(cid:4)कया जायेगा ।
4. राजमाग(cid:23) ख9ड पर बJया%ाq हते ु पास िनpिलिखत दरA पर जारी (cid:4)कया जाएगा, अथा(cid:23)त्ः
संदये रािश अनुwात एकतरफा या%ाq क(cid:29) िविधमा(cid:11)यता क(cid:29) अविध
अिधकतम सं(या
एकतरफा या%ा के िलए शु(cid:6)क का डेढ़ गुना दो संदाय के समय से चैबीस घंटे
पचास या अिधक एकल या%ाq के िलए संदये शु(cid:6)क पचास संदाय क(cid:29) तारीख से एक मास

5. िजस िजले म1 शु(cid:6)क bलाजा पड़ता ह ै उस िजले म1 पंजीकृत वािणि0यक वाहन (रा(cid:19)ीय परिमट के अधीन चल रहे वाहनA को
छोड़कर) के िलए शु(cid:6)क उस {ेणी के िलए वाहन के िलए िनधा(cid:23) रत शु(cid:6)क का 50% होगा बशत| के ऐसे वािणि0यक वाहनA के उपयोग के
िलए कोई सuवस रोड अथवा वैकि(cid:6)पक सड़क उपलhध न हो ।
6. जो यांि%क वाहन अपनी {ेणी के िलए िनधा(cid:23) रत अनुwेय भार क(cid:29) अपे\ा अिधक भार से लदा Jआ होगा उसके चालक अथवा
मािलक अथवा (cid:24)भारी gिH को ऐसे अिधक भार से लद े Jए वाहन को रा(cid:19)ीय राजमाग(cid:23) म1 (cid:24)वेश कराने के िलए शु(cid:6)क संCहण एज1सी को
ऐसी {ेणी के यांि%क वाहनA के िलए लागू शु(cid:6)क के दस गुना के बराबर शु(cid:6)क का भुगतान करना होगा और उसे राजमाग(cid:23) ख9ड का उपयोग
करने क(cid:29) तब तक अनुमित नह} होगी जब तक (cid:4)क ऐसे यांि%क वाहन से अिधक भार को हटा नह} (cid:4)दया जाए।
7. यांि%क वाहनA क(cid:29) {ेणी, उनके िलए अनुwये भार, छूट-(cid:24)ा~ वाहनA क(cid:29) {ेणी, सuवस रोड, वैकि(cid:6)पक सड़क आ(cid:4)द सिहत सभी
प रभाषाएं िनयमA म1 िविनkदl प रभाषाq के अनुसार हAगी ।
8. उH िनयमA के िनयम 12 के अनुसार, उपयोगकता(cid:23)q क(cid:29) जानकारी के िलए शु(cid:6)क क(cid:29) दर1 (cid:24)दuशत क(cid:29) जाएंगी ।
9. ऊपर सारणी-1 म1 यथा-उि(cid:6)लिखत, आधार वष(cid:23) 2007-08 के िलए (cid:24)ित (cid:4)कलोमीटर शु(cid:6)क क(cid:29) आधार दर के आधार पर, यांि%क
वाहनA से िलए जानेवाले वा]तिवक शु(cid:6)क और कटौितयA क(cid:29) गणना (cid:24)ािधकरण -ारा खंडA क(cid:29) पूरी कर ली गई लLबाई के आधार पर क(cid:29)
जायेगी और उसम1 उH िनयमA के िनयम 5 के अनुसार वाuषक तौर पर संशोधन (cid:4)कया जाएगा तथा उस,े तदनुसार, अंCेजी और ]थानीय
भाषा के कम-से-कम एक-एक समाचार प% म1 (cid:24)कािशत (cid:4)कया जाएगा, परंतु शत(cid:23) यह ह ै(cid:4)क शु(cid:6)क म1 िपछली बार क(cid:29) गई वृि(cid:127) क(cid:29) तारीख से
6 माह क(cid:29) अविध के भीतर कोई संशोधन नह} (cid:4)कया जाएगा ।

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS
NOTIFICATION
New Delhi, the 29th June, 2018
S.O. 3164(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and
Highways number S.O. 78 (E) dated 04.02.1999, issued under Section 11 of the National Highways Authority of India
Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 75.000 to km 395.870 (Vijayawada to
Visakhapatnam Section) of National Highway No. 5 in the State of Andhra Pradesh to the National Highways Authority
of India (hereinafter referred to as the “Authority”);
And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956)
read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central
Government by notification of the Government of India authorized Authority for levying and collecting fee on
mechanical vehicles for the use of stretches as follows:
Vide S.O. No. 1712(E) dated 26th July, 2012 and amended vide S.O. No. 2645 (E) dated 28th September, 2015 &
S.O. No. 3323 (E) dated 09.12.2015 for the section from km 200.000 to km 272.000 (New Chainage km 901.753 to km
830.525) of NH-5 in the State of Andhra Pradesh.
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988
(68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/s
Diwancheruvu Tollway Private Limited having its registered office at 91/92, 9th Floor, 2 North Avenue, Maker Maxity,
BandraKurla Complex, Bandra (E), Mumbai – 400051, (hereinafter referred to as the “Concessionaire”), on 26/04/2018
for the bid submitted on 22/02/2018 for the Tolling, Operation, Maintenance and Transfer (ToT mode) of Annavaram to
Diwancheruvu Section from km 830.525 to km 901.500 (length 70.975 km) of NH-16 (Old NH-5) in the state of Andhra
Pradesh (hereinafter referred to as the said section) of the National Highway;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read
with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 [GSR 838 (E) dt.
05.12.2008] read along with National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2010
[GSR 950(E) 03.12.2010], National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2011
[GSR 15(E) 12.01.2011], National Highways Fee (Determination of Rates and Collection) Second Amendment Rules,
2011 [GSR 756 (E) 12.10.2011], National Highways Fee (Determination of Rates and Collection) Amendment Rules,
2013 [GSR 778(E) 16.12.2013], National Highways Fee (Determination of Rates and Collection) Amendment Rules,

[GSR 248(E) 14.03.2017] and any other amendments till bid due date and in supersession of the Notification Number
S.O. No. 1712(E) dated 26th July, 2012, S.O. No. 2645 (E) dated 28th September, 2015 & S.O. No. 3323 (E) dated
09.12.2015 except as respect things done or omitted to be done before such supersession, the Central Government,
having regard to the expenditure involved in building, maintenance, management and operation of the said Section of
said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said
agreement entered between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected
fees on mechanical vehicles at the rate specified in column (2) of the Table 1 for total equivalent road length of 72.685
km [including 70.785 km road and 190.00 m of structures (having length more than 60m) with equivalent length of 1.90
km] for use of the four and more lane sections (hereinafter referred to as “base rate”) on the Type of Vehicles specified in
column (1) of the Table 1 below and authorizes the said Concessionaire to collect and retain the fee on and from the date
of Commercial Operation (COD) or publication of this Notification in the Official Gazette, whichever is later, till the
termination date as specified in the agreement. This fee notification shall be effective from the Appointed Date of the
ToT project.

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes
and resides within a distance of twenty kilometers from the fee plaza is Rs. 255.00 (Rupees Two Hundred Fifty Five
only) for the year 2018-19 which is subject to revision every year as per the provisions of the National Highways Fee
(Determination of Rates and Collection) Rules, 2008.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely;

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the
fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road

6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load
specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the
toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be
entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service
road, alternative road etc. shall be as per definitions specified in the Rules.
8. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
9. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of
fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of
completed length of the Project Highway. The same shall be got published by the Authority through the Concessionaire
in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with the
rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be
effected within a period of 6 (six) months from the date of the preceding revision of Fee.
