L.-33004/99 EXTRAORDINARY I— 1 PART I—Section 1 PUBLISHED BY AUTHORITY 123] No. 123] NEW DELHI, MONDAY, MAY 8, 2017/VAISAKHA 18, 1939 रेल मत्रं ालय (रेलवे बोर्ड) सकं ल प नई दिल्ल ी, 05 मई, 2017 स.ं 2015/इंफ्रा/12/15.—सरकार ने मंत्रत्रमंर्ल के अनुमोिन से 5 अप्रैल, 2017 को रेल त्रवकास प्रात्रिकरण (''आरर्ीए'') गठित करने का त्रवत्रनश चय दकया ह।ै रेल त्रवकास प्रात्रिकरण का स व रूप तथा पैरा/कायड त्रनम नानसु ार होंगे:- 1. "रेल त्रवकास प्रात्रिकरण" ऐसे काय-ड कलापों, त्रिन ह ें वतमड ान आिशे में दिया िा रहा ह,ै का त्रनष प ािन प्रचत्रलत त्रविायी फ्रेमवकड और/अथवा दकसी कानून के अंतगडत सांत्रवत्रिक प्रात्रिकार अथवा त्रवषयगत मामल े के अन तगडत फ्रेम दकए गए त्रनयमों अथवा त्रवत्रनयमों का अत्रतक्रमण दकए त्रबना करेगा। 2. रेल त्रवत्रनयामक स थ ात्रपत करन े का उद्दशे य एक स व तंत्र रेल त्रवत्रनयामक त्रनम नत्रलत्रित उद्दशे य ों को प्राप त करन े में सहायता करेगा: (i) लागत के अनरूु प सेवाओं की कीमत का त्रनिाडरण करना। (ii) गैर-दकराया रािस व को बढाने के उपायों का सुझाव िने ा। (iii) सेवा की गुणवत्त ा और इष् टतम लागत को सुत्रनत्रित करके उपभोक्त ाओं के त्रहतों की रक्षा करना। (iv) प्रत्रतस्प िाड, कुशलता और त्रमतव् यत्रयता को बढावा िने ा। (v) बािार के त्रवकास और स्ट ेकहोल् र्रों तथा ग्राहकों के त्रलए उत्रचत व् यवस् था सुत्रनत्र‍च त करने के त्रलए रेल सेक् टर में स्ट ेकहोल् र्रों की भागीिारी को बढावा िने ा। (vi) त्रनवेश के त्रलए सकारात् मक माहौल बनाना। (vii) इस सेक् टर में संसािनों के कुशल आबंटन को बढावा िने ा। 2981 GI/20172 THE GAZETTE OF INDIA: EXTRAORDINARY [PART I—SEC. 1] (viii) अन् तरराष्र ीय मानिण्र् ों के अनुरूप सेवा के मानकों की बेंचमार्किंग करना और उनके द्वारा मुहयै ा की गई सेवाओं की गुणवत्त ा, त्रनरन् तरता और त्रव‍ वसनीयता को त्रनिाडठरत करना और उसे लागू करना। (ix) र्त्रे र्केठटर् फ्रेट कोठरर्ोर (र्ीएफसी) अवसंरचना और भत्रवष् य में अन् य अवसंरचना के त्रलए त्रबना भेिभाव की िुली अत्रभगम् यता के त्रलए फ्रेमवकड मुहयै ा कराना। (x) अपेत्रक्षत कुशलता और त्रनष प ािन मानक प्राप त करने के त्रलए नई प्रौद्योत्रगदकयों को अपनाने के त्रलए उपाय सुझाना। (xi) अपने दकसी त्रनर्िषड ट उद्दशे य को प्राप त करन े हते ु मानव ससं ािन त्रवकास के त्रलए उपाय सुझाना। 3. ''रेल त्रवकास प्रात्रिकरण'' की सरं चना: इसम ें एक अि यक्ष होगा िो रेल त्रवकास प्रात्रिकरण की संपूणड कायड- व य वस था के त्रलए त्रिम मेिार होगा तथा तीन सिस य होंगे। सिस य (टैठरफ), टैठरफ त्रनिा रड ण तथा रेलपथ अत्रभगम यता प्रभार स े संबंत्रित कायड के त्रलए उत त रिायी होगा। सिस य (पीपीपी), ठरयायत करारों के साथ-साथ स टेकहोल र् रों के त्रनवेश संबंिी सभी मुद्दों का त्रनपटान करने के त्रलए उत त रिायी होगा तथा सिस य (कुशलता, मानक एवं बेंचमाकड), कुशलता, त्रनष प ािन मानक, बेंचमाकड त्रनिाडठरत करन े एवं सचू ना के प्रसार स े संबंत्रित सभी मामलों के त्रलए उत त रिायी होगा। 4. अि य क्ष तथा सिस य ों की त्रनयकु त्र त- अि यक्ष तथा तीनों सिस यों की त्रनयकु त्र त केन द्र सरकार द्वारा िोि एवं चयन सत्रमत्रत द्वारा संस त ुत नामों के पैनल में स े की िाएगी। िोि एवं चयन सत्रमत्रत में अि यक्ष के रूप में मंत्रीमण र्ल सत्रचव, अि य क्ष रेलव े बोर्ड एवं सत्रचव, कार्मडक एवं प्रत्रशक्षण त्रवभाग, मंत्रीमण र्ल सत्रचव द्वारा नात्रमत केन द्र सरकार के दकसी त्रवत्रनयामक त्रनकाय का अि यक्ष शात्रमल होंगे। अि यक्ष तथा सिस यों की त्रनयकु त्र त और सेवा स े संबंत्रित शतें आदि अनलु ग न क में िी गई ह।ैं 5. रेल त्रवकास प्रात्रिकरण के काय:ड रेल त्रवकास प्रात्रिकरण त्रनम नत्रलत्रित कायड करेगा: (i) टैठरफ त्रनिारड ण करन े का काय-ड रेल त्रवकास प्रात्रिकरण, इस संबंि में केन् द्र सरकार को सहायता िने े और उसके कायों के त्रनष्प ािन को सरल बनाने के त्रलए त्रनम् नत्रलत्रित कायों को त्रनष्प ादित करेगा: 1. फ्रेट तथा पैसेंिर िोनों सेगमेंटों के त्रलए टैठरफ के त्रनिाडरण के त्रलए मागडिशडक त्रसद्ांतों/त्रनयमों/मॉर्लों को तैयार करना। 2. टैठरफ त्रनिाडठरत करन े के सबं ंि में त्रसफाठरश करना, त्रिसमें प्रस त ात्रवत टैठरफ और टैठरफ म ें संशोिन का सुझाव िने ा शात्रमल ह।ै 3. वस तुओं के वगीकरण और पनु वडगीकरण का त्रनिाडरण करने के त्रलए त्रसद्ांतों को बनाना। 4. बिटीय सहायता अथवा अन य त्रवत्रियों के रूप में सब त्र सर्ी/सामात्रिक सेवा के िात्रयत वों के त्रसद्ातं ों को बनाना। 5. र्र्े ीकेठटर् फ्रेट कोठरर्ोर नटे वकड और भत्रवष य में अन य नेटवकों के त्रबना भेिभाव के अत्रभगम यता मुहयै ा करान े के त्रलए रैक अत्रभगम य ता प्रभार का त्रनिाडरण करन े के त्रलए मागडत्रनिशे ों/त्रनयमों का त्रनिाडरण करना। 6. कोई अन य कायड िो ऊपर उल त्र लत्रित कायों से सम ब द् हो या उनके पठरणामत: दकए िाने हों अथवा ऊपर (1) से (5) के संबंि में ऐसे अन य कायड, िो केन द्र सरकार द्वारा त्रवत्रशष ट तौर पर सौंपे िाए।ं (ii) रेलव े म ें स ट ेकहोल र् र के त्रनवशे के त्रलए उत्रचत तथा समान अवसर सत्रु नश त्र चत करना - रेल त्रवकास प्रात्रिकरण समान अवसर सुत्रनश त्रचत करने के त्रलए त्रनम नत्रलत्रित कायों को त्रनष प ादित करेगा:I 3 1. संशोिन का प्रस त ाव करना तथा रेल मंत्रालय द्वारा प्रस तुत संिभ ड पर रेल मंत्रालय को सुझाव/परामशी नोट भेिना। 2. त्रनिी त्रनवेशों/पीपीपी के माि यम से अवसंरचना सिृ न के त्रलए रेल मंत्रालय की नीत्रतयों के संबंि में सुझाव िने ा और पीपीपी त्रनवेशकों की समुत्रचत सुरक्षा सत्रु नत्रित करना। 3. भावी ठरयायत करारों के बारे म ें त्रववािों का समािान करना बशत े दक मि यस थता एव ं सुलह अत्रित्रनयम, 2015 के साथ-साथ मि यस थ ता एवं सुलह अत्रित्रनयम, 1996 और उसके संशोिनों के अनुपालन में ऐस े त्रववािों को रेल त्रवकास प्रात्रिकरण को भिे न े के त्रलए ठरयायत करार में कोई त्रवत्रशष ट िण र् हो। 4. कोई अन य कायड िो ऊपर उल त्र लत्रित कायों स े सम बद् हों या उनके पठरणामत: दकए िान े हों अथवा ऊपर (1) से (3) के संबंि में ऐसे अन य कायड, िो केन द्र सरकार द्वारा त्रवत्रशष ट तौर पर सौंपे िाए।ं (iii) कुशलता और काय-ड त्रनष प ािन के मानक त्रनिाठड रत करना- रेल त्रवकास प्रात्रिकरण काय-ड त्रनष प ािन और कुशलता के मानकों को त्रनिाडठरत कर सकता ह।ै रेलवे अत्रित्रनयम के अन त गडत ऐस े मानकों को त्रनयमों के रूप में अत्रिसूत्रचत दकया िाएगा तादक इन ह ें स वीकार करने की बाि य ता हो। इस बारे में रेल त्रवकास प्रात्रिकरण, यात्री तथा फ्रेट िोनों में ग्राहकों की संतुष ठ ट त्रलए कुशलता और काय-ड त्रनष पािन के त्रलए मानकों को त्रनिाडठरत करेगा। रेल त्रवकास प्रात्रिकरण को इसम ें दकसी प्रकार की त्रभन न ता की िांच करने और उपचारात म क उपाय करन े का सुझाव िने े के त्रलए प्रात्रिकृत दकया िाएगा। रेल त्रवकास प्रात्रिकरण कोई ऐस े अन य कायड भी करेगा िो ऊपर उल त्रलत्रित काय ड स े सम ब द् हों या उनके पठरणामत: दकया िाना हों, अथवा त्रिसे केन द्र सरकार द्वारा त्रवत्रशष ट तौर पर सौंपा गया हो। इस प्रात्रिकरण को यह भी अत्रिकार होगा दक वह वांत्रित कुशलता तथा कायड-त्रनष पािन के मानकों को हात्रसल करने के त्रलए नई प्रौद्योत्रगकी को अपनान े का सुझाव प्रिान करे। (iv) सचू ना का प्रसार- यह प्रात्रिकरण, उपभोक ताओं की सहायता करन े और उन ह ें िागरूक बनान े के त्रलए सवोत त म कायड-व य वहार के संबंि में सूचना का प्रसार करने के त्रलए फ्रेमवकड/मागडत्रनिशे ोंका सुझाव िगे ा। इस संबंि में यह प्रात्रिकरण त्रनम न त्रलत्रित कायड करेगा: 1. यह र्ाटा संग्रहक के रूप में कायड करेगा। यह रेल मंत्रालय और अन य ऑपरेटरों से र्ाटा एकत्रत्रत करेगा और समय-समय पर उसे स व ेच िा से प्रसाठरत करेगा। 2. यह त्रवश व में सवोत त म कायड-व य वहारों, बेंचमार्किंग तथा मानकों के बारे में सूचना का प्रसार करेगा तादक उपभोक त ाओं की िागरूकता बढे। 3. त्रवश व मानकों, त्रवश व के सवोत तम काय-ड व य वहार तथा बेंचमार्किंग पर आिाठरत सूचना का प्रसार करने की प्रदक्रया अथवा पद्त्रत की त्रसफाठरश करेगा। 4. ठरयायत्रतयों/रेल ऑपरेटरों सत्रहत सभी अन य स टेकहोल र् रों से उनकी पठरयोिनाओं के संबंि में सूचना एकत्रत्रत करेगा और उसे आम िनता के साथ शेयर करेगा। 5. कोई अन य कायड िो ऊपर उल त्रलत्रित कायों स े सम ब द् हों या उनके पठरणामत: दकए िान े हों अथवा ऊपर (1) से (4) के संबंि में ऐसे अन य कायड, िो केन द्र सरकार द्वारा त्रवत्रशष ट तौर पर सौंपा गया हो। (v) रेल त्रवकास प्रात्रिकरण को ऊपर (i) से (iv) में उल त्रलत्रित कायों का त्रनष प ािन करते समय त्रनम नत्रलत्रित त्रवत्रशष ट कायड करन े का अत्रिकार नहीं होगा:- 1. रेलव े के बारे में एक सेक ट र अथवा इसके दकसी पहलू के संबंि में नीत्रत बनाना; 2. िण र् (4), उप िण र् (i) (1) से (3) के प्राविानों को िोड़कर टैठरफ का त्रनिाडरण करना और वस त ुओं का वगीकरण/पुनवडगीकरण करना;4 THE GAZETTE OF INDIA: EXTRAORDINARY [PART I—SEC. 1] 3. रेल प्रणाली का पठरचालन और अनुरक्षण; 4. ऐसे बेंचमाकों के बारे में सझु ाव िने ा िो त्रनणडय लेन े में मागडिशडक हो सकता, को िोड़कर त्रवत त ीय/व य य प्रबन िन; 5. तकनीकी मानक त्रनिाडठरत करना; 6. संरक्षा मानकों तथा काय-ड व य वहारों का पालन करना; 7. ऐसे काय,ड िो तत स मय लागू दकसी त्रविान के अंतगडत सांत्रवत्रिक रूप से दिया गया हो। (vi) प्रात्रिकरण अपने त्रनर्िषड ट उद्दशे यों और कायों को पूरा करने हते ु मानव संसािन त्रवकास के त्रलए उपाय का सुझाव ि े सकता ह।ै 6. रेल त्रवकास प्रात्रिकरण का त्रवत त पोषण: रेल मंत्रालय अपने बिट में से 50,00,00,000 (पचास करोड़ रुपए) भारतीय रुपए की प्रारंत्रभक संग्रह रात्रश का अंशिान करेगा तादक रेल त्रवकास प्रात्रिकरण कायड शुरू कर सके। रेल त्रवकास प्रात्रिकरण आवेिन शुल क , आर्बटड रेशन शुल क, िुमाडना आदि के रूप म ें अत्रित्रनणडय शुल क के माि य म से िन िटु ा सकता ह ै (त्रिसे भारत की समेदकत त्रनत्रि में िमा दकया िाएगा), िैसा भी रेल त्रवकास प्रात्रिकरण द्वारा प्रारूत्रपत त्रवत्रनयमों म ें व य वस था की िाएगी। बाि में रेल त्रवकास प्रात्रिकरण त्रवत तीय स व तंत्रता सुत्रनश त्रचत करते हुए अपना कायड संचात्रलत कर सके इसके त्रलए रेलव े के बिट में स े वार्षडक अनुिान त्रनिाडठरत दकया िाएगा। 7. रेल त्रवकास प्रात्रिकरण के पास अपने कायों का प्रभावी ढंग से त्रनष पािन करने के त्रलए पयाडप त अत्रिकार होंगे। इस प्रयोिन के त्रलए रेल त्रवकास प्रात्रिकरण अपने त्रलए उपयुक त सहायक कमडचाठरयों, सरकारी पिात्रिकाठरयों तथा त्रवशेषज्ञों की व य वस था करेगा और उसके पास अपने सरकारी कायों के संबंि म ें सरकारी और गैर-सरकारी त्रनकायों से ठरकॉर्,ड नोट, र्ाटा अथवा कोई अन य संगत सामग्री मंगवाने और उनके साथ त्रवचार-त्रवमशड करने की भी शक त्र तयां होंगी। 8. रेल त्रवकास प्रात्रिकरण का मुि य ालय दिल ल ी में होगा और यह रेल त्रवकास प्रात्रिकरण के त्रलए त्रनिाडठरत कायों से संबंत्रित त्रवत्रभन न पहलुओं तथा ऐसे अन य त्रवत्रशष ट मामलों, त्रिनके बारे में समय-समय पर केन द्र सरकार द्वारा मांग की िाए, के संबंि में केन द्र सरकार को समय-समय पर ठरपोटड प्रस तुत करेगा। 9. प्रशासत्रनक तथा अन य आनषु त्रं गक मामल:े - (i) रेल त्रवकास प्रात्रिकरण के अि यक्ष तथा सिस य ों की सेवा शतों से संबंत्रित ऐसे प्रशासत्रनक मामलों, त्रिसके संबंि में कोई स प ष ट प्राविान नहीं दकया गया ह,ै में त्रनणडय लेने के त्रलए प्रत य ेक मामल े को केन द्र सरकार को भेिा िाएगा और उस पर केन द्र सरकार का त्रनणडय रेल त्रवकास प्रात्रिकरण पर बाि य कारी होगा। (ii) रेल त्रवकास प्रात्रिकरण के पठरचालन स े संबंत्रित प्रशासत्रनक मामलों और रेल त्रवकास प्रात्रिकरण के अि यक्ष तथा सिस य ों के अलावा अत्रिकाठरयों तथा कमचड ाठरयों की त्रनयुक त्र त, त्रिनके संबंि में कोई स पष ट प्राविान नहीं दकया गया ह,ै के संबंि में अि यक्ष और सिस य ों की आम सहमत्रत से त्रनणडय दकया िाएगा। आर. के. वमाड, सत्रचव (रेलव े बोर्)डI 5 अनलु ग न क अतं ठरम रेल त्रवकास प्रात्रिकरण के अि य क्ष तथा सिस य ों की त्रनयकु त्र त की त्रनबिं न एव ं शत:ें (क) अि य क्ष की अहतड ाए ं (i) रेल त्रवकास प्रात्रिकरण का अि यक्ष एक ऐसा व य क त्र त होगा त्रिसकी योग य ता तथा सत य त्रनष िा त्रसद् हो और त्रिसके पास रेल उद्योग अथवा त्रवत त अथवा लेिांकन अथवा त्रवत्रि अथवा त्रवत्रनयामक मामलों की त्रवशेष िानकारी और कम स े कम 25 वषड का व य ावसात्रयक अनुभव हो। (ii) ऐसे उम मीिवार िो सरकारी सेवा में ह/ैं रह े ह,ैं को भारत सरकार में सत्रचव के पि पर अथवा केन द्र सरकार/राि य सरकार में इसके समकक्ष पि पर होना चात्रहए/रहा होना चात्रहए और उनके पास संगत अनुभव होना चात्रहए। (iii) अि यक्ष को बासि (62) वष ड से कम आयु का होना चात्रहए। (ि) सिस य ों की अहतड ाए ं (क) सिस य (टैठरफ) (i) रेल त्रवकास प्रात्रिकरण का सिस य (टैठरफ) एक ऐसा व य क त्र त होगा त्रिसकी योग य ता तथा सत य त्रनष िा त्रसद् हो और त्रिसके पास रेल उद्योग अथवा त्रवत त अथवा लेिांकन अथवा त्रवत्रि अथवा त्रवत्रनयामक मामलों की त्रवशेष िानकारी और कम-स-े कम 25 वषड का व य ावसात्रयक अनुभव हो। (ii) ऐसे उम मीिवार िो सरकारी सेवा में ह/ैं रह े ह,ैं को भारत सरकार में सत्रचव/अपर सत्रचव के पि पर अथवा केन द्र सरकार/राि य सरकार म ें इसके समकक्ष पि पर होना चात्रहए/रहा होना चात्रहए और उसके पास संगत अनुभव होना चात्रहए। रेल सके टर में फ्रेट और पैसिें र टैठरफ के त्रनिाडरण/रेटटंग/लागत त्रनिारड ण के अनुभव को तरिीह िी िाएगी। (iii) सिस य (टैठरफ) को साि (60) वषड से कम आयु का होना चात्रहए। (ि) सिस य (पीपीपी) (i) रेल त्रवकास प्रात्रिकरण का सिस य (पीपीपी) एक ऐसा व य क त्रत होगा त्रिसकी योग य ता तथा सत य त्रनष िा त्रसद् हो और त्रिसके पास रेलव े अथवा उद्योग अथवा त्रवत त अथवा लेिांकन अथवा त्रवत्रि अथवा त्रवत्रनयामक मामलों की त्रवशेष िानकारी और कम स े कम 25 वषड का व य ावसात्रयक अनुभव हो। (ii) ऐसे उम मीिवार िो सरकारी सेवा में ह/ैं रह े ह,ैं को भारत सरकार में सत्रचव/अपर सत्रचव के पि पर अथवा केन द्र सरकार/राि य सरकार म ें इसके समकक्ष पि पर होना चात्रहए/रहा होना चात्रहए और उसके पास संगत अनुभव होना चात्रहए, पब त्र लक प्राइवेट पाटडनरत्रशप के मुद्दों को त्रनपटाने के अनुभव को तरिीह िी िाएगी। (iii) सिस य (पीपीपी) को साि (60) वषड से कम आयु का होना चात्रहए। (ग) सिस य (कुशलता, मानक एव ं बचें मार्कडग) (i) रेल त्रवकास प्रात्रिकरण का सिस य (कुशलता, मानक एव ं बेंचमार्किंग) एक ऐसा व य क त्रत होगा त्रिसकी योग य ता तथा सत य त्रनष ि ा त्रसद् हो और त्रिसके पास रेल उद्योग अथवा त्रवत त अथवा लेिांकन अथवा त्रवत्रि अथवा त्रवत्रनयामक मामलों की त्रवशेष िानकारी और कम स े कम 25 वष ड का अनुभव हो।6 THE GAZETTE OF INDIA: EXTRAORDINARY [PART I—SEC. 1] (ii) ऐसे उम मीिवार िो सरकारी सेवा में ह/ैं रह े ह,ैं को भारत सरकार में सत्रचव/अपर सत्रचव के पि पर अथवा केन द्र सरकार/राि य सरकार म ें इसके समकक्ष पि पर होना चात्रहए/रहा होना चात्रहए और उसके पास संगत अनुभव होना चात्रहए, पठरवहन के क्षेत्र के अनुभव को तरिीह िी िाएगी। (iii) सिस य (कुशलता, मानक एव ं बेंचमार्किंग) को साि (60) वषड से कम आयु का होना चात्रहए। (ग) अि य क्ष और सिस य ों के पि की अवत्रि तथा हटाया िाना: अि यक्ष तथा सिस य ों का कायडकाल पांच (5) वषड का होगा। केन द्र सरकार द्वारा त्रनम न त्रलत्रित आिार पर अि य क्ष/सिस यों को हटाया िा सकता ह:ै i. यदि उसे दिवात्रलया घोत्रषत कर दिया िाता ह,ै अथवा ii. अिालत द्वारा उसे दकसी ऐस े अपराि में िोष त्रसद् पाया िाए त्रिसमें नत्रै तक किाचार शात्रमल हो, अथवा iii. वह सिस य अथवा अि यक्ष के रूप में काय ड करने के त्रलए शारीठरक तथा मानत्रसक तौर पर असक्षम हो गया हो, अथवा iv. उसने इस प्रकार स े त्रवत त ीय अथवा अन य त्रहत प्राप त कर त्रलया हो त्रिसमें सिस य /अि यक्ष के रूप में उसका कायड करना प्रत्रतकूल रूप से प्रभाव र्ालता हो, अथवा v. उसने अपनी स त्र थत्रत का गलत फायिा उिाया हो त्रिसमें उसका पि पर बना रहना िनत्रहत के त्रवरूद् हो, अथवा vi. त्रसद् िवु ड य वहार का िोषी हो, अथवा vii. वह दकसी ऐसे रोिगार में लगा हो, त्रिसमें उसे भुगतान प्राप त होता ह।ै (घ) पनु र्नयड ोिन के त्रलए पात्रता अि य क्ष अथवा सिस य अपना पि त यागने के बाि एक वषड का अन तराल होने तक केन द्र सरकार अथवा दकसी ऐस े त्रनकाय/प्रात्रिकरण में पुनर्नडयोिन के त्रलए पात्र नहीं होंग,े त्रिसे केन द्र सरकार द्वारा काफी त्रवत त पोत्रषत दकया िाता हो। इसी प्रकार, पि त य ागने के बाि एक वषड के त्रलए अि य क्ष, अथवा RAILWAYS (RAILWAY BOARD) RESOLUTION New Delhi, the 5th May, 2017 No. 2015/Infra/12/15 Pt.1.—The Government have, with the approval of Cabinet, decided on 5th April 2017 to constitute a Rail Development Authority (“RDA”). The composition and the paras/functions of the RDA shall be as follows:- 1. “RDA” would perform such functions as is being provided in the Order without impinging upon the prevalent legislative framework and/or statutory authority of any entity arising under any of the Statute, or rules and regulations framed there under holding the subject-matter. 2. Objectives of setting a Rail Regulator: An independent Rail Regulator will help to achieve the following objectives: (i) Pricing of services commensurate with costs. (ii)Suggest measures for enhancement of Non Fare Revenue. (iii) Protection of consumer interests, by ensuring quality of service and cost optimization. (iv) Promoting competition, efficiency and economy. (v) Encouraging market development and participation of stakeholders in the rail sector and for ensuring a fair deal to the stakeholders and customers. (vi) Creating positive environment for investment. (vii) Promoting efficient allocation of resources in the sector. (viii) Benchmarking of service standards against international norms and specify and enforce standards with respect to the quality, continuity and reliability of services provided by them. (ix) Providing framework for non-discriminatory open access to the Dedicated Freight Corridor (DFC) infrastructure and others in future. (x) Suggesting measures to absorb new technologies for achieving desired efficiency and performance standards (xi) Suggesting measures for human resource development to achieve any of its stated objectives 3. Composition of “RDA”: It shall consist of a Chairman who shall be responsible for overall functioning of RDA and three Members. Member (Tariff) shall be responsible for function pertaining tariff determination and track access charges. Member (PPP) shall be responsible for dealing with all issues of stakeholders investments including concession agreement and Member (Efficiency, Standards & Benchmarking) shall be responsible for dealing with all issues of setting efficiency, performance standards, benchmarking and information dissemination.8 THE GAZETTE OF INDIA: EXTRAORDINARY [PART I—SEC. 1] 4. Appointment of Chairman and Members - The appointment of the Chairman and three Members will be done by the Central Government from the panel of names recommended by the Search and Selection Committee. The Search and Selection Committee shall comprise of Cabinet Secretary as Chairman, Chairman Railway Board, Secretary, DoPT and Chairman of any Regulatory Body of Central Government nominated by the Cabinet Secretary. The terms and conditions etc., with regard to appointment and service conditions of Chairman and the Members is Annexed . 5. Functions of RDA: RDA will undertake the following functions: (i) Tariff determination functions - RDA, with a view to assist and facilitate the Central Government in this regard, shall perform the following functions: 1. Framing guiding principles/ rules/ models for tariff determination for both freight and passenger segments; 2. Make recommendations on tariff setting including suggesting proposed tariff and revision of tariff; 3. Framing principles for determining classification and reclassification of commodities; 4. Framing principles for subsidy/social service obligations in form of budgetary support or other methods; 5. Lay down guidelines/rules to determine track access charge for providing non-discriminatory access to Dedicated Freight Corridor network and others in future; and 6. Any other function which is incidental or consequential to the abovementioned functions or such other functions regarding (1) to (5) above as specifically assigned by Central Government. (ii) Ensuring fair play and level playing field for stakeholder investment in Railways: RDA shall perform the following functions to ensure level playing field: 1. Propose modifications and send suggestions / Advisory Notes to Ministry of Railways on reference made by Ministry of Railways. 2. Make suggestions regarding policies of Ministry of Railways for infrastructure creation through private investments/PPP and to ensure reasonable safeguards to PPP investors. 3. Dispute resolution regarding future Concession Agreements subject to a specific clause in the Concession Agreement for referring of such disputes to RDA in compliance with the Arbitration and Conciliation Act, 1996 and Amendments thereto including the Arbitration and Conciliation Act, 2015;. 4. Any other function which is incidental or consequential to the abovementioned functions or such other functions regarding (1) to (3) above as specifically assigned by Central Government. (iii) Setting efficiency and performance standard: RDA can define standards of performance and efficiency; such standards would be notified as rules under the Railway Act to give a binding force upon acceptance. RDA in this regard will lay down standards for efficiency and performance forI 9 consumer satisfaction in both passenger and freight. RDA will also be authorized to check for deviations and suggest remedial measures. RDA will undertake any other function which is incidental or consequential to the mentioned function or such other functions as specifically assigned by Central Government. It shall also be the Authority’s mandate to suggest measures for absorbing new technologies for achieving desired efficiency and performance standards. (iv) Dissemination of Information - The Authority will suggest a framework / guidelines for dissemination of information relating to best practices for the assistance and awareness of consumers. In this regard, the Authority will perform the following functions: 1. Act as a data repository. It will collect the data from Ministry of Railways and other operators and voluntarily disseminate the same periodically; 2. Disseminate information on global best practices, benchmarking and standards leading to greater consumer awareness ; 3. Recommend the process or method for dissemination of information based on global standards, global best practices and benchmarking; 4. Collect information from all other stakeholders including the concessionaires/ rail operators pertaining to their projects and share the same with general public ; and 5. Any other function which is incidental or consequential to the abovementioned functions or such other functions regarding (1) to (4) above as specifically assigned by Central Government. (v) RDA shall have below-mentioned specific exclusions while performing the functions listed at point (i) to (iv) above:- 1. Policy making regarding Railways as a sector or any of its facets; 2. Tariff determination and classification/reclassification of commodities save as provided in Clause (4), Sub-Clause (i) (1) to (3); 3. Operations & Maintenance of the Rail system ; 4. Financial/ expenditure management save and except suggesting benchmarks that can guide decision making; 5. Setting of technical standards; 6. Compliance of safety standards and practices; 7. Such functions which are statutorily provided under any of the statutes for the time being in force. (vi) Authority may suggest measures for Human Resource Development to achieve any of its stated objectives and functions. 6. Funding of RDA: Ministry of Railways would contribute an initial corpus of INR 50, 00, 00, 000 (Fifty Crore Rupees) from its budget to enable RDA to start functioning. RDA can raise funds through adjudication fees in the form of application fees, arbitration fee, penalties etc (which will flow to the Consolidated Fund of India ) as may be put in the regulations drafted by RDA. Subsequently10 THE GAZETTE OF INDIA: EXTRAORDINARY [PART I—SEC. 1] an annual grant would be earmarked for RDA from Budget of Ministry of Railways for its continuance and ensuring financial independence. 7. RDA shall have appropriate powers to discharge its functions effectively. For this purpose, RDA shall provide itself with suitable supporting staff, government officials and experts and will have power to call for records, notes, data or any other material relevant to its official functioning from official and non-official bodies and also hold discussion with them. 8. RDA will have its Headquarter in Delhi and shall submit periodical reports to the Central Government on various aspects relating to the functions prescribed for the RDA and on such other specific matters as may be called for by the Central Government from time to time. 9. Administrative and other Residuary matters: (i) Administrative matters relating to conditions of service of the Chairman and the Members of RDA, with respect to which no express provision has been made, shall be referred in each case to the Central Government for its decision and the decision of the Central Government thereon shall be binding on RDA. (ii) Administrative matters relating to the operations of RDA and with regard to appointment of the officers and staff other than the Chairman and the Member of the RDA, with respect to which no express provision has been made, shall be decided by the Chairman and the Members with general consensus. VERMA, Secy.(Railway Board) Annexure TERMS AND CONDITIONS OF APPOINTMENT OF CHAIRMAN AND MEMBERS OF THE INTERIM RAIL DEVELOPMENT AUTHORITY (“RDA”) (A) QUALIFICATIONS OF THE CHAIRMAN (i) The Chairman of RDA shall be a person having proven ability and integrity and should have special knowledge and professional experience of not less than 25 years in either Rail Industry or Finance or Accountancy or Law or Regulatory Affairs. (ii) Candidates who are/ have been in Government service, should have held a post of Secretary to Government of India or equivalent post in the Central Government/ State Government with relevant experience. (iii) The Chairman should be below sixty two (62) years of age. (B) QUALIFICATIONS OF THE MEMBERS (a) Member (Tariff) (i) The Member (Tariff) of RDA shall be a person having proven ability and integrity and should have special knowledge and professional experience of not less than 25 years in rail industry or finance or accountancy or law or regulatory affairs.I 11 (ii) Candidates who are/ have been in Government service, should have held a post of Secretary/ Additional Secretary to Government of India or equivalent post in the Central Government/ State Government with relevant experience preferably in freight and passenger tariff setting/ rating/costing in the rail sector. (iii) The Member (Tariff) should be below sixty (60) years of age. (b) Member (PPP) (i) The Member (PPP) of RDA shall be a person having proven ability and integrity and should have special knowledge and professional experience of not less than 25 years in Railways or industry or finance or accountancy or law or regulatory affairs. (ii) Candidates who are/ have been in Government service, should have held a post of Secretary/ Additional Secretary to Government of India or equivalent post in the Central Government/ State Government with relevant experience preferably in handling Public Private Partnership issues. (iii) The Member (PPP) should be below sixty (60) years of age. (c) Member (Efficiency, Standards & Benchmarking) (i) The Member (Efficiency, Standards & Benchmarking) of RDA shall be a person having proven ability and integrity and should have special knowledge and professional experience of not less than 25 years in rail industry or finance or accountancy or law or regulatory affairs. (ii) Candidates who are/ have been in Government service, should have held a post of Secretary/ Additional Secretary to Government of India or equivalent post in the Central Government/ State Government with relevant experience preferably in transport sector. (iii) The Member (Efficiency, Standards & Benchmarking) should be below sixty (60) years’ of age. (C) TERM OF OFFICE AND REMOVAL OF CHAIRMAN AND MEMBERS: The Chairman and Members will have a tenure of Five (5) years. The Chairman/Members may be removed by the Central Government on following grounds: i. If adjudged insolvent or ii. Convicted by a court of any offence involving moral turpitude or iii. Has become physically and mentally incapable of acting as Member or Chairman or iv. Has acquired such financial or other interest as is likely to affect prejudicially his/ her functioning as Member/Chairman or v. Has abused his position as to render his/her continuance in office prejudicial to the public interest or vi. Has been guilty of proven misbehavior or vii. Has engaged in any other paid employment. (D) ELIGIBILITY FOR RE-EMPLOYMENT: Chairman or a Member would not be eligible for re-employment under the Central Government or anybody/ authority substantially financed by the Central Government unless there is a gap of one year after demitting office. Similarly, for one year after demitting office, Chairman or Member would not12 THE GAZETTE OF INDIA: EXTRAORDINARY [PART I—SEC. 1] be eligible to take up private employment, in the organizations/ conglomerates/ associates that fell within the operational jurisdiction of the RDA. Further, the Chairman or Members will severe all connections from the regulated entities and will also declare particulars of employment and shareholding in regulated entity of the immediate family members i.e. spouse, dependent children or parents. (E) PAY, ALLOWANCES, TRAVEL, ACCOMMODATION,LEAVE AND MEDICAL FACILITIES: The Chairman and Members will be entitled to pay, perks, allowances, travel, leave, medical facilities and accommodation as per the extant notifications of Government of India for similar other regulatory bodies like TRAI, CCI etc. (F) ADMINISTRATIVE AND OTHER RESIDUARY MATTERS Administrative matters relating to the operations of RDA or the conditions of service of the Chairman and Members, with respect to which no express provisions has been made in these instructions, shall be referred in each case to the Central Government for its decision and the decision of the Central Government thereon shall be binding on RDA.
