण शेरावती घाट(cid:8) व% यजीव
अभयार] य क3 सीमा के 1 Iकलोमीटर के भीतर अन€ु ात नह(cid:8)ं ह>गे ।
(iii) आंच(cid:20)लक महायोजना का अनमु ोदन Iकए जाने तक, पयट( न के (cid:20)लए Hवकास और Hव:यमान पयट( न
I_याकलाप> के HवDतार को वाDतHवक Dथल Hव(cid:19)न(cid:4)द(Tट संवी-ा तथा मानीटर(cid:8) स(cid:20)म(cid:19)त क3 (cid:20)सफाZरश पर
आधाZरत संबं(cid:29)धत Hव(cid:19)नयामक (cid:24)ा(cid:29)धकाZरय> :वारा अन€ु ात Iकया होगा ।
(4) नैस(cid:21)गक(cid:4) -वरासत - पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन मS मह;वपूण ( नैस(cid:29)गक( Hवरासत के सभी Dथल> जैसे सभी जीन
कोश आरo-त -ेK, शैल Hवरचनाएं, जल (cid:24)पात>, झरन>, घाट(cid:8) मागz, उपवन>, गुफाएं, Dथल>, †मण, अOवरोहण, (cid:24)पातो
आ(cid:4)द क3 पहचान क3 जाएगी और उ%हS संरo-त Iकया जाएगा तथा उनक3 सुर-ा और संर-ा के (cid:20)लए इस अ(cid:29)धसूचना के
(cid:24)काशन क3 तार(cid:8)ख से छह मास के भीतर, उपयु=त योजना बनाएगी और ऐसी योजना आंच(cid:20)लक महायोजना का भाग
होगा ।
(5) मानव-'न4मत(cid:4) -वरासत % थल - पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन मS भवन>, संरचनाओं, (cid:20)श(cid:6)प-त‡य, ऐ(cid:19)तहा(cid:20)सक,
कला;मक और सांDकृ(cid:19)तक मह;व के -ेK> क3 पहचान करनी होगी और इस अ(cid:29)धसूचना के (cid:24)काशन क3 तार(cid:8)ख से छह
माह के भीतर उनके संर-ण क3 योजनाएं तैयार करनी होगी तथा आंच(cid:20)लक महायोजना मS सि(cid:12)म(cid:20)लत क3 जाएगी ।¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(6) C व'न "दषू ण - पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन मS ~ व(cid:19)न (cid:24)दषू ण के (cid:19)नयंKण के (cid:20)लए रा^ य सरकार का पया(वरण
Hवभाग वाय ु ((cid:24)दषू ण (cid:19)नवारण और (cid:19)नयंKण) अ(cid:29)ध(cid:19)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:19)नयम> के
उपबंध> के अनुसरण मS मागद( शक( (cid:20)सuांत और Hव(cid:19)नयम तैयार करेगा ।
(7) वाय ु "दषू ण - पाZरिDथ(cid:19)तक3 संवेद(cid:8) जोन मS, वाय ु (cid:24)दषू ण के (cid:19)नयंKण के (cid:20)लए रा^य सरकार का पया(वरण

वन मंKालय क3 समय-समय पर यथा संशो(cid:29)धत अ(cid:29)धसूचना स.ं का.आ. 908(अ), तार(cid:8)ख
25 (cid:20)सतबं र, 2000 नगरपा(cid:20)लक ठोस अप(cid:20)शTट ((cid:24)बंध और हथालन) (cid:19)नयम, 2000 के उपबंध> के

NOTIFICATION
New Delhi, the 7th December, 2015
S.O. 3327(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified

DRAFT NOTIFICATION
WHEREAS, the Chulannur Peafowl Sanctuary is situated between the North Latitudes 10o 42’ 33.1” and 10o
43’ 57.9”and between the East Longitudes 76o 27’ 21.6” and 76o 30’ 0.20” in Althur and Thalapilly Taluks of Palakka
and Thrissur Districts, respectively, in the State of Kerala and is spread over an area of 3.42 square kilometres;
AND WHEREAS, the Sanctuary was constituted for ensuring long-term protection of the entire bio-diversity of
the area, especially ‘Peafowl’ (Pavo cristatus) and its habitat;
AND WHEREAS, the Sanctuary also 76 species of birds which include Grey francolin, Golden oriole, Indian
grey hornbill, Asian palm civet, Baya weaver, black headed muniya, Eurasian golden oriole, White breasted water hen,
White cheeked barbet, White throated kingfisher, Yellow billed babbler, Shikra, Mottled wood owl, etc.;
AND WHEREAS, the sanctuary predominantly consisting of deciduous forests with open patches and rocky
areas and harbours a total of 337 species of flowering plants of which the dominant tree species are Xylia xylocarpa,
Terminalia paniculata, Bombax ceiba, Lannea coromandelica, Stereospermum colais, Cleistanthus collinus, Morinda
tinctoria, Careya arborea, Pterocarpus marsupium, Terminalia tomentosa, Dalbergia latifolia etc.;
AND WHEREAS, about 15 species of small Mammals have been recorded from the Sanctuary area; including
the Jungle cat, Grey Mongoose, Asian Palm Civet, Golden Jackal, Indian Crested Porcupine, Indian Pangolin, Wild
Boar, etc.;
AND WHEREAS, it is necessary to conserve and protect the area, extent and boundaries of which are specified
in paragraph 1 of this notification around the protected area of Chulannur Peafowl Sanctuary as Eco- sensitive Zone
from ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent
varying from 100 meters to 990 meters around the boundary of Chulannur Peafowl Sanctuary in the State of Kerala as
the Chulannur Peafowl Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of
which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1)The extent of Eco-sensitive Zone varies from 100 meters to 990
meters around the boundary of Chulannur Peafowl Sanctuary and the details of boundary are appended as Annexure-I.
(2) The map of the Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure II
(3) The Eco-sensitive Zone covers a geographical area of 2.667 square kilometres which includes vested forests of
Thrissur and Nenmara forest divisions and three revenue villages and the list of the villages falling within the Eco-
sensitive Zone is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the competent cuthority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as
is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) State Pollution Control Board;
(ix) Irrigation;
(x) Public Works Department;
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,
orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development
for livelihood security of local communities.
(9) Adequate publicity shall be given to the provisions of the Zonal Master Plan.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 12, 17, 23, 29 and 32 in column (2)
of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities,
(ii) Widening and strengthening of existing roads,
(iii) Small scale industries not causing pollution,
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State
Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such
areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Kerala in consultation with
Department of Revenue and Forests, Government of Kerala.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Chulannur Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly
tourism activities;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be
identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the
date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations
for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations
for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forest vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to
time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forest vide notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 15
prepared and approved, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant
Acts and the rules and regulations made thereunder.
(12) Industrial Units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall
be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone
shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely:-

permitted only for bona fide agricultural use and domestic
consumption of the occupier of the land.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of
water from any source including agriculture.

Regulated Activities
12. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within
the Eco-sensitive Zone except for accommodation for temporary
occupation of tourists related to eco-friendly tourism activities.
13. Construction activities. (a) No new commercial construction of any kind shall be
permitted within the Eco-sensitive Zone:
Provided that, local people shall be permitted to undertake
construction in their land for their residential use including the
activities listed in sub-paragraph (1) of paragraph 3.
(b) The construction activity related to small scale industries not
causing pollution shall be regulated and kept at the minimum,
with the prior permission from the competent authority as per
applicable rules and regulations, if any.
(c) Construction activity in the Eco-sensitive Zone shall be as per
Zonal Master Plan.
14. Felling of trees. (a) There shall be no felling of trees on the forest or Government
or revenue or private lands without prior permission of the
Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the
provisions of the concerned Central or State Act and the rules
made thereunder.
(c) In case of Reserve Forests and Protected Forests the Working
Plan prescriptions shall be followed.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(i) The District Collector, Palakkad - Chairman
(ii) Representative of the District Collector, Thrissur - Member
(iii) The Member of Legislative Assembly, Chelakkara, Tharoor - Member
(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from the
Speaker of Legislative Assembly, Kerala, if required)
(iv) President, District Panchayat, Palakkad – Member
(v) President, District Panchayat, Thrissur – Member
(vi) One representative of Non-Governmental Organisation working in the field of environment to be nominated by
the Government of Kerala for a term of one year in each case – Member
(vii) One expert in the area of ecology and environment from a reputed institution of University in the State to be
nominated by the Government of Kerala for a term of one year in each case – Member
(viii) Kerala Pollution Control Board, District Officer, Palakkad – Member
(ix) Concerned Divisional Forest Officer (Territorial) – Member
(xi) The Wildlife Warden, Peechi Wildlife Divsion – Member-Secretary
6. Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this
notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior
environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are
falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under
paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific
conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-
charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986
against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry Associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per proforma given in
Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.

BOUNDARY OF THE CHULANNUR ECO-SENSITIVE ZONE
North Boundary starts from a point on the northwest (N 10˚ 43’ 49.2” and E 76˚ 27’ 49.8”) and runs along
eastwards across Chozhiyankode-Plavichode road; then runs along the private lands and paddy fields of
Thiruvillamala Village and then crossing district boundary of Thrissur and Palakkad districts and
Naduvathppara-Chulannur road; then run eastwards through the private elands and paddy fields of18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Peringottukurussi Village and it ends at Ayakurissi (N 10˚ 43’ 41.5” and E 76˚ 29’ 32.4”); and extends to
a length of 4.27 km, here the width of Eco-sensitive Zone is 100m.
East Starts from Ayakurissi (N 10˚ 43’ 41.5” and E 76˚29’32.4”) and runs southwards through the Private
lands of Tholannur and Peringottukurussi Village and reaches a point (N 10˚ 43’ 30.2”) and E 76˚ 29’
54.6”) near Kuriyilpadi and extends to a length of 400m with a zonal width of 100m.
South Starts from Kuriyilapadi (N 10˚ 43’ 30.2” and E 76˚ 29’ 54.6”); runs westward through the paddy fields
and private lands of Meppadam of Peringottukurussi Village and reaches Cheerathukulamb Vested forest
of Alathur range; runs along the boundary of vested forest and it reaches Chadachikunnu; then runs
through the paddy fields and private lands of Chulannur; Chilambathodi, Iruvilamkad, Erukulam and it
reaches Meenikode (N 10˚ 42’ 51.2” and E 76˚ 27’ 28.5”); it extends to a length of 9.24 km with
maximum zonal width of 990 m.)
West 100 meter width to a distance of 500 m; Starts from Meenikode (N 10˚ 42’ 51.2” and E 76˚ 27’ 28.5”);
towards the north direction through the private lands and paddy fields of Meenikode, Kattiyanchira and
then reaches the vested forest of Wadakkanchery range at Theendanpara; along the boundary of vested
forest and reaches at Chozhiyankode of Thiruvillamala village; and it ends at a northwest point near
Choziyandode (N 10˚ 43’ 49.2” and E 76˚ 27’ 49.8”).
