ii. राज्र् सरकार के कार्माक जवभाग के अजतररि मख्ु र् सजचव र्ा प्रधान सजचव र्ा प्रभारी सजचव - सिस्ट्र्, iii. पर्ाावरण, वन एव ं िलवार्ु पररवतान मंत्रालर् में केन्द्रीर् सरकार का एक प्रजतजनजध, िो भारत सरकार के जनिेिक के पि स े अन्द्र्नू पि धाररत करता हो - सिस्ट्र् iv. राज्र् सरकार द्वारा नाजमत पर्ाावरण के िेत्र के एक जविेषज्ञ- सिस्ट्र्; v. राज्र् सरकार के पर्ाावरण जवभाग के अजतररि मुख्र् सजचव र्ा प्रमुख सजचव र्ा प्रभारी सजचव- सिस्ट्र् सजचव। (2) सजमजत में दकसी ररजि र्ा अनुपजस्ट्थजत के कारण अध्र्ि का चर्न अवैध नहीं होगा। (3) राज्र् सरकार, मृत्र्ु, त्र्ागपत्र र्ा पिच्र्ुजत के कारण दकसी ररजि की तारीख से एक माह के भीतर; तथा दकसी प्रत्र्ाजित ररजि से छह माह पूवा, पि को भरने के जलए चर्न सजमजत को संिर्भता करेगी। (4) चर्न सजमजत अपनी जसफाररिें करने के जलए अपनी प्रदिर्ा अवधाररत करेगी। (5) चर्न सजमजत इसकी जसफाररिें करेगी तथा राज्र् सरकार को वणाानुिम में तीन उपर्ुि व्यजिर्ों का पैनल प्रस्ट्तुत करेगी। (6) चर्न सजमजत अजधजनर्म की धारा 4 में जवजनर्िाष्ट जविेष ज्ञान र्ा व्यावहाररक अनुभव रखने वाले अभ्र्र्थार्ों से आवेिन आमंजत्रत करने के पश्चात कम से कम तीन राष्ट्रीर् समाचार पत्रों में, जिनमें से एक स्ट्थानीर् भाषा म ें होगा, प्रकाजित मुि जवज्ञापन के माध्र्म से सजमजत को संिभा भेिे िान े की तारीख से तीन माह के भीतर अध्र्ि के चर्न के जलए तीन र्ा अजधक व्यजिर्ों के पैनल की जसफाररि करेगी। (7) राज्र् सरकार चर्न सजमजत द्वारा अनुिंजसत व्यजिर्ों के पैनल में से अध्र्ि का मनोनर्न कर सकेगी। (8) दकसी व्यजि को अध्र्ि के रूप में जनर्ुि करने की जसफाररि करने से पहले चर्न सजमजत स्ट्वर्ं संतुष्ट होगी दक ऐस े व्यजि का कोई जवत्तीर् र्ा अन्द्र् जहत नहीं है, जिसस े अध्र्ि के रूप में उसके कार्ों पर प्रजतकूल प्रभाव काररत होन े की संभावना हो। (9) इन जनर्मों के प्रवृत्त होन े की तारीख को अध्र्ि का पि धाररत करन े वाला कोई भी व्यजि अपन े कार्ाकाल की समाजप्त तक अपने पि पर बना रहगे ा। 3A. चर्न सजमजत पर्ाावरणीर् संरिण स े सम्बजन्द्धत जवषर्ों की बाबत जविेष िानकारी र्ा व्यावहाररक अनुभव रखने वाले व्यजि अथवा पूवोि जवषर्ों से संबंजधत संस्ट्थाओं के प्रिासन की िानकारी और अनुभव रखने वाल े व्यजि पर जवचार करेगी, और तिनसु ार राज्र् सरकार को जसफाररि करेगी। 4. वते न और भत्त:े अध्र्ि सातवें केन्द्रीर् वेतन आर्ोग के वेतनमान में स्ट्तर-17 में वेतन पाने वाले समूह 'क' पि के केन्द्रीर् सरकार के अजधकारी को दिए िाने वाले समान वेतन और अन्द्र् भत्ते प्राप्त करने हते ु पात्र होगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 5. सवे ा के अन्द्र् जनबधं न और िते.-(1) अध्र्ि ऐसा व्यजि होगा, जिसका ऐसा कोई जवत्तीर् र्ा अन्द्र् जहत नहीं होगा, जिससे राज्र् बोडा के अध्र्ि के रूप में उसके कृत्र्ों पर प्रजतकूल प्रभाव पड़ने की संभावना हो; (2) र्दि कोई व्यजि अध्र्ि के रूप म ें केन्द्रीर् सरकार र्ा राज्र् सरकार के अधीन सेवा स े सेवाजनवृत्त हुआ ह ै और वह पेंिन प्राप्त करता ह,ै र्दि लागू हो, तो अध्र्ि के रूप में उसके वेतन में से उसके द्वारा प्राप्त पेंिन की सकल राजि घटा िी िाएगी। (3) अध्र्ि, िो र्दि उस पि को अवधाररत न करे, वह उस तारीख स े िो वषा की अवजध के जलए केन्द्रीर् सरकार र्ा दकसी राज्र् सरकार के अधीन जनर्ोिन के जलए अपात्र हो िाएगा, जिस तारीख से वह उस पि को अवधाररत न करता हो। (4) अध्र्ि, उस तारीख से िो वषा की अवजध के जलए, जिस तारीख से वह उस पि को अवधाररत न करता हो, िैिजणक िेत्र को छोड़कर, कोई भी रोिगार स्ट्वीकार नहीं करेगा। (5) र्दि अध्र्ि बीमारी, अवकाि र्ा ऐसे अन्द्र् कारणों से अस्ट्थार्ी रूप स े अपने कताव्यों का पालन करन े में असमथा ह,ै तो राज्र् सरकार अजधजनर्म की धारा 4 की उप-धारा (2) के खंड (ख) के अधीन नाजमत दकसी सिस्ट्र् को अध्र्ि का कार्ाभार सौंप सकेगी। (6) अध्र्ि की सेवा की अन्द्र् िते, जिनके संबंध में इन जनर्मों में कोई स्ट्पष्ट उपबंध नहीं दकर्ा गर्ा है, वे होंगी िो सातवें केन्द्रीर् वेतन आर्ोग के वेतन मान में स्ट्तर-17 में वेतन पाने वाले समूह 'क' पि को धारण करने वाले केन्द्रीर् सरकार के अजधकारी को अनमु ेर् ह।ैं 6. जनरहरा ता- कोई भी व्यजि,- (क) जिसने ऐस े व्यजि से जववाह दकर्ा है, जिसका पजत र्ा पत्नी िीजवत है, र्ा (ख) जिसने अपन े पजत र्ा पत्नी के िीजवत रहत े हुए दकसी व्यजि स े जववाह दकर्ा है, उि पि पर जनर्ुजि के जलए पात्र नहीं होगा: परन्द्तु र्दि राज्र् सरकार का समाधान हो िाता ह ै दक ऐसा जववाह ऐसे व्यजि और जववाह के िसू रे पिकार पर लागू स्ट्वीर् जवजध के अधीन अनुमेर् ह ै और ऐसा करन े के जलए अन्द्र् आधार ह ैं तो वह दकसी व्यजि को इस जनर्म के प्रवतान स े छूट िे सकेगी। 7. अध्र्ि का कार्का ाल. (1) अध्र्ि, अपने पिभार ग्रहण करने की तारीख से तीन वषा से अनजधक अवजध र्ा पैंसि वषा की आर्ु प्राप्त करने तक, िो भी पहले हो, पि पर बने रहगें े। (2) अध्र्ि के रूप में नाजमत कोई भी व्यजि, इन जनर्मों के अनुसार, पैंसि वषा की अजधकतम आर्ु के अधीन, एक और कार्ाकाल के जलए अध्र्ि के रूप में नाजमत होने के जलए पात्र होगा। 8. अध्र्ि की पिच्र्जु त:-(1) राज्र् सरकार, अध्र्ि को किाचार र्ा अिमता के जनम्नजलजखत आधारों पर पि स े हटा सकती ह,ै र्दि- क) दिवाजलर्ा घोजषत दकर्ा गर्ा हो; र्ा ख) दकसी ऐसे अपराध के जलए िोषजसद्ध दकर्ा गर्ा हो, िो राज्र् सरकार की रार् म ें नैजतक अधमता स े संबंजधत हो; र्ा ग) अध्र्ि के रूप म ेंकार्ा करने म ेंिारीररक र्ा मानजसक रूप से अिम हो गर्ा हो; र्ा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] घ) उसने ऐसा जवत्तीर् र्ा अन्द्र् जहत अर्िात कर जलर्ा हो, जिससे अध्र्ि के रूप में उसके कार्ों पर प्रजतकूल प्रभाव काररत होने की संभावना हो; र्ा ङ) अपन ेपि का इस प्रकार िरुु पर्ोग दकर्ा हो दक उसका पि पर बने रहना लोकिजृ ष्ट से जवघातक ह ै (2) अध्र्ि को उप-जनर्म (1) के खंड (ख) स े (ङ) के अधीन तब तक नहीं हटार्ा िाएगा, िब तक दक उस े मामल े में सुनवाई का सम्र्क अवसर न दिर्ा गर्ा हो। 9. अजधजनर्म और इन जनर्मों के प्रावधानों के अधीन, केंर सरकार इन जनर्मों के सुचारू कार्ाान्द्वर्न के जलए मानक संचालन प्रदिर्ाएं िारी कर सकती ह,ै र्दि आवश्र्क हो। [फा. सं. क्र्ू-15012/2/2022-सीपीडब्ल्र्/ू ई-179314] वेि प्रकाि जमश्रा,संर्ुि सजचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 25th November, 2024 G.S.R.727(E).–– In exercise of the powers conferred by sub-section (2) of section 4 and sub- section (9) of section 5, read with clause (aa) of sub-section (2) of section 63 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), the Central Government after consultations with the Central Pollution Control Board, hereby makes the following rules, namely:- 1. Short title and commencement. (1) These rules may be called the State Pollution Control Board (Manner of Nomination and other Terms and Conditions of Service of Chairman) Rules, 2024. (2) They shall come into force on the date of their publications in the Official Gazette. 2. Definitions. (1) In these rules unless the context otherwise requires,- (a) "Act" means the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974); (b) "Chairman" means the Chairman of the State Pollution Control Board; (c) "Selection Committee" means the Search-cum-Selection Committee; (c) "State Board" means the State Pollution Control Board constituted under section 4 of the Act. (2) The words and expressions used and not defined in these rules but defined in the Act made thereunder, shall have the same meanings respectively assigned to them in the Act. 3. Manner of nomination of Chairman.-(1)The nomination of the Chairman shall be made by the State Government on the recommendations of a Selection Committee consisting of the following members, namely:- (i) Chief Secretary of the State Government -- Chairperson; (ii) Additional Chief Secretary or the Principal Secretary or the Secretary in charge of the Department of Personnel of the State Government-- Member, (iii) a representative of the Central Government in the Ministry of Environment, Forest and Climate Change not below the rank of Director to the Government of India-Member (iv) an expert in the field of environment to be nominated by the State Government - Member; (v) Additional Chief Secretary or the Principal Secretary or the Secretary in charge of the Department of Environment of the State Government - Member Secretary. (2) No selection of Chairman shall be invalid merely by reason of any vacancy or absence in the committee.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (3) The State Government shall, within one month from the date of occurrence of any vacancy by reason of death, resignation or removal; and six months before any anticipated vacancy, make a reference to the Selection Committee for filling up of the post. (4) The Selection Committee shall determine its procedure for making its recommendations. (5) The Selection Committee shall make its recommendations and submit a panel of three suitable persons in alphabetical order to the State Government. (6) The Selection Committee shall after inviting the applications from the candidates having special knowledge or practical experience as specified in section 4 of the Act through open advertisement published in at least three national newspapers, one of which shall be in Vernacular language, recommend a panel of three or more persons for selection of the Chairman, within three months from the date on which the reference is made to the Committee. (7) The State Government may nominate the Chairman from amongst the panel of persons recommended by the Selection Committee. (8) Before recommending any person for appointment as a Chairman, the Selection Committee shall satisfy itself that such person does not have any financial or other interests, which is likely to affect prejudicially his functions as a Chairman. (9) Any person holding the office of the Chairman on the date of commencement of these rules shall continue to hold such office till expiry of his term. 3A. The Selection Committee will consider the candidates having special knowledge or practical experience in respect of matters relating to environmental protection or a person having knowledge and experience in administering institutions dealing with the matters aforesaid, and make recommendation to the state Government accordingly. 4. Pay and allowances: The Chairman shall be entitled to receive a pay and other allowances as admissible to a Central Government officer holding a Group 'A' post carrying Pay in Level-17 in the pay matrix of the Seventh Central Pay Commission. 5. Other terms and conditions of service.-(1) The Chairman shall be a person who shall not have any financial or other interests as are likely to affect prejudicially his functions as Chairman of the State Board; (2) In case of a person as a Chairman, who retired from service under the Central Government or the State Government and he receives pension, if applicable, his pay as Chairman shall be reduced by gross amount of pension received by him. (3) The Chairman ceasing to hold that office shall be ineligible for employment under the Central Government or any State Government for a period of two years from the date he ceases to hold such office. (4) The Chairman shall not, for a period of two years from the date on which he ceases to hold office, accept any employment, except in the field of academics. (5) If the Chairman is not able to perform his duties temporarily due to illness, leave or such other causes, the State Government may assign the charge of Chairman to any member nominated under clause (b) of sub- section (2) of section 4 of the Act. (6) The other conditions of service of a chairman with respect to which no express provision has been made in these rules, shall be such as are admissible to a Central Government officer holding a Group 'A' post carrying Pay in Level-17 in the pay matrix of the Seventh Central Pay Commission. 6. Disqualification.- No person,- (a) who has entered into or contracted a marriage with a person having a spouse living, or (b) having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post: Provided that the State Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 7. Tenure of Chairman. (1) The Chairman shall hold office for a term not exceeding three years from the date on which he enters upon office or until he attains the age of sixty-five years, whichever is earlier.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) Any person nominated as Chairman shall be eligible for nomination as Chairman for another term in accordance with these rules, subject to maximum age of sixty-five years. 8. Removal of Chairman:-(1) The State Government may, remove from office the Chairman on the following grounds of misconduct or incapacity, who- (a) has been adjudged as an insolvent; or (b) has been convicted of an offence which, in the opinion of the State Government, involves moral turpitude; or (c) has become physically or mentally incapable of acting as the chairman; or (d) has acquired such financial or other interest as is likely to affect prejudicially his functions as the chairman; or (e) has so abused his position as to render his continuance in office prejudicial to the public (2) The Chairman shall not be removed under clauses (b) to (e) of sub-rule (1), unless he has been given a reasonable opportunity of being heard in the matter. 9. Subject to provisions of the Act and these rules, the Central Government may issue Standard Operating Procedures for smooth implementation of these rules, if required. [F.
