G.S.R. 287(E).—The following draft rules further amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of powers conferred by sections 41, 50, 109, 110, of Motor Vehicles Act, 1988 (59 of 1988), are hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification, as published in the Gazette of India, are made available to the public. Objections or suggestions, if any, may be sent to the Joint Secretary (MVL, Transport, Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001, Email: comments- morth@gov.in. Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government; Draft Rules 1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (...............Amendment) Rules, 2021. (2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred as the said rules), for rule 2 (zd), the following sub rule 2 (zd) shall be substituted, namely: - “(zd) “Special Purpose Vehicle (SPV)” means a motor vehicle so constructed or altered to serve as a specific transportation requirement of goods and/or passenger transport.” 3. In the said rules in [rule 112] after sub-rule (4) the following sub rules shall be inserted, namely.- “(5) On and after six months from the date of issue of the notification, Special Purpose Vehicles, viz, Cash Vans and Mobile Canteen, and as described in AIS 163, shall comply with the requirements stated in AIS-163:2020, as amended from time to time. (6) On and after six months from the date of issue of this notification, Two Wheeled First Responder – Fire, shall comply with the requirements stated in AIS 167:2020, as amended from time to time. (7) On and after one year from the date of issue of this notification, Insulated vehicles, shall comply with the requirements stated in AIS-164:2021, as amended from time to time. (8) On and after six months from the date of issue of this notification, Motor Caravans, shall comply with the requirements stated in AIS-124:2014, as amended from time to time.” 4. In the said rules, in rule 125-G, after sub-rule (2), the following proviso and sub-rules shall be inserted, namely: - “Provided that, on and after six months from the date of issue of this notification, motor vehicles modified as Motor Caravans shall comply with AIS 124:2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act 2016 (11 of 2016). (3) On and after six months from the date of issue of this notification, Special Purpose Vehicle, viz, Cash Vans and Mobile Canteen, and as defined in AIS 163, manufactured by Original Equipment Manufacturers, shall comply with the requirements of AIS 163, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act 2016 (11 of 2016). (4) On and after six months from the date of issue of this notification, Two Wheeled First Responder – Fire, manufactured by Original Equipment Manufacturer, shall comply with the requirements of AIS 167, as amended from time to time.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (5) On and after one year from the date of issue of this notification, Insulated Vehicle manufactured by Original Equipment Manufacturer, shall comply with the requirements of AIS 164, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act 2016 ( 11 of 2016).” 5. In the said rules, in Form 22 F, - for the words, figures and brackets, “[(See rules 47B (3),112(3), 112(4), 126)]”, the words, figures and brackets, “[(See rules 47B (3),112(3), 112(4), 112(5), 112(6), 112(7), 112(8), 126)]”, shall be substituted.
