(ii) वन ; (iii) शहरी िवकास ; (iv) पय(cid:20)टन ; (v) नगरपािलक ; (vi) राज’ व ; (vii) कृिष ; (viii) कना(cid:20)टक राM य (cid:11)दषू ण िनयं-ण बोड;(cid:20) (ix) Sसचाई; और (x) लो क िनम ा(cid:20)ण िव भाग, (5) आंचिलक महायोजना अनुमो(cid:1)दत िवEमान भ-ू उपयोग, अवसंरचना और (cid:1)mयाकलाप" पर कोई िनबnधन अिधरोिपत नहo करेगी जब तक (cid:1)क इस अिधसूचना म 7 िविन?दYट न हो और आचंिलक महायोजना सभी अवसंरचना और (cid:1)mयाकलाप" म7 और अिधक द(cid:26)ता और पा(cid:28)रि’थ ितक(cid:27)य अनुकूलता का संवध(cid:20)न करेगी । (6) आंचिलक महायोजना म 7 अना=छा(cid:1)दत (cid:26)े-" के जीणcVार, िवEमान जल िनकाय" के संर(cid:26)ण, आवाह (cid:26)े-" के (cid:11)बंधन, जल-संभर" के (cid:11)बंधन, भूतल जल के (cid:11)बंधन, मृदा और नमी संर(cid:26)ण, ’थानीय समुदाय" क(cid:27) आवeयकताO तथा पा(cid:28)रि’थितक और पया(cid:20)वरण से संबंिधत ऐसे अ(cid:17)य पहलOु , िजन पर pयान देना आवeयक ह,ै के िलए उपबंध ह"ग े । (7) आंचिलक महायोजना सभी िवEमान पूजा ’थ ल", ^ाम" और नगरीय बंदोब’त", वन" के (cid:11)कार और (cid:1)क’म ", कृिष (cid:26)े-", ऊपजाऊ भूिम, ह(cid:28)रत (cid:26)-े जैसे उEान और उसी (cid:11)कार के ’थ ान, उEान कृिष (cid:26)े-, फलोEान, झील" और अ(cid:17)य जल िनकाय" का अqयकंन करेगी । (8) आंचिलक महायोजना ’ थानीय समुदाय" क(cid:27) जीवकोपाज(cid:20)न को सुिनिeच त करने के िलए, पा(cid:28)रि’थितक संवेदी जोन म7 िवकास को पा(cid:28)रि’थक अनुकूल िवकास के िलए िविनयिमत करेगी। (9) आंचिलक महायोजना ’थ ानीय समुदाय" क(cid:27) जीवकोपाज(cid:20)न को सुिनिeच त करन े का सुिनe च य करेगी । 3. रररराााा(cid:31)(cid:31)(cid:31)(cid:31)यययय ससससररररककककाााारररर ाााारररराााा !!!!ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेे ेे उउउउपपपपाााायययय-------- राMय सरकार इस अिधसूचना के उपबंध" को (cid:11)भावी करने के िलए िन(cid:8)िलिखत उपाय करेगी, अथा(cid:20)त ् :-- (1) भभभभ--ूू--ूू उउउउपपपपययययोोोोगगगग ---- पा(cid:28)रि’ थितक संवेदी जोन म 7 वन", उEान-कृिष (cid:26)े-", कृिष (cid:26)े-", आमोद-(cid:11)मोद के (cid:11)योजन के िलए िचि(cid:17)हत (cid:1)कए गए पाकr और खुल े ’थान" का वािणिMयक और औEोिगक संबV िवकास (cid:1)mयाकलाप" के िलए उपयोग या संप(cid:28)रवत(cid:20)न नहo होगा : परंत ु पा(cid:28)रि’थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:28)रवत(cid:20)न, मानीटरी सिमित क(cid:27) िसफा(cid:28)रश पर और राMय सरकार के पूव (cid:20) अनुमोदन से, ’थानीय िनवािसय" क(cid:27) आवासीय ज(cid:13)रत" को पूरा करन े के िलए और पैरा 4 क(cid:27) सारणी के ’तभं (2) म7 mम स.ं 10, 18, 24, 30 और 31 के अधीन (cid:1)mयाकलाप" को पूरा करने के िलए अनुsात होगा, अथा(cid:20)त ्:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) पा(cid:28)रि’थितक अनुकूल पय(cid:20)टन (cid:1)mयाकलाप" के िलए पय(cid:20)टक" के अ’थ ायी आवासन के िलए पा(cid:28)रि’थ ितक(cid:27) अनुकूल आरामगाह जैसे ट7ट, लकड़ी के मकान आ(cid:1)द ; (ii) िवE मान सड़क" को चौड़ा करना और सुदढ़ृ करना; (iii) (cid:11)दषू ण उXपf न करन े वाले लघु उEोग; (iv) कुटीर उEोग, िजसके अंतग(cid:20)त ^ामीण उEोग, सुिवध ाजनक भंडार और ’थ ानीय सुिवध ाएं भी ह;1 और (v) वषा (cid:20) जल संचय : परंत ु यह और (cid:1)क राMय सरकार के पूव (cid:20) अनुमोदन और संिवध ान के अन=ु छ ेद 244 तथा तXसमय (cid:11)वृ(cid:31) िविध के उपबंध" के अनुपालन के िबना, िजसके अतं ग(cid:20)त अनुसूिचत जनजाित और अ(cid:17)य परंपरागत वन िनवासी (वन अिधकार" क(cid:27) मा(cid:17)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिMयक या उEोग िवकास (cid:1)mयाकलाप" के िलए जनजातीय भूिम का उपयोग अनुsात नहo होगा : परंत ु यह और भी (cid:1)क पा(cid:28)रि’ थितक संवेदी जोन के भीतर भू-अिभलेख" म 7 उपसंजात कोई -ु(cid:28)ट, इसम7 पैरा 3 म7 िन?दYट मानीटरी सिमित के िवचार (cid:11)ा3 करन े के प4ात ् राMय सरकार (cid:30)ारा (cid:11)Xयेक मामले म 7 एक बार संशोिधत होगी और उ! -ु(cid:28)ट के संशोधन क(cid:27) क7(cid:18)ीय सरकार के पया(cid:20)वरण, वन और जलवायु प(cid:28)रवत(cid:20)न मं-ालय को सूचना दने ी होगी । परंत ु यह और भी (cid:1)क उपयु(cid:20)! -ु(cid:28)ट का संशोधन म 7 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म 7 भू- उपयोग का प(cid:28)रवत(cid:20)न सिPमिलत नहo होगा । परंत ु यह और भी (cid:1)क िजससे ह(cid:28)रत (cid:26)े- म 7 जैसे वन (cid:26)े-, कृिष (cid:26)े- आ(cid:1)द म7 कोई पा(cid:28)रणािमक कटौती नहo होगी और अन(cid:11)यु] त या अनुX पादक कृिष (cid:26)े-" म7 पुन: वनीकरण करन े के (cid:11)यास (cid:1)कए जाएंगे । (2) (cid:15)(cid:15)(cid:15)(cid:15)ााााककककृृृृििििततततकककक जजजजलललल %%%%ोोोोतततत’’’’---- आचंिलक महायोजना म 7 सभी (cid:11)ाकृितक जल uोत" क(cid:27) पहचान क(cid:27) जाएगी और उनके संर(cid:26)ण और पनु gvभूतकरण के िलए योजना सिP मिलत होगी और राMय सरकार (cid:30)ारा ऐस े (cid:26)-े " पर या उनके िनकट िवकास (cid:1)mयाकलाप (cid:11)ितिषV करने के िलए ऐसी रीित से माग(cid:20)िनदkश तयै ार (cid:1)कए जाएंग े । (3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन –––– (क) पा(cid:28)रि’थितक संवेदी जोन के भीतर पय(cid:20)टन संबंधी (cid:1)mयाकलाप, पय(cid:20)टक महायोजना के अनुसार ह"ग,े जो आंचिलक महायोजना का एक भाग बनग7 े । (ख) पय(cid:20)टन महायोजना पय(cid:20)टन िवभाग (cid:30)ारा राM य सरकार के वन और पया(cid:20)वरण िवभाग के परामश(cid:20) से तैयार क(cid:27) जाएगी । (ग) पय(cid:20)टन संबंधी (cid:1)mयाकलाप िनP निलिखत के अधीन िविनयिमत ह"ग,े अथा(cid:20)त ्:- (i) पा(cid:28)रि’थितक संवेदी जोन के भीतर सभी नए पय(cid:20)टन (cid:1)mयाकलाप" या िवEमान पय(cid:20)टन (cid:1)mयाकलाप" का िव’तार क7(cid:18)ीय सरकार के पया(cid:20)वरण, वन और जलवायु प(cid:28)रवत(cid:20)न मं-ालय के माग(cid:20)दश(cid:20)क िसVांत" के (cid:30)ारा तथा पा(cid:28)रि’थितक पय(cid:20)टन राY ‘ीय x याy संर(cid:26)ण (cid:11)ािधकरण, (cid:30)ारा जारी (समय-समय पर यथा संशोिधत) माग(cid:20)दश(cid:20)क िसVांत" के अनुसार, पा(cid:28)रि’थितक पय(cid:20)टन, पा(cid:28)रि’थितक िश(cid:26)ा और पा(cid:28)रि’थितक िवकास को महXव देते %ए पा(cid:28)रि’थितक संवेदी जोन क(cid:27) वहन (cid:26)मता के अpययन पर आधा(cid:28)रत होगा; at: esz-mef@nic.in Draft Notification WHEREAS, Bannerghatta National Park lies between the 12° 34’ and 12° 50’ N latitudes and between 77° 31’ and 77° 38’ E longitudes and spread over an area of 260.51 square kilometre; AND WHEREAS, Bannerghatta National Park, is situated in South-Eastern corner of Karnataka State and borders with Cauvery Wildlife Sanctuary in the South and with Thali, Thali extension, Javalagiri Reserved Forests in the Tamil Nadu State on its South-Eastern boundaries to form a contiguous Wildlife Habitat of nearly–1400 square kilometres with the pockets of intact prime habitat for Elephants and other Wildlife species;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 AND WHEREAS, Bannerghatta National Park as a terminal point on the northern side of “Mysore Elephant Reserve” inhabitates the large Mammal-Asian Elephants that migrate from adjacent Thali reserve Forest of Tamil Nadu State which are contiguous with Cauvery Wildlife Sanctuary. The area has high faunal and floral diversity; AND WHEREAS, Bannerghatta National Park, has breeding population of Elephants and also supports Leopard, Wild dogs, Gaur, Sambar, Chital, Sloth bear, Slender Loris, Oriental white rumped vultuer, Long-billed vulture, Yellow throated bulbul and other important wildlife species; AND WHEREAS, the areas of Bannerghatta National Park are covered by dry deciduous and scrub forests with reverine and moist deciduous habitat in the valleys. The main vegetative species in the areas of Bannerghatta National Park includes Anogeissuslatifolia, Acacia catechu, Acacia leucopholea, Tectonagrandis, Santalum album, Shoreatalura, Azadirachtaindica, Terminiliapaniculata, Terminiliachebula, Terminiliatomentosa, Dalbergialatifolia, Lagerstromialanceolata, Ziziphusjujuba, Dendrocalamusstrictus and others; AND WHEREAS, Bannerghatta National Park is an important watershed area for the river Arkavathi, Suvarnamukhi, Muthyalamadavu hole, Rayathmala hole, Hebbalahalla and Antharagange that joins the river Cauvery; And whereas, it is necessary to conserve and protect the area around Bannerghatta National Park as Eco-sensitive Zone from Ecological and Environmental point of view to protect wildlife and their habitat therein or its environment; NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent variying from 100 meters to 4.5 kilometres around the boundary of Bannerghatta National Park in the State of Karnataka as the Bannerghatta National Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.- (1) The total area of the Eco-sensitive Zone is 268.96 square kilometres with an extent varies from 100 meter to 4.5 kilometres around the boundary of Bannerghatta National Park and the boundary details of such zone are given in Annexure-I. (2) The Eco-sensitive Zone covers a total of 77 villages, 17 hamlets (enclosures) that fall within the boundaries of Bannerghatta National Park as given in Annexure –II All the enclosure areas forms the part of Eco-sensitive Zone. (3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III. (4) Key locations (GPS points) on the eco-sensitive zone boundary as well as on the sanctuary boundary are appended as Annexure-IV. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the competent authority in the State Government. (3) The said Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment, (ii) Forest, (iii) Urban Development,20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) Tourism, (v) Municipal, (vi) Revenue, (vii) Agriculture, (viii) Karnataka Pollution Control Board, (ix) Irrigation, (x) Public Works Department. (6) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (7) The said Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (8) The said Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (9) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities. (10) Adequate publicity shall be given to the provisions of the Zonal Master Plan. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 18, 24,30,31 in column (2) of the Table in paragraph 4, namely:- (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco- friendly tourism activities, (ii) Widening and strengthening of existing roads and construction of new roads. (iii) Small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of Article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within the ESZ from the boundary of the Bannerghatta National Park except for accommodation for temporary occupation of tourists related to Eco- friendly tourism activities: (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Karnataka Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under. (7) Air pollution.- The Environment Department of the State Government or Karnataka Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under. (9) Solid wastes.- Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco- sensitive Zone (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under. (12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco- sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco- sensitive Zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE S. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 3. No new commercial hotels and resorts shall be permitted within the delineated zone from the boundary of the Wildlife Sanctuary or Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to Eco- friendly tourism activities . However, within the Eco-sensitive Zone delineated from the boundary of the Bannerghatta National Park all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan 11. Construction activities. (a) No new commercial construction of any kind shall be permitted within 1 km from the boundary of the Bannerghatta National Park or Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub- paragraph (1) of paragraph 3: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) beyond one kilometre upto the extent of Eco sensitive Zone construction for bona fide local needs shall be permitted and other construction activities shall be regulated as per Zonal Master Plan. 12. Discharge of treated effluents and solid Regulated under applicable laws. waste in natural water bodies or land area. 13. Air and vehicular pollution. Regulated under applicable laws. 14. Noise pollution. Regulated under applicable laws. 15. Extraction of ground water. Regulated under applicable laws. 16. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. Monitoring Committee.- (1) The Central Government for effective monitoring of the Bannerghatta National Park Eco-sensitive Zone, hereby constitutes a Committee for the State of Karnataka to be called the Monitoring Committee,as under:- Monitoring Committee for the State of Karnataka comprising of the following members, namely:- i. Regional Commissioner, Mysore -Chairman¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25 ii. Representative of the Department of Environment, Government of Karnataka -Member; iii. Representative of the Department of Urban Development, Government of Karnataka -Member; iv. Representative of Non-governmental Organisations working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Karnataka for a period of one year -Member; v. The Regional Officer, Karnataka State Pollution Control Board, Mysore -Member; vi. An expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka for a period of one year -Member. vii. Deputy Commissioner or his representative, Bangalore Urban District - Member viii. Deputy Commissioner or his representative, Ramanagara District - Member ix. The Deputy Conservator of Forests, Bannerghatta National Park, Bengaluru - Member Secretary. (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Central Government in the Ministry of Environment, Forest and Climate Change as per proforma given in Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. CHANDINI, Scientist ‘G’ ANNEXURE-I Boundary description of the eco-sensitive zone of the Bannergahatta National Park North: The Boundary of Eco Sensitive Zone of Bannerghatta National Park starts at a point with GPS location 12.844 N, 77.584 Elocated at distance of 100m from the northern most boundary of Bannerghatta National Park in Pillaganahalli Village. The boundary then moves eastwards maintaining a distance of 100 mtrs along the boundary of Bannerghatta National Park and turns southward moving along the eastern boundary of Bannerghatta National Park till it touches the northern junction of Kalkere to Bannerghatta village boundary and moves in south distance along26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the eastern boundary of Bannerghatta Village till it touches the northern most boundary of Gollahalli village and moves north and east boundary of Gollahalli village along the till it touches the Bannerghatta Village boundary and then moves along the east and boundary of Bannerghatta till it touches the northern junction of Bannerghatta and Mantapa village. And then follows the northern and eastern boundary of Mantapa Village. Up till the junction of Manatapa and Bagihalli Village boundary from this point onwards it moves along the northern and eastern boundary of Begihalli Village, till it touches the junction of Begihalli and Bukkasandra Village. Then it moves along the eastern boundary of Bukkasandra Village, Up till touches Kallabalu Village boundary and moves easteward along the northern and eastern boundary of Kallabalu village, till it touches Mahanthalingapura village boundary and runs along the eastern boundary of Mahanthalingapura. Untill it touches the boundary of Kadujakkanahalli village and moves eastward along the Kadujakkanahalli village boundary further it moves southward and westward along the same boundary till it touches the boundary of Bagganadoddi Village. From this point onwards it moves southeast along the boundary of Bagganadoddi Village till it touches the boundary of Indlavadi Village and moves along the northern and eastern boundary of Indlavadi Village till it touches the northern boundary of Indlavadipura. From this point it moves along the eastern boundary of Indlavadipura till it touches the Chikkahosahalli Village boundary and then it moves along the northern and eastern boundary of Chikkahosahalli village until it touches the boundary Thammanayakanahalli. Then it moves along the eastern boundary of Thammanayakanahalli till it touches Tamilnadu Border. East: Then it runs along the Bannerghatta National Park boundary all along the Tamilnadu and Karnataka border untill it reaches the boundary of Therubeedi and then moves westward, southward and eastward along the outer boundary of Therubeedi village. Untill it touches the interstate boundary of Tamilnadu and Karnataka and then again moves southward along the boundary of Bannerghatta National Park until it touches the Gattigunda village boundary and then moves along the eastern boundry of Gatgunda till it touches Kaulagaudanhalli and Bannergjhatta national park trijunction and from this point onwards the boundary of eco-sensitive zone coincides with the park boundary until it touches eastern boundary of Hunsanhalli village. South: The boundary starts at the North Eastern corner of Hunsanhalli Village and moves along the southern boundary of Hunsanahalli, Balagondapahalli, Thattekere and Bainnimkodalu village in continuation including the whole villages till it touches the Bannerghatta National park boundary and moves along this boundary till it touches the boundary of Guddaveeranhosalli village. West: The western boundary starts at GPS location which is at 100 mtrs distance from the Bannerghatta National Park boundary in Guddaveeranahosahalli village and move northwards all along the National Park boundary at a distance of 100 mtrs in Guddeveeranahosahalli and Salbanni village till it touches the junction of Anekadaburu and Bannerghatta National Park boundary from this point onwards in travels along the boundary of Anekadaburu till it touches the tri junction of boundary of Hosadurga, Bannerghatta National Park and Anekadaburu. From this point onwards the boundary line of Eco Sensitive Zone runs parallel to Bannerghatta National Park boundary at a distance 100 mtrs passing through Hosadurga, Bommasandra, Bijahalla, Tipitura, Herandyapanahalli, till it touches the boundary of Hanchaguli village. From here the line travels in western direction along the southern boundaries of Hanchaguli and Halasuru village till it reaches the tri junction of Doddahalli, Bannerghatta National Park and Halasuru and from here line travels parallel to Bannerghatta National Parkboundary at a distance of 100 mtrs through Doddaguli village till it touches Arkere village boundary. From here the line travels eastern along northern boundary of Arkere and later along eastern boundaries of Arkere and Dodkaballi village untill it touches the tri junction of Dadkaballi, Bannerghatta National Park and Garlapura. From this point the line runs parallel to Bannerghatta National Park boundary at a distance of 100 mtrs from it till it reaches the tri junction of Bannerghatta National Park Garalapura and Kebbehalli and then runs up to southern most point of Kebbehalli village. From here the line runs along western boundaries of villages Kebbehalli, Narayanapura, Bekuppe, Kerelellusandra, Chakanahalli, Mavathur, Bacholhallidoddi, Maniyambal, Tokasandra, Hosadoddi, Devanahalli, Doddamanalavadi, Yalachavadi, Kallanakuppe, Kalalagundi, Thatekere and then in continuation along the Southern boundary of Biliganakuppe, Goduru, Attiguppe, Jakkasandra, and then continue along western boundary of Jakkasandra, Gottigehalli, Vaddarapalaya and Thatteguppe. From this point it moves along northern boundary of Thattaguppe¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27 in east directions till it touches the Taralu village boundary and travels along northern boundary of Taralu and Gulakamale till it touches Bhuthanahalli village boundary. From here it travels southward along Gulakamale and Bhuthanahalli village boundary till it touches the point 100 mtrs away from Bannerghatta National Park. From here it travels northward parallel to the Bannerghatta National Park boundary at a distance of 100 metres till it joins the starting point at Pilliganahalli. Annexure-II Bannerghatta National Park consists of the following 83 adjacent villages (or part of the villages) and hamlets as given below all falling under Bangalore South, Anekal and Kanakapura Talukas.
