Executive Summary & Key Takeaways

**Executive Summary** The Ministry of Commerce and Industry has notified the Gas Cylinders (Amendment) Rules, 2026, to further amend the principal Gas Cylinders Rules, 2016. Effective from their publication date of April 28, 2026, these amendments streamline import permissions for specific government departments and clarify the regulatory scope for flammable gases. The final rules were issued following a 30-day public objection period initiated in February 2026, during which no suggestions were received. **Key Points / Main Content** **Exemptions for Government Entities** * The rules now include cylinders and valves imported by the Ministry of Defence, the Department of Space, and their respective Public Sector Undertakings (PSUs) for their own use under specific regulatory provisions (Rule 3). **Simplification of Import Permissions** * Permission is no longer required for the import of empty gas cylinders that are not fitted with valves. * Import permission is exempted for valves and LPG regulators, provided they are sourced from foreign manufacturing plants approved by the Chief Controller and possess a valid import license in Form-D. **Expanded Regulatory Scope** * The regulatory language in Rule 48 has been broadened to include "other flammable gases" alongside "Liquified Petroleum Gas" (LPG), ensuring a wider range of hazardous substances are covered by the safety provisions. **Impact Analysis** **Ministry of Defence, Department of Space, and related PSUs** **Impact** These entities are now explicitly recognized regarding the import of cylinders and valves for internal consumption, potentially streamlining their procurement and logistics operations. **Action Required** Relevant departments must ensure that their import documentation for cylinders and valves correctly cites the updated provisions for "own use" as per Rule 3(5). **Importers of Gas Cylinder Components** **Impact** Importers benefit from reduced administrative hurdles as permissions are waived for empty cylinders without valves and for specific components from approved foreign plants. **Action Required** Importers must verify that their foreign suppliers are approved by the Chief Controller and ensure they hold a valid import license in Form-D to utilize the permission exemptions. **Gas Industry and Safety Compliance Officers** **Impact** The amendment clarifies that regulations previously specifying LPG now apply to all flammable gases under Rule 48. **Action Required** Compliance teams must update internal safety protocols and regulatory filings to ensure all flammable gases are handled in accordance with the amended Rule 48(3).
