और यतः, ओएमटी रयायत करार क(cid:29) समािe पर (cid:24)ािधकरण .ारा 23.10.2017 को ओएमटी करार का समापन (cid:4)कया गया ।
ओएमटी रयायत करार के समाe होन े के प रणाम/वVप, भारारा(cid:24)ा रयायत करार/तारीख 21.07.2011 क(cid:29) शु(cid:6) क अिधसूचना के
(cid:24)ावधानJ के अनुसार (cid:24)यो8त ा शु(cid:6) क संMहण का काय(cid:23) जारी रखे Pए ह।ै तथािप, इस अिधसूचना के (cid:24)काशन क(cid:29) तारीख से, भारारा(cid:24)ा इस

मािलक अथवा (cid:24)भारी vिO को ऐसे अिधक भार से लदे Pए वाहन को रा(cid:19)ीय राजमाग(cid:23) म2 (cid:24)वेश कराने के िलए शु(cid:6)क संMहण एज2सी को
ऐसी yेणी के यांि%क वाहनJ के िलए लागू शु(cid:6)क के दस गुना के बराबर शु(cid:6)क का भुगतान करना होगा और उसे राजमाग(cid:23) ख@ड का उपयोग
करने क(cid:29) तब तक अनुमित नह{ होगी जब तक (cid:4)क ऐसे यांि%क वाहन से अिधक भार को हटा नह{ (cid:4)दया जाए।
8. यांि%क वाहनJ क(cid:29) yेणी, उनके िलए अनुwेय भार, छूट-(cid:24)ाe वाहनJ क(cid:29) yेणी, सEव(cid:23)स रोड, वैकि(cid:6)पक सड़क आ(cid:4)द सिहत सभी
प रभाषाए ंिनयमJ म2 िविन[द\(cid:23) प रभाषा] के अनुसार हJगी ।
9. उO िनयमJ के िनयम 12 के अनुसार, उपयोगकता(cid:23)] क(cid:29) जानकारी के िलए शु(cid:6)क क(cid:29) दर2 (cid:24)दEश(cid:23)त क(cid:29) जाएंगी ।
10. ऊपर सा रणी-1 म2 यथा - उि(cid:6)लिखत आधार वष(cid:23) 2007-08 के िलए (cid:24)ित (cid:4)कलोमीटर शु(cid:6)क क(cid:29) आधार दर के आधार पर, यांि%क
वाहनJ िलए जाने वाले वा/तिवक शु(cid:6)क और कटौितयJ क(cid:29) गणना (cid:24)ािधकरण .ारा ख@डJ क(cid:29) पूरी कर ली गई लंबाई के आधार पर क(cid:29)
जाएगी और उO िनयमJ के िनयम 5 के अनुसार वाEष(cid:23)क तौर पर संशोधन (cid:4)कया जाएगा तथा उसे तदनुसार, अंMेजी और /थानीय भाषा के
कम-से-कम एक-एक समाचार प% म2 (cid:24)कािशत करवाया जाएगा।
11. प रयोजना क(cid:29) पूंजीगत लागत का वत(cid:23)मान मू(cid:6)य 445.79 करोड़ qपए (मलेरा शु(cid:6)क oलाजा क(cid:29) (cid:24)भावी लंबाई के िलए) +
291.70 करोड़ Vपए (जसवंतगढ़ शु(cid:6)क oलाजा क(cid:29) (cid:24)भावी लंबाई के िलए) = 737.49 qपये (सात सौ सRतीस करोड़ उन(cid:11) चास लाख qपये
मा%) ह।ै (cid:24)ािधकरण .ारा वसूल (cid:4)कए गए (cid:24)योOा शु(cid:6)क के ज रए पूंजीगत लागत क(cid:29) वसूली का रकॉड(cid:23) रखा जाएगा और पूंजीगत लागत
क(cid:29) वसूली हो जान ेके बाद लगाए जाने वाले शु(cid:6)क क(cid:29) दरJ को घटाकर 40% कर (cid:4)दया जाएगा और उO िनयमJ के अनुसार इसम2 वाEष(cid:23)क
तौर पर संशोधन (cid:4)कया जाएगा।

New Delhi, the 29th June, 2018
S.O. 3165(E).—Whereas, vide notification of the Government of India in the Ministry of Road Transport and
Highways number S.O. 465 (E), dated the 26th April, 2002, issued under section 11 of the National Highways
Authority of India Act, 1988 (68 of 1988) (hereinafter referred to as the said Act), the Central Government entrusted the
stretch from km 0.000 to km 114.000 of Pindwara – Udaipur section of National Highway No. 76 in the State of
Rajasthan and from km 246.800 to km 306.000 of Pindwara – Rajasthan/Gujarat Border section of National Highway
No. 14 in the State of Rajasthan to the National Highways Authority of India (hereinafter referred to as the Authority);
And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National
Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules,
2008, vide G.S.R. 838 (E) dated the 5th Dec, 2008, and amended vide GSR 950 (E) Dt 03.12.2010, GSR 15 (E) Dt.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
12.01.2011 and GSR 756 (E) Dt. 12.10.2011, G.S.R 778 (E) dated 16th December,2013, G.S.R 26(E) dated 16th January,

March, 2017 and G.S.R 427(E) dated 07th May, 2018 for collection of fee for use of sections of national highways,
permanent bridges, bypasses and tunnels;
And whereas, in exercise of the powers conferred by Section 14 of the National Highway Act, 1956 (48 of
1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central
Government by notification of the Government of India vide S.O. No. 1681(E) dated 21.07.2011 authorized the
Concessionaire M/s Udaipur Pathways Pvt. Ltd., Mhow, Madhya Pradesh for levying and collecting fee on mechanical
vehicles for the use of the stretch of Swaroopgunj - Pindwara section from km 264.000 to km 248.700 on National
Highway No. 14 and Pindwara – Udaipur section from km 0.000 to km 104.724 on National Highway No. 76 (New NH-
27) in the State of Rajasthan on OMT basis on and from the Date of Commercial Operation declared by the Authority
and till the termination date as specified in the Agreement superseding the Notifications published vide S.O. No. 819 (E)
dated 23.03.2009, S.O. No. 876(E) dated 27.03.2009 and S.O. No. 1181 (E) dated 08.05.2009.
And whereas, the OMT Concession Agreement was terminated on account of expiry of OMT Concession
Agreement by the Authority on 23.10.2017. Consequent upon termination of OMT Concession Agreement, NHAI is
continuing the user fee collection as per provisions in Concession Agreement/Fee Notification dated 21.07.2011.
However, w.e.f. date of publication of this fee notification, NHAI shall collect user fee as per provisions under this fee
notification.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of
1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended
from time to time (hereinafter referred to as the “said Rules”), and in supersession of the notification number S.O. 1681
(E) dated 21.07.2011, except as respects things done or omitted to be done before such supersession, the Central
Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for total equivalent road length
of 99.298 km [excluding 1002 m of structures (having length more than 60m) with equivalent length of 10.020 km] for
use of the four and more lane sections (hereinafter referred to as “base rate”) and at one and one half times the base rate
for bypasses having an aggregate length of 19.449 km (excluding 275 m of structures having length more than 60 m)
costing each Bypass Rupees Ten Crore or more of the stretch from km 264.000 to km 248.700 on National Highway No.
14 and Pindwara – Udaipur section from km 0.000 to km 104.724 on National Highway No. 76 (New NH-27) in the
State of Rajasthan on the Type of Vehicles specified in column (1) of the Table 1 below and authorizes the Authority to
collect, either through its officials or through a contractor, the said fee, namely:-

costing more than Rs. 10 crores at the following Fee Plaza(s) at one and half times of the base rate mentioned in Table-1
above for the length of bypass(es) specified for such Fee Plaza(s):

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes
and resides within a distance of twenty kilometers from the toll plaza is Rs. 255.00 (Rupees Two Hundred Fifty Five
only) for the year 2018-19, and is subject to revision every year as per the provisions of the National Highways Fee

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the
fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road
is available for use of such commercial vehicle.
7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load
specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee
collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled
to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles,
service road, alternative road etc. shall be as per definitions specified in the said Rules.
9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.
10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual
amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the
basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the
same shall be published in at least one newspaper, each in English and vernacular language accordingly.
11. The present value of Capital Cost of the Project is Rs. 445.79 Crore (for influence length of Malera Fee Plaza) +
Rs. 291.70 Crore (for influence length of Jaswantgarh Fee Plaza) = Rs. 737.49 Crore (Rupee Seven Hundred Thirty
Seven crore and Forty Nine lakh only). The Authority shall maintain a record of the recovery of capital cost through user
fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be
revised annually in accordance with the said rules.
