KKARNATAAKA ORDINNANCE NOO 16 OF 22020 THE KARRNATAKAA TOWN ANND COUNTTRY PLANNNING (SEECOND AMMENDMENNT) ORDINAANCE, 20220 (Promuulgated byy the Goveernor of Kaarnataka in the seveenty-first yyear of thee Republic oof India annd first puublished inn the Karnnataka Gazzette Extraa-Ordinaryy on 31st day oof July, 20020) An OOrdinancee further to amend tthe Karnattaka Townn and Couuntry Plannning AAct, 1961 (Karnataaka Act 111 of 1963) and for matters cconnectedd therewithh or iincidentall thereto; Wheereas bothh Houses of the staate legislaature are nnot in sesssion and the Governor of Karnattaka is sattisfied thaat the circcumstancees exist whhich rendeer it nnecessaryy for him tto take immmediate aaction to ppromulgatee the Ordiinance forr the ppurposes hereinafteer appearinng; (1)2 Now, therefore, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Karnataka is pleased to promulgate the following Ordinance, namely:- 1. Short title and commencement.- (1) This Ordinance may be called the Karnataka Town and Country Planning (Second Amendment) Ordinance, 2020. (2) It shall come into force at once. 2. Insertion of new section 18-B.- After section 18-A of the Karnataka Town and Country Planning Act, 1961 (Karnataka Act 11 of 1963), the following shall be inserted, namely:- “18-B. Levy of premium charges for grant of Premium Floor Area Ratio.- (1) The Authority may grant permission for premium floor area ratio in the areas identified for the purpose in the Zonal regulations of the master plan. (2) Where an application is made for grant of permission for utilization of premium floor area ratio for the development of a building under section 15, the Authority may levy premium charges, at such rate, not exceeding one third of the estimated increase in value of land and building as may be prescribed by the Government from time to time, for grant of an premium floor area ratio, not exceeding the limits as specified in the zonal regulations of the master plan. Explanation: For the purpose of this section, “premium floor area ratio” means additional floor area ratio permitted over and above the ordinary permissible floor area ratio.” VAJUBHAI VALA GOVERNOR OF KARNATAKA By order and in the name of the Governor of Karnataka, (K. The Karnataka Town and Country Planning (Second Amendment) Ordinance, 2020 ಇದಕೆಕ್ 2020ರ ಜುಲೈ ತಿಂಗಳ 31ನೇ ದಿನಾಂಕದಂದು ರಾಜಯ್ಪಾಲರ ಒಪಿಪ್ಗೆ ದೊರೆತಿದುದ್, ಸಾಮಾನಯ್ ತಿಳುವ(cid:314)ಕೆಗಾಗಿ ಇದನುನ್ 2020ರ ಕನಾರ್ಟಕ ಅಧಾಯ್ದೇಶ ಸಂಖೆಯ್: 16 ಎಂಬುದಾಗಿ ಕನಾರ್ಟಕ ರಾಜಯ್ಪತರ್ದ(cid:313)ಲ್ ಪರ್ಕಟಿಸಬೇಕೆಂದು ಆದೇ(cid:316)ಸಲಾಗಿದೆ. 2020 ರ ಕನಾರ್ಟಕ ಅಧಾಯ್ದೇಶ ಸಂಖೆಯ್ -16 ಕನಾರ್ಟಕ ಪಟಟ್ಣ ಮತುತ್ ಗಾರ್ಮಾಂತರ (cid:372)ೕಜನೆ (ಎರಡನೇ ತಿದುದ್ಪಡಿ) ಅಧಾಯ್ದೇಶ, 2020 (ಭಾರತ ಗಣರಾಜಯ್ದ ಎಪಪ್ತೊತ್ಂದನೇ ವಷರ್ದ(cid:313) ಲ್ ಕನಾರ್ಟಕ ರಾಜಯ್ಪಾಲರಿಂದ ಪರ್ಖಾಯ್ಪಿತವಾಗಿ 2020 ರ ಜುಲೈ 31 ನೇ ದಿನಾಂಕದಂದು ಕನಾರ್ಟಕ ರಾಜಯ್ಪತರ್ದ (cid:315)ಶೇಷ ಸಂಚಿಕೆಯ(cid:313) ಲ್ (cid:363)ದಲು ಪರ್ಕಟವಾಗಿದೆ). ಕನಾರ್ಟಕ ಪಟಟ್ಣ ಮತು ತ್ ಗಾರ್ಮಾಂತರ (cid:372)ೕಜನೆ ಅಧಿನಿಯಮ, 1961 ನುನ್ ಮತತ್ಷುಟ್ ತಿದುದ್ಪಡಿ ಮಾಡಲು ಒಂದು ಅಧಾಯ್ದೇಶ. ರಾಜಯ್ (cid:315)ಧಾನಮಂಡಲದ ಉಭಯ ಸದನಗಳು ಅಧಿವೇಶನದ(cid:313) ಲ್ ಇಲಲ್ದಿರುವುದರಿಂದ ಮತು ತ್ ಇ(cid:313)ಲ್ ಇನುನ್ ಮುಂದೆ ಕಂಡುಬರುವ ಉದೆದ್ೕಶಗ(cid:314)ಗಾಗಿ ಅಧಾಯ್ದೇಶವನುನ್ ಪರ್ಖಾಯ್ಪಿಸಲು, (cid:316)ರ್ೕಘರ್ ಕರ್ಮವನುನ್ ತೆಗೆದುಕೊಳುಳ್ವುದು ಅವಶಯ್ಗೊ(cid:314)ಸುವಂಥ (cid:315)ದಯ್ಮಾನಗಳು ಉಂಟಾಗಿವೆಯೆಂದು ಕನಾರ್ಟಕದ ರಾಜಯ್ಪಾಲರಿಗೆ ಮನದಟಾಟ್ಗಿರುವುದರಿಂದ; ಈಗ, ಭಾರತ ಸಂ(cid:315)ಧಾನದ 213ನೇ ಅನುಚೆಛ್ೕದದ (1)ನೇ ಖಂಡದ ಮೂಲಕ ಪರ್ದತತ್ವಾದ ಅಧಿಕಾರವನುನ್ ಚಲಾಯಿ(cid:318) ಕನಾರ್ಟಕದ ರಾಜಯ್ಪಾಲರು ಈ ಮುಂದಿನ ಅಧಾಯ್ದೇಶವನುನ್ ಪರ್ಖಾಯ್ಪಿ(cid:318)ದಾದ್ರೆ, ಎಂದರೆ: 1. ಸಂ(cid:320)ಪ ತ್ ಹೆಸರು ಮತು ತ್ಪಾರ್ರಂಭ.- (1) ಈ ಅಧಾಯ್ದೇಶವನುನ್ ಕನಾರ್ಟಕ ಪಟಟ್ಣ ಮತು ತ್ ಗಾರ್ಮಾಂತರ (cid:372)ೕಜನೆ (ಎರಡನೇ ತಿದುಪದ್ ಡಿ) ಅಧಾಯ್ದೇಶ, 2020 ಎಂದು ಕರೆಯತಕಕ್ದು.ದ್ (2) ಇದು ಈ ಕೂಡಲೇ ಜಾರಿಗೆ ಬರತಕಕ್ದು.ದ್R.N.I. No. RNP/KA/BGS/2202/2017-19 Licensed to post without prepayment WPP No. 297 4 2. 18-ಬಿ ಹೊಸ ಪರ್ಕರಣದ ಸೇಪರ್ಡೆ.- ಕನಾರ್ಟಕ ಪಟಟ್ಣ ಮತುತ್ ಗಾರ್ಮಾಂತರ (cid:372)ೕಜನೆ ಅಧಿನಿಯಮ, 1961ರ (1963ರ ಕನಾರ್ಟಕ ಅಧಿನಿಯಮ 11) 18-ಎ ಪರ್ಕರಣದ ತರುವಾಯ ಈ ಮುಂದಿನದನುನ್ ಸೇರಿಸತಕಕ್ದುದ್, ಎಂದರೆ:- ʻʻ 18-ಬಿ. ಪಿರ್ೕಮಿಯಮ್ ನೆಲ (cid:315)(cid:318)ತ್ೕಣರ್ ಅನುಪಾತ (premium floor area ratio) ಮಂಜೂರಾತಿಗಾಗಿ ಪಿರ್ೕಮಿಯಮ್ ಚಾಜುರ್ಗಳನುನ್ (cid:315)ಧಿಸುವುದು.- (1) ಪಾರ್ಧಿಕಾರವು ಮಾಸಟ್ರ್ ಪಾಲ್ನ್ನ ವಲಯವಾರು (cid:315)ನಿಯಮಗಳ(cid:313)ಲ್ನ ಉದೆದ್ೕಶಕಾಕ್ಗಿ ಗುರುತಿಸಲಾದ ಪರ್ದೇಶಗಳ(cid:313)ಲ್ ಪಿರ್ೕಮಿಯಮ್ ನೆಲ (cid:315)(cid:318)ತ್ೕಣರ್ ಅನುಪಾತಕಾಕ್ಗಿ ಅನುಮತಿಯನುನ್ ನೀಡಬಹುದು. (2) 15ನೇ ಪರ್ಕರಣದ ಅಡಿಯ(cid:313)ಲ್ ಕಟಟ್ಡದ ಅಭಿವೃದಿಗಧ್ ಾಗಿ ಪಿರ್ೕಮಿಯಮ್ ನೆಲ (cid:315)(cid:318)ತ್ೕಣರ್ ಅನುಪಾತದ ಬಳಕೆಗಾಗಿ ಅನುಮತಿಯನುನ್ ನೀಡುವುದಕಾಕ್ಗಿ ಅಜಿರ್ಯನುನ್ ಸ(cid:313)ಲ್(cid:318)ದ(cid:313),ಲ್ ಪಾರ್ಧಿಕಾರವು, ಮಾಸಟ್ರ್ ಪಾಲ್ನ್ನ ವಲಯವಾರು (cid:315)ನಿಯಮಗಳ(cid:313)ಲ್ ನಿದಿರ್ಷಟ್ಪಡಿ(cid:318)ದ ಮಿತಿಗಳನುನ್ ಮೀರದಂತೆ, ಪಿರ್ೕಮಿಯಮ್ ನೆಲ (cid:315)(cid:318)ತ್ೕಣರ್ ಅನುಪಾತದ ಮಂಜೂರಾತಿಗಾಗಿ, ಕಾಲಕಾಲಕೆಕ್ ಸಕಾರ್ರವು ನಿಯಮಿಸಬಹುದಾದಂತೆ ಭೂಮಿ ಮತು ತ್ ಕಟಟ್ಡದ ಮೌಲಯ್ದ(cid:313) ಲ್ ಅಂದಾಜುಮಾಡಿದ ಹೆಚಚ್ಳದ ಮೂರನೇ ಒಂದನುನ್ ಮೀರದ ಅಂಥ ದರದ(cid:313)ಲ್ ಪಿರ್ೕಮಿಯಮ್ ಚಾಜುರ್ಗಳನುನ್ (cid:315)ಧಿಸಬಹುದು. ʻʻ ʼ ʼ (cid:315)ವರಣೆ: ಈ ಪರ್ಕರಣದ ಉದೆದ್ೕಶಕಾಕ್ಗಿ ಪಿರ್ೕಮಿಯಮ್ ನೆಲ (cid:315)(cid:318)ತ್ೕಣರ್ ಅನುಪಾತ ಎಂದರೆ ಸಾಮಾನಯ್ವಾಗಿ ಅನುಮತಿಸಬಹುದಾದ ನೆಲ (cid:315)(cid:318)ತ್ೕಣರ್ ಅನುಪಾತಕಿಕ್ಂತಲೂ ಮೇಲೆ ಅನುಮತಿ(cid:318)ದ ಹೆಚುಚ್ವರಿ ʼ ʼ ನೆಲ (cid:315)(cid:318)ತ್ೕಣರ್ ಅನುಪಾತ.
