1850.43 मीटर तक के िव+ता रत (cid:29)े5 को जFम-ू क;मीर राnय म = रामनगर व(cid:21)यजीव अभयारEय पा रि+थितक(cid:30)य संवेदी जोन

रामनगर व(cid:21)यजीव अभयारEय क(cid:30) सीमा के साथ जीपीएस िनदशu ाकं िब(cid:21)द ुउउउउपपपपााााबबबबधधंंधधंं IIII के 0प म= उपाबA ह ै।
(2) पा रि+थितक संवेदी जोन का सीमा के 6यौर& तथा अ(cid:29)ांश और दशे ातं र सिहत मानिच5 उउउउपपपपााााबबबबधधंंधधंं IIIIIIII के 0प म =
उपाबA ह ै।

के िलए राजप5 म = इस अिधसचू ना के अिं तम (cid:17)काशन क(cid:30) तारीख स ेदो वष(cid:9) क(cid:30) अविध के भीतर, +थानीय <ि%य& के परामश (cid:9)
से, और इस अिधसूचना म= (cid:1)दए गए अनुबंध& का पालन करते )ए आंचिलक महायोजना तैयार करेगी ।
(2) आचिं लक महायोजना का अनमु ोदन राnय सरकार म =स(cid:29)म (cid:17)ािधकारी "ारा (cid:1)कया जाएगा ।
(3) पा रि+थितक संवेदी जोन के िलए आचं िलक महायोजना राnय सरकार "ारा ऐसी रीित जैसा इस अिधसूचना म =
िविनBद> ह ै और ससु ंगत के(cid:21)(cid:22)ीय और राnय िविधय& तथा के(cid:21)(cid:22)ीय सरकार "ारा जारी माग(cid:9)दश(cid:9)क िसAांत&, य(cid:1)द कोई हो, के
अनु0प भी तैयार क(cid:30) जाएगी ।
(4) आंचिलक महायोजना सभी संबA राnय िव भाग& के साथ परामश(cid:9) स े पयाव(cid:9) रणीय और पा रि+थितक िवचारण& को
उसम= एक(cid:30)कृत करन ेके िलए तयै ार क(cid:30) जाएगी, अथा(cid:9)त्:--
(i) पया(cid:9)वरण ;
(ii) वन ;
(iii) नगर िवकास ;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(iv) पय(cid:9)टन ;
(v) नगरपािलका ;
(vi) राज+व ;
(vii) कृिष ;
(viii) िहमाचल (cid:17)दशे राnय (cid:17)दषू ण िनयं5ण बोड (cid:9);
(ix) xसचाई;
(x) लोक िनमा(cid:9)ण िवभाग ।
(5) आंचिलक महायोजना अनमु ो(cid:1)दत िवkमान भ-ू उपयोग, अवसंरचनाU मक और (cid:1)yयाकलाप& पर कोई िनबzधन
अिधरोिपत नहt करेगी जब तक (cid:1)क इस अिधसूचना म= इस (cid:17)कार िविनBद> न हो और आंचिलक महायोजना सभी अवसंरचना
और (cid:1)yयाकलाप& म= द(cid:29)ता और पा रि+थितक अनकु ूलता का सवं Aन(cid:9) करेगी ।
(6) आंचिलक महायोजना म = अनाZछा(cid:1)दत (cid:29)े5& के जीण{Aार, िवkमान जल िनकाय& के संर(cid:29)ण, आवाह (cid:29)े5& के
(cid:17)बंधन, जल-संभर& के (cid:17)बंधन, भूतल जल के (cid:17)बंधन, मदृ ा और नमी संर(cid:29)ण, +थानीय समुदाय& क(cid:30) आव;यकता| तथा
पा रि+थितक और पया(cid:9)वरण स ेसंबंिधत ऐस ेअ(cid:21)य पहलू|, िजन पर }यान दने ा आव;यक ह,ै के िलए उपबंध ह&गे ।
(7) आंचिलक महायोजना सभी िवkमान पूजा + थल&, _ाम& और नगरीय बि+ तय&, वन& के (cid:17)कार और (cid:1)क+म &, कृिष
(cid:29)े5&, ऊपजाऊ भिू म, ह रत (cid:29)5े जैसे उkान और उसी (cid:17)कार के +थ ान, उkान कृिष (cid:29)े5, आBकड&, झील& और अ(cid:21)य जल
िनकाय& का अ(cid:127)यकंन करेगी ।
(8) आंचिलक महायोजना पा रि+थितक संवेदी जोन म= िवकास को िविनयिमत करेगी िजससे (cid:1)क +थ ानीय समुदाय& के
पा रि+थितक ज(cid:21)य िवकास और जीिवका को सुिनि; चत (cid:1)कया जा सके ।
(9) जFमू-क;मीर राnय क(cid:30) सरकार, उसक(cid:30) अिध कारता के अधीन आन े वाले (cid:29)े5 के िलए पथृ क आंचिलक महायोजना
तैयार करेगी।

िन(cid:12)िलिखत उपाय करेगी, अथा(cid:9)त ्:-
(1) भभभभ--ूू--ूू उउउउपपपपययययोोोोगगगग ---- पा रि+थ ितक संवेदी जोन म = वन&, उkान-कृिष (cid:29)े5&, कृिष (cid:29)े5&, आमोद-(cid:17)मोद के (cid:17)योजन के िलए
िचि(cid:21)हत (cid:1)कए गए पाकl और खुल े +थान& का वािणिnयक और औkोिगक संबA िवकास (cid:1)yयाकलाप& के िलए उपयोग या
संप रवतन(cid:9) नहt होगा :
परंत ु पा रि+थितक संवेदी जोन के भीतर कृिष भिू म का संप रवत(cid:9)न के अधीन मानीटरी सिमित क(cid:30) िसफा रश पर और
राnय सरकार के पूव(cid:9) अनमु ोदन स,े +थानीय िनवािसय& क(cid:30) आवासीय ज0रत& को पूरा करन ेके िलए और पैरा 4 क(cid:30) सारणी के
+तंभ (2) के अधीन मद सं. 10, 21, 29, 33 और 34 के सामन े सूचीबA (cid:1)yयाकलाप& को पूरा करन े के िलए अन(cid:128)ु ात ह&गे,
अथा(cid:9)त ्:-
(i) पा रि+थितक अनकु ूल पय(cid:9)टन (cid:1)yयाकलाप& के िलए पय(cid:9)टक& के अ+थ ायी आवासन के िलए पा रि+थितक अनकु ूल
आरामगाह जैस ेट=ट, लकड़ी के मकान आ(cid:1)द ;
(ii) िवkमान सड़क& को चौड़ा और सुदढ़ृ करना ;
(iii) (cid:17)दषू ण उUप(cid:129) न करन ेवाल ेलघ ुउkोग;
(iv) कुटीर उkोग, िजसके अंतग(cid:9)त _ामीण उkोग, सुिवधा भंडार और +थानीय सुिवधाए ंसिFमिलत ह;9 और

परंत ु यह और (cid:1)क राnय सरकार के पूव(cid:9) अनमु ोदन और संिव धान के अनZु छ ेद 244 तथा तUसमय (cid:17)वृ# िविध के उपबंध&
के अनुपालन के िबना, िजसके अंतग(cid:9)त अनुसिू चत जनजाित और अ(cid:21)य परंपरागत वन िनवासी (वन अिधकार& क(cid:30) मा(cid:21)यता)
अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिnयक या उkोग िवकास (cid:1)yयाकलाप& के िलए जनजातीय भूिम का उपयोग
अनु(cid:128)ात नहt होगा :
परंत ु यह और भी (cid:1)क पा रि+थितक संवेदी जोन के भीतर भ-ू अिभलेख& म = उपसंजात कोई 5ु ट मानीटरी सिमित के
िवचार (cid:17)ा: करने के पRात ् राnय सरकार "ारा (cid:17)Uयके मामल े म = एक बार संशोिधत होगी और उ% 5ु ट के संशोधन क(cid:30)
के(cid:21)(cid:22)ीय सरकार के पया(cid:9)वरण, वन और जलवाय ुप रवत(cid:9)न मं5ालय को सूचना दने ी होगी ।
परंत ुयह और भी (cid:1)क उपयु(cid:9)% 5ु ट का संशोधन म =इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म =भ-ू
उपयोग का प रवत(cid:9)न सिFमिलत नहt होगा ।
परंत ु यह और भी (cid:1)क िजससे ह रत (cid:29)े5 म = जैस े वन (cid:29)े5, कृिष (cid:29)े5 आ(cid:1)द म= कोई पा रणािमक कटौती नहt होगी और
अन(cid:17)युQत या अनUु पादक कृिष (cid:29)े5& म =पुन: वनीकरण करन ेके (cid:17)यास (cid:1)कए जाएंगे ।

पुन(cid:18)(cid:131)भूतकरण के िलए योजना सिFम िलत होगी और राn य सरकार "ारा ऐसे (cid:29)े5& पर या उनके िनकट िवकास (cid:1)yयाकलाप
(cid:17)ितिषA करन ेके िलए ऐसी रीित स ेमाग(cid:9)िनदशu तैयार (cid:1)कए जाएंगे ।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन –––– (क) पा रि+थितक संवेदी जोन के भीतर पय(cid:9)टन संबंधी (cid:1)yयाकलाप पय(cid:9)टन महायोजना के अनुसार ह&गे जो (cid:1)क
आंचिलक महायोजना के भाग 0प म =होगी ।
(ख) पयट(cid:9) न महायोजना पय(cid:9)टन िवभाग "ारा जFम-ू क;मीर राnय क(cid:30) सरकार के वन और पयाव(cid:9) रण िवभाग के परामश (cid:9)स े
तैयार क(cid:30) जाएगी ।
(ग) पय(cid:9)टन संबंधी (cid:1)yयाकलाप िनFन िलिखत के अधीन िविनयिमत ह&गे, अथा(cid:9)त् :-
(i) पा रि+थितक संवेदी जोन के भीतर सभी नए पय(cid:9)टन (cid:1)yयाकलाप& या िवkमान पय(cid:9)टन (cid:1)yयाकलाप& का िव+तार
क=(cid:22) सरकार के पया(cid:9)वरण, वन और जलवाय ु प रवतन(cid:9) मं5ालय के माग(cid:9)दशक(cid:9) िसAांत& के "ारा तथा रा2 eीय (cid:132) या(cid:133)
संर(cid:29)ण (cid:17)ािधकरण, "ारा जारी पा रि+थितक पय(cid:9)टन (समय-समय पर यथा संशोिधत) माग(cid:9)दशक(cid:9) िसAांत& के
अनसु ार, पा रि+थितक पय(cid:9)टन, पा रि+थितक िश(cid:29)ा और पा रि+थितक िवकास को महUव दते े )ए पा रि+थितक
संवेदी जोन क(cid:30) वहन (cid:29)मता के अ}ययन पर आधा रत होगा;
(ii) पा रि+थितक अनकु ूल पयट(cid:9) क (cid:1)yयाकलाप& के संबंध म = अ+थायी अिधभोग के िलए वास सुिवधा के िसवाय
रामनगर व(cid:21)यजीव अभयारEय क(cid:30) सीमा स े एक (cid:1)कलोमीटर भीतर होटल और रसोटl का नया संिनमाण(cid:9) अनु(cid:128)ात
नहt होगा ;
परंतु सरं ि(cid:29)त (cid:29)े5 क(cid:30) सीमा स ेएक (cid:1)कलोमीटर क(cid:30) दरू ी स े परे पा रि+थितक संवेदी जोन क(cid:30) सीमा तक नए
होटल और रसोट(cid:9) क(cid:30) +थापना पय(cid:9)टन महायोजना के अनसु ार पा रि+थितक पय(cid:9)टन सुिवधा के िलए पूव (cid:9) प रभािषत
और िविनBद> +थान म= ही अन(cid:128)ु ात (cid:1)कया जाएगा ।
(iii) आंचिलक महायोजना का अनमु ोदन (cid:1)कए जान े तक, पय(cid:9)टन के िलए िवकास और िवkमान पय(cid:9)टन (cid:1)yयाकलाप&
के िव+तार को वा+तिवक +थल िविनBद> संवी(cid:29)ा तथा मानीटरी सिमित क(cid:30) िसफा रश पर आधा रत संबंिधत
िविनयामक (cid:17)ािधकरण& "ारा अनु(cid:128)ात (cid:1)कया होगा ।
(4) ननननससैैससैै $$$$गगगगकककक ििििववववररररााााससससतततत -------- पा रि+थितक संवेदी जोन म = महUवपूण(cid:9) नैस1गक िवरासत के सभी +थल& जैसे सभी जीन कोश

NOTIFICATION
New Delhi, the 18th March, 2016
S.O. 1167(E).—The following draft of the notification, which the Central Government proposes to
issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby
published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the
information of the public likely to be affected thereby; and notice is hereby given that the said draft
notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on
which copies of the Gazette containing this notification are made available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period
so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran

Draft Notification
Whereas, the Ramnagar Wildlife Sanctuary located on the Northern side of Jammu city. The
Ramnagar Wildlife Sanctuary covers an area of 12.75 square kilometres. The boundaries of the sanctuary are
as under:
North – Keranwali Rakh
East – River Tawi and Khanpur village
South – Jammu city
West - Settlements of Janipura and Shangan
And whereas, the flora and fauna represent rich biological significance of this sanctuary;
And whereas, the Ramnagar Wildlife Sanctuary is known for habitat of large number of herbivores
and rich biodiversity of avifauna. The principal species include Common Indian Leopard, Rhesus Macaque,
Barking Deer, Wild Boar, Nilgai, Porcupine, Red Jungle foul, Pea Fowl, Python, Russel Viper (Cobra)
Partridges and other avian species. Besides being important from wildlife conservation point of view, this area
is ecologically very important being in the close proximity of Jammu city and it also forms catchment of River
Tawi;
The Ramnagar Wildlife Sanctuary area falls under Group 9 (C-1) Northern Dry Mixed Decidous
Forest. The area is covered by dense mixed scrub forest with occasional Chir (Pinus roxburghii) trees. Acacia
modesta (Phullai) predominated the area. Other common species are Acacia catechu (Khair), Bombax ceiba
(Silk cotton tree), Cassia fistula (Amaltas), Acacia arabica (Baul), Dalbergia sissoo (Shisham), Mallotus
phellipinensis, and Grewia optiva and few other species are Adhatoda vasica, Adinia cardifolia (Haldu), Aegle
marmelos (Bel), Ageratum conyzoides (Goat Weed), Albizia labbeck (Siris), Bauhinia purpuria (Khanwal),
Calotropis procera (Aak), Cascuta reflexa (Dodder), Toona ciliata (Toon);
And Whereas, it is necessary to conserve and protect the area the extent and boundaries of which is
specified in paragraph 1 of this notification around the protected area of Ramnagar Wildlife Sanctuary as Eco-
Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or
class of industries and their operations and processes in the said Eco-sensitive Zone;
Now Therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of
sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read
with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby
notifies the area with an extent up to 1850.43 meters around the boundary of Ramnagar Wildlife Sanctuary in
the State of Jammu and Kashmir as the Ramnagar Wildlife Sanctuary Eco-sensitive Zone (herein after
referred to as the Eco-sensitive Zone) details of which are as under, namely:-¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
1. Extent and boundaries of Eco-sensitive Zone.- (1) The extent of Eco-sensitive Zone is 1850.43 meter
around the Ramnagar Wildlife Sanctuary. There is no village falling in the in Eco-Sensitive Zone area. The
Global Positioning System Co-ordinates of points along the boundary of Ramnagar Wildlife Sanctuary is
appended as Annexure-I.
(2) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is
appended as Annexure-II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of
the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of
publication of final notification in the Official Gazette, in consultation with local people and adhering to the
stipulations given in this notification.
(2) The Zonal Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government
in such a manner as is specified in this notification and also in consonance with the relevant Central
and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State
Departments, namely:-
(i) Environment,
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue,
(vii) Agriculture,
(viii) Jammu and Kashmir State Pollution Control Board,
(ix) Irrigation,
(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restrictions on the approved existing land use,
infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall
factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing
water bodies, management of catchment areas, watershed management, groundwater management,
soil and moisture conservation, needs of local community and such other aspects of the ecology and
environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban
settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such
as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-
friendly development for livelihood security of local communities.
(9) The Government of Jammu and Kashmir shall prepare separate Zonal Master Plans for area
under their jurisdiction.
3. Measures to be taken by State Government.-The State Government shall take the following
measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for
recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on
the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to
meet the residential needs of local residents, and for the activities listed against serial numbers 10, 21, 29, 33
and 34 in column (2) of the table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-
friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial
development activities without the prior approval of the State Government and without compliance of the
provisions of article 244 of the constitution or the law for the time being in force, including the Scheduled
Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be
corrected by the State Government after obtaining the views of Monitoring Committee, once in each case and
the correction of said error shall be intimated to the Central Government in the Ministry of Environment,
Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except
as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and
agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be
drawn up by the State Government in such a manner as to prohibit development activities at or near these
areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per
Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Jammu and
Kashmir in consultation with Department of Forests and Environment of the State Government of Jammu and
Kashmir.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone
shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment,
Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority,
(as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based
on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary
of the Ramnagar Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to
eco-friendly tourism activities:
Provided that, beyond the distance of one kilometre from the boundary of the protected areas till the
extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-
defined and designated area for eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny
and recommendation of the Monitoring Committee.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the
gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs,
etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within
six months from the date of publication of this notification and such plan shall form part of the Zonal Master
Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical,
architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for
their conservation shall be prepared within six months from the date of publication of this notification and
incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Jammu & Kashmir
State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the
Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act,
1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government or Jammu and Kashmir
State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the
Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act,
1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in
accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and
the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of
the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the
Government of India in the erstwhile Ministry of Environment and Forests vide notification
number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into bio-
degradable and non-bio-degradable components;
(iii) the bio-degradable material shall be recycled preferably through composting or
vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site
identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be
permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried
out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the
Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O.
630(E), dated the 20th July, 1998 as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly
manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time
as the Zonal Master Plan is prepared and approved by the competent authority in the State Government,
Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the
rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-
sensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed
Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the
Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of

sensitive Zone all new tourism activities or expansion of existing
activities would in conformity with the Tourism Master Plan and
National Tiger Conservation Authority guidelines.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted
within one kilometer from the boundary of the protected area:
Provided that local people shall be permitted to undertake
construction in their land for their residential use including the
activities listed in sub-paragraph (1) of paragraph 3;
(b) the construction activity related to small scale industries not
causing pollution shall be regulated and kept at the minimum with the
prior permission from the competent authority as per applicable rules
and regulations, if any;
(c) beyond one kilometer upto the extent of Eco-Sensitive Zone
construction for bone fide local needs shall be permitted and other

(d) construction activity in the Eco-sensitive Zone shall be as per
Zonal Master Plan.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for
effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(a) Collector, Jammu - Chairman
(b) An expert in the area of ecology and environment - Member
to be nominated by the Government of Jammu and Kashmir
for a period of one year, in each case
(c) One representatives of Non-Governmental Organisation - Member
working in the field of environment including heritage
conservation to be nominated by the Government of
Jammu and Kashmir for a period of one year.
(d) Regional Officer, Jammu and Kashmir State Pollution Control Board - Member
(e) Divisional Forest Officer cum Wildlife Warden, Jammu - Member-Secretary
6. Terms of Reference.—(1) The Monitoring Committee shall monitor the compliance of the provisions of
this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006,
and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in the table
under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual
site-specific conditions and referred to the Central Government in the Ministry of Environment,
Forest and Climate Change for prior environmental clearances under the provisions of the said
notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in
the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September,
2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in the
table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the
actual site-specific conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned
Park in-charge shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry associations or concerned stakeholders to assist in its deliberations
depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st
March of every year by 30th June of that year to the Central Government in the Ministry of
Environment, Forest and Climate Change as per pro-forma given in Annexure III.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such

7. The Central Government and State Government may specify additional measures, if any, for giving effect
to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the
Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
