GMR Ulundurpet Expressway Private Limited to collect and retain the fee for the development, operation and maintenance of the stretch from km 121.000 to km 192.250 (Tindivanam - Ulundurpet section) of NH-45 in the state of Tamil Nadu to four lane divided carriageway on Build, Operate and Transfer (BOT) basis. Now, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with the National Highways Fee (Collection of fees by any person for user of Section of National Highways/ Permanent Bridge/Temporary bridge on National Highways) Rules, 1997, the Central Government hereby makes the following amendment in the notification published vide S.O. 862(E) dated 26.03.2009. 1. Notes 1. (a) (ii) of the Notification shall be substituted as follows: “Fee at the base rate as shown in column (3) of the above Table, and shall be rounded off to the nearest five rupee;” 2. Following shall be added as Notes 1. (a) (iii): “Length of the project section is 72.900 km and user fee shall be collected at Toll Plaza located at km 148.900 (Old chainge) on NH- 45 (near village Vikiravandi, in Villuppuram district).” 3. Notes 7 of the Notification shall be substituted as follows: “The Concessionaire shall publish substance of this notification and the scheme of discount to frequent and local users, as provided in the Concession Agreement, in two local newspapers (one of which shall be in vernacular language), which shall also state the date of commercial operation as per the provision of this notification, at least ten days prior to the date of commercial operation. Such substance shall also be repeated, ten days prior to giving effect to revised Fee as per this notification.” 4. Following shall be added as Notes 11: “A mechanical vehicle which is loaded in excess of permissible load specified for its category under sub-rule (2) of rule 4 of National Highways fee (Determination of Rates and Collection) Rules, 2008, shall not be permitted to use the National Highway or crossing the toll plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of a mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the national highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicles.” [F.
