(1) संजक्षप्त नाम और प्रारम्भ :- इन जनयमों को माल का भौगोजलक उपििधन (पंिीकरण और संरक्षण) (संिोधन) जनयम, 2025 कहा िाएगा। (2) य ेजनयम आजधकाररक रािपत्र में इनके प्रकािन की तारीख से प्रभावी होंगे। 2. माल का भौगोजलक उपििनध (पंिीकरण और संरक्षण) जनयम, 2002 में, पहली अनुसूची की ताजलका में, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, नामतः- “पहली अनसु चू ी” [जनयम 10 (1) िेख]ें प्रजवजि की सबं जं धत प्रपत्र दकस मि हते ुिेय होगा राजि रुपए म ें सख्ं या सख्ं या (1) (2) (3) (4) एक श्रणे ी म ें िाजमल वस्ट्तओंु के जलए भौगोजलक उपििधन के िीआई-1 1क. पंिीकरण हते ु आवेिन करने पर [धारा 11(1); जनयम 23(2) 1000 िेख]ें । दकसी कन्वेंिन िेि से एक श्रेणी में िाजमल वस्ट्तुओं के जलए 1ख. भौगोजलक उपििनध के पंिीकरण हते ु आवेिन करन े पर [धारा 1000 िीआई-1 11(1), 84(1); जनयम 23(3) िेख]ें । जवजभन्न श्रेजणयों की वस्ट्तओंु के जलए भौगोजलक उपििनध के प्रत्येक श्रेणी के िीआई-1 1ग. पंिीकरण हते ु एक आवेिन करने पर [धारा 11(3); जनयम 23(5) जलए 1000 िेख]ें । दकसी कन्वेंिन िेि की जवजभन्न श्रेजणयों की वस्ट्तओंु के जलए प्रत्येक श्रेणी के िीआई -1 1घ. भौगोजलक उपििधन के पंिीकरण हते ु एक आवेिन करन े पर [धारा जलए 1000 11(3), 84(1); जनयम 23(4)]। धारा 14(1) के तहत भौगोजलक उपििधन के पंिीकरण के जवरोध प्रत्येक श्रेणी के 2क. या प्राजधकृत उपयोगकताध के जवरोध संबंधी नोरिस िेन े पर [धारा िीआई -2 जलए 1000 17(3)(ङ) िेख]ें । जवरोध संबंधी प्रत्येक आवेिन के जलए धारा 14(2) या 17(3)(ङ) के तहत जवरोध के नोरिस के उिर म ें और प्रत्येक भौगोजलक 2ख. 1000 िीआई -2 उपििधन के संबंध में धारा 27 के तहत आवेिन के उिर में या धारा 29 के तहत जवरोध के नोरिस के उिर म ेंिवाबी कथन पर जवरोध का नोरिस फाइल करने के जलए समयावजध बढाने हते ु 2ग. आवेिन करन े पर [धारा 14(1), 17(3)(ङ), 29(2); जनयम 41(5) 300 िीआई -2 िेख]ें । धारा 17, जनयम 56(1) के तहत पंिीकृत भौगोजलक उपििनध के 3क. 10 िीआई -3 प्राजधकृत उपयोगकता धके पंिीकरण के जलए आवेिन पर। 3ख. प्राजधकृत उपयोगकताध के पंिीकरण के नवीकरण के जलए [धारा 18 10 िीआई -3 की उप-धारा (2) और जनयम 60 का उप-जनयम (1)] जपछल े पंिीकरण के समाप्त होने पर भौगोजलक उपििधन के 4क. पंिीकरण की धारा 18(1) के तहत नवीकरण के जलए [जनयम 500 िीआई -4 60(1) िेख]ें । 1000 रुपए भौगोजलक उपििनध या रजिस्ट्िर से हिाए गए प्राजधकृत तथा नवीकरण 4ख. उपयोगकता ध की बहाली के जलए धारा 18(5) के तहत आवेिन पर िीआई -4 के जलए लाग ू [जनयम 63]। िुल्क[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 4ग. धारा 18(4) के परन्तुक के तहत नवीकरण के जलए आवेिन पर। 1000 िीआई -4 िीआई आवेिन के मामल ेम ें 300 भौगोजलक उपििधन रजिस्ट्िर या प्राजधकृत उपयोगकता धद्वारा भारत 5क. में व्यवसाय करन े के मुख्य स्ट्थान या जनवास स्ट्थान के पत े या गहृ िीआई -5 प्राजधकृत ििे के पत े में पररवतनध के अनुरोध पर [धारा 28; जनयम 69 िखे ें]। उपयोगकताध आवेिन के मामल े म ें30 भौगोजलक उपििधन के स्ट्वामी के नाम या जववरण म ें पररवतनध को 5ख. 300 िीआई -5 रजिस्ट्िर म ेंिि धकरन े के अनुरोध पर। िीआई आवेिन के मामल ेम ें 300 दकसी भौगोजलक उपििधन के पंिीकृत स्ट्वामी या प्राजधकृत 5ग. उपयोगकताध के नाम, पत े या जववरण म ें दकसी त्रुरि म ें सुधार के िीआई -5 प्राजधकृत अ नुरोध पर [धारा 28 (क) िेख]ें उपयोगकताध आवेिन के मामल े म ें30 दकसी प्राजधकृत उपयोगकताध को हिाने के जलए भाग ख म ें रजिस्ट्िर 5घ. 1000 िीआई -5 म ें सुधार के जलए आवेिन पर [धारा 27; जनयम 65 िेख]ें। धारा 15 जनयम 23(7) के परन्तुक के तहत दकसी श्रेणी म ें वस्ट्तुओं 5ङ. के वगीकरण पर या जवजभन्न श्रजे णयों म ें दकसी भौगोजलक उपििधन 1000 िीआई -5 के पंिीकरण के जलए दकए गए आवेिन के वगीकरण पर। 5च. एक श्रेणी के संबंध म ेंजनयम 22 के तहत पता लगान े के जलए। 500 िीआई -5 रजिस्ट्िर म ें सुधार या भौगोजलक उपििनध को हिान े या रजिस्ट्िर म ें ििध जनयम 32(1) के तहत मामले के जववरण या रजिस्ट्िर स े 6क. 1000 िीआई -6 प्राजधकृत उपयोगकता ध को हिाने या बिलन े के जलए धारा 27 के तहत आवेिन पर [जनयम 65 िखे ]ें । रजिस्ट्िर म ें सुधार या रजिस्ट्िर स े दकसी भौगोजलक उपििनध या प्राजधकृत उपयोगकता ध को हिाने से संबंजधत कायधवाही में हस्ट्तक्षपे 6ख. 500 िीआई -6 करन े की अनुमजत के जलए आवेिन पर [जनयम 67 और 80 (4) िेख]ें । िीआई आवेिन के मामले म ें 300 रजिस्ट्रार के प्रमाण-पत्र संबंधी अनुरोध पर [धारा 69 या धारा 7क. िीआई -7 78(1) ; जनयम 96] के तहत प्रमाण -पत्र को छोड़कर। प्राजधकृत उपयोगकताध आवेिन के मामले में 150 मामले के कथन के समथधन में िपथ पत्र या अजधजनयम या जनयमों 7ख. िून्य िीआई -7 के तहत अपेजक्षत अन्य िस्ट्तावेि। अपीलीय बोडध की वैधता प्रमाण-पत्र के नोि को रजिस्ट्िर म ें िि ध 7ग. 200 िीआई -7 करने और जवज्ञापन िने े के अनुरोध पर [जनयम 99 िेख]ें । 7घ. रजिस्ट्रार के जनणधय की समीक्षा के जलए आवेिन पर। 500 िीआई -7 7ङ. भौगोजलक उपििधन के जवज्ञापन के जववरण के जलए रजिस्ट्रार स े 100 िीआई -74 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अनुरोध करन े पर। िीआई आवेिन के मामले म ें 200 प्रमाण-पत्र की िसू री प्रजत या अजतररि प्रजत के जलए रजिस्ट्रार स े 7च. िीआई -7 अ नुरोध करन े पर। प्राजधकृत उपयोगकताध आवेिन के मामले में 40 भौगोजलक उपििनध एिेंि के पंिीकरण के जलए आवेिन [जनयम 8क. 1000 िीआई -8 107 िेख]ें । भौगोजलक उपििनध एिेंि के रूप म ें प्रमाण-पत्र िारी करने के 8ख. 1000 िीआई -8 अनुरोध पर [जनयम 109 िेख]ें । जनयम 110 के तहत भौगोजलक उपििनध एिेंि के रजिस्ट्िर म ें दकसी व्यजि का नाम िारी रखने के जलए। (i) प्रत्येक वर्ध के जलए (पहल े वर्ध को छोड़कर) प्रत्येक वर् ध की 1 अप्रैल को भगु तान दकया िाएगा। 8ग. (ii) पहल े वर् ध के जलए, 1 अप्रलै से 30 जसतंबर के बीच दकसी भी 1000 िीआई -8 समय पंिीकृत व्यजि के मामल े में, पंिीकरण िल्ु क सजहत भुगतान दकया िाएगा। कृपया ध्यान िें: इस प्रयोिन के जलए एक वर्ध 1 अप्रलै से िरूु होगा और अगल ेवर्ध के 31 माचध को समाप्त होगा। 1000 के साथ प्रजवजि संख्या जनयम 113 के तहत भौगोजलक उपििनध रजिस्ट्िर म ें दकसी व्यजि 8ग के तहत 8घ. का नाम पुनःडालने के जलए आवेिन पर। िीआई -8 िारी रखन े के जलए जनधाधररत िुल्क कुछेक वस्ट्तओंु को अजतररि सरं क्षण प्रिान करन े के जलए रजिस्ट्रार 9क. 12000 िीआई -9 को आवेिन पर [धारा 22(2); जनयम 77 िेखें]। दकसी पंिीकृत भौगोजलक उपििधन को िाजमल करन े या पररवर्ततध करने की अनुमजत के जलए आवेिन पर [ऐसे मामलों को छोड़कर, 9ख. िहां आवेिन दकसी व्यजि या दकसी लोक प्राजधकरण द्वारा या 300 िीआई -9 दकसी सांजवजधक आवश्यकता के पररणामस्ट्वरूप दकया गया हो, [धारा 29 िेखें]। ऐसी समयावजध बढाने के जलए आवेिन पर, जिसके जलए 9ग. अजधजनयम म ें स्ट्पि रूप से प्रावधान नहीं दकए गए ह ैं या जनयमों म ें 300 िीआई -9 जवजनर्िधि नहीं दकया गया ह ै[जनयम 83 िेखें]। रजिस्ट्िर म ें दकसी प्रजवजि को रद्द करन े या वस्ट्तुओं को रजिस्ट्िर स े 10क. 300 िीआई -10 ह िाने के जलए आवेिन पर। [धारा 28 (ग) या (घ) िेख]ें अजधजनयम के तहत दकसी मामले या कायधवाही में एिेंि का 10ख. िून्य िीआई -10 प्र ाजधकार संबंधी प्रपत्र [धारा 76; जनयम 20 िेख]ें दकसी जववाि संबंधी कायधवाही में दकसी भी मध्यस्ट्थता वाले मामल े 11. पर रजिस्ट्रार का आििे प्राप्त करन े के जलए याजचका पर (िो 500 अन्यथा प्रभाररत न हो)। धारा 78(1) म ेंउजल्लजखत िस्ट्तावेि की िांच करने के जलए- 12. i. दकसी जविेर् भौगोजलक उपििनध या प्राजधकृत 100[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 उपयोगकताध के संबंध में, प्रत्येक घंिे या उसके भाग के जलए; ii. प्रत्येक 15 जमनि के कंप्यूिर सचध (उपलब्ध कराया 100 िाए) के जलए; iii. धारा 78 म ेंउजल्लजखत सूचकांक का पता लगाने हते ु, 100 प्रत्येक घंिे या उसके भाग के जलए। िस्ट्तावेिों की प्रजतजलजप हते ु (फोिोकॉपी या िाइप दकए गए) 13. 10”. प्रत्येक पृष्ठ या एक पष्ठृ के अलावा उसके भाग के जलए। [फा.सं. पी-24027/1/2023-आईपीआर-III] जहमानी पाण्ड,े अपर सजचव नोि: मलू जनयम, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खडं (i) अजधसूचना संख्या सा.का.जन. 176 (अ), तारीख 8 माच ध 2002 के माध्यम स े प्रकाजित दकए गए थ े और जपछली बार तारीख 26 अगस्ट्त, 2020 की सा.का.जन. 528 (अ) के माध्यम से संिोजधत दकए गए थे। MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 3rd November, 2025 G.S.R. 812 (E)— Whereas the draft of certain rules, further to amend the Geographical Indications of Goods (Registration and Protection) Rules, 2002 were published as required under sub- section (1) of section 87 of the Geographical Indications of Goods (Registration and Protection) Act, 1999 (48 of 1999) (hereinafter referred as “Act’) vide notification of the Government of India in the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) vide number G.S.R. 542 (E), dated the 11th August 2025, in the Gazette of India, Extraordinary, Part II, Section 3,sub-section (i) inviting objections and suggestions from all person likely to be affected thereby before the expiry of a period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the said notification were made available to the public on the 11th August 2025; And whereas, the objection and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now therefore, in exercise of the powers conferred by section 87 of the Geographical Indications of Goods (Registration and Protection) Act, 1999, (48 of 1999), the Central Government hereby makes the following rules further to amend the Geographical Indications of Goods (Registration and Protection) Rules, 2002, namely: - RULES 1. Short title and commencement.: — (1) These rules may be called the Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2.
