अभयारDय घोिषत करके इसे संरि(cid:26)त (cid:26)े3 बनाया गया था। इस (cid:26)े3 का कुल (cid:26)े3फल 108.86 हJे टये र ह।ै इसका नाम पटना Kाम के नाम पर रखा गया ह ैिजसम= यह प(cid:26)ी अभयारDय ि)थत है। यह .का रहता ह।ै यहा ंझील के भाग क म= पानी क(cid:27) पू/त (cid:20)के िलए दो बोPरंग ह 7ता(cid:1)क झील क(cid:27) आ(cid:18) (cid:20)अविध को लQबे समय तक बनाकर रखा जा सके। झील का भाग ख भाग क क(cid:27) तुलना म= िछछला ह ैऔर इसका (cid:26)े3 15 हJे टये र ह।ै यह दि(cid:26)ण- पिRम मानसून शु. होन ेपर जल-Sलािवत हो जाता ह ैऔर वषा(cid:20) क(cid:27) ि)थित के आधार पर इसम= फरवरी के अंत तक या माच(cid:20) क(cid:27) शु.आत तक पानी रहता ह;ै और,,,, पटना प(cid:26)ी अभयारDय वष(cid:20) म= कुछ या अ(cid:17)य अविधय$ म= 180 से अिधक प(cid:26)ी-(cid:11)जाितय$ का आTय )थल बना रहता ह।ै आ(cid:18)(cid:20)भूिम वाला यह प(cid:26)ी अभयारDय िलए राजप3 म= अंितम अिधसूचना के (cid:11)काशन क(cid:27) तारीख से दो वष(cid:20) क(cid:27) अविध के भीतर, )थानीय <ि#य$ के परामश(cid:20) से और इस अिधसूचना म= (cid:1)दए गए अनुबंध$ का पालन करते ’ए रा]य सरकार के स(cid:26)म (cid:11)ािधकारी के अनुमोदनाथ(cid:20) एक आंचिलक महायोजना तैयार करेगी। (ii) पा(cid:30)रि)थितक(cid:27) संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म= िविनCद0(cid:20) ट रीित से रा] य सरकार ारा तथा (cid:11)ासंिगक क=(cid:18)ीय और रा]य िविधय$ तथा क=(cid:18)ीय सरकार ारा जारी माग(cid:20)िनदशb $, य(cid:1)द कोई ह$, के अनु.प तैयार क(cid:27) जाएगी। (iii) आंचिलक महायोजना इसम= पा(cid:30)रि)थितक(cid:27) और पया(cid:20)वरणीय संबंधी सरोकार$ को समाकिलत करने के िलए, रा] य सरकार के िन(cid:8)िलिखत िवभाग$ के परामश(cid:20) से तैयार क(cid:27) जायेगी,:- (क) पया(cid:20)वरण; (ख) वन और व(cid:17)यजीव; (ग) कृिष; (घ) राज) व; (ङ) शहरी िवकास; (च) पय(cid:20)टन; (छ) Kामीण िवकास; (ज) Vसंचाई और बाढ़ िनयं3ण; (झ) नगरपािलका; (ञ) पंचायती राज; और (ट) लोक िन मा(cid:20)ण िवभ ाग। (iv) जब तक इस अिधसूचना म= िविनCद(cid:20)> न हो, आंचिलक महायोजना म= वत(cid:20)मान म= अनुमो(cid:1)दत भू-उपयोग, अवसंरचना और (cid:1)fयाकलाप$ पर कोई (cid:11)ितबंध नहg लगाया जाएगा तथा आचंिलक महायोजना म= सभी अवसंरचनाh और (cid:1)fयाकलाप$ को अिधक द(cid:26) और पया(cid:20)वरण अनुकूल बनाने क(cid:27) <व)था क(cid:27) जाएगी। (v) आंचिलक महायोजना म= अनाAछा(cid:1)दत और अवfिमत (cid:26)े3$ के जीणiLार, िव[मान जल िनकाय$ के संर(cid:26)ण, आवाह (cid:26)े3$ के (cid:11)बंधन, जल-संभर$ के (cid:11)बंधन, भू-जल के (cid:11)बंधन, मृदा और नमी के संर(cid:26)ण, )थानीय जनता क(cid:27) आव:यकताh तथा पा(cid:30)रि)थितक(cid:27) एवं पया(cid:20)वरण के ऐसे अ(cid:17)य पहलुh, िजन पर jयान दने ा आव:यक ह,ै क(cid:27) <व)था क(cid:27) जाएगी । (vi) आंचिलक महायोजना म= सभी िव[मान पूजा ) थल$, Kामीण और शहरी बि)तय$, वन$ क(cid:27) Tेिणय$ और (cid:1)क) म$, कृिष (cid:26)े3$, ऊपजाऊ भिू म, उ[ान$ एवं उ[ान$ क(cid:27) तरह के ह(cid:30)रत (cid:26)े3$, बागवानी (cid:26)े3$, बगीच$, झील$ और अ(cid:17)य जल िनकाय$ क(cid:27) सीमा का सहायक मानिच3$ के साथ (cid:1)fयाकलाप$ का पालन (cid:1)कया जाएगा तथा ) थानीय समुदाय$ क(cid:27) आजीिवका क(cid:27) सुर(cid:26)ा के िलए, पा(cid:30)रि)थितक(cid:27) अनुकूल िवकास को सुिनि: चत तथा संव/ध(cid:20)त (cid:1)कया जाएगा। (viii) आंचिलक महायोजना (cid:26)े3ीय िवकास योजना क(cid:27) सह-कािलक होगी । (ix) आंचिलक महायोजना म= पा(cid:30)रि)थितक(cid:27) संवेदी जोन म= होन े वाले िवकास को िविनयिमत (cid:1)कया जाएगा ता(cid:1)क ) थानीय जनता क(cid:27) आजीिवका क(cid:27) सुर(cid:26)ा के िलए, पा(cid:30)रि)थितक(cid:27)-अनुकूल िवकास सुिनि: चत (cid:1)कया जा सके। (x) इस (cid:11)कार अनुमो(cid:1)दत आंचिलक महायोजना इस अिधसूचना के उपबंध$ के अनुसार मानीटरी के अपने कृFय$ को करने के िलए मानीटरी सिमित के िलए एक संदभ(cid:20) द)तावेज होगी । 3. रररराााा(cid:14)(cid:14)(cid:14)(cid:14)यययय ससससररररककककाााारररर के िलए िन(cid:8)िलिखत उपाय करेगी, अथा(cid:20)त्:-- (1) भभभभ--ूू--ूूउउउउपपपपययययोोोोगगगग –––– (क) पा(cid:30)रि)थितक(cid:27) संवेदी जोन म= वन$, उ[ान-कृिष (cid:26)े3$, कृिष (cid:26)े3$, आमोद-(cid:11)मोद के (cid:11)योजन के िलए िचि(cid:17)हत (cid:1)कए गए पाकm और खुले )थान$ का वृहद वािणि]यक या वृहद आवासीय काQपलैJस या औ[ोिगक (cid:1)fयाकलाप$ के (cid:26)े3ो के .प म= उपयोग या संप(cid:30)रवत(cid:20)न नहg होगा: (ख) परंतु पा(cid:30)रि)थितक(cid:27) संवेदी जोन के भीतर भाग (क) म= िविनCद(cid:20)> (cid:11)योजन से िभn (cid:11)योजन के िलए कृिष और अ(cid:17)य भूिम का संप(cid:30)रवत(cid:20)न, मानीटरी सिमित क(cid:27) िसफा(cid:30)रश पर और यथा लागू (cid:26)े3ीय नगर योजना अिधिनयम तथा के(cid:17)(cid:18)ीय/रा]य सरकार के अ(cid:17)य िनयम$ तथा िविनयम$ के अधीन स(cid:26)म (cid:11)ािधकारी के पूव(cid:20) अनुमोदन से तथा इस अिधसूचना के उपबंध$ ारा )थानीय िनवािसय$ क(cid:27) िन(cid:8)िलिखत आवासीय ज.रत$ को पूरा करने के िलए अनुpात (cid:1)कया जाएगा, जैसे (cid:1)क:- (i) िव[मान सड़क$ को चौड़ा करना, उ(cid:17)ह =सुदढृ करना और नई सड़क$ का संिनमा(cid:20)ण; (ii) बुिनयादी ढांच$ और नाग(cid:30)रक सुिवधाh का संिनमा(cid:20)ण और नवीकरण; (iii) (cid:11)दषू ण उFपn न करने वाले लघु उ[ोग, (iv) कुटीर उ[ोग िजनके अंतग(cid:20)त Kामीण उ[ोग भी ह;7 सुिवधा भDडार और )थानीय सुख-सुिवधाएं जो पा(cid:30)रि)थितक(cid:27) पय(cid:20)टन म= सहायक ह 7िजनम= Kहवास सिQमिलत है; और (v) संव/ध(cid:20)त (cid:1)fयाकलाप और पैरा 4 म= (cid:1)दए गए (cid:1)fयाकलाप: (ग) परंतु यह भी (cid:1)क (cid:26)े3ीय शहरी िनयोजन अिधिनयम के अधीन स(cid:26)म (cid:11)ािधकारी के पूव(cid:20) अनुमोदन के िबना तथा रा]य सरकार के अ(cid:17)य िनयम$ एवं िविनयम$ का अनुपालन (cid:1)कए िबना तथा संिवधान के अनुAछेद 244 के उपबंध$ तथा तFसमय (cid:11)वृ! िविध, िजसके अंतग(cid:20)त अनुसूिचत जनजाित और अ(cid:17)य परंपरागत वन िनवासी (वन अिधकार$ क(cid:27) मा(cid:17)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना वािणि]यक या औ[ोिगक िवकास (cid:1)fयाकलाप$ के िलए जनजातीय भूिम का (cid:11)योग अनुpात नहg होगा। (घ) परंतु यह भी (cid:1)क पा(cid:30)रि)थ ितक(cid:27) संवेदी जोन के भीतर क(cid:27) भूिम के अिभलेख$ म= उFपn (cid:1)कसी 3ु(cid:30)ट क(cid:27), िनगरानी सिमित के िवचार (cid:11)ा9 करने के पRात्, रा]य सरकार ारा (cid:11)Fयेक मामले म= एक बार शुिL क(cid:27) जाएगी और उ# 3ु(cid:30)ट के शुिLकरण क(cid:27) सूचना क=(cid:18)ीय सरकार के पया(cid:20)वरण, वन और जलवायु प(cid:30)रवत(cid:20)न मं3ालय को दी जाएगी । (ड.) परंतु यह भी (cid:1)क उपयु(cid:20)# 3ु(cid:30)ट के शुिLकरण म=, इस उप-पैरा म= यथा वनीकरण के तथा पया(cid:20)वास और जैव- िविवधता क(cid:27) बहाली के (cid:11)यास (cid:1)कए जाएगं े । (2) (cid:1)(cid:1)(cid:1)(cid:1)ााााककककृृृृििििततततकककक जजजजलललल (cid:23)(cid:23)(cid:23)(cid:23)ोोोोतततत -- सभी (cid:11)ाकृितक जल vोत$ के आवाह (cid:26)3े $ क(cid:27) पहचान क(cid:27) जाएगी और आचंिलक महायोजना म= उनके संर(cid:26)ण और बहाली क(cid:27) योजना सिQ मिलत क(cid:27) जाएगी । इन (cid:26)े3$ म= या इनके आसपास के (cid:26)े3$ म= इन (cid:26)े3$ के िलए हािनकारक िवकास (cid:1)fयाकलाप$ को िनिषL के िलए रा]य सरकार ारा सEत (cid:1)दशािनदशb तैयार (cid:1)कए जाएंगे। (3) और (cid:30)रसोटm क(cid:27) )थापना पय(cid:20)टन महायोजना के अनुसार पा(cid:30)रि)थितक(cid:27) पय(cid:20)टन सुिवधाh के िलए पूव(cid:20) प(cid:30)रभािषत एवं अभीिहत (cid:26)े3$ म= अनुpात क(cid:27) जाएगी। प(cid:30)रवत(cid:20)न मं3ालय ारा जारी माग(cid:20)दशy िसLांत$ तथा पा(cid:30)रि)थितक(cid:27) पय(cid:20)टन पर बल देते ’ए राzीय बाघ संर(cid:26)ण (cid:11)ािधकरण ारा जारी पा(cid:30)रि)थितक(cid:27) पय(cid:20)टन संबंधी माग(cid:20)दशy िसLांत$ समय-समय यथा संशोिधत के अनुसार होगा । (iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जाने तक, पय(cid:20)टन के िवकास तथा िव[मान पय(cid:20)टन (cid:1)fयाकलाप$ के िव)तार को वा)तिवक )थल िविनCद(cid:20)> संवी(cid:26)ा तथा िनगरानी सिमित क(cid:27) िसफा(cid:30)रश के आधार पर संबिंधत िविनयामक (cid:11)ािधकरण$ ारा अनुpात (cid:1)कया जाएगा और पा(cid:30)रि)थितक(cid:27) Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Sanctuary is situated about 45 Km from the district Head Quarter Etah. It is small but important bird sanctuary in U.P. It comprises of a natural fresh water shallow wetland or lake. The area was brought under Protected Area (PA) by declaring it a sanctuary on 22.12.1990. The total area of Patna Bird Sanctuary is 108.86 ha. It has been named after the village Patna in which the bird sanctuary is situated. This sanctuary is very close to semi-arid bio- geographical zone. AND WHEREAS The lake of Patna Bird Sanctuary is in two parts divided by a dyke which has water regulator. The main Part (Part A) is 30 ha. in size and in a year with good rainfall, water is retained up to end of April when the reverse migration is almost near completion. There are two borings to supplement water into the Part A of the lake so as to prolong the wet period of the lake. The Part B of the lake is shallow in comparison to Part A and its area is 15 ha. It is inundated with water with the onset of south-west monsoon and depending upon the rainfall it holds water till the end of February or beginning of March. AND WHEREAS Patna Bird Sanctuary give shelter to more than 180 species of birds during some or other parts of the year. This wetland based bird sanctuary also qualified for being declared a Ramsar site. Every year it provides shelter to more than 50,000 birds during winter. AND WHEREAS The bird sanctuary is habitat of Nilgaj, Jackal, Monitor lizard, Jungle Cate, Procupine etc. The bird sanctuary is also rich in large number bird species such as Pintail, Common pochard, Havalic, Bar headed Goose, Comb Duck, Graylag Goose etc. AND WHEREAS, it is necessary to conserve and protect the area up to one kilometre all around the boundary of the protected area of Patna Bird Sanctuary as Eco-sensitive Zone from the ecological and environmental point of view. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Patna Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of above protected area, reintroduction and rehabilitation of local species, promotion of environmental education and ecological research and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area up to one kilometre from the boundary of the protected area of Patna Bird Sanctuary, Etah in the state of Uttar Pradesh as the Eco-sensitive Zone (herein after called as the Eco-sensitive Zone) details of which are as under namely:- 1. Extent and boundaries of Eco-sensitive Zone. – (1) The said Eco-sensitive Zone is between the area upto One Kilometer from the boundary of Patna Bird Sanctuary (N 27°31’35.6” & E 78°19’12.1”) situated in the Etah district of Uttar Pradesh. The area of ESZ shall be 734.06 Hectares.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) The boundary description of Patna Bird Sanctuary and its Eco-sensitive Zone is given in Annexure- I. (3) The map of Patna Bird Sanctuary and Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II. (4) The Geo-coordinates of Patna Bird Sanctuary and its Eco-sensitive Zone is given in Annexure III. (5) The list of five villages falling within the Eco-sensitive Zone is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.- (i) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State. (ii) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (iii) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:- a) Environment; b) Forest and Wildlife; c) Agriculture; d) Revenue; e) Urban Development; f) Tourism; g) Rural Development; h) Irrigation and Flood Control; i) Municipal; j) Panchayati Raj; and k) Public Works Department. (iv) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (v) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (vi) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features. (vii) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (viii) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (ix) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities. (x) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government - The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. (b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and (v) promoted activities and given in paragraph 4: (c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): (d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism/ Eco-tourism (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:- (i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan. (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution. - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and Management of solid wastes shall be as under:- (a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste. – Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic Waste Management. - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial Units. – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of Hill Slopes. - The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. Prohibited, Regulated and Promoted Activities:-All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under, and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description A. Prohibited Activities 1. Commercial Mining (a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for the manufacture of country tiles or bricks for housing and for other activities. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C)¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. Setting of industries causing pollution No new industries and expansion of existing polluting industries in (Water, Air, Soil, Noise, etc.). the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 9. Construction activities (a) No new commercial construction of any kind shall be permitted within one Kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: (b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including homestays; and (v) Promoted activities listed in this Notification. (c) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (d) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 10. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non- hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 11. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 12. Monitoring Committee.- The Central Government hereby, constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:- 1. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25 (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. From here passing through farmland in clockwise direction it goes to village Ganeshpur (GPS N 27°31.0’25.2” E 078° 19.0’ 33.8”) again through farmland it goes to village Sarsela ((GPS N 27°31.0’06.6” E 078° 19.0’ 01.8”).
