स(cid:30)म (cid:15)ािधकारी #ारा अनुमो(cid:1)दत होगी । (3) पा!रि,थ ितक संवेदी जोन के िलए आंचिलक महायोजना, राE य सरकार #ारा इस अिधसूचना म; िविनAदH ट (cid:17)प म; ऐसी रीित म; तथा सुसंगत क;(cid:22)ीय और राEय िविधय’ के सामंज, य म; भी तथा क;(cid:22)ीय सरकार #ारा जारी माग(cid:24)िनदशl , य(cid:1)द कोई ह’, #ारा तैयार होगी । (4) आंचिलक महायोजना, इसम; पया(cid:24)वरणीय और पा!रि, थितक(cid:31) िवचार’ को समाकिलत करने के िलए राE य के सभी संब@ िवभाग’ के परामश(cid:24) से तैयार होगी, अथा(cid:24)त्:-- (i) पया(cid:24)वरण ; िवकास के पा!रि, थितक अनुकूल िवकास और , थानीय समुदाय’ क(cid:31) आजीिवका को सुिनिQच त करते *ए िविनयिमत होगी । (9) कना(cid:24)टक राEय सरकार अपनी अिधका!रता के अधीन (cid:30)े1 के िलए पृथक जोनल महायोजना तैयार करेगी । 3. रररराााा(cid:24)(cid:24)(cid:24)(cid:24)यययय ससससररररककककाााारररर (cid:25)(cid:25)(cid:25)(cid:25)ाााारररराााा (cid:26)(cid:26)(cid:26)(cid:26)ककककएएएए जजजजाााानननन ेे ेेववववााााललललेे ेे उउउउपपपपाााायययय-------- राEय सरकार इस अिधसूचना के उपबंध’ को (cid:15)भावी करने के िलए िन(cid:13)िलिखत उपाय करेगी, अथा(cid:24)त् :-- (1) भभभभ---ूू-ूूउउउउपपपपययययोोोोगगगग ---- पा!रि,थ ितक संवेदी जोन म; वन’, उhान-कृिष (cid:30)े1’, कृिष (cid:30)े1’, आमोद-(cid:15)मोद के (cid:15)योजन के िलए िचि(cid:21)हत (cid:1)कए गए पाकi और खुले ,थान’ का वािणिEयक और औhोिगक संब@ िवकास (cid:1)oयाकलाप’ के िलए उपयोग या संप!रवत(cid:24)न नहq होगा : परंतु पा!रि,थितक संवेदी जोन के भीतर कृिष भूिम का संप!रवत(cid:24)न, के अधीन मानीटरी सिमित क(cid:31) िसफा!रश पर और राEय सरकार के पूव(cid:24) अनुमोदन से, ,थानीय िनवािसय’ क(cid:31) आवासीय ज(cid:17)रत’ को पूरा करने के िलए और पैरा 4 क(cid:31) सारणी के ,तंभ (2) के अधीन oम सं. 12, 18, 24, 29 और 32 के सामने सूचीब@ (cid:1)oयाकलाप’ को पूरा करने के िलए अनुuात ह’ग,े अथा(cid:24)त् :- (क) पा!रि,थ ितक(cid:31)य अनुकूल पय(cid:24)टन (cid:1)oयाकलाप’ के िलए पय(cid:24)टक’ के अ, थायी आवासन के िलए पा!रि, थितक(cid:31)य अनुकूल आरामगाह जैसे टट; , लकड़ी के मकान आ(cid:1)द ; (ख) िवhमान सड़क’ को चौड़ा करना और सुदढ़ृ बनाना तथा नई सड़क’ का सन् िनमा(cid:24)ण ; (ग) (cid:15)दषू ण का!रत न करने वाले लघु उhोग ; (घ) वषा(cid:24) जल संचयन; और (ड.) कुटीर उhोग, िजसके अंतग(cid:24)त \ामीण उhोग, सुिवधा भंडार और , थानीय सुख-सुिवधाएं ह 5: परंतु यह और भी (cid:1)क राEय सरकार के पूव(cid:24) अनुमोदन और संिवधान के अनुr छेद 244 या तIसमय (cid:15)वृ$ िविध के उपबंध’ के अनुपालन के िबना, िजसके अंतग(cid:24)त अनुसूिचत जनजाित और अ(cid:21)य परंपरागत वन िनवासी (वन अिधकार’ क(cid:31) मा(cid:21)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिEयक या उhोग िवकास (cid:1)oयाकलाप’ के िलए जनजातीय भूिम का उपयोग अनुuात नहq होगा : परंतु यह और भी (cid:1)क पा!रि,थ ितक संवेदी जोन के भीतर भू-अिभलेख’ म; पाई जाने वाली कोई 1ु!ट मानीटरी सिमित के िवचार (cid:15)ा7 करने के प8ात् राEय सरकार #ारा (cid:15)Iयेक मामले म; केवल एक बार संशोिधत होगी और उ& 1ु!ट के संशोधन क(cid:31) भारत सरकार के पया(cid:24)वरण, वन और जलवायु प!रवत(cid:24)न मं1ालय को सूचना दने ी होगी : परंतु यह और भी (cid:1)क उपयु(cid:24)& 1ु!ट के संशोधन म; इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म; भू-उपयोग का प!रवत(cid:24)न सिwमिलत नहq होगा : परंतु यह और भी (cid:1)क ह!रत (cid:30)े1 जैसे वन (cid:30)े1, कृिष (cid:30)े1 म; कोई पा!रणािमक कटौती नहq होगी और अ(cid:15)यु(cid:7) त या अनुI पादक कृिष (cid:30)े1’ म; सभी (cid:15)ाकृितक xोत’ क(cid:31) पहचान क(cid:31) जाएगी और उनके संर(cid:30)ण और पुनन(cid:24)वीकरण के िलए योजना सिwम िलत होगी और राEय सरकार #ारा ऐसे (cid:30)े1’ पर या उनके िनकट िवकास (cid:1)oयाकलाप (cid:15)ितिष@ करने के िलए ऐसी रीित से माग(cid:24)िनदlश तैयार (cid:1)कए जाएंगे । (3) पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा!रि,थितक संवेदी जोन के भीतर पय(cid:24)टन संबंधी (cid:1)oयाकलाप, पय(cid:24)टन महायोजना के अनुसार ह’ग,े जो आंचिलक महायोजना का भाग (cid:17)प ह’गे । (ख) पय(cid:24)टन महायोजना पय(cid:24)टन िवभाग, कना(cid:24)टक सरकार #ारा राज, व और वन िवभाग, कना(cid:24)टक सरकार के परामश(cid:24) से तैयार होगी । (ग) पय(cid:24)टन संबंधी (cid:1)oयाकलाप िनw निलिखत के अधीन िविनयिमत ह’गे, अथा(cid:24)त् :- (i) पा!रि,थितक संवेदी जोन के भीतर सभी नए पय(cid:24)टन (cid:1)oयाकलाप’ या िवhमान पय(cid:24)टन (cid:1)oयाकलाप’ का िव,तार के(cid:21)(cid:22) सरकार के पया(cid:24)वरण, वन और जलवायु प!रवत(cid:24)न मं1ालय #ारा जारी माग(cid:24)िनदशे ’ तथा राH fीय y याz संर(cid:30)ण (cid:15)ािधकरण #ारा जारी पय(cid:24)टन माग(cid:24)िनदशे ’ के अनुसार होगा िजसम; पा!रि,थितक पय(cid:24)टन, पा!रि,थितक िश(cid:30)ा और पा!रि,थितक िवकास को महIव (cid:1)दया जाएगा और पा!रि,थितक संवेदी जोन क(cid:31) वहन (cid:30)मता के अGययन पर आधा!रत होगा; (ii) मूनकांिबका व(cid:21)य जीव अभयारCय क(cid:31) एक (cid:1)कलोमीटर सीमा के भीतर होटल’ और !रसाटi के नए संिनमा(cid:24)ण अनुuात नहq ह’गे िसवाय पा!रि,थ ितक अनुकूल पय(cid:24)टन (cid:1)oयाकलाप’ के संबंध म; Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Any person interested in making any objections or suggestions on the Draft Notification Whereas, the Mookambika Wildlife Sanctuary has been named after goddess “Mookambika” the presiding deity of the famous Mookambika temple at Kollur located in the heart of the Wildlife Sanctuary and situated in Kundapur Taluk of Udupi district in Karnataka state and lies between 13o 42’ and 13 o 59’ North Latitude and 74o 39’ to 74o 50’ East Longitude and spread over an area of 394.65 sq. km. and notified vide Government of Karnataka vide Notification number AFD.48.FWL.74 dated the 22nd May, 1978. And whereas, the Mookambika Wildlife Sanctuary spreads across the Western slopes of Western Ghats and the terrain is generally hilly and undulating. The altitude of the Wildlife Sanctuary varies from 50 meters above Mean Sea Lever at Idur near Jannalane RF to 1343 meters above Mean Sea Lever at Kodachadri. The distribution of rainfall at Mookambika Wildlife Sanctuary is very uneven, but it receives torrential downpour from the South-West monsoon and the annual average precipitation is close to 6000 millimetre. And whereas, with the above mentioned terrain, elevation and rainfall distribution, the forest types of Mookambika Wildlife Sanctuary varies from Moist Deciduous Forest at the lower altitude of foot hills to West Coast Semi-Evergreen forest and West Coast Tropical Evergreen Forest at mid-altitude to Shola Grass land at higher altitude. Thus the major forest types of Mookambika Wildlife Sanctuary are West Coast Tropical Evergreen Forest (1A/C4), West Coast Semi- Evergreen forest (2A/C2), Southern Secondary Moist Mixed Deciduous Forest (3B/C2/2S1) and Dry Grass lands (5 DS 4). And whereas, major faunal species of Mookambika Wildlife Sanctuary are Spotted Deer, Sambar Deer, Indian Guar, Barking Deer, Mouse Deer, Wild Pig, Indian Porcupine (herbivore species) etc. Carnivore includes Tiger, Leopard, Black Panther, Wild Dog, Striped, Hyena and Jackal. Primates include endangered Lion-Tail Macaque, Bonnet Macaque and Common Langur etc. Other faunal species includes Sloth Bear, Malabar Giant Squirrel, Flying Squirrel, Land Monitor Lizard, Cane Turtle (rare species, on the verge of extinction). Along with Someshwara Wildlife Sanctuary, Mookambika Wildlife Sanctuary also remains one of the last remaining forest or habitat for Malabar Civet Cat, which is considered as endemic restricted to few places of Kerala & Karnataka and declared as Critically Endangered species by International Union for Conservation of Nature and Natural Resources. Some of the reptiles include King Cobra, Rock Python, Indian Cobra, Bamboo Pit Viper etc. Avifaunal species includes Great Hornbill, Malabar Grey Hornbill, Malabar Pied Hornbill, Malabar Lark, Malabar Trogon etc. International Union for Conservation of Nature and Natural Resources. And whereas, it is necessary to conserve and protect the area around the protected area of Mookambika Wildlife Sanctuary as Eco-sensitive Zone from ecological, floral, faunal, geographical associations or importance and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. Now therefore, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub- section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 10 kilometres around the boundary of Moonkambika Wildlife Sanctuary in the State of Karnataka as the Moonkambika Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone.- (1) Mookambika Wildlife Sanctuary is situated at the Kundapur Taluk of Udupi district in the State of Karnataka. The eco-sensitive zone is spread over an area of 168.23 sqare kilometre with an extent upto 10 kilometres from the boundary of sanctuary and the boundary description of such Zone is given in Annexure-I. (2) The list of villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure-II. (3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure- III. (4) Key locations (Global Positioning System points) on the eco-sensitive zone boundary as well as on the sanctuary are appended as Annexure-III A . 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the Competent Authority in the State Government.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; (viii) Karnataka State Pollution Control Board; (ix) Irrigation; and (x) Public Works Department. for integrating environmental and ecological considerations into it. (5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 18, 24, 29 and 32 in column (2) of the Table in paragraph 4, namely:- (a) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities; (b) Widening and strengthening of existing roads and construction of new roads; (c) Small scale industries not causing pollution; (d) Rainwater harvesting; and (e) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the Moonkambika Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco- friendly tourism activities; Provided that beyond the distance of one kilometer from the boundary of the Protected Area till the extend of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in the pre-defined and designated area for Eco-tourism facilities as per Tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under. (9) Solid wastes. - Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; and (iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial Units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco- sensitive zone shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks (1) (2) (3) Prohibited Activities 1. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan. 13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3; (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any; (c) Beyond one kilometre upto the extent of Eco-Sensitive Zone construction for bone fide local needs shall be permitted and other construction activities shall be regulated as per Zonal Master Plan. 14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. Erection of electrical cables and (i) Promote underground cabling; telecommunication towers. (ii) Electric polis can be erected within the Eco-sensitive Zone as per the prescriptions under the Zonal Master Plan or with the recommendation of monitoring committee; (iii) Existing domestic lines – if over ground should be at the height of 20 feet for slope < 20 degree and for slope > 30 degree it should be at the height of 30 feet from the ground; (iv) For any future laying of electric lines for the domestic purpose up to 11KV has to be done underground; (v) For any transmission line more than 11KV the “sag” point between the two towers should be at least 1 metres from the; (vi) For any transmission line more than 11KV the “sag” point between the two towers should be at safe distance from the ground. 17. Fencing of existing premises of hotels Regulated under applicable laws. and lodges. 18. Widening and strengthening of existing Shall be done with proper Environment Impact roads. Representative of the Department of Urban Development, Government of Karnataka - Member; iv. Representative of Karnataka State Pollution Control Board - Member; v. A representative of NGO working in the field of environment to be nominated by the Government of Karnataka for a term of one year in each case -Member; vi. An expert in the area of ecology and environment to be nominated by the Government of Karnataka for a term of one year in each case - Member; vii. Terms of Reference:- (1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification. (2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV. (7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
