35) क(cid:7409) धारा 56 क(cid:7409) उपधारा (2) के खंड (क), खंड (ख), खंड (ग), खंड (घ), खंड (ड), खंड (च), और खडं (छ) (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए िन(cid:7388)िलिखत िविनयम बनाती ह,ै अथा(cid:6981)त ्:--

1. संि(cid:6979)(cid:7385) नाम और (cid:7079)ारंभ—

(1) इन िविनयम(cid:7298) का संि(cid:6979)(cid:7385) नाम भारतीय बीमांकक सं(cid:7021)थान (सद(cid:7021) य(cid:7298) के रिज(cid:7021) टर म(cid:7286) नाम(cid:7298) क(cid:7409) (cid:7079)िवि(cid:7020) ट, संदेय फ(cid:7409)स, अवैतिनक सद(cid:7021) य, संब(cid:7373) सद(cid:7021) य, िव(cid:7378)ाथ(cid:7278) सद(cid:7021) य, (cid:7018) यवसाय (cid:7079)माणप(cid:7074) का जारी (cid:7408)कया जाना) िविनयम, 2016 ह ै।

2. प(cid:7407)रभाषाएं- इन िनयम(cid:7298) म,(cid:7286) जब तक संदभ (cid:6981)से अ(cid:7008)यथा अपेि(cid:6979)त न हो,--

(1) (क) ''अिधिनयम'' से बीमांकक अिधिनयम, 2006 (2006 का 35) अिभ(cid:7079)ेत ह;ै (ख) ''(cid:7018) यवसाय (cid:7079)माणप(cid:7074)'' से (cid:7408)कसी ऐसे (cid:7018) यि(cid:6989) त को, जो इस अिधिनयम के अधीन बीमांकक के (cid:7272)प म(cid:7286) व य् वसाय करने के िलए का हकदार ह,ै जारी (cid:7018) यवसाय (cid:7079)माणप(cid:7074) अिभ(cid:7079)ते ह;ै (ग) ''अवैतिनक सिचव'' से भारतीय बीमांकक सं(cid:7021) थान प(cid:7407)रषद ्का अवैतिनक सिचव अिभ(cid:7079)ेत ह;ै (घ) ''सं(cid:7021) थान'' से अिधिनयम क(cid:7409) धारा 3 के अधीन ग(cid:7407)ठत भारतीय बीमांकक सं(cid:7021) थान अिभ(cid:7079)ेत ह।ै

(2) उन श(cid:7011) द(cid:7298) और पद(cid:7298) के जो इसम (cid:7286) (cid:7079)यु(cid:6989) त ह ै और प(cid:7407)रभािषत नह(cid:7277) ह ै (cid:7408)क(cid:7008) त ु अिधिनयम या उसके अधीन बनाए गए (cid:7408)कसी िनयम या िविनयम म(cid:7286) प(cid:7407)रभािषत ह ै वही अथ (cid:6981) ह(cid:7298)ग ेजो, यथाि(cid:7021)थ ित, अिधिनयम या ऐसे िनयम या िविनयम म(cid:7286) उनका ह ै ।

3. स(cid:7021)ं थ ान क(cid:7409) सद(cid:7021)य ता के िलए अहत(cid:6981) ाएं--

(1) (क) कोई (cid:7018) यि(cid:6989) त, जो इस िविनयम म(cid:7286) िविन(cid:7416)द(cid:7020) ट परी(cid:6979)ा म(cid:7286) अ(cid:7414)हत होता ह,ै सं(cid:7021) थान के सबं (cid:7373) या अ(cid:7007) येता सद(cid:7021) य के (cid:7272)प म(cid:7286) अपना नाम रिज(cid:7021) टर म (cid:7286) (cid:7079)िव(cid:7020) ट करने का हकदार ह।ै (ख) सं(cid:7021)थ ान, अपने सद(cid:7021) य(cid:7298) के िलए सगु म रीित म,(cid:7286) उपिविनयम (1) म(cid:7286) िन(cid:7416)द(cid:7020) ट परी(cid:6979)ा के िलए पा(cid:7353) िववरण अपनी वेबसाइट पर अपलोड करेगा :

परंत ु (cid:7408)कसी अ(cid:7007) ययन प(cid:7074) या परी(cid:6979)ा के िलए पा(cid:7353) िववरण म(cid:7286) कोई संशोधन, प(cid:7407)रवत(cid:6981)न या फेरफार सं(cid:7021)थ ान क(cid:7409) वेबसाइट पर अिधसूचना क(cid:7409) तारीख के प(cid:7019) चात् कम स ेकम तीन मास तक (cid:7079)भावी रहगे ा ।

(2) (क) परी(cid:6979)ा का आयोजन ऐसी रीित म (cid:7286) और ऐस े समय और (cid:7021)थ ान पर होगा जैसा प(cid:7407)रषद ्या प(cid:7407)रषद ्(cid:7367)ारा (cid:7079)ािधकृत ि(cid:7021) थित या (cid:7018) यि(cid:6989) तय(cid:7298) का समूह समय-समय पर िविन(cid:7019) चय करे । (ख) सिमित या सिमित (cid:7367)ारा िनयु(cid:6989) त (cid:7018) यि(cid:6989) त इस िविनयम के अधीन परी(cid:6979)ा(cid:7312) के (cid:7079)योजन के िलए अनुमो(cid:7408)दत परी(cid:6979)क(cid:7298) क(cid:7409) एक सूची बनाएगा ।

(3) (क) (cid:7408)कसी परी(cid:6979)ा म (cid:7286) (cid:7079)वेश के िलए कोई आवेदन ऑनलाइन या अनसु चू ी 'ज' के (cid:7079)ा(cid:7272)प ड़ ़म (cid:7286)(cid:7408)कया जाएगा (ख) खडं (क) के अधीन (cid:7079)(cid:7004) येक आवेदन के साथ िविनयम 6 के उपिविनयम (2) म (cid:7286) िविन(cid:7416)द(cid:7020) ट ऐसी फ(cid:7409)स संल(cid:6991) न होगी िजससे वह समय स े और प(cid:7407)रषद ् (cid:7367)ारा समय-समय पर (cid:7408)दए गए िनदशे ो के अनुसार सं(cid:7021) थान म (cid:7286) प(cid:7263)चं जाए और सं(cid:7021) थान, परी(cid:6979)ा म (cid:7286) उपि(cid:7021) थत होने के िलए (cid:7079)(cid:7004) येक अ(cid:7012) यथ(cid:7278) को अनुसूची 1 के (cid:7079)(cid:7272)प ट म(cid:7286) परी(cid:6979)ा (cid:7079)वेशप(cid:7074) जारी करेगा । 4(क) प(cid:7407)रषद ्या प(cid:7407)रषद ्(cid:7367)ारा इस (cid:7079)योजन के िलए (cid:7079)ािधकृत सिमित या (cid:7018) यि(cid:6989) त लेखब(cid:7373) (cid:7408)कए जाने वाले (cid:7408)कसी पया(cid:6981)(cid:7009) त कारण से (cid:7408)कसी अ(cid:7012) यथ(cid:7278) को परी(cid:6979)ा म(cid:7286) (cid:7079)वेश करने से इंकार कर सकेगा या उसे, ऐसी शत(cid:7300) के अधीन रहते (cid:7263)ए जो मामले क(cid:7409) प(cid:7407)रि(cid:7021) थितय(cid:7298) म(cid:7286) युि(cid:6989) त यु(cid:6989) त समझी जाएं (cid:7408)कसी परी(cid:6979)ा म(cid:7286) (cid:7079)वेश दे सकेगा अ(cid:7008) यथा लेखब(cid:7373) (cid:7408)कए जाने वाले (cid:7408)कसी पया(cid:6981)(cid:7009) त कारण स े (cid:7408)कसी अ(cid:7012) यथ(cid:7278) को परी(cid:6979)ा भवन म (cid:7286) (cid:7079)वेश दने े से इंकार कर सकेगा या सामा(cid:7008) य अनु(cid:7059)म म (cid:7286) परी(cid:6979)ा भवन म (cid:7286) उसके (cid:7079)वेश करन ेके प(cid:7019) चात ् उसे वहां से िन(cid:7020) कािसत कर सकेगा:

परंत ु (cid:7408)कसी अ(cid:7012) यथ(cid:7278) को, सुनवाई का अवसर (cid:7408)दए िबना परी(cid:6979)ा म(cid:7286) (cid:7079)वेश करन े स े इंकार या परी(cid:6979)ा भवन से िन(cid:7020) कािसत नह(cid:7277) (cid:7408)कया जाएगा । (ख) य(cid:7408)द (cid:7408)कसी अ(cid:7012) यथ(cid:7278) क(cid:7409) परी(cid:6979)ा भवन म (cid:7286) या उसके पास िव(cid:6994) छृखल (cid:7018) यवहार क(cid:7409) (cid:7407)रपोट(cid:6981) क(cid:7409) जाती ह ै या (cid:7408)कसी परी(cid:6979)ा म(cid:7286) उ(cid:7004) तीण(cid:6981) होने या उसम(cid:7286) िव(cid:6992) न डालने के (cid:7079)योजन के िलए अनुिचत साधन(cid:7298) का सहारा लेने या सहारा लेने का (cid:7079)य(cid:7004) न करने के बारे म(cid:7286) (cid:7407)रपोट(cid:6981) क(cid:7409) जाती ह ै तो प(cid:7407)रषद ् या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित या (cid:7018) यि(cid:6989) त, इस (cid:7079)भाव क(cid:7409) (cid:7407)रपोट(cid:6981) (cid:7079)ा(cid:7009) त होने पर और ऐसा अ(cid:7008) वेषण करने के प(cid:7019) चात ् जो वह अ(cid:7012) यथ(cid:7278) का परी(cid:6979)ा (cid:7079)माणप(cid:7074) र(cid:7374) (cid:7408)कया जाना या उसक(cid:7409) िव(cid:7378)ाथ(cid:7278) सद(cid:7021) यता र(cid:7374) करना अ(cid:7008) यथा दोन(cid:7298), सिहत ऐसी अनशु ासना(cid:7004) मक कार(cid:6981)वाई करन े के िलए आव(cid:7019) यक समझ,े ऐसी अनशु ासना(cid:7004) मक कार(cid:6981)वाई जो वह ठीक समझे कर सकेगा, परंतु अ(cid:7012) यथ(cid:7278) को (cid:7079)भािवत करने वाला कोई आदेश पा(cid:7407)रत करने के पवू (cid:6981) उसे सुनवाई का अवसर (cid:7408)दया जाएगा ।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (ग) प(cid:7407)रषद ् या प(cid:7407)रषद ् (cid:7367)ारा (cid:7079)ािधकृत सिमित या (cid:7018) यि(cid:6989) त (cid:7367)ारा पा(cid:7407)रत (cid:7408)कसी आदशे का (cid:7079)भािवत अ(cid:7012) यथ(cid:7278) (cid:7367)ारा (cid:7408)कए गए अ(cid:7012) यावेदन पर प(cid:7407)रषद ्(cid:7367)ारा पनु (cid:7414)वलोकन (cid:7408)कया जा सकेगा और प(cid:7407)रषद ्का िविन(cid:7019) चय अंितम और सभी संबंिधत (cid:7018) यि(cid:6989) तय(cid:7298) पर आब(cid:7373)कारी होगा । (घ) (cid:7408)कसी अ(cid:7012) यथ(cid:7278) (cid:7367)ारा संद(cid:7004) त परी(cid:6979)ा फ(cid:7409)स का, प(cid:7407)रषद ् या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित या (cid:7018) यि(cid:6989) त (cid:7367)ारा जारी मागदशक(cid:6981) िस(cid:7373)ांतो के अनुसार कितपय प(cid:7407)रि(cid:7021) थितय(cid:7298) म (cid:7286) (cid:7079)ितदाय (cid:7408)कया जा सकेगा ।

(5) (क) (cid:7079)(cid:7004) येक परी(cid:6979)ा म (cid:7286) घोिषत सफल अ(cid:7012) य(cid:7414)थय(cid:7298) क(cid:7409) सूची को, (cid:7079)ािधकृत (cid:7018) यि(cid:6989) त (cid:7367)ारा स(cid:7013) यक् (cid:7272)प से ह(cid:7021) ता(cid:6979)र (cid:7408)कए जाने के प(cid:7019) चात् सं(cid:7021)थ ान क(cid:7409) वेबसाइट पर (cid:7079)कािशत क(cid:7409) जाएगी:

परंत ुसं(cid:7021) थान अ(cid:7012) य(cid:7414)थय(cid:7298) को भी (cid:7018) यि(cid:6989) तगत (cid:7272)प से उनके प(cid:7407)रणाम क(cid:7409) सूचना द ेसकेगा । (ख) प(cid:7407)रषद ् या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित, अपवा(cid:7408)दक प(cid:7407)रि(cid:7021) थितय(cid:7298) म (cid:7286) और (cid:7079)ाियक (cid:7074)ु(cid:7407)टयां उ(cid:7006)भूत होन े से (cid:7408)कसी िविश(cid:7020) ट (cid:7079)(cid:7019) नप(cid:7074) या (cid:7079)(cid:7019) नप(cid:7074)(cid:7298) म(cid:7286) उ(cid:7004) तीण (cid:6981) होने वाले मानक(cid:7298) को बनाए रखने के िलए, सभी अ(cid:7012) य(cid:7414)थय(cid:7298) या अ(cid:7012) य(cid:7414)थय(cid:7298) के (cid:7408)कसी वग(cid:6981) (cid:7367)ारा अिभ(cid:7079)ा(cid:7009) त अंक(cid:7298) या (cid:7061)डे (cid:7298) को पनु (cid:7407)रि(cid:6979)त कर सकेगी या ऐसी रीित से जो वह आव(cid:7019) यक समझे, संकिलत कर सकेगी । (cid:7021) प(cid:7020) टीकरण – इस खंड के (cid:7079)योजन(cid:7298) के िलए ''वग(cid:6981)'' श(cid:7011) द ऐसे अ(cid:7012) य(cid:7414)थय(cid:7298) के (cid:7079)वग(cid:6981) के (cid:7079)ितिनद(cid:7287)श ह ैजो प(cid:7407)रषद ्(cid:7367)ारा यथा उपव(cid:7414)णत कितपय मानदंड(cid:7298) को पूरा करते ह (cid:7289)।

(6) इस िविनयम म (cid:7286) अंत(cid:7414)व(cid:7020) ट (cid:7408)कसी बात के होत े (cid:7263)ए भी जहां यह पाया जाता ह ै (cid:7408)क (cid:7408)कसी परी(cid:6979)ा का प(cid:7407)रणाम गलती अनाचार, कपट, अनुिचत आचरण या (cid:7408)कसी (cid:7079)कृित क(cid:7409) अ(cid:7008) य िवषय व(cid:7021) तु से (cid:7367)ारा (cid:7079)मािवत (cid:7408)कया गया ह ै वहां प(cid:7407)रषद ्या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित को ऐसे परी(cid:6979)ा प(cid:7407)रणाम का ऐसी रीित म(cid:7286) जो ि(cid:7021) थित के अनुसार सही हो और ऐसी घोषणा करन े के िलए जैसा प(cid:7407)रषद ्इस िनिम(cid:7004) त आव(cid:7019) यक समझ,े संशोधन करन ेक(cid:7409) शि(cid:6989) त होगी:

परंतु (cid:7408)कसी अ(cid:7012) यथ(cid:7278) को सुनवाई का अवसर (cid:7408)दए िबना ऐसा कोई संशोधन नह(cid:7277) (cid:7408)कया जाएगा िजसका उस पर (cid:7079)ितकूल (cid:7079)भाव पड़े: परंतु यह और (cid:7408)क (cid:7408)कसी ऐसी गलती क(cid:7409) दशा म(cid:7286), जो (cid:7408)कसी अ(cid:7012) यथ(cid:7278) क(cid:7409) ओर से (cid:7408)कए गए (cid:7408)कसी काय(cid:6981) या (cid:7018) यित(cid:7059)म से उदभूत नह(cid:7277) (cid:7263)ई ह,ै अ(cid:7012) यथ(cid:7278) को (cid:7079)ितकूल (cid:7272)प से (cid:7079)भािवत करने वाली संशोधन संबंधी काय(cid:6981)वािहयां प(cid:7407)रणाम क(cid:7409) घोषणा क(cid:7409) तारीख से एक मास क(cid:7409) अविध क(cid:7409) समाि(cid:7009) त के प(cid:7019) चात् आरंभ नह(cid:7277) क(cid:7409) जाएंगी ।

(7) (cid:7079)(cid:7004) येक अ(cid:7012) यथ(cid:7278) िजसने इस िविनयम के अधीन कोई परी(cid:6979)ा उ(cid:7004) तीण(cid:6981) क(cid:7409) ह,ै अनसु चू ी क के (cid:7079)(cid:7272)प छ म (cid:7286) इस (cid:7079)भाव क(cid:7409) एक पालन (cid:7407)रपोट(cid:6981) दगे ा ।

4. अ(cid:7007)य ते ा सद(cid:7021)य के (cid:7272)प म (cid:7286)रिज(cid:7021)(cid:7069) ीकरण के िलए अहत(cid:6981) ा--

(1) (cid:7408)कसी (cid:7018) यि(cid:6989) त को अ(cid:7007) येता सद(cid:7021) य के (cid:7272)प म (cid:7286) रिज(cid:7021) (cid:7069)ीकृत (cid:7408)कया जा सकेगा य(cid:7408)द-- (क) उसन ेिविनयम 3 के अधीन अ(cid:7007) यते ा सद(cid:7021) यता के िलए परी(cid:6979)ा उ(cid:7004) तीण(cid:6981) क(cid:7409) ह;ै (ख) उसन ेऐसा वृि(cid:7074)क या अ(cid:7008) य पा(cid:7353)(cid:7059)म या (cid:7079)िश(cid:6979)ण परू ा कर िलया ह ैजो प(cid:7407)रषद ्(cid:7367)ारा समय समय पर बताए जाए;ं और (ग) उसके पास ऐसा सुसंगत काय(cid:6981) अनुभव हो जो प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर बताया जाए ।

(2) सं(cid:7021) थान (cid:7367)ारा भारत के बाहर अवि(cid:7021) थत अ(cid:7008) य बीमांकक िनकाय(cid:7298) के साथ (cid:7408)कए गए पार(cid:7021)प (cid:7407)रक मा(cid:7008) यता करार (एमआरए) के अधीन अ(cid:7007) येता सद(cid:7021) य के (cid:7272)प म(cid:7286) (cid:7079)वेश क(cid:7409) ई(cid:7009) सा करने वाले (cid:7408)कसी (cid:7018) यि(cid:6989) त के िलए िविनयम 3 म(cid:7286) िन(cid:7416)द(cid:7020) ट परी(cid:6979)ा को अिध(cid:7004) य(cid:6989) त कर (cid:7408)दया जाएगा य(cid:7408)द,-- (क) सं(cid:7021) थान क(cid:7409) अ(cid:7007) येता सद(cid:7021) यता के िलए आवेदन क(cid:7409) तारीख को (cid:7018) यि(cid:6989) त ऐसे बीमांकक िनकाय का, िजसका सं(cid:7021) थान के साथ पार(cid:7021) प(cid:7407)रक मा(cid:7008) यता करार ह,ै सद(cid:7021) य बना (cid:7263)आ ह;ै (ख) सं(cid:7021) थान क(cid:7409) अ(cid:7007) येता सद(cid:7021)य ता के िलए आवेदन क(cid:7409) तारीख को (cid:7018) यि(cid:6989) त न े संबंिधत बीमांकक िनकाय के साथ पार(cid:7021) प(cid:7407)रक मा(cid:7008) यता करार क(cid:7409) सुसंगत अपे(cid:6979)ाएं परू ी कर ली ह:ै परंत ु प(cid:7407)रषद ् सं(cid:7021) थान क(cid:7409) वेबसाइट पर ऐस े सभी संबंिधत बीमांकक िनकाय(cid:7298) क(cid:7409) िजनके साथ स(cid:7021)ं थान न े पार(cid:7021) प(cid:7407)रक मा(cid:7008) यता करार (cid:7408)कया ह ैजानकारी उपल(cid:7011)ध करवाएगी ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

परंत ुआवेदक ऐसी अ(cid:7008) य जानकारी देगा िजसक(cid:7409) प(cid:7407)रषद ्अपे(cid:6979)ा करे ।

(4) अ(cid:7007) यते ा सद(cid:7021) यता का (cid:7079)माणप(cid:7074) अनसु चू ी 'छ' के (cid:7079)(cid:7272)प 'झ' म(cid:7286) जारी (cid:7408)कया जाएगा ।

5. सहय(cid:6989)ु त सद(cid:7021)य के (cid:7272)प म (cid:7286)रिज(cid:7021)(cid:7069) ीकरण के िलए अहत(cid:6981) ा –

(1) (cid:7408)कसी (cid:7018) यि(cid:6989) त को सहयु(cid:6989) त सद(cid:7021) य के (cid:7272)प म (cid:7286) तभी (cid:7079)वशे (cid:7408)दया जाएगा, य(cid:7408)द— (क) उसने िविनयम 3 के अधीन सहयु(cid:6989) त सद(cid:7021) यता के िलए परी(cid:6979)ा उ(cid:7004) तीण(cid:6981) क(cid:7409) ह;ै और (ख) उसने ऐसी वृि(cid:7004) तक या अ(cid:7008) य पा(cid:7353)(cid:7059)म या (cid:7079)िश(cid:6979)ण पूरा कर िलया ह ैजैसा प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर बताया जाए;

और (ग) उसके पास ऐसा सुसंगत काय(cid:6981) अनुभव ह ै जो प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर बताया जाए ।

(2) (cid:7408)कसी ऐसे (cid:7018) यि(cid:6989) त क(cid:7409) दशा म,(cid:7286) िजसने (cid:7408)कसी अ(cid:7008) य बीमां(cid:7408)कक िनकाय या शै(cid:6979)िणक सं(cid:7021)थ ान से सं(cid:7021) थान क(cid:7409) त(cid:7004) (cid:7021)थ ानी परी(cid:6979)ा के समतु(cid:7016) य समझी जाने वाली ऐसी परी(cid:6979)ा उ(cid:7004) तीण(cid:6981) क(cid:7409) ह ैजैसी प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर बताई जाए िविनयम 3 म(cid:7286) िन(cid:7416)द(cid:7020) ट परी(cid:6979)ा से अिभमुि(cid:6989) त दी जा सकेगी ।

(3) कोई (cid:7018) यि(cid:6989) त जो सहयु(cid:6989) त सद(cid:7021)य के (cid:7272)प म(cid:7286) (cid:7079)वशे लेने क(cid:7409) वाछं ा रखता ह ै अनसु चू ी 'ख' के (cid:7079)(cid:7272)प ख म(cid:7286) सद(cid:7021) यता के िलए अपनी पा(cid:7074)ता के बारे म (cid:7286) द(cid:7021)त ावेजी सा(cid:7023) य और िविनयम 6 के उपिविनयम (1) म(cid:7286) िविन(cid:7416)द(cid:7020) ट फ(cid:7409)स के साथ आवेदन करेगा;

परंत ुआवेदक ऐसी अ(cid:7008) य जानकारी देगा िजसक(cid:7409) प(cid:7407)रषद ्अपे(cid:6979)ा करे ।

(4) सहयु(cid:6989) त सद(cid:7021) यता का (cid:7079)माणप(cid:7074) अनसु चू ी च के (cid:7079)(cid:7272)प ज म (cid:7286)जारी (cid:7408)कया जाएगा ।

6. फ(cid:7409)स--

(1) िविनयम 4 और िविनयम 5 के अधीन रिज(cid:7021) टर म(cid:7286) नाम (cid:7079)िव(cid:7020) ट करवाने के िलए (cid:7079)(cid:7004) येक आवेदन के साथ प(cid:6994) चीस हजार (cid:7272)पए से अनिधक रािश क(cid:7409) ऐसी फ(cid:7409)स संल(cid:6991) न होगी जैसी प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर अवधा(cid:7407)रत क(cid:7409) जाए ।

(2) िविनयम 3 के उपिविनयम (3) के अधीन (cid:7408)कसी परी(cid:6979)ा म (cid:7286) (cid:7079)वेश करन े के िलए (cid:7079)(cid:7004) येक आवेदन के साथ, भारत म (cid:7286) िजसके अंतगत(cid:6981) दि(cid:6979)ण एिशयाई (cid:6979)े(cid:7074)ीय सहयोग सगं ठन (साक(cid:6981)) देश भी ह (cid:7289) िव(cid:7378)ा(cid:7414)थय(cid:7298) के िलए (cid:7079)ित िवषय एक लाख (cid:7271)पए स े अनिधक रकम क(cid:7409) ऐसी फ(cid:7409)स सलं (cid:6991) न होगी जैसी प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर अवधा(cid:7407)रत क(cid:7409) जाए:

परंतु भारत और साक(cid:6981) दशे (cid:7298) के बाहर के परी(cid:6979)ा के(cid:7008) (cid:7076) के िलए (cid:7018) यि(cid:6989) तय(cid:7298) के बाहर के परी(cid:6979)ा के(cid:7008) (cid:7076) के िलए (cid:7018) यि(cid:6989) तय(cid:7298) (cid:7367)ारा संदेय परी(cid:6979)ा फ(cid:7409)स (cid:7079)ित िवषय दो लाख (cid:7272)पए से अनिधक क(cid:7409) ऐसी रकम होगी जैसी प(cid:7407)रषद ् (cid:7367)ारा समय-समय पर अवधा(cid:7407)रत क(cid:7409) जाए ।

(3) (cid:7079)(cid:7004) येक सद(cid:7021) य एक लाख (cid:7271)पए से अनिधक क(cid:7409) वा(cid:7414)षक सद(cid:7021) यता फ(cid:7409)स क(cid:7409) ऐसी रकम का संदाय करेगा जैसी प(cid:7407)रषद ् (cid:7367)ारा समय-समय पर अवधा(cid:7407)रत क(cid:7409) जाए:

परंत ु ऐसे सद(cid:7021) य, िजनका सद(cid:7021)य (cid:7298) के रिज(cid:7021) टर म (cid:7286) प(cid:7074)ाचार का पता भारत के बाहर का ह,ै दो लाख (cid:7271)पए स े अनिधक क(cid:7409) वा(cid:7414)षक सद(cid:7021) यता फ(cid:7409)स क(cid:7409) ऐसी रकम का संदाय कर(cid:7286)ग े जैसी प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर अवधा(cid:7407)रत क(cid:7409) जाए ।

(4) प(cid:7407)रषद ्पा(cid:7353)(cid:7059)म साम(cid:7061)ी, को(cid:7410)चग, काउंस(cid:7410)लग, (cid:7079)िश(cid:6979)ण और अ(cid:7008) य (cid:7079)योजन(cid:7298) के िलए फ(cid:7409)स का अवधारण करेगी : परंत ुऐसी फ(cid:7409)स, जो प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर अवधा(cid:7407)रत क(cid:7409) जाए (cid:7079)ित िवषय पचास हजार (cid:7271)पए से अिधक नह(cid:7277) होगी ।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 परंतु यह और (cid:7408)क ऐसे (cid:7018) यि(cid:6989) त िजनका प(cid:7074)ाचार का पता भारत के बाहर का ह,ै (cid:7079)ित िवषय एक लाख (cid:7271)पए स े अनिधक ऐसी फ(cid:7409)स का संदाय कर(cid:7286)ग े जैसा प(cid:7407)रषद ्समय-समय पर अवधा(cid:7407)रत करे ।

7. रीित िजसम (cid:7286)अवतै िनक सद(cid:7021)य का चयन (cid:7408)कया जा सकेगा-- प(cid:7407)रषद ् अपने सभी सद(cid:7021) य(cid:7298) के कम से कम पांच चौथाई मत (cid:7367)ारा (cid:7408)कसी ऐसे (cid:7018) यि(cid:6989) त को अिधिनयम क(cid:7409) धारा 8 क(cid:7409) उपधारा

(1) के अधीन अवतै िनक सद(cid:7021)य के (cid:7272)प (cid:7079)वशे द े सकेगी िजस े वह बीमाकं क के (cid:7018)य वसाय स े सबं ंिधत िवषय(cid:7298) म (cid:7286) उसक(cid:7409) (cid:7079)ित(cid:7020)ठ ा और उसके अनुभव के कारण सं(cid:7021) थान के उ(cid:7374)े(cid:7019) य(cid:7298) के संवध(cid:6981)न सहायता करने के िलए समथ (cid:6981) समझती ह ै परंत ु यह तब जब वह बीमांकक के (cid:7272)प म (cid:7286) (cid:7018) यवसायरत न हो:

परंतु ऐसी भत(cid:7278) हते ु िवचार (cid:7408)कए जाने वाले (cid:7018) यि(cid:6989) त (cid:7367)ारा प(cid:7407)रषद ् (cid:7367)ारा समय-समय पर िनयत सभी अपे(cid:6979)ाएं परू ी करनी ह(cid:7298)गी ।

8. स(cid:7021)ं थ ान के सबं (cid:7373) सद(cid:7021)य के (cid:7272)प म (cid:7286)भत(cid:7278)--

(1) कोई (cid:7018) यि(cid:6989) त िजसके पास (cid:7408)कसी अ(cid:7008) य बीमां(cid:7408)कक िनकाय से ऐसी अहत(cid:6981) ा ह ै िजसे प(cid:7407)रषद ् (cid:7367)ारा सं(cid:7021) थान क(cid:7409) अ(cid:7007) यते सद(cid:7021) यता के समत(cid:7016)ु य समझा गया ह ै और जो कम से कम प(cid:6994) चीस वष(cid:6981) क(cid:7409) आयु का ह,ै अिधिनयम क(cid:7409) धारा 8 क(cid:7409) उपधारा (2) के अधीन सं(cid:7021) थान के संब(cid:7373) सद(cid:7021)य के (cid:7272)प म (cid:7286) भत(cid:7278) (cid:7408)कए जान ेका हकदार होगा ।

(2) उपिविनयम (1) िन(cid:7416)द(cid:7020) ट कोई (cid:7018) यि(cid:6989) त, जो सं(cid:7021) थान के सबं (cid:7373) सद(cid:7021) य के (cid:7272)प म (cid:7286) भत(cid:7278) होन े क(cid:7409) वांछा रखता ह,ै सं(cid:7021) थान को, अनुसूची ड़ के (cid:7079)(cid:7272)प ग म(cid:7286) के साथ और िविनयम 6 के उपिविनयम (1) म (cid:7286)िविन(cid:7416)द(cid:7020) ट फ(cid:7409)स का संदाय करके आवेदन कर सकेगा:

परंत ु सं(cid:7021) थान के पास पार(cid:7021) प(cid:7407)रक मा(cid:7008) यता करार या प(cid:7407)रषद ् (cid:7367)ारा स(cid:7013) यक् (cid:7272)प स े (cid:7079)ािधकृत वैसे ही करार पर ह(cid:7021) ता(cid:6979)(cid:7407)रत ऐस े बीमां(cid:7408)कक िनकाय के साथ (cid:7018) यितकारी करार होना चािहए ।

(3) इस बात का अवधारण (cid:7408)क (cid:7008) यायालय (cid:7408)कसी अ(cid:7008) य बीमां(cid:7408)कक िनकाय से उपिविनयम (1) म (cid:7286) िन(cid:7416)द(cid:7020) ट (cid:7408)कसी बीमां(cid:7408)कक अहत(cid:6981) ा को सं(cid:7021) थान क(cid:7409) अ(cid:7007) यते ा सद(cid:7021) यता के समत(cid:7016)ु य समझा जाए या नह(cid:7277), इस संबंध म(cid:7286) समय-समय पर प(cid:7407)रषद ् (cid:7367)ारा अिधकिथत मानदंडो के अनुसार (cid:7408)कया जाएगा ।

9. स(cid:7021)ं थ ान के िव(cid:7378)ाथ(cid:7278) सद(cid:7021)य के (cid:7272)प म (cid:7286)भत(cid:7278)--

(1) कोई (cid:7018) यि(cid:6989) त, िजसने 10+2 या समतु(cid:7016) य परी(cid:6979)ा उ(cid:7004) तीण(cid:6981) क(cid:7409) ह ैऔर िजसने सं(cid:7021)थ ान (cid:7367)ारा संचािलत बीमां(cid:7408)कक सामा(cid:7008) य (cid:7079)वेश परी(cid:6979)ा (एसीईटी) पास कर ली ह ै अिधिनयम क(cid:7409) धारा 8 क(cid:7409) उपधारा (3) के अधीन स(cid:7021)ं थान के िव(cid:7378)ाथ(cid:7278) सद(cid:7021) य के (cid:7272)प म(cid:7286), भत(cid:7278) होने का हकदार होगा ।

(2) कोई (cid:7018) यि(cid:6989) त, जो (cid:7021) वयं को सं(cid:7021)थ ान के िव(cid:7378)ाथ(cid:7278) सद(cid:7021) य के (cid:7272)प म(cid:7286) भत(cid:7278) होने क(cid:7409) वांछा रखता ह ै रखता ह,ै सं(cid:7021) थान को अनुसूची घ के (cid:7079)(cid:7272)प क म (cid:7286) सद(cid:7021)य ता के िलए अपनी पा(cid:7074)ता के बारे म(cid:7286) द(cid:7021)त ावेजी सा(cid:7023) य के साथ और िविनयम 6 के उपिविनयम

(1) म (cid:7286)िविन(cid:7416)द(cid:7020) ट फ(cid:7409)स संल(cid:6991) नक करके आवेदन कर सकेगा ।

10. (cid:7018)य वसाय (cid:7079)माणप(cid:7074) के िलए अहत(cid:6981) ा, (cid:7079)(cid:7272)प और फ(cid:7409)स--

(1) सं(cid:7021) थान का कोई अ(cid:7007) यते ा सद(cid:7021)य िजसका नाम अिधिनयम क(cid:7409) धारा 6 के अधीन सं(cid:7021) थान (cid:7367)ारा अनरु ि(cid:6979)त रिज(cid:7021) टर म (cid:7286) (cid:7079)िव(cid:7020) ट ह ै और जो प(cid:7407)रषद ् (cid:7367)ारा समय-समय पर अिधकिथत अनुभव और मानदडं (cid:7298) को पूरा करता ह,ै इस िविनयम के अधीन (cid:7018) यवसाय (cid:7079)माणप(cid:7074)(cid:7298) के िलए आवेदन करन े का हकदार होगा ।

(2) (cid:7018) यवसाय (cid:7079)माणप(cid:7074) के िलए कोई आवेदन अनुसूची (ञ) के (cid:7079)(cid:7272)प च म (cid:7286) (cid:7408)कया जाएगा, उसके साथ ऐसी फ(cid:7409)स संल(cid:6991) न होगी जो प(cid:7407)रषद ्(cid:7367)ारा समय-समय पर अवधा(cid:7407)रत क(cid:7409) जाए (cid:7412)कतु जो (cid:7408)कसी भी दशा म (cid:7286)एक लाख (cid:7271)पए से अिधक नह(cid:7277) होगी ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(3) इस िविनयम म(cid:7286) अंत(cid:7414)व(cid:7020) ट (cid:7408)कसी बात के होते (cid:7263)ए भी अिधिनयम क(cid:7409) धारा 9 के अधीन (cid:7408)कसी सद(cid:7021) य (cid:7367)ारा धा(cid:7407)रत (cid:7018) यवसाय (cid:7079)माणप(cid:7074) को इस िविनयम के अधीन जारी (cid:7408)कया गया समझा जाएगा और जब तक उसे र(cid:7374) नह(cid:7277) कर (cid:7408)दया जाता ह ै तब तक वह िविधमा(cid:7008) य बना रहगे ा ।

(4) (cid:7018) यवसाय (cid:7079)माणप(cid:7074) अनुसूची ट के (cid:7079)(cid:7272)प ट म (cid:7286)जारी (cid:7408)कया जाएगा ।

11. (cid:7018)य वसाय (cid:7079)माणप(cid:7074) का र(cid:7374) (cid:7408)कया जाना--

(1) िविनयम 10 के अधीन जारी (cid:7018)य वसाय (cid:7079)माणप(cid:7074) र(cid:7374) (cid:7408)कए जाने यो(cid:6991) य होगा, य(cid:7408)द-

(i) अिधिनयम क(cid:7409) धारा 24 के अधीन (cid:7079)माणप(cid:7074) के धारक का नाम रिज(cid:7021) टर से हटा (cid:7408)दया जाता ह;ै या

(ii) प(cid:7407)रषद ्का संबंिधत (cid:7018) यि(cid:6989)त को सुनवाई का अवसर (cid:7408)दए जान ेके प(cid:7019) चात ् यह समाधान हो जाता ह ै(cid:7408)क ऐसा (cid:7079)माणप(cid:7074) गलत, (cid:7082)ामक या िम(cid:7005) या जानकारी के आधार पर या गलती से या अनवधानता से जारी (cid:7408)कया गया था; या

(iii) सद(cid:7021) य न े (cid:7018) यवसाय से (cid:7079)िवरत होने के कारण र(cid:7374)करण के िलए आवेदन (cid:7408)कया ह;ै या

(iv) सद(cid:7021) य न े सुसगं त वष (cid:6981) क(cid:7409) एक अ(cid:7079)ैल को या उसके पूव (cid:6981) (cid:7018) यवसाय (cid:7079)माणप(cid:7074) के िलए वा(cid:7414)षक फ(cid:7409)स या का न(cid:7011) ब े (cid:7408)दन स े अिधक लंिबत कोई अ(cid:7008) य शो(cid:7007) य(cid:7298) का संदाय नह(cid:7277) (cid:7408)कया ह ैजो; या

(v) सद(cid:7021) य प(cid:7407)रषद ्(cid:7367)ारा अिधकिथत अनुभव या मानदंड(cid:7298) को पूरा नह(cid:7277) करता ह;ै या

(vi) सद(cid:7021) य न े सुसंगत वष(cid:6981) क(cid:7409) 30 जनू तक वा(cid:7414)षक सद(cid:7021) यता फ(cid:7409)स का संदाय नह(cid:7277) (cid:7408)कया ह;ै या

(vii) कोई अ(cid:7008) य मानदंड जो प(cid:7407)रषद ्(cid:7018)य वसाय (cid:7079)माणप(cid:7074) को र(cid:7374) (cid:7408)कए जाने के िलए अिधसूिचत करे ।

(2) (cid:7079)माणप(cid:7074) का र(cid:7374)करण,-- (क) उपिविनयम (1) के खंड (i) के अधीन आने वाले (cid:7408)कसी मामले म(cid:7286) उस तारीख को िजसको और अविध के दौरान िजसके िलए (cid:7079)माणप(cid:7074) के धारक का नाम रिज(cid:7021) टर से हटाया गया था, (cid:7079)भावी होगा;

(ख) उपिविनयम (1) के खडं (iv), खंड (v) और खंड (vi) के अधीन आन े वाले (cid:7408)कसी मामले म (cid:7286) स(cid:7021)ं थान (cid:7367)ारा सूचना जारी (cid:7408)कए जाने क(cid:7409) तारीख स े पं(cid:7076)हव े (cid:7408)दन (cid:7079)भावी होगा;

(ग) (cid:7408)कसी अ(cid:7008) य मामल े म(cid:7286) ऐसी तारीख से और ऐसी अविध के िलए (cid:7079)भावी होगा जो प(cid:7407)रषद ्(cid:7367)ारा िविनि(cid:7019) चत क(cid:7409) जाए ।

(3) जहां कोई (cid:7079)माणप(cid:7074) र(cid:7374) कर (cid:7408)दया जाता ह ै वहां वह तारीख क(cid:7409) िजससे (cid:7079)माणप(cid:7074) र(cid:7374) (cid:7408)कया जाएगा, सद(cid:7021) य को संसूिचत क(cid:7409) जाएगी और सं(cid:7021)थ ान क(cid:7409) वेबसाइट पर (cid:7079)कािशत क(cid:7409) जाएगी:

No. M-18012/03/2008-Ins.III.—The following draft regulations which the Council of the Institute of Actuaries of India, proposes with the previous approval of the Central Government is hereby published as required under sub-section(1) of section 56 of the Actuaries Act, 2006 (35 of 2006), for the information of all persons likely to be affected thereby; and notice is hereby given that the said regulations will be taken into consideration after expiry of a period of forty-five days from the date on which the Official Gazette in which this notification is published are made available to the public;

Objections or suggestions which may be received from any person in respect of the said draft regulations before expiry of the said period, will be taken into consideration by the Council of the Institute of Actuaries of India;

DRAFT REGULATIONS In exercise of the powers conferred by clauses (a), (b), ( c), (d), (e), (f) and (g) of sub-section (2) of section 56 of the Actuaries Act, 2006 (35 of 2006), the Council of the Institute of Actuaries of India, with the previous approval of the Central Government, makes the following regulations, namely: -

1. Short title and commencement.—

(1) These regulations may be called the Institute of Actuaries of India (Entry of Names in Register of Members, Fees Payable, Honorary Members, Affiliate Members, Student Members and Issuance of Certificate of Practice) Regulations,

2016.

(2) They shall come into force from the date of their final publication in the Official Gazette.

2. Definitions.— In these regulations, unless the context otherwise requires,

(1) (a) “Act” means the Actuaries Act, 2006 (35 of 2006);

(b) “certificate of practice” means the certificate of practice issued to a person who is entitled to practice as an Actuary under the Act;

(c) “Honorary Secretary” means Honorary Secretary to the Council of the Institute of Actuaries of India;

(d) “Institute” means the Institute of Actuaries of India constituted under section 3 of the Act.

(2) All words and expressions used herein and not defined but defined in the Act, or any rule or regulation made thereunder shall have the meanings respectively assigned to them in the Act or such rule or regulation, as the case may be.

3. Qualification for membership of Institute.—

(1) (a)Any person who qualifies the examination specified in this regulation shall be entitled to have his name entered in the register as an associate or a fellow member of the Institute.

(b) The Institute shall upload on its website in a manner accessible to its members the syllabi for the examination referred to in sub-regulation (1) :

Provided that any amendment, alteration or variation in the syllabi for any paper of study or examination shall take effect not less than three months after the date of notification on the website of the Institute.

(2) (a) The examination shall be conducted in such manner and at such time and place as the Council, or a committee or a group of persons authorised by the Council, may decide, from time to time.

(b) The committee or person appointed by the Council shall maintain a list of approved examiners for the purpose of the examinations under this regulation.

(3) (a) An application for admission to an examination shall be made online or in Form E of Schedule H.

(b) Every application under clause (a) shall be accompanied by such fees specified in sub-regulation (2) of regulation 6 so as to reach the Institute in time and in accordance with the directions given by the Council from time to time and the Institute shall issue an examination admit card in Form K of Schedule I to each candidate appearing in the examination.

(4) (a) The Council, or a committee or persons authorised by the Council for this purpose, may, for any sufficient reason to be recorded in writing, refuse to admit a candidate to an examination or admit him to an examination subject to¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 35 such conditions considered to be reasonable in the circumstances of the case or may for any sufficient reason to be recorded in writing , refuse a candidate admission to an examination hall or expel him from an examination hall, after he

has been admitted to it in the usual course :

Provided that no candidate shall be refused admission to an examination or be expelled from an examination hall without giving him an opportunity of being heard.

(b) If a candidate is reported to have behaved in a disorderly manner in or near an examination hall or is reported to have resorted to or attempted to have resorted to unfair means for the purpose of passing or disturbing an examination, the Council or a committee or a person authorised by it, may, on receipt of a report to that effect and after such investigation as it may deem necessary take such disciplinary action including cancellation of candidate’s examination result or cancellation or suspension of his student membership or both , as it may think fit, provided that an opportunity shall be given to the candidate of being heard before an order affecting him is passed.

(c) Any order passed by the Council, or the committee or the person authorised by the Council, may be reviewed by the Council on a representation made by the affected candidate and that the decision of the Council shall be final and binding on all concerned.

(d) The examination fee paid by a candidate may be refunded under certain circumstances as per the guidelines issued by the Council or the committee or the person authorised by it.

(5) (a) A list of candidates declared successful at each examination shall be published on the website of the Institute after

it is duly signed by an authorised person:

Provided that the Institute may also intimate the candidates of their results individually.

(b) The Council or the committee authorised by it may, under exceptional circumstances and arising out of systemic error, revise the marks or grades obtained by all candidates or a section of candidates in any particular paper or papers or in the aggregate in such manner as it may consider necessary, for maintaining the pass standards.

Explanation.— For the purposes of this clause, the word “section” refers to a category of the candidates who meet certain criteria as set out by the Council.

(6) Notwithstanding anything contained in this regulation, where it is found that the result of an examination has been affected by error, malpractice, fraud, improper conduct or other matter, of whatever nature, the Council or the committee authorised by it shall have the power to amend such result, in such manner as shall be in accordance with the true

position and to make such declaration as the Council shall consider necessary in that behalf:

Provided that no such amendment shall be made which adversely affects a candidate, without giving him an

opportunity of being heard:

Provided further that in the event of an error not arising out of any act or default on the part of a candidate, proceedings for amendment adversely affecting the candidate shall not be initiated after the expiry of a period of one month from the date of the declaration of result.

(7) Every candidate who has passed an examination under this regulation shall be given a performance report to that effect in Form G of Schedule A.

4. Qualification for registration as a fellow member.—

(1) A person maybe registered as a fellow member if he -

(a) has passed the examination for fellow membership under regulation 3;

(b) has completed such professional or other course or training as stipulated by the Council from time to time; and

(c) has relevant work experience as stipulated by the Council from time to time.

(2) The examination referred to in regulation 3 shall stand waived for a person seeking admission as a fellow member under the Mutual Recognition Agreement (MRA) entered into by the Institute with other actuarial bodies located outside India if --

(a) on the date of application for fellow membership of the Institute, the person continues to be a member of the actuarial body which has the MRA with the Institute;

(b) on the date of application for fellow membership of the Institute , the person satisfies the relevant requirements

of MRA with the concerned actuarial body :

Provided that the Council shall provide the information of all concerned actuarial bodies with whom the Institute has entered in MRA on the website of the Institute.36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(3) A person who desires to be admitted as a fellow member shall make an application to the Institute in Form D of Schedule C together with documentary evidence as to his eligibility for admission as a fellow and the fee specified in sub-regulation(1) of regulation 6:

Provided that the applicant shall provide such other information as the Council may require.

(4) A certificate of fellow membership shall be issued in Form I of Schedule G. (cid:53)(cid:46) Qualification for registration as an associate member .—

(1) A person shall be admitted as an associate member if he -

(a) has passed the examination for associate membership under regulation 3; and

(b) has completed such professional or other course or training as stipulated by the Council from time to time; and

(c) has relevant work experience as stipulated by Council from time to time.

(2) The examination referred to in regulation 3 may be dispensed with in the case of a person who has passed such examination as stipulated by the Council from time to time from another actuarial body or an academic institution deemed to be equivalent to the corresponding examination of the Institute.

(3) A person who desires to be admitted as an associate member shall make an application to the Institute in Form B of Schedule B, together with documentary evidence as to his eligibility for membership and the fee specified in sub- regulation (1) of regulation 6;

Provided that the applicant shall furnish such other information as the council may require.

(4) A Certificate of an associate membership shall be issued in Form H of Schedule F.

6. Fees .—

(1) Every application for entry of names in the register under regulation 4 and regulation 5 shall be accompanied with a fee of an amount not exceeding twenty-five thousand rupees, as the Council may determine from time to time.

(2) Every application for admission to an examination under sub-regulation (3) of regulation 3 shall be accompanied with a fee of an amount not exceeding one lakh rupees per subject for students in India including South Asian Association for Regional Cooperation (SAARC) countries, as the Council may determine from time to time:

Provided that the examination fees payable by persons with examination centre outside India and SAARC countries shall be such amount not exceeding two lakh rupees per subject, as the council may determine from time to time.

(3) Every member shall pay annual membership fee of such amount not exceeding one lakh rupees, as the Council may determine, from time to time :

Provided that the members whose address for correspondence is located outside India in the register of members, shall pay such annual membership fee of an amount not exceeding two lakh rupees, as the Council may determine from time to time.

(4) The Council shall determine fees for course material, coaching, counselling, training and other purposes :

Provided that such fee shall not exceed fifty thousand rupees per subject, as the Council may determine from time to time.

Provided further that persons with address for correspondence outside India shall pay such fees not exceeding one lakh rupees per subject, as the Council may determine from time to time.

7. The manner in which honorary members may be chosen.— The Council may, by a vote of not less than four-fifths of all its members, admit as an honorary member under sub-

section (1) of section 8 of the Act, a person who, on account of his eminence and his experience in matters related to the profession of actuary is considered to be able to render assistance in promoting the objects of the Institute provided that

he is not practicing as an Actuary :

Provided that the person to be considered for such admission shall satisfy all the requirements stipulated by the Council from time to time.

8. Admission as an affiliate member of the Institute.—

(1) Any person who possesses a qualification from another actuarial body deemed by the Council as equivalent to the fellow membership of the Institute and who is not less than twenty-one years of age shall be entitled to be admitted as an affiliate member of the Institute under sub-section (2) of section 8 of the Act.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 37

(2) Any person referred to in sub-regulation (1) who desires to be admitted as an affiliate member of the Institute shall make an application to the Institute in Form C of Schedule E together with documentary evidence about his eligibility for membership and on payment of a fee specified in sub-regulation (1) of regulation 6:

Provided that the Institute has a reciprocity agreement with such actuarial body through the signing of a mutual recognition agreement or the like as duly authorised by the Council.

(3) The determination as to whether an actuarial qualification referred to in sub-regulation (1) from another actuarial body is deemed as equivalent to fellow membership of the Institute shall be as per the norms laid down by the Council from time to time in this regard.

9. Admission as a student member of the Institute.—

(1) Any person who has passed 10 plus 2 or equivalent and has cleared Actuarial Common Entrance Test (ACET) conducted by the Institute shall be entitled to be admitted as a student member of the Institute under sub-section

(3) of section 8 of the Act.

(2) Any person who desires to enroll himself as a student member of the Institute shall make an application to the Institute in Form A of Schedule D together with documentary evidence as to his eligibility for membership and accompanied by a fee specified in sub-regulation (1) of regulation 6.

10. Qualification, form and fee for certificate of practice.—

(1) A fellow member of the Institute whose name is entered in the register maintained by the Institute under section 6 of the Act and who possesses the experience and the norms laid down by the Council from time to time, shall be entitled to apply for a certificate of practice under this regulation.

(2) An Application for certificate of practice shall be made in Form F of Schedule J accompanied by such fee as may be determined by the Council from time to time but which shall not exceed one lakh rupees in any case.

(3)Notwithstanding anything contained in this regulation, a certificate of practice held by a member under section 9 of the Act shall be deemed to have been issued under this regulation and shall continue to be valid until it is cancelled.

(4) A certificate of practice shall be issued in Form K of Schedule K.

11. Cancellation of certificate of practice.—(1) A certificate of practice issued under regulation 10 shall be liable for cancellation if –

(1) (i) the name of the holder of the certificate is removed from the register under section 24 of the Act; or

(ii) the Council is satisfied, after giving an opportunity of being heard to the person concerned, that such certificate was issued on the basis of incorrect, misleading or false information, or by mistake or inadvertence; or

(iii) a member has applied for cancellation as he has ceased to practice; or

(iv) a member has not paid annual fee for certificate of practice on or before the first day of April, of the relevant year, or any other dues are pending for more than ninety days; or

(v) a member has not fulfilled the experience or the norms laid down by the Council; or

(vi) a member has not paid annual membership fee till the 30th day of June of the relevant year; or

(vii) any other criteria which the Council may notify, for cancellation of certificate of practice.

(2) The cancellation of a certificate shall be effective -

(a) in a case falling under clause (i) of sub-regulation (1), on the date on which and during the period for which, the name of the holder of the certificate was removed from the register;

(b) in a case falling under clauses (iv), (v) and (vi) of sub-regulation (1), from the 15th day following the date of issue of notice by the Institute ;

(c) in any other case, from such date and for such period, as may be decided by the Council.

(3) Where a certificate is cancelled, the date from which the certificate shall stand cancelled shall be communicated to

the member and published on the website of Institute:

• Candidates are required to write answers to Question Papers in their own handwriting with pen/ ball-point pen in blue or black ink and in no other colour ink. Writing answers with red or green ink is prohibited. Accordingly, candidates are advised to bring their own pen, pencil, scale, ink pot and calculator for their use.

• Candidates may be allowed to use Electronic Calculators provided they do not have the memory that can retain text or formulae previously keyed in. Irrespective of the use of calculator, candidates are advised to invariably show all important steps and working notes relating to solutions of practical problems along with their answers. Rough work done should be marked as “ROUGH WORK for Questions No. …..” and scored off by drawing a line across the written material. Rough work could be done on the back side of the ruled sheet. Exchange of calculators or any other item / material shall not be permitted in the Examination Hall.

• On receipt of the answer booklet, first of all, every candidate must write his / her Roll number in the bottom right corner of the answer booklet. The total number of pages used should be mentioned on the first page of the answer sheet. You need to ensure that the invigilator has signed on the first page of your answer booklet and any other extra sheet taken by you for writing the examination. Further, every candidate is expected to satisfy himself/ herself that he / she has received correct and complete question paper and verify it with reference to the Examination Time – Table and Programme, and see that the total number of questions and printed pages are in order.

• Candidates are warned that writing of any matter on Question Paper, Hall Ticket, Identity Card, Scale , etc. , or taking any paper

(s) from the Examination Hall shall be viewed seriously and entail disciplinary action. • Candidates must not write any irrelevant matter, criticism of question paper, any sort of appeal to examiners, salutation or invocation to God, etc., anywhere in the answer sheet/s. This will invite disciplinary action.

• Candidates should write answers only on ruled sides of the answer sheet/s. In order to avoid wastage and possibility of misuse, candidates will be issued additional answer sheets only on demand after they have completely used the answer booklet provided to them initially at the start of the examination. Any attempt to tamper with the answer booklet shall tantamount to misconduct.

• Each question should be started on a fresh page and sub – question (s) of the same question should be attempted in a consecutive order. While attempting a fresh question or sub – question, the candidate must clearly and prominently mention respective question number before the answer, in bold capital letters.

• Candidates are expected to write precise and to – the – point answers to the questions in neat and legible handwriting.

Candidates are advised that a reasonable standard of handwriting legibility is expected by the examiners and that candidates may be penalized if undue effort is required by the examiners to interpret scripts.

• On completion of examination, the answer booklet and question paper must be handed over immediately to the Invigilator on duty separately. • It shall be the personal responsibility of the candidate concerned to properly hand over his / her answer booklet even if blank, to the Invigilator concerned on duty in the Examination Hall. Any representation regarding omission to surrender the written answer booklet or part thereof in the Examination Hall at the time of handing over his / her Answer Booklet, for any reason whatsoever, shall not be entertained after the examination in that paper is over.

• It is brought to your notice that in accordance with provisions contained in the Professional Conduct Standards, if any candidate is found copying or involved in any other form of malpractice, during or in connection with the examination, disciplinary action will be taken against the candidate which may include expulsion or suspension from the membership of IAI also.

• The candidates appearing for CA, ST and SA series examination will be given 15 minutes at the start of the examination for reading the Question Paper.
