Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period specified above to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jor Bagh, Road, New Delhi-110003, or send it to Member Secretary, CPCB and Scientist ‘D’ Ministry at the e-mail address i.e. mscb.cpcb@nic.in and h.kharkwal@nic.in.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Draft Rules 1. (1) These rules may be called the Environment (Protection) Amendment Rules, 2018. (2) They shall come intoforce on the date of their final publication in the Official Gazette. 2. In the Environment (Protection) Rules, 1986, in Schedule-I, for entry 74 the following entry shall be substituted, namely:- 1 2 3 4 “74 Brick Kilns Bull’s Trench Kilns, Induced/High Draft Kiln, Hoffmann Kilns, Tunnel, down draft Kilns, Vertical Shaft Kilns (VSK) and Zig Zag. Particulate matter in stack emission 250 mg/Nm’ Minimum stack height (for Natural draft kilns) - Kiln capacity less than 30,000 bricks per day 27 m - Kiln capacity equal or more than 30,000 bricks per day 30 m Minimum stack height (for Induced/High draft kilns) - Kiln capacity less than 30,000 bricks per day 24 m - Kiln capacity equal or more than 30,000 bricks per day 27 m Notes: 1. All new brick kilns shall be allowed only with zig-zag or vertical method of brick making and shall comply to the new standards as stipulated in this notification. 2. The existing brick kilns which are not following zig zag or vertical method of brick making shall be converted so as to adopt zig zag or vertical method within a period of one year in case of kilns located near non-attainment cities and two year for other both kilns. Further, in cases where CPCB/SPCB/PPC has separately laid down timelines for conversion, such orders shall prevail. 3. The new brick kilns shall have appropriate stack heights to meet the new standards and comply with the norms for Particulate Matter (PM) within one year. 4. All brick kilns shall use only approved fuel such as coal, fire wood and/or agricultural residues. Use of pet coke shall not be allowed in brick kilns. 5. In the intervening period of one year allowed to the existing brick kilns to complywith these new standards for Particulate Matter by adopting good fuel charging/operation practices. 6. Brick kilns shall construct permanent facility (port hole and platform) as per the norms/design laid down by the CPCB for monitoring of Emissions. 7. Emission sample shall represent both fuel charging and non-charging conditions. 8. Particulate Matter (PM) results shall be normalized at 4% CO, as below: 9. PM (normalized) = PM (measured) x 4% / measured CO, in% Stack height (in metre) shall also be calculated by formula H=l4Q’' (where Q is SO emission rate in kg/hr), and the maximum of two 2 shall apply. 10. A brick kilns will be considered an Induced/High draft kiln if it has a fan operating with minimum 50mm water gauge draught. 11. Brick kilns should be established at a minimum distance of 0.8 km from habitation and fruit orchards. State Boards may make siting criteria stringent considering proximity to habitation, population density, water bodies, sensitive receptors, etc. 12. Brick kilns should be established at a minimum distance of 1 km from an existing fixed chimney kiln to avoid clustering of kilns in an area. 13. Brick kilns shall follow process emission control guidelines as prescribed by concerned SPCBs/PCCs. 14. The ash generated in the brick kilns shall be fully utilized in-house in brick making. 15. All necessary approvals from the concerned authorities including mining department of the concerned State/UT shall be obtained for extracting the top soil to be used for brick making in the brick kiln. 16. The brick kiln owners shall ensure that the road utilized for transporting raw materials/bricks shall be metaled roads and is dust free. 17. Trucks shall be covered during transportation of raw material/bricks. 18. The existing kilns shall increase stack height, if required, to meet these new standards within 1 year”. [F.N.O.
