## Report on Corrigendum Notification Regarding Anti-Dumping Duty on Glazed/Unglazed Porcelain/Vitrified Tiles from China PR **1. Executive Summary:** This report analyzes a corrigendum notification issued by the Directorate General of Trade Remedies (DGTR), Ministry of Commerce and Industry, regarding the sunset review of anti-dumping duty imposed on imports of glazed/unglazed porcelain/vitrified tiles originating in or exported from China PR. The corrigendum modifies the period of investigation (POI) for the review, shifting it from the applicants' proposed period to a period considered more suitable by the Authority. This change aims to ensure a comprehensive and fair investigation, particularly considering the involvement of small-scale domestic producers. **2. Introduction:** This report aims to provide an overview and analysis of the corrigendum notification (F. No. 7392020DGTR) issued on February 9, 2021, regarding the sunset review of anti-dumping duty on certain tiles imported from China PR. The analysis is based solely on the information provided within the given policy text. **3. Policy Overview:** * This notification is a *corrigendum*, implying it *amends* a previous notification (Notification No. 7392020DGTR dated 22nd January 2021) concerning the initiation of a sunset review of anti-dumping duties. * **Core Objective(s):** To correct the Period of Investigation for the sunset review of anti-dumping duties to ensure a more representative and accurate assessment, especially concerning domestic producers. The inferred overall objective of the Sunset Review, which this change supports, is to determine whether the existing anti-dumping duty should be continued. **4. Background and Rationale:** The notification is a corrigendum, meaning it corrects an error or omission in the original notification. The amendment specifically addresses the Period of Investigation (POI). The likely reason for the amendment is that the Authority (DGTR) found the applicants' proposed POI (1st April 2019 to 31st March 2020) to be less suitable than a modified period (1st April 2019 to 30th September 2020) for conducting a comprehensive sunset review, especially given the involvement of smaller domestic producers. The correction seems designed to ensure the investigation period better aligns with the accounting year of the industry and is more recent. **5. Key Provisions / Changes:** This notification *amends* paragraph 23 of the original notification. * **Original Policy Part Changed:** Paragraph 23 of Notification No. 7392020DGTR dated 22nd January 2021, which defined the Period of Investigation. * **New Rule/Provision:** The amended paragraph 23 now specifies the Period of Investigation (POI) as 1st April 2019 to 30th September 2020. This period is chosen by the Designated Authority based on the criteria specified in the notification. The Injury period is specified as April 2016-March 2017, April 2017-March 2018, April 2018-March 2019 and the POI. * **Difference/Effect of Change:** The applicants proposed POI was 1st April 2019 to 31st March 2020. The Designated Authority has chosen to extend the investigation period to 30th September 2020, encompassing a longer timeframe. This change impacts the data considered for the review and could affect the outcome of the sunset review investigation, potentially leading to different conclusions regarding the need for continued anti-dumping duties. **6. Target Audience and Stakeholders:** The primary target audience includes: * **Domestic producers** of glazed/unglazed porcelain/vitrified tiles in India, particularly small-scale producers. * **Importers and exporters** of these tiles from China PR. * **Consumers** of these tiles in India (indirectly). * Other stakeholders involved in the trade of these tiles. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** The Directorate General of Trade Remedies (DGTR) is the responsible agency, acting as the Designated Authority. * **Timelines/Procedures:** The notification indicates an ongoing sunset review investigation, initiated on January 22, 2021. The change in POI will likely impact the data collection and analysis phases of the investigation. The notification does not specify detailed timelines for the completion of the sunset review but it's an ongoing investigation. * **Implementation of Changes:** The DGTR will need to adjust its data collection and analysis processes to reflect the changed POI. Parties involved in the investigation will need to submit data relevant to the revised period. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome of changing the POI is to: * Provide a more accurate and representative assessment of the need for continued anti-dumping duty. * Better reflect the economic realities of the domestic industry, particularly small-scale producers. * Enhance the fairness and robustness of the sunset review investigation. The potential impact of the change is that the investigation may reveal different trends or data points compared to using the original proposed period, potentially influencing the DGTR's decision on whether to extend, modify, or terminate the anti-dumping duty. **9. Conclusion:** The corrigendum notification represents a critical adjustment to the ongoing sunset review of anti-dumping duties on glazed/unglazed porcelain/vitrified tiles imported from China PR. By modifying the Period of Investigation, the DGTR aims to ensure a more thorough and equitable assessment, particularly considering the interests of domestic producers. This change could have significant implications for the future of trade in these products between China PR and India.
