L.-33004/99 सी.जी.-डी.एल.-अ.-11032024-252841 CG-DxLx-xEG-I1D1H0x3x2x0 24-252841 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 158] नई दिल्ली, सोमवार, माच ड11, 2024/फाल्ग नु 21, 1945 No. 158] NEW DELHI, MONDAY, MARCH 11, 2024/PHALGUNA 21, 1945 रेल मत्रं ालय (रेलव ेबोडड) अजधसचू ना नई दिल्ली, 11 माच,ड 2024 सा.का.जन. 170(अ).—केंद्रीय सरकार, रेल अजधजनयम, 1989 (1989 का 24) की धारा 198 द्वारा प्रित् त िजियों का प्रयोग करते हुए, रेलव े को चाल ू करन े संबंधी (याजत्रयों के सावडिजनक वहन के जलए) जनयम, 2000 का और संिोधन करने के जलए जनम्न जलजखत जनयम बनाती ह, अर्ाडत:्- 1. संजिप्त नाम और प्रारंभ.– (1) इन जनयमों का संजि प्त नाम रेलवे को चाल ू करन े संबंधी (याजत्रयों के सावडिजनक वहन के जलए) संिोधन जनयम, 2024 ह। (2) य ेजनयम रािपत्र म ेंइनके प्रकािन की तारीख को प्रवृत् त होंगे। 2. रेलव े को चाल ू करने संबंधी (याजत्रयों के सावडिजनक वहन के जलए) जनयम, 2000 (जिसे इसमें इसके पश्चात ् उि जनयम कहा गया ह) के अध्याय -VI म,ें जनयम 22क. के पश् चात्, जनम्न जलजखत जनयम अतं :स्ट्र्ाजपत दकया िाएगा, अर्ाडत:्- “22ख. जनयम 3 म ें उप-जनयम (3) के परंतकु की मि (क) स े (ङ) {मि (च) और (छ) स े जभन्न} के अधीन जवजनर्िष्ड ट कायों को चाल ूकरना - 1730 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (1) मिों के जलए: (क) ऊपरी प िल पलु ों और ऊपरी सड़क पलु ों का जनमाडण, पुनर्नडमाणड , उपांतरण और मिबूत करना; (ख) छोटे पलु ों का जनमाडण, पुनर्नडमाणड , पुनः गडडर लगाना और मिबूत करना; (ग) छोटे पलु ों से जभन्न सभी जवद्यमान पलु ों पर पनु : गडडर लगाना और मिबूत करना; (घ) चौकीिार युि क्रॉससंग को हटाना; और (ङ) समपार को अपग्रडे करना और समपारों पर सड़क का पर्ांतरण, िेत्रीय रेलव े का प्रधान मुख्य इंिीजनयर, जबना दकसी पूवड सचू ना के और जनरीिण करके या जबना जनरीिण दकए, यदि उसका समाधान हो िाता ह, यात्री यातायात के जलए उि छोटा जनमाडण काय ड चाल ू करन े की मंिूरी अनुित्त कर सकेगा: परंतु दक इस जनयम के अधीन िेत्रीय रेलव े के प्रधान मुख्य इंिीजनयर द्वारा प्रयोग की िा रही िजि को प्रत्यायोजित नहीं दकया िाना चाजहए: परंत ु यह और दक जनरीिण के जबना चाल ू दकए गए जनमाडण कायों का साधारणत: यर्ासभं व िीघ्र तारीख को जनरीिण दकया िाना चाजहए, िेत्रीय रेलवे के प्रधान मख्ु य इंिीजनयर पश्चात्वती जनरीिण करने की आवश्यकता के जलए अपने जववेक का उपयोग करेगा: परंत ु यह भी दक उि छोटा जनमाडण कायड के चाल ू कराने के प्राजधकार के संबंध म ें िेत्रीय रेलवे के प्रधान मुख्य इंिीजनयर द्वारा संबंजधत रेलवे प्रिासन को जलजखत में संसूजचत दकया िाएगा तर्ा प्रत्येक वर्ड के िौरान ऐसे मंिरू ी प्रिान दकए गये सभी जनमाडण कायों का अजभलेख, यदि बनाया गया ह, जिसके अन्तगतड पूवड या पश्चात्वती जनरीिण की जवजिजियां भी ह, िेत्रीय रेलवे के प्रधान मख्ु य इंिीजनयर द्वारा रखा िाएगा। (2) समपारों के अंतपाडिन संबंधी जनमाडण कायों को चालू करने की मंिूरी अनुित्त करने के जलए, आग ेजबना दकसी और को प्रत् यायोजित दकए, सिम प्राजधकारी, िेत्रीय रेल के प्रधान मख्ु य जसगनल और िरू सचं ार इंिीजनयर होंगे। (3) मिों के जलए: (क) याडड का पुन: प्रजतरूपण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार् िोहरी िरू ी संकेतक प्रणाली की पुर:स्ट्र्ापना करना; (ख) याडड का पुन: प्रजतरूपण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार्, जस्ट्लप साइसडंग और क च साइसडंग वाल े खण्डों के जसवाय, नई मध्यवती खंड संकेतक प्रणाली की पुर:स्ट्र्ापना करना; और (ग) याडड का पुन: प्रजतरूपण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार्, जस्ट्लप साइसडंग और क च साइसडंग वाल ेखण्डों के जसवाय, नई स्ट्वचाजलत खडं संकेतक प्रणाली की पुर:स्ट्र्ापना करना, कायड चालू करन े संबंधी मंिरू ी अनुित्त करन े के जलए, आग े जबना दकसी और को प्रत् यायोजित दकए, सिम प्राजधकारी िेत्रीय रेलव ेके महाप्रबंधक होंग:े परंत ु दक िेत्रीय रेलवे के यर्ाजस्ट्र्जत महाप्रबंधक या प्रधान मुख्य जसगनल और िरू संचार इंिीजनयर, जनरीिण करके या जनरीिण दकए जबना, उसका समाधान हो िाता ह , तो इस जनयम के अधीन, यात्री यातायात के जलए कायों को चालू करन े की स्ट्वीकृजत अनुित्त कर सकेंग े और जनरीिण दकये जबना चालू दकए गए कायों का सामान्यतया यर्ासंभव िीघ्र जनरीिण कर लेना चाजहये ककंतु छोटे दकस्ट्म के कायों के मामले में िेत्रीय रेलवे के यर्ाजस्ट्र्जत[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 महाप्रबंधक या प्रधान मख्ु य जसगनल और िरू संचार इंिीजनयर, अपन े जववेकानुसार पश्चात्वती जनरीिण करन े की आवश्यकता जनधाडररत करेंगे।”; (3) उि जनयमों के अध्याय - VII म,ें जनयम 25क. के उप-जनयम (1) म,ें – (क) मि (ङ) के पश् चात,् जनम्नजलजखत िीघ ड पंजि रखी िाएगी, अर्ाडत्:- “जबना दकसी पूवड सूचना के और जनरीिण करके या जबना जनरीिण दकए, यदि उसका समाधान हो िाता ह, तो यात्री यातायात के जलए उि छोटा जनमाडण कायड चाल ू करन े की मंिरू ी िेत्रीय रेलव े के प्रधान मख्ु य इंिीजनयर अनुित्त कर सकेगा: परंतु दक इस जनयम के अधीन िेत्रीय रेलवे के प्रधान मुख्य इंिीजनयर द्वारा प्रयोग की िा रही िजि को प्रत्यायोजित नहीं दकया िाना चाजहए: परंतु यह और दक जनरीिण के जबना चालू दकए गए जनमाडण कायों का साधारणत: यर्ासंभव िीघ्र जनरीिण दकया िाएगा, िेत्रीय रेलवे के प्रधान मुख्य इंिीजनयर पश्चात्वती जनरीिण करने की आवश्यकता के जलए अपन ेजववेक का उपयोग करेगा: परंतु यह भी दक उि छोटे जनमाडण कायड के चालू कराने के प्राजधकार के संबंध में िेत्रीय रेलवे के प्रधान मुख्य इंिीजनयर द्वारा संबंजधत रेलवे प्रिासन को जलजखत में संसूजचत दकया िाएगा तर्ा प्रत्येक वर्ड के िौरान ऐसे मंिूरी प्रिान दकए गये जनमाडण कायों का अजभलेख िेत्रीय रेलवे के प्रधान मुख्य इंिीजनयर द्वारा रखा िाएगा जिसमें पूवड या पश्चात्वती जनरीिणों की जवजिजियां भी होंगी।”; Short title and commencement.– (1) These rules may be called the Railways (Opening for Public Carriage of Passengers) Amendment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Railways (Opening for Public Carriage of Passengers) Rules, 2000 (herein after referred to as the said rules), in Chapter VI, after rule 22A, the following rule shall be inserted, namely:- “22B. Opening of works specified under items (a) to (e) to proviso {other than items (f) and (g)} of sub- rule (3) of rule 3,- (1) For items,- (a) construction, rebuilding, modification and strengthening of foot-over-bridges and road-over- bridges; (b) construction, rebuilding, regirdering and strengthening of minor bridges; (c) regirdering and strengthening of all existing bridges, other than minor bridges; (d) elimination of manned level crossing; and4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (e) upgradation of level crossing and diversion of roads at level crossings, the Principal Chief Engineer of zonal railway, may without previous notice, sanction the opening of said minor works for passenger traffic, if he is satisfied, either with or without inspection: Provided that the power being exercised by the Principal Chief Engineer of zonal railway under this rule should not be delegated: Provided further that the works so opened without inspection, should ordinarily be inspected at the earliest possible date, the Principal Chief Engineer of zonal railway shall exercise his discretion as to the necessity of carrying out a subsequent inspection: Provided also that the authority for opening said minor works shall be communicated in writing by the Principal Chief Engineer of zonal railway to the concerned railway administration and a record of all works so sanctioned during each year, with particulars of the prior or subsequent inspection, if made, shall be maintained by the Principal Chief Engineer of zonal railway. (2) For interlocking of level crossing, the competent authority to grant sanction to open works shall be the Principal Chief Signal and Telecommunication Engineer of zonal railway, with no further delegation. (3) For items,- (a) introduction of Double Distant Signalling alongwith corresponding changes at adjacent stations without yard remodelling; (b) introduction of new Intermediate Block Signalling, except in section with Slip Siding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodelling; and (c) introduction of new Automatic Block Signalling, except in section with Slip Siding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodeling, the Competent Authority to grant sanction to open works shall be the General Manager of zonal railway, with no further delegation: Provided that the General Manager or Principal Chief Signal and Telecommunication Engineer of the zonal railway, as the case may be, may sanction the opening of works for passenger traffic under this rule, if he is satisfied, either with or without inspection and works so opened without inspection, should ordinarily be inspected at the earliest possible date, but in case of works of a minor types, the General Manager or Principal Chief Signal and Telecommunication Engineer of Zonal Railway, as the case may be, shall exercise his discretion as to the necessity of carrying out a subsequent inspection.”; (3) In chapter VII of the said rules, in rule 25A, in sub-rule (1),– (i) for the longline, occurring after item (e), the following longline shall be substituted, namely:- “the Principal Chief Engineer of zonal railway, may without previous notice, sanction the opening of said minor works for passenger traffic, if he is satisfied, either with or without inspection: Provided that the power being exercised by the Principal Chief Engineer of zonal railway under this rule should not be delegated: Provided further that the works so opened without inspection, should ordinarily be inspected at the earliest possible date, the Principal Chief Engineer of zonal railway shall exercise his discretion as to the necessity of carrying out a subsequent inspection: Provided also that the authority for opening said minor works shall be communicated in writing by the Principal Chief Engineer of zonal railway to the concerned railway administration and a record of all works so sanctioned during each year, with particulars of the prior or subsequent inspection, if made, shall be maintained by the Principal Chief Engineer of zonal railway.”; (ii) the Note shall be omitted.
