(xiv) र्थय उपियरय (3) के सयथ परिर् उपियरय (1) द्वयरय प्रित्त शधिर्ों कय प्रर्ोग करर्े हुए, जयरी करन े कय प्रस्र्यव करर्ी ह,ै पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) की अपेक्षयनुसयर, जनसयियरण की जयनकयरी के धलए जिनके उससे प्रभाजित होने की संभािना ह,ै प्रकाजित की िाती ह;ै र्ह सूचनय िी जयर्ी ह ै दक उि प्रयरूप अधिसूचनय पर, उस र्यरीि से, धजसको इस अधिसूचनय वयले रािपत्र की प्रधर्र्यं जनसयियरण को उपलब्ि करय िी जयर्ी ह,ैं सयि दिन की अवधि की समयधि पर र्य उसके पश्चयर् ् धवचयर दकर्य जयएगय ; ऐसय कोई व्यधि, जो प्रयरूप अधिसूचनय म ें अंर्र्वाष्ट प्रस्र्यवों के संबंि म ें कोई आक्षेप र्य सुझयव िेने म ें धहर्बद्ध ह,ै इस प्रकयर धवधनर्िष्टा अवधि के भीर्र, केन्द्रीर् सरकयर द्वयरय धवचयर दकए जयने के धलए, सजिि, पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर्, इंदिरय पर्यावरण भवन, जोर बयग रोड, उिमपरु रोड, उत्तर- पधश्चम म ें सुरीनसयर झील और िधक्षण-पूवा में मनसयर झील के बीच 97.82 दकलोमीटर के क्षत्रे में अवधस्थर् ह ै और अभर्यरण्र् र्ीन धजल ेअथयार्् जम्म,ू उिमपरु और सयंबय र्क फैलय हुआ ह ैऔर द़िधलपेधन्द्सस, कैधसर्य द़िस्टुला, जिजिफस िुिुबे िालबर्गार्य धसससो, एजबबजलका ऑदफधसनललंस, द़िकस बेनगलेजसस, फफकस रेलीगीस, बौधहनी िारीगर्य, अधाटोडय, वयधस्सकय, डोडोनय, वेस्कोसय और कैधसर्य ओपेकय शयधमल ह ैं । और, पाररजस्ट्थजतकीय, पयाििरणीय और िैि जिजिधता की दजृ ि से पाररजस्ट्थजतक संिेदी िोन के रूप म ें सुरीनसार- मनसार िन्यिीि अभयारण्य के संरधक्षर् क्षत्रे की िारों ओर के क्षत्रे ( जिसके जिस्ट्तार और सीमाओं को इस अजधसूिना के पैरा 1 में जिजनर्दिि फकया गया ह)ै का पररक्षण और संरक्षण करना आिश्यक हो गया ह।ै अर्ः, अब, केन्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परिर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (1), उपियरय (2) के िंड (v) और िंड (xiv) और उपियरय (3) द्वयरय प्रित्त शधिर्ों कय प्रर्ोग करर् े हुए, जम्मू-कश्मीर रयज्र् में सुरीनसयर-मनसयर वन्द् र्जीव अभर्यरण्र् की सीमय से लगभग 2128 हक्े टेर्र के क्षेत्र को पयररधस् थधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर्् पयररधस्थ धर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै अथयर्ा ् :— (1) पयररधस्थधर्क संविे ी जोन कय धवस्र्यर और उसकी सीमयएं.—(1) पयररधस्थधर्क सवं ेिी जोन रेंज जम्म, उिमपुर धजल े और जम्मू-कश्मीर रयज्र् के सयम्बय में सुरीनसयर-मनसयर वन्द्र्जीव अभर्यरण्र् के 0 मीटर (संरधक्षर् क्षेत्र के उत्तर और पूवोत्तर स्थल) से िधक्षण-पूवा में र्ीन सौ बहत्तर मीटर (372 मीटर). िधक्षण में एक हजयर र्ीन सौ पयंच मीटर (1305) िधक्षण पधश्चम म ें एक हजयर चयर सौ र्ैंर्यलीस मीटर (1443 मीटर). पधश्चम म ें एक हजयर छह सौ धर्रसि मीटर (1663 मीटर). और उत्तर पधश्चम सीमय में नौ सौ चयलीस मीटर (940 मीटर). र्क फैलय हुआ ह;ै उत्तर पधश्चम स्थल पर नंदिनी वन्द्र्जीव अभर्यरण्र् के सयथ सधम्मधलर् सीमय कय संरधक्षर् क्षेत्र और सीमय वणान उपयबिं I म ेंउपलब्ध ह ै। (2) सीमय ब्र्ौरे के सयथ-सयथ पयररधस्थधर्क संवेिी जोन कय मयनधचत्र उपयबिं II के रूप म ें उपयबद्ध ह ैं। (3) सुरीनसयर-मनसयर वन्द्र्जीव अभर्यरण्र् के धनिेशयंक उपयबिं III के रूप म ेंउपयबद्ध ह ैं। (4) पयररधस्थधर्क संवेिी जोन के क्षेत्र म ें आन े वयल े ग्रयमों की सूची उपयबिं IV पर िी गई ह ै और पयररधस्थधर्क संवेिी जोन कय धनिेशयंक उपयबद्ध V पर िी गई ह।ै 2. पयररधस्थधर्क सवं िे ी जोन के धलए आचं धलक महयर्ोजनय.—(1) रयज्र् सरकयर, पयररधस् थधर्क संवेिी जोन के प्रर्ोजन के धलए रयजपत्र म ें अधिसूचनय के अंधर्म प्रकयशन की र्यरीि से िो विा की अवधि के भीर्र, स्थयनीर् व्यधिर्ों के परयमश ासे, और इस अधिसूचनय म ेंसंलग्न अनुबिं ों के सयमंजस् र् से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।II (ii) 3 (2) आंचधलक महयर्ोजनय रयज्र् सरकयर में सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होगी । (3) पयररधस् थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस अधिसूचनय में धवधनर्िष्ा ट रूप में ऐसी रीधर् में रयज्र् सरकयर र्थय सुसंगर् केंरीर् और रयज्र् धवधिर्ों के सयमंजस् र् में भी र्थय केंरीर् सरकयर द्वयरय जयरी मयगाधनिेश, र्दि कोई हों, द्वयरय र्ैर्यर होगी । (4) आचंधलक महयर्ोजनय सभी संबद्ध रयज्र् सरकयर के धवभयगों के परयमशा से र्ैर्यर होगी, अथयार्:्— (i) पर्यावरण ; (ii) वन; (iii) नगर धवकयस; (iv) पर्ाटन; (v) नगरपयधलकय; (vi) रयजस्व; (vii) कृधि पर्ाटन; (viii) जम्म-ू कश्मीर रयज्र् प्रििू ण धनर्ंत्रण बोडा; (ix) लसंचयई; और (x) लोक धनमयाण धवभयग पंचयर्र्ी रयज; इसमें पर्यावरणीर् और पयररधस्थधर्क धवचयरों को समयकधलर् करने के धलए होंगे। (5) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन धवधिक भू-उपर्ोग, धवधिक अवसंरचनयत्मक और दरर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िष्ा ट न हो और उि आचंधलक महयर्ोजनय म ें सभी अवसंरचनय और दरर्यकलयपों में िक्षर्य और पयररधस्थ धर्क अनुकूलर्य कय संविान करेगी । (6) आंचधलक महयर्ोजनय म ें अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, स्थयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधस्थधर्क और पर्यावरण से संबंधिर् ऐस ेअन्द्र् पहलओंू , धजन पर ध्र्यन िेनय आवश्र्क ह,ै के धलए उपबंि होंगे । (7) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमों और नगरीर् बंिोबस्र्ों, वनों के प्रकयर और दकस् मों, जनजयधर् क्षेत्रो, कृधि क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैस े उद्ययन और उसी प्रकयर के स्थ यन, उद्ययन कृधि क्षत्रे , आर्कििो, झीलों और अन्द्र् जल धनकयर्ों कय अभ्र्कंन करेगी । (8) आंचधलक महयर्ोजनय पयररधस्थधर्क संवेिी जोन म ें पयररधस्थक अनुकूल धवकयस को सुधनधश्चर् करर्े हुए जिजनयजमत करेगी । 3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्.—रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करन े के धलए धनम्नधलधिर् उपयर् करेगी, अथयार्् :— (1) भू-उपर्ोग - पयररधस् थधर्क संवेिी जोन के क्षेत्रों म ेेँ आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्द्हर् दकए गए वनों, उद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, पयकों और िुल े स्थयनों कय वयधणधज्र्क और औद्योधगक संबद्ध धवकयस दरर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय : परंर् ु पयररधस्थधर्क संवेिी जोन के भीर्र कृधि भूधम कय संपररवर्ान, मयनीटरी सधमधर् की धसफयररश पर और रयज्र् सरकयर के पूव ा अनुमोिन से, स्थयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन े के धलए और पैरय 4 की सयरणी के स्र्ंभ (2) के अिीन मि स.ं 9,18, 28, 35, और 36 के सयमने सूचीबद्ध दरर्यकलयपों को पूरय करन े के धलए अनुज्ञयर् होंग,े अथयार् ् :—4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) पयररधस् थधर्क अनुकूल पर्ाटन दरर्यकलयपों के धलए पर्ाटकों के अस् थयर्ी आवयसन के धलए पयररधस् थधर्क अनुकूल आरयमगयह जैसे टेंट, लकी ी के मकयन आदि ; (ii) धवद्यमयन सी कों को चौी य और सुिढ़ृ बनयनय ; (iii) प्रििू ण कयररर् न करने वयल ेलघु उद्योग; (iv) कुटीर उद्योग, धजसके अंर्गार् ग्रयमीण जिल्पकयर भी ह;ै और (v) धहम र्य विय ा जल संचर्न । परंर् ु र्ह और दक रयज्र् सरकयर के पूवा अनुमोिन र्थय भयरर् के संधवियन के अनुच्छ ेि 244 और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनपु यलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्द्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्द्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दरर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय: परंर् ु र्ह और भी दक पयररधस्थ धर्क संवेिी जोन के भीर्र भू-अधभलेिों म ें उपसंजयर् कोई त्रुरट मयनीटरी सधमधर् के धवचयर प्रयि करन े के पश्चयर् ् रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमल े म ें संशोधिर् होगी और उि त्रुरट के संशोिन की केन्द्रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को सूचनय िेनी होगी । परंर् ु र्ह और भी दक उपर्ुाि त्रुरट कय संशोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी िशय म ें भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय: परंर् ु र्ह और भी दक धजससे हररर् क्षेत्र में जैसे वन क्षेत्र, कृधि क्षेत्र आदि में कोई पयररणयधमक कटौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कृधि क्षेत्रों में पुन: वनीकरण करन े के प्रर्यस दकए जयएंगे । (2) प्रयकृधर्क जल स्रोर्ों - आचधं लक महयर्ोजनय म ें सभी प्रयकृधर्क जल स्रोर्ों की पहचयन की जयएगी और उनके संरक्षण और पुननावीकरण के धलए र्ोजनय को सधम् मधलर् दकर्य जयएगय और रयज्र् सरकयर द्वयरय ऐसी रीधर् से मयगािशाक धसद्धयंर् बनयए जयएंगे धजससे दक उन क्षेत्रो में र्य इसके समीप धवकयस दरर्यकलयप को प्रधर्धिद्ध दकर्य जय सके। (3) पर्टा न – (क) पयररधस्थधर्क संवेिी जोन के भीर्र पर्ाटन संबंिी दरर्यकलयप, पर्ाटन महयर्ोजनय के अनुसयर होंग,े जो दक आंचधलक महयर्ोजनय के भयग रूप म ेंहोगी । (ि) पर्ाटन महयर्ोजनय रयज्र् सरकयर के वन और पर्यावरण धवभयग के परयमशा से पर्ाटन धवभयग द्वयरय र्ैर्यर होगी । (ग) पर्ाटन संबंिी दरर्यकलयप धनम्न धलधिर् के अिीन धवधनर्धमर् होंगे, अथयार् ् :— (i) पयररधस्थधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दरर्यकलयपों र्य धवद्यमयन पर्ाटन दरर्यकलयपों कय धवस्र्यर, केंरीर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् द्वयरय जयरी मयगाधनिशे ों के अनुसयर होगय पयररधस्थधर्क पर्ाटन, पयररधस्थधर्क धशक्षय और पयररधस्थधर्क धवकयस को महत्व फदया िाएगा और पयररधस्थधर्क संवेिी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय; (ii) पयररधस् थधर्क अनुकूल पर्टा क दरर्यकलयपों के संबंि में पयिटका के अस्थयर्ी अधिभोग के धलए वयस सुधविय के धसवयर् सुरीनसयर-मनसयर अभर्यरण् र् की सीमय से एक दकलोमीटर के भीर्र होटल और ररसोटों कय नर्य संधनमयाण अनुज्ञयर् नहीं होगय; परंर्ु सरं धक्षर् क्षेत्र की सीमय से एक दकलोमीटर की िरू ी से परे पयररधस्थधर्क संवेिी जोन की सीमय र्क नए होटल और ररसोट ा की स्थयपनय पर्ाटन महयर्ोजनय के अनुसयर पयररधस्थधर्क पर्ाटन सुधविय के धलए धवधनर्िष्टा स्थयन में ही अनुज्ञयर् दकर्य जयएगय ।II (ii) 5 (iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दरर्यकलयपों के धवस्र्यर को वयस्र्धवक स्थल धवधनर्िष्टा संवीक्षय र्थय मयनीटरी सधमधर् की धसफयररश पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकाररयों द्वयरय अनुज्ञयर् फकया िाएगा । (4) नसै र्गका धवरयसर् — पयररधस्थधर्क संवेिी जोन म ें महत्वपूण ा नैसर्गाक धवरयसर् के सभी स्थलों जैसे सभी जीन कोश आरधक्षर् क्षत्रे , शैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयए,ं स्थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उन्द्ह ें संरधक्षर् दकर्य जयएगय र्थय उनकी संरक्षय और संरक्षण के धलए इस अधिसूचनय के प्रकयशन की र्यरीि से छह मयस के भीर्र, उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगी (5) मयनव धनर्मर्ा धवरयसर् स्थ ल — पयररधस्थ धर्क संवेिी जोन में भवनों, संरचनयओं, धशल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक सौंिर्ार्य और सयंस्कृधर्क महत्व के क्षेत्रों की पहचयन करनी होगी और इस अधिसूचनय के प्रकयशन की र्यररि से छह मयस के भीर्र उनके संरक्षण की र्ोजनयए ंर्ैर्यर करनी होगी र्थय आंचधलक महयर्ोजनय म ें सधम्मधलर् की जयएगी । (6) ध्व धन प्रििू ण — पयररधस्थधर्क संवेिी जोन म ें ध् वधन प्रििू ण के धनर्ंत्रण के धलए रयज्र् सरकयर या िबमू-कश्मीर राज्य प्रदषू ण जनयंत्रण बोिि, वयर्ु (प्रििू ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसरण म ेंमयगािशाक धसद्धयंर् और धवधनर्म र्ैर्यर करेगय । (7) वयर् ु प्रििू ण — पयररधस्थधर्क संवेिी जोन म,ें वयर् ु प्रििू ण के धनर्ंत्रण के धलए रयज्र् सरकयर या िबमू-कश्मीर राज्य प्रदषू ण जनयंत्रण बोिि, वयर्ु (प्रििू ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसरण म ेंमयगािशाक धसद्धयंर् और धवधनर्म र्ैर्यर करेगय । (8) बधहस्रयव कय धनस्सयरण — पयररधस्थधर्क संवेिी जोन म ें उपचयररर् बधहस्रयव कय धनस्सयरणजल (प्रििू ण धनवयरण र्थय धनर्ंत्रण) अधिधनर्म, 1974 (1974 कय 6) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय । (9) िोस अपधशष्ट — िोस अपधशष्टों कय धनपटयन धनम्नधलधिर् रूप में होगय - (i) पयररधस्थधर्क संवेिी जोन म ें िोस अपधशष्टों कय धनपटयन भयरर् सरकयर के र्त्कयलीन पर्यावरण, वन और जलवयर्ु पररवर्ना मंत्रयलर् की समर्-समर् पर र्थय संशोधिर् अधिसूचनय सं. कय.आ. 1357(आ), र्यरीि 8 अप्रैल, 2016 िोस अपधशष्ट प्रबंि धनर्म, रीधर् म ें होगय और पयररधस्थधर्क संवेिी जोन म ें िोस अपधशष्ट ों को जलयनय र्य भष्म ीकरण अनुज्ञयर् नहीं होगय। (10) जवै धचदकत्स ीर् अपधशष्ट — पयररधस्थधर्क संवेिी जोन म ें जैव धचदकत्सीर् अपधशष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंशोधिर् अधिसूचनय स.ंसा.का.जन. 343(अ), र्यरीि 28 मयचा 2016 द्वयरय प्रकयधशर् जैव धचदकत्सीर् अपधशष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (11) र्यनीर् पररवहन — पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि म ें आंचधलक महयर्ोजनय म ें धवशेि उपबंि सजबमजलत दकए जयएंग े आंचधलक महयर्ोजनय के र्ैर्यर होने और अनुमोफदत होने तक, मयनीटरी सधमधर् सुसंगत अजधजनयमों और प्रवृत्त धनर्मों और इसके अध्यधीन बनाए गए धवधनर्मों के अधीन र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीटर करेगी ।6 जिद्यमान काष्ठ आधाररत उद्योग के जसिाय प्रजतजषद्ध नहीं फकए िाएंगे। (ि) प्रस्ट्ताजित पयररधस्थधर्क संवेिी जोन के भीतर जल, वयर्,ु मृिय, ध् वधन प्रििू ण के कोई नए उद्योग का स्ट्थापन्न नहीं होगा। 4. पयररधस्थधर्क सवं िे ी जोन म ें प्रधर्धिद्ध और धवधनर्धमर् दरर्यकलयपों की सचू ी - पयररधस्थधर्क संवेिी जोन म ें सभी दरर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और इसके अध्यधीन के जसिायII (ii) 7 पाररजस्ट्थजतक संिेदी िोन के संरजक्षत क्षत्रे की सीमा स े एक फकलोमीटर स े भीतर या उसकी सीमा तक िो भी जनकटतम हो कोई नया िाजणजज्यक होटल और ररसोट ि अनुज्ञात नहीं होगे। पंरर्ु, पाररजस्ट्थजतक संिेदी िोन के एक फकलोमीटर स े परे या उसकी सीमा तक सभी नए पयिटन फियाकलाप या जिद्यमान फियाकलापों का जिस्ट्तार पयिटन महायोिना के अनुरूप होंगे। 8. संधनमयाण दरर्यकलयप। (क) फकसी फकस्ट्म का कोई नया िाजणजज्यक संजनमािण पाररजस्ट्थजतक संिेदी िोन के संरजक्षत क्षत्रे की सीमा से एक फकलोमीटर के भीतर या उसकी सीमा तक िो भी जनकटतम हो अनुज्ञात नहीं होगा। परंर्ु स्थ यनीर् व्यजियों को उनके आिासीय उपयोग के जलए उनकी भूजम म ें संजनमािण जिसके अंतगित आंिजलक महायोिना के अनुसार पैरा 3 के उपपैरा(1) म ें सूिीबद्ध फियाकलाप भी ह,ैं को करन े के जलए अनुज्ञात फकया िाएगा। परंत ु यह और फक प्रदषू ण काररत न करने िाल े लघ ु उद्योगों स े सबं ंजधत संजनमािण फियाकलाप जिजनयजमत फकए िाएंगे और लाग ू जनयमों और जिजनयमों, यफद कोई हो, के अनुसार सक्षम प्राजधकारी के पूिि अनुज्ञा लेकर ऐसे प्रदषू ण को कम फकया िाएगा। (ख) पयररधस्थधर्क संवेिी जोन के एक दकलोमीटर परे और उसकी सीमा तक िास्ट्तजिक स्ट्थानीय जनिाजसयों की आिश्यकता के जलए संजनमािण अनुज्ञात फकया िाएगा और अन्य िाजणजज्यक संजनमािण फियाकलाप आंिजलक महायोिना के अनुसार जिजनयजमत होंगे 9. पयिटकों के अस्ट्थायी उपिीजिका के लयग ूधवधिर्ों के अिीन प्रजतजषद्ध । जलए, पाररजस्ट्थजतक अनुकूल पयिटन फियाकलाप के जलए पाररजस्ट्थजतक अनुकूल िैसे टेंट, काष्ठा, घर आफद। 10. मलखान भूजम । नए मलखान भूजम की स्ट्थापना करना प्रजतजसद्ध और पुरानी मलखान लाग ूजिजधयों के अधीन जिजनयजमत होंगे। 11. प्रयकृधर्क जल धनकयर्ों या सतही लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े। क्षत्रे म ें उपिाररत भूजमगत केबल को बढािा देना । बनाना। 18. धवद्यमयन सी कों को चौी य करनय पाररजस्ट्थजतक संिेदी िोन म ें नई सड़को का संजनमािण और और उन्द्ह ें सुिढृ करनय । जिद्यमाना सड़कों को िौड़ाकर या मरबमत जिजनयजमत होंग े और अल्पतम से फकए िाएंगे । 19. होटलों और लॉिों के धवद्यमयन लयग ूधवधिर्ों के अिीन धवधनर्धमर् होगय । पररसरों में बयड लगयनय। वन्द् र्जीव के स्ट्ितंत्र जििरण को अनुज्ञात करन े के उद्देश्य स े पाररजस्ट्थजतक संिेदी िोन के भीतर होटलों और अन्य िाजणजज्यक स्ट्थापन कांटेदार तार स े उनके स्ट्ित्ि पर बािे नहीं होंगे और बािें की ऊंिाई 1 मीटर स े अजधक ऊंिाई नहीं होंगे और यह अनुबंध का पालन कोई जिद्यमान बािे आंिजलक महायोिना म ें उजल्लजखत समय के अनुसार उपांतररत नहीं होगा। 20. प् लयधस् टक थलै ों कय उपर्ोग । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े। 21. छोटे िारों का एकत्रण। लयग ूधवधिर्ों के अनुज्ञयर् नहीं दकर्य िाता जब र्क 1 से 10 मीटर स े अनजधक पहयी ी ढालों और नालों के फकनारे से 100 मीटर तक का भी भार अपन े ऊपर नहीं लेगा। 28. प्रििू ण उत्पन्न न करन े वयले लघ ु पयररधस्थधर्क संवेिी जोन स े गरै प्रििू ण, गैर पररसंकटमर्, लघु उद्योग । और सेवय उद्योग, कृधि उद्यान, कृजष या कृजष आियररर् देिीय माल से औद्योजगक उत्पादों का उत्पादन उद्योग और िो पयाििरण पर कोई जिपररत प्रभाि नहीं िालत े ह,ै अनुज्ञात फकए िाएंग। 29. आरय धमलों की स्थयपनय । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े । 30. धविेशी प्रजयधर्र्ों को लयनय । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े। 31. पर्यावरण पर्ाटन। पर्यावरण पर्ाटन संवर्िर्ा दरर्यकलयप 32. स्थयनीर् समुियर्ों द्वयरय चल रही सदर र् रूप से बढयवय दिर्य जयएगय । कृधि और बयगवयनी प्रथयओं के सयथ दग्ु धिाला, िेयरी उद्योग, एक्वाकल्िर और मत्स्ट्य पालन । 33. जैधवक खेती। सदर र् र्य संबद्ध कलक्टर र्य संबंजधत उद्यान के उप िन संरक्षक, कोई व्यधि िो इस अजधसूिना के फकसी उपबंध का उल्लंघन करता ह,ै उसके जिरूद्ध, पयाििरण (संरक्षण) अधिधनर्म, 1986की ियरय 19 के अिीन पररवयि फयइल करन े के by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;16 THE Draft Notification WHEREAS, the Surinsar-Mansar Wildlife Sanctuary with an area of 97.82 sq kms, is situated between river Tawi in the north and north-west, Udhampur road in south-east, Surinsar lake in the north - west and Mansar lake in south-east and the sanctuary is spread over three districts that is Jammu, Udhampur and Samba and the major part of the sanctuary fall in the Jammu district. AND WHEREAS the area forms one of the important catchments of river Tawi. The sanctuary contains two important lakes that is Surinsar and Mansar lakes, which have been declared as Ramsar Sites on the 8th November, 2005. AND WHEREAS, the flora and fauna represent rich biological significance of the Surinsar-Mansar Wildlife Sanctuary and it is habitat of mammals such as Common Leopard (Panthera pardus), Barking deer (Muntiacus muntejak), Nilgai (Boselaphus tragocamelus), Goral (Nemorhaedus goral), Wild Boar (Sus scorfa), Jackal (Canis aureus), Hare (Lepus nigricollis), Jungle cat (Felis chaua), Porcupine (Hystrix indica), Mongoose (Herpestes edwardis), besides the Wildlife sanctuary is inhabited by many avian species; Pea fowl (Pavo cristatus), Red jungle fowl (Gallus gallus), Black partridges (Francolinus francolinus), Grey partridge (Francolinus pondicerianus), Bush Quil (Prediculata asiatica), Red Turtle Dove (Streptopelia tranquebarica), Blue rock pigeon (Columba livia), Ring Dove (Streptopelia cecacto), Spotted Owlet (Athena brama), Blue jay (Coracias benghalensis), Parakeetes (Psittacula cyanoocephala), Hoope (Upup aepops), Koel (Eudyanmys scolopacea), Bablers (Turdoides caudatus). AND WHEREAS the flora of the region include Acacia catechu, Lannea grandis, Mallotus philipenesis, Cassia fistula, Zizyphus jujube Dalbergia sissoo, Emblica, officinalis, Ficus bengalensis, Ficus religiosa, Bauhinia varigata, Adhtoda, vassica, Dodonea , Vescosa and Cassia opaca. AND WHEREAS, it is necessary to conserve and protect the area (the extent and boundries of which are specified in paragraph 1 of this notification) surrounding the protected area of Surinsar-Mansar Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view. NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 2128 hectares around the Surinsar-Mansar Wildlife Sanctuary in the State of Jammu and Kashmir as the Eco-sensitive Zone (hereinafter called as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.- (1) The extent of Eco-sensitive Zone ranges from 0 meter (North and North-East side of the Protected Area) to three hundred and seventy two meters (372 m) from South- East, thirteen hundred and five meters (1305 m) from South, fourteen hundred and forty three meters (1443 m) from South-West, sixteen hundred and sixty three meters (1663 m) from West and nine hundred and forty meters (940 m) from North-West boundary of the Surinsar-Mansar Wildlife Sanctuary in the District of Jammu, Udhampur and Samba of Jammu and Kashmir State; Protected Area shares boundary with Nandini WildlifeII (ii) 17 Sanctuary on the North West Side and the boundary description is provided in Annexure-I. (2) The map of the Eco-sensitive Zone along with boundary details is appended as Annexure-II. (3) The co-ordinates of Surinsar-Mansar Wildlife Sanctuary is appended as Annexure-III. (4) The list of villages falling in the in Eco-Sensitive Zone area is given at Annexure-IV and the Co-ordinates of Eco Sensitive Zone is appended at Annexure-V. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of the final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; (viii) Jammu & Kashmir State Pollution Control Board; (ix) Irrigation; and (x) Public Works Department, for integrating environmental and ecological considerations into it. (5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 9,18,28,35 and 36 in column (2) of the Table in paragraph 4, namely:- (i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities; (ii) widening and strengthening of existing roads; (iii) small scale industries not causing pollution; (iv) cottage industries including village artisans; and (v) Snow or rainwater harvesting: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.II (ii) 19 (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) New construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Surinsar-Mansar Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities; Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre defined and designated areas for eco-tourism facilities as per Tourism Master Plan. (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Jammu and Kashmir State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or Jammu and Kashmir State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) Solid wastes. - Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th of March, 2016 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units:- (a) No establishment of new wood based Industries within the proposed Eco- sensitive zone shall be permitted except the existing wood based Industries set up as per the law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco- sensitive zone shall be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and shall be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks (1) (2) (3) Prohibited Activities 1. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any. (b) Beyond one kilometer upto the extent of Eco- Sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan. 9. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise the following, namely:- (i) Concerned Deputy Commissioner -Chairman; (ii) One representative of Non-Governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Jammu and Kashmir for a period of three years -Member; (iii) One subject expert in the field of Ecology and Environment, nominated by Jammu and Kashmir Government for a period of three years -Member; (iv) Representative of Jammu and Kashmir Pollution Control Board -Member; (v) Representative of District Land & Land Reforms Officer -Member (vi) Member of State Bio-diversity Board -Member; (vii) Chief Wildlife Warden, Government of Jammu and Kashmir -Member; (viii) Wildlife Warden Concerned -Member; (ix) Divisional Forest Officer Concerned –Member Secretary 6. Terms of reference:- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring Committee shall be three years. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions andII (ii) 25 referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per pro forma given in Annexure VI. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
