और जबदक जनता स ेप्राि आपजियों और सुझागों पर केंद्र सरकार द्वारा जगचार दकया गया ह ै ; अत: अब, ददव्ांगजन अजधकार अजधजनयम, 2016 (2016 का 49) की धारा 100 की उप-धारा (1) और (2) द्वारा प्रदि िजकरणयों का प्रयोग करते हुए, केंद्र सरकार ददव्ांगजन अजधकार जनयमागली, 2017 में आगे और संिोधन करन े के जलए एतदद्वारा जनम्नजलजखत जनयम बनाती ह,ै अथाात्:-

(2) ये आजधकाररक राजपत्र म ेंअपन ेप्रकािन की तारीख से लागू होंगे।

2. ददव्ांगजन अजधकार जनयमागली, 2017 में (इसमें इसके बाद उक्त जनयमागली कहा जाएगा), जनयम 17 हते ु जनम्नजलजखत जनयम प्रजतस्ट्थाजपत दकया जाएगा, अथाात् :- ‘’17. ददव्ागं ता प्रमाण पत्र और यडू ीआईडी काडा के जलए आगदे न - (1) जगजनर्ददष्ट ददव्ांगता ग्रस्ट्त कोई भी व्जकरण ददव्ांगता प्रमाण पत्र / जगजिष्ट ददव यांगता पहचान पत्र (यडू ीआईडी) के जलए प्रपत्र-IV में आगेदन कर सकता ह ै और आगेदन को यडू ीआईडी पोटाल के माध्यम स े जनम्न जलजखत को जमा कर सकता ह:ै क) आगेदन पत्र म ें जनगास के प्रमाण म ें उल्लेख दकए गए अनुसार आगेदक के जनगास के जजल े में ऐसा प्रमाण पत्र जारी करन े के जलए जचदकत्सा प्राजधकारी या दकसी अन्य अजधसूजचत सक्षम जचदकत्सा प्राजधकारी; अथगा (ख) अस्ट्पताल म ें संबंजधत जचदकत्सा प्राजधकारी, जहा ं गह अपनी ददव्ागं ता के संबंध म ें इलाज करा रहा हो या इलाज कराया हो :

बिते दक जहा ं कोई ददव्ागं व्जकरण अगयस्ट्क ह ै या बौजिक ददव्ांगता या दकसी ऐसी अन्य ददव्ांगता स े पीज़ित ह ै जो उस े स्ट्गयं ऐसा आगेदन करने के जलए अनुप् यक्ु त या असमथ ा बनाता ह,ै तो ऐसे मामले म ें उसकी ओर से आगेदन उसके जगजधक अजभभागक द्वारा या इस अजधजनयम के अधीन पंजीकृत दकसी ऐसे संगठन, जजसकी देखरेख में अगयस्ट्क ह,ै द्वारा दकया जा सकता ह।ै

(2) आगेदन के साथ जनम्नजलजखत संलग्न होगा - (क) पहचान प्रमाणपत्र ; (ख) हाल ही का फोटोग्राफ, जो छ: माह स े परु ाना न हो; (ग) जनगास का प्रमाण; और (घ) आधार संख्या या आधार नामांकन संख्या । नोट: यदद पहचान के प्रमाणपत्र के रूप म ें आधार काड ा जमा दकया गया ह,ै और यदद उस आधार काड ा म ें उसी जनगास स्ट्थ ान का पता ह ैतो जनगास स्ट्थ ल के पते के प्रमाण हते ु दकसी भी अजतररकरण दस्ट्तागेज की आगश्यकता नहीं होगी।‘’ उकरण जनयमागली म,ें जनयम 18 हते ु, जनम्नजलजखत जनयम प्रजतस्ट्थाजपत दकया जाएगा, अथाता :्- ‘’18 ददव्ागं ता प्रमाण पत्र/यडू ीआईडी काड ा जारी करना – (1) जनयम 17 के तहत आगेदन प्राि होने पर, जचदकत्सा प्राजधकारी या कोई अन्य अजधसूजचत सक्षम जचदकत्सा प्राजधकारी, आगेदक द्वारा प्रदान की गई जानकारी को सत्याजपत करेगा और केंद्र सरकार द्वारा जारी प्रासंजगक ददिाजनदेिों के संदभा में ददव्ागं ता का आकलन करेगा और स्ट् गयं को संतुष्ट करने के बाद दक आगेदक ददव्ांग व्जकरण ह,ै उसके जलए प्रपत्र V और VI में ददव्ांगता प्रमाण पत्र और प्रपत्र VII में तीन रंगों के कोडेड यूडीआईडी काडा म ें स े एक रंग का काडा, जैसा भी मामला हो, जारी करेगा । ददव्ागं ता की गंभीरता के आधार पर तीन रंगों के काडा म ेंसे दकसी एक रंग का यडू ीआईडी काडा जारी दकया जाएगा :- क. सफेद पट्टी गाला काडा: जब ददवय ांग व यजकरण की ददव्ांगता का प्रजतित चालीस प्रजतित स े कम हो। ख. पीली पट्टी गाला काड:ा जब ददवय ांग व यजकरण की ददव्ांगता का प्रजतित चालीस प्रजतित या उससे अजधक हो ककत ु अस्ट् सी प्रजतित से कम हो। ग. नीली पट्टी गाला काड:ा जब ददवय ागं व यजकरण की ददव्ांगता का प्रजतित अस्ट् सी प्रजतित या उससे अजधक हो।

(2) जचदकत्सा प्राजधकारी दकसी भी ददव्ांगता का जनदान होन े पर तीन महीने के अंदर ददव्ागं ता प्रमाण पत्र और यूडीआईडी काड ाजारी करेगा।.

(3) आगदे क के आगदे न पर दो गर् ा स े अजधक की अगजध होन े पर भी यदद दकसी ऐस े कारण स,े जजस े सबं जंधत जचदकत्स ा प्राजधकारी जनजित न कर सके, जचदकत्सा प्राजधकारी द्वारा कोई जनणाय नहीं जलया जाता है, तो ऐसे आगेदन को जनजष्क्रय कर ददया जाएगा, और उस आगेदक को पोटाल पर नए जसरे से आगेदन करन े या उस लंजबत आगेदन को पुन:

सदक्रय बनाने के जलए जचदकत् सा प्राजधकारी से संपका करन े की आगि् यकता होगी ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3

(4) जचदकत्सा प्राजधकारी, जगजधगत जांच के बाद -

(i) ददव्ांगता की अगस्ट् था में समय के साथ सुधार होन े की कोई संभागना ना होन े के मामले में, स्ट्थायी ददव्ागं ता प्रमाण पत्र/यूडीआईडी काड ाजारी करेगा; अथगा

(ii) ददव्ांगता की अगस्ट्थ ा में समय के साथ सुधार होने की कोई संभागना होने के मामले में, गैधता की अगजध इंजगत करत े हुए ददव्ांगता प्रमाण पत्र / यूडीआईडी काड ाजारी करेगा ।

(5) जगिेर्ज्ञ या जचदकत् सा बोडा, जैसा भी मामला हो, के आकलन के बाद, यदद कोई, आगेदक ददव्ागं ता प्रमाण पत्र/यूडीआईडी काड ा प्राि करन े के जलए पात्र नहीं पाया जाता ह,ै तो जचदकत्सा प्राजधकारी ऐसे अस्ट् गीकरण करन े की तारीख से एक महीने की अगजध के अंदर, ऑनलाइन प् लेटफामा के माध् यम से, प्रपत्र VIII में जलजखत रूप में उसे कारणों सजहत सूजचत करेगा। व यजथत आगेदक आरपीडब् ल् यडू ी अजधजनयम, 2016 की धारा 59 (1) के तहत जनधााररत प्रदक्रया का प्रयोग करते हुए ऐसे अस्ट् गीकरण के नब् ब े ददनों के अंदर अपील दायर कर सकता ह।ै

(6) राज्य सरकार और संघ राज्य क्षेत्र प्रिासन यह सुजनजित करेगा दक ददव्ागं ता प्रमाण पत्र / यडू ीआईडी काड ा केंद्र सरकार द्वारा यथा अजधसूजचत ऑनलाइन प्लेटफॉमा के माध्यम से प्रदान दकया जाए।‘’ [फा.सं. पी-13013/50/2024-यूडीआईडी/आईटी/सांजख्यकी] राजीग िमाा, संयुकरण सजचग नोट:- ददव यागं जन अजधकार जनयमागली, 2017 भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में अजधसूचना संख्या सा.का.जन. 591 (अ.), ददनांक 15 जून, 2017 के माध्यम से प्रकाजित की गई थी और उसे जपछली बार सा.का.जन.

NOTIFICATION New Delhi, the 16th October, 2024 G.S.R. 649(E).—Whereas a draft of certain rules further to amend the Rights of Persons with Disabilities Rules, 2017, were published, as mandated by sub-sections (1) and (2) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016), vide G.S.R. 455(E), dated the 29th July, 2024 in the Official Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (i), inviting objections and suggestions from the public and persons likely to be affected thereby, before exiry of thirty days from date on which the copies of the Official Gazette containing the said notification was made available to the public;

And whereas, the copies of the Official Gazette in which the said notification were made available to the public on 29th July, 2024;

And whereas, the objections and suggestions received from the public were considered by the Central Government;

Now, therefore, in exercise of powers conferred by sub-sections (1) and (2) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016), the Central Government hereby makes the following rules further to amend the Rights of Persons with Disabilities Rules, 2017, namely:-

(1) These rules may be called the Rights of Persons with Disabilities (Amendment) Rules, 2024.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. In the Rights of Persons with Disabilities Rules, 2017 (hereinafter referred to as the said rules), for rule 17 the following rule shall be substituted, namely:- “17. Application for disability certificate and UDID Card.- (1) Any person with specified disability may apply in Form -IV for a disability certificate/ Unique Disability Identity (UDID) Card and submit the application through

UDID Portal to:

(a) a medical authority or any other notified competent medical authority to issue such a certificate in the district of residence of the applicant as mentioned in the proof of residence in the application; or

(b) the concerned medical authority in a hospital where he may be undergoing or may have undergone treatment

in connection with his disability:

Provided that where a person with disability is a minor or suffering from intellectual disability or any other Disability which renders him unfit or unable to make such an application himself, the application on his behalf may be made by his legal guardian or by any organisation registered under the Act having the minor under its care.

(2) The application shall be accompanied by -

(a) proof of identity;

(b) a recent photograph not older than six months;

(c) proof of residence;

(d) aadhaar number or aadhaar enrolment number.

Note: if an Aadhaar Card is submitted as proof of identity, no additional documents will be required for address proof in case Aadhaar has the same residential address” In the said rules, for rule 18, the following rule shall be substituted, namely:- “18 Issue of disability certificate/ UDID Card.- (1) On receipt of an application under rule 17, the medical authority or any other notified competent medical authority shall verify the information as provided by the applicant and shall assess the disability in terms of the relevant guidelines issued by the Central Government and after satisfying himself that the applicant is a person with disability, issue a disability certificate in Form-V and Form-VI and one of the three types of colour-coded UDID card in form VII in his favour , as the case may be. One of the three types of colour- coded UDID Card shall be issued based on the severity of the disability- a. White Band Card: When the disability percentage of a Person with Disability is below forty percent.

b. Yellow Band Card: When the disability percentage of a Person with Disability is forty percent or above but below eighty percent. c. Blue Band Card: When the disability percentage of a Person with Disability is eighty percent or above.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 13

(2) The medical authority shall issue the Disability certificate and UDID card within three months, in case any disability is diagnosed.

(3) In case, due to any reason not attributable to concerned Medical authority, no decision is taken by the Medical authority on the application of the applicant for a period above two years, such application shall be made inactive, and the applicant needs to apply afresh on portal, or approach the medical authority to re-activate the pending application.

(4) The medical authority shall, after due examination-

(i) issue a permanent Disability certificate/UDID card in cases where there are no chances of improvement over time in the degree of disability; or

(ii) issue a certificate of disability/UDID Card indicating the period of validity, in cases where there is any chance of improvement over time in the degree of disability.

(5) If an applicant is found ineligible for issuance of certificate of disability/UDID Card after assessment by Specialist or Medical Board or as the case may be, the medical authority shall convey the reasons to him in Form-VIII through online platform within a period of one month from the date of such rejection. The aggrieved applicant may file appeal within ninety days of such rejection, using the mechanism prescribed under Section-59 (1) of the Rights of Persons with Disabilities Act, 2016.
