जनसाधारण क(cid:29) जानकारी के िलए, (cid:15)कािशत (cid:1)कया जाता ह;ै िजनके उससे (cid:15)भािवत होन ेक(cid:29) संभावना ह,ै और यह सूिचत (cid:1)कया जाता ह ै

फैला )आ है। गोदने ा और दवे धारा जैसे कई झरने इस (cid:28)े9 के (cid:15)ाकृितक द?ृ य क(cid:29) सुंदरता को समृO बनाते ह <यह (cid:15)चुर जैव िविवधता और
वन& से संपP ह।ै इस बाघ रजव(cid:24) क(cid:29) जल िनकास (cid:15)णाली के अंतग(cid:24)त मुRय नदी महानदी के साथ उसक(cid:29) सहायक न(cid:1)दयाँ उदांती, सीतानदी,
इं(cid:22)ावन और पेरी न(cid:1)दयां शािमल ह<;
और, यह बाघ रजव(cid:24) एक महVवपूण(cid:24) संरि(cid:28)त (cid:28)े9 ह ै जो अपने समृO पया(cid:24)वास के िलए जाना जाता ह।ै यहां िविवध (cid:15)कार क(cid:29)
वन+पित और जीवजंतु पाए जाते ह।ै इस संरि(cid:28)त (cid:28)े9 क(cid:29) महVवपूण(cid:24) वन+पित (cid:15)जाितय& मA सतवार (असपरागुस रेकेमूसुस), रामदातुन
(ि+मिलXस जीयलानीका), चार (बुचानािनया ला(cid:21)जन), मैदा छाल (िल+टीए Zलुितनोसा), बाइिबिडग (ए(cid:8)बेिलया रोबु+टा), धावरा

अतः, अब, के(cid:21)(cid:22)ीय सरकार, पया(cid:24)वरण (संर(cid:28)ण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प ठत पया(cid:24)वरण
(संर(cid:28)ण) अिधिनयम, 1986 (1986 का 29) क(cid:29) उपधारा (1), धारा 3 क(cid:29) उपधारा (2) के खंड (v) और खंड (xiv) एवं उपधारा
(3)"ारा (cid:15)द# शि%य& का (cid:15)योग करते )ए, छ#ीसगढ़ राf य मA ग रयाबंद और धमतरी िजल& मA उदांती सीतानदी बाघ रजव (cid:24)क(cid:29) सीमा से
4.2 (cid:1)कलोमीटर तक िव+त ा रत (cid:28)े9 को उदांती सीतानदी बाघ रजव (cid:24)पा रि+थितक(cid:29) संवेदी जोन (िजसे इसमA इसके प? चात् पा रि+थितक(cid:29)
संवेदी जोन कहा गया ह)ै के 5प मA अिधसूिचत करती ह,ै िजसका िववरण िन(cid:12)ानुसार ह,ै अथा(cid:24)त् :--
1. पपपपाााा(cid:8)(cid:8)(cid:8)(cid:8)ररररिििि(cid:18)(cid:18)(cid:18)(cid:18)थथथथििििततततकककक(cid:21)(cid:21)(cid:21)(cid:21) ससससंवंवंवंवददेेददेे ीीीी जजजजोोोोनननन ककककाााा ििििवववव(cid:18)(cid:18)(cid:18)(cid:18)तततताााारररर औऔऔऔरररर उउउउससससकककक(cid:21)(cid:21)(cid:21)(cid:21) ससससीीीीममममााााएएएएंं-ंं-(1)))) इस पा रि+थितक(cid:29) संवेदी जोन का िव+तार इसके चार& ओर
0 से 4.2 (cid:1)कलोमीटर तक ह।ै उड़ीसा के साथ लगी अंत:राfय सीमा के पूवl और दि(cid:28)णी भाग& क(cid:29) ओर इसका सीमा -िव+तार शू(cid:21)य ह।ै इस
पा रि+थितक(cid:29) संवेदी जोन का (cid:28)े9 472.14 वग(cid:24) (cid:1)कलोमीटर ह।ै
(2) पा रि+थितक(cid:29) संवेदी जोन क(cid:29) सीमा को दशा(cid:24)ने वाला संरि(cid:28)त (cid:28)े9 का मानिच9 उउउउपपपपााााबबबबधधंंधधंं I पपपपरररर हहहह ैै ैै और संरि(cid:28)त (cid:28)े9 और
पा रि+थितक(cid:29) संवेदी जोन क(cid:29) सीमा के भू- िनदशo ांको क(cid:29) सूची उउउउपपपपााााबबबबंधंधंधंध I कककक औऔऔऔरररर उउउउपपपपााााबबबबंधंधंधंध I खखखख पर दी गई ह।ै
(3) मुRय pबदqु के भू- िनदशo ाकं ो के साथ पा रि+थितक(cid:29) संवेदी जोन के अंतग(cid:24)त आने वाले rाम& क(cid:29) सूची उउउउपपपपााााबबबबधधंंधधंं IIIIIIII के (cid:17)प मA
उपाबO ह ै।
2222.... पपपपाााा(cid:8)(cid:8)(cid:8)(cid:8)ररररिििि(cid:18)(cid:18)(cid:18)(cid:18)थथथथििििततततकककक(cid:21)(cid:21)(cid:21)(cid:21) ससससंवंवंवंवददेेददेे ीीीी जजजजोोोोनननन ककककेेेे ििििललललएएएए आआआआचचंंचचंं ििििललललकककक ममममहहहहााााययययोोोोजजजजननननाााा ––––(1) राfय सरकार, पा रि+थितक(cid:29) संवेदी जोन के (cid:15)योजन के िलए, सरकारी
राजप9 मA अंितम अिधसूचना के (cid:15)काशन क(cid:29) तारीख से दो वष(cid:24) क(cid:29) अविध के भीतर, +थानीय @ि%य& के परामश(cid:24) से तथा इस अिधसूचना
मA (cid:1)दए गए अनुबंध& का अनुपालन करके आंचिलक महायोजना बनाएगं ी ।
(2) इस (cid:15)कार बनायी गई आंचिलक महायोजना अिधसूचना मA िविनGदB अनुबंधो के अनु5प होगी और उसमA पया(cid:24)वरणीय सरोकार
शािमल ह&गे।
(3) आंचिलक महायोजना राfय सरकार के स(cid:28)म (cid:15)ािधकारी "ारा अनुमो(cid:1)दत क(cid:29) जाएगी।
(4) पा रि+थितक(cid:29) संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मA िविनGद7 ट रीित से राf य सरकार "ारा (cid:15)ासंिगक
कA(cid:22)ीय और राfय िविधय& तथा कA(cid:22)ीय सरकार "ारा जारी माग(cid:24)िनदशo &, य(cid:1)द कोई ह&, के अनु5प तैयार क(cid:29) जाएगी ।
(5) आंचिलक महायोजना संबंिधत राfय सरकार के िन(cid:12)िलिखत िवभाग& के परामश(cid:24) से तैयार क(cid:29) जाएगी, अथा(cid:24)त्:--
(i) पया(cid:24)वरण;
(ii) वन और व(cid:21)यजीव;
(iii) कृिष ;
(iv) राज+ व;
(v) शहरी िवकास;
(vi) पय(cid:24)टन;
(vii) rामीण िवकास;
(viii) pसचाई और बाढ़ िनयं9ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) छ#ीसगढ़ राfय (cid:15)दषू ण िनयं9ण बोड।(cid:24)

(6) जब तक इस अिधसूचना मA िविनGदB न हो, आंचिलक महायोजना मA वत(cid:24)मान मA अनुमो(cid:1)दत भू-उपयोग, अवसंरचना और
(cid:1)sयाकलाप& पर कोई (cid:15)ितबंध नहt लगाया जाएगा तथा आचंिलक महायोजना मA सभी (cid:15)कार क(cid:29) अवसंरचनाq और (cid:1)sयाकलाप& क(cid:29)
बेहतरी क(cid:29) @व+था क(cid:29) जाएगी िजससे (cid:1)क वे अिधक द(cid:28) और पा रि+थितक(cid:29) अनुकूल बन सकA।
(7) आंचिलक महायोजना मA अनाEछा(cid:1)दत (cid:28)े9& के जीणuOार, िवcमान जल िनकाय& के संर(cid:28)ण, आवाह (cid:28)9े & के (cid:15)बंधन, जल-संभर&
के (cid:15)बंधन, भू-जल के (cid:15)बंधन, मृदा और नमी के संर(cid:28)ण, +थानीय जनता क(cid:29) आव?यकताq तथा पा रि+थितक(cid:29) एवं पया(cid:24)वरण के ऐसे अ(cid:21)य
पहलुq, िजन पर vयान दने ा आव?यक ह,ै क(cid:29) @व+था क(cid:29) जाएगी ।
(8) आंचिलक महायोजना मA सभी िवcमान पूजा + थल&, rाम& और शहरी बि+तय&, वन& के (cid:15)कार& और (cid:1)क+ म&, आ(cid:1)दवासी (cid:28)े9&,
कृिष (cid:28)े9&, ऊपजाऊ भूिम, उcान& एवं उcान& क(cid:29) तरह के ह रत (cid:28)े9&, बागवानी (cid:28)े9&, बगीच&, झील&, नमभूिमय& और अ(cid:21)य जल
िनकाय& क(cid:29) सीमा का िनधा(cid:24)रण (cid:1)कया जाएगा तथा सहायक मानिच9 भी (cid:1)दया जाएगा। इस महा-योजना से संबंिधत सहायक मानिच9 मA
िवcमान और (cid:15)+तािवत भूिम के उपयोग क(cid:29) िवशेषताq का :यौरा (cid:1)दया जाएगा।
(9) आंचिलक महायोजना के अंतग(cid:24)त पा रि+थितक(cid:29) संवेदी जोन मA िवकास को िविनयिमत (cid:1)कया जाएगा तथा इस अिधसूचना मA
िविनGदBानुसार िनिषO (cid:1)कए गए, िविनयिमत (cid:1)कए और बढ़ावा (cid:1)दए गए (cid:1)sयाकलाप& स(cid:8)बधी @व+था का पालन (cid:1)कया जाएगा ता(cid:1)क
+थानीय जनता क(cid:29) आजीिवका क(cid:29) सुर(cid:28)ा के (cid:1)कए पा रि+थितक(cid:29)- अनुकूल िवकास सुिनि\त (cid:1)कया जा सके ।
(10) आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ(cid:24) द+तावेज होगा िजसमA इस अिधसूचना के उपबंध& से स(cid:8)बिधत उसके
कत(cid:24)@& के िनव(cid:24)हन का िववरण होगा ।

करेगी, अथा(cid:24)त्:-
((((1111)))) भभभभ---ूू-ूूउउउउपपपपययययोोोोगगगग ---- पा रि+थितक(cid:29) संवेदी जोन मA वन&, बागवानी (cid:28)े9&, कृिष (cid:28)े9&, उcान& तथा आमोद-(cid:15)मोद के (cid:15)योजन के िलए िचि(cid:21)हत
(cid:1)कए गए खुले +थान& का वािणfय और उcोग संबंधी िवकास (cid:1)sयाकलाप& के िलए उपयोग या संप रवत(cid:24)न नहt (cid:1)कया जाएगा:
परंतु, िनगरानी सिमित क(cid:29) िसफा रश पर और राfय सरकार के पूव(cid:24) अनुमोदन से, +थानीय िनवािसय& क(cid:29) आवासीय ज5रत& को पूरा करने
के िलए और पैरा- 4 क(cid:29) सारणी के +तंभ (2) मA सूचीबO िन(cid:12)िलिखत (cid:1)sयाकलाप& के िलए पा रि+थितक(cid:29) संवेदी जोन के भीतर कृिष भूिम
के संप रवत(cid:24)न क(cid:29) अनुमित दी जा सकती ह,ै अथा(cid:24)त् :-
(i) िवcमान सड़क& को चौड़ा करना और उ(cid:21)हA सुदढृ करना और नई सड़क& का संिनमा(cid:24)ण
(ii) पय(cid:24)टक& के अ+ थायी आवासन के िलए पा रि+ थितक(cid:29) अनुकूल पय(cid:24)टन (cid:1)sयाकलाप& हते ु पा रि+ थितक(cid:29) अनुकूल
आरामगाह जैसे (cid:1)क तंबू और लकड़ी के मकान;
(iii) (cid:15)दषू ण उxपP न करने वाले लघु उcोग;
(iv) वषा(cid:24) जल संचय, और
(v) rामीण सिहत उcोग& कुटीर उcोग; सुिवधा भyडार और +थानीय सुिवधाएं ।
परंतु यह भी (cid:1)क राfय सरकार के पूव(cid:24) अनुमोदन के िबना तथा संिवधान के अनुEछेद 244 के उपबंध& तथा तxसमय (cid:15)वृ# िविध,
िजसके अंतग(cid:24)त अनुसूिचत जनजाित और अ(cid:21)य परंपरागत वन िनवासी (वन अिधकार& क(cid:29) मा(cid:21)यता) अिधिनयम, 2006 (2007
का 2) भी ह,ै के अनुपालन के िबना वािणिfयक या औcोिगक िवकास (cid:1)sयाकलाप& के िलए जनजातीय भूिम के उपयोग क(cid:29)
अनुमित नहt होगी:
परंतु यह भी (cid:1)क पा रि+थ ितक(cid:29) संवेदी जोन के भीतर क(cid:29) भूिम के अिभलेख& मA उxपP (cid:1)कसी 9ु ट (cid:1)क, िनगरानी सिमित के िवचार
(cid:15)ा> करने के प\ात्, राfय सरकार "ारा (cid:15)xयेक मामले मA एक बार शुिO क(cid:29) जाएगी और उ% 9ु ट के शुिOकरण क(cid:29) सूचना कA(cid:22)ीय सरकार
के पया(cid:24)वरण, वन और जलवायु प रवत(cid:24)न मं9ालय को दी जाएगी ।
परंतु यह भी (cid:1)क उपयु(cid:24)% 9ु ट के शुिOकरण मA, इस उप-पैरा मA यथा उपबंिधत के िसवाय, (cid:1)कसी भी दशा मA भू-उपयोग का
प रवत(cid:24)न सि(cid:8)मिलत नहt होगा ।
परंतु यह भी (cid:1)क वन (cid:28)े9 और कृिष (cid:28)े9 जैसे ह रत (cid:28)े9 मA कोई पा रणामी कमी नहt क(cid:29) जाएगी और अन(cid:15)ु युX त या अनुx पादक
कृिष (cid:28)े9& मA पुन: वनीकरण करने के (cid:15)यास (cid:1)कए जाएंगे ।

संर(cid:28)ण और बहाली क(cid:29) योजना सि(cid:8)म िलत क(cid:29) जाएगी और राf य सरकार "ारा जल आवाह (cid:15)बंधन योजना इस रीित से बनाई जाएगी (cid:1)क

((((3333)))) पपपपाााा(cid:8)(cid:8)(cid:8)(cid:8)ररररिििि(cid:18)(cid:18)(cid:18)(cid:18)थथथथििििततततकककक(cid:21)(cid:21)(cid:21)(cid:21) पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा रि+थितक(cid:29) संवेदी जोन के भीतर पय(cid:24)टन संबंधी (cid:1)sयाकलाप पा रि+थितक(cid:29) पय(cid:24)टन महायोजना के
अनुसार ह&गे जो (cid:1)क आंचिलक महायोजना का भाग होगA ।
(ख) पा रि+थितक(cid:29) पय(cid:24)टन महायोजना, छ#ीसगढ़ सरकार के राज+व और वन िवभाग, परामश(cid:24) से, छ#ीसगढ़ राf य सरकार पय(cid:24)टन के
िवभाग "ारा तैयार क(cid:29) जाएगी।
(ग) पय(cid:24)टन महायोजना आंचिलक महायोजना का एक घटक होगी ।
(घ) पय(cid:24)टन संबंधी (cid:1)sयाकलाप िन(cid:8)न ानुसार िविनयिमत (cid:1)कए जाएंग,े अथा(cid:24)त् :-
(i) उदांती सीतानदी बाघ रजव(cid:24) क(cid:29) सीमा से एक (cid:1)कलोमीटर के भीतर या पा रि+थितक(cid:29) संवेदी जोन क(cid:29) सीमा तक, इनमA जो
भी अिधक िनकट हो, (cid:1)कसी होटल या रजॉट(cid:24) का नया सिPमा(cid:24)ण अनु}ात नहt (cid:1)कया जाएगा। तथािप, नए होटल& और रजॉट&

(iii) rामीण उcोग& सिहत कुटीर उcोग,; सुिवधा भyडार और गृह-वास
सिहत पा रि+थितक(cid:29) पय(cid:24)टन मA सहायक +थानीय सुिवधाएं ह;< और
(iv) इस अिधसूचना मA सूचीबO बढ़ावा (cid:1)दए गए (cid:1)sयाकलाप ।

(13) वृ(cid:28)& क(cid:29) कटाई । (क) राfय सरकार के स(cid:28)म (cid:15)ािधकारी क(cid:29) पूव(cid:24) अनुमित के िबना वन भूिम
अथवा सरकारी या राज+व या िनजी भूिम पर वृ(cid:28)& क(cid:29) कटाई नहt होगी ।
(ख) वृ(cid:28)& क(cid:29) कटाई कA(cid:22)ीय या संबंिधत राfय के अिधिनयम या उसके अधीन

(14) िवcुत और संचार टॉवर लगाने तार-िबछान े रेलवे लाइनो के िसवाय लागू िविधय& के अधीन िविनयिमत होगा । भूिमगत
तथा अ(cid:21)य बुिनयादी ढांचे क(cid:29) @व+था । केबल िबछाने को बढ़ावा (cid:1)दया जाएगा।
(15) िवcमान सड़क& को चौड़ा करना, उ(cid:21)ह A सुदढृ इसक(cid:29) @व+था लागू िविधय&, िनयम&, िविनयम& और म(cid:139)जूदा (cid:1)दशािनदoश& के
बनाना और नई सड़क& का िनमा(cid:24)ण । अनुसार उपशमन उपाय& के साथ क(cid:29) जाएगी।
(16) पव(cid:24)तीय ढ़लान& और नदी तट& का संर(cid:28)ण । लागू िविधय& के अधीन िविनयिमत होगा ।
(17) राि9 मA वाहन यातायात का संचलन । लागू िविधय& के अधीन वािणिfयक (cid:15)योजन के िलए िविनयिमत होगा ।
(18) (cid:15)ाकृितक जल िनकाय& या भू (cid:28)े9 मA जल िनकाय& मA उपचा रत अपिशB जल/बिहzा(cid:24)व के िन+सारण से बचा

NOTIFICATION
New Delhi, the 22nd November, 2017
S.O. 3712(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and
sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required
under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be
affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the
expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made
available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period specified

Draft Notification
WHEREAS, the Udanti-Sitanadi Tiger Reserve is located in Gariaband and Dhamtari Districts, Chhattisgarh
and is spread over an area of 1842.54 square kilometers. A number of waterfalls such as Godena and Deodhara, add
richness to the scenic beauty of the natural landscape of the area and is endowed with rich biodiversity and forests.
Drainage system of the Tiger Reserve consists of Mahanadi as the main river along with Udanti, Sitanadi, Indravan and
Pairi Rivers as tributaries.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
AND WHEREAS, the Tiger Reserve is an important protected area known for its rich habitat. The Protected
Area is the home to a variety of flora and fauna. Important floral species of the Protected Area include Satavar
(Asparagus recemosus), Ramdataun (Smilax zeylanica), Char (Buchnania lanzan), Maida chhal (Listea glutinosa),
Baibiding (Embelia robusta), Dhawra (Anogeissus latifolia), Rohni (Soymida febrifuga), Bija (Ptetocarpus marsupium),
Kusum (Schleichera oleosa), etc.
AND WHEREAS, the Tiger Reserve is also the home to several mammals, birds, amphibians, reptiles, fish, and
a variety of butterflies and insects. Some important mammals of the area include Tiger (Panthera tigris), Panther
(Panthera pardus), Wild Buffalo (Bubalus bubalis), Nilgai (Boselaphus tragocamelus), Barking Deer (Muntiacus
muntajak), Sloth Bear (Melursus ursinus), etc. Key bird species of the Protected Area include the Brown Fish Owl (Bubo
zeylonensis), Golden Backed Wood-pecker (Dinopium benghalense), White spotted Fantail Flycatcher (Rhipidura
albicollis), Pied Kingfisher (Ceryle rudis), and several other species. The endemic flora of the area is Salparni
(Desmodium gangeticum) and endemic fauna is the Rusty spotted cat (Prionailurus rubiginosus).
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is
specified in paragraph 1 of this notification around the protected area of Udanti-Sitanadi Tiger Reserve, as Eco-sensitive
zone (ESZ) from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries
and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of
sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-
rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an
extent of upto 4.2 kilometre around the boundary of Udanti-Sitanadi Tiger Reserve in the Districts of Gariaband and
Dhamtari, Chhattisgarh as the Udanti-Sitanadi Tiger Reserve, Eco-sensitive Zone (herein after referred to as the Eco-
sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from 0 to 4.2
kilometres around the Udanti-Sitanadi Tiger Reserve. Zero extent is towards Eastern and Southern sides due to interstate
boundary with Odisha. The area of the Eco-Sensitive Zone is 472.14 square kilometers.
(2) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure I and the list of geo
co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure I (A) and (B)
respectively.
(3) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is
appended as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the
Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulations specified in the Notification and include
the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by
the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
i. Environment;
ii. Forest and Wildlife;
iii. Agriculture;
iv. Revenue;
v. Urban Development;
vi. Tourism;
vii. Rural Development;
viii. Irrigation and Flood Control;
ix. Municipality;
x. Panchayati Raj;

xii. Public Works Department.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, archaeological monuments, heritage
structures, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green
areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with
supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and
promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local
communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions
with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism
activities;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities.
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of
said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the
State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master
Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Chhattisgarh in
consultation with Department of Revenue and Forests, Government of Chhattisgarh.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan;
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Udanti
Sitanadi Tiger Reserve or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and
resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be
in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time)
with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and
recommendation of the Monitoring Committee.
(4) Monitoring Committee.-Upon completion of the term of the first Monitoring Committee, the State
Government/Union Territory shall re-constitute the subsequent Monitoring Committees as per the composition given at
Para 5, without referring to the Central Government.
(5) Natural Heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(6) Man-made heritage sites.-Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic,
and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared
within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(7) Noise pollution.-The Environment Department of the State Government or Chhattisgarh State Pollution Control
Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the
provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection)
Act, 1986.
(8) Air pollution.-Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be
complied with.
(9) Discharge of effluents.-The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental
(Protection) Act, 1986 and rules made therein. –
(10) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate
Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-
sensitive Zone;
(11) Bio-medical waste.-The bio-medical waste management and disposal in the Eco-sensitive Zone shall be carried out
as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the
Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March,
2016, as amended from time to time.
(i) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(12) Plastic Waste Management.-The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as
amended from time to time.
(13) Construction and Demolition Waste Management.-The Construction and Demolition Waste Management in the
Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management
Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.
(14) E-waste.-The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the
E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change and as amended from time to time.
(15) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(16) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with
applicable laws. Efforts to be made for use of cleaner fuels like CNG, LPG, etc.
(17) Industrial Units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall
be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in
the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and
the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact
Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of
1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made
thereto and be regulated in the manner specified in the Table below, namely:-

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per

Regulated activities
10. Commercial establishment of hotels No new commercial hotels and resorts shall be permitted
and resorts. within one kilometre of the boundary of the Protected Area
of WLS or upto the extent of Eco-sensitive zone, whichever
is nearer, except for small temporary structures for Eco-
tourism activities.
Provided that, beyond one kilometre from the boundary of
the protected Area or upto the extent of Eco-sensitive zone
whichever is nearer, all new tourist activities or expansion
of existing activities shall be in conformity with the
Tourism Master Plan and guidelines as applicable.
11. Construction activities No new commercial construction of any kind shall be
permitted within one Kilometre from the boundary of the
Protected Area or upto extent of the Eco-sensitive Zone
whichever is nearer:
(a) Provided that, local people shall be permitted to
undertake construction in their land for their use including
the activities listed in sub paragraph (1) of paragraph 6 as
per building byelaws to meet the residential needs of the
local residents such as:
(i) Widening and strengthening of existing roads and
construction of new roads;
(ii) Construction and renovation of infrastructure and civic
amenities;
(iii) Cottage industries including village industries;
convenience stores & local amenities supporting eco-
tourism including home stays; and
(iv) Promoted activities listed in this Notification.
12. Small scale non polluting industries. Non polluting industries termed as White Category as per
classification of industries issued by the Central Pollution
Control Board in February 2016 and non-hazardous, small-
scale and service industry, agriculture, floriculture,
horticulture or agro-based industry producing products

5. Monitoring Committee.- (1) The Central Government hereby constitutes the first Monitoring Committee, for
effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment
(Protection) Act, 1986. Upon completion of the term of the first Monitoring Committee, the State Government shall re-
constitute the subsequent Monitoring Committees as per the following composition without referring to the Central
Government.
i. Collector, Gariaband -Chairperson;
ii. Collector, Dhamtari -Member;
iii. An expert in the area of ecology and environment to be nominated by the

iv. Divisional Forest Officer Gariaband -Member;

6. Terms of Reference.—
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the
Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment,
2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E)
dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the
prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be
considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated 6th
January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table
under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions
and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file
complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who
contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from
Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to
issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every
year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per
proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it
deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
