NOTIFICATION Whereas The draft of the Karnataka Civil Services (Regulation of transfer of Teaching Staff of Department of Collegiate Education) (2nd Amendment) Rules, 2024, was published as required by clause (a) of sub-section (2) of Section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No. ED 240 DCE 2024, dated:28.08.2024 in part IVA of the Karnataka Gazette Extraordinary No. 417 dated:29.08.2024 inviting objections and suggestions from all persons likely to be effected thereby within fifteen days from the date of its publication in the official Gazette. And whereas, the said Gazette was made available to public on 29.08.2024. And whereas the objections and suggestions received in this behalf have been considered by the Government. Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby make the following Rules, namely RULES 1. Title and Commencement - (1) These rules may be called The Karnataka State Civil Services (Regulation of Transfer of Teaching Staff of Department of Collegiate Education) (2nd Amendment) Rules, 2024. (2) They shall come into force from the date of their final publication in the official Gazette. 2. Amendment of rule 4(4)(b):- In the Karnataka State Civil Services (Regulation of Transfer of Teaching Staff of Department of Collegiate Education) Rules, 2021, in rule 4(4)(b) after (b), following shall be inserted namely:- “(C) Notwithstanding anything contained in this rules teachers with Benchmark Disabilities and teachers having husband/wife, children and dependent parents, who are persons with benchmark disability, shall not be transferred unless requested, which shall be considered only after completion of minimum length of service as prescribed in rule 4(1)”R.N.I. Amendment of rule 9(2)(a), (b), (c) and (d): - In the Karnataka State Civil Service (Regulation of Transfer of Teaching Staff of Department of Collegiate Education) Rules, 2021, in rule 9(2)(a), (b), (c) and (d) following shall be omitted. namely: - “and if no such eligible teaching staff is available, then teaching staff who have completed maximum number of years below the minimum length of service for transfer as prescribed in sub-rule (1) of rule 4”.
