के (cid:11)योजन के िलए राजप/ म 9 इस अिधसूचना के अंितम (cid:11)काशन क(cid:27) तारीख से दो वष (cid:20) क(cid:27) अविध के भीतर, )थानीय 8ि#य$
के परामश (cid:20) से और इस अिधसूचना म9 सलं a न अनुबंध$ के सामंज)य से, एक आंचिलक महायोजना तैयार करेगा ।
(2) आंचिलक महायोजना संघ राGय (cid:26)े/ क(cid:27) सरकार म 9 स(cid:26)म (cid:11)ािधकारी ारा अनुमो(cid:1)दत होगी ।
(3) पा(cid:30)रि) थितक संवेदी जोन के िलए आंचिलक महायोजना, संघ राGय (cid:26)े/ सरकार ारा इस अिधसूचना म 9 िविन?दQट
(cid:13)प म9 ऐसी रीित म9 तथा सुसंगत क9(cid:18)ीय और संघ राGय (cid:26)े/ क(cid:27) िविधय$ के सामंज)य म9 भी तथा क9(cid:18)ीय सरकार ारा जारी
माग(cid:20)िनद_श$, य(cid:1)द कोई ह$, ारा तैयार होगी ।
(4) आंचिलक महायोजना, इसम9 पया(cid:20)वरणीय और पा(cid:30)रि)थ ितक(cid:27) िवचार$ को समाकिलत करन े के िलए िनdन िलिखत
सभी संब> संघ राG य(cid:26)े/ क(cid:27) सरकार के िवभाग$ के परामश (cid:20) से तैयार होगी, अथा(cid:20)त:्--
(i) पया(cid:20)वरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पय(cid:20)टन ;

(vi) राज) व ;
(vii) कृिष ;
(viii) चंडीगढ़ (cid:11)दषू ण िनयं/ण बोड (cid:20) ; vkSj
(ix) लोक िनमा(cid:20)ण िवभाग,
(5) आंचिलक महायोजना अनुमो(cid:1)दत िवTमान भ-ू उपयोग, अवसंरचना और (cid:1)fयाकलाप$ पर कोई िनबgधन अिधरोिपत
नहh करेगी जब तक (cid:1)क इस अिधसूचना म9 और आंचिलक महायोजना म9 सभी अवसंरचना और अिधक (cid:11)भावी और
पा(cid:30)रस ि् थितक(cid:27)य अनुकूल (cid:1)fयाकलाप कारक इस (cid:11)कार िविन?दQट न ह$ ।
(6) आंचिलक महायोजना म 9 अनाiछा(cid:1)दत (cid:26)े/$ के जीणk>ार, िवTमान जल िनकाय$ के संर(cid:26)ण, आवाह (cid:26)े/$ के
(cid:11)बंधन, जल-संभर$ के (cid:11)बंधन, भूतल जल के (cid:11)बंधन, मृदा और नमी संर(cid:26)ण, )थानीय समदु ाय$ क(cid:27) आवSयकताl तथा
पा(cid:30)रि)थितक(cid:27)य और पया(cid:20)वरण से संबंिधत ऐसे अ(cid:17)य पहलlु , िजन पर mयान देना आवSयक ह,ै के िलए उपबंध ह$ग े ।
(7) आंचिलक महायोजना सभी िवTमान पूजा )थ ल$, nाम$ और नगरीय बंदोब)त$, वन$ के (cid:11)कार और (cid:1)क)म $, कृिष
(cid:26)े/$, ऊपजाऊ भूिम, ह(cid:30)रत (cid:26)/े जैसे उTान और उसी (cid:11)कार के )थ ान, उTान कृिष (cid:26)े/, आ?कड$, झील$ और अ(cid:17)य जल
िनकाय$ का अpयकंन करेगी ।
(8) आंचिलक महायोजना पा(cid:30)रि) थितक संवेदी जोन म9 िवकास के पा(cid:30)रि)थ ितक अनुकूल िवकास और )थ ानीय समुदाय$
क(cid:27) आजीिवका को सुिनिS चत करते ’ए िविनयिमत होगी ।

कृिष (cid:26)े/$, पाकU और खुल े )थान$ का वािणिGयक और औTोिगक संब> िवकास (cid:1)fयाकलाप$ के िलए उपयोग या संप(cid:30)रवत(cid:20)न
नहh होगा:
परंत ुपा(cid:30)रि)थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:30)रवत(cid:20)न, पैरा 5 के अधीन मानीटरी सिमित क(cid:27) िसफा(cid:30)रश
पर और संघ राG य(cid:26)े/ क(cid:27) सरकार के पूव (cid:20) अनुमोदन से, )थानीय िनवािसय$ क(cid:27) आवासीय ज(cid:13)रत$ को पूरा करन े के िलए और
पैरा 4 क(cid:27) सारणी के )तंभ (2) के अधीन fम सं. 21, 24, 26, और 31 के सामन े सूचीब> (cid:1)fयाकलाप$ को पूरा करने के
िलए अनुJात ह$गे, अथा(cid:20)त ्:————
(i) पा(cid:30)रि) थितक(cid:27)य अनुकूल पय(cid:20)टन (cid:1)fयाकलाप$ के िलए पय(cid:20)टक$ के अ)थ ायी आवासन के िलए पा(cid:30)रि)थ ितक(cid:27)य
अनुकूल आरामगाह जैसे ट9ट, लकड़ी के मकान आ(cid:1)द ;
(ii) (cid:11)दषू ण का(cid:30)रत न करन े वाले लघु उTोग;
(iii) वषा (cid:20) जल संचयन; और
(iv) कुटीर उTोग, िजसके अंतग(cid:20)त nामीण िश(cid:3)पी भी ह 3:
परंत ु यह और (cid:1)क राGय सरकार के पूव (cid:20) अनुमोदन और संिवधान के अनुiछ ेद 244 या तMसमय (cid:11)वृ! िविध के उपबंध$
के अनुपालन के िबना, िजसके अंतगत(cid:20) अनुसूिचत जनजाित और अ(cid:17)य परंपरागत वन िनवासी (वन अिधकार$ क(cid:27) मा(cid:17)यता)
अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिGयक या उTोग िवकास (cid:1)fयाकलाप$ के िलए जनजातीय भूिम का उपयोग

परंत ु यह और भी (cid:1)क पा(cid:30)रि) थितक संवेदी जोन के भीतर भू-अिभलेख$ म 9 पाई जाने वाली कोई /ु(cid:30)ट मानीटरी
सिमित के िवचार (cid:11)ा5 करन े के प6ात ् राGय सरकार ारा (cid:11)Mयेक मामल े म 9 एक बार संशोिधत होगी और उ# /ु(cid:30)ट के
संशोधन क(cid:27) भारत सरकार के पया(cid:20)वरण, वन और जलवायु प(cid:30)रवत(cid:20)न मं/ालय को सूचना देनी होगी :
परंत ु यह भी (cid:1)क उपयु(cid:20)# /ु(cid:30)ट के संशोधन म 9 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म 9 भू-
उपयोग का प(cid:30)रवत(cid:20)न सिdमिलत नहh होगा :
परंत ु यह भी (cid:1)क ह(cid:30)रत (cid:26)े/ जसै े वन (cid:26)े/, कृिष (cid:26)े/ आ(cid:1)द म 9 कोई पा(cid:30)रणािमक कटौती नहh होगी और अ(cid:11)युOत या
अनुM पादक कृिष (cid:26)े/$ म9 पनु : वनीकरण करन े के (cid:11)यास (cid:1)कए जाएंगे ।
(2) (cid:15)(cid:15)(cid:15)(cid:15)ााााककककृृृृििििततततकककक जजजजलललल----""""ोोोोतततत -- आचं िलक महायोजना म 9 सभी (cid:11)ाकृितक tोत$ क(cid:27) पहचान क(cid:27) जाएगी और उनके संर(cid:26)ण और
पुनन(cid:20)वीकरण के िलए योजना सिd मिलत होगी और राGय सरकार ारा ऐसे (cid:26)े/$ पर या उनके िनकट ऐसे िवकास
(cid:1)fयाकलाप$ को जो ऐसे (cid:26)े/$ के िलए हािनकारक ह$, (cid:11)ितिष> करन े के िलए माग(cid:20)िनद_श तैयार (cid:1)कए जाएंग े ।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन————(क) पा(cid:30)रि)थितक संवेदी जोन के भीतर पय(cid:20)टन संबंधी (cid:1)fयाकलाप, पय(cid:20)टन महायोजना के अनुसार ह$गे, जो
आंचिलक महायोजना का भाग (cid:13)प ह$ग े ।
(ख) पय(cid:20)टन महायोजना पय(cid:20)टन िवभाग, संघ राGय (cid:26)े/ क(cid:27) सरकार के पय(cid:20)टन िवभाग ारा राज)व और वन िवभाग, संघ
राG य(cid:26)े/ क(cid:27) सरकार के परामश(cid:20) से तैयार होगी ।
(ग) पय(cid:20)टन संबंधी (cid:1)fयाकलाप िनd निलिखत के अधीन िविनयिमत ह$ग,े अथा(cid:20)त ् :-
(i) पा(cid:30)रि)थितक संवेदी जोन के भीतर सभी नए पय(cid:20)टन (cid:1)fयाकलाप$ या िवTमान पय(cid:20)टन (cid:1)fयाकलाप$ का िव)तार
राQ uीय v याw संर(cid:26)ण (cid:11)ािधकरण, पया(cid:20)वरण, वन और जलवायु प(cid:30)रवत(cid:20)न मं/ालय ारा जारी (समय-समय पर यथा
संशोिधत) मागि(cid:20) नदेश$ के अनुसार होगा िजसम9 पा(cid:30)रि)थितक पय(cid:20)टन, पा(cid:30)रि)थितक िश(cid:26)ा और पा(cid:30)रि)थितक िवकास
को महMव (cid:1)दया जाएगा और पा(cid:30)रि)थितक संवेदी जोन क(cid:27) वहन (cid:26)मता के अmययन पर आधा(cid:30)रत होगा ;
(ii) पा(cid:30)रि) थितक संवेदी जोन के भीतर होटल और (cid:30)रसाट(cid:20) के नए संिनमा(cid:20)ण अनुJात नहh ह$गे ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जाने तक, पय(cid:20)टन के िलए िवकास और िवTमान पय(cid:20)टन (cid:1)fयाकलाप$
के िव)तार को वा)तिवक )थल िविन?द; संवी(cid:26)ा तथा मानीटरी सिमित क(cid:27) िसफा(cid:30)रश पर आधा(cid:30)रत संबंिधत
िविनयामक (cid:11)ािधका(cid:30)रय$ ारा अनुJात (cid:1)कया होगा ।
(4) ननननससैैससैै &&&&गगगगकककक ििििववववररररााााससससतततत––––पा(cid:30)रि)थितक संवेदी जोन म 9 महMवपूण (cid:20) नैस:गक िवरासत के सभी )थल$ जैसे सभी जीन कोश आरि(cid:26)त
(cid:26)े/, शैल िवरचनाएं, जल (cid:11)पात$, झरन$, घाटी मागU, उपवन$, गुफाl, )थल$, xमण, अyरोहण, (cid:11)पातो आ(cid:1)द क(cid:27) पहचान
क(cid:27) जाएगी और उ(cid:17)ह 9 प(cid:30)ररि(cid:26)त (cid:1)कया जाएगा तथा उनक(cid:27) सुर(cid:26)ा और संर(cid:26)ा के िलए इस अिधसूचना के (cid:11)काशन क(cid:27) तारीख
से छह मास के भीतर, उपयु# योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।

भीतर उनके संर(cid:26)ण क(cid:27) योजनाएं तैयार क(cid:27) जाएंगी तथा आंचिलक महायोजना म 9सिdमिलत क(cid:27) जाएंगी ।

NOTIFICATION
New Delhi, the 27th July, 2015
S.O. 2045(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and
sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required
under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be
affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after
the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made
available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification
Whereas, the City Bird Sanctuary Union territory Chandigarh has ecological, faunal, floral, geo-morphological,
natural and geological significance and for the purpose of protecting, propagating and developing wildlife and its
environment, this area was declared as Wildlife Sanctuary vide Chandigarh Administration notification No. 18/1/48-
HII(4)-98 dated 3rd October, 1998 with a total area of 2.90 hectare.
And whereas, a variety of Wildlife such as Rose ringed Parakeet, Grey Hornbill, House sparrow, Common
Myna, Indian Koel, Red vented Bulbul, Blue Rock Pigeon, Starling Hoopoe, Ring Dove, Green bee eater, Spotted Owlet
Purple Sunbird, Indian Grey Mongoose and Various reptiles are found here in abundance;
And whereas, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in
paragraph 1 of this notification around the protected area of the City Bird Sanctuary as Eco-sensitive Zone from
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent
varying from 80 to 125meters from the boundary of the City Bird Sanctuary Union territory Chandigarh as the City Bird
Sanctuary Eco-sensitive Zone(hereinafter referred to asthe Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.—(1)The Eco-sensitive Zone varies from 80 to 125 meters
from theCity Bird Sanctuarycomprising an area of 12.2 hectares approximately. The boundary description of the Eco-
sensitive Zone is appended asAnnexure I.
(2) The Eco-sensitive Zone is bounded by 30º43’43.5"N latitude and 76º46’58.1"E longitude towards East (Point
No.I of Annexure I map); 30º 43’43.4"N latitude and 76º46’35.9"E longitude towards west (Point No.A of Annexure I
map); 30º43’52.4"N latitude and 76º46’50.2"E longitude towards north (Point No. G of Annexure I map) and
30º43’34.3"N latitude and 76º46’42.9"E longitude towards south(Point No.L of Annexure I map).
(3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended asAnnexure II.
(4) The coordinates of Eco-sensitive Zone with its latitudes and longitudes is appended asAnnexure III.
(5) The list of the Houses/Buildings falling within Eco-sensitive Zone is appended as Annexure IV.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The Union territory Government shall, for the purpose
of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of
final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The said Plan shall be prepared by the Union territory Government for the Eco-sensitive Zone in such manner
as is specified in this notification and also in consonance with the relevant Central and Union territory Government laws
and the guidelines issued by the Central Government, ifany.
(4) The said Plan shall be prepared in consultation with all concerned State Departments, namely:-14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(ix) Chandigarh Pollution Control Board.
(x) Irrigation; and
(xi) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6) The said plan shall provide for restoration of denuded areas, conservation of existing water bodies, management
of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local
community and such other aspects of the ecology and environment that need attention.
(7) The said Plan shall demarcate all the existing worshipping places, village and urban settlements, types and
kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards,
lakes and other water bodies.
(8) The said Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and
livelihood security of local communities.
3. Measures to be taken by Union territory Government.—The Union territory shall take the following
measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zonemay be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed at item numbers 21, 24, 26 and 31 in column (2) of the
Table in paragraph 4, namely
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly
tourism activities;
(ii) Small scale industries not causing pollution;
(iii) Rainwater harvesting; and
(iv) Cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the Union territory Government, after obtaining the views of the Monitoring Committee, once in each case and the
correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate
Change:
Provided also that the above correction of error shall not include change of land use in any case except as

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.—The catchment areas of all natural springs shall be identified and plans for their conservation
and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State
Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such
areas..
(3) Tourism.—(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall be part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Union territory Government of
Chandigarh in consultation with Department of Revenue and Forests, Government of Union territory Chandigarh.
(c) The activity of tourism shall be regulated as under, namely.—
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be and
based on carrying capacity study of the Eco-sensitive Zonein accordance with the eco-tourism guidelines issued by the
National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the Union territory Government shall draw up guidelines and
regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air
(Prevention and Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder..
(7) Air pollution.—The Environment Department of the Union territory Government shall draw up guidelines and
regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air
(Prevention and Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder..
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with
the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder..
(9) Solid wastes. - Disposal of solid wastes shall be as under.—
(a) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment, Forest and Climate Change vide notification number S.O. 908 (E), dated the 25th September, 2000as
amended from time to time;
(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(c) the biodegradable material shall be recycled preferably through composting or vermiculture;
(d) the inorganic material shall be disposed of in an environmentally acceptable mannerat site identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment, Forests and Climate Change vide Notification number S.O. 630(E), dated the 20th

(11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco-
sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules
made thereunder and shall be regulated in the manner specified in the Table below, namely:—

5. Eco-sensitive Zone Monitoring Committee.—(1) The Central Government hereby constitutes a Monitoring
Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:—
(i) Deputy Conservator Forest (WL), Government of Union territory (UT) Chandigarh–Chairman;
(ii) Chief Architect, UT, Chandigarh–Member;
(iii) Chief Engineer, UT, Chandigarh–Member;
(iv) Chief Engineer, Municipal Corporation UT, Chandigarh–Member;
(v) Director Rural Development, UT, Chandigarh–Member;
(vi) Member Secretary, Chandigarh Pollution Control Committee, UT, Chandigarh–Member;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(vii) A representative of Non-governmental Organizations’ working in the field of environment to be nominated by
the Government of Union territory Chandigarh–Member;
(viii) One expert in the area of ecology and environment to be nominated by the Government of UT, Chandigarh for
a term of one year - Member; and
(ix) DivisionalForest Officer (Territorial), UT, Chandigarh–Member Secretary.
Terms of Reference:
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the
Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the
concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Conservator Forest (WL) shall
be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against
any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wild Life Warden of the Union Territory proforma appended
at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions,
as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
