उपिनयम (3) क(cid:27) अपे(cid:26)ानुसार, जनसाधारण क(cid:27) जानकारी के िलए (cid:11)कािशत क(cid:27) जाती ह;ै िजनके उससे (cid:11)भािवत होने क(cid:27)
संभावना ह ै ; और यह सूचना दी जाती ह ै (cid:1)क उ! (cid:11)ा(cid:13)प अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत

अंितम अिधसूचना के (cid:11)काशन क(cid:27) तारीख से दो वष (cid:20) क(cid:27) अविध के भीतर, ’थानीय 6ि!य" के परामश (cid:20) से और इस अिधसूचना
म7 संलc न अनुबंध" के सामंज’ य से आंचिलक महायोजना तैयार करेगी ।
(2) आंचिलक महायोजना राB य सरकार म7 स(cid:26)म (cid:11)ािधकारी (cid:30)ारा अनुमो(cid:1)दत होगी ।
(3) राBय सरकार (cid:30)ारा पा(cid:28)रि’थ ितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म 7 िविन=दdट
(cid:13)प तथा सुसंगत क7(cid:18)ीय और राB य िविधय" के सामंज’य और क7(cid:18)ीय सरकार (cid:30)ारा जारी माग(cid:20)िनद^श", य(cid:1)द कोई ह", (cid:30)ारा
तैयार होगी ।
(4) आंचिलक महायोजना, पया(cid:20)वरणीय और पा(cid:28)रि’थितक िवचार" को समाकिलत करन े के िलए राBय सरकार के सभी
संब< िवभाग" के परामश (cid:20) से तयै ार होगी, अथा(cid:20)त:्-
(i) पया(cid:20)वरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पय(cid:20)टन ;
(v) नगरपािलक ;
(vi) राज’ व ;
(vii) कृिष ;
(viii) (cid:1)द(cid:3)ली राB य (cid:11)दषू ण िनयं-ण बोड(cid:20) ;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(ix) _सचाई; और
(x) लोक िनमा(cid:20)ण िवभाग ।
(5) आंचिलक महायोजना अनुमो(cid:1)दत िवYमान भ-ू उपयोग, अवसंरचना और (cid:1)fयाकलाप" पर कोई िनबgधन अिधरोिपत
नहh करेगी जब तक (cid:1)क इस अिधसूचना म 7 िविन=दdट न हो और आचंिलक महायोजना सभी अवसंरचना और (cid:1)fयाकलाप" म7
और अिधक द(cid:26)ता और पा(cid:28)रि’थितक अनुकूलता का संवध(cid:20)न करेगी ।
(6) आंचिलक महायोजना म 7 अनाPछा(cid:1)दत (cid:26)े-" के जीणZ<ार, िवYमान जल िनकाय" के संर(cid:26)ण, आवाह (cid:26)े-" के (cid:11)बंधन,
जल-संभर" के (cid:11)बंधन, भूतल जल के (cid:11)बंधन, मृदा और नमी संर(cid:26)ण, ’थानीय समुदाय" क(cid:27) आव\यकता‘ तथा पा(cid:28)रि’थितक
और पया(cid:20)वरण से संबंिधत ऐसे अ(cid:17)य पहल‘ू , िजन पर iयान देना आव\यक ह,ै के िलए उपबंध ह"ग े ।
(7) आंचिलक महायोजना सभी िवYमान पूजा ’थ ल", ]ाम" और नगरीय बंदोब’त", वन" के (cid:11)कार और (cid:1)क’म ", कृिष
(cid:26)े-", ऊपजाऊ भूिम, ह(cid:28)रत (cid:26)-े जैसे उYान और उसी (cid:11)कार के ’थ ान, उYान कृिष (cid:26)े-, फलोधान, झील" और अ(cid:17)य जल
िनकाय" का अjयकंन करेगी ।
(8) आंचिलक महायोजना ’ थानीय समुदाय" क(cid:27) जीवकोपाज(cid:20)न को सुिनि\च त करने के िलए, पा(cid:28)रि’थितक संवेदी जोन म7
िवकास को पा(cid:28)रि’थितक अनुकूल िवकास के िलए िविनयिमत करेगी।
3. रररराााा(cid:24)(cid:24)(cid:24)(cid:24)यययय ससससररररककककाााारररर (cid:25)(cid:25)(cid:25)(cid:25)ाााारररराााा (cid:26)(cid:26)(cid:26)(cid:26)ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेे ेे उउउउपपपपाााायययय-------- राBय सरकार इस अिधसूचना के उपबंध" को (cid:11)भावी करने के िलए
िन(cid:8)िलिखत उपाय करेगी, अथा(cid:20)त:् -
(1) भभभभ--ूू-ू-ू उउउउपपपपययययोोोोगगगग ---- पा(cid:28)रि’ थितक संवेदी जोन म 7 वन", उYान-कृिष (cid:26)े-", कृिष (cid:26)े-", आमोद-(cid:11)मोद के (cid:11)योजन के िलए िचि(cid:17)हत
(cid:1)कए गए पाकk और खुले ’थान" का वािणिBयक और औYोिगक संब< िवकास (cid:1)fयाकलाप" के िलए उपयोग या संप(cid:28)रवत(cid:20)न
नहh होगा:
परंत ु पा(cid:28)रि’थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:28)रवत(cid:20)न, मानीटरी सिमित क(cid:27) िसफा(cid:28)रश पर और राBय
सरकार के पूव (cid:20) अनुमोदन से, ’थानीय िनवािसय" क(cid:27) आवासीय ज(cid:13)रत" को पूरा करन े के िलए और पैरा 4 क(cid:27) सारणी के ’तंभ
(2) के अधीन मद सं0 10, 19, 27,31 और सं. 32 के सामने सूचीब< (cid:1)fयाकलाप" को पूरा करन े के िलए अनुlात ह"ग,े
अथा(cid:20)त:्-
(i) पा(cid:28)रि’थितक अनुकूल पय(cid:20)टन (cid:1)fयाकलाप" के िलए, पय(cid:20)टक" के अ’थ ायी अिधभोग के िलए पा(cid:28)रि’थितक
अनुकूल कुटीर जैस े टे(cid:17)ट, काm गहृ ;
(ii) िवYमान सड़क" को चौड़ा करना तथा उनका सुदढ़ृ ीकरण;
(iii) (cid:11)दषू ण उLपn न करने वाल ेलघु उYोग
(iv) कुटीर उYोग, िजसके अंतग(cid:20)त ]ामीण उYोग, सुिवधा भंडार और ’थ ानीय सुख-सुिवधाएं ह;1 और
(v) वषा (cid:20) जल संचयन ।
परंत ु यह और (cid:1)क जनजातीय भूिम का उपयोग राBय सरकार के पूव (cid:20) अनुमोदन और संिवधान के अनुPछ ेद 244 या
तLसमय (cid:11)वृ(cid:31) िविध के उपबंध" के अनुपालन के िबना, िजसके अंतग(cid:20)त अनुसूिचत जनजाित और अ(cid:17)य परंपरागत वन िनवासी
(वन अिधकार" क(cid:27) मा(cid:17)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिBयक या उYोग िवकास (cid:1)fयाकलाप" के िलए
अनुlात नहh होगा :
परंत ु यह और भी (cid:1)क पा(cid:28)रि’ थितक संवेदी जोन के भीतर भू-अिभलेख" म 7 उपसंजात कोई -ु(cid:28)ट, मानीटरी सिमित के
िवचार (cid:11)ा3 करने के प4ात ्राBय सरकार (cid:30)ारा (cid:11)Lयेक मामले म 7 एक बार संशोिधत होगी और उ! -ु(cid:28)ट के संशोधन क(cid:27) सूचना
क7(cid:18)ीय सरकार के पया(cid:20)वरण, वन और जलवाय ुप(cid:28)रवत(cid:20)न म-ं ालय को देनी होगी ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
परंत ु यह और भी (cid:1)क उपयु(cid:20)! -ु(cid:28)ट का संशोधन म 7 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म 7
भू-उपयोग का प(cid:28)रवत(cid:20)न सिoमिलत नहh होगा ।
परंत ु यह और भी (cid:1)क िजससे ह(cid:28)रत (cid:26)े- म7 जैसे वन (cid:26)े-, कृिष (cid:26)े- आ(cid:1)द म7 कोई पा(cid:28)रणािमक कटौती नहh होगी और
अन(cid:11)युp त या अनुL पादक कृिष (cid:26)े-" म7 पुन: वनीकरण करन े के (cid:11)यास (cid:1)कए जाएंगे ।
(2) (cid:15)(cid:15)(cid:15)(cid:15)ााााककककृृृृििििततततकककक जजजजलललल (cid:31)(cid:31)(cid:31)(cid:31)ोोोोतततत!!!! - आचिं लक महायोजना म 7 सभी (cid:11)ाकृितक जल qोत" क(cid:27) पहचान क(cid:27) जाएगी और उनके संर(cid:26)ण और
पुनbrभूतकरण के िलए योजना सिo मिलत होगी और राBय सरकार (cid:30)ारा ऐसे (cid:26)े-" पर या उनके िनकट िवकास (cid:1)fयाकलाप
(cid:11)ितिष< करन े के िलए ऐसी रीित से माग(cid:20)िनदश^ तैयार (cid:1)कए जाएंगे ।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन –––– (क) पा(cid:28)रि’थितक संवेदी जोन के भीतर पय(cid:20)टन संबंधी (cid:1)fयाकलाप पय(cid:20)टन महायोजना के अनुसार ह"ग े जो (cid:1)क
आंचिलक महायोजना के भाग (cid:13)प म 7होगी ।
(ख) पय(cid:20)टन महायोजना पय(cid:20)टन िवभाग (cid:30)ारा, (cid:1)द(cid:3)ली राBय सरकार के वन और पया(cid:20)वरण िवभाग के परामश (cid:20) से तैयार क(cid:27)
जाएगी ।
(ग) पय(cid:20)टन संबंधी (cid:1)fयाकलाप िनo निलिखत के अधीन िविनयिमत ह"ग,े अथा(cid:20)त ्:-
(i) पा(cid:28)रि’थितक संवेदी जोन के भीतर सभी नए पय(cid:20)टन (cid:1)fयाकलाप" या िवYमान पय(cid:20)टन (cid:1)fयाकलाप" का िव’तार
क7(cid:18) सरकार के पया(cid:20)वरण, वन और जलवायु प(cid:28)रवत(cid:20)न मं-ालय के माग(cid:20)दश(cid:20)क िस<ांत" के (cid:30)ारा तथा राdt ीय uय ाT
संर(cid:26)ण (cid:11)ािधकरण, (cid:30)ारा जारी पा(cid:28)रि’थितक पय(cid:20)टन (समय-समय पर यथा संशोिधत) माग(cid:20)दश(cid:20)क िस<ांत" के
अनुसार, पा(cid:28)रि’थितक पय(cid:20)टन, पा(cid:28)रि’थितक िश(cid:26)ा और पा(cid:28)रि’थितक िवकास को महLव देते %ए पा(cid:28)रि’थितक
संवेदी जोन क(cid:27) वहन (cid:26)मता के अiययन पर आधा(cid:28)रत होगा;
(ii) पा(cid:28)रि’थितक संवेदी जोन के भीतर होटल और सरै गाह" के नए संिनमा(cid:20)ण असोला भाटी व(cid:17)यजीव अभयारEय क(cid:27)
सीमा से एक (cid:1)कलोमीटर के भीतर पा(cid:28)रि’थितक अनुकूल पय(cid:20)टन संब< पय(cid:20)टक" के अ’थायी 6वसाय के िलए आवास
के िलए अनुlात ह"ग े अ(cid:17)यथा नहh ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जाने तक, पय(cid:20)टन के िलए िवकास और िवYमान पयट(cid:20) न (cid:1)fयाकलाप"
के िव’तार को वा’तिवक ’थल िविन=द9 संवी(cid:26)ा तथा मानीटरी सिमित क(cid:27) िसफा(cid:28)रश पर आधा(cid:28)रत संबंिधत
िविनयामक (cid:11)ािधकरण" (cid:30)ारा अनुlात (cid:1)कया होगा ।
(4) ननननससैैससैै $$$$गगगगकककक ििििववववररररााााससससतततत -------- पा(cid:28)रि’थितक संवेदी जोन म 7 महLवपूण (cid:20) नैस8गक िवरासत के सभी ’थल" जैसे सभी जीन कोश
आरि(cid:26)त (cid:26)े-, शैल िवरचनाएं, जल (cid:11)पात", झरन", घाटी मागk, उपवन", गुफाए,ं ’थल", vमण, अwरोहण, (cid:11)पातो आ(cid:1)द क(cid:27)
पहचान क(cid:27) जाएगी और उ(cid:17)ह 7 संरि(cid:26)त (cid:1)कया जाएगा तथा उनक(cid:27) सुर(cid:26)ा और संर(cid:26)ा के िलए इस अिधसूचना के अंितम (cid:11)काशन
क(cid:27) तारीख से छह मास के भीतर, उपयु! योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) ममममााााननननवववव ििििनननन$$$$ममममतततत ििििववववररररााााससससतततत (cid:18)(cid:18)(cid:18)(cid:18)थथथथ लललल ---- पा(cid:28)रि’ थितक संवेदी जोन म 7 भवन", संरचना‘, िश(cid:3)प-तxय, ऐितहािसक, कलाLमक और
सां’कृितक महLव के (cid:26)े-" क(cid:27) पहचान करनी होगी और इस अिधसूचना के अंितम (cid:11)काशन क(cid:27) तारीख से छह माह के भीतर
उनके संर(cid:26)ण क(cid:27) योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म 7 सिoमिलत क(cid:27) जाएगी ।

NOTIFICATION
New Delhi, the 15th June, 2016
S.O.2114(E).-The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified
to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Draft Notification
WHEREAS, the Asola Bhatti Wildlife Sanctuary located in National Capital Territory (NCT) of Delhi is spread over an
area of 19.57 square kilometres. The sanctuary is located between 280 23’00’’ N to 280 30’00’’ N latitude and 77o 11
‘00’’ E to 77o 17’ 00’’ E longitudes.
AND WHEREAS, the flora and fauna represent rich biological significance of this sanctuary and the species found in
the protected area are as Nilgai, Jungle cat, small Indian Civet, Common mongoose, Jackal, Indian porcupine, five
striped palm squirrel, Cheetal, Rufous tailed hare, Rhesus monkey, around 200 species of resident and migratory birds.
The faunal diversity is represented by 17 species of mammals, around 201 species of birds, 12 species of reptiles, 5
species of amphibians, 63 species of butterflies and 05 species of dragonflies.
AND WHEREAS, the sanctuary consists of a mixture of indigenous and exotic species. It is known to harbor around 83
species of trees, around 30 species of shrubs, around 95 species of herbs, around 18 species of grasses and around 4
species of sedges;
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in
paragraph 1 of this notification around the protected area of Asola Bhatti Wildlife Sanctuary as Eco-sensitive Zone from
ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their
operations and processes in the said Eco-sensitive Zone;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2)
and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5
of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent upto one
kilo metre around the boundary of Asola Bhatti Wildlife Sanctuary in the National Capital Territory of Delhi as the Asola
Bhatti Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as
under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be of 15.55 square kilometres
with an extent upto one kilometre around the Asola Bhatti Wildlife Sanctuary. List of villages falling in the in
Eco-sensitive Zone are given at Annexure-I. The Co-ordinates of Asola Bhatti Wildlife Sanctuary and GPS co-
ordinates of points along the boundary of Asola Bhatti Wildlife Sanctuary are given at Annexure-II.
The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as
Annexure-III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The Zonal Master Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a
manner as is specified in this notification and also in consonance with the relevant Central and State laws and
the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments,
namely:-
(i) Environment,
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue,
(vii) Agriculture,
(viii) Delhi State Pollution Control Committee,
(ix) Irrigation,
(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and Eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture
conservation, needs of local community and such other aspects of the ecology and environment that needs
attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements,
types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places,
horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational
purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related
development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities specified under in column (2) of the table in paragraph 4,
namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities,
(ii) widening and strengthening of existing roads and construction of new roads.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
(iii) small scale industries not causing pollution,
(iv) rainwater harvesting, and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the
State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to
such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism
Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests
and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Asola Bhatti Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly
tourism activities:
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene
pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be
identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the
date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical,
architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their
conservation shall be prepared within six months from the date of publication of this notification and incorporated in the
Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Delhi Pollution Control
Committee shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules
made thereunder.
(7) Air pollution.- The Environment Department of the State Government or Delhi Pollution Control
Committee shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules
made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance
with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made

(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of
India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th
March, 2016, as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner
and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal
Master Plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee
shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-
sensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-
sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules
made thereunder, and be regulated in the manner specified in the table below, namely:-

2. Setting up of saw mills. No new or expansion of existing saw mills shall be
permitted within the Eco-sensitive Zone.

Regulated activities
10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted
within one kilometer of the boundary of the protected area
or up to the boundary of the Eco-sensitive Zone whichever
is nearer except for accommodation for temporary
occupation of tourists related to Eco-friendly tourism
activities.
Provided that, beyond one kilometer or up to the extent
of the Eco-sensitive Zone, all new tourism activities or
expansion of existing activities shall be in conformity with
the Tourism Master Plan.
11. Construction activities. (a) No new commercial construction of any kind shall be
permitted within one kilometer from the boundary of the
Eco-sensitive Zone Whichever is nearer.
Provided that, local people shall be permitted to
undertake construction in their land for their residential use
including the activities listed in sub-paragraph (1) of
paragraph 3:
(b) Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the competent authority as per applicable
rules and regulations, if any.
(c) Beyond one kilometer upto the extent of Eco-sensitive
Zone, construction for bone fide local needs shall be
permitted and other construction activities shall be
regulated as per Zonal Master Plan.
12. Trenching ground. Establishing of new trenching ground is prohibited. Old
trenching grounds are to be regulated under applicable
laws.
13. Discharge of treated effluents and solid Regulated under applicable laws.

15. Noise pollution. Regulated under applicable laws.

17. Felling of trees. (a) There shall be no felling of trees in the forest or

permission of the competent authority in the State

(b) the felling of trees shall be regulated in accordance with
the provisions of the concerned Central or State Acts and
the rules made thereunder.
(c) in case of Reserve Forests and Protected Forests the
Working Plan prescriptions shall be followed.
18. Insulation of electric lines. Promote underground cabling. All existing electric lines
passing through the Eco-sensitive Zone shall be adequately
insulated in the time frame prescribed under the Zonal
Master Plan.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(i) Divisional Commissioner - Chairman
(ii) An expert in the area of ecology and environment - Member
to be nominated by the Government of National Capital Territory (NCT) of Delhi
for a period of one year.
(iii) One representatives of Non-Governmental Organisation - Member
(working in the field of environment including heritage
conservation) to be nominated by the Government of
NCT of Delhi for a period of one year.
(iv) Representation of Delhi - Member
Pollution Control Committee
(v) Dy. Conservator of Forests (South), Department of Forests, - Member
and Wildlife, Government of NCT of Delhi.
(vi) Chief Wildlife Warden, department of forests, Delhi - Member Secretary
and Wildlife, Government of NCT of Delhi.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph 4¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior
environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are
falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the table under
paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific
conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park in-
charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986
against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden in the State as per pro forma given in
Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal .
