L.-33004/99 सी.जी.-डी.एल.-अ.-13052022-235755 xxxGIDHxxx CG-DL-E-13052022-235755 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 337] नई ददल्ली, िुक्रवार, मई 13, 2022/विै ाख 23, 1944 No. 337] NEW DELHI, FRIDAY, MAY 13, 2022/VAISAKHA 23, 1944 राज्य सभा सजचवालय (ससं द के सदनों की सयं क्तु सजमजत) अजधसचू ना नई ददल्ली, 12 मई, 2022 कुटुंब पिें न (दस्ट्तावजे प्रस्ट्ततु करना) सदं ाय जनयम, 2021 सा.का.जन. 352 (अ).—जनम्न जलजखत जनयम, जो संसद सदस्ट्य वेतन, भत्ता और पेंिन अजधजनयम, 1954 (1954 का 30) की धारा 9 की उपधारा (1) के अधीन गठित संयक्तु सजमजत द्वारा उक्त धारा की उपधारा (3) के खंड (ङङ) और (छ) द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए, केंद्र सरकार स े परामि श करन े के पश्चात ् बनाए गए ह ै तथा राज्य सभा के सभापजत और लोक सभा के अध्यक्ष द्वारा अनुमोददत और पष्टु की गयी ह,ै उस धारा की उपधारा (4) द्वारा यथा अपेजक्षत सवशसाधारण की जानकारी के जलए प्रकाजित की जाती ह:ै- कुटुंब पिें न (दस्ट्तावजे प्रस्ट्ततु करना) सदं ाय जनयम, 2021 1. संजक्षप्त नाम और प्रारम्भ - (1) इन जनयमों का सजं क्षप्त नाम कुटुंब पिें न (दस्ट्तावजे प्रस्ट्ततु करना) सदं ाय जनयम, 2021 ह।ै (2) य े राजपत्र म ें उनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. पठरभाषाए ं– इन जनयमों म,ें जब तक सदं भ श स ेअन्यथा अपजे क्षत न हो,- 3241GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) ''अजधजनयम'' स े संसद सदस्ट्य वते न, भत्ता और पिें न अजधजनयम, 1954 (1954 का 30) अजभप्रेत ह;ै (ख) '' कुटुंब पेंिन'' से अजधजनयम के अंतगशत मृतक सदस्ट्य अथवा पवू श संसद सदस्ट्य के पजत या पत्नी या उसके आजितों को संदेय राजि, यदद दावा की गई ह,ै अजभप्रेत ह;ै (ग) ''धारा'' स े अजधजनयम की धारा अजभप्रेत ह;ै (घ) इन जनयमों म ेंप्रयुक्त िब्द और अजभव्यजक्तया ाँ जजन्ह ें पठरभाजषत नहीं दकया गया ह ैपरंत ु जजन्ह ेंअजधजनयम म ें पठरभाजषत दकया गया ह,ै का अथश क्रमि: अजधजनयम म ेंददए गए अथ श के अनुरूप होगा। 3. वतमश ान सदस्ट्यों द्वारा दस्ट्तावजे प्रस्ट्ततु करना- (1) वतशमान संसद सदस्ट्य संबंजधत सदनों म ें अपना स्ट्थान ग्रहण करन े के तुरंत बाद उनके द्वारा सम्यक रूप स े अनुप्रमाजणत जनम्नजलजखत दस्ट्तावेजों को 8 क ग की उप-धारा (1) के उपबंधो के अनुसार प्रस्ट्तुत करेंगे तादक कुटुंब पेंिन के मामल े म,ें जब कभी आवेदन दकया जाय,े प्रदक्रया को सुगम बनाया जा सके- (क) इन जनयमों म ें उपबंध क के अनसु ार, यथाजस्ट्थजत, पजत या पत्नी अथवा आजितों के चार फोटोग्राफ और चार नमूना हस्ट्ताक्षर या अगं ूिे का जनिान; (ख) कुटुंब के सदस्ट्यों का जववरण, इन जनयमों स े उपबंध ख के अनुसार संलग्न प्रोफामा श म ें ददए जाए ाँ। (2) संसद सदस्ट्य उप-जनयम (1) के खडं (क) म ें जनर्ददष्ट व्यजक्त की पठरजस्ट्थजत म ें दकसी पठरवतनश के बारे म,ें िीघ्र ही लोक सभा या राज्य सभा सजचवालय को सूजचत करेंगे। 4. भतू पवू श ससं द सदस्ट्यों द्वारा दस्ट्तावजे प्रस्ट्ततु करना-(1) भतू पूव श संसद सदस्ट्य पेंिन के जलए आवेदन प्रस्ट्तुत करते समय, पजत या पत्नी अथवा आजित के इन जनयमों के, जो कुटुंब पेंिन के जलए पात्र ह,ैं जब कभी भी आवेदन दकया जाय,े धारा 8 क ग का उप-धारा (2) के उपबधं ों के अनुसार स्ट्वय ं भूतपूव श ससं द सदस्ट्य द्वारा सम्यक रूप म ें अनुप्रमाजणत चार फोटोग्राफ और चार नमूना हस्ट्ताक्षर या अंगूिे का जनिान सजहत इन जनयमों स े उपबंध ख के अनुसार संलग्न प्रोफामा श म ें कुटुंब के सदस्ट्यों और आजितों के ब्योरे प्रस्ट्तुत करें। (2) पिें न के जलए आवेदन उप-जनयम (1)के उपबंधों के अनसु ार चार फोटोग्राफ और चार नमूना हस्ट्ताक्षर या अंगूिे का जनिान इन जनयमों के साथ संलग्न प्रपत्र क म ें प्रस्ट्तुत करेंगे। (3) भूतपूव श संसद सदस्ट्य उप-जनयम (1) म ें जनर्ददष्ट व्यजक्त की पठरजस्ट्थजत म ें दकसी पठरवतशन के बारे म,ें िीघ्र ही लोक सभा सजचवालय या राज्य सभा सजचवालय को सूजचत करेंगे। 5. ससं द सदस्ट्य के पजत या पत्नी द्वारा दस्ट्तावजे प्रस्ट्ततु करना-(1) संसद सदस्ट्य के पजत या पत्नी, कुटुंब पेंिन के जलए आवेदन करते समय उस क्षत्रे के नगरपाजलका प्राजधकारी या स्ट्थानीय पंचायत द्वारा जारी मृत्य ु प्रमाण पत्र के अजतठरक्त जनम्नजलजखत भी प्रस्ट्तुत करेंग े- (क) लोक सभा या राज्य सभा सजचवालय द्वारा जारी भूतपूव श संसद सदस्ट्य का पहचान पत्र (मूल) और यदद मूल पहचान पत्र खो जाता ह ै या नहीं जमलता ह ै या पता नहीं चलता ह,ै तो दावेदार द्वारा भूतपूव श संसद सदस्ट्य के पहचान पत्र के खो जाने के संबंध म ें एक िपथ पत्र प्रस्ट्तुत दकया जाएगा; (ख) वतशमान संसद सदस्ट्य या भूतपवू श संसद सदस्ट्य पर जनभरश ता के कारणों को दिाशन े वाला िपथ पत्र; (ग) प्रथम या जद्वतीय िणे ी मजजस्ट्रेट द्वारा सम्यक रूप म ेंप्रमाजणत क्षजतपूर्तत बांड; तथा (घ) जववाह प्रमाण पत्र और यदद वह उपलब्ध नहीं ह ै तो जनयम 3 का उपजनयम (1) खंड (ख) या जनयम 4 के उप जनयम (1) के अधीन यथा अपेजक्षत वतशमान संसद सदस्ट्य या भूतपूव श संसद सदस्ट्य द्वारा प्रस्ट्ततु जानकारी म ें कोई अंतर की दिा म ें प्रथम या जद्वतीय िणे ी मजजस्ट्रेट द्वारा जारी उत्तराजधकार प्रमाण पत्र।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (2) उपजनयम (1) म ें जनर्ददष्ट कुटुंब पेंिन के जलए आवेदन इन जनयमों के साथ सलं ग्न प्रपत्र ख म ेंप्रस्ट्ततु करेंग े । 6. सदस्ट्य के आजितों द्वारा दस्ट्तावजे प्रस्ट्ततु करना - (1) आजित, कुटुंब पेंिन के जलए आवेदन करत े समय उस क्षत्रे के नगरपाजलका प्राजधकारी या स्ट्थानीय पंचायत द्वारा जारी मृत्य ुप्रमाण पत्र के अजतठरक्त जनम्नजलजखत भी प्रस्ट्ततु करेगा- (क) प्रत्येक वष श के 31 माच श तक का िपथ पत्र दक वह अभी भी एक आजित ह ै जजसके जवफल रहन े पर, उनकी कुटुंब पेंिन बंद कर दी जाएगी या रोक दी जाएगी; (ख) प्रथम या जद्वतीय िणे ी मजजस्ट्रेट द्वारा जारी उत्तराजधकार प्रमाण पत्र; (ग) लोक सभा या राज्य सभा सजचवालय द्वारा जारी भूतपूव श संसद सदस्ट्यों का पहचान पत्र (मलू ) और यदद मूल पहचान पत्र खो जाता ह ै या नहीं जमलता ह ै या पता नहीं चलता ह,ै तो दावेदार द्वारा भूतपूव श संसद सदस्ट्य के पहचान पत्र के खो जाने के संबंध म ें एक िपथ पत्र प्रस्ट्तुत दकया जाएगा; Short title and commencement.—(1) These rules may be called the Payment of Family Pension (Submission of Documents) Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.-In these rules, unless the context otherwise requires,- (a) “Act” means the Salary, Allowances and Pension of Members of Parliament Act, 1954 (30 of 1954); (b) “family pension” means the amount payable, if claimed, to the spouse or dependents of a deceased member or ex-member of Parliament under the Act; (c) “section” means a section of the Act; (d) words and expressions used in these rules and not defined but defined in the Act shall have the meanings, respectively assigned to them in the Act. 3. Submission of documents by sitting members.- (1) Sitting members immediately after taking their seat in the respective Houses of Parliament shall also submit the following documents, duly attested by them, to facilitate expeditious processing of family pension cases, as and when applied for, as per the provisions of sub-section (1) of section 8AC:- (a) four photographs and four specimen signatures or thumb impression of the spouse or dependent, as the case may be, as per the Annexure A to these rules; (b) details of family members may be given in the proforma annexed as Annexure B to these rules. (2) Members shall also intimate immediately the Lok Sabha or Rajya Sabha Secretariat, as the case may be, about any change in the status of the person referred to in clause (a) of sub-rule(1). 4. Submission of documents by ex-members.- (1) Ex-members shall, while submitting application for pension, also submit details of family members and dependents in the proforma annexed as Annexure B to these rules along with four photographs and four specimen signatures or thumb impression, duly attested by ex-member himself or herself, of the spouse or dependent, as the case may be, who may be eligible for family pension, if applied for, as per the provisions of sub-section (2) of section 8AC. (2) The application for pension, four photographs and four specimen signatures or thumb impression referred to in sub-rule (1) shall be submitted in Form A annexed to these rules.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) Ex-members shall also intimate immediately the Lok Sahba Secretariat or Rajya Sabha Secretariat, as the case may be, about any change in the status of the person referred to in sub-rule (1). 5. Submission of documents by spouse of member.- (1) The spouse of member shall, while applying for family pension, in addition to Death Certificate issued by the Municipal Authority or the local Panchayat of the area, also submit:- (a) ex-member’s Identity Card (in original) issued by the Lok Sahba or Rajya Sabha Secretariat, as the case may be, and in case the original Identity Card is lost or not found or untraceable, an affidavit shall be submitted by the claimant regarding loss or misplace of Identity Card of ex- member; (b) affidavit showing reasons for dependency on the sitting member or ex-member; (c) Indemnity Bond duly certified by First or Second Class Magistrate; and (d) the marriage certificate and if the same is not available, succession certificate issued by First or Second Class Magistrate, in case of any variation in the information furnished by the sitting member or ex-member, as required under clause (b) of sub-rule (1) of rule 3 or sub-rule (1) of rule 4. (2) The application for family pension referred to in sub-rule (1) shall be submitted in Form B annexed to these rules. 6. Submission of documents by dependents of member.- (1) Dependent while applying for family pension, in addition to Death Certificate issued by the Municipal Authority or the local Panchayat of the area, shall also submit:- (a) by the 31st March of every year an affidavit that he or she still continues to be a dependent, failing which their family pension shall be discontinued or stopped; (b) Succession Certificate issued by First or Second Class Magistrate; (c) ex-member’s Identity Card (in original) issued by the Lok Sahba or Rajya Sabha Secretariat, as the case may be, and in case the original Identity Card is lost or not found or untraceable, an affidavit shall be submitted by the claimant regarding loss or misplace of Identity Card of ex-member; and (d) Indemnity Bond duly certified by First/Second Class Magistrate.
